9. INTRODUCTION AND CONSIDERATION OF ORDINANCES AND
RESOLUTIONS:
a. Ordinance No. 37793, on second reading, rezoning five tracts of land
located on Highland Farm Road and Ferncliff Avenue, N. W., to permit
the redevelopment of the William Fleming High School campus.

10. MOTIONS AND MISCELLANEOUS BUSINESS:
a. Inquiries and/or comments by the Mayor and Members of City Council.
On motion, duly seconded and unanimously adopted, Council agreed
to delay implementation of the proposed parking rate increases until
its regular meeting on September 4, 2007, in order to allow the City
Administration an opportunity to continue to discuss the issue with
the downtown business community.
In connection with concerns expressed the increase in parking fees at
the Gainsboro Parking Garage, the City Manager recommended that
evening students attending classes at the Higher Education Center be
able to park in the Gainsboro Parking Garage at a discount rate of
$1.00. Upon exiting the Garage, the student will be required to
present appropriate identification and a discount coupon, which may
be downloaded from the City's website or obtained at the Higher
Education Center.
Council Member Lea announced that the Roanoke Chapter - NAACP
recognized the City Manager and City Clerk, along with the Sheriff,
Treasurer, Commissioner of the Revenue, Clerk of the Circuit Court
and Health Department Director at its annual Citizen of the Year
Awards Banquet on Saturday, June 2, 2007, at the Hotel Roanoke and
Conference Center.
b. Vacancies on certain authorities, boards, commissions and committees
appointed by Council.

12. CITY MANAGER COMMENTS:
The City Manager distributed copies of the Urban Policy Report. She stated
that she and Council Member Fitzpatrick recently attended a First Cities
Coalition meeting, and that she serves on the Governor's Task Force on
Urban Policy, which addresses challenges that face older urban areas. She
added that a report was presented at the meeting outlining goals and
performance measures to evaluate urban issues, and that the City needs to
look at these when formulating its Legislative Policy for the next fiscal year.
She also corrected a statement made previously by a citizen who stated that
the City charges patrons for parking in City-owned parking garages when
attending Civic Center events. The City Manager emphasized that the City
does not charge nor does it have any intentions of charging individuals who
use the shuttle buses and park in City-owned garages to attend events at
the Roanoke Civic Center. She added that a parking fee is included in the
cost of the purchased ticket.

The following appointments were made:
Christy L. Cooper was appointed to the Fair Housing Board ending
March 31, 2010.
Amy M. Naff was appointed to the Roanoke Arts Commission for a term
ending June 30, 2010.
The City Attorney was requested to prepare the proper measure appointing
Richard E. Huff, II, to fill the unexpired term of John B. Williamson, III, as a
Director of the Western Virginia Water Authority, ending March 1, 2008.

WHEREAS, American Cancer Society funds more than $125 million of cancer
research a year and will assist persons touched by cancer find information or quality of
life programs needed; and
WHEREAS, 35,090 new cases of cancer are estimated to occur in the Commonwealth
of Virginia in 2007, and approximately 13,990 Virginians are expected to die from
cancer this year; and
WHEREAS, one in three people will be diagnosed with cancer during their lifetime;
more than two-thirds of all cancer deaths are preventable and the five.year survival rate
for all types of cancer has increasedfrom 50% to 66% in the last 25 years; and
WHEREAS, since its inception in 1985, Relay For Life has become a worldwide
movement to end cancer and recognize survivors and their caregivers; and
WHEREAS, for the newly diagnosed, Relay For Life is a healing experience that
offers a chance to meet others who have claimed victory over cancer; and for the long-
term survivor, Relay For Life is a public forum to show their gratitude and tell the world
they are still here; and
WHEREAS, Relay For Life is an opportunity to recognize caregivers for their hard
work and dedication to those they love and care for, and the goal of Relay For Life
Survivor Day is to honor all touched by cancer, increase awareness, and raise funds for
the American Cancer Society; and
WHEREAS, Roanoke was the site of the first Relay For Life in Virginia and since its
inception, the Roanoke Valley Relay for Life has contributed over $5.5 million toward the
fight against cancer; and
WHEREAS, the annual Survivor Reception will be held at the Roanoke Civic Center
Special Events Center on Tuesday, Jun.e,5, 2007.
NOW, THEREFORE,1, C Nelson Harris, Mayor of the City of Roanoke, Virginia, urge
all citizens to join the fight against cancer, honor all survivors and participate in Relay
For Life, and do hereby proclaim Tuesday, June 5 throughout this great All-America

