endorse an amendment to the Code of Virginia to provide for an

clinics.

the City of Roanoke at a regular meeting held on Monday November
3, 1986. '

Dear Mayor and Council Members:

The Free Clinic of Roanoke Valley, Inc., is a nonprofit,
nonstock Virginia corporation partially supported by the United
Way of Roanoke Valley. The Clinic is a § 501(o)(3) organization
established to provide free medical and dental care to the
working poor. Doctors and dentists volunteer their services to
the Clinic.
Purchases of supplies and equipment by the Clinic are
subject to the Virginia Retail Sales and Use Tax. The law
(§ 58.1 608) provides for exemptions from the tax for certain
organizations. A list of the types of organizations which
currently enjoy exemptions is attached.
The Board of Directors of the Clinic would like to
recommend that the law be amended to provide for an exemption
for tangible personal property purchased for Free Clinics.
Suggested wording for such an amendment follows:
Tangible personal property for use, consumption, or
distribution by a nonprofit nonstock corporation, which is
exempt from taxation under § 501(c)(3) of the Internal
Revenue Code, and which is organized under the laws of the
Commonwealth exclusively for the purpose of conducting a
free clinic furnishing health care services by licensed
physicians and dentists, where no charges are made for any
health care services furnished at such clinic, such
exemption to apply to each transaction in the chain of
commerce from manufacture to final disposition.

Charges for operational (custodial) services will be absorbed by local
operating funds of the Roanoke City Public Schools. Special arrangement
of furniture on stages and in gymtoriums is to be coordinated in advance
with the respective Operational Building Manager indicated in Item 4 of
the Permit.
Participants should be advised the Roanoke City School Board Regulations
does not permit smoking inside of facilities used.
You are also advised that the Roanoke City Fire Marshal requires that all
exit doors be unlocked and pathways of egress be left unobstructed in
facilities during the period of use.
Necessary communications and P.A. equipment should be coordinated through
Mr. Alfred Beckley, Manager of City Communications (981-24250.
If doubt should surround the holding of the reservation for any date
requested, please contact 98~-2851 at least one (~) working day in advance
for confirmation.
For your added information, if schools are closed for inclement weather,
all activities of each school named in the Permit will be canceled during

I. Background:
A. Roanoke City Council has held City Council meetings in each of the
four neighborhood quadrants during the past four years.
B. May 2~ 1983, Roanoke City Council voted to continue meetings in the
four neighborhood quadrants of the City each year.
II. Current Situation:
City Code Provisions (Sec. 2-15), Rule 1, require that the first,
third and fourth regular monthly meetings of Council shall be held at
2 p.m., in the Council Chambers and that the second regular monthly
meeting of Council be held at 7:30 p.m., in the Council Chambers.
Resolution by Council is required to designate a new time, date and
location of any City Council meeting.

A RESOLUTION extending the pay benefits provided for by Resolution
No. 4748 for a certain emergency service employee.
WHEREAS, Resolution No. 4748, adopted February 28, 1936, provides
that police officers and firefighters absent from duty because of
disabling injuries incurred in the line of duty shall suffer no loss
in compensation for sixty days;
WHEREAS, by Resolution No. 4748, Council has voluntarily estab-
lished a local benefit for the City's police officers and firefight-
ers, and eligibility for such benefit is determined solely by the
terms of Resolution No. 4748, not by the Workers' Compensation Act or
related law;
WHEREAS, Resolution No. 4748 requires that extension of benefits
provided for by such resolution beyond sixty days shall be only upon
authority of Council;
WHEREAS, Lieutenant J. C. Jefferson of the Fire Department has
previously been determined eligible for such benefits, and by report
of November 3, 1986, the City Manager has recon~aended that benefits
available to such

Council Resolution No. 4748 of February 28,
1936, established policy for payment of
regular salaries in lieu of other
compensation paid by the City, to employees
of the Police and Fire Departments absent
from duty due to line-of-duty injuries, not
to exceed 60 days without approval of City
Council. City Council may consider paying
the employee injured in the line of duty for
additional time absent from his regular duty;
in excess of 60 days, but in no event will
payment in excess of 60 days be made until
authorized by Council.

