Mr. Chris Craft, 1501 East Gate Avenue, N. E., requested that
citizens be permitted to take photographs of Victory Stadium as
a memento prior to demolition. He asked that the City of
Roanoke enforce the sign ordinance prohibiting the posting of
yard sale signs on City property.

regard to increasing the eligibility requirements for City of

This brings in one full-service firm that can manage all the different disciplines that
have to be intertwined together so that this project has a high level of quality control,
continuity, and efficiency. This effort will provide us one point of contact for all
disciplines as described below.

occasion of Virginia Western Community College's 40th anniversary. The City's support of
Virginia Western over the years has been very much appreciated.
During Fall 2005 2,096 students of Virginia Western were from Roanoke City which accounts for
25% of total enrollment. 55 percent of graduating seniors from Roanoke City who attended
college in the Fall of 2005 attended Virginia Western.
The College has grown from an initial enrollment of 1,600 students in 1966-67 to an enrollment of
12,574 students (2004-05 annual unduplicated headcount). In the Fall 2005 semester the college
enrollment was 8,244 credit students (3,811 FTES). Three-fourths of the Fall 2005 students
(76%) were enrolled part-time; over half (58%) were females, and 13% were racial/ethnic
minorities. Over half (57%) were enrolled in a curriculum. Virginia Western does not provide
residential facilities, so all students are commuters, and most drive a fairly short distance to
campus. More area residents attend Virginia Western than all other colleges
combined. According to annual surveys, most students come to Virginia Western for an
affordable, convenient and quaiity education in order to prepare for better employment
opportunities or for transfer (to a baccalaureate program).
In addition to traditional on-campus courses, Virginia Western's Workforce Development Division
has responded to employer and community needs by serving over 4,000 students and providing
custom training courses for many of the region's leading businesses.

Background:
In 2005, the United States was hard hit by the most active hurricane season in history.
Hurricanes Katrina, Rita and Wilma hit Louisiana and Florida hard, leaving paths of
destruction that are still being cleaned up today.
To help with the hurricane recovery in these devastated regions, Roanoke Fire-EMS
was called upon by the Virginia Department of Emergency Management (VDEM) during
FY2005-06 for three different deployments. The first deployment consisted of six
individuals that departed Roanoke on October 3rd to assist the hard hit Calcasieu Parish
in Louisiana. While there, they helped get the city back on its feet after Hurricane Rita
and assisted with clean up and basic day to day activities. This group returned on
October 23rd. On October 25th, a second team of six individuals headed to Moore
Haven County, FL to help the area recover from Hurricane Wilma which tore through
the county. This team helped get sewage and water back on line and staffed the
Emergency Operations Center. They returned on November 9th. In December, Roanoke
Fire-EMS sent its final deployment back to Louisiana to the Cameron Parish. This seven
man team also worked in the EOC and helped aid in the recovery from Hurricane Rita.
Roanoke Fire-EMS incurred expenses due to overtime and supplies which is now being
reimbursed by VDEM.

Considerations:
The funding recovered from VDEM will be used to cover expenses incurred by Fire-
EMS during the three deployments in 2005. Roanoke Fire-EMS has submitted all
requested receipts and paperwork and is working with VDEM to secure
reimbursements.
Recommended Action:
Authorize the Director of Finance to establish a revenue estimate in the General Fund
from VDEM in the amount of $158,939 and appropriate funding to the following Fire-
EMS accounts:

INTRODUCTION:
The Virginia Department of Emergency Management (VDEM), through the Emergency Management
Assistance Compact (EMAC), Virginia Code Sections 44-146.14, and 44-146-28 coordinates emergency
management and interstate mutual aid for the Commonwealth of Virginia. EMAC is the interstate mutual aid
agreement to which most states belong that allows states to assist each other in times of disaster. When any
member state's Governor declares a disaster or when a disaster is imminent, as in the case of the recent
Hurricane Katrina impacting Louisiana, other member states may agree to provide assistance in response to
requests from the impacted staters). The assistance from other member states may be in the form of
personnel and/or other resources. EMAC has been operational since the threat of hurricane was imminent and
will remain operational until all needs are met. In response to EMAC requests, several local government
employees have volunteered to respond. In cooperation with City of Roanoke, VDEM has identified several
experienced and qualified city employees who are available to deploy to assist Calcasieu Parish with response
and recovery missions. These city employees will travel to Calcasieu Parish and work in support of the
Louisiana Emergency Management Agency.
(NAME OF COUNTY EMPLOYEE & STATEMENT OF EXPERIENCE/QUALIFICATIONS)
This Intergovernmental Agreement establishes a services contract between the Virginia Department of
Emergency Management and City of Roanoke for the loan of this city employee for the time periOd identified
above.
(List of Employees, see attached) shall remain an employee of the City of Roanoke throughout their
deployment. City of Roanoke or (list of employees, see attached) hereby agrees to make the necessary
travel arrangements for (list of employees, see attached), including airline, lodging and rental car, if
authorized. Per diem expenses and other necessary miscellaneous expenses will be paid by City of Roanoke
or (list of employees, see attached). Once the service is complete and the City employee submits his/her
travel expense report, VDEM agrees to submit the travel expense report to the Louisiana Emergency
Management Agency for reimbursement through the EMAC reimbursement process. The City employee will
continue to be paid by his/her city employer, will continue to receive the same benefits as if working at his/her
home station, and will carry with him/her all the liability protections of a city employee as if working at his/her
home station. VDEM assumes no responsibility for this city employee other than, the submission of completed
travel expense reports through the EMAC reimbursement process, and the transmittal of reimbursement from
the State of Louisiana to the City of Roanoke. (List of employees, see attached) will report to the Calcasieu
Parish upon arrival and perform duties as assigned. The EMAC A-Team will provide emergency contact
information for (list of employees, see attached) and (list of employees, see attached) will provide contact
information and progress reports on their service throughout the periOd of deployment.
REIMBURSEMENT:
Upon receipt of reimbursement from the State of Louisiana, VDEM shall transmit that reimbursement to City of
Roanoke in a final amount for the authorized expenses claimed on the employee travel expense report
(including salary and benefits), when reimbursement is received from the Louisiana Emergency Management
Agency. Reimbursement shall not exceed the final, total amount indicated on the travel expense report. City
of Roanoke shall submit a final invoice or other appropriate travel expenses report, with all appropriate
documentation, to VDEM within 30 days of (list of employees, see attached) return to City of Roanoke.
VDEM shall reimburse City of Roanoke within 30 days of receipt of reimbursement from the State of Louisiana.
ALTERATIONS AND AMENDMENTS
This Agreement may only be amended by mutual agreement of the parties. Amendments shall not be binding
unless they are in writing and signed by personnel authorized to bind each of the parties.
TERMINATION
Either party may terminate this Agreement upon 30 days' prior written notification to the other party. If this
Agreement is so terminated, the parties shall be liable only for performance rendered or costs incurred in
accordance with the terms of this Agreement prior to the effective date of termination.
IN WITNESS THEREOF, the parties hereto have executed this agreement on the day and year last
specified below. This Agreement contains all the terms and cond~ions agreed upon by the parties. No other
understandings, oral or otherwise, regarding the subject matter of this Agreement shall be deemed to exist or to
bind any of the parties hereto.

]. As set out in the City Manager's ]etler to Council dated June 5, 2006, the market
spacc fees for the use of spaces at the Roanoke City Market shall be, and hereby are, amended,
effective on July 1, 2006, to provide that the Fees for Daily Permits shall be as follows:
DAILY PERMIT:
. Sunday through Thursday - $10.00 per space per day.
. Friday and Saturday - S 15.00 per space per day.
The Fees for the other Permits, the Spreading Fee, and the Cleanup Fee referred to in
Resolution No. 37263-120505, adopted on Dccember 5,2005, continue as set forth therein.