AN ORDINANCE accepting the bid of Ovations Food Services, LP., a Pennsylvania
limited partnership, ("Ovations") to be the exclusive provider of all food, beverage, catering and
concessions services at the Roanoke Civic Center, located at 710 Williamson Road, N.E" Roanoke,
Virginia, for a term of ten (10) years; authorizing the City Manager to take such further action
and/or execute such further documents as may be necessary to implement and administer such
franchise and lease agreement; and dispensing with the second reading of this ordinance.
WHEREAS, the City has, by advertisement, published once a week for two successive weeks
in a paper of general circulation published in the City, publicly invited bids for the execution ofthe
foregoing agreement;
WHEREAS, the City desires to enter into a franchise and lease agreement for the exclusive
provision of food, beverage, catering and concession services at the Roanoke Civic Center;
WHEREAS, one bid for the execution of the aforementioned agreement was received
pursuant to such advertisement and was publicly opened at the Council meeting held Monday, May
7,2007;
WHEREAS, Council held a public hearing on this matter at its meeting on Monday, June 4,
2007, at which all persons were accorded a full'and fair opportunity to comment with respect to the
proposed agreement and lease for such franchise; and
WHEREAS, City Council determined that the bid of Ovations was the most re~ponsive and

responsible bid received by the City and Council is desirous of accepting such bid.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Roanoke as follows:
1. The bid of Ovations Food Services, L.P. , to be the exclusive provider of all food,
beverage, catering and concessions services at the Roanoke Civic Center, for a term of ten (10) years,
commencing July I, 2007, subject to a management fee paid by the City to Ovations of 6,5% of
Ovations' gross sales from its catering and concession sales and 12.5% of Ovations' total net profits,
as further set forth in the City Manager's letter to Council dated June 4, 2007, and upon such other
terms and conditions as the City Manager may deem appropriate and agree to, is hereby
ACCEPTED.
2. Ovations will be required to invest at least $600,000.00 to build a kitchen for the
Special Events Center at the Roanoke Civic Center, such costs to be amortized over the first seven
(7) years of the agreement.
3, The City Manager and the City Clerk are authorized to execute and attest,
respectively, a franchise and lease agreement with Ovations Food Services, L.P " for Ovations to be
the exclusive provider, for a term of ten years, of all food, beverage, catering and concessions
services at the Roanoke Civic Center, located at 710 Williamson Road, NE, Roanoke, Virginia. All
documents shall be upon form approved by the City Attorney
4, The City Manager is further authorized to take such further action and/or execute such
further documents as may be necessary to implement and administer such agreement.
5, Pursuant to the provision of Section 12 ofthe City Charter, the second reading of this

Dear Mayor Harris and Members of City Council:
Background:
With the recent opening of the Special Events Center (SEC) at the Civic Center,
there is more need to provide for concessions services at the Civic Center. Due
to a lack of available funding, the planned kitchen for the SEC was not built.
The existing kitchen, located in the Exhibit Hall, is being used to prepare meals
for all events where food and beverages are served. That placement is
inadequate and inefficient due to the distance from the Exhibit Hall to the
various areas at the Civic Center where such meals are served.
Considerations:
Food and beverage sales and services are currently managed in-house by City
staff. In order to provide the necessary kitchen for the SEC, the City proposes
to enter into a ten-year franchise and lease agreement, commencing July 1,
2007, with Ovations Food Services, LP, a Pennsylvania limited partnership and
national food services company; whereby Ovations would be the provider of all
food, beverages, including alcoholic beverages, catering, and concession

services for the Roanoke Civic Center, unless prior approval is obtained from
the City to allow outside food or beverage on the premises during an event or
set up of the event.
Under the terms of the proposed agreement, Ovations would be solely
responsible for building and funding the desired kitchen in the SEC based on
existing City designed plans. Ovations would invest at a minimum, Six Hundred
Thousand Dollars ($600,000) for their design, construction, and installation of
the kitchen, The cost of the kitchen would be amortized over seven years. At
the end of seven years, the kitchen would become the property of the City. The
City would lease the kitchen area to Ovations and license Ovations to use the
remainder of the Civic Center for catering and concessions services.
In return, Ovations would receive a management fee of 6,5 percent of Ovations'
gross sales receipts and 12.5 percent of Ovations' net profits. The term of the
Agreement would be for ten years, The City would retain oversight of Ovations'
operations.
Council previously authorized the invitation for bids in this matter as required
by the Code of Virginia since the franchise and lease agreement will be for a
period of ten years. The bids were opened at the May 7, 2007, Council
meeting,
Recommended Action:
Accept the bid of Ovations Food Services, LP, and authorize the City Manager to
execute a franchise and lease agreement with Ovations Food Services, LP, for a
term of ten years, upon form approved by the City Attorney.

