TOPICS FOR DISCUSSION BY THE MAYOR AND MEMBERS OF COUNCIL:
Vice-Mayor Lea inquired about the relocation of the Valley Metro Bus at J C
Penney, Valley View Mall. The City Manager advised that the owners of Valley
View Mall, which is private property, requested that the bus stop be relocated;
and City staff is continuing to work with the owners to possibly define another
location at the Mall.
In response to concerns expressed by the Council regarding ridership by
public school students, the City Manager advised that the matter was referred
to the Youth Services Superintendent and the Youth Advisory Council for
review.
Mayor Bowers requested that a special meeting of the GRTC Board of Directors
be held either on October 23 or November 3, pending notification to the General
Manager, Valley Metro.

Market Building for operation of a Chinese restaurant business on a month to month
basis, beginning November 1, 2008.
RECOMMENDED ACTION: Concurred in the request.
C-2 A communication from Tim Steller, Executive Director, Blue Ridge Behavioral
Healthcare, requesting that Council ratify the appointment of Larry Cadd, as an
at-large member of the Board of Directors, for a three-year term of office,
commencing January 1,2009, and ending December 31,2011.
RECOMMENDED ACTION: Concurred in the request.

C-3 Reports of qualification of the following individuals:
Alvin L. Nash as a City representative to the Roanoke Valley Area
Metropolitan Planning Organization, for a term commencing July 1,
2008 and ending June 30,2011;
Raheem L. Muhammad as a member of the Youth Services Citizen
Board, for a term ending May 31,2011;
Stan Smith as a member of the Towing Advisory Board, for a term of
three years ending October 31,2011; and
Rhonda Chewning as a member of the Fair Housing Board for a term
ending March 31, 2010.
RECOMMENDED ACTION: Received and filed.

b. Presentation by Total Action Against Poverty in the Roanoke Valley to seek a
letter of support for two proposed subdivisions at the northeast and southwest
quadrants of the intersection of Old Stephens Road and Shenandoah Avenue.

Request for letter of support to the Virginia Housing Development
Authority was referred to the City Manager; and designation of the area

the vote was recorded; and Council Member Rosen abstained from
voting inasmuch as he serves as a City representative on the Total
Action Against Poverty Board of Directors.)

c. A request from the Roanoke City Electoral Board recommending the
temporary return of the polling place for Jefferson #2 Precinct located at
250 Reserve Avenue, S. W. (Roanoke City Schools Maintenance Building) to
the National Guard Armory at 32 Reserve Avenue. (Sponsored by the City

The City Manager announced that the Center in the Square celebrated its 25th
Anniversary on Saturday, October 4 at the Roanoke Civic Center Special Events
Center.

At 4:30 p.m., continuation of public interviews for consideration of three vacancies on
the Roanoke Redevelopment and Housing Authority, Board of Commissioners, for
terms ending August 31, 2012.
At 5:30 p.m., the Council meeting was declared in recess for continuation of Closed
Meeting which was voted on at the 9:00 a.m., informal session of Council. (By
consensus, the Council agreed to defer the Closed Meeting request by the City
Manager regarding the disposition of publicly-owned property until the next regular
meeting of the Council on Thursday, October 23.)
At this point, Council Member Rosen left the meeting. (6:30 p.m.)
At 6:30 p.m., the Council reconvened in the Council Chamber, Mayor Bowers
presiding and all Members of the Council in attendance, with the exception of Council
Member Rosen.
Continuation of public interviews for consideration of an upcoming vacancy on the
Architectural Review Board for a four-year term commencing October 2, 2008 and
ending October 1, 2012. (The question as to why code violations are referred to the
Architectural Review Board as opposed to being handled by the Courts was referred
to the City Attorney for appropriate response.)
At 7:10 p.m., the Council meeting was declared in recess for continuation of Closed
Meeting which was voted on at the 9:00 a.m., informal session of Council.
At 7:50 p.m., the Council meeting reconvened in the Council Chamber, Mayor Bowers
presiding and all Members of the Council in attendance, with the exception of Council
Member Rosen.
CERTIFICATION OF CLOSED MEETING. (6-0)
Reappointed Gail Burruss and Quentin White and appointed James D. Ritchie as
members of the Human Services Advisory Board for terms of four years, each,
ending November 30, 2012.