July 22, 1986, J. C. Jefferson, a Fire
Lieutenant, was injured in the line of duty
while at a fire scene on 711 Norfolk Avenue,
NW. Fire Lieutenant Jefferson did not
contribute to the cause of the accident.
II. Current Situation:
Fire Lieutenant Jefferson suffered a
traumatic injury to his left elbow, with
infection. He had immediate pain following
the accident but the injury did not appear to
require immediate medical attention.
However,the pain persisted and he
sought medical treatment on July 23, 1986
through the City Occupational Nurse who
examined him and referred him to Community
Hospital, Roanoke Valley. Lieutenant
Jefferson received full pay on July 23, 1986
and began on Workmen's Compensation on July
24, 1986.
Fire Lieutenant Jefferson has not been
released by his physician to return to duty.
It is anticipated that Lieutenant Jefferson
can return to duty in 30-45 days.

Subject: Fire Program Fund
I. Background
The Fire Program Fund was enacted by the
General Assembly effective October 4, 1985,
pursuant to Section 38.1-44.1 of the State
Statutes. The legislation will expire July
1, 1990.
Be
Funds to support this program are derived
from a .8% surcharge on all fire insurance
premiums collected throughout the
Commonwealth.
The Fire Program Statute provides that funds
received are to be non-supplanting and must
be used in accordance with the provisions
established by the Department of Fire
Programs.
Funds provided by this program may be used
for the following:
Fire service training - the fire
department may use money received to
purchase equipment for training
programs, employment of outside
instruction and tuition reimbursement of
approved training.
2. Regional fire service training
facilities - funds may be used to
construct, improve and expand regional
fire service training facilities.
Firefighting Equipment - funds may be
used to purchase fire hose, forcible
entry tools, ladders, radio equipment
and etc.

be used to purchase helmets, eye protection,
protective hoods, boots, coats, pants and
gloves.
Funds provided by this pro~ram may not be
used for the following:
Construction, improving and expanding
any training facilities other than
Regional Fire Service Training
Facilities.

equipment and appurtenances attached
thereto required and used at the scene
of a fire to deliver water or other
extinguishing agent on the fire, remove
smoke and gases, protect property from
smoke and water damage and assure the
fire is extinguished.

Fire Protection Association Standards in
effect at the time the purchase is made.
Current Situation:
The City Treasurer received a check in the
amount of $44,928.17 from the Department of
Fire Programs on October 14, 1986.

to establish Grant Fund accounts from which
the fire department may disperse these funds
to purchase equipment in accordance with
provisions of this program as follows:

$10,000. To purchase audio-visual

I. Background:
October 20~ 1986, the City of Roanoke received $329~727,00 from
Federal and State governments as partial reimbursement for flood
damages.
Partial Reimbursement Received was deposited in the General Fund
Revenue Account R00102012340856 (Flood of '85) and in the Sewage Fund-
Accounts Receivable Account X0031136 (Flood of '85) to satisfy in part
an outstanding receivable of $242,935.83. These amounts were
$124,945.92 and $204~781.08, respectively.
II.
Current Situation:
A.
The amount of $124~945.92 deposited in the General Fund needs to be
appropriated and transferred to the Capital Fund - Flood of '85 to
continue the efforts of the City in its recovery program.

Appropriate $124~945.92, which is Federal and State flood reimburse-
ment, to continue selected operations by the City in its flood recov-

A RESOLUTION authorizing the issuance of a revocable permit
to Dominion Bankshares, N. A. for the attachment or installation
of certain holiday decorations to City trees adjacent to the
Bank's building on Campbell Avenue.
WHEREAS, Dominion Bankshares, N. A., (hereinafter "Permittee")
has requested that City Council authorize Permittee to install
certain seasonal lights or decorations on City trees adjacent to
Permittee's building on' Campbell Avenue in the downtown business
district; and
WHEREAS, Council is desirous of granting the request of
Permittee pursuant to certain terms and conditions.

a water tight box with proper plugs and cable for
wet location to be mounted on street light pole as
approved by the City;
all electrical equipment shall be UL approved for
wet locations and installed pursuant to the National
Electrical Code and the National Electrical Safety
Code;
no object shall be constructed, attached, installed,
erected or maintained so as to obscure the view of
any directional or informational sign by any opera-
tor of a motor vehicle or pedestrian;
Permittee shall obtain any and all necessary per-
missions for construction, attachment, installa-
tion. erection and maintenance of such object from
any affected private property owners and the State
Department of Highways and Transportation;
no object shall be installed in or attached to any
tree or shrub which is the property of the City of

Avenue with small white lights during the holiday season as we
have done the past several years. We would like to decorate the
trees on December 1 and take down the lights on January 5, which
is the Monday after New Years.
I understand that this request must go before City Council,
and I hope that you may simply update last year's Resolution
No. 27847. The city, especially Bill Mullins, has been very
cooperative in allowing us to brighten our corner at Christmas.

