C-4 A communication from the City Manager requesting that Council schedule a public hearing for Monday, March 17, 2008, at 7:00 p.m., or as soon thereafter as the matter may be heard, to consider a proposed lease agreement between the City of Roanoke and Easter P. Moses, owner, Gone CoCo, LLC., for rental space in the City Market Building. RECOMMENDED ACTION: Concurred in the request. C-5 A communication from the City Manager requesting that Council schedule a public hearing for Monday, March 17, 2008, at 7:00 p.m., or as soon thereafter as the matter may be heard, to consider budget adjustments for certain social services/human service programs. Phillips as a City representative to the Court Community Corrections Program Regional Community Criminal Justice Board for a term ending June 30, 2010; Lauren D. Saunders as a member of the Roanoke Public Library Board, for a term ending June 30, 2010; and Jay E. Foster as a member of the Roanoke Valley Alleghany Regional Commission to fill the unexpired term of William D. Bestpitch, for a term ending June 30, 2009. RECOMMENDED ACTION: Received and filed. REGULAR AGENDA 4. PUBLIC HEARINGS: NONE. 5. PETITIONS AND COMMUNICATIONS: a. A communication from Mayor C. Nelson Harris with regard to a selection process to fill the unexpired term of Alfred T. Dowe, Jr., which runs through June 30, 2010. Council adopted the selection process as proposed by the Mayor outlining certain dates and times. 6. REPORTS OF OFFICERS: a. CITY MANAGER: BRIEFINGS: NONE. 6 ITEMS RECOMMENDED FOR ACTION: 1. Appropriation of additional funds for weed and trash abatement. Adopted Budget Ordinance No. 38028-030308. (5-0) 2. Approval of a resolution supporting the City of Roanoke's designation as a Preserve America Community, a White House Administration initiative to encourage and support community efforts that preserve and enjoy its priceless cultural and natural heritage. Adopted Resolution No. 38029-030308. (5-0) b. DIRECTOR OF FINANCE: 1. Financial Report for the month of January 2008. Received and filed. 7. REPORTS OF COMMITTEES: NONE. 8. UNFINISHED BUSINESS: a. Conveyance of City-owned property located at Countryside Golf Course to Newbern Properties, LLC, for expansion of a heating and air conditioning company. (Matter was tabled on Tuesday, February 19, 2008.) Matter was deferred until Monday, April 7 at 2:00 p.m. b. Approval of Enterprise Zone One A and its subzone amendment applications. APPROVAL OF MINUTES FROM JUNE 4, 2007, MEETING Chairman Lea asked if there were any corrections or amendments to the minutes of the June 4, 2007, Audit Committee meeting. There were none. Ms, Mason moved and Mr. Trinkle seconded that the minutes be approved as Audit Committee Minutes - October 1,2007 Page 2 distributed. A vote was taken and the motion carried. The minutes will be placed on the Consent Agenda for the next City Council meeting. 3. INTERNAL AUDIT REPORT A. Alarm Registration Program Chairman Lea ordered that item A be received and filed. There were no objections to the order. Chairman Lea recognized Mr. Harmon for comments on the audit report. Mr. Harmon explained that the alarm registration program became effective in the City of Roanoke on January 1, 2004, for alarm company operators and commercial alarm system users to register their alarms. The goal of the ordinance was to provide current contact information for the city's response to alarms and to reduce false alarms. Mr. Harmon stated this audit examined the processes in place for the registration and billing of the alarm program for both Fire and Police Departments. It did not examine the effectiveness of the program in reducing false alarms. Mr. Harmon stated there were three findings in the report and other, less significant, items were discussed with management. It was found that the Fire and Police Departments were not assessing registrations, renewals, and fines in the same manner. Applicable City Code did not provide the clarity necessary to determine the proper procedures for administering the alarm programs. During the course of the audit, the Fire and Police Departments, along with Billings & Collections (which administers the city's centralized billing service), formed a committee to evaluate the process. The City Attorney's office and the Department of Technology are assisting in this endeavor. The committee was formed to collaboratively revise the ordinance and make it clearer. Mr. Harmon stated he thought the committee had a revision almost ready to present to City Council. Ms. Burcham stated that having the two ordinances, one for Police and one for Fire/EMS, had resulted in a significant reduction in false alarms responded to by the Police, thus freeing up law enforcement to respond to other calls. She emphasized the ordinances were not created to make money for the city through the fines, but to reduce the number of false alarms. She could not speak to a reduction in false alarms in the Fire Department, but stated that Mr. Grigsby possibly could. Mr. Grigsby stated there was a reduction in false alarms from some of the chronic abusers. Ms. Burcham said the ordinance changes would soon be brought before City Council, probably in about 30 days. Audit Committee Minutes - October 1,2007 Page 3 Chairman Lea commented on the large number of false alarms occurring within the city. Ms. Burcham responded that there have been very few appeals from people cited for violations. She further stated that the city's goal is to reduce the number of false alarms as much as possible in order to conserve city resources and enable appropriate responses to valid emergencies. 