Market Operations on Sundays
Background:
Downtown Roanoke, Inc. (DR) is the City's operator of the Historic Roanoke
City Market (Market) area spaces. DRI has received many requests from market
vendors, storeowners, and others to provide for regular Sunday operating hours
for the Market. In response, DRI has been coordinating, under a Special Event
Permit for DRI, for use of the Market area on Sundays from 10 A.M. to 4 P.M. by
various vendors since March 20, 2006, to see what the response would be to
Sunday hours. The response has been very good.
In view of the positive response, DRI has requested that the City amend Section
24-64, Code of the City of Roanoke (1979), as amended, to change the days of
operation from Monday through Saturday to Sunday through Saturday on a
regular basis. DRI has also requested that City Council amend the Fee
Compendium for Fees for use of Market Spaces to reflect Sunday operations.
Such change would only require that the current Daily Permit Fee reflect that
the Daily Permit Fee of $10.00 per space per day would now apply to Sunday
use as well as Monday through Thursday use. The fees for Friday and Saturday
use and other permits would remain the same. Such changes will provide for
more activities to be available for the Downtown area on Sundays. DRI has
requested these changes be effective July 1, 2006.

Recommended Action:
Amend Section 24-64, Operating hours, of the Code of the City of Roanoke
(1979), as amended, to change the days available for operation of the Market
from Monday through Saturday to Sunday through Saturday, with the days and
hours for the operation of the Market to be established by the City Manager, as
set forth in such Code Section.
City Council approve the above requested change for market space fees and
amend the Fee Compendium to reflect such change. City Council provide that
the effective date for the above changes will be July 1, 2006.

Additional State Funding
for Social Service Programs
Background:
Social Services, through our Foster Care Program, provides out-of-home
placements for children who are in need of protection and can no longer live at
home. For those children who are deemed eligible for Title IV-E funding, the
Federal and State governments will reimburse localities for the costs of out-of-
home placements at 100% of the maintenance, day care and visitation-related
transportation. Federal and State funding is also available to assist with
maintenance costs and special needs for adoptive families and assist with
refugee resettlement.
Considerations:
The City of Roanoke will receive additional funding for Foster Care, Special
Needs Adoption, Subsidized Adoption and Refugee Resettlement for FY 2005-
2006 in the amount of $355,000. Social Services currently maintains over 600
children who are in Foster Care or who receive some type of adoption
assistance and the cost of providing services to these children continues to
increase. Many of these children have difficulties which require special needs
payments.

Programs
Background:
The City of Roanoke Outreach Detention/Electronic Monitoring and
Sanctuary/Crisis Intervention Programs provide court-ordered, pre-dispositional,
intensive supervision of juveniles living within the community. Program services
are provided to juveniles who reside in the City of Roanoke and other
jurisdictions such as: Roanoke County, Botetourt, Salem, Craig County, and
Alleghany County. Each outside jurisdiction pays for the services provided. The
FY 2005-06 revenue estimate for Outreach Detention/Electronic Monitoring
Services is $50,000. The FY 2005-06 revenue estimate for Sanctuary/Crisis
Intervention is $30,000. It is anticipated that actual revenue for Outreach
Detention/Electronic Monitoring will exceed the estimate in the amount of
$9,850. It is also anticipated that actual revenue for Sanctuary/Crisis
Intervention will exceed the estimate in the amount of $13,000.
Considerations:
In accordance with state mandates, all program revenue must be used for
services that are specifically outlined in the board approved VjCCCA plan. The
excess revenue must be appropriated for program activities.

Background:
A local emergency was declared in the City of Roanoke on September 28, 2004
as a result of flooding. Cleanup, debris removal and repair efforts were initiated
by city departments following the flooding. The Virginia Department of
Emergency Management (VDEM) was notified by the Governor's Office that state
funding was approved to assist the City of Roanoke in clean up required
following the flooding. The approval was for 72% of eligible costs up to
$504,000.
Over the course of several months, supporting documentation regarding flood
related expenditures was subsequently collected. Final expenditure
documentation was available in recent months and a complete request was
submitted to VDEM. VDEM has notified the City of Roanoke that funding in the
amount of $115,642 is being provided as a reimbursement for expenses
incurred. This reimbursement represents 72% of total eligible expenses of
$160,613 incurred during the prior fiscal year.
Additional flood insurance proceeds have also been received in the amount of
$50,168 for repairs to the National Guard Armory.

