CITY MANAGER COMMENTS: The City Manager advised that Council met earlier in the day with the City's representatives to the General Assembly and an item of priority is a request to modify the State Code to provide for future notification of localities when any type of substance abuse or methadone clinic is to be considered in a locality. The current lease agreement expired November 30, 2003. The Hertz Corporation is interested in extending the lease of this parcel for an additional five year period, beginning December 1,2003 through November 30, 2008. The proposed agreement would establish an annual rate of $26,600.04 with an increase of 2% each year thereafter. After much reflection I have decided to tender my resignation as a member of the Roanoke City School Board effective December 31, 2003. My decision is based on a number of factors, including my concern that as a board member I am unable to carry forth the commitments I made to myself and the people when I assumed this role. Those commitments focused primarfly on making Roanoke City Public Schools a model for other systems throughout the state and country. However, in recent months I have not felt that Roanoke City Schools have met that goal. Due to those philosophical differences it is better for me to step aside. I have been a resident of Roanoke for 30 years. I am a former teacher in the Roanoke school system. I am a charter member of the Neighborhood Parmership. It has been my privilege to be appointed by council and the city manager to serve on numerous committees and boards, representing the interest of our citizens. In addition I have served our school system in like manner. My most recent appointment was to serve on the committee to choose the Architectural fnma to do the feasibility study for our two high schools. A group of citizens have inundated my phones with calls concerning the manner in which E. Wayne Harris our School Superintendent and the Roanoke Public Schools have been maligned. At the aegis of those people whose jobs will not permit them the freedom to be here I shall speak. The last several months have caused many of us a great deal of pain. We could not and cannot understand how our wonderful school system under the sterling leadership of E. Wayne Harris for over ten years has become to some to be the worst in our region, our state and our country. We have searched the archives of the Roanoke Times for the past ten and one half years on articles dealing with our schools and the superintendent. I submit to you that there has been less than a fist full during that span that hinted at anything negative concerning our schools or superintendent. In the past six months hardly a day passes without our school system and superintendent be maligned. A clue to what may have caused this may be found if we go on line to the Roanoke Times web site. On their home page we read under the special section these words - "school system in turmoil, what started over inaccurate crime reports has snowballed." I would not down play all of our concern over violence in our schools. We are all concerned but some have challenged you to the point that council has acted as if we have a crisis. The usual behavior in crisis is; place the blame on one person or entity, crucify them and crisis goes away. There is no crisis so let's stop the crucifixion. I have a need to make an open confession to council. Our silence put you at a disadvantage. You heard consistently from one side on the issue of school violence and I personally regret that you are just heating from us. I pray that our coming today is, right on time. The Titanic hit the iceberg because they began turning too late. I believe that we have amble time and the right people to start turning this ship in the right direction if we discover she is off course. We have a concern but it is not a crisis and it can be corrected. It will require the collaborative effort of council, the school board and the superintendent. We have ail the faith that you will do just that. Our faith in and support of our elected and public officials is one of the reasons we are a five times, All American City. If we do not correct this quickly our children, our schools and our city will be in a crisis. You know as well as I that increase enrolment means more dollars for our schools. If persons moving into the valley feel that our schools are waiting to devour their children they will seek an address outside of our district. They may work, eat, play and be entertained here. They may visit for culture enrichment but will not cail this place home. Today members of council I seek your pledge to be about the business of singing the praises of Roanoke and especially our school district. Let us follow the leadership of one of our own who said: It's a state of national recognition. I think back to my first State of the City speech three years ago, and I said then, we are better than we think we are." Despite our challenges, Roanoke doesn't give itself enough credit for all the things we have and all the things we are. Other people are