Taylor and Members of City Council The retired city employees request that you give financial consideration to us in your 1987-88 budget. The new tax on food and gasoline that has been imposed upon all of us has really hurt alot of the retirees. We were having a difficult time making ends meet before and this has really compounded our problem. Our supplemental health insurance that we must carry, since medicare does not come close to taking care of our doctor and hospital expenses, has really escalated and in my case 29%. I understand that some have a much higher rate. You can imagine what this has done to our budget. Also, the retirees request that serious consideration be given to incorporating any increase in our reqular monthly pension. A one-time lump sum is great for one month, but for the next eleven months we will be worse off than before. We realize that this is an additional work load for your staff. But we feel that alot is at stake for us. I can assure you that any help that you and your staff can give us will be greatly appreciated. Thank you for your kind attention and for giving us the opportunity to speak to you. You have not failed us in the past and we pray that you will not in the future. Back~round on this subject is: Wilkins Construction Company, Inc. submitted a base bid in the amount of $403~358.00 for Walnut Avenue Bridge, S.E. over N&W Railway Deck Rehabilitation, which was accepted by City Council in Ordinance No. 28083 at a regular meeting held on April 7, 1986. B. Project includes: 1. Contract amount of $495,033.00 (base bid plus alternates and change order No. 1). 2. Time limit of 225 consecutive calendar days (contract time plus Change Order No. 1). Walnut Avenue Brid~e, S.E. over N&W Railway has been experiencing deck deterioration due to the penetration of water through the deck joints. The deck, which has been resurfaced several times since its 1927 construction date, is being rehabilitated in order to lighten the dead load on the structure, improve the bridge's riding surface, and extend the life of the bridge. The estimated remaining bridge life is now eight years. Following the comple- tion of all necessary repairs, the estimated remaining bridge life will be 40 to 50 years, with only normal, regular maintenance expected to be needed. Deck deterioration of this bridge was studied by Hayes, Seay, Mattern and Mattern in 1984 to determine the extent to which deck rehabilitation is needed as a result of water penetratlon. The study included obtaining seventy-two (72) test cut samples from the bridge deck which were submitted for laboratory analysis. The results of the analysis indicated that deck rehabilitation was necessary on the structural deck areas at the bridge piers. Areas of the structural deck between each pier were believed to need only a minor amount of rehabilitation. The structural deck needed to be completely exposed (by removing the several bituminous and concrete overlays that have occurred since 1927) in order to make these necessary repairs. Page 2 II. Current situation of the subject is: Structural deck of this bridge has been completely exposed by the contractor. The exposed deck was examined by Hayes, Seay, Mattern and Mattern, which resulted in Change Order No. 1, which included an additional 515 square yards of rehabilitation, which was an estimated quantity. As construction proceeded, it was found that an additional 107 square yards of this rehabilitation was needed. Of this amount: 45 square yards are needed to correct a joint alignment problem that exists in the sidewalk area. This problem was created several years ago when the bridge sidewalk was overlayed with new concrete, the joints of which were not aligned with existing bridge joints. This problem was not detected until deck sections were removed as part of this contract, and is not something that could have been readily detected during the engineering design of this bridge rehabi- litation project. 2. 62 square yards are needed in addition to the previously estimated 515 square yards, for proper deck rehabilitation. At $125.00 per square yard, this is an additional $13~375.00. Latex concrete overlay that will be placed as the final riding surface is now estimated to require 30% (363 cubic yards) more material. Close examination of the exposed deck reveals some high and low spots which, when supplemented by the knowledge gained from placing a similar overlay on Wasena Bridge, supports the need for the additional latex concrete material. At $750.00 per cubic yard, this is an additional $27,225.00. Spalled areas on piers require an additional 73 square feet of patching to cover exposed reinforcing steel. At $84.00 per square foot, this is an additional $6,132.00. quantities developed during the engineering and design of the pro- ject were based upon the 72 test-cut samples noted in part I.C. above. In order to have correctly estimated the quantities found, considerably more test-cuts would have been needed. This may have provided a better idea of quantities of repair work needed, but would have involved a higher Engineering fee, with the same quan- tities of repair work having been found in any event. Page 3 Funding in the amount of $46~732.00 is available from the Public Improvement Bond - Series 1985 - Streets and Bridges Account No. 008 052 9577 9181 and from the project contingency to provide the subject work for Change Order No. 2. Fe Contract would increase to $541,765.00 by virtue of Change Order No. 2 in the amount of $46,732.00. The same unit prices used in the original low bid would also be used in this change order. An additional five (5) calendar days would also be added to the 225 calendar days for this contract, resulting in a total 230 calendar-day contract. III. Issues in order of importance are: A. Necessity and justification of additional work. B. Funding availability. C. Timing requirements. IV. Alternatives in order of recommendation are: Ae Authorize the City Manager to execute Change Order No. 2 in the amount of $46~732.00, and an extension of time in the amount of five (5) consecutive calendar days. Necessity and justification of additional work exists. Addition of these necessary repairs to the structural deck will provide the new 40-50 year bridge life that is desired. 2. Fundin~ availability: a) In the amount of $36~732.00 is from the Public Improvement Bond - Series 1985 - Streets and Bridges Account No. 008 052 9577 9181. b) In the amount of $10~000.00 is from the project con- tingency. 3. Timing requirements would be acceptable. Page 4 Do not authorize the City Manager to execute Change Order No. 2 in the amount of $46~732.00, and an extension of time in the amount of five (5) consecutive calendar days. Necessity and justification of additional work would continue to exist. Extension of bridge life would not be maximized. Additional costly deck rehabilitation work would likely be needed again in the near future, resulting in further disrup- tion of traffic. 2. Funding availability would be saved for other future bridge projects. 3. Timing requirements would not be an issue. V. Recommendation is that City Council approve Alternative "A" by taking the following actions: A. Authorize the City Manager to execute Change Order No. 2 in the amount of $46~732.00. B. Time limit of contract to be extended by five (5) consecutive calendar days. C. Transfer: 1) $36,732.00 from the Public Improvement Bond - Series 1985 - Streets and Bridges Account No. 008 052 9577 9181 into the existing Walnut Avenue Bridge Deck Repair Account No. 008 052 9529 9001. 2) $10~000.00 from the project contingency into the existing Walnut Avenue Bridge Deck Repair Account (this leaves a $10~000.00 contingency for the remainder of the project). AN ORDINANCE providing for the City's gift to Virginia Mountain Housing of certain houses located on Shadeland Avenue, N. W., upon certain terms and conditions. that: 1. BE IT ORDAINED by the Council of the City of Roanoke The City hereby agrees to give and convey to Virginia Mountain Housing (hereinafter referred to as VMH) certain houses located on Shadeland Avenue, N. W., now owned or hereafter to be acquired by the City, subject to the terms and conditions of this ordinance. 2. Within ten days of the effective date of this ordinance or of the City's acquisition of the property, whichever is later, VMH shall indicate its desire to acquire any of the houses owned by the City on Shadeland Avenue by delivering to the City Manager a written request for such houses. The City Manager shall, within five days of the receipt of the VHM's written request for a house, respond in writing to VMH concerning the availability of such house. The City Manager's letter shall be deemed delivered at the time it is mailed by first class mail to VMH at 400 Draper Road, Blacksburg, Virginia. The City Manager's decision with regard to the availability of any house shall be final and binding. If the City Manager determines that, for any reason, a house is not available for transfer to VMH, VMH shall have no further right, title or interest in such house. 3. Transfer of ownership of each house to VMkI shall occur when the City Manager mails notice to VMH that the house is available to VM}I, and risk of lose with respect to such house shall pass to VMH at that time. 4. VMH shall provide public liability insurance to provide coverage for the activities authorized by the ordinance. The City shall be named as an additional insured on such policy of insurance. Such insurance shall continue in effect until each house owned by VMH is removed and relocated by VM}I. Failure of VMH to provide such insurance shall, at the option of the City Manager, result in reversion to the City of ownership of such houses which have not been removed from Shadeland Avenue. 