A budget adjustment for motor fuels in the amount of $296,800 was made on
March 20, 2006. As a result of a cost increase since the prior adjustment, it is
anticipated that motor fuel expenditures will exceed the current budget in the
amount of $100,000. The Fleet Management Fund revenue and expense
budgets will need to be adjusted, and funding in the amount of $95,500 will
need to be allocated in the General Fund to cover its share of motor fuel
billings. The remaining $4,450 will be billed to the Roanoke Redevelopment
and Housing Authority, Roanoke Valley Resource Authority, Roanoke Valley
Detention Commission, Civic Center Fund, and Department of Technology
Fund.
Recommended Action(s):
Adopt the accompanying budget ordinance to establish a revenue estimate of
$115,642 from VDEM in the General Fund and increase the revenue estimate for
Flood Insurance Proceeds in the Capital Projects Fund in the amount of
$50,168. Appropriate $50,168 to Facilities Management (BCAP) (008-440-9854-
9003) in the Capital Projects Fund.
Increase the revenue estimate for Fleet Management Billings for Motor Fuels
(017-110-1234-1279) by $100,000. Appropriate funding in the amount of
$100,000 to Fleet Management Motor Fuels (017-440-2641-3013). Appropriate
funding in the amount of $95,550 to General Fund department motor fuel
accounts as documented on Attachment A and $20,092 to Contingency (001-
300-9410-2199).

Dear Mayor Harris and Members of Council:
Background:
Over the years, several automotive dealers have been gracious enough to
donate the use of motor vehicles to the City for use in our community oriented
policing and crime prevention efforts at a cost of either one dollar per year or
one dollar per month. The citizens of the city of Roanoke have benefited from
these gracious donations through increased police presence and enhanced
community support in our neighborhoods.
In support of the City's mission to develop public/private partnerships
and to enhance community oriented policing efforts within the community, a
local car dealership has offered to donate the use of one vehicle to this effort.
Considerations:
The conditional offer includes a mileage stipulation regarding the usage,
whereby the mileage shall not exceed 15,000 miles per year. Mileage will be
monitored on a monthly basis to ensure this conditional requirement is met.

Recommended Action:

Subject: Resolution in Support of Railroad
Industrial Access Application by FreightCar
Roanoke, Inc.
Background:
FreightCar Roanoke, Inc., presently located in the former Norfolk Southern East
End Shops in the City of Roanoke, produces aluminum railroad cars. In
February 2005, City Council adopted Resolution No. 36961-020705 in support
of FreightCar Roanoke, Inc. 's application for Railroad Industrial Access Funds of
up to $450,000. Those funds have been received and used. The site now
needs an additional rail line costing approximately $600,000 to increase
production. FreightCar Roanoke, Inc. has approached the City of Roanoke to
support its application to the Virginia Department of Rail and Public
Transportation (DRPT) Railroad Industrial Access Program for funds to help
defray a portion of this cost. This application must be supported by the City for
the industry and be accompanied by a resolution from the local governing
authority in support of the application. The City will not incur any monetary
obligation to provide any part of these funds.
Considerations:
The company will invest $600,000 over and above their original $5.45 million
and retain their 440 employees. As part of this project, the company is again
requesting $300,000 in Industrial Access Railroad Track Funds from the
Department of Rail and Public Transportation (DRPT). In addition, if the

company spends an additional $300,000 in upgrading the railroad track, the
company is requesting DRPT to grant it additional monies equal to $150,000.
Recommended Action:
Adopt a resolution in support of such application.
Authorize the City Manager to execute and/or provide appropriate documents
for the Virginia Department of Rail and Public Transportation for the Railroad
Industrial Access Program in connection with FreightCar Roanoke, Inc. 's
application to assist the company in obtaining up to $450,000 in Program
funds and to state the City's support for FreightCar Roanoke, Inc. receiving
such Program funds from the Commonwealth.

