2. APPROVAL OF MINUTES FROM August 7,2006, MEETING
Chairman Lea asked if there were any corrections or amendments to the
minutes of the August 7, 2006, Audit Committee meeting. There were none.
Mr. Fitzpatrick moved and Ms. Mason seconded that the minutes be approved

as distributed. A vote was taken and the motion carried. The minutes will be
placed on the Consent Agenda for the next City Council meeting.
3. INTERNAL AUDIT REPORT:
A. Housing and Neighborhood Services - Mortgage Assistance Program
B. Library Collections and Expenditures
C. Sheriff's Canteen Fund and Jail Inmate Fund
Chairman Lea ordered that items A through C be received and filed. There
were no objections to the order. Chairman Lea recognized Mr. Harmon for
comments on the audits.
Mr. Harmon stated the Mortgage Assistance Program was a relatively small
program in terms of dollars, and he felt it was an appropriate time to
examine the program to determine if safeguards were in place to ensure
compliance with the program requirements. The audit revealed the program
was operating well. Mr. Harmon added that the funds were almost
expended, but he understood more funds were forthcoming for the
continuation of the program.
Mr. Harmon asked if there were any questions regarding the audit of the
Mortgage Assistance Program. There being none, Chairman Lea asked Mr.
Harmon to proceed to the next audit report.
Mr. Harmon stated the investigative audit report of the Library Collections
and Expenditures was rather detailed in order to provide adequate
background information. He stated he would answer any questions the
Audit Committee members had regarding the report.
Mr. Trinkle stated that the city and school systems had programs for
tracking fixed assets, and he asked if the Library could use one of those.
Mr. Harmon responded that the Library has the SIRSI circulation system in
which assets are available to be checked out by the patrons; those items are
barcoded and listed in that system. Mr. Harmon stated the items reviewed
by Municipal Auditing were internal items such as digital cameras and
furniture. It was recommended in the report that the Library develop an
asset management program to track these items. Mr. Harmon noted there
was no sharing of systems at this time. The schools recently acquired a
fixed asset system with barcoding of items, but the city does not have
anything comparable to that. Mr. Harmon explained this type of tracking for
small assets is currently done on a department by department basis within
the city by using spreadsheets, databases, or paper records. The
Department of Technology uses a database on Lotus Notes to track its

assets, and the Library has chosen to copy and modify this system for its use
in tracking smaller assets. Mr. Trinkle asked if Mr. Harmon thought the
system used by the schools could be a shared resource, and Mr. Harmon
replied that he thought it might since the school's system was specifically
designed to track assets. He added that the schools have a centralized
warehouse where assets are received and tagged whereas the city's
individual departments receive the items.
Ms. Mason stated she was pleased that Municipal Auditing recommended a
tighter system in collecting, reporting, and depositing the monies for fines
from the various libraries. She asked if it was true that, if overdue city books
are returned to a county library and fines are paid there, the county keeps
that money. Mr. Harmon replied it was true because the system in place
does not allow for sorting that out. Mayor Harris asked if that worked in
reverse for the city to keep the money returned to city libraries for overdue
county books, and Mr. Harmon confirmed that it was.
Chairman Lea asked if there were any further questions regarding the Library
audit. There being none, he asked Mr. Harmon to comment on the next
audit report.
Mr. Harmon stated the Sheriff's Canteen Fund and Jail Inmate Fund audit is
required by the Virginia Auditor of Public Accounts as part of the city's year
end financial audit. The city's external auditors, KPMG, rely upon Municipal
Auditing to provide the services for this section of the audit. Procedures for
the audit are set by the Auditor of Public Accounts (APA). The law specifies
this money must be used for the benefit of the inmates; therefore, the
expenditures were reviewed very closely as well as the vendors and bank
statements. Medical co pays and telephone commissions are received by the
Sheriff's department as well, but are not reflected in this audit. Mr. Harmon
stated he expected these to be required by the APA next year, which will
make this audit more extensive. Mr. Harmon estimated the telephone
commissions are approximately $300,000 per year.
Mr. Harmon stated there were no issues with this year's audit. The financial
statements are attached and reveal that sales commissions are up by 45
percent. This is because Swanson now has the contract for this service, and
the commission is 30 percent. The prior contract provided 17 percent
commission. This is the first full year that Swanson has had the contract.
Mr. Wishneff referred to the recent news item about the allegations of fraud
in Henry County and asked Mr. Harmon if the city's Police department is
audited annually in regard to confiscation of property such as drugs. Mr.
Harmon replied the annual audit of the Police department examines the cash
funds placed in the property room and the controls in place. The Police