WHEREAS, the City of Roanqke has a multitude of agencies committed
to educating the public about domestic violence and helping
victims; and
WHEREAS, domestic violence can affect anyone regardless of age, race,
gender or socio-economic status; and
WHEREAS, many victims are ashamed to seek help, thus continuing to
suffer through years of terrifying and dangerous abuse;
children often witness domestic violence, while feeling
helpless to stop the abuse of the victim; and
WHEREAS, domestic violence can change from day to day, but seldom
changes for the better unless someone intervenes; dealing
effectively with domestic violence requires a coordinated and
integrated response from many different facets of the
community; and
WHEREAS, work must continue within the community to educate the

WHEREAS, Virginia fire departments respond to more than 34,000 fires
per year; home fires claimed more than 83 lives in the
Commonwealth of Virginia in 2007, and 82 per cent of fire
deaths nationwide happen in the home with three out of ten
home fires in the kitchen, making unattended cooking the
leading cause of home fires; 105 firefighters lost their lives
nationwide in the line of duty in 2007; and
WHEREAS, the City of Roanoke recognizes the significant personal and
economic toll that fire takes on its citizens; and
WHEREAS, the City of Roanoke understands that safety measures can
significantly cut the risk of fire; a fire can spread rapidly and
a quick escape from the home increases the chances of
survival; and
WHEREAS, smoke alarms have proven to be an effective life-saver,
having helped to decrease the home fire death rate by one
half since introduction to the general public; and
WHEREAS, the City of Roanoke joins with the National Fire Protection
Association (NFPA) in reaching out with a message to all
citizens of Virginia in commemoration of national safety
efforts of fire departments, schools and other public safety
advocates; and
WHEREAS, "It's Fire Prevention Week: Prevent Home Fires" is an
important reminder for all citizens during Fire Prevention
Week 2008.

Background:
Min Shao t/a Hong Kong, has leased approximately 748 square feet of space
located in the City Market Building at 32 Market Square, Roanoke, Virginia
24011, for the past four (4) years. The City has offered to Mr. Shao to continue
to operate a Chinese restaurant business in the Market Building on a month to
month basis with the term beginning November 1, 2008 such term not to
exceed one year. A public hearing is required to consider this lease term.
Recommended Action:
Authorize the scheduling and advertising of this matter for a public hearing on
October 23, 2008, at 7:00 pm.

At its regularly scheduled meeting on August 7, 2008, the Board of Directors of Blue
Ridge Behavioral Healthcare voted unanimously to recommend Mr. Larry Cadd,
who resides at 2715 Tenth Street, Bldg 4-201, Roanoke, VA, 24012, as an at-large
member of the Board upon the expiration of the final term of Ms. Linda Bannister in
December. According to Title 37, Chapter 10, of the Code of Virginia, the Board
nominates at-large representatives, and participating governing bodies must ratify
those appointments.
Under the Code, Community Services Board members are eligible for three full
three-year terms. We respectfully request that Roanoke City Council ratify our
Board's nomination of Mr. Cadd for an initial term to begin January 1, 2009 and run
through December 31, 2011. His appointment will serve to maintain the required
compliance with demographic and other attributes for CSB board member
composition as set out in the Code of Virginia.
Our request is being sent concurrently to the Administrators in each of our other
local governing bodies for their attention and ratification as well.

Melrose Jobs Campus Renovation Project - Capital Campaign

Economic Development Investment
Brief description of the organization, its history and purpose
Goodwill was established in 1934 as the Goodwill Industry and Gospel Mission in
downtown Roanoke. Only 30 years prior a Methodist minister in Boston, Edgar
Helms, began the Goodwill movement in his parish. Since the beginning, the
organization has been about work, following the philosophy established by Helms -
"a hand up, not a hand out".
Goodwill Industries of the Valleys was created in January 2000 through the merger
of four organizations with similar missions, Goodwill Tinker Mountain merged with
the Developmental Center of Franklin County in Rocky Mount, Radford based New
River Valley Workshop, and the Association for Retarded Citizens in Roanoke. The
Northern Shenandoah Valley including Harrisonburg and Charlottesville, became a
part of the area served by the Roanoke based Goodwill in 2003. The new
organization created by the merger provides services in 31 counties and 14 cities in
the western and central portion of Virginia, from Grayson County in the southwest to
Harrisonburg in the north, and from Martinsville in the south to Lynchburg and
Charlottesville. The new organizational name, Goodwill Industries of the Valleys,
was based on inclusion of the Shenandoah, Roanoke, and New River Valleys.
It is the mission of Goodwill Industries of the Valleys to help people and
families in our community achieve a better life through work and
independence.
Goodwill accomplishes this mission through focus on these programs that address
individuals' barriers to employment with the goals of increasing their opportunities for
employment and advancement, self-sufficiency and independence:
· Center-based services and supported employment for disabled adults
· School to work adjustment for disabled youth
· Specialized day support and adult developmental learning skills for
developmentally disabled adults
· Welfare-to-work and disadvantaged adult and youth employment programs
· Older workers community service training
· Employee development
For Fiscal Year 2007-2008, Goodwill served 10,815 individuals and placed 426
people into competitive employment in the community. As a result of Goodwill
programs, 254 individuals are no longer dependent solely on public assistance.
Goodwill Business Services provided quality products on-time and at a competitive
rate to 124 area businesses. All of Goodwill's twenty-seven retail stores provided
training and employment opportunities to individuals with disabilities and
disadvantages; 90% of all retail revenues go directly back to the training and