WHEREAS, by Ordinance No. 25043, adopted April 7, ]980, this Council adopted and
enacted a new code for the CiTy of Roanoke entitled the Code of the City of Roanoke (1979)
(hereinafter sometimes referred to as the "City Code");
WHEREAS, such Code, as amendcd, contains ccrtain provisions which incorporate by
reference portions of the Code of Virginia (1950), as amended, (hereinafter "Statc Code");
WHEREAS, from time to time, certain of these Slate Code sections which are
incorporatcd by reference in the City Code have becn amended by the General Assembly;
WHEREAS, such amendments are a matter of public record which are set forth in the Acts
of Assembly and supplements and replacement volumes of the State Code; and
WHEREAS, it is the desire of this Council that those provisions of the City Codc which
adopt by referencc State Code provisions shall be fully consistent with enactments of the most
recent Session of the General Assemb]y;
THEREFORE, BE IT ORDAINED by the Council of the City of Roanoke that:

City Clerk's OfJice, cOIisisting of Chapters I through 36.2, each inclusive, is hereby readopted and
recnacted. Such Code amendments herctoforc and hereafter adoptcd shall continue to be known as the

2. With respcct to sections or provisions of the State Code incorporated by reference in
the City Code, Council recognizes any amendments made to such sections or provisions of the State
Code by the most recent Session of the Genera] Assembly and hereby expresses the intent and ordains
that such amendments to sections or provisions of the State Code incorporated by reference in the City
Code shall be included in the City Code verbatim as enacted by the most recent Session of the General
Assembly. .
3. Any reference in the City Code to any section, article or chapter from f0n11er Titles of
the State Code shall be deemed and construed to apply to the successor section, article or chapter of the
State Code, comparable sections being set out in Tables of Comparable Sections for certain Repealed
and Revised Titles published in Volume 10.

and for the benefit of the City the condition and covenants contained in the deed dated March 15, 1941,

recreational uses.

Subject: April Financial Report
The adopted budget for the fiscal year 2006 totaled $223.8 million representing a 5.7%
increase over the previous year's adopted budget. The following narrative provides
commentary on the significant events of this period.
Revenue~
Revenues through April 2006 increased .8% compared to the prior fiscal year. This
revenue growth is affected by the Commonwealth's change in methodology regarding
the Personal Property Tax Relief Act (PPTRA) allocation. In prior years, amounts were
remitted to the City by the Commonwealth upon payment by the taxpayer of their
share of personal property taxes. As such, PPTRA was collected from the state on an
ongoing basis. Furthermore, by using accrual accounting to record personal property
tax revenues, the City recognized revenue at the time of billing, typically mid-April of
each year. Under the new allocation method effective with the current personal
property tax year, the City will receive its share of 2006 PPTRA in July/August. This
revenue will be recorded as revenue in FY06 via an accounting accrual. As mentioned
previously, this change is not expected to have an overall negative effect on the City's
revenue, although 'We will forgo some interest earnings due to the delay in receiving
the cash. As a reminder, due to the cap on PPTRA funding from the state, citizens will
receive 66.19% PPTRA relief on qualifying vehicles as opposed to 70% as in previous
Years, Adjusted for this fairly significant change, General Fund revenues grew 5.4%,

