October 1,2007 at 12:00 p.m., in Room 159. All agenda items were requested to

8. UNFINISHED BUSINESS:
a. Request of Echo Sentinel Group, LLC, and Unified Human Services
Transportation Systems, Inc., that 3151 Street, N. W., between Baker
Avenue and Breckenridge Avenue, N. W.; and a portion of Breckenridge
Avenue, N. W.; and a 1 5 foot wide alley running in an easterly direction
to its terminus at 3151 Street, N. W., be permanently vacated,
discontinued and closed. (Ordinance was tabled on Monday, August 20,
2007.)
Matter was carried over until the next regular meeting of Council on
Monday, September 17, 2007, at 2:00 p.m.

10. MOTIONS AND MISCELLANEOUS BUSINESS:
a. Inquiries and/or comments by the Mayor and Members of City Council.
Council Member Lea inquired about the City's Dog Ordinance as it
pertains to dangerous dogs.

Council Member Mason inquired about the status of a day center for
the homeless at the Rescue Mission, and the Step Plaza in downtown
Roanoke.
Mayor Harris announced that since there were no public hearings
scheduled to be heard by the Council on Monday, September 17,
2007, at 7:00 p.m., the 7:00 p.m. Session of the Council will be
cancelled. He also called attention to the opening football season at
Patrick Henry High School on Monday, September 3,2007, noting that
the Stadium was filled with enthusiasm and excitement, and there
appeared not to be any problems with traffic or parking.
The City Attorney was instructed to prepare the proper measure
granting Monday, December 24, 2007, and Monday, December 31,
2007, as paid holidays for City employees.
b. Vacancies on certain authorities, boards, commissions and committees
appointed by Council.
11. HEARING OF CITIZENS UPON PUBLIC MATTERS: NONE.
12. CITY MANAGER COMMENTS:
City Manager distributed copies of the Citizen Magazine. She also called
attention to the Arts Festival on October 4 - 7, 2007.
CERTIFICATION OF CLOSED SESSION. (5-0, Council Member Lea
and Dowe were absent.)
Barry Baird was reappointed as a member of the Local Board of Building
Code Appeals for a term ending September 30, 2012.

Recommendation for
Downtown Parking System
Rate Increases
Dear Mayor Harris and Members of City Council:
On Tuesday, July 31, 2007, City staff hosted 2 public information meetings at
the Science Museum of Western Virginia, to provide information regarding the
proposed fiscal year 2008 parking rate increases and to facilitate public
discussion of potential alternative funding / rate solutions in support of the
parking enterprise fund.
Approximately 25 citizens attended the two sessions. City staff was also in
attendance as well as representatives of the City's parking system management
company, Lanier Parking Systems.
The powerpoint presentation previously sent to City Council was shared with
the attendees outlining. basic information about the City's parking system's size
and utilization, the comparative rate structure, . budgetary and financial
information, capital construction needs, and related debt service and rate
increase scenarios for the parking fund. Upon completion of the presentation,
staff reviewed with the audience a variety of suggested .funding / revenue
enhancement proposals that had been received, and asked for additional
suggestions and feedback. A summary of that information is outlined below:
1. Suggestions Received From Public prior to the July 31" Public Meetings:
· Provide 1" and/or 2nd hour free daily/hourly parking.
(would require additional hourly rate increases of as much as 25%
to be revenue neutral)

o ProVide pre-paid yearly passes. (depending on rate and utilization,
could have a substantial adverse impact on revenues generated
from hourly parking)
8 Increase downtown service district tax to support parking fund, (to
cover needed revenue for debt service support would require an
additional 9 cents/$100 of assessed value on the current rate of
10<1:)
· Investigate selling advertisements inside parking garages, (staff
needs further time to evaluate potential revenue enhancements
from this suggestion; although it appears this would generate less
than $5,000 a year.
· Apply on-street parking ticket revenue to support the parking
fund's debt service needs. Currently net revenue derived from
fine/ticket collections is approximately $229,000.)