recognizing us for our outstanding achievements. It's about t/me we recognize them ourselves. Mayor Smith I am sure you recall those words. They were spoken by you on July 23 of this year at the Clarion Hotel as you gave the State of the City Speech. I applauded you then and I applaud you now for those words, for those words set the tone today for us to acknowledge the outstanding achievements of Roanoke Public Schools under the leadership of E. Wayne Harris. We know that others recognize the achievements of our school system because they have told us. In the interest of time and the critical work you must do, let me share just two touching moments when others recognized Roanoke Schools achievements and sung our praises. Two young summer school interns, one from New York, the other from Alabama sings our praises. They attended services at Loudon Avenue Christian Church while here and on occasions we ate dinner together. The chatter at dinner about Roanoke and our schools was enlightening and refreshing. Others are singing our praises. Two law clerks who participated in the host program last year beamed when they talked with me about their experience and how well mannered the children were. 2 Others are singing our praises. It is time for us to join the chorus. Permit me to lead us in singing praises about our schools and the leadership of the School Board, E. Under his leadership academic achievement has been raised and the dropout rate has been lowered. I have included a copy of the editorial A Superintendent with Vision. I could not say it any better than that. We have so much more to sing about. I would encourage council and all the residents of Roanoke with purposeful intentionally to take a drive around Roanoke. Drive by the 12.2 million dollar Roanoke Academy for Mathematics and Sciences. Take special note that because of excellent leadership the children are being educated without being displaced and at the same time can see progress on the new home for learning. Drive Orange Avenue east and beam with all of the Addisonians at how that building, that houses fond memories has been transformed into a show place. Let me hasten for time will not permit me to give you the whole tour. Jackson Middle school serves as an anchor in Southeast. Virginia Heights smiles daily and announces a hardy welcome to all who pass by. 4 In a few years Patrick Henry and William Fleming will get major make over at the sum of $78,000,000. I hope I am not singing to loud but I love this city, I'm proud of our schools and I give unwavering support to our leadership. It takes great leadership to compose a song such as this. As I conclude this message please indulge me to sing solo. I am a patron of our schools. Our two children, Aaron (1997) and (Sarah 2001) graduated from William Fleming. Aaron also completed City School. Aaron graduated from the University of Virginia in 2001 and will receive his Masters from George Washington University on Saturday. Sarah is a third year student at James Madison University. The two of them were home for thanksgiving and I asked if we missed the violence while they were in school. With smiles on their faces they said, "dad, we have the usual stuff that kids do but we did not see all this violence that paper reports. I just so happen to be standing at this podium but there are hundreds of parents who could and would sing solo about the start their children got in our school system. Sarah has been challenged in light of the few months of negative press by her classmates at James Madison concerning her intentions of coming back to Roanoke to teach. She has had this dream and aspiration for as long as I can remember. Her response was "Roanoke schools are the best. Dr. Harris is the best. I was taught by the best. I look forward to teaching with the best at the best school system I know. Wayne Harris is determined to raise academic achievement and lower the dropout rate. And under his leadership, the schools have made marked progress toward both. Roanoke City Council's public rebuke Friday of the superintendent, and of the council-appointed school board that has the power to fire him, may add a useful sense of urgency to resolving the school safety controversy that has engulfed Harris' administration. But council members should be careful what they ask for. Harris' commitment to leave no child behind, made long before the political slogan was coined, increases pressures on all involved in the already complex process of educating children. Difficult students, not easily swept along, should not easily be swept aside. And, long-term, that is good. It is a strategy that advances the best interests of society. Now, the emotional issue of school safety has shifted the public focus away from academics. And no one yet knows the answer to the newly critical question: Does the city truly have a problem with safety in its schools? Two community groups - one appointed by city leaders, the other self- appointed watchdogs - are investigating. And teachers' complaints about inconsistent discipline and lack of