Monday, January 12, 1987, Council held a public hearing on the
request of your client, TRUST, The Roanoke Valley Trouble Center,
Inc., that a certain tract of land containing .527 acres, more or

Re: TRUST rezoning on Birchwood Street
Dear Mrs. Bowles and Gentlemen:
This is in regard to the request of TRUST, The Roanoke Valley
Trouble Center, Inc., to rezone a lot in the City at 3515 Birch-
wood Street, N. E., from RD, Duplex Residential District to RG-1,
General Residential District. Petitions have been filed with the
City by citizens of the City opposed to the rezoning. Sufficient
signatures have been set out in these petitions to invoke the pro-
visions of §62(5) of the Roanoke City Charter which provides with
reference to amendments to the City's Zoning Map, in pertinent
part, as follows:
"Such regulations, restrictions, and boundaries may
from time to time be amended, supplemented, changed,
modified or repealed. In case, however, of a protest
against such change signed by the owners of twenty per
centum or more either of the area of the lots included
in each proposed change, or of those immediately ad-
jacent in the rear thereof, or of those directly
opposite thereto, such amendment shall not become
effective except by the favorable vote of five-
sevenths of all the members of the Council."
There are seven lots adjacent to the one proposed to be re-
zoned. According to City records, the owners of these lots are

Harlan S. and Cecelia F. Cato (who own property to the rear
of the subject property) and Carson D. and Carol M. Wray (who
own property across from the subject property) have signed the
protest petition, thus invoking the requirement that five-sevenths
of all of the members of Council vote in favor of the rezoning in
order for it to be approved.
I should note that Sallie W. Perdue signed the petition, but
Andrew T. Perdue, the other record owner of Official Tax No. 317-
0110, did not. My Office has previously opined on several occa-
sions that all of the record owners of a lot must sign such a
petition in order for it to be considered pursuant to §62(5). The
same is true for Official Tax No. 3170407, which was obviously
signed by one person as "Mr. and Mrs. E. W. Sink." This Office
has previously opined that this is not sufficient to meet the
requirements of §62(5).

The Planning Commission held two public hearings on this rezoning
request: 12/3/86 and 12/17/86. On 12/17/86, the Commission voted 3-3
to d~en~ the rezoning request (Messrs. Waldvogel, Sowers and Jones voting
in favor of denial of the request and Messrs. Bradshaw, Buford and Mrs.
Goode voting in favor of approval; Mr. Price absent). The Commission's
by-laws provide that "in the event of a tie vote, it is to be construed
as a denial of the requested action."

The Commission voting in favor of the denial felt that Trust was a
commercial, business use and that changing the zoning to permit the use
was not in keeping with the residential area.
Information on the operations of Trust was provided to the
neighborhood and to the residents of the area by Trust. An additional
meeting by Trust with residents on the matter is planned in January
prior to the City Council hearing.

tract of land lying at 3515 Btrchwood Street, N.E.,
designated as Official Tax No. 3170401, be rezoned from
RD, Duplex Residential District, to RG-1, General
Residential District, such rezontng to be subject to
certain conditions proffered by the petitioner.
A. Purpose of the rezontng request is to allow Trust to utilize
an existing structure if granted a special eXCeption permit by
the Board of Zoning Appeals.
B. T__rusk is a non-profit institution which provides 24-hour
Counseling, information and referral services for crisis
situations. They also provide emergency food and shelter on a
limited arrangement basis. The attached letter, dated
11/19/86 from Ms. Ellen Weinman, attorney for Trust, provides
additional details as to the operations of the facility.
C. Un_~der the present zoning ordtnanc,, non-profit institutional
uses are Permitt~d as special exc~ptions by the Board of
Zoning Appeals in RG-1 and RG-2 districts provided the use is
within an enclosed building, there are no more than two paid
employees, and no new major construction is required. It

homes, are permitted in all residential ZOnes by special
exception.