4. NEW BUSINESS: A. Roanoke City Council Audit CommitteeAnnLi:~.1 Report:'" June;30, 2007 Chairman Lea ordered item A to be received and filed. There were no objections to the order. 5. UNFINISHED BUSINESS: A. Letter from Auditor of Public Accounts Chairman Lea ordered that item A be received and filed, There were no objections to the order. Chairman Lea recognized Mr. Harmon for comments. Mr. Harmon stated this was in conjunction with the audit of the Clerk of the Circuit Court. Municipal Auditing does a portion of this audit, and the Auditor of Public Accounts (APA) does the remainder. This letter from the APA states there were no reportable conditions or instances of noncompliance that were required to be reported. 6. OTHER BUSINESS: A. Audit Activity Report Chairman Lea ordered item A to be received and filed. There were no objections to the order. Chairman Lea recognized Mr. Harmon for comments. Mr. Harmon explained that revisions to government auditing standards require adequate communication with the governing body related to activities of the auditing function. The audit activity report is intended to meet this standard and will be developed to include additional information in the future. Chairman Lea thanked Mr, Harmon for the report and commended the department on its work. He acknowledged the committee's support of development activities, such as participating on peer reviews of other Audit Committee Minutes - October 1, 2007 Page 4 localities, that contribute to improving auditing processes at the city. One of the department's key businesses is the enforcement of the weed and trash abatement program, mandated by City Code, Chapter 33, Article II. The services provided by this program include citing for violations declared as a public nuisance occurring on private property, and if the nuisance is not removed, abating the nuisance through contracted services. Costs are recovered by billing violators. Considerations: The Department of Neighborhood Services' expenditures for weed and trash abatement are projected to be $96,31=ll>.,.Cr-;: Based on this projection, these expenditures will exceed the FY2008 budget in the amount of $28,000. Revenue generated from billing violators is anticipated to cover these additional expenses. Wish neff, Council Member Dear Mayor Harris and Members of City Council: Subject: January Financial Report Recent national indicators depict deteriorating economic conditions as the housing shock and credit crunch continue to spread. As mentioned in previous reports, the Federal Reserve has responded to the evolving conditions by cutting its target for the federal funds rate a total of two and a quarter percentage points since September, from 5.25% to 3.0%. The job market weakened in January as payroll employment fell by 17,000 jobs for the month. This is the first decline since August 2003. Unemployment rates as of December were at 3.4%, 3.3% and 4.8%, respectively, for Roanoke, the Commonwealth, and the Nation. All ten Virginia metropolitan areas experienced increased unemployment in December. Relative to inflation, the Consumer Price Index increased 0.3% in December. Core inflation, excluding food and energy, rose by 0.2% in December or 2.4% on a fiscal year to date basis. At the State level, according to the Secretary of Finance's monthly financial report, revenues grew 3.5% in January 2008 compared to January 2007. Revenues grew 3.3% on a fiscal year-to- date basis, equal to the annual estimate of 3.3%. Individual income taxes grew 6.3% on a fiscal- year-to date basis, below the projected annual growth rate of 6.5%, due to lagging collections of nonwithholding taxes. Sales tax revenue grew 1.7%, trailing the forecasted growth rate of 2.8%. It should be noted that the Sales Tax revenues from the main holiday shopping season actually fell 0.6% for the first time since fiscal year 2003, and this is only the third decline for the holiday season since fiscal year 1991. Corporate income taxes fell 22.3%, behind the expected decline of 15.0% due to lower corporate payments and a substantial increase in refunds. In addition, wills, suits, deeds, and contracts, mainly recordation tax collections, fell 18.1 % as the housing market continues to weaken. April and May are the next significant revenue collection months for individual and corporate income tax payments. The Commonwealth's forecast anticipates further weakness in the corporate and income tax payments, a continued slowdown in the sales tax receipts, and decreases in recordation tax receipts as the housing market continues to weaken. The City of Roanoke's adopted budget for fiscal year 2008 totals $252.6 million, representing a 5.4% increase over the adopted budget for fiscal year 2007. Budgeted