employment programs for these individuals. Through recycling efforts, 10,179,896
pounds of material were kept out of area landfills.
A concise description of the investment request, including specific
purpose(s), the benefits to be provided, and the needs to be met
Goodwill Industries of the Valleys is constructing a $7.7 million Jobs Campus at its
corporate offices on Melrose Avenue in the City of Roanoke, As shown on page 4 of
this request, Goodwill is financing $6.4 million through industrial revenue bonds, and
is seeking support from corporations, foundations, governments, and private
individuals as part of a $1.3 million Building Goodwill capital campaign. Goodwill is
requesting a $500,000 capital construction investment from the City of Roanoke.
Goodwill has purchased two buildings and the 10 acre tract upon which they sit. It
will develop over 100,000 square feet of classrooms, training facilities, work center,
and centralized office space to support the employment programs that it administers.
The second building is a working retail store that will provide on the job training,
reinforcing classroom retail skills for the region's retail stores, The property
renovation is a two-year project which has already commenced. Completion is
expected in the Fall of 2009.
Purpose of the Jobs Campus Proiect

· Creates 50 new jobs, 40 with an average salary of $27,000 annually, which
addresses the economic development goal for its location in a designated
Enterprise Zone One. Census figures place the average per capita income for
Roanoke City residents at $18,500.
· Positively changes the appearance of a major inner city location.
. Expands the capacity to serve residents within the Roanoke Valley from 350
to up to 450 people per day.
· Develops a multi-functional job development center. The Jobs Campus will
contain office space, a retail store, and a work center and training facility -
provides workforce development services to youth and adults with disabilities
and disadvantages, dislocated workers, and senior adults
· Provides on-going workforce training and development to local neighborhood
residents lacking marketable job skills, education, and training.
· Provides retail skills training through a combined classroom and actual work
environment.
· Provides training that supports the most basic health care services, especially
for the elderly, including Nursing Assistants Certification and training for
Medical Technicians.

preparation skills, job training skills,' and work adjustment. Local employer
surveys indicate continued skills gap for entry-level and semi-skilled workers
in soft skills areas (work readiness and work adjustment skills),

to the high percentage of residents living near Jobs Campus who lack
marketable job skills, education, and training. Of these 3,321 residents in
Roanoke City Census Tracts 8 & 9, aged 16 years and older that are in the
labor force, 378 or 11.4% are unemployed; and 38% of residents aged 25
and older have less than a high school diploma or equivalent.
. Addresses aging baby boomers unprecedented demand for senior care
services. By 2020 there will be 1.5 million people in Virginia over the age of
65. There will be more than 170,000 over the age of 85. The front-line
healthcare training will support workers for local and regional senior care
facilities and hospitals
A detailed financial plan for the project including all sources of funding
{secured/anticipated}, all related expenses, and provisions for
contingencies and ongoing support
The overall project budget totals $7,709,589; the enclosed detailed budget for the
project outlines the specific cost categories by project phases. Goodwill currently is
in a strong financial position with expert financial leadership. A strong corporate
presence in all major business lines (donated goods, industrial service contracts,
mission services, grants) has helped to maintain a positive net income, which
provides the on-going support through Goodwill's overall operational budget.
The description of each phase is as follows:
Phase I: Retail TraininQ Store. November 2007 to AUQust 2008
Renovations have been completed that converted the existing 8,640 square foot building
into a Goodwill Retail Center with a structured retail training component. The City of
Roanoke sales tax revenue in the six weeks since the store opened approaches $1,000.
Phase II:
· Job Development Center. September 2008 to June 2009
Construct Job Development Center within the renovated Jobs Campus. The
completed renovation will result in new training and employment opportunities for
neighborhood or community residents. The center will also Increase the capacity to
serve additional individuals with barriers to employment.
· Corporate Offices and BuildinQ Exterior. September 2008 to June 2009
Increase the capacity of the corporate offices to support the organization's
operations. Goodwill employs 800 people who provide services in 31 counties and
14 Virginia cities. This project will support improvements in IT, Human Resource
management, and financial accounting, including oversight and compliance, as well
as grant auditing. Not only will the renovations enhance the property value and
neighborhood esthetics by improving the exterior faCfade, it will also enhance
economic development in the key area of the Melrose Avenue corridor.

· ADLS and SDS, July 1: 2009 to Auqust 31,2009
The ADLS (Adult Developmental Learning Services) will move from its current
location in Salem and consolidate its operations with SDS (Specialized Day Support)
currently in the Melrose Avenue facility. These are vital and productive programs for
serving developmentally disabled adults. The consolidation will increase the capacity
to serve additional individuals with barriers to employment.
· Site Development, March 2009 to Auqust 2009
Renovate the outside property by improving parking efficiency, accessibility to
neighborhood and area residents, and overall property appearance and value.