Saving Crew at 3502 Birchwood and the Holy Trinity Greek
Orthodox Church, on the Corner of Birchwood and Huntington
Boulevard.
C. Utilities are available. Building is existing. More parking
space may be needed, in which case storm water management
would have to be handled on Site.

TO THE HONORABLE MAYOR AND MEMBERS OF THE COUNCIL OF THE CITY OF ROANOKE:
1. The Petitioner, TRUST, the Roanoke Valley Trouble Center, Inc.,
a non-profit corporation, providing 24 hour crisis-intervention, lay
counseling, and referral services, has a contract to purchase a certain
tract of land located in the City of Roanoke, Virginia containing .527
acres, more or less, located at 3515 Birchwood Street, N.E., and de-
signated on Roanoke City Appraisal Maps as Offical Tax No. '3170401; the
said property is currently zoned RD, Duplex Residential District. A
map of the property to be zoned is attached as Exhibit A.
2. Pursuant to Articles VII and VIII of Chapter 36, Code of the
City of Roanoke, (1979), as amended, the Petitioner requests that the
said property be rezoned from ED, Duplex Residential District, to RG-I,
General Residential District, subject to certain conditions, for the
purpose of maintaining a 24 hour crisis-intervention, lay counselinE
and referral facility on the premises.
3. The Petitioner believes that the rezoning of the said tract of
land will further the intent and purposes of the City's zoning ordinance
and its comprehensive plan in that:
(a) It will enable the Petitioner to carry on the work of the
agency, to wit: free assistance to those in need on a 24 hour basis
in the same general area of the City where the Petitioner has been

located for the past sixteen years.
(b) It will enable the Petitioner to continue to provide to
the citizens of the City with free, confidential services in the areas
of lay counseling, referral, and emergency assistance.
(c) Petitioner's services are endorsed by the comprehensive
plan in that many of the citizens of the City who use the services can-
not afford to seek assistance in the private sector.
4. The Petitioner hereby proffers and agrees that if the said tract
is rezoned as requested that:
(a) The use of the property will be limited to the operation
of TRUST, Roanoke Valley Trouble Center, Inc.;
(b) The rezoning be subject to Petitioner procuring a special
use exception permit from the Board of Zoning Appeals; and
(c) If the Petitioner does not secure a special use exception
permit from the Board of Zoning Appeals the zoning of the property shall
revert to RD, Duplex Residential District without any further action of
City Council.
(d) The proposed development of the property will be in sub-
stantial conformance with the preliminary plan attached hereto as Ex-
hibit C, subject to any revisions that may be required by the City
Engineer during site plan review.
(e) Signage will be limited to two signs, no more than
twelve (12) square feet combined.
(f) The proposed parking area will be landscaped to adequately
screen the area from adjacent residential property. The proposed parking
area will be lighted by a dust to dawn light.

(g) There would be no expansion of the existing structure.
5. Attached hereto is Exhibit B containing the names and add-
resses of the owner and owners of all lots or property immediately
adjacent to or immediately across the street from the property to be

WHEREFORE, the Petitioner requests that the above described tract
be rezoned as requested in accordance with the provisions of the zoning
ordinance of the City of Roanoke.

TO THE HONORABLE MAYOR AND MEMBERS OF COUNCIL OF THE CITY OF
ROANOKE:
1. Your Petitioner, Imaging Center of Southwest
Virginia, Inc., a Virginia, non-stock, not-for-profit
corporation, is the owner of certain real property located on
the east side of Jefferson Street northeast of its intersection
with Marion Street in the City of Roanoke, Virginia, which
property is more particularly described on Exhibit A attached
hereto.
2. Your Petitioner plans to construct on its property a
permanent structure to house a magnetic resonance imaging unit
and other equipment to provide a full range of medical
diagnostic imaging services.
3. Your Petitioner desires to be an organization des-
ignated by a section within Article 4, ~58.1-3650 et seq. of
the 1950 Code of Virginia, as amended, in order that the
referenced real and personal property housed on such real
property and used exclusively for charitable and benevolent
purposes in responding to the health care needs of the citizens
of the Roanoke Valley and its environs be exempt from taxation

