Due to the lack of a quorum, the Vice-Mayor proceeded with the briefing regarding
Market Garage Repairs.
A communication from Mayor C. Nelson Harris requesting that Council convene in
a Closed Meeting to discuss vacancies on certain authorities, boards, commissions
and committees appointed by Council, pursuant to Section 2.2-3711 (A)(1), Code
of Virginia (1950), as amended, and more specifically to consider appointments to
the Local Board of Building Code Appeals, Roanoke Civic Center Commission,
Youth Services Citizen Board, Board of Zoning Appeals, City Planning Commission,
Blue Ridge Behavioral Healthcare Board of Directors, Roanoke Valley Resource
Authority, and Roanoke Arts Commission.

Smarter Lighting: A Bright Idea
One of ttle cijsiest and cheapest places to start saving energy IS wltl, ligllting.
Replace your most frequently used incandescent bulbs with compact fluorescent lights.
Compact fluorescent light. bulbs about one-fourth as mucll electncity as a ständard incandescent bulb.

easily pay for Itself. If every householf..1 in ttle U.S. replaced one light bulb with a compact fluorescent light
bulb (CFL), it would prevent" enough pollution to equal t.he removal of one million cars from the road.
Replace outdoor lighting with a motion-detector equipped bulb or fixture.
Outdoor lights that are left on ñll night can add unnecessary waste energy and disturb wildlife. You c:ñn
safely and efficiently light t.he outside of your home by installing light fixtures that are activated by mot.ion
sensor or a timer. These devices will keep areas well lit when you need them to be while reducing your
energy bill
Hot Water shouldn't be a drain on your wallet.
Over lO'lfo of your energy bill goes to heating water for your dishwasller, sllower, find faucets. You can cut
this energy use, and your energy bill, by implementlllg these easy steps.
Lower your hot water heater to 120 degrees and drain any sediment.
Though you need to keep your water heater above 120 degrees to prevent bacteria from building up,
many hot water heaters are set too high. Draining some water a few times a year reduces sediment and
increases efficiency. .
Add insulation to your hot-water heater.
The standard hot water heater is on all tile tUlle, adding extra insulation will save more energy than you
think. Most hardware stores sell pre-made Insulator "jackets" that can be easily wrapped around one's
water heater. Adding insulation to your water heater and any exposed pipes can knock up to 15 percent
off the costs of heating water.
Install a low-flow shower head,
Low-flow shower heads are also a worttlwtlile investment (especially for renters, because you can take
them with you) that will redLJr.~ the amount or hot water you use and hence the energy nceded to heat it,
and it will Save water.
Heat your home - Not the planet.
Heating and coolinç your home is the single largesl expense on your energy bills. But taking steps to
weatheri7c your horne, you can make keeping your home a r.omfortable temperature easier and ctleaper.
Check for and seal any cracks or gaps.
Heating one's home is the single largest use of energy for the average customer. Tiny gaps and cracks in
an older home are roughly equivalent to a one-foot square hole punched in your wall, which means that
sealing gaps with caulking and weather stripping makes a big difference in keeping the heat inside your
home and saves you money.
Windows of opportunity
Ir YOll invest in top quality windows, you'll see a big difference (through tIle windows and in your heating
and cooling bills, too). A cheaper and easier method than replaCing windows is to insulate your windows