Goodwill's President/CEO, Bruce Phipps, through regular updates and discussions

The actual site design and construction is being managed and supervised by Bill
Hume, AlA, President of Interactive Design Group. Bill has an Architecture degree

from Virginia Tech, and has over 23 years of experience in the design and
management of construction and technology related projects for the private and
government sectors. His experience as a Principal, Project Manager, and Project
Architect includes all facets of pre-design efforts. His past experience includes civil
engineering design, surveying, GIS development, and complete architectural design
and implementation.
Plans for the evaluation of the project's results and for sustaining it after
grant funds expire
Evaluatinq Results: Each planned objective of the renovation project will be
monitored on an onqoinq basis to compare planned with actual targeted goals, in
terms of timeframes and implementation of objectives.
Sustainabilitv: The projected revenue from the Jobs Campus expansion itself will
help to offset the expenses. This additional revenue will be realized from the
project's Retail Training Store, Job Development Center's community partners'
leases, and center-based contract employment. The project's initial start-up costs
will be offset by the Goodwill's overall donated goods revenue, which is its largest
source of revenue. An Operating Profit Analysis has been completed through 2010
for the entire organization, including projections of revenues and expenses from the
Jobs Campus. This analysis projects a net income for each of the next two fiscal
years through 2009-2010.

. Good afternoon. Mayor Bowers, Vice Mayor Lea, Members
of City Council, City Manager Burcham, ladies and
gentlemen.
. Thank you for the opportunity to share with you a unique and
financially sound housing opportunity, with benefits to the
community, area residents and the City of Roanoke.
. TAP has entered into a partnership with PIHRL, an
experienced company in Ohio, to develop a subdivision of 44
work force single family homes at the intersection of
Shenandoah A venue ,and Old Stephens Road.
. The Peters Creek South Family Homes combines the proven
track record of TAP with that of PIRHL which is doing
similar developments in several states, developing 2,600
units of housing within 75 tax credit properties.
. These three and four bedroom homes' hard and soft costs
will amount to a per single family home cost of $180,000 and
a total subdivision investment of $9,000,000.
. This family subdivision will provide quality leased housing
and eventual home ownership for families at up to 60% AMI,
or $41,880. It will impact positively on the value of area
homes now assessed from between $94,000 and $106,000. It
will provide annual tax increase to the City of Roanoke of
$94,248 per year.

. In an uncertain financial market with tighter restrictions on
mortgage resources, this subdivision takes advantage of
available reliable tax credit financing.
. Last week, after contacting 780 residents by mail, we held a
community meeting for residents of the Cherry Hill and
Wilmont Farms neighborhoods to explain the nature of this
housing opportunity. I am attaching a petition of 127
residents who are in support of this subdivision. TAP is
offering the resident organization of these neighborhoods a
seat on its board for additional oversight.
. In order to be competitive for highly sought after tax credits,
we are asking City Council for two things: 1) A letter of
support for our LIHTC application and 2) A certification of
the parcels as a revitalization area according to VHDA
standards.
. Weare asking for a go ahead at this time to warrant the
commission of significant resources to prepare a successful
application.
. Though funded with Low Income Housing Tax Credits, this
subdivision represents a small but important expanded
opportunity for middle class Roanokers at a time when the
squeeze on the middle class is coming from all directions.

unproductive portion of the Shenandoah Avenue corridor in Roanoke's Peters Creek South target area
through the development of two new, single family home subdivisions of up to forty-four (44) ranch-style
homes at the intersection of Old Stephens Road and Shenandoah Avenue. All of these market-rate quality
homes are designed to be architecturally harmonious with the existing ranch homes in the Wilmont and
Cherry Hill neighborhoods where these subdivisions are located.
This development will provide quality affordable housing for working families, it will contribute to the
local economy, it will increase property values of the homes in the Wilmot and Cherry Hill
neighborhoods, and it will provide tax revenue to the City of Roanoke. This development furthers
some key goals in the Peters Creek South Neighborhood Plan, a component of Vision 2001-2020,
Roanoke's Comprehensive Plan.