revenue growth results Honorable Mayor and Members of Council March 3, 2008 Page 2 from a projected increase in Real Estate and Personal Property tax revenues, as well as projected growth in various local taxes including Sales tax, Business License tax, and Prepared Food and Beverage tax. The aforementioned growth has been allocated to provide more funding to the Roanoke City Public Schools, for capital maintenance and equipment replacement, to enhance services to citizens, and to fund salary increases for employees. Furthermore, the fiscal year 2008 budget provides for greater social services program funding and the resources necessary to meet the current year's debt service requirements. The City had no major tax due dates in January or February. Our business license tax is due March 1, and we will provide an update with the next monthly financial report regarding its performance. The following narrative provides commentary on notable variances in revenues and expenditures for the first seven months of fiscal year 2008. Revenues Revenues through January increased 3.4% compared to the prior fiscal year. A significant delinquent tax billing occurred in December of the prior fiscal year. Adjusted for this, revenues grew 5.4% through the first seven months of the fiscal year. Most revenues are growing as anticipated, taking into account that the due dates for two of our major taxes, business license and personal property, are in the upcoming months of the fiscal year. Detailed comments on budgetary variances for our major revenues are addressed as follows: General Property Taxes increased 1.6% in total. December of fiscal year 2007 included a large Machinery and Tools tax delinquent billing. Adjusted for this difference, revenues in this category increased 6.9% primarily as a result of growth in reassessments and new construction. The first installment of the real estate tax was due October 5. This tax is expected to grow by approximately 6.7% as a whole in fiscal year 2008, and actual growth has followed this trend for the first seven months of the fiscal year. Partially offsetting this increase is a decline in personal property tax revenue compared to last year when the state tax relief on older years' taxes was phased out. When this occurred, taxpayers were balance billed their share of delinquent taxes previously covered through tax relief. This was a one-time item affecting the prior year, and it has an offsetting increase in the Grants-in-Aid Commonwealth category. Other Local Taxes increased 1.1 % as presented in the accompanying financial statement. However, when adjusted for the change in telecommunications taxation, local taxes have grown 3.7%. Transient Occupancy, Prepared Food and Beverage, and Cigarette taxes have increased, while the Sales tax is down 3.7% compared to the prior year. Business License tax has decreased from fiscal year 2007 and is impacted by higher exonerations in the current fiscal year. The new Telecommunications Tax program went into effect January 1, 2007 and affects the comparability of FY07 to FY08. Revenues are now remitted by companies to the Commonwealth. The State then pays the local governments, therefore receipts are delayed an additional month under the revised program than when administered locally. The timing difference in revenue recognition will be eliminated by the close of fiscal year 2008 when year end accruals are prepared. Permits, Fees and Licenses grew 48.1 % from fiscal year 2007 due to an increase in building inspection permit fees, most notably due to the William Fleming High School project and Carilion Medical Center. Honorable Mayor and Members of Council March 3, 2008 Page 3 Revenue from the Use of Money and Property decreased 28.5% compared to the prior year as a result of a change in the interest allocation method which negatively impacted the current year. Grants in Aid Commonwealth will be impacted by State budget reductions announced earlier this fiscal year. Currently, the impact to the City is anticipated at $362,000, mainly as a result of a decrease in funding through HB 599. An adjustment to state revenues and budgeted expenditures will be recommended to Council once the General Assembly has adjourned and reductions are final. Through January, revenues grew 9.7% compared to those of the prior year in part due to the increase in Social Services expenditures, most notably Foster Care, which are reimbursable by the Commonwealth. Also contributing to the variance is the reduction in the prior year revenue from the Commonwealth which occurred when tax relief expired on older year taxes and these amounts were balanced billed to local taxpayers. As mentioned previously, this has an offsetting decrease in the local tax category. Internal Services revenue decreased 19.4% due in part to a timing difference in the billing for occupational health services. While only half was billed in December of the current fiscal year, the entire amount was billed in December of the prior year. Also contributing to the decrease in this category is the decline in the school share of comprehensive services act monthly billing. This billing is based upon the budgeted expenditures