Wise transportation choices can help curb
global climate change, reduce air pollution, and save you $$$!
Automobile emissions are a major contributor to greenhouse gas emissions that cause global
climate change, unhealthy air; and visible air pollution. Here are some Ideas to help you cut
back your share of the pollution (they'll save you money at the pump, toO):
1. Drive Friendly! When you drive aggressively, you waste gas and put others at risk.
Observe the speed limit, avoid rapid acceleration and braking, and maintain a constant speed.
2. Keep Your Car in Shape. A well-tuned car burns less gasoline; make sure that you get
your oil and air filters changed regularly and that your tires are always properly inflated.
3. Change Your Commute. Sitting in rush hour traffic burns gas and gets you nowhere. If
possible, adjust your work schedule so that you avoid rush hour traffic. Even better, think
about telecommuting. If you can't telecommute full-time, try for one or two days a week.
4. Use Public Transportation. Look into the public-transportation options in your area, and
use them as much as possible. If you find that publiC transportation doesn't meet your needs,
tell your elected officials what improvements you'd like to see.
5. Combine Errands. According to the Department of Energy, several short trips taken from
a cold start can use twice as much fuel as a longer, multipurpose trip covering the same
distance when the engine is warm. Delay low-priority errands until you can make a multi-
purpose trip.
6. Go for a Ride or Walk. Rather than drive your car to the corner store or a friend's house,
walk or ride your bike there. You'll save money, reduce your contribution to pollution, stay in
shape, and feel great'
7. Carpool. Share a ride to work or school with neighbors or co-workers. Look into ride share
services provided by Ride Solutions at http://www.ridesolutions.org/carpooling.shtml or call
866-424-3334.
8. Pack Light. According to the Department of Energy, a loaded roof rack on your car can
decrease fuel economy by approximately five percent. Also, every 100 pounds you carry in a
car reduces a typical car's fuel economy by one to two percent. So, when you go on vacation
or a long car trip, put everything you can inside your vehicle, and pack light
g. Think Hybrid. The most fuel-efficient vehicles on the road today are hybrid-electric cars. A
hybrid combines an eiectric motor with a conventional, but cleaner, gasoline-powered engine.
Over its lifetime, a 50-mile per gallon hybrid will use half as much gas and release half as
much global-warming pollution, as a typical 2s-mpg sedan.
Hot Tip: If you purchase a hybrid, you may be eligible for a new federal tax credit (as
opposed to the previous tax deduction) tl1at could be worth as much as $3,000.
10. Go for the mileage. Even if a hybrid car isn't in your budget, you can still save a bundle
and reduce emissions by making sure that your next car, new or used, is a fuel efficient model
in your chosen class; and avoid buying a larger car than your really need. Many late model
small sedans have excellent safety records.
Bonus: Write Your Leaders. Urge them to raise fuel economy standards to 40 miles per
gallon. Modern technology can make our cars and trucks go farther on a gallon of gas. Taking
this step would save nearly 4 million barrels of oil a day -- more oil than we currently import

Rescue Squad Assistance Fund
Grant Acceptance
Background:
The Virginia Department of Health, Office of Emergency Medical Services
administers a Rescue Squad Assistance Fund (RSAF) grant program that awards
grants twice annually. The State Office of Emergency Medical Services has
awarded Roanoke Fire-EMS a grant in the amount of $19,500 towards the
purchase of two additional 12 Lead EKG Defibrillators. This medical monitoring
equipment will require a $19,500 local match. Funding for the local match is
budgeted in Local Match Funding for Grants (35-300-9700-5415).
Considerations:
City Council action is needed to formally accept and appropriate these funds,
and authorize the Director of Finance to establish revenue estimates and
appropriate accounts to purchase the equipment and supplies in accordance
with provisions of this grant.
Recommended Action:
Accept the grant as described above and authorize the City Manager to execute
any required grant agreements or documents such to be approved as to form
by the City Attorney.

Adopt the accompanying budget ordinance to establish revenue estimates in

Matching Program
Dear Mayor Harris and Members of City Council:
Background:
Employees can stretch their income, reduce their healthcare and childcare
costs, and pay less in taxes by utilizing the City's healthcare Flexible Spending
Account (FSA) program. The FSA program allows employees to set aside pre
tax dollars to assist in paying healthcare or childcare costs. Unfortunately, only
100 employees are currently taking advantage of this opportunity - a
participation rate of 5%. The Human Resources Department is requesting that
Council authorize matching employees' healthcare FSA contributions up to $5
per pay period ($130 per year) in order to provide an incentive to participate.
Due to tax consequences, childcare is not included in this request. With the
City's participation in a qualified healthcare flexible spending plan, this benefit
to employees will be exempt from federal, state and social security taxation. A
participation rate of up to 38% is anticipated (684 employees) with the incentive
program. This additional benefit will be funded by savings through the City's
health claims experience as a result Of increasing the stop loss coverage in the
City's health insurance program from $150,000 to $200,000 for the 2007
contract year. Stop loss coverage refers to the coverage obtained by the City
for a premium to cover claims in excess of a certain amount. By increasing the
level of our stop loss limit, we are able to pay a lower premium for such
coverage. Thus, this savings creates funding for the match to flexible
spending. Based on recent claims history, the City's health care consultant
recommended that we increase our stop loss level.