I am writing to request that any decision regarding the proposed construction of homes by TAP
and PIRHL in Wilmont Farms be delayed until the October 23rd-meeting at either 2:00 pm or
at 7:00 pm when more residents of the Wilmont Farms and Westside Boulevard neighborhoods
will be available to attend.
We received a le~!er from TAP approximately September 23rd stating that a meeting would be
held on September 30th for residents to receive information regarding the proposed
construction of approximately 40 homes in the Wilmont Farms area and Westside Boulevard
area. Some residents were able to attend on September 30th, but there were also many people
who could not come and who have not had an opportunity to become better informed about the
proposed construction or to totally understand the meaning of the statement on the proposal
that the area where construction is to occur would have to be designated as an area requiring
revitalization, rehabilitation, and other terminology that is worrisome to those of us who
currently are homeowners in this area.
Most homes in our area were built in approximately 1965, and there are few homes in the area
that would in any way appear to be in need of repair or revitalization. As residents, we have
been trying to determine if this designation would adversely affected our future property values
and to find someone who can give us definitive information about how our neighborhood _
would be affected. As citizens of this area and taxpayers, we need and deserve an opportunity
to receive more information about how this may affect our neighborhood.cJ,nthe future. We do
not know if this designation is solely something that would appear on an application or whether
it would become an issue for us when it comes to future real estate values for our area.
We do realize that there is a need to make home ownership more affordable for residents for
Roanoke City, but concerns were expressed by many at the September 30th meeting that those
who live in the proposed homes would not become actual homeowners for 15 years and that
they would be under only a one year lease which could potentially lead to greater turnover
among residents in the proposed area.
It will be difficult for many residents to attend at 2:00 pm on October 23th due to previous
work obligations, so I request that any decision be extended until October 20th so that residents
of our area will have more time to receive answers to the many concerns that we share and to
questions that still need to be more fully answered.

Armory, 32 Reserve Avenue, S.W.; and dispensing with the second reading of this ordinance.
WHEREAS, the National Guard Armory, 32 Reserve Avenue, S.W., is the regular polling
place for Jefferson Precinct #2;
WHEREAS, following the tragic events of September 11, 2001, the Armory became
unavailable as a polling place, and the polling place was relocated indefinitely, on an emergency
basis, to the Roanoke City School Maintenance Building, 250 Reserve Avenue, S.W.;
WHEREAS, due to the unusually high turnout for the Presidential primaries in February and
the increase in registered voters throughout the summer, the Electoral Board feels that the space at
the Roanoke City School 'Maintenance Building, the temporary polling place for Jefferson #2
Precinct, will not be sufficient for the November 4,2008, Presidential election;
WHEREAS, by Resolution dated September 8, 2008, the Roanoke City Electoral Board has
recommended the temporary return of the polling place for Jefferson #2 Precinct to the National
Guard Armory, such polling place being located within such precinct as required by ~24.2-31 0, Code
of Virginia (1950), as amended; and
WHEREAS, the Electoral Board has given notice of such emergency relocation of polling
place to the State Board of Elections and has obtained approval of such change from the Board
pursuant to ~24.2-310.D., Code of Virginia (1950), as amended, and the Electoral Board will give
notice of this change in polling place by mail to all registered voters in the Jefferson #2 Precinct at
least fifteen (15) days prior to all elections, and public notice of such change, pursuant to S24.2-306,
Code of Virginia (1950), as amended;
THEREFORE, BE iT ORDAINED by the Council of the City of Roanoke as follows:
1. The polling place for Jefferson #2 Precinct shall be relocated indefinitely from the
Roanoke City School Maintenance Building, 250 Reserve Avenue, S.W., to the National Guard
Armory, 32 Reserve Avenue, S.W.
2. The City Clerk is directed to forward attested copies of this ordinance to Beryl Y.
Brooks, General Registrar, so that notice of this change in polling place can be mailed to all
registered voters of Jefferson #2 Precinct, and to the Chief, Voting Section, Civil Rights Division,
United States Department of Justice.
3. Pursuant to the provisions of Section, 12 of the City Charter, the second reading of this

The Roanoke City Electoral Board is seeking the following
temporary change of Precinct #008, Jefferson #2 polling place
from Roanoke City Schools Maintenance Building to the National
Guard Armory. Due to the unusually high turnout for the
Presidential primaries in February and the increase in registered
voters through out the summer months, the Electoral Board feels
that the space in the Roanoke City Schools Maintenance Building
will not be sufficient to handle the voters for the upcoming
November 4, 2008, presidential Election. (See resolution
attached. )
Normally Section 24.2-306, which prohibits us from moving a
polling place 60 days before an election and without prior
approval of the Justice Department, would be in affect. However
due to circumstances not in our control the confirmation for our
approval to use the building was not received until after the time
period in which a regular move could be made.
We are requesting that this matter be brought before City Council
at the next available public meeting. Although I am still
required to submit for expedited approval from the Justice
Department, I will have to proceed with the move as approved by
the state Board of Elections. The appropriate notification for
expedi ted approval has been forwarded to the Ci ty At torney for
submission to the Department of Justice.

Subject: Justice Assistance Grant
Background:
The Roanoke Police Department's community based bicycle patrol program has
been funded over the last several years by the Edward Byrne Memorial Justice
Assistance Grant UAG). This funding opportunity allows for community policing
programs similar to our current bike patrol initiative.
On August 20, the Police Department was awarded $51,083 under the JAG
funding formula. This opportunity is to be used for the continuation of the
successful bicycle patrol program. With this funding, operation of the program
will be sustained at the high level the community has come to expect. This
grant does not require any local matching funds.
Recommended Action:
Accept the Edward Byrne Memorial Justice Assistance Grant UAG) described
above and authorize the City Manager to execute the grant agreement and any
related documents, in such form as approved by the City Attorney.