department manages this, requiring their own staff to do internal monthly
audits. Personnel outside the Police Services division and unrelated to the
property room management are used for this purpose. Municipal Auditing
checks to make sure these monthly and quarterly audits are done. Every
three or four years, Municipal Auditing does a more substantial audit to
examine the system, access, and history.
Chairman Lea recognized that Sheriff Johnson was in attendance at the Audit
Committee meeting and thanked her for coming. The Chair asked Sheriff
Johnson how many federal inmates were housed in the Roanoke City jail, and
she responded there were 150.
Chairman Lea asked if there were any further questions regarding the audit
report of the Sheriff's Canteen Fund and Jail Inmate Fund. There were none.
4. UNFINISHED BUSINESS:
Chairman Lea stated there was no unfinished business and proceeded to the
next item on the agenda.
5. NEW BUSINESS:
A. Letter from Auditor of Public Accounts
Chairman Lea ordered that Item A be received and filed. There were no
objections to the order. He recognized Mr. Harmon for additional
comments.
Mr. Harmon stated the Auditor of Public Accounts (APA) annually examines
elected officials mainly in the areas of state revenues and state collections.
This letter from the APA confirms that no findings were found during the
audit for the year ended June 30, 2006.

Architectural Review Board (ARB)
I am pleased to provide City Council with the following information on the Board's
accomplishments and attendance for calendar year 2006.
The ARB met 12 times during 2006. In addition, a review committee met 10
times to review applications and recommend improvements to individual
applications. Actions taken by the Board, staff and City Council are summarized
below.

·
Investment in historic district rehabilitation continues to accelerate. 2006 had
another double-digit increase (20%) in case activity over the previous year.
· ARB and staff considered 139 applications and approved 1270r 91 %.
· While the number of approvals continued to increase over previous years, the
number of denials remained in the 5-7 range seen over the past four years.
Three of the five denied applications were for work already commenced or
completed without approval. These cases accounted for three of the four
appeals to City Council.
· One denial was a project on Market Street that would have added a story to
an existing building. The applicant modified the project to one where a new
building will be constructed. The ARB approved the new application later in
the year.
· To expedite approvals, the ARB delegates approval authority for certain types
of projects to the Agent. Almost half (45%) of all applications were reviewed
and approved by the Agent. Typically, such approvals are given within five
business days of receiving the application.
Major ARB activities during 2006:
· Approved four applications for new construction:
o Retail/office building at 308-310 Market Street.
o Large office building in the 1100 block of 1s1 Street, SW.
o 20 townhouse units located on a new loop street which will connect
the ends of Janette and King George Avenues.
o 4 townhouse units on Woods Avenue at 6th Street.
· As a Certified Local Government (CLG) with the Department of Historic
Resources (DHR), the City of Roanoke had direct support from the state and
federal governments with grant money for historic preservation studies and
for ARB training.
1. Worked in coordination with DHR for a cost-share project to survey
and nominate the Salem Avenue Historic District to the Virginia
Landmarks Register and the National Register of Historic Places.
2. Staff and the Vice-Chair received training through the National Alliance
of Preservation Commissions. These workshops train local historic
preservation commissioners and staff in community revitalization
methods.