consistent with the growth anticipated in the budget. Additional variances from the
prior year are addressed as follows:
General Property Taxes increased 8.3%, led by growth in the real estate tax. The first
installment of the tax was due October 5 and the second installment was due on April
5. Real estate tax revenue has increased 9.0% as of April 30 as a result of growth in
reassessments and new construction for the year. Personal property tax bills were
mailed on April 17, and the tax due date was May 31. Personal property taxes
decreased through April; however, the majority of collections will be reported on the
upcoming month's report. We anticipate modest growth in this major revenue source.
Other Local Taxes increased 7.6% through April. The Prepared Food and Beverage tax
rate increased from 4% to 5% effective July 1, 2005. Through April, this rate increase
has provided approximately $1.5 million in additional revenue and is on target to
provide total growth of $2 million this fiscal year. Exclusive of the rate increase,
Prepared Food and Beverage tax increased 6.9%, excellent growth in this important
local tax. Sales tax collections increased 5.8% compared to the prior year, also
providing a positive indication of the health of the local economy. The Business,
Professional and Occupational License tax (BPOL) was due March 1, 2006. The revenue
from this tax has increased 7% from the prior year and exceeds the revenue estimate.
Also indicative of a positive trend in our economy is 13.5% growth in the Transient
Room Tax, which is influenced by positive performance at local hotels in terms of both
room rates and occupancy levels. This revenue has also benefited from the results of
ongoing tax audits.
Revenue from the Use of Money and Property increased significantly over the prior year
as a result of interest income on the Budget Stabilization Reserve. The reserve was
established in late FY05 by transfer of funds from the Debt Service Fund to serve as a
funding source for emergencies or unforeseen decline in revenues. Additional rental
income from the Commonwealth Building also contributed to the variance.
Grants-in-Aid Commonwealth decreased 19.6% due to the aforementioned change in
PPTRA and the impact of using accrual accounting in the past to recognize PPTRA
revenues when taxes were billed in April. Also in this category, revenues provided by
the Commonwealth of Virginia Compensation Board grew due to an increase in the
percentage of salary expenditures eligible for reimbursement. AFDC Foster Care and
Employment Services revenues also grew. These social services revenues are directly
related to an increase in reimbursable expenditures related to adoption and
employment services.

Miscellaneous Revenue decreased 15.2% due in part to the adoption of the Economic
and Community Development Reserve Policy during the latter part of Fiscal Year 2005.
This policy accounts for revenue from small property sales in the Capital Projects Fund
where the reserve is maintained rather than the General Fund. A timing difference in
the collection of the Roanoke Redevelopment and Housing Authority's payment in lieu
of taxes also contributed to the decline.
EXPenditures
General Fund expenditures, as a whole, increased 5.7%. All departments are affected
by the 3% average pay raise granted to City employees beginning July 1, 2005.
Fire/EM5 and Sheriff/Jail employees also received an additional 4% raise effective
January 1, 2006. A change in the billing methodology of the Fleet and Department of
Technology (Don funds also affects user departments. Effective with FY06, Fleet and
DOT began billing user departments for capital outlay rather than a Nondepartmental
lump sum transfer as in prior years. This causes a decline in the Nondepartmental
category and an offsetting increase in numerous other categories throughout FY06.
Other variances between FY05 and FY06 are addressed as follows:
General Government expenditures grew 7.7% due to the aforementioned increases in
the personnel costs and internal service charges. Additionally, City expenditures for
Cable Television Educational Access (RVTV) are now recorded as a function of the
Office of Communications." In prior years, this expenditure was accounted for under
Community Development.
Public Safety expenditures are 7.8% higher in the current year due to the
aforementioned increase in salaries. Additionally, the Jail has experienced an increase
in the cost of prison health care services, and capital maintenance and equipment
replacement spending in the Police Department is higher in the current year.
Parks, Recreation and Cultural expenditures increased 15.3% in part due to the
reclassification of expenditures for Event Zone, Virginia Amateur Sports, as well as
other recreational related subsidies from Community Development to Parks and
Recreation Administration. An increase in special project expenditures for Youth
5ervices contributed to the variance, as well as higher personnel costs for the Libraries
due to the reclassification of several existin9 positions and the addition of new
positions.
Transfer to Debt Service Fund expenditures increased 12.6% primarily as a result of
debt service on the 2004B issue which began in July 2006.

Nondepartmental expenditures declined 13.4% due to a decrease in the amount of
undesignated fund balance transferred to the Capital Projects Fund. The
aforementioned change in internal service billing procedures also contributed to the
variance.

Affirmation of Office which may be administered by the Clerk of the Circuit
Court of the City of Roanoke, located on the third floor of the Roanoke City
Courts Facility, 315 Church Avenue, S. W.
Please return one copy of the Oath of Office to Room 456 in the Noel C. Taylor
Municipal Building, 215 Church Avenue, S. W., prior to serving in the capacity to
which you were reappointed.
Pursuant to Section 2.2-3702, Code of Virginia (1950), as amended, I am
enclosing copy of the Virginia Freedom of Information Act. The Act requires
that you be prOVided with a copy within two weeks of your appointment and
each member is required "to read and become familiar with provisions of the