For Maple Leaf Bakery
Background:
Maple Leaf Bakery is expanding its existing facility at the Roanoke Centre for
Industry and Technology (RClT) and has encountered a problem with fleet
parking due to construction. Currently, the plant needs 60 spaces for truck
parking at full operation. With the construction, the fleet parking area has
been reduced to approximately 30 spaces which impacts deliveries to the
bakery significantly,
The company has been using the street frontage on Blue Hills Drive, NE for
fleet parking, which violates the restrictive covenants in place at RClT. The
trailer drops have also encouraged trucks not associated with the Maple Leaf
Bakery to similarly use street frontage for their trailer drops. Economic
Development staff met with Bakery officials to work out a compromise that
would properly allow fleet parking for the bakery without violating any
restrictive covenants,
Considerations:
The City of Roanoke proposes to grant a revocable license allowing the use of
Tax Map #7230103, in RClT to Canada Bread Bakeries, Inc., d.b.a. Maple Leaf

Bakery, for the purpose of providing fleet parking to Maple Leaf Bakery for a
period, commencing June 5, 2007 and expiring December 31, 2007. This
parcel is immediately across Blue Hills Drive from the bakery site,
Maple Leaf proposes to place gravel on a portion of Tax Map #7230103 to
create a temporary parking area, After construction is complete, Maple Leaf
will be responsible for removal of all gravel and will restore the site to
original condition, Maple Leaf will be responsible for all construction permits
and erosion and sediment control at the site. The storage of hazardous
substances on site is prohibited.
Recommended Action:
Authorize the City Manager to execute a revocable license with Canada Bread
Bakeries, Inc., d.b.a. Maple Leaf Bakery, for the period June 5, 2007, until
December 31, 2007, such license to be approved as to form by the City
Attorney.

WHEREAS, the Roanoke Civic Center Commission has concurred with
the following amendment to the City Code.
THEREFORE, BE IT ORDAINED by the Council of the City of Roanoke as
follows:
1, Section 24-26, Rates for use and terms, of Division 1, Generallv, of
Article II, Civic Center. of Chapter 24, Public Buildinqs and Propertv Generallv, of
the Code of the City of Roanoke (1979) as amended, be and it is hereby
amended to read and provide as follows:
(a) The Rocmoke Civio Center Commission City Council shall establish from time
to time a current schedule of fees, rentals, rates, charges, and terms to be
required for use of the civic center and, subject to such limits and guidelines as
the commission Council may impose, authorize the director of civic facilities to
vary the fees, rentals, rates, charges, and terms in certain instances for events at
the civic center, including, without limitation, concerts, plays, sporting events,
circuses or ice shows.

(b) The director of civic facilities may negotiate and execute contracts, licenses,
or leases for the use of the civic center for single- or multiple-date events, with
the approval of the city manager or his or her designee, that occur during any
period of time of less than twelve (12) months. Furthermore, the director of civic
facilities may negotiate and execute contracts, licenses, or leases for the use of
the civic center for multiple date events, with the concurrence of the city manager
or the city manager's designee, that occur over a time period of twelve (12)
months or more, but less than sixty (60) months~. with tho 3pproval of the
Roanoke Civic Center Commission.

(d) Civic, religious and charitable organizations, the incomes of which are
exempt from taxation under the United States Internal Revenue Code, may apply
to the civic center manager for a civic rate, as established by Council Roanoke
Civic Center Commission, to conduct a nonprofit activity at the civic center,
where the proceeds do not accrue to the benefit of an individual, business or
commercial entity. The director of civic facilities may authorize the use of a civic
rate. ,where such rate has been established by the Roanoke Civic Center
Commission.

Article II, of Chapter 24, Public Buildinqs and Property Generally, of Article II,
Civic Center. of the Code of the City of Roanoke (1979) as amended, is hereby
amended to read and provide as follows:
Sec. 24-48. Authority. Function.
(a) The commission shall bo the policy making arm of serve in an advisory
capacity for the Civic Center and, to that end, is hereby delegated and shall
exercise authority operate in the following matters. manner:
(1) Within funds provided by appropriation, to decide upon, direct and
implement the promotion and the advertising policy of the recommend
promotional methods to diversify or increase events at the Civic Center
Coliseum, Performing Arts Theatre, and Special Events Center.
(2) To establish fees, rentals, rates, charges, and terms for the use of the
civic center as provided f-or in section 21 26 of this Code Recommend to
City Council appropriate rates for fees, rentals, rates, and terms for the
use of the civic center, and for necessary changes thereto.

Background:
The Civic Center Commission was established on September 15, 1976 and
became the policy making arm of the Civic Center with authority to:
1) Direct and implement the promotion and advertising policy of the Civic
Center;
2) Establish fees, rentals, rates, charges, and terms for the use of the
Civic Center;
3) Determine all matters relating to the parking of vehicles at the Civic
Center, and to fees charged;
4) Decide upon the City's award of contracts or agreements providing for
catering and product sales concessions at the Civic Center; and
5) Determine and establish matters of policy with reference to ticket
sales,
At present, the majority of these duties and (esponsibilities are being
performed by the Director of Civic Facilities with oversight by the City
Manager's Office, and the Commission is functioning in an advisory capacity.