Considerations:
This relative small investment may serve as an incentive for significant savings
in healthcare costs for our employees. City Council action is needed to
authorize this additional benefit.
Recommended Action:
Adopt the attached resolution, authorizing this program, effective January 1,
2007, to provide the benefit as described above to employees.

lane, \i.E., to L & L Deyelopment Corporation, by a quitclaim decd, for the consideration of
$25.000.00;

serve this neighborhood arc laid out, sewer is not directly available to this lot without an extension of
one of the systems;
WHEREAS. the cost estimate provided by the Westcrn Virginia Water Authority to extend
thc nccessary facilities to provide sewer service to this lot is approximately $26,000.00, which is
greater than the value of the lot itself;
WHEREAS, this lot cannot be developed without incurring the expense of extending the

WHEREAS, L & L Development Corporation has indicated it is not feasible to develop the

On July 17, 2006, by Ord. No. 37503-080706, Council approved the
conveyance of property located on Nelms Lane, NE, to L & L Development
Corporation, for $25,000, containing approximately 0.2457 acres that was
formerly used by the Water Department as the site of a water storage tank.
Subsequently it was discovered that because of how the two sewer systems
that serve this neighborhood are laid out, sewer is not directly available to this
lot without an extension of one of the systems. The cost estimate provided by
the Western Virginia Water Authority to extend the necessary facilities to
provide sewer service to this lot is approximately $26,000, which is greater
than the value of the lot itself. (See Attachment #1). This lot cannot be
developed without incurring the expense of extending the sewer line. L & L
Development has indicated it is not feasible to develop the lot for a single
family home while incurring the costs of the land, removal of remaining
foundations from the former water tank, and extension of the sewer line.
In order for this city-owned parcel to be conveyed for development of a single
family home and to provide a feasible means to have the lot be developed and
returned to the, tax base given the extraordinary development costs, it is
reasonable to convey the property at a nominal charge (not exceed S 10.00) to L
& L Development.

Corporation at no cost, and authorize the City Manager to execute the

Subject: Comprehensive Roadside
Management Program
Background:
The Comprehensive Roadside Management Program was developed by the Virginia
Department of Transportation (VDOT) to provide the private sector with the
opportunity to work through localities to landscape portions of interstate highways and
other state-maintained primary routes. Locally, Lamar Outdoor Advertising and Cycle
Systems have both expressed interest in contributing to specific landscape
improvements. These landscape plans have been modeled after the concepts
recommended in the original "Gateway to Roanoke"' document that had previously been
shared with City Council.
VDOT regulations require a formal resolution from City Council endorsing the
proposed landscape plans, to be adopted subsequent to a public hearing during which
the proposed landscaping activities are made available for review. Staff held such a
public hearing at the Public Works Service Center on Tuesday, October 3, 2006. Based
upon there being no opposition, staff is prepared to seek Council's endorsement.
Recommended Action:
City Council endorse the landscape plans as presented at the public hearing.

WHEREAS, the City, the IDA (the IDA is changing its mune to the Economic
Development Authority of the City of Roanoke, Virginia), (EDA), and Th1D entered into a

IMD's proposed development of certain property mentioned therein, and which was subjcct to

