WHEREAS, for the usual daily operation of the Municipal
Government of the City of Roanoke, an emergency is declared to

Joel M. Schlanger
School Board Request for Appropriation of Capital
Maintenance and Equipment Replacement (CMERP) Funds
The School Board was allocated $601,347 as their share of
fiscal year 1986 CMERP funds. City Council appropriated $392,977 of
these funds on November 10, 1986, for building modernization and
roof renovation. The attached correspondence requests appropriation
of an additional $43,545 of CMERP funds for equipment and building
improvements. If this request is approved, the School Board will
have a balance of $164,825 of unappropriated CMERP funds.
I recommend the attached budget ordinance for your
approval.

I. Background:
A. City Council at its November 17, 1986 meeting, publicly opened
and read aloud bids for the installation of certain underground
traffic signal work.
B. Two bids were received for the project which were from:
1. New River Electrical Corporation,
Roanoke, Virginia $28,468.00'
*original bid of $27,938 included

2. Guard Rail of Roanoke $33,767.50
C. Advertisement was in the the Roanoke Times & World News
paper and a showing was held with _3 contractors attending.
D. Proiect consists of the following:
1. Underground Conduit Runs & Junction Boxes
2. Concrete Foundations
3. Loop Detectors in the Roadway
E. Addendum Number 1 dated November 3, 1986 was received
by both bidders.
II. Issues in order of importance are:
A. Compliance of bidders with the requirements of the Contract

consecutive calendar days to New River Electrical Corporation,
the low responsible bidder, to install certain traffic signal
underground work and with quantities as set forth in Contract
Documents as prepared by the Office of the City Engineer.
Establish a project contingency amount of $2,800.
1. COmpliance of the bidder with the requirements of the
Contract Document was met.
2. Amount of the bid is acceptable and under the estimate.
3. Funding for this project is available in Account No. 008
052 9580 9065.
4. Time of completion of work meets schedule for installation
of equipment by City.
B. Reject the bid and do not award contract at this time.

2. Amount of the bid could increase due to construction season
and scheduling.

Subject: Disposition of City-Owned Property on Shadeland Avenue
I. Backsround:
A. Shadeland Avenue was site of severe flooding and property damage in
November 1985.
City Council has comanitted to buying all property on Shadeland
Avenue and converting the site into a dry basin for downstream
flood control.
C. Some properties have been acquired by the City, including two houses
still on site. (917 and 943 Shadeland Avenue NW)
II. Current Situation:

A. The two City-owned houses are in good condition structurally. One has been
renovated since the flood and is in very good condition overall.
Northwest Neishborhood Environmental Orsanization (NNEO) of the
Gilmer Avenue Conservation Area has expressed interest in taking 917
Shadeland Avenue, moving it into the Gilmer neighborhood, renovating it,
and selling it to a low-moderate income family.
House at 917 Shadeland Avenue cannot be moved until one of the adjacent
houses is acquired and removed to gain necessary access to 917
Shadeland.
Possibility exists that some of the other houses on Shadeland Avenue
not yet acquired by the City may be feasible to move into older
neighborhoods, renovate and sell. In such a case, the house moved and
repaired by NNEO may serve as a model of what houses may be like after
relocation and repair.

IV. Alternatives
Approve the ~ift of the house located at 917 Shadeland Avenue NW to the
Northwest Neighborhood Environmental Organization (NNEO) on the
following conditions:
°Transfer of title shall occur within 10 days of the effective date
of the ordinance;
°Risk of loss with respect to the house will pass to the NNEO at
the time of title transfer;
°House will be conveyed to the NNEO in "as is" condition with no
expressed or implied warranties;
°The NNEO will provide public liability insurance from the date of
title transfer until the house is removed from City property;
°The house be removed from Shadeland Avenue by the NNEO within 30
days of the title transfer, or of the City's acquisition of one of
the adjacent buildings, whichever occurs later.
°After its relocation and repair, the house be available for up to
six months for showing on a limited basis as a model, in the event
that, subject to council approval, more houses are similarly
relocated from Shadeland Avenue to be renovated.
°The NNEO will agree to indemnify and hold harmless the City, its
officers, agents, and employees from any and all liability growing
out of the location of the house on City property, movement,
relocation, and renovation of the house and showing it to interested
parties.
Cost to the City will be reduced by eliminating demolition
costs of donated house, although the site still will have to be
cleared and regraded. In addition, relocated house will
contribute to the City's tax base. No other funds are required
from the City.
City's liability would be minimized, as ownership and
responsibility for the house would be transferred very soon,
and house would be moved within 30 days thereafter.
Effect on neighborhood revitalization would be positive in that a
neighborhood without new infill construction will have a new
home added, possibly encouraging additional improvements.

B. Do not approve the transfer of house at 917 Shadeland Avenue NW to the NNEO.
Cost to the City would depend on the eventual disposition of
the property. If the building is demolished, cost may be
increased thereby. If the house is sold to be moved,
proceeds of sale could offset some of the other costs of dry
basin project.
City's liability would continue until eventual disposition of
house and would relate primarily to maintaining safety and
security of building.
Effect on neighborhood revitalization would be negative in that
an opportunity to provide new housing in a designated
Conservation Area and to reinforce the viability of the
neighborhood organization may be missed.
V. Recommendation:
Adopt Alternative A, thereby approving the gift of the house at 917
Shadeland Avenue NW to the NNEO on condition that:
1. Transfer of title shall occur within 10 days of the effective date
of the ordinance;
2. Risks of loss with respect to the house will pass to the NNEO at
the time of title transfer;
3. House will be conveyed to the NNEO in "as is" condition with no
expressed or implied warranties;
4. The NNEO will provide public liability insurance from the date of
title transfer until the house is removed from City property;

Dear Members of Council:
Subject: Land Acquisition, Airport Clearzone
Dent Road, N.W.
I. Background:
City has acquired several properties on Dent Road, N.W.,
Roanoke County, in conjunction with the extension of Runway
5-22. These properties were acquired in conjunction with the
Runway 23 Extension Project.
Vacant property directly on the extended centerline of the
runway, on the northerly side of Dent Road, is elevated by
the terrain to within about 75 feet of the elevation of the
runway. Development of such property would be undesirable.
II. Current Situation:
Mr. Charles H. Burton, owner of the single remaining vacant
tract north of and fronting on Dent Road, N.W. has offered to
sell the tract to the City for $79~500.00. This price
approximates the fair market value established by an
appraisal prepared for the City in 1985.
B. Elimination of future development of tract through acquisi-
tion by the City is recommended.

City Council authorize the appropriate City officials to
acquire in fee simple by general warranty deed a 9.12 acre
parcel, identified by Roanoke County Tax Map No. 27.18-I-50,
located on the northerly side of Dent Road, N.W, from Charles
H. Burton for $79~500.00. Documentation necessary to
transfer title to be prepared by the owner in a form accep-
table to the City Attorney.

1. Need by City to control vacant developable property near
end of Runway 5-22 is met.
2. Cost to City is $79,500.00 plus $500.00 for costs asso-
ciated with title transfer for a total of $80,000.00.
Funding must be appropriated from Previous Years'
Retained Earnings to an account to be established by the
Director of Finance.
B. City Council not authorize the acquisition of a 9.12 acre
tract on Dent Road, N.W. from Charles H. Burton.
1. Need by City to control the development of vacant land
near the end of Runway 5-22 is not met.
2. Cost to City is zero.
3. Funding is not needed.
Recommendation: City Council authorize the acquisition of a 9.12
acre tract from Charles H. Burton and appropriate $80~000.00 in
accordance with Alternative "A".