The Civic Center Commission members consider their advisory role an
important one. To clarify the Commission's actual and desired role, the code
requires modification.

- Leaf Collection
Background:
The City's ongoing effort to improve the appearance of our public rights-of-way
through code enforcement creates the need to amend the solid waste
management provisions in the City Code (Chapter 14,1), In August 2006, the
code was updated to better facilitate the City's new Uniform Code Violation
program. Additional changes that were identified as a result of the 2006 Leaf
Collection Program include:
~ Updating several definitions to improve understanding of terms
~ Clarifying placement of bulk, brush, lawn rakings, and leaves to
improve citizen understanding
~ Removing reference to loose leaves raked to the curb "for a fee."
A summary is attached that outlines the specific code section changes.

Dear Mayor Harris and Members of City Council:
The City's mounted patrol unit has been operated in a collaborative fashion
with the support of the Roanoke Foundation for Downtown, Incorporated
beginning in 1998, In July 2004, the City and the Foundation entered into an
agreement regarding the funding and support for the mounted patrol unit,
That agreement terminates on June 30, 2007.
In order to provide for the continued support of the mounted patrol, the City
and the Foundation desire to enter into another agreement, similar in content
to that which is about to expire, for a one year term with two automatic renewal
terms of one additional year each. The City would provide operating funds to
support the mounted patrol in the amount of $20,000,00 annually. Funding
for the agreement is included in the FY 2007-08 adopted General Fund budget
in account 01-640-3113-3696, The Foundation would use reasonable efforts to
secure monetary donations and donation of goods and services for use by the
unit, and would also be(r~sponsible for the procurement of goods and services
in support of the unit as they have under previous agreements. A copy of the
proposed agreement is attached to this report.

immunity and authorizes the City Manager to execute the agreement with the

AGREEMENT
THIS AGREEMENT by and between THE CITY OF ROANOKE, VIRGINIA, a municipal corporation
organized under the laws of the Commonwealth of Virginia ("City") and ROANOKE FOUNDATION
FOR DOWNTOWN, INC. ("Foundation"), a non-stock corporation organized under the laws of the
Commonwealth of Virginia, is dated July 1, 2007, for identification,
WHEREAS, the parties to this Agreement desire that City maintain a mounted patrol unit ("Unit")
within the Police Department of City to serve the residents of City: and
WHEREAS, Foundation has for many years contributed and is willing to contribute to the extent
provided herein to the well being of the Unit;
NOW THEREFORE, the parties agree as follows:
1, The term of this Agreement shall be for one year, commencing July 1, 2007 and ending
on June 30, 2008. This Agreement shall automatically renew for two (2) successive

terms of one year each unless any party shall provide to the other party, at least sixty
(60) days prior to the end of the initial term of any renewal term, written notice of the
giver's intent not to renew the Agreement.
2, Foundation shall have no responsibility for the payment or reimbursement of any
expense incurred hereunder except from monies provided herein by the annual
operating funds,
3. Prior to July 1" of each year that this Agreement is in effect, City will prepare an annual
operating budget for the Unit for the next fiscal year. City will be responsible for all
operating expenses in excess of the annual operating funds unless expressly approved
by Foundation.
4. City shall provide Foundation annual operating funds of $20,000 to be used for the
benefit of the Unit. Foundation shall use reasonable efforts, in its sole discretion, to
secure monetary donations and donations of goods and services for use by the Unit. To
the extent goods and services are not donated, Foundation shall use City's informal
procurement procedures for any goods or services for which payment is expected to
exceed $500, In order to comply with such procurement procedures, Foundation will
document price quotes from at least three (3) vendors, where possible, and secure
goods and services at competitive rates. As and to the extent such operating funds are
received Foundation will p ay all Unit expenses as submitted by City, excluding the
officers' salaries and benefits and ordinary police equipment and uniforms, All
decisions as to what types of goods and services are to be purchased with operating
funds are solely the responsibility of City, and Foundation shall have no liability or
responsibility for the goods and services purchased,
5, The parties recognize that the Unit shall be under the operational control of City and
that the horses and all equipment donated to City shall be the sole property of City. To
the extent permitted by applicable law, each party to this contract will be responsible for
the actions, inactions or violations of its officers, employees, and agents in connection
with the police activity contemplated under this contract, but nothing contained herein
shall be construed as a waiver of the City's sovereign immunity,
6. In the event that Foundation fails or refuses to perform its duties hereunder, City shall,
within forty-five (45) days of Foundation's failure or refusal of performance, give
Foundation written notice of such failure or refusal of performance which notice shall
completely and accurately describe the duty and the nature of Foundation's refusal or
failure of performance. Within thirty (30) days of receipt of such notice, Foundation