A RESOLUTION urging the Committee on District Courts to
certify a judicial vacancy in'the General District Court of the
Twenty-Third Judicial Circuit upon the retirement of the Honorable
James P. Brice.
WHEREAS, the Honorable James P. Brice, one of the five
General District Court judges of the Twenty-Third Judicial
Circuit, has announced his retirement from the Bench;
WHEREAS, the General Assembly has heretofore seen fit to
elect five General District Court judges to serve the Twenty-
Third Judicial Circuit which is composed of the City of Roanoke,
the City of Salem, the Town of Vinton and Roanoke County;
WHEREAS, failure to certify a vacancy upon the retirement of
Judge Brite will create a backlog of cases and impose an undue
hardship upon the public, Bar and judiciary; and
WHEREAS, this Council is of the firmly held opinion that it
is very important that the Twenty-Third Judicial Circuit continue
to be served by five General District Court judges;
THEREFORE, BE IT RESOLVED by the Council of the City of Roa-
noke as follows:
1. This Council respectfully urges the Committee on District
Courts to certify the need for five General District Court judges
for the Twenty-Third Judicial Circuit in order that a successsor
can be elected to the Honorable James P. Brite.
2. The City Clerk is directed to forward attested eopies of
this resolution to the members of the Committee on District Courts,
to the Circuit Court Judges of the Twenty-Third Judicial Circuit,
to the President of the Roanoke Bar Assoeiation and to the members
of the General Assembly representing jurisdictions in the Twenty-
Third Judicial Circuit.

in the General District Court
Dear Mrs. Bow]es and Gentlemen:
At the Council Meeting of October 20, 1986, City Council
adopted a motion requesting that the City Attorney prepare a
resolution urging the State Committee on Distriet Courts to
certify a judicial vacancy in the General District Court of
the Twenty-Third Judicial Circuit upon the retirement of the
Honorable James P. Briee. I am pleased to transmit with
this report a resolution implementing Council's motion.
For the information of Council, when an active judge
retires, resigns or dies, no vacancy exists to be filled by
the General Assembly until the vacancy has been "certified"
by the State Committee on District Courts. In the case of
Judge Brice's retirement, the Committee on District Courts
has preliminarily declined to certify the position. I
believe this action of the Committee represents a misunder-
standing, perhaps because of a statistical quirk, of the
workload of our General District Court judges, and I am hope-
ful that the Committee will reverse itself once it beeomes
thoroughly familiar with the local facts.
As you know, the general public rarely has eontaet with
the Cireuit Court or higher courts; most members of the pub-
lic have their sole contact with the judicial system at the
General District Court level. At this level, it is important
that the public be treated courteously and fairly and that
cases be handled as efficiently as possible. Regrettably,
failure to certify a vacancy upon the retirement of Judge
Briee will create a backlog of cases imposing an undue hard-
ship upon the pub]ic, Bar and judiciary and making it diffi-
cult for the General District Court to efficiently serve

LEGISLATION PASSED BY THE STATE LEGISLATURE, THIS ENABLES THE
AUTHORITY TO BORROW FUNDS AND OBTAIN FEDERAL AID UNDER VARIOUS
FEDERAL PROGRAMS PRIMARILY FOR LOW-INCOME PUBLIC HOUSING, FUNDS