Background:
The City, IMD Investment Group, LLC (IMD), and the Industrial Development
Authority of the City of Roanoke, Virginia (IDA), whose name is changing to the
Economic Development Authority of the City of Roanoke, Virginia (EDA), entered
into a Performance Agreement dated November 18, 2004, regarding the
development of certain property on the corner of Wonju Street and Franklin
Road, SW, to include a Ukrop's grocery store in what is called the Ivy Market
shopping center. Due to unanticipated time delays related to the various
environmental approvals required for this project at the state and federal levels,
which IMD has indicated was beyond the control of IMD, certain time extensions
for completion of three of IMD's first phase obligations have been requested by
IMD.
Such time extensions will provide a Ukrop's Super Markets grocery store with a
minimum of 58,000 square feet be open to the public on or before July 31,
2007; a drug store, anticipated to be a Walgreen's, be open to the public on or
before September 30, 2007; and IMD spend or cause to be spent $3 million on
infrastructure costs on the property and one-floor structured parking below
ground level on or before July 31, 2007. All other terms of the November 18,
2004, agreement will remain in effect.

Recommended Action:
Approve IMD's requested time extensions and the terms of Amendment NO.1
to the Performance Agreement as set forth in the attachment to this letter.
Authorize the City Manager to execute an Amendment NO.1 to the

substantially similar to the one attached, with the form of such Amendment No.
1 to be approved by the City Attorney.
Authorize the City Manager to take such actions and execute such documents
as necessary to implement, administer, and enforce such Amendment No.1 to

Subject: September Financial Report
September completes the first quarter of the fiscal year. There are several notable economic
indicators that warrant mention. The Federal Reserve's most recent Open Market Committee
meeting left the benchmark interest rate unchanged at S.25 percent for the third consecutive
meeting, following 17 consecutive rate increases. Although economists expressed concern
over moderating economic growth and inflation pressures, there are a number of positive
indicators. Oil prices have fallen to their low for the year, dropping to the 560 per barrel
range. Unemployment rates as of August were reasonable at 4.3%, 3.2% and 4.6%,
respectively, for Roanoke, Virginia and the nation. The Dow recently reached a record close,
exceeding 12,000. Strong earnings reports are being posted by many blue chip
corporations. Thirty-year mortgage rates are currently just above 6%, and twenty-year
double A bonds are currently selling in the 4.5% range, still comparatively low rates. There
have been numerous recent articles on the housing market. Sales have slowed, inventories
of unsold houses have increased and some of the hot markets in California, Arizona, Florida
and the northeast are seeing price decreases. Although housing in the Roanoke Valley did
not have the run-up in prices ,equivalent to some parts of the country, sales have slowed
from a year ago. According to the Roanoke Valley Association of Realtors. September sales
of residential units dropped 19% compared to sales of a year ago. However, the current level
of sales was characterized as more of a return to normal as opposed to the "bubble
bursting." Similarly, single family housing sales in the City have decreased 16% for the
period January through September 2006 compared to the same period a year ago.
At the state level, according to the Secretary of Finance's monthly financial report, revenues
grew 3,0% for the first quarter, in line with the adjusted annual estimate of 3.1%. Jobs grew
slightly less than expected, although claims for unemployment dropped slightly. Sales tax.
which makes up 20% of the general fund budget, grew 3.8% compared to a 6,0% estimate.
Both individual and corporate income taxes are significantly ahead of budget. Recordation
taxes generated from real estate transfers have slowed dramatically. In general. although
the state is still experiencing a reasonable level of growth, there is definitely a slowdown in