under the provisions of Article X, §6(a) (6) of the Constitution
of Virginia so long as your Petitioner is operated not for
profit and the property so exempted is used in accordance with
the purpose for which your Petitioner is classified.
4. Your Petitioner respectfully requests that the
Council of the City of Roanoke adopt a resolution in accordance
with the requirements of §30-19.04(B) of the 1950 Code of
Virginia, as amended, after holding a public hearing with
respect thereto where citizens shall have an opportunity to be
heard in order that legislation involving the designation of
property to be exempted from taxation pursuant to Article X,
§6(a) (6) of the Constitution of Virginia may be presented to
the General Assembly of Virginia.
In compliance with §30-19.04(B) the following questions
are submitted for consideration:
1. Whether the organization is exempt from taxation
pursuant to §501(c) of the Internal Revenue Code of
1954.
(A). Your Petitioner is exempt from taxation pursuant to
§501(c) of the Internal Revenue Code of 1954.
2. Whether a current annual alcoholic beverage license
for serving alcoholic beverages has been issued by
the Alcohol Beverage Control Board to such orga-

Southwest Virginia, Inc., keeping in mind the philos-
ophy and objectives of both its members; having
concerns for the needs of its service area; being
conscious of the Imaging Center's responsibility to
the people it serves; dedicated to this cooperative
approach to providing health-care services; and
respectful of the autonomy of other health-care
organization in Southwest Virginia, has adopted a
mission statement which, in part, states as follows:
"The Imaging Center of Southwest
Virginia, Inc., is a freestanding,
diagnostic center. Presently, it pro-
vides Magnetic Resonance Imaging, but the
Center was formed with the purpose of
providing a full range of diagnostic
imaging services. The Imaging Center
will respond to the needs and concerns of
its patients, the needs of other health
organizations, the educational needs and
professional development needs of its
staff and physicians, as well as the
needs of Community Hospital and Roanoke

WHEREFORE, your Petitioner, Imaging Center of South-

the City of Roanoke (1) that a resolution be adopted pursuant
to §30-19.04 of the Code of Virginia stating the provisions of

Grant applications are being submitted to Federal Aviation
Administration (FAA) and Virginia Department of Aviation (VDA)
for funding the new airport terminal development project. The
attached sheet shows anticipated requested funding amounts.
Initial grants hdve been received and accepted by Council from
the FAA for $1,902,006 and VDA for $114,500 for the first phase
of the site grading, land acquisition and design.
C. Preliminary plans have been received and the consultant has been
directed to proceed to final plans and specifications.
Ordinance No. 28173, dated June 9, 1986, authorized the City
Manager to execute grant applications for State and Federal fund-
ing for the airport terminal project.
Current Situation:
A. Delta and Odell Associates are proceeding with final design of
terminal plans.
B. FAA entitlement funding based on a yearly enplanement formula is
approximately $1,200,000 per year.
State entitlement funding under the new Commonwealth Airport Fund,
as administered by the VDA, is expected to be approximately $445,929
annually.
FAA pure discretionary funding will be requested for all eligible
project costs in the amount of $4,428,656, it being anticipated
some advance funding will be chargeable against future entitlement
funding.
Commonwealth Airport Fund is estimated to receive approximately
$10.1 million annually. Maximum yearly funding to airport sponsor
is 25% or approximately $2,525,000.

VDA discretionary funding will be requested for all eligible
project cost in the amount of up to the anticipated maximum
eligible cost cap of $4,905,057 over a 3-year funding period.
III.
Conclusion is that maximum funding should continue to be sought from
the FAA and VDA under a multi-year program to assure orderly and timely
completion of terminal development.
This report is for Council's information and no action is required.
Council will be kept informed on progress and efforts to receive State
and Federal grants. All grant offers will be reported to Council for
approval.