administrative support are widespread enough to be credible. None of these things should be ignored. But city leaders must not take their eyes offthe prize - not when academic gains are also so clear and so vital. Of course, salvaging "at-risk" students should not be allowed to compromise the safety of the overwhelming majority of children attending Roanoke schools. But academic gains and safe schools are not mutually exclusive goals; they are mutually dependent. Children cannot learn well in dysfunctional schools. Which suggests that, given significant gains in achievement, the city's schools quite possibly are more peaceful than some terrible incidents might indicate. No leader is above scrutiny. But Harris' critics should not lose sight of his vision. The Western Virginia Workforce Development Board administers the federally funded Workforce Investment Act (WIA) for Area 3, which encompasses the counties of Alleghany, Botetourt, Craig, Franklin and Roanoke, and the cities of Covington, Roanoke, and Salem. WIA funding is for four primary client populations: · Dislocated workers who have been laid off from employment through no fault of their own; · Economically disadvantaged individuals as determined by household income guidelines defined by the U.S. Department of Labor; · Youth who are economically disadvantaged, or who have other barriers to becoming successfully employed adults; and · Businesses in need of employment and job training services. Considerations: · Program Operations - Existing activities will continue and planned programs will be implemented. · Funding - Funds are available from the Grantor agency and other sources as indicated, at no additional cost to the City. Concerns about the fee structure limited applicants' interest in applying for an outdoor dining permit and were addressed when City Council reduced the fees to $3.25 per square foot in Ordinance No. 35943-061702 June 17, 2002 for calendar year 2002. This fee was again reduced to $3.25 by City Council for calendar year 2003 in Ordinance No. 38237-021803. Total program revenues for 2003 are $3,171. In an effort to provide again an incentive for restaurants to apply for outdoor dining permits, the City Administration recommends that the reduced fee of $3.25 per square foot be continued for calendar year 2004. This grant program is designed to increase public safety and provide accountability among assaultive youth. The pilot for this program had a 94% success rate and continues to be a valuable addition to the continuum of services available in the treatment of juvenile offenders. ARTEP provides a less costly alternative than incarceration of juvenile offenders. This program increases the options available to juvenile court judges by providing intensive supervision, education and rehabilitative treatment services for juvenile offenders who are before the court on violent offenses. This is the last year in a five-year funding cycle, which has required increasing local responsibility for funding to the current 75%. Revenues from JJDP have decreased to 25% of the project total in the fifth year, to allow for local assumption of costs. Grant funds for this final year will pay for a portion of the Relief Counselor(s) salary and fringe benefits and administrative supplies. Funding awarded by the State for the current year is $17,571.50. The local match for this year is $52,714 and is provided from funding currently budgeted in the Crisis Intervention budget. (We are using the resources of Randall Funding and Development for help in identifying new funding sources). The Code of Virginia has been amended to allow a locality to require greater liability insurance coverage for dangerous dogs. The Code of Virginia, Section 3.1- 796.93:1.(D).(2)., previously required only $50,000 insurance coverage. It now states: "All certificates or renewals thereof required to be obtained under this section shall only be issued to persons who present satisfactory evidence that the owner, (of an animal found to be a dangerous dog), has liability insurance coverage, to the value of at least $100,000, that covers animal bites." Further, the Code of Virginia, §3.1-796.93:1.(B). revises definitions of "dangerous" and "vicious" dogs. Considerations: Amending the Code of the City of Roanoke to increase the required liability insurance coverage from $50,000 to $100,000 and amending the definitions of" ,, dangerous and "vicious" dogs will increase the level of protection for citizens and is expected to reduce the number of dangerous dogs.. Wyatt, Council Member Dear Mayor Smith and Members of City Council: SUBJECT: October Financial Report This financial report covers the first four months of the 2003-2004 fiscal year. The following narrative discusses revenues and expenditures. REVENUES Effective with the 2003-2004 fiscal year, recovered costs are being reported as revenues rather than as reductions of department expenditures as in prior years. This change in reporting has the impact of increasing both revenues and expenditures as compared to the prior year. As