economic growth compared to the previous year, much of which is attributable to a
slowdown in the housing market,
Relative to the City's budget, the adopted budget for fiscal year 2007 totals $239,6 million
representing a 7,1 % increase over the previous year. Additional revenue sources include a
projected increase in Real Estate and Personal Property tax revenue, as well as projected
growth in various local taxes including Sales tax, Business License tax, and Prepared Food
and Beverage tax. Funding from the Commonwealth will also increase, particularly in the
area of funding for social services. The aforementioned additional revenues will be allocated
in part to provide for capital maintenance and equipment replacement, to enhance services
to citizens, and to fund salary increases for employees. Furthermore, the FY07 budget
provides for greater social services program funding and the resources necessary to meet
the current year's debt service requirements.
Revenues
Revenues for September 2006 increased 4.2% compared to the prior fiscal year, Some
revenues vary due to the year-end accrual reversals and additional variances from the prior
year are addressed as follows:
General Property Taxes increased 9.S% as a result of growth in reassessments and new
construction. The first installment of the real estate tax was due October S. This tax is
expected to grow by approximately $4.8 million as a whole in FY 2007, and actual growth
has followed this trend for the first quarter of the fiscal year,
Other Local Taxes increased 1.7% in the current fiscal year, Growth in this category on a
year-to-date basis is mitigated somewhat due to a timing difference in receipt of September
telephone utility taxes and E-911 taxes for FY07. The Cigarette Tax increased from 27 cents
to 54 cents per twenty pack effective July 1, 2006. This rate is commensurate the other
Virginia First Cities. Sales tax revenue increased approximately 11.5% through September.
Sales tax growth for FY2006 was approximately 5%. Although fiscal year-to-date sales tax
received from the state substantiate the 11.5% growth rate, I suspect this is due to some
anomaly and I am doubtful we will sustain this level of growth through the current fiscal
year. Also adding to the growth in this category are increases in both Transient Occupancy
and Prepared Food and Beverage tax revenues.
Fines and Forfeitures increased 10.1 % in part due to higher collections of delinquent tax
fees, Higher revenue from General District Court fines also contributed to the variance.
Revenue from the Use of Money and Property increased over the prior year due in part to
several lease renewals in the Commonwealth Building as well as a timing difference in the
collection of Health Department rent. The City also benefited from higher interest rates in
the current year,

Grants-in-Aid Commonwealth decreased 5.6% due to an earlier receipt of Comprehensive
Services Act revenue in the prior fiscal year versus the current year. This category of revenue
is anticipated to increase 11.2% for FY07.
Charges for Services revenues decreased 8,6% primarily due to an earlier collection of
revenues related to housing prisoners of other jurisdictions in the prior year versus the
current year. A timing difference in demolition and weed cutting billings also lent to the
decrease.
Miscellaneous Revenue decreased 14.4% in part as a result of a one-time collection of
surplus tax sale proceeds in the prior fiscal year, Additionally, timing of the Building New
Partnership Conference contributed to the variance. This City-sponsored conference took
place in FY06 and is scheduled to occur next in FY08.
Expenditures
General Fund obligations as a whole increased 10.6%. The FY07 expenditure budget
includes funding of approximately $1.2 million to cover contracts and purchase orders made
during FY06 but not paid by the end of that year. City Council approved re'appropriation of
this funding when adopting the General Fund budget in May. Additionally, General Fund
expenditures of all departments are affected by the aforementioned pay raise. Other than
these items which affect most categories of expenditures, variances between FY06 and FY07
are addressed as follows:
Judicial Administration expenditures increased 19.3% due in part to a timing difference in
payments for juvenile detention costs. An increase in the number of juveniles housed at the
Roanoke Valley Juvenile Detention Center in the current fiscal year also contributed to the
variance.
Public Safety expenditures increased 11.2% due in part to the aforementioned pay raise, as
well as an increase in the cost of prison health care services and food purchases.
Public Works costs increased 46.5% as a result of the contract for Paving Program
expenditures being encumbered earlier in the current year than prior year.
Health and Welfare costs grew 8.9% due to increased ADC Foster Care and Special Needs
Adoption expenditures as a result of a higher rate of child placement. Additionally,
payments associated with foster care and adoption costs are based on the needs of the child
and can be high when special medical care is required.
Community Development expenditures increased 30.0% due to a timing difference in the
second quarter subsidy payment to the Convention and Visitors Bureau, as well as the
movement of Department of Management and Budget personnel to Housing and
Neighborhood Services.

Transfer to Debt Service Fund expenditures increased 12,0% primarily as a result of
increased debt service payments.
Nondepartmental expenditures varied due to a decrease in the transfer of capital
improvement project funding to the Grant, Technology, and Fleet funds.