The fiscal year ]986-87 General Fund and Internal
Service Fund budgets included funds in the non-departmental cate-
gory for payment of termination leave and workman's compensation
wages and medical expenses. These three types of fringe benefits
are budgeted in the non-d~partmental category because annual
charges to each department cannot be accurately projected. The
actual costs are charged to the applicable department in anticipa-
tion of periodic budget transfers to cover these costs.

2. The City Manager or the Assistant City Manager and the City
Clerk are hereby authorized on behalf of the City to execute and
attest, respectively, the requisite contract with the successful
bidder, based on its proposal made therefor and the City's specifica-
tions made therefor, said contract to be in such form as is approved
by the City Attorney, and the cost of said work to be paid for out of
funds heretofore or simultaneously appropriated by Council.

Bids for Replacement of Wise Avenue Pedestrian
Bridge Over Tinker Creek
I. Background on this subject includes:
Bids were received by City Council at its December 15, 1986 meeting,
publicly opened and read aloud for Replacement of Wise Avenue
Pedestrian Bridge over Tinker Creek. Three (3) bids were received and
referred to the bid committee for review and report back to Council.
Low base bid, in the amount of $74~500.00 was submitted by H & S
Construction Company. Bid price includes construction of new bridge,
approach sidewalk, and removal of former bridge pier.
Flood of November 4, 1985, demolished the former Wise Avenue
Pedestrian Bridge, over Tinker Creek.
Pedestrian volume had been approximately 50 to 60 people per day.
Regular requests have been received from citizens to provide a new,
safe walkway. Existing Wise Avenue roadway bridge is a low-water
bridge, and is less than desirable for pedestrian traffic due to
24-foot width.
E. Damage Survey Report was submitted to Federal Emergency Management
Agency in an effort to receive funds for bridge replacement.
II. Current Situation on this subject is:
Wise Avenue Pedestrian Bridge replacement will require approximately
two (2) months to construct. The new bridge will provide a 4 1/2-foot
wide sidewalk area on the same alignment as the former bridge. Wise
Avenue will need to be closed temporarily at certain stages of project
construction.

III. Issues in order of importance:
A. Compliance of the bidders with requirements of the contract
documents.
B. Amount of the low bid.
C. Funding for construction.
D. Time of completion.
IV. Alternatives in order of recommendation are:
A. Award the contract to H & S Construction Company, in the sum of
4-~500.00 and establish a contingency in the amount of $6~000.00.
1. Compliance of the bidder with the requirements of the contract
documents was met.
2. Amount of the low base bid of $74,500.00 is slightly higher than
the engineer's estimate.
Funding in the amount of $80~500.00 (base bid plus contingency)
reimbursable in the amount of $60~375.00 (Federal Funds) and
$20)125.00 (State Funds).
4. Time of completion of the project is 60 calendar days.

Reject the three (3) bids received and do not construct the project
at this time. Re-evaluate the project for future rebidding.
1. Compliance with requirements of the contract documents would not
be an issue.
2. Amount of the bid price would probably be higher if rebid at a
later date.
3. Funding would not be spent at this time. Any appreciable delays
could affect state and federal disaster assistance.
Time of completion of the project would be delayed, during which
time pedestrians would continue to be without a safe walkway
across Tinker Creek.

V. Recommendation is that City Council take the following action:
Approve Alternative "A" and award the contract to H & S Construction
Company, in the sum of $74,500.00 and establish a contingency in the
amount of $6~000.00.
Authorize the Director of Finance to establish an account receivable
in the amount of $60~375.00 (Federal Funds) and $20,125.00 (State
Funds) and appropriate this amount into an account to be established
by the Director of Finance.
C. Reject the other bids received.