of the end of October, approximately $ 1,377,000 in recovered costs had been received and were included in the Charges for Services revenue category. Adjusted for this change in accounting for recovered costs, General Fund revenues increased 3.2% compared to FY03. Other variances in specific categories of revenues are discussed in the following paragraphs. General Property Taxes increased 6.7% ($1,706,124) in FY04 year to date in comparison with FY03. Current real estate tax revenues lead this increase with penalties and interest revenues contributing an additional $50,961 in FY04 versus FY03. Sales tax revenues are currently 8.5% higher than those of FY03. When adjusted for a $190,000 collection of unpaid prior month's taxes made as the result of a sales tax audit, revenues am 4.2% higher than those of FY03. The increase in retail sales tax is in part due to reduced performance in the fall of FY03 when consumer spending was negatively impacted by the sniper shootings. Other Local Taxes at October 31, 2003 have increased approximately 3.1% over the same period in FY03 when adjusted to include the electric service utility tax payment that was received in November. Permits and Fees continue their increase over FY03. They are $122,400 (41.0%) higher than FY03 due to the increases in building and other inspection fees generated as a result of new construction and various expansions to existing companies mentioned in the prior monthly report. Revenue from Use of Money and Property has decreased 10.6% due to a reduction in revenue from the lease of the Commonwealth building. Operating and maintenance fees generated from the lease were less than those pre-billed, causing an adjustment in FY04. Grants-in-aid Commonwealth revenues declined by 2.3% in spite of an I 1.6% increase in social services funding resulting from a change in state reimbursement guidelines for ADFC foster care adoptions. The declines result in part from less state share of personal property tax revenues ($228,283), less jail block grant ($259,208) and less Sheriff's shared expense reimbursements ($63,752). Honorable Mayor and Members of Council December 1, 2003 Page 2 Charges for Services have increased by the aforementioned change in recording recovered costs as revenue in FY04. In addition, EMS fees for both current and delinquent collections have increased 40.2%. EMS revenues have increased in recent years in accordance with federally-permitted fees. Interfund Services revenues decreased 38.7% primarily due to timing differences in billings to the Airport for fire safety and the loss of revenue from Roanoke Valley Detention Center administrative fees. General Fund miscellaneous revenues remain higher due to the sale of surplus property and donations for parks and police. EXPENDITURES AND ENCUMBRANCES A couple of key changes continue to impact the obligations of the City in the 2003-2004 fiscal year as noted in previous reports. First, the City granted a pay raise to active employees effective July 1, 2003, which averaged 2.85% City-wide. Secondly, the City's purchasing division has created an initiative to assure that contractual commitments such as rents are encumbered via purchase order for the annual amount. This has resulted in higher obligations in the current fiscal year compared to the prior fiscal year, but it represents a more realistic assessment of departmental obligations. Also, the changes to recording of recovered costs, discussed above, will result in affected departmental obligations being greater than the prior year since the recovered costs are no longer deducted from obligations. General fund expenditures and encumbrances have increased 12.4%. Adjusted for the change in recovered costs, this increase is 10.5%. Other variances in specific categories are discussed below. Public Safety expenditures grew due to increases in personal services in the labor-intensive Police and Fire departments. Health and Welfare expenditures increased as a result of a 15.2% increase in Social Services expenditures. This was mainly due to increases in ADC-foster care and special needs adoption. Parks, Recreation and Cultural expenditures increased $80,000 as a result of additional Department of Technology billings to the libraries. Community Development expenditures and obligations increased due to one-time expenditures in for the Mill Mountain Zoo water line improvements ($175,000) and for the marketing initiative ($153,000). The transfer to debt service decreased as a result of debt service savings from the Series 2003 refunding issue. Additionally, the payments required on the 2002 Series issues are lower in the current year than in FY03. The transfer to school capital projects fund resulted from an appropriation of fund balances relative to CMERP for a reserve for future school construction and renovation costs. There was no similar transfer in FY03. Nondepartmental expenditures and obligations increased due to a transfer of $2,845,800 to the Parking Fund to redeem the lease of the Century Station parking garage with the Housing Authority.