5. Each house shall be conveyed to VM}I in "as is" condition with no expressed or implied warranties. 6. VMH shall remove each house which it acquires from the City as expeditiously as possible, consistent with the intent of the overall relocation project. Any house which is not removed within sixty days of VMH's request to the option of the City Manager, revert shall have no further right, title or take such house shall, at to City ownership, and VMH interest in such house. 7. VMH shall market each house acquired to home buyers in substantial compliance with the Project Concept attached to the City Manager's report dated January 12, 1987. All houses con- veyed to VMH shall be relocated within the City of Roanoke only. 8. VMH shall and, by execution of this ordinance, does hereby agree to indemnify and hold harmless the City, its offi- - 2 cers, agents and employees from any and all liability growing out of the location any house which it owns on City property, the movement, relocation and virtue of this ordinance interested parties. 9. Background: A. Shadeland Avenue was site of severe flooding and property damage in November 1985. City Council has committed to buying all real property on Shadeland Avenue and converting the site into a dry basin for downstream flood control purposes. Most properties have been acquired by the City. Structural assessment of some of the houses indicates some are salvageable and can be repaired at reasonable cost (estimated at this time to be $18,000-$21,000 per house for complete rehabilitation.) One house has been repaired and moved to a new location, and on December 15, Council agreed to give another house to the Northwest Neighborhood Environmental Organization to relocate and repair. II. Current Situation: City staff and staff of several other a~encies have discussed alternatives to demolishing the houses on Shadeland Avenue. These discussions have yielded a plan to move some of the houses to other locations, have them renovated, and sell them to low-income buyers. B. General concept of the plan is as shown on the attachment. C. Incentives for relocation and rehabilitation of the houses include: 1. Preservation and improvement of the City's housing stock; 2. Enhanced homeownership opportunities for lower income families; 3. Redevelopment of designated Conservation Areas and Rehabilitation Districts. Approval of the conditional gift of houses to Virsinia Mountain Housing (VMH) (a private non-profit housing development corporation experienced at residential development and rehabilitation) for proposed project must be given by City Council. Alternatives: Authorize the gift of any or all houses on Shadeland Avenue to Virginia Mountain Housing on the following conditions: -VMH shall indicate in writing within 10 days of the effective date of the ordinance or the City's acquistiion of the property, whichever is later, whether each house is desired; -Transfer of title of each house to VMH shall occur within 15 days of the effective date of the ordinance or the City's acquisition of the property, whichever is later; -Risks of loss with respect to each house will pass to VMH at the time of title transfer; -Houses will be conveyed to VMH in "as is" condition with no expressed or implied warranties; -VMH will provide public liability insurance naming the City as an additional insured from the date of title transfer until the house is removed from City property; -VMH will remove each house from Shadeland Avenue as expeditiously as possible, consistent with the intent of the overall relocation project; any house not removed within 60 days of VMH's written declaration of interest to take such house shall automatically revert to City ownership, and VMH shall have no further right, title or interest in such house. -VMH will market each house to homebuyers in general compliance with the Project Concept attached, with the understanding that modifications may be necessary and in recognition of the risk borne by VMH; Page 3 January 5, 1987 -VMH will agree to indemnify and hold harmless the City, its officers, agents, and employees from any and all liability growing out of the location of the house on City property, movement, relocation, and renovation of the house and showing it to interested parties. Effect on City's housing stock will be positive, in that several single-family houses will be improved and preserved for ownership by lower-income owners on affordable terms. Effect on neighborhood revitalization will be positive, in that areas targeted for improvement will have several highly visible, newly repaired homes and families added at one time, where new construction is needed to encourage other revitalization. 