shall undertake to perform or cause the performance of its said duty. No funds received
from the service district tax shall be expended for purposes of this Agreement.
7. Any and all notices, requests or demands given or required to be given under this
Agreement shall be in writing and mailed by registered or certified mail, return receipt
requested, postage paid, or hand-delivered to the other party. Notice to City shall be
provided to City Manager, 364 Municipal Building, 21 S Church Avenue, S.W" Roanoke,
Virginia 24011. Notice to Foundation shall be provided to President, Downtown
Roanoke Incorporated, 213 Market Street, Roanoke, Virginia 24011,
8, In the performance of this Agreement, Foundation shall not discriminate against any
contractor, subcontractor, sublessee, employee, applicant for employment, or invitee,
because of race, religion, color, sex, or national origin, except where race, religion,
color, sex, or national origin is a bona fide qualification reasonably necessary to the
normal operation of the party,
9. During the performance of this Agreement, Foundation agrees to: (i) provide a drug-free
workplace for Foundation employees: (ii) post in conspicuous places, available to
employees and applicants for employment, a statement notifying employees that the
unlawful manufacture, sale, distribution, dispensation, possession, or use of a
controlled substance or marijuana is prohibited in the workplace and specifying the
actions that will be taken against employees for violations of such prohibition: (iii) state
in all solicitations or advertisements for employees placed by or on behalf of Foundation
that Foundation maintains a drug-free workplace: and (iv) include the provisions of the
foregoing clauses in every subcontract or purchase order of over $10,000, so that the
provisions will be binding upon each subcontractor or vendor. For the purposes of this
section, "drug-free workplace" means a site for the performance of work done in
connection with a speCific contract awarded to a contractor, the employees of whom are

prohibited from engaging in the unlawful manufacture, sale, distribution, dispensation,
possession or use of any controlled substance or marijuana during the performance of
the contract or Agreement.
10. By September 30th after each year this Agreement is in effect, Foundation shall make
available to appropriate City personnel an accounting of fiscal year expenditures of
those funds included in this Agreement. Upon request of City, foundation shall provide
the City with an annual audited financial statement for Foundation,

modification is set forth in a written instrument executed by all parties to this
agreement.

prior fiscal year, as most revenues are growing as anticipated. Detailed comments
on budgetary variances for our major revenues are addressed as follows:
General Property Taxes increased 8,3% due in part to the collection of a non-
recurring delinquent machinery and tools tax of approximately $887,000. In
addition, Personal Property Tax revenue recognized from the annual assessments
increased by 4.4% compared to fiscal year 2006, It should be noted that the
Personal Property tax as reported through April is based on billed amounts since
collection of the tax is not complete until after the May 31" due date. Revenue on
the cash basis should closely follow these results, however. The Real Estate Tax
also contributes to the increase due to growth in real estate -reassessments and
new construction. The second semi-annual installment of the real estate tax was

due AprilS, 2007. This tax was expected to grow by approximately 7.6% in FY
2007, and actual growth met this expectation.
Other Local Taxes increased 2.5% in the current fiscal year. Sales Tax growth
through April totaled 7,3% compared to the same period during FY06. Sales Tax is
performing well on a year-to-date basis, and is exceeding projections. The
Cigarette Tax also contributed to the growth in this category due to the rate
increase from 27 cents to 54 cents per twenty pack effective July 1, 2006. While
this tax rate has produced growth compared to the prior year, it has not performed
as well as anticipated and will under perform the revenue estimate in fiscal year
2007. Also adding to the growth in this category are increases in both Prepared
Food and Beverage Tax and Transient Occupancy Tax revenues of 4.3% and 5.7%,
respectively. Conversely, there has been a decrease in the Telecommunications
revenues due to the timing of the receipt of revenues under the new program. The
new state-established Telecommunications Tax went into effect January 1, 2007
with the first distribution to localities in March. This new tax was intended to be
revenue neutral relative to the taxes it replaced, but collections of the new tax
statewide are lower than anticipated. Revenues from telecommunications in
general have been negatively impacted compared to last year as a result of the
change in timing of receipt from the State versus when the revenues were received
by the City directly from telecommunications businesses. By the close of the fiscal
year when accruals are made, this timing difference will be rectified. The Virginia
Department of Taxation will be auditing the implementation process in the future.
Revenues from the Business, Professional, and Occupational License Tax (BPOL) are
above the fiscal year 2007 adopted estimate, but are slightly lower than this time
last year.
Permits, Fees and Licenses decreased 5.8% compared to the same period in fiscal
year 2006. This decline is due to a lower total value of properties on which
building inspection permit fees have been obtained,
Fines and Forfeitures increased 9.5% due in part to an increase in Collection Fees
revenue. Higher revenue from General District Court fines due to an increased case
load also contributed to the variance.

Revenue from the Use of Money and Property increased 5S.4% due in part to a
timing difference in the collection of Health Department rent and several leases
being re-established at higher renewal rates. In addition, the City continues to
benefit from higher interest rates.