for special education. The current fiscal year estimates have decreased from the prior year, therefore the monthly billing is lower. The final billing of the fiscal year is adjusted to reflect actual expenditures for special education. Miscellaneous Revenue increased 93.1 % primarily due to billings of several invoices for damage to city property. Adjusted for these large billings, the revenue in this category grew 23.0%. Revenues from the Art Festival also contributed to the growth in this category because there were no collections in the prior year. Collections for the Building New Partnerships Conference held this September had an impact as well. In fiscal year 2007, collections were not received until much later in the fiscal year. Expenditures General Fund obligations as a whole increased 3.3%. The fiscal year 2008 expenditure budget includes funding of approximately $743,000 to cover contracts and purchase orders made during fiscal year 2007 but not paid by the end of that year. City Council approved re- appropriation of this funding when adopting the General Fund budget in May. Additionally, General Fund expenditures of all departments are affected by a 4% pay raise effective July 1, 2007. Other than these items which affect most categories of expenditures, variances between fiscal year 2007 and fiscal year 2008 are addressed as follows: Health and Welfare grew 10.1 % due to increased foster care, adoption, and daycare expenditures as a result of a higher rate of child placement. As of December, the caseload increased to 438 compared to 383 in the prior year. Also, payments for foster care and adoptions are based on the needs of the child and are higher when special medical care is required. Lastly, the Commonwealth approved a 13% rate increase for foster family homes and adoption subsidy effective July 1, 2007 compared to a 4% increase in the prior year. Offsetting Honorable Mayor and Members of Council March 3, 2008 Page 4 this increase is a decline in health department subsidies due to the timing of the contract encumbrance. Nondepartmental expenditures decreased 21.6% due to a decline in the transfer of funds for the Capital Maintenance and Equipment Replacement Program to the Market Building, Civic Facilities, Department of Technology, and Fleet Management funds. Upon consultation with the golf course manager, Meadowbrook Golf, it has been determined that the conveyance of this 1.05 acre tract will have no adverse impact on course operations. Recommended Action: Authorize the City Manager to execute such further action as may be necessary to accomplish the above matter, including execution of a deed and to complete the sale of the property to Newbern Properties, LLC. WHEREAS, there areeertain areas cUrrently located outside the City's Enterprise Zone One A that are contiguous to it that are not currently a part of Enterprise Zone One A, but that can be added to it and that will benefit from the designation ofthose additional areas as part of Enterprise Zone One A, as set forth in a letter from the City Manager to Council dated February 19, 2008, and a supplemental letter to Council dated March- 3, 2008; WHEREAS, the Virginia Enterprise Zone Grant Act of 2005, as amended, authorizes the amendment of an existing Enterprise Zone to add areas ~d to include noncontiguous subzones, thereby making qualified business firms within such an area eligible for Enterprise Zone benefits; WHEREAS, there are additional areas within the City of Roanoke which are eligible for designation as part of an Enterprise Zone and which may be able to benefit by being designated as a subzone of Enterprise Zone One A; Enterprise Zone Amendments-One A-2008.doc 1 WHEREAS, the addition of certain areas of the City as part of the City's Enterprise Zone One A, as set forth above, has a potential to stimulate significant private sector investment within the City in areas where such business and industrial growth could result in much needed growth and revitalization; WHEREAS, this Council, acting in its capacity as the governing body of the City of Roanoke, held a public hearing on February 19, 2008, on the above mentioned proposed boundary" amendments, including the creation of a subzone, at which public hearing citizens and parties in interest were afforded an opportunity to be heard on such proposed boundary amendments to Enterprise Zone One A; WHEREAS, at the public hearing on February 19, 2008, a representative of the owners of 1.7 acres of property appeared and requested that such property, which will be contiguous to the propos'ed new Subzone A, be added to such Subzone A. An additional.3 acres of public right of way will also be included to make such area contiguous to Subzone A. Council tabled the matter regarding Enterprise Zone One A to allow City staff to review the request; and WHEREAS, City staff has recommended that such additional 2 acres be added to the new Subzone A, and that VDHCD staffhas advised City staff that no further advertisements or public hearings are needed. ,THEREFORE, BE IT RESOLVED by the Council ofthe City of Roanoke as follows: 1. The City of Roanoke is hereby applying for boundary amendments to the City's Enterprise Zone One A, which amendments will add additional areas which are currently outside it and that will add as a noncontiguous Subzone A certain other areas not currently in Enterprise Z;one . Such boundary amendments are more fully shown on the map attached to the City Enterprise Zo'ne Amendments-One A-2008.doc 2 Manager's letter to Council dated February 19,2008, and a revised map attached to a supplemental letter to Council dated March 3, 2008, and more fully described in such letters. 