2. Suggestions Received From Public durinq and after the July 31" Public
Meetings:
· Reinstate on-street metered parking in downtown to increase
overall parking revenue to support garage construction debt
service costs. (meters removed in 1 999)
8 Subsidize the parking enterprise fund through transfer of funds
from the General Fund.
· Provide a differential student parking rate for the Higher Education
Lot and Gainsboro Garages than those proposed.
· Increase utilization and extent of business supported validated
customer parking.
· Develop a 'contracted' payment process for event parking, paid
directly by event promoters/operators in downtown in lieu of the
proposed $2 event rate for parking patrons at certain parking
facilities.
· Have non-profit organizations provide support to the parking fund
in lieu of payment by the public and/or customers attending
events.
· Implement a tiered real estate tax rate system, and have additional
revenue raised used to support the parking system.
· Increase daily parking rates Monday-Friday to raise additional
revenue in order to keep nights and weekends free.
Staff evaluated all comments/suggestions submitted prior to, during, and
subsequent to, the meetings as part of the development of its recommendation
on rate changes to the City Council. Based on upon the comments received,
and to ensure the appropriate rate structure to meet anticipated revenue needs
for Fiscal Year 2008, the follOWing rate structure is recommerided:
.. Implement previously adopted rate increases:
increase daily parking rates from O. 75/half hour to 1.00/half hour (Center in
Square, Church Avenue, Tower, and Market Garages)
Increase daily parking rates from .50/hour to .50/half hour
(Gainsboro Garage and Higher Ed Center Lot)
Increase monthly rate for reserved spaces from $85 to $90; unreserved
spaces from $65 to $70
(Center In the Square Garage)
Evening Rates (4pm-9pm) (Monday through Saturday):
o Center In the Square Garage: $3
o Market Garage, Tower Garage: $2

Evening Rates (4pm-9pm) (Monday through Friday):
o Gainsboro Garage: $2
· Implement Modifications to Previously Adopted Rate Increases:
NO DAY RATES on Saturday/Sunday in any facilities (evening rates in effect
beginning at 4pm on Saturdays in Tower, Market and Center In The Square
Garages)
Delay implementation of an Event Rate until July 2008, to give event
organizers and operators time to plan for such a rate. Staff will further
investigate the' suggestion made by EventZone during public sessions to
devise a 'single/flat' payment from event organizer to parking system per
event for use of certain facilities at no charge by patrons/volunteers/guests.
$1 discount with student ID at the Gainsboro Garage Evenings (Monday
through Friday 4pm - 9pm)
If approved, these rate adjustments would go into affect on October 1, 2007,
and would result in approximately $183,000 of the $245,000 previously
anticipated in the FY-08 budget. This revenue, in addition to $62,000
previously set aside within the parking fund would be sufficient to support the
additional operating and debt service expenses for the Campbell Avenue
parking facility and would not require monies from the General Fund.

Dear Nelson:
I am writing to inform you of my decision to resign as a Commissioner and Chair of the
Roanoke Redevelopment and Housing Authority board effective August 31, 2007. My
expanded job responsibilities coupled with the announcement ofFNB Corporation's
merger with Virginia Financial Group, Inc. precludes me from dedicating the time that is
necessar~,~o be effective in these roles.
The Authority is blessed with a dedicated staff under the able leadership of Ms. Glenda
Edwards. In addition, the reconstituted Board is compris~d of dedicated 'individuals
committed to the mission of the Authority and its constituents. The business climate
within the Authority has been stabilized and is improving, in my estimation. So I feel the
timing of my departure will have limited impact.
Please extend my appreciation to your fellow Council members for allowing me to be of
service to the City of Roanoke.

BE IT RESOLVED by the Council of the City of Roanoke as follows:
1. The City Manager is hereby authorized on behalf of the City to accept from the
Commonwealth of Virginia Department of Criminal Justice Services a VictimlWitness Assistance
Program grant in the amount of $115,117.00 for Fiscal Year 2007-2008, such grant being more
particularly described in the letter of the City Manager to Council dated September 4, 2007.
2. The local cash match for Fiscal Year 2007-2008 shall be in the amount of$29,386.
3. The City Manager is hereby authorized to execute and file, on behalf of the City, any
documents setting forth the conditions of the grant in a form approved by the City Attorney.
4. The City Manager is further directed to furnish such additional information as may be
required by the Department of Criminal Justice Services in connection with the acceptance of the