Grants-in-Aid Commonwealth grew 12.4% in part due to a timing difference in the
collection of personal property tax relief revenues. Also contributing to the
increase are reimbursements to fund the costs of constitutional officers, AFDC
Foster Care revenues, and funding for law enforcement through HB 599. These
revenues have grown as expected based on state budgetary data,
Internal Services grew by 10.1 % over fiscal year 2006 due in part to an increase in
the school share of the comprehensive services act revenues. Also contributing to
the variance is the timing between fiscal year 2007 and fiscal year 2006
recognition of the revenues for audit services provided to the schools and fire
safety services provided to the airport.
Miscellaneous Revenue increased 17.0% in the current fiscal year primarily due to
the collection of a larger purchasing card rebate than in the prior year.
Expenditures
General Fund obligations as a whole increased 7.7%. The FY07 expenditure budget
includes funding of approximately $1.2 million to cover contracts and purchase
orders made during FY06 but not paid by the end of that year. City Council
approved re-appropriation of this funding when adopting the General Fund budget
in May 2006. Additionally, General Fund expenditures of all departments are
affected by a 4% pay raise effective July 1, 2006. Other than these items, which
affect most categories of expenditures, variances between FY06 and FY07 are
addressed as follows:
Judicial Administration expenditures increased 13,1 % due in part to an increase in
the number of juveniles housed at the Roanoke Valley Juvenile Detention Center in
the current fiscal year. These expenditures have grown as expected based on the
fiscal year 2007 budget.
Public Safety expenditures increased 8.3% due to the aforementioned pay raise, as
well as an increase in the cost of prison health care services and food.
Health and Welfare expenditures increased 9.7% primarily due to higher foster care,
special needs adoption, and daycare services expenditures as a result of a higher
rate of child placement.

Parks, Recreation, and Cultural expenditures grew 11.8% due in part to the
aforementioned pay raise. An increase in workers compensation expenditures as
well as a professional contract for accreditation also contributed to the variance,
This category of expenditures is growing as anticipated based on the adopted
budget.
Transfer to Debt Service Fund expenditures increased 7,5% primarily as a result of
the Series 2006 A & B general obligation bond issuances, Debt payments for these
series commenced in the current year.
Nondepartmental expenditures increased 27.2% due to an increase in the amount
of undesignated fund balance transferred to the Capital Projects, Civic Facilities,
Market Building, and Greater Roanoke Transit Company funds. These transfers
fluctuate from year to year based on the needs of each fund and availability of fund
balance.

AN ORDINANCE to amend ~36.2-100, Code of the City of Roanoke
(1979), as amended, and the Official Zoning Map, City of Roanoke, Virginia, dated
December 5, 2005, as amended, to rezone five tracts of land located on Highland Farm
Road, N.W., and Femcliff Avenue, N.W., and identified by Official Tax Nos, 6460102,
6460103, 6472207, 6472208 and 6472209, from INPUD, Institutional Planned Unit
Development District, and ROS, Recreation and Open Space District, to INPUD,
Institutional Planned Unit Development District.
WHEREAS, the City of Roanoke, represented by Darlene L. Burcham, City
Manager, has made application to the Council of the City of Roanoke, Virginia ("City
Council"), to have the hereinafter described properties rezoned from INPUD, Institutional
Planned Unit Development District, and ROS, Recreation and Open Space District, to
INPUD, Institutional Planned Unit Development District, to permit the redevelopment of
the William Fleming High School campus, such redevelopment to include a new
approximately 295,000 square foot main high school building, an approximately 3,000
seat sports stadium, three new ballfields, two practice fields, tennis courts, an
approximately 3,362 square foot new employee health center building located along
Femdale Drive, and two new parking areas to the north and south of the new high school
building. The existing Lawson Hall and the William Ruffner Middle School buildings
will remain. The classroom wing (west) will have a parapet height of approximately 33
feet, and the gym and theater in the east wing will have a parapet height of approximately
40 feet. The stadium is estimated to be 33-34 feet high, but will not exceed 40 feet high,

and the stadium will have four light poles at a height of approximately 70-75 feet each.
The exterior of the school will be brick and metal;
WHEREAS, the City Planning Commission, after giving proper notice to all
. concerned as required by 936.2-540, Code of the City of Roanoke (1979), as amended,
and after conducting a public hearing on the matter, has made its recommendation to City
Council;
WHEREAS, a public hearing was held by City Council on such application at its
meeting on May 21, 2007, after due and timely notice thereof as required by 936.2-540,
Code of the City of Roanoke (1979), as amended, at which hearing all parties in interest
and citizens were given an opportunity to be heard, both for and against the proposed
rezoning; and
WHEREAS, City Council, after considering the aforesaid application, the
recommendation made to City Council by the Planning Commission, the City's
Comprehensive Plan, and the matters presented at the public hearing, finds that the public
necessity, convenience, general welfare, and good zoning practice require the rezoning of
the subject property, and for those reasons, is of the opinion that the hereinafter described
property should be rezoned as herein provided.
THEREFORE, BE IT ORDAINED by the Council of the City of Roanoke that