3. Cost to the City will be reduced in two ways: a) Some demolition costs will be saved. h) Tax revenues from houses that would have been lost will be preserved for those houses moved, amounting to up to approximately $30,000 in taxable value for each house. No further cost to the City would be incurred, in that the plan does not include any funds from the City, either from general funds or Community Development Block Grant funds. Timing is such that the VMH must be allowed reasonable opportunity to evaluate condition and rehabilitation needs of each house, and to arrange for relocation with house movers. The time required will be related to the number of houses to be moved. 5. Legal issues include: a) City's continued liabilit~ for security of houses until title is transferred to VMH within 15 days of approval of transfer or acquisition by the City, whichever is later. b) City can give propert~ to private non-profit agencies, but cannot give or sell property directly to individuals; therefore, an intermediate agency between the City and the eventual homeowner is necessary. c) City would relinquish responsibility for property's relocation, ownership having been transferred to the private non-profit agency prior to the move. B. Do not authorize gift of houses to Virginia Mountain Housing; pursue original intention of demolition. Construction of new houses on available sites may be delayed for years, and meanwhile further deterioration of nearby properties may continue. 3. Cost to the City would be increased somewhat by the demolition costs and by lost tax revenues. Timin~ is such that houses could be demolished as soon as title is taken to each. Work on dry basin could proceed as soon as all houses are acquired, if not before. 5. Legal issues are such that City's liability for houses would continue until demolition. V. Others in Gainsboro or other neighborhoods may be available by purchase or donation, with quality of title unknown 3) a) Estimates to move houses are $3,500-$4500 after clean out and gutting on current site. b) Estimated costs for total rehabilitation are $18,000-$21,000 for each house. c) Estimated average cost for foundation on new site, building permits, hook-up fees etc., is $3,600. TOTAL: $25,000 - $29,000 4) Permanent financing has been offered by the Virginia Housing Development Authority @ 5% for 30-year term. Procedure: 1) City and Virginia Mountain Housing enter contract whereby City will give to VMH up to 20 houses on Shadeland Avenue, in as-is condition, on condition that VMH have each house removed by certain date. 2) VMH carefully assesses conditions and projected rehabilitation costs of each available house and selects which houses it will accept and move. 3) VMH takes title and responsibility for houses selected, strips each one out, and has each moved into the Gainsboro Conservation/Redevelopment Area or other Conservation Areas or Redevelopment Districts. Lots onto which houses will be placed will be provided by the Redevelopment and Housing Authority or other owners. Sites will be concentrated to the extent available lots allow, to maximize impact, strength of redevelopment and to facilitate rehabilitation and marketing. 4) VMH renovates at least one house immediately for use as a model. Page 2 5) Each house will be offered for sale at a price to cover the costs to VMH of moving and setting the house in its new location. The total price to the buyer of a house as relocated and of its complete renovation is expected to be $27,000-$30,000. A period of open house(s) and showing of the development will be scheduled and publicized extensively. Information will be developed for each house, to include sales price as-is, renovation work expected and its cost, total cost of purchase and rehabilitation, and projected monthly payments of principal, interest, property taxes and insurance (PITI). 7) Through the showing period and on a scheduled "Selection Day", parties interested in buying a particular house will be asked to complete a general application form and register for each house of interest. The applications will be divided into the following categories, in order of priority: lst--low-moderate income buyers to occupy 2nd--higher income buyers to occupy 3rd--all others, for other uses 8) On the "Selection Day", for any house for which more than one party in a priority group applies, the parties of that priority group will be selected at random to have the opportunity to buy it, and will be processed for eligibility in order of selection. 