Acceptance of the Victim Witness
Program Grant
Background:
The Victim/Witness Assistance Program has been awarded a twelve month $115,117 grant
(#08-N8554VW07) for July 2007 through June 2008. The grant from the Department of
Criminal Justice Services (DCJS) will allow the Victim/Witness Assistance Program to
continue to provide comprehensive information and direct services to crime victims and
witnesses in accordance with the Virginia Crime Victim and Witness Rights Act.
The Victim/Witness Program continues to operate with a full-time coordinatorforthe Circuit
Court, as well as one full-time assistant for the Juvenile and Domestic Relations Court and
one full-time assistant for the General District Court.
The Victim/Witness Program is coordinated by the Office of the Commonwealth's Attorney.

Considerations:
The cost to the City for grant #08-N8554VW07 would be $29,386 as a local cash match for
a total grant budget of $144,503. The local cash match is an increase of $2,428 from FY
2006-2007. This local cash match is included in the General Fund FY 2007-2008 adopted
budget in the Transfer to Grant Fund account (01-250-9310-9535).
Recommendations:
Accept the Victim/Witness Grant #08-N8554VW07 of $115,117 with the City of Roanoke
providing $29,386 as a local cash match from the funding provided in the Transfer to Grant
Fund account.
Authorize the City Manager to sign and execute all appropriate documents, approved as to
form by the City Attorney, to obtain Grant #08-N8554VW07.
Adopt the accompanying budget ordinance to establish revenue estimate of $115,117 in
state grant funds and $29,386 in local match in the Grant fund, to transfer local match
totaling $29,386 from the General Fund and to appropriate funding totaling $144,503 as
outlined on Attachment A in accounts to be established by the Director of Finance in the
Grant Fund.

offered by the Commonwealth of Virginia Commission for the Arts in the amount of $5,000

Background:
Notification has been received from the Commonwealth of Virginia Commission
for the Arts that a $5,000 Local Government Challenge Grant (LGCG) has been
awarded to the City of Roanoke. Application for the grant was made for the
Arts Council of Roanoke Valley, Mill Mountain Theatre, Opera Roanoke, and
Roanoke Symphony Orchestra.
Considerations:
In order to receive these funds, the Commission must obtain written
confirmation that local funds will be used to match or exceed the amount of the
grant. For Fiscal Year 2007-08, the organizations receiving LGCG funds will
also receive local funding through the Roanoke Arts Commission in the
amounts shown below:

rezoned from MX, Mixed Use District, to I-I, Industrial District, with the proffer that the
property would be' developed for certain uses as set forth in the permitted uses list
contained in Amended Application No.2, dated June 18, 2007, to allow for certain
commercial and industrial uses;
WHEREAS, the City Planning Commission, after giving proper notice to all
concerned as required by 936.2-540, Code of the City of Roanoke (1979), as amended,
and after conducting a public hearing on the matter, has made its recommendation to City
Council;
WHEREAS, a public hearing was held by City Council on such application at its
meeting on August 20, 2007, after due and timely notice thereof as required by 936.2-
540, Code of the City of Roanoke (1979), as amended, at which hearing all parties in

interest and citizens were given an opportunity to be heard, both for and against the
proposed rezoning; and
WHEREAS, City Council, after considering the aforesaid application, the
recommendation made to City Council by the Planning Commission, the City's
Comprehensiv~ Plan, and the matters presented at the public hearing, finds that the public
necessity, convenience, general welfare, and good zoning practice require the rezoning of
the subject property, and for those reasons, is of the opinion that the hereinafter described
property should be rezoned as herein provided.
THEREFORE, BE IT ORDAINED by the Council of the City of Roanoke that:
1. g36.2-100, Code of the City of Roanoke (1979), as amended, and the
Official Zoning Map, City of Roanoke, Virginia, dated December 5, 2005, as amended,
be amended to reflect that three tracts of land located at 1302 Kimball Avenue, N.E.,
bearing Official Tax Nos. 3043001, 3043002 and 3043003, be, and are hereby rezoned
from MX, Mixed Use District, to I-I, Industrial District, subject to a proffer to allow for
certain commercial and industrial uses, as set forth in the Application for Conditional
Rezoning - Amended Application No.2 of Plantation & Kanter, filed in the Office of the
Department of Planning Building and Economic Development on June 18, 2007.
2. Pursuant to the provisions of Section 12 of the City Charter, the second