REVOLVING LOAN PROGRAM
ON JUNE 10, 1985, THE BOARD OF COMMISSIONERS APPROVED A
HOMEOWNERSHIP REVOLVING LOAN ACCOUNT TO ENCOURAGE RESIDENTS
IN THE HIGHLAND MANOR TURNKEY III HOMEOWNERSHIP PROJECT TO
PURCHASE THEIR UNITS. THE FUND WAS SET UP IN THE AMOUNT OF
$100,000.00, AND ONLY ORIGINAL RESIDENTS OF THE DEVELOPMENT
ARE ELIGIBLE FOR LOANS. A COMMITTEE OF FOUR HOUSING AUTHORITY
STAFF MEMBERS REVIEWS EACH APPLICATION TO DETERMINE ELIGIBILITY
FOR A LOAN. UPON APPROVAL, THE AMOUNT AND LENGTH OF THE TERM
OF THE LOAN ARE DETERMINED. HOMEBUYERS ARE CHARGED PRIME RATE
INTEREST PLUS THREE PERCENT FOR ADMINISTRATIVE COSTS. A TOTAL
OF SEVEN FAMILIES IN THE HIGHLAND MANOR DEVELOPMENT HAVE TAKEN
ADVANTAGE OF THIS PROGRAM SINCE ITS INCEPTION WITH AN ADDITIONAL
TEN ORIGINAL RESIDENTS REMAINING WHO COULD POSSIBLY QUALIFY.

HOODS TO SERVE LOW-INCOME FAMILIES. PARTICIPATING PROPERTY OWNERS
MAY RECEIVE GRANTS OF $5,000,00 PER UNIT NOT TO EXCEED ONE-THIRD
OF THE TOTAL REHABILITATION COST. RENTAL SUBSIDIES ARE PROVIDED
TO ELIGIBLE TENANTS IN THE FORM OF HOUSING "CERTIFICATES" TO BE
USED IN SELECTING A UNIT WHICH FALLS WITHIN FMR LIMITATIONS AND
RENT REASONABLENESS OF THAT AREA,

SECTION 8 PROJECT SELF-SUFFICIENCY PROGRAM
In 1986, THE SECTION 8 PROJECT SELF-SUFFICIENCY PROGRAM BEGAN
WITH 50 SECTION 8 EXISTING HOUSING CERTIFICATES. THIS PROGRAM
COMBINES THE RESOURCES OF BOTH THE PUBLIC AND THE PRIVATE SECTORS,
AND °"ITS GOAL IS TO BREAK THE POVERTY CYCLE FOR SINGLE PARENT,
LOW-INCOME FAMILIES BY BRINGING SINGLE PARENTS INTO THE ECONOMIC
MAINSTREAM THROUGH A PROGRAM COMBINING HOUSING, CHILD CARE, AVAIL-
ABLE TRANSPORTATION, COUNSELING, JOB TRAINING, PLACEMENT AND OTHER
SUPPORT MECHANISMS". A TASK FORCE COMPRISED OF INDIVIDUALS RE-
PRESENTING VARIOUS AGENCIES IN THE CITY HAS COMPLETED A LOCAL
NEEDS ASSESSMENT, PREPARED AN ACTION PLAN, AND ESTABLISHED ELIGI-
BILITY CRITERIA AND A SELECTION PROCESS. ALL 50 CERTIFICATES HAVE
BEEN ISSUED.

THE SECTION 8 RENTAL REHABILITATION VOUCHER PROGRAM WAS
CREATED IN 1986, CONSISTING OF 21 UNITS, AND ITS DESIGN FOLLOWS
THE SAME BASIC CRITERIA AS THE RENTAL REHAB PROGRAM OF 1985 EXCEPT
THAT HOUSING "VOUCHERS" ARE ISSUED. THIS ALLOWS A FAMILY TO PAY
A RENT EXCEEDING 30% OVER THEIR MONTHLY ADJUSTED INCOME ALLOWING
MORE FLEXIBILITY IN THE SELECTION OF RENTAL UNITS. THE "VOUCHER"
MUST BE USED IN A RENTAL REHAB UNIT FOR THE FIRST YEAR, THE RENT
OF WHICH IS SET BY THE CITY OF ROANOKE REDEVELOPMENT AND HOUSING
AUTHORITY,