Planning Commission Public Hearing/Recommendation
Planning Commission public hearing was held on Thursday, April 19, 2007. The
Commission found the application to rezone Official Tax Nos. 6472207, 6472208,
& 6472209 from ROS to INPUD and to amend the INPUD for Official Tax Nos,
6460102 and 6460103 for the demolition and reconstruction of William Fleming
High School to be consistent with Vision 2001-2020 and the Peters Creek North
Neighborhood Plan, By a vote of 5-0 (Mr. Williams absent and Mr. Rife
abstaining), the Commission recommended that City Council approve the
request.

Background
The applicant is requesting to demolish and reconstruct the William Fleming High
School campus, This will be the first development plan for the facility as the
property was comprehensively rezoned to an INPUD in December of 2005. The
first phase of construction would be the 297,000 square foot higl:1 school. The
school would be a maximum of forty (40) feet in height and constructed of brick,
pre-cast concrete, glass, metal panels and architectural Concrete Masonry Units.
Once complete, the existing high school would be demolished and construction
of parking facilities and athletic fields would begin including a 161 space faculty,
staff and bus parking lot off Ordway Drive NW; a 353 space student, event and
visitor parking lot off Ferncliff Avenue, N.W., a 3,000 seat stadium with a
maximum height of 40 feet; three ball fields; six tennis courts; and two practice
fields. A 3,362 square foot City school employee health clinic would also be
constructed, William Ruffner Middle School, Lawson Hall and their associated
parking would be retained.

Compliance with the Zoninq Ordinance:
The proposed development plan complies with all regulations set forth in the
City's Zoning Ordinance for dimensional standards within the district, parking,
and buffer yards. All other components will be required to meet the regulations
of the Zoning Ordinance during the comprehensive plan review process.
Stadium lighting will be required to obtain a special exception from the Board of
Zoning Appeals.
Conformity with the Comprehensive Plan and Neiqhborhood Plan:
Providing quality educational facilities for the citizens of Roanoke is a high
priority, A well planned facility not only provides a place to educate the
community's youth but provide education and recreation to citizens of all ages
and with a variety of interests. The flexibility of the space proposed in this
application could easily be used for a multitude of activities and events for the
community,
Both plans emphasize the importance of improving the City's infrastructure and
providing a variety of safe transportation options. Addressing the lack of
sidewalks, curb and gutters is a major priority for Peters Creek' residents. The
development plan calls for the construction of a sidewalk along the subject
property's frontage on Ferncliff Avenue, NoW., providing a missing link in
pedestrian circulation,
The following policies of Vision 2001-2020 are relevant in the consideration of
this application:
· PE P4. Quality Education. Roanoke's school system will be known for its
quality education that prepares students for the workplace or with the skills

and knowledge needed to succeed in higher education. Roanoke will
maintain and improve its high-quality public education facilities and programs
at all levels.
. PE P2. School Facilities. School facilities are important community facilities,
The location of new school facilities will be carefully planned to enhance the
surrounding community and adhere to the City Design principles
recommended.
. PE P4. Community learning centers. Roanoke will encourage the efficient
use of public schools by co-location of education, lifelong learning, and
recreation programs in school facilities, making them community learning
centers.
The following recommendations of the Peters Creek North Neighborhood Plan
are relevant in the consideration of this application:
. Economic Development
o Ferncliff Avenue: Pedestrian connections should be provided to
existing residential areas and hotels.
. Infrastructure:
o Improve sidewalk/curb system.
o Improve traffic circulation and connections.
o When developing curb and sidewalk:
. Concentrate new infrastructure on improving pedestrian
circulation to important destinations.
. Require developers to install new sidewalk and curbs at
rezoning in a manner consistent with current city policy.
. Provide planting strips at least six (6) feet wide when new
sidewalks and curbs are installed.
. Quality of Life
o Improve non-motorized transportation and circulation in the
neighborhood.