On June 7, 2007, Plantation and Kanter filed an Application for Conditional Rezoning,
requesting that Official Tax Nos. 3043001, 3043002 and 3043003 be rezoned with the proffer as
set forth in the application. On June 18, 2007, an Amended Application No.1 and an Amended
Application No.2 were filed, requesting that the aforesaid properties be rezoned with the proffer
as set forth in the respective applications. At the time of the filings, the subject property was
zoned MX, Mixed Use District. .
On July 19, 2007, the Planning Commission recommended by a 5-0 vote (Messrs.
Chrisman and Williams were absent) that the property be rezoned to I-I, Industrial District,
subject to a proffer proposed by the applicant. At a public hearing held on August 20, 2007, City
Council voted to rezone the property as requested by Plantation and Kanter, and as
recommended by the Planning Commission. While it correctly indicates that the property is to
be rezoned to I-I, Industrial District, in the title paragraph, the ordinance that was adopted uses
an incorrect district designation elsewhere. I have prepared a revised ordinance, which corrects
this error.

Subject: July Financial Report
The adopted budget for fiscal year 2008 totals $2S2.6 million representing a S.4% increase over
the previous year. Additional revenue sources include a projected increase in Real Estate and
Personal Property tax revenue, as well as projected growth in various local taxes including Sales
tax, Business License tax, and Prepared Food and Beverage tax. The aforementioned additional
revenues will be allocated in part to provide more funding to the Roanoke City Public Schools, for
capital maintenance and equipment replacement, to enhance services to citizens, and to fund
salary increases for employees. Furthermore, the fiscal year 2008 budget provides for greater
social services program funding and the resources necessary to meet the current year's debt
service requirements.
The Commonwealth recently announced that reductions in funding to localities will be necessary
as a result of a shortfall in state revenues. Reductions of five percent are planned. Some state-
funded programs will be exempted including mandated Comprehensive Services Act programs and
certain others. More information will be available from the state in the fall, and we will
recommend adjustments to our budget if needed. The City's funding from the Commonwealth
totals $66.3 million.
This financial report covers the first month of activity for fiscal year 2008. The first quarter of the
year is difficult to analyze due to the relatively small volume of activity which occurs within the
early months. Additionally, the accrual of certain revenues and expenditures into the prior year,
and accompanying accounting..reversal, cause some categories to have very small or even negative
balances in the early months of fiscal year 2008 until current year activity exceeds the impact of
the reversals. The following narrative provides commentary on the significant events of this first
fiscal month.
Revenues
Revenues for July are negative in total, as well as in several of the individual categories, due to the
accrual of amounts to the prior year without collections in the current year to offset the impact of

the reversed accrual. Some revenues, whether positive or negative in balance, have additional
variances from the prior year and are addressed as follows:
General Property Taxes decreased as a result of the difference in the accrual reversals. This
variance is primarily seen in the Personal Property Tax area. Collections for the months of July and
August are accrued back to the prior fiscal year in accordance with governmental accounting
standards. The amounts accrued back to FY07 were greater than in FY06. Therefore, the reversal
affecting FY08 is a higher negative amount than in the previous year. The City should start
recognizing an increase in Personal Property taxes later in the year: as the fiscal year 2008 budget
increased 9.1 %, due in part to the decrease in the personal property tax relief percentage. Real
Estate taxes are expected to provide growth of 6.3%
Other Local Taxes decreased in total due in part to the aforementioned impact of accrual reversals.
In FY07, the Cigarette Tax increased from 27 cents to 54 cents per pack. July FY07 revenue was
low because merchants purchased tax stamps at the end of fiscal year 2006 in anticipation of the
higher rates for the new year. In addition, the accrual reversal of the new state-established
Telecommunications Tax program which went into effect January 1, 2007, caused a negative
balance in this category for July. This revenue is received two months after the period for which it
is applicable. The timing difference willlevei out later in the year and be eliminated at the close of
fiscal year 2008 with year end accruals.
Permits, Fees and Licenses decreased from fiscal year 2007. The decline is due to lower building
inspection permit fees recognized over the same period last year. The City experienced an active
construction market during fiscal year 2006 which carried over into July and August fiscal year
2007. The revenue recognized in July of fiscal year 2008 is more indicative of the average
collected in September through June of fiscal year 2007.
Fines and Forfeitures increased due in part to higher collections of delinquent tax fees. Higher
revenue from General District Court fines and Parking Tickets also contributed to the variance.
Revenue from the Use of Money and Property decreased over the prior year due primarily to the
timing of billings for the Commonwealth Building rental as well as other rentals.
Charges for Services increased compared to the same time period in fiscal year 2007. This is due
primarily to large collections of Emergency Medical Services charges. The City is continuing to
benefit from the positive collection results of its third party billing company. The current period
revenue included collections of prior year's accounts dating back to November 2005. Also
contributing to the variance is an increase in Weed Cutting and Demolition billings.