· Continued annual spring mailings to all property owners in the historic districts
and contractors in the Roanoke Valley to increase awareness of the historic
districts. The Department of Real Estate Valuation also sends notices to all
new property owners in the historic districts.
· Continued the Design Assistance Review Committee comprised of two ARB
members to review applications prior to the Board meetings. Two members
and staff attend the monthly meetings and notify applicants of preliminary
recommendations.
· Continued annual in-house ARB workshops to improve the application
process and Board meetings.
· Invited DHR to review and assess the ARB's processes. DHR staff
completed the assessment and provided recommendations for improvements.
The Board's current initiatives:
· Review and update the H-1 and H-2 Architectural Design Guidelines to
incorporate information on new materials that were not available when the
1995 guidelines were written, delete outdated information or materials, and
comply with zoning provisions contained in the adoption of the new zoning
ordinance in December, 2005. The first workshops with property owners in
the H-1 and H-2 Districts will be held on January 17, 2007. This initiative was
undertaken using a 50/50 match of State and City funding.

Prosccution (V STOP) Violence Against Women grant offered by the Virginia Department of
. Criminal Justice Serviccs in the amount of$32,967 upon all the tcnns, provisions and conditions
relating to the receipt of such funds. The grant, which requires an S I 0,989 in-kind match by the

Subject: Police Department Domestic
Violence Program Grant
Background:
The Virginia Department of Criminal Justice Services (DCjS) provides grant
funding for programs and activities which increase the apprehension,
prosecution and adjudication of persons committing violent crimes against
women. The program, "Virginia Services, Training, Officers, Prosecution
Violence Against Women" (V-STOP) has funded the establishment of a Domestic
Violence Unit within the Police Department since 1999.
The Domestic Violence Unit collects and interprets relevant domestic violence
offense data which allows proactive case intervention and cultivation of the
cooperative working relationships with clients and service/adjudication
agencies. The program produces more equitable victim-offender criminal
justice dispositions related to domestic violence offenses.
On December 12, 2006, DCJS awarded the Police Department $32,967 to
employ its full-time, non-sworn Domestic Violence Specialist, thereby allowing
continuance of the Domestic Violence Unit in calendar year 2007. The required
City match of $10,989 will be met through a cash transfer of $10,036 and an
in-kind donation of $953. The cash expenditure will be necessary to continue to
fully fund the salary and benefits portion of the Domestic Violence Specialist
position. Funding for the local match is budgeted in Local Match Funding for
grants (35-300-9700-5415).

Recommended Action:
Accept the V-STOP grant described above and authorize the City Manager to
execute the grant agreement and any related documents, in such form as is
approved by the City Attorney.
Adopt the accompanying budget ordinance to establish revenue estimates for
State grant funds of $32,967 and local cash funding of $10,036, to transfer
funding in the amount of $10,036 from 35-300-9700-5415 to provide the local
match funding, and to appropriate total funding of $43,003 in accounts to be
established by the Director of Finance in the Grant Fund as follows:

Violence Coordinator Grant
Background:
The Virginia Department of Criminal Justice Services (DCJS) provides grant
funding for programs and activities which increase the apprehension,
prosecution and adjudication of persons committing violent crimes
against women. The Virginia Sexual and Domestic Violence Victim Fund
(VSDVVF) was created in 2004 by the Virginia General Assembly. The
VSDWF, through DCJS, provides funding for programs that assist the
victims of sexual and domestic violence.
On December 28, 2006, DCJS awarded the Police Department $27,957 in
VSDVVF funding to employ a part time, 36 hour per week, Sexual
Violence and Hispanic Outreach Specialist. There is no matching funds
requirement. The person in this position will be bilingual in Spanish and
English. They will collect and interpret relevant sexual violence offense
data which will allow proactive case intervention and cultivation of
cooperative working relationships with clients and service/adjudication
agencies. Additionally, the position will serve all Hispanic victims of
sexual and domestic violence as well as perform crime prevention
outreach services in the Hispanic community.