2. The City Manager is hereby authorized to apply, on behalf ofthe City, to the VDHCD for the above mentioned boundary amendments to the City's existing Enterprise Zone One A pursuant to the applicable provisions of the Virginia Enterprise Zone Grant Act, as amended, which boundary amendments will add to. it certain areas, including a new Subzone A, not currently in Enterprise Zone One A, all as more fully set forth in the above mentioned letters. 3. Council hereby certifies that it held a held a public hearing on February 19, 2008, as required by. the Virginia Enterprise Zone Grant Act Regulations. 4. The City Manager is authorized to submit to the VDHCD all information necessary for the application for the boundary amendments to the City's Enterprise Zone One A for the Department's review and consideration and to take such further action as may be necessary to meet other program requirements or to establish the boundary amendments as set forth above. The City Clerk is authorized to execute and attest any documents that may be necessary or required for the application or for the provision of such information. 5. Local incentives applicable for Enterprise Zone One A shall also be applicable for.any new areas covered by such approved boundary amendments. 6. Lea, Council Member Honorable Gwendolyn W, Mason, Council Member Honorable Brian J, Wishneff, Council Member Dear Mayor Harris and Members of City Council: Subject: Approval of Enterprise Zone One A and its Subzone Amendments Application Background: On February 19, 2008, City Council held a public hearing to receive comments on proposed boundary amendments to the City's Enterprise Zone One A and Enterprise Zone Two, as required by the Virginia Department of Housing and Community Development's (VDHCD) Enterprise Zone Program regulations. At the hearing, a representative of the owners of 1.7 acres of property, which will be contiguous to the new proposed Subzone A to Enterprise Zone One A, requested that such property be included in the new Subzone A. No other public comments were made about the proposed boundary amendments, Council adopted an Ordinance approving the boundary amendments application for Enterprise Zone Two. However, Council tabled the Ordinance approving the boundary amendments for Enterprise Zone One A to allow City staff to determine if the request to include the additional 1.7 acres in the proposed new Subzone A to Enterprise Zone One A could be done by Council without readvertising and conducting another public hearing. City staff has reviewed the request to add the 1.7 acres to the proposed new Subzone A to Enterprise Zone One A and recommends that the request be granted. However, an additional .3 acres of public right of way will also be included to make such area contiguous to Subzone A, which totals 2 acres. The additional 2 acres will be contiguous to the proposed new Subzone A and is along Franklin Road and bounded by Roberts Road and Beechwood Drive, and consists of Tax Map Nos, 1290211, 1290212, 1290218, and 1290213. Honorable Mayor and Members of City Council March 3, 2008 Page 2 A revised map showing the additional 2 acres, as well as each boundary amendment to both Enterprise Zone One A and Enterprise Zone Two, is attached hereto. The total acreage for the new Subzone A to Enterprise Zone One A would be increased from 28.28 acres to 30.28 acres. This new description modifies the description in the City Manager's letter dated February 19, 2008, CM 08-00027, to Council. It also revises the total acreage that will be added to Enterprise Zone One A from 53 acres as mentioned in such letter to 55 acres. Other than these changes, the City Manager's letter dated February 19, 2008, and its recommendations remain unchanged. City staff contacted VDHCD about the procedures to be followed to add the additional property to the new Subzone A to Enterprise Zone One A. The VDHCD staff has advised City staff in writing that no additional advertisements or public hearings are needed and the addition of such property can be done in the application forms to be completed and sent to VDHCD. Recommended Action: City Council adopt the appropriate measure to expand the boundaries of Enterprise Zone One A, to include a new Subzone A to Enterprise Zone One A, all subject to approval by the VDHCD, with an effective date retroactive to a date approved by the VDHCD, for the amended boundaries, all as set forth above. Furthermore, City Council authorize the City Manager to apply to the VDHCD for approval of the above mentioned amendments and to take such further action and/or to execute such additional documents as may be needed to obtain or confirm such amendments.