Roanoke, Virginia; and dispensing with the second reading by title of this ordinance.
WHEREAS, the Indw;trial Dcvelopment Anthority of the City of Roanoke,
Virginia (the "Authority''), a political subdivision of thc Commonwealth of Virginia. was
created by Ordinance No. 18391 of the Council on Octobcr 2], ]968, pursuant to the
Industria] Development and Revenue Bond Act (Chaptcr 33, Title 15.1, Code of Virginia,
1950, as amcnded);
\VIIEREAS, on October II, 2006, the Directors of thc Authority passed a
resolution requesting Council to authorizc changing the name of the Authority;
WHEREAS, Section 15.2-4903 of the Codc of Virginia, 1950, as amended,
authorizes the goveming body of the City of Roanoke, Virginia, to eh¡mge the name of the
AUlhorÜy to the Economic Deve]opment AuthorÜy of the City of Roanoke, Virginia, if it
so chooses; and
WHEREAS, Council lìnds that changing the name of thc Industrial Development
Authority of the City of Roanoke, Virginia, to the Economic Deve]opment Authority of the
City of Roanoke, Virginia, more accurately rcflects its current purpose and role in fostering
and promoting economic development in the City.
NOW, THEREFORE, BE IT ORDAI:-.JED by the Council of the City of Roanoke
that:
1. Council hereby amends paragraph 2 of Ordinance No. 18391 to read as
follows: "2. That thc name of the po]itical subdivision of the Commonwealth created
hereby shall be the Economic Developmcnt Authority of the City of Roanokc, Virginia
(thc Authority)."
2. Pursuant to Section 12 of the City Charter, the second reading hy title of
this ordinance is hereby dispensed with.

hereby amended and reordained to read and provide as follows:
§3Z.1-8. Technologv zone incentives.
(a) Telecommunication connection fee grant (i.e. fiber optics, data). Qualified
technology businesses may receive a one-timc telecommunication cOl1Ilcetion fee
grant, equal to fifty (50) percent of the actual costs spent by such busincss to obtain
telecommunication services to its location, but such grant will not cxcecd one
thousand dollars ($1,000.00) per business. A qualified zone residenl may also
qualify for such a b'Tant if the qualified zonc resident can demonstrate that one
hundred (100) percent of the cost of the telecommunication cOilllection is to
accommodate a qnalified tcchnology business actually operating in such resident's
facility. Such grants shall be awarded through a grant from the Economic IRdustrial
Development Authority of the City of Roanoke, Virginia (£IDA).
(b) Capital investment grants.

There is hereby established a capital investment grant which may be
provided to qualified technology businesses. The grant will bc based
on the net increase in the laxes paid on new investment made within
the technology zone. Thc capital investment grant will be calculated
on the net qualifying increase in business personal property and real
estate taxes actually paid by a qualified technology business. The
grant will be equal to fifty (50) percent of the net increase in taxes
actually paid by the technology business and which increasc resulted
from a qualified technology business' new inveslmcnt in business
personal properly and/or real estate improvemenls.
Grants will be administered through thc Economic lnclllstrial
Development Authority of Ihc City of Roanoke, Virginia (EmA).
The city manager shall be responsible for requesting appropriations

The l'ational League of Cities Annual Business Meeting will bc held on
Saturday. Dl'cl'mbcr 9,2006. at the conelusion of the Congress ol"Citic's and
Exposition 'in Reno. Nc'vada. As a direct memher city. your city is entitkd to
vote at this meeting. Based on population. eadlmember city casts Detl\'cen
one and twenty votes. The number 01" votes Illr each population range can be
f()und on the table on the reversc' of this memorandum.
To be digihle tll cast a city's vote(s). a voting delegate and alternat<: must be
ollic'ially designated by the city using the allached credentials form. This
forml\'ill bc' ti.lI"\varded to NLCs Credentials Committce. NLC bylaws
expressly prohihit Vllling by proxy.
At the Congn:ss of Cities, the voting dl'legate must pick up the city's voting
card at the credentials booth belì)re the Annual ßusin~ss Meeting and must he
present al the Annual Businl'ss Meeting to ~ast the city's votl'(S). Alternates
should )'isit the cTc'dentials blllllh bd(lre the me~ting to'piek up their stickers
which identify them as alternate voting delegates. The credentials booth will
be open throughout the Congress 01" Cities.