Recommended Action:

Subject: Access Point Grant
Background:
The Department of Criminal Justice Services (DCJS) distributes federal funding
through the Edward Byrne Memorial Grant Program. Byrne programs may
consist of many initiatives including improvements to technology that will
enhance the functioning of the criminal justice system. The police department
identified instances where incident reports failed to satisfactorily wirelessly
transmit from the police vehicle into the main records management system
database. This sporadic system failure hampered the investigative process
which resulted in inefficient service to the community.
On December 18, 2006, DCJS awarded the police department $31,013 in Byrne
Memorial Grant funding to purchase wireless access point technology. This
equipment once installed should dramatically reduce system failures and
increase operational effectiveness. The grant program requires a City funded
cash match of $10,338. Funding for the local match is budgeted in Police
Mobile Units account # 13-430-9915-9003.
Recommended Action:
Accept the Access Point Grant described above and authorize the City Manager
to execute the grant agreement and any related documents, in such form as is
approved by the City Attorney.

Dear Members of Council:
As the result of official School Board action at its meeting on January
9, the Board respectfully requests City Council to appropriate monies to the
following programs:
· $193,639.00 for the Addison Community Learning Center. The
Learning Center will address the critical attendance, academic, and
parental involvement needs of the community in a safe, supervised,
and nurturing environment. This continuing program is one hundred
percent reimbursed by federal funds.
· $15,000.00 for the Chess Program to pay for chess materials and
tournament participation costs. A private donation has been received
for this continuing program.
· $16,746.00 for the Westside Turnaround Program to provide state
funds for the incentive package for the turnaround specialist program
at Westside Elementary School. This is a continuing grant program.
· $28,000.00 for the School Improvement Plan for
Unaccredited/Warned Schools to provide funds for four improvement
specialists in support of the effort to improve student achievement in
warned schools. The program in the prior year resulted in six of the
twelve schools warned last year becoming fully accredited this year.
This is a continuing grant program.
· $8,250.00 for the Western Virginia Regional Science Fair being
hosted by Roanoke City. Participating school districts and corporate
and individual contributions along with a local match cost to Roanoke
City Schools provide for the cost of the fair.

Subject: School Board Appropriation Request
As a result of official School Board action at its meeting on January 9, 2007,
the Board has respectfully requested that City Council appropriate the
following funds:
· $193,639 for the Addison Community Learning Center. The Learning
Center will address the critical attendance, academic and parental
involvement needs of the community in a safe, supervised, and
nurturing environment. This continuing program is one hundred
percent reimbursed by federal funds.
· $1 S,OOO for the Chess Program to pay for chess materials and
tournament participation costs. A private donation has been received
for this continuing program.
· $16,746 for the Wests ide Turnaround Program to provide state funds
for the incentive package for the turnaround specialist program at
Westside Elementary School. This is a continuing grant program.
· 528,000 for the School Improvement Plan for Unaccredited/Warned
Schools to provide funds for four improvement specialists in support of
the effort to improve student achievement in warned schools. The
program in the prior year resulted in six of the twelve schools warned
last year becoming fully accredited this year. This is a continuing grant
program.
· 58,2S0 for the Western Virginia Regional Science Fair being hosted by
Roanoke City. Participating school districts and corporate and individual
contributions along with a local match cost to Roanoke City Schools
provide for the cost of the fair.

WHEREAS, Pro-Line Performance, Inc., represented by Maryellen F. Goodlatte,
attorney, has made application to the Council of the City of Roanoke, Virginia ("City
Council"), to have the hereinafter described property rezoned from RA, Residential
Agricultural District, to I-I, Light Industrial District, subject to a certain condition
proffered by the applicant; and
WHEREAS, the City Planning Commission, after giving proper notice to all
concerned as required by 936.2-540, Code of the City of Roanoke (1979), as amended,
and after conducting a public hearing on the matter, has made its recommendation to City
Council; and
WHEREAS, a public hearing was held by City Council on such application at its
meeting on January 16, 2007, atier due and timely notice thereof as required by 936.2-
540, Code of the City of Roanoke (1979), as amended, at which hearing all parties in
. interest and citizens were given an opportunity to be heard, both for and against the
proposed rezoning; and
WHEREAS, City Council, after considering the aforesaid application, the
recommendation made to City Council by the Planning Commission, the City's