WHEREAS, the City and the Artist entered into a Contract dated September 10, 1999, for the
Artist to create a work of art to be located at the Virginia Museum of Transportation;
WHEREAS, the Contract dated September 10, 1999, was amended on July 10, 2001,
allowing the artist to make up to four castings of the Oljginal work;
WHEREAS, the Contract allowed the City to have complete authority to reproduce theW ork
which could include three dimensional renderings; and
. WHEREAS, the City and the Artist have agreed that they prefer only non-three dimensional
renderings of the Work be made.
NOW, THERE FORE, BE IT ORDAINED by the Council ofthe City of Roanoke as follows:
1. The City Manager and City Clerk are authorized to execute and attest, respectively, an
amendment to the agreement dated September 10, 1999, between Betty M. Branch and the City of
Roanoke. Such amendment shall permit the City to reproduce the Work in non-three dimensional
items.
2. The contract amendment shall be in such form as is approved by the City Attorney.
3. All of the remaining provisions of the contract shall remain in full force and effect.

Re: Contract Amendment - Firefighter Memorial
Dear Mayor Bowers and Council Members:
The City contracted with local artist Betty Branch in 1999 to create a sculpture as a
Firefighter Memorial. The sculpture currently is located at the The Virginia Museum of
Transportation. In the contract, the City reserved the right to reproduce the sculpture in "books,
art magazines, exhibition catalogues, post cards or posters or other commemorative items." Ms.
Branch has requested that the contract be amended to provide that any reproductions of the
sculpture by the City be two-dimensional, rather than three-dimensional reproductions. In 2000,
City Council authorized an amendment to the contract which permitted the artist to make up to
four castings of the original work.
The proposed amendment, in which the City Manager concurs, is attached along with a
resolution for Council's consideration that authorizes execution of the amendment on behalf of
the City.

In all other respects, the Contract and the Amendment shall remain unchanged.

Budget Amendments -FY 2009 State Budget Reductions
Background:
The FY 2009 General Fund budget adopted by City Council included a reduction in
funding from the Commonwealth of Virginia in the amount of approximately $1.1
million based on the level of funding that is provided to the City of Roanoke. The
Commonwealth of Virginia Department of Planning and Budget identified three
methods of managing the reductions, and on September 2, 2008, Council adopted a
resolution supporting the reimbursement option. A budget ordinance was adopted at
that time that was intended to create a contra revenue account from which the
budgeted reimbursement would be made.
Considerations: '
The budget ordinance adopted on September 2 did not have the effect intended, as it
adjusted accounts by only the $43,000 change from estimated budget reductions to
actual reductions and not by the entire amount of the reductions. A correcting budget
ordinance is needed to adjust revenue estimates to properly reflect the full amount of
the reductions and to budget for the required disbursement to the Commonwealth in
January 2009. The correction will not alter the City's budget in total, but will result in
proper revenue amounts in individual line items.

Recommendation:
Adopt the accompanying budget ordinance to adjust revenue accounts to reflect the
City's election of the reimbursement option using a revenue account titled Local Aid to
the Commonwealth.

Subject: August Financial Report
The revised revenue estimate for FY09 totals $260.3 million representing a 3.1 %
increase over the adopted budget for FY08. Additional sources of revenue include
projected increases in Real Estate tax, as well as projected growth in
Telecommunications, Consumer Utility, Cigarette, and Prepared Food and
Beverage taxes. These expected increases are partially offset by anticipated
declines in other areas due to current economic conditions as well as State budget
cuts. Revenues with projected decreases over the prior fiscal year include Sales
tax, Business License, Housing of Federal Prisoners, and various other State
revenues.
Revenues
The City's revenue recognition practices call for accrual back to the prior year of
revenues received within the first sixty ,gays of a fiscal year provided the taxes

relate to the period through June 30th. Therefore, for example, real estate and
personal property taxes collected during July and August but billed by June 30th
must be reported as revenue of fiscal year 2008. This practice results in many
low, or even negative, revenue amounts as of .the end of our second fiscal
month, August. Also, variances in amounts accrued from one fiscal year to
another can cause large fluctuations in the revenue amounts in the early months
of one fiscal year versus another. The City's revenue trends will smooth and
become more meaningful for comparison after the first quarter of the year.
This financial report covers the first two months of activity for FY09. The
revenue recognition policies as described above explain the variances in the
total General Fund revenues as well as the individual categories of General
Property Taxes, Other Local Taxes and Grants-in-Aid Commonwealth. All three
categories are significant components of the City's revenue base and all are
impacted by year end accruals.
Commentary on other variances are shown below.
Fines and Forfeitures decreased 20.9% from the prior year primarily due to a
decline in Parking Ticket revenue. Tickets for "Failure to Display a Valid Decal"
. are no longer issued as a result of the City eliminating vehicle decals. A
reduction in General District Court fines also contributed to the variance. The
caseload for fiscal year 2009 has declined due to budget cuts for substitute
judges. Judges are typically absent more during July and August for vacations
and conferences, therefore the cases and resulting fines declined compared to
fiscal year 2008 where substitute judges were present.
Revenue from the Use of Money and Property increased 16.1 % from FY08 due to
the timing of rental payments received from the Federal and State Governments
for the Commonwealth building contract.
Grants-in-Aid Commonwealth increased 18.3% from FY08 due to the timing of
collections for Comprehensive Services Act reimbursements. June's service
reimbursement was received in August for fiscal year 2009 but not received
until October for fiscal year 2008. Partially offsetting this increase is a decline