IN THE AMOUNT OF $1000,00 EACH TO BECOME AVAILABLE UPON
INTO A SCHOOL OF HIGHER EDUCATION.
THE 1986 PUBLIC HOUSING SCHOLARSHIP AWARDS WERE PRESENTED
TO ANA T. FOLIACO, A RESIDENT OF THE INDIAN ROCK VILLAGE HOUSING
DEVELOPMENT AND IS A STUDENT AT WILLIAM FLEMING HIGH SCHOOL, AND
WENDY D. JONES, A RESIDENT OF THE HURT PARK HOUSING DEVELOPMENT
AND ATTENDS PATRICK HENRY HIGH SCHOOL.
ONE 1986 SECTION 8 SCHOLARSHIP AWARD WAS PRESENTED, AND THE
RECIPIENT WAS RHONDA R. PRICE WHO RESIDES AT 3360 HERSHBERGER ROAD,
N.W., AND ATTENDS PATRICK HENRY HIGH SCHOOL.

COMMUNITY DEVELOPMENT PROGRAM
THE COMMUNITY DEVELOPMENT DEPARTMENT IS CURRENTLY ACQUIRING
PROPERTY IN SEVERAL AREAS OF THE CITY OF ROANOKE FOR VARIOUS
PURPOSES. SHAFFER'S CROSSING COMMUNITY DEVELOPMENT PROJECT AREA,
LOCATED BETWEEN SHENANDOAH AND BAKER AVENUES, N.W., OF WHICH WE
ARE PRESENTLY ACQUIRING 5 PARCELS, WILL BE DEVELOPED INTO AN
INDUSTRIAL PARK. DEANWOOD EXPANSION AREA, CONSISTING OF 11 PARCELS,
WILL ALSO BECOME AN INDUSTRIAL PARK. THE GATEWAY PROJECT AREA,
LOCATED AT THE CORNER OF ORANGE AVENUE AND WILLIAMSON ROAD AND
CONSISTING OF 2 PARCELS, IS A BEAUTIFICATION PROGRAM AND WILL BE
LANDSCAPED TO VISUALLY IMPROVE THE AREA. THE HENRY STREET RE-
VITALIZATION AREA, IN THE GAINSBORO PROJECT AREA, COMPRISED OF
31 PARCELS TO BE ACQUIRED, WILL BE DEVELOPED INTO AN ENTERTAIN-
MENT CENTER.

COMMUNITY DEVELOPMENT/REHABILITATION
The Neighborhood Development Department has had a busy and very
successful year serving 109 homeowners for a total expenditure of
$1,943,322.
PRIVATE REHABILITATION LOAN PROGRAM (9% & 10%)
The Private Rehabilitation Loan Program is a program created for the
rehabilitation of homes within designated Conservation Areas and Rehabi-
litation Districts within the City of Roanoke. The program was financially
supported during the 1985-86 year by a $600,000 mortgage revenue bond.
During calendar year 1985 (1984 Bond Series) the CRRHA has completed
17 loans in the amount of $581,050. Calendar year 1986 (1985 Bond Series)
has realized the completion of 18 loans in the amount of $600,000 for a
total of 35 loans totaling $1,181,050.
CRITICAL HOME REPAIR PROGRAM
The Critical Home Repair Program is a straight grant program of up to
$6,000 per unit. This program is limited to very low-income owners of
homes that have been identified as in critical need of repairs. During
1985-86 the CRRHA completed 35 units for a total expenditure of $199,592
and returned unexpended funds to the City in the amount of only $408 of
the allocated funding of $200,000.
SECTION 312 LOAN
The "312" loans are loans on a direct basis from HUD at 3% for re-
habilitation of owned homes for those candidates whose income is in the
low income range. During 1985 the Neighborhood Development Department
completed 7 loans in the amount of $144,400.
GAINSBORO
The Neighborhood Development Department has been involved with the
Gainsboro Program Area over the past year in two separately funded areas:
A, GAINSBORO GRANT PROGRAM
The CRRHA serviced 30 homeowners for a total of $398,137.
B, REVOLVING LOAN PROGRAM
This program is a "0" interest loan program serving to further stabil-
ize homes in the Gainsboro Program Area that cannot be completely stabil-
ized within the Gainsboro Grant Program. Three (3) loans have been made
in the amount of $20,143.
Two staff members of the Neighborhood Development Department were
recently tested and were certified to perform financial and inspection
services under the various rehab programs: Sueann Brown, Certified
Rehabilitation Construction Specialist and Charles A Davis, Certified
Loan Specialist.