City Department Comments:
The City's Transportation Manager proposed three modifications to the INPUD
development plan. These modifications are as follows with the applicant's
response in italics:
. The two proposed entrances should be combined into one entrance and
located further from the existing entrance at Ruffner. As an alternative,
the entrance at Ruffner may be relocated or modified to improve the
existing condition. The entrance to William Ruffner has been significantly
reduced providing greater separation between this entrance and the new
William Fleming entrance.
. Additional right of way should be preserved or dedicated along Ferncliff
Avenue, N,W., and Ferndale Drive, N.W, Given the volume of school
traffic and potential development in the vicinity of the school,
improvements will likely be required to provide, at a minimum, turn lanes
on Ferncliff Avenue, NW. The applicant is proposing a 57' right-of-way
for Ferncliff Avenue, N. W. This would add 2.5' of pavement to the
roadway, a 2.5' curb and gutter, a 6' planting strip, a 5' sidewalk and a 0.5'
right-of-way edge. According to the City's Transportation Manager, a 66'
right-of-way should be provided to meet the City's draft Street Design
Guidelines. The additional nine (9) feet of right-of-way would allow a
nineteen (19) foot landscaped median to be added in the future.
. Ferndale Drive should be connected to Ordway Drive to facilitate traffic
flow around the school without requiring vehicles to use Hoback Drive or
Hershberger Road. The applicant has not proposed any changes to this
area which would preclude the future connection of these streets.
Planninq Commission Public Hearinq:
The Planning Commission discussed the following at their public hearing on April
19,2007,
1, The Planning Commission asked how the height of the stadium's lights
compared to Patrick Henry High School. The applicant responded that
Patrick Henry would have six (6) poles at fifty-five (55) feet to sixty (60)
feet in height while William Fleming would have four (4) poles at seventy-
five (75) feet in height. Staff added that stadium lighting must go before
the Board of Zoning Appeals for a Special Exception.

2. The Planning Commission asked if the project would be phased, The
applicant said it would with the construction of the high school first, the
demolition of the existing high school second and the construction of
parking and athletic fields last
3. The Planning Commission asked how the applicant had addressed the
City's Transportation Manager's request to connect Ordway Drive and
Ferndale Drive. Staff responded that while applicant is not dedicating any
right-of-way, they are also not proposing any changes that would preclude
the connection at a later date.
One (1) member of the public spoke in regards to this application. He asked who
was responsible for determining the effects of the school and the 3,000 seat
stadium on traffic. Staff responded that the City's Transportation Manager was
responsible for that determination and that the results of his review did not raise
concern over an increase in traffic from the current volumes as the same number
of students and teachers would be accessing the site.

Applicant's Report
The proposed zoning amendments will permit the redevelopment of
William Fleming High School with a new building and associated
accessory uses. The use and scale of the high school campus is such that
it is only permitted in the INPUD district.
The majority of the property, comprised of parcels 6460103 & 6460102,
is zoned INPUD. This application is to have an INPUD development plan
adopted for this portion of the property. Three smaller parcels to the
north of the school, identified as parcels 6472207, 6472208, & 6472209
are zoned ROS and this application proposes rezoning these parcels to
INPUD, with the development plan also applicable to this portion of the
site. All five parcels will be combined into a single parcel of
approximately 61.3 acres,
The site will contain a new 297,000 s,f. main high school building, a
3,000-seat sports stadium, three new ball fields, two practice fields, and
tennis courts. A 3,362 s.f. new employee health center building will be
located to the west of the existing Lawson Hall. The existing Lawson Hall
(40,000 s.f.) will remain. The William Ruffner Middle School building will
also remain. Two new parking areas are proposed to the north and south
of the new high school building.
The INPUD development plan meets the requirements of section 36.2-
327(e) of the Zoning Ordinance, Items (1) through (6) underthis section
are shown on the "William Fleming High School Proposed INPUD
Development Plan," prepared by Caldwell White Associates, revised March
29, 2007, attached as Exhibit 2. Information about infrastructure (Item
(7)) is shown on page 2 of this exhibit. Information for Item (8) to .
demonstrate the compatibility of structures with the character and
appearance of the surrounding neighborhood is provided below,
The classroom wing (west) has a parapet height of approximately 33 feet.
The gym and theater in the east wing will have a parapet height of
approximately 40 feet. This height is comparable to adjacent properties
such as Johnson & Johnson and Burlington Coat Outlet and lower than
two of the nearby hotels. The stadium is estimated to be 33-34 feet high.
Final design of the stadium has not been determined, but will not exceed
40 feet. The stadium will have four light poles at 70-75 feet each, The
stadium lighting is subject to special exception review and approval by
the Board of Zoning Appeals.
The exterior of the school will be brick and metal panels. The nearby
commercial, industrial and retail uses also use these materials.

redevelopment to include a new approximately 295,000 s,f. main high school
building, an approximately 3,000 seat sports stadium, three new ballfields,
two practice fields, tennis courts, an approximately 3,362 s,f. new employee
health center building located along Femdale Drive, and two new parking
areas to the north and south of the new high school building. The existing
Lawson Hall and the William Ruffner Middle School buildings will remain.
The classroom wing (west) will have a parapet height of approximately 33
feet, and the gym and theater in the east wing will have a parapet height of
approximately 40 feet. The stadium is estimated to be 33-34 feet high, but
will not exceed 40 feet high, and the stadium will have four light poles at a
height of approximately 70-75 feet each. The exterior of the school will be
brick and metal panels,