Internal Services decreased due to a diffe'rence in Roanoke Regional Airport fire station billing
accrued in relation to the prior fiscal year. Also contributing to the variance is a decrease in the
School Share of Comprehensive Services Act revenue.
Miscellaneous Revenue increased as a result of a timing difference in City-sponsored tax sales and
the related collections that follow. These tax sales are periodic, and collections fluctuate from
year to year as well as month to month. In addition, collections were received in July fiscal year

2008 for the Building New Partnership Conference to be held this September. In fiscal year 2007,
collections were not received until much later in the fiscal year.
Expenditures
The fiscal year 2008 expenditure budget includes funding of approximately $1.6 million to cover
contracts and purchase orders made during fiscal year 2007 but not paid by the end of that year.
City Council approved re-appropriation of this funding when adopting the General Fund budget in
May. Additionally, General Fund expenditures of all departments are affected by a 4% pay raise
effective July 1, 2007. Other than these items which affect most categories of expenditures,
variances between fiscal year 2007 and fiscal year 2008 are addressed as follows:
Public Safety costs increased due to a timing difference in two large encumbrances, the Jail food
services contract and the Wearing Apparel contract. They were both encumbered in July this year,
but not until August last fiscal year.
Public Works costs decreased as a result of the contract for Paving Program expenditures being
encumbered earlier in the previous year than in the current.
Health and Welfare increased due to higher foster care, special needs adoption, and daycare
services expenditures as a result of a higher rate of child placement.
Parks, Recreation and Cultural expenditures increased as a result of a timing difference in
payments providing funding to various cultural agencies through the Roanoke Arts Commission
cost center. Expenditures for the Arts Festival Anniversary Celebration also contributed to the
variance, as fiscal year 2007 had no activity in this area until November. In addition there is a
timing difference in the encumbrance of the cleaning contract for the Libraries as well as
additional personnel costs.
Community Development costs increased due to earlier payments to the Convention and Visitors
Bureau, Marketing Initiative, Center in the Square, Fifth Planning District, Building New
Partnerships, and Virginia First Cities Coalition than in the prior fiscal year.
Transfer to Debt Service Fund expenditures decreased due to a timing difference in the transfer of
funds for the August 1" debt service payments.
Nondepartmental expenditures increased primarily due to an increase in the transfer to the Capital
Project Fund for cash funding of the capital improvement program for fiscal year 2008. In fiscal
year 2007, less funding was transferred, and the transfer was not made until October.

WHEREAS, the Council is advised that the term of office ofF. Gordon Hancock, a Director
of the Economic Development Authority ofthe City of Roanoke, Virginia, will expire October 20,
2007; and
WHEREAS, ~15.2-4904, Code of Virginia (1950), as amended, provides that appointments
made by the governing body of such Directors shall, after initial appointment, be made for terms of
four (4) years.

BE IT RESOLVED by the Council ofthe City of Roanoke as follows:
1. For the Annual Business Session of the Virginia Municipal League to be held during
the League's 2007 Annual Conference scheduled for October 14 -16,2007, in James City County,
Virginia, and for any meetings of the Urban Section held in conjunction with the Annual Conference