9) VMH will enter into a sales contract with each buyer, whereby the buyer pays an earnest money deposit/down payment of $500, agrees to apply for special VHDA (or other acceptable) financing to buy and rehabilitate the house, and live in it (if in 1st or 2nd priority groups). lO) The buyer will apply for special VHDA (or other acceptable) financing. When loan is approved, transfer of house as-is to buyer will occur, rehabilitation funds will be escrowed, and work will begin by VMH and its contractors. On Thursday, Jan. 29, 1987, at 12:15 p.m. we are requesting that the Aerial LeMoines, a world renown highwire troupe based in Roanoke, be permitted to stage "Riders In the Sky." This aerial performance will be done on a cable suspended from the roof of the Colonial American National Bank building and extending into Elmwood Park. The LeMoines will use the same cable rigging as in last year's similar circus promotion, "Slide for Life." As last year, the 1/2-inch cable is anchored appropriately on the roof of Colonial American National Bank, crosses above Franklin Road and the promenade between Central Fidelity Bank and Blue Cross Blue Shield. The cable is secured in the amphitheater area of Elmwood Park. The installation of the wire will be done in a safe manner acceptable to the Circus and Colonial American. In this year's act, a motorcyclist ascends the cable from Elmwood Park with an acrobat suspended beneath the bike. They climb approximately two-thirds the height of the wire, backing down at the end of the performance. The act is about five minutes long, and will be covered live by Roanoke's major tv and radio stations, the Roanoke Times, and outlying media. John LeMoines, who has performed the feat in many countries around the world, will supervise the attachment and dismantling of the cable at an off-peak banking hour. As last year, it will be necessary to close Franklin Rd between Jefferson and Willtamson for the duration of the act, from noon to 12:30 p.m. The entity staging the promotion is Abel Holding Co., Inc., T/A Hamld-Morton Circus, George Hamid, president. We understand the referenced activity will consist of the Circus attaching a wire line to the roof of our building and anchoring it to the ground in the City park across Franklin Road behind the Blue Cross/Blue Shield Building. A motorcyclist will ascend the cable from Elmwood Park with an aerialist suspended beneath the bike. The bike will climb about two-thirds the height of the wire and will not come in contact with the building. To help promote this worthy benefit, the Shrine and Abel Holding Co., Inc., T/A Hamid-Morton Circus is seeking City Council permission to stage a very special event. On Thursday, Jan. 29, 1987, at 12:15 p.m. we are requesting that ~he Aerial LeMoines, a world renown highwire troupe based in Roanoke, be permitted to stage "Riders In the Sky." This aerial performance will be done on a cable suspended from the roof of the Colonial American National Bank building and extending into Elmwood Park. The LeMoines will use the same cable rigging as tn last year's similar circus promotion, "Slide for Life." As last year, the 1/2-inch cable is anchored appropriately on the roof of Colonial American National Bank, crosses above Franklin Road and the promenade between Central Fidelity Bank and Blue Cross Blue Shield. The cable is secured in the amphitheater area of Elmwood Park. The installation of the wire will be done in a safe manner acceptable to the Circus and Colonial American. In this year's act, a motorcyclist ascends the cable from Elmwood Park with an acrobat suspended beneath the bike. They climb approximately two-thirds the height of the wire, backing down at the end of the performance. The act is about five minutes long, and will be covered live by Roanoke's major tv and radio stations, the Roanoke Times, and outlying media. John LeMoines, who has performed the feat in many countries around the world, will supervise the attachment and dismantling of the cable at an off-peak banking hour. As last year, it will be necessary to close Franklin Rd between Jefferson and Williamson for the duration of the act, from noon to 12:30 p.m. The entity staging the promotion is Abel Holding Co., Inc., T/A Hamid-Morton Circus, George Hamid, president. Insurance coverage for the event is guaranteed and documented by Abel Holding Co., Inc., as the primary insurer, and by the Kazim Temple Shrine under two separate $1 million Comprehensive General Liability policies. The City of Roanoke, its officers, agents and employees, and Colonial American National Bank are named as additional insureds on both policies.