due to timing in the receipt of Rental Car Tax which was not received until early
September of this fiscal year.
Charges for Services decreased 27.2% from the prior year attributed to a decline
in the number of federal prisoners housed at our jail. Due to an increase in
local prisoners held, there is less capacity for federal prisoners, and many
federal prisoners are now being housed at the regional jail in Abingdon. Also
contributing to the variance is a normalization in the collection of Emergency
Medical Services charges after a significant amount of delinquent charges were
collected in FY08 after a change in contracted billing management.
Expenditures:
The fiscal year 2009 expenditure budget totals $261.7 million and includes
funding of approximately $1.3 million to cover contracts and purchase orders
made during fiscal year 2008 but not paid by the end of that year.
The General Fund expenditures and encumbrances through August were $47.9
million. Compared to the prior year, these expenditures in total represent an
increase of 3.1 % or $1.4 million. Increased spending for Street Paving, due to
contracts carried over from the prior year, accounts for the majority of, this
variance while timing differences and cost differences for items related to Public
Safety and Parks, Recreation and Culture are a significant secondary cause.

These increases are offset by significant decreases in spending by Health and
Welfare and Community Development. Both increases and decreases are,
discussed in the following sections in detail. In fiscal year 2009, the average
employee pay raise was -2%, which caused a slight increase in many categories of
expenditures. The variances detailed in this report are in addition to this rise in
personnel cost.
Public Works expenditures increased 20.7% or $1.3 million due to an increase in
contracts carried over from the prior year for Street Paving and Maintenance and
a timing difference in the internal charge for Fleet Capital expenditures. Street
Paving expenditures have increased $1.0 million over the pr!or year, and 35.7%

of the fiscal year 2009 budget has been committed. This variance is appropriate
given the size of the current year budget including the amounts carried forward
for Street Paving. Maintenance expenditures increased primarily due to a new
contract for bridge maintenance and repair that was finalized for $125,000.
The internal billing for Fleet Capital expenditures is billed monthly; in the prior
year this expenditure was billed quarterly.
Health and Welfare expenditures decreased 13.1% or $781,815. This is due to a
combination of timing differences and a significant decrease in the number of
foster children using state residential services. State residential services are
used on an as needed basis, and participation levels fluctuate depending on the
number of children that can be housed in other kinds of placements such as
foster parent homes or therapeutic residences.
Parks. Recreation and Culture expenditures increased 16.0% or $346,540. The
variance is primarily related to increased expenditures in the Roanoke Arts
Commission and Parks and Recreation Administration cost centers. The
projects of the Roanoke Arts Commission have been expanded and its current
increase in expenditures is directly correlated with this increase in budget. The
variance for Parks and Recreation Administration expenditures. is wholly due to
the timing of Event Zone expenditures.
Community Development expenditures decreased 9.2% or $131,406 due to
decreased spending on Economic Development, the Virginia Cooperative
Extension, and Memberships and Affiliations. The annual contract for rent for
Franklin Plaza was committed in July of fiscal year 2008. No similar contract has
been finalized' in fiscal year 2009. The slight decrease in Virginia Cooperative
Subsidies is due to timing. The slight decrease in expenditures for Membership
and Affiliations correlates with a decrease in budget and is expected to continue
throughout the year.

A RESOLUTION urging all citizens to join in observing Veterans Day, recognizing and
honoring the commitment and sacrifice of all veterans.
WHEREAS, November 11 is celebrated as the end of World War I, as fighting ended at
11:00 a.m., November 11,1918 (the 11th hour of the nth day of the nth month); this become
known as "Armistice Day" and was later proclaimed as Veterans Day after World War II and the
Korean Conflict ended;
WHEREAS, Veterans Day is dedicated to the extraordinary Americans who protected
our freedom in years past, and to those who protect it today. They represent the very best of our
Nation. Every Soldier, Sailor, Airman, Marine, and Coast Guardsman has earned the lasting
gratitude of the American people, and their service and sacrifice will be remembered forever;
WHEREAS, millions of American men and women have answered the call to duty in
defending the hard-won freedoms we enjoy today;
WHEREAS, it is of paramount importance that the sacrifice and commitments made by
those persons who have served our nation in the armed forces, and that continue to be made by
those serving today, not be forgotten and serve as a constant reminder of the ideals and principles
of our Country; and
WHEREAS, on Veterans Day, we honor these extraordinary Americans for their service
and sacrifice, and we pay tribute to the legacy of freedom and peace that they have given our
great Nation.