Comprehensive Plan, and the matters presented at the public hearing, finds that the public
necessity, convenience, general welfare and good zoning practice, require the rezoning of
the subject property, and for those reasons, is of the opinion that the hereinafter described
property should be rezoned as herein provided.
THEREFORE, BE IT ORDAINED by the Council of the City of Roanoke that:
1. 936.2-100, Code of the City of Roanoke (1979), as amended, and the
Official Zoning Map, City of Roanoke, Virginia, dated December 5, 2005, as amended,
be amended to reflect that 3922 Thirlane Road, N.W., bearing Official Tax No. 6520103
and 3942 Thirlane Road, N.W., bearing Official Tax No. 6520102, be, and are hereby
rezoned from RA, Residential Agricultural District, to I-I, Light Industrial District,
subject to the proffer contained in the Amended Petition filed by Pro-Line Performance,
Inc., represented by Maryellen F. Goodlatte, attorney, in the Office of the City Clerk on
December 7, 2006.

Planning Commission Action
Planning Commission public hearing was held on Thursday, December 21,2006.
During the public hearing, public comment was received and is summarized in the
background section of this report. Bya vote of 0-7, the motion failed.
Background
The petitioner, Pro-Line Performance Inc., has contracted to purchase two properties
located in the Airport neighborhood at 3922 Thirlane Road NW. (Official Tax No.
6520103) and 3942 Thirlane Road, NW. (Official Tax No. 6520102), which are zoned
RA, Residential-Agricultural District. The petitioner wishes to rezone the property to 1-1,
Light Industrial District with proffered conditions, to permit the construction of a
commercial motor vehicle sales and services establishment.
The site development plan calls for the demolition of the frame house located at 3942
Thirlane Road, N.W., while retaining the brick rancher and garage at 3922 Thirlane
Road, N.W., for use as the sales office and storage. The development plan also calls

for the construction of a 2,400 square foot trailer storage building, an eleven space
paved parking lot accessed by two driveways, and a 26,250 square foot trailer display
area. The site would be buffered from adjacent properties by evergreen trees and
shrubs.
The Petition to Rezone was filed on November 2, 2006. This petition was amended and
filed on December 7, 2006, to address specific staff comments.
Considerations
SurroundinQ ZoninQ Districts and Land Uses
The subject properties are currently zoned RA, Residential-Agricultural District, with
each containing a single-family residence. Immediately surrounding zoning and land
use is as follows:
. AD, Airport District, extends to the north and east of the subject properties across
Thirlane Road, N.W. This district contains developments such as the Roanoke
Regional Airport, United Parcel Service distribution center and the Federal
Express distribution center.
. RA, Residential-Agricultural District, extends to the south and west of the subject
properties. The property to the south contains a single-family residence. The
property to the west is vacant and abuts Interstate 581.
Condition Proffered bv the Petitioner
The petitioner proffers the following condition:
1. That the properties shall be developed in substantial conformity with the Site
Development Plan prepared by Hughes Associates Architects dated November
21, 2006, subject to such changes as may be required by the City of Roanoke
during comprehensive site plan review.
Compliance with the ZoninQ Ordinance
During the City's comprehensive rezoning in 2005, these properties were identified as
AD, Airport District, on a draft zoning map along with numerous other properties within
the vicinity of the Roanoke Regional Airport. The subject property's owners, along with
others in the area, contested the rezoning to AD, stating that 1-1, Light Industrial District,
was more appropriate for the area. They argued that their properties were not
contiguous with the airport and would tie in better with nearby property that had been
rezoned to LM, Light Manufacturing District with proffered conditions, in October of 2000
to permit the construction of an office/industrial park. Most of the properties were
rezoned to AD, however, the subject properties retained their RA zoning designation
due to their residential uses.

The site development plan as proposed on Exhibit 2 of the First Amended Petition to
Rezone meets the use and dimensional standards of the 1-1 District.
Compatibility with the City's Comprehensive and Neiqhborhood Plans
Due to the limited amount of developable land near the airport, both Vision 2001-2020
and the Williamson Road Area Plan stress the need to designate land near the airport
for uses that relate to or benefit from the airport. The Williamson Road Area Plan
specifically identified Thirlane Road as the appropriate location for airport-related uses
with the future land use map showing the subject properties as 'airport development'.
The proposed use of the property as commercial motor vehicle sale and services
establishment does not have an apparent need for close proximity to the airport.
The following policies from the Vision 2001-2020 Comprehensive Plan and the
Williamson Road Area Plan are relevant in the consideration of the current petition.
. Vision 2001-2020:
o IN P5 Airport. Land use adjacent to the airport should be reserved for
commercial and industrial development related to air transportation or those
businesses needing easy access to airport facilities. Airport-related uses will
be encouraged in the areas near the airport.
. Williamson Road Area Plan Strategic Initiatives:
o Airport. Land around the airport should be reserved for land uses that are
dependent upon and complement the airport.
Planninq Commission Discussion
The petition to rezone was discussed, primarily in regards to the proposed use in
relation to the airport and the interstate as follows:
. The Planning Commission asked staff if the only appropriate zoning for this
property was AD, Airport District. Staff responded that it was not an issue of
appropriate zoning but appropriate use.
. A member of the Planning Commission asked how it was determined that a use
was airport supportive. Another member of the Planning Commission responded
that airport supportive could mean (1) something that supports plane flights; (2)
businesses that strongly rely on the airport, such as UPS; (3) businesses or non-
profits that need to be close to the airport for travel purposes.
. The Planning Commission asked why the petitioner wished to locate his business
on this particular piece of property. The petitioner responded that access, not
visibility, to the interstate was the main draw to this property.
Four members of the public commented on this petition, two of which were in favor and
two of which were in opposition. Their comments included the following:
· Two adjoining property owners were in favor of the rezoning; stating that they felt
the petitioner would be a good neighbor.

. The owner of a neighboring office park felt that the use of this property as a retail
sales and maintenance business for trailers would hurt the value of his existing
project and discourage his future plans. A tenant of the office park stated that he
would not have invested in the area if he had known that a trailer type use would
be located on Thirlane.
Recommendation
Bya vote of 0-7, the Planning Commission recommends denial of the request to rezone
the subject property to 1-1 (c), Light Industrial District with proffered conditions, for the
construction of a commercial vehicle sales establishment. The petition is not consistent
with, nor furthers the intent of, the City's Comprehensive and Neighborhood Plans as
both specifically identify this property for airport related uses.

Petitioner, Pro-Line Performance, Inc., a Virginia corporation, has contracted to purchase
Official Tax Map Nos. 6520103 and 6520102 &0111 Sylvia J. Ails. This property was jointly held
by Jesse C. Ails and Sylvia J. Ails. Jesse C. Ails is deceased and title is vested in Sylvia J. Ails,
as the survivor. The property is currently zoned RA, Residential-Agricultural District. A map of
the property to be rezoned is attached as Exhibit A.
Pursuant to Section 36.2-541, Code of the City of Roanoke (1979), as amended,
Petitioner requests that the said property be rezoned &0111 RA, Residential-Agricultural District,
to 1-1, Light Industrial District, subject to certain conditions set forth below, for the purpose of
moving its trailer sales business now located at 3021 Fle111ing Avenue, Roanoke, Virginia 24012.
The site development plan prepared by Hughes Associates Architects, dated Nove111ber 2 I, 2006,
is attached hereto as Exhibit B ("Site Deve1op111ent Plan").
Your petitioner believes the rezoning of the property will further the intent and purposes
of the City's Zoning Ordinance and its Comprehensive Development Plan.

Your petitioner hereby proffers and agrees that if the said tracts are rezoned as requested,
that the rezoning will be subject to, and that it will abide by, the following conditions:
That the properties shall be developed in substantial conformity with the Site
Development Plan prepared by Hughes Associates Architects dated November 21,2006, subject
to such changes as may be required by the City of Roanoke during comprehensive site plan
review.
Attached as Exhibit C are the names, addresses and tax nU111bers of the owners of all lots