Petition: Say No to New Huff Lane Right-of-Way

Background:
On June 11,2008, Sidney Bush, President of the Dorchester Court Neighborhood Crime
Watch, received notice from Chris Chittum of the- Roanoke City Planning. Building and
Development Department, that the City plans. to construct a new public right-of-way along the
eastern border of Huff Lane Park. This new right-of-way would provide direct access from
Valley View Boulevard to Avalon Avenue and the surrounding neighborhoods. It is also
intended to prevent further damage to a private fence running along the rear of private lots on
Greenland Avenue (see attachment, Map of "New Lot 4C-2B Oakland" [hereinafter "Buffer
Zone"], Tax Map Number2250119),
Since January, 2007, vagrants, vandals, burglars, and other lawbreakers have cut
openings into the Buffer Zone fence and used these openings as a means to avoid the public eye
and escape from the police, Area homeowners have repeatedly asked the City to
repair/reinforce/replace the aforementioned Buffer Zone fence, which serves as a protective
barrier between Valley View Mall and our neighborhoods beyond, to little avail.
The proposed new right-of-way would not solve our present problem, i.e. lawbreakers
filtering into our neighborhoods. It would, instead, give them direct and unencumbered access to
our streets.
We believe that the solution to our stated problem is this: The City of Roanoke needs to
repair or replace the Buffer Zone fence and maintain it, or compel the commercial property
owners to do so,

Pedestrian Access between
Valley View Mall and surrounding
neighborhoods
Background:
This summary is provided in response to Mr. Sidney Bush's appearance before City
Council on October 6, 2008.
In 1997, the property bordering the Dorchester Court neighborhood was rezoned
to commercial for development of Valley View Crossing. As part of the rezoning,
the following conditions related to a buffer were proffered:
· A landscaped green space a minimum of 75 feet wide adjacent to the residential
property along Huff Lane and Greenland Avenue with a six feet high berm and a
black vinyl coated chain link fence six feet high shall be constructed planted
and maintained by the Property owner until such time as ownership of the
landscaped green space can be conveyed to the Western Virginia Land Trust or
other organization acceptable to the City of Roanoke. In the event that the
issue of ownership of the landscaped green space cannot be resolved, the berm,
vinyl coated chain link fence, and landscaping shall be maintained by the
property owner.
· There shall be no motorized vehicular access from the property to the adjacent
residential neighborhood.

· Pedestrian access between the Property and the adjacent residential
neighborhood will be provided only as requested by the City of Roanoke.
In 2005, the City began to receive complaints from adjoining property owners that
holes were being cut in the fence that was constructed along the buffer area. Staff
contacted the owner (Faison in Charlotte, NC) and the fence was repaired. When
there were subsequent complaints in 2007 about repeated breaches in the fence,
Faison was less responsive. Code Enforcement staff cited the owner and spot
repairs were performed on the fence. Correspondence from the'neighborhood
group indicated that a repair behind IHOP completed in summer 2007 was cut
open again three days later.
In March 2008, the City received a letter from the Dorchester Court Neighborhood
Crime Watch advising that a hole had been cut in the fence and requested it be
repaired. Code enforcement and Planning staff inspected the entire fence and
noted multiple breaches between IHOP and Oakland Boulevard. After repeated
repairs and considering the lack of access between the neighborhood and Valley
View, staff began to consider creating legitimate openings in fence. Chris Chittum
met with IHOP manager for feedback on the idea. He had no objection. Mr.
Chittum contacted Anita Adams (Faison) and she agreed to have fence repaired
once legitimate openings are created.
Public Works, Parks and Recreation, and Planning staff met at the site to determine
the location for fence openings and a pathway. Staff was approached by Mr.
Shanks, who expressed opposition to creating path and fence opening. Following
the on-site meeting, there was consensus to proceed with creating legitimate
openings in the fence. The plan of action and justification were included in a City
Council update.
Mr. Chittum notified Sidney Bush about plans to create openings on June 10, and
met with Mr. Bush next day to discuss details. Mr. Chittum offered to attend an
upcoming meeting, but the next contact was a 'phone message on June 25 from Mr.
Bush that the neighborhood watch groups opposed the fence openings.
Considerations:
The fence has been cut open and repaired repeatedly only to have it cut open
again, sometimes only a few days after repair. This pattern leads to continued
friction between residents, the City, and the property owner. Repairing the fence
only addresses a symptom and is, as we have learned from experience, only a
temporary solution. The root problem is that the fence separates the

neighborhood from Valley View Mall, a major employer and center for goods and
services. People walk from the surrounding to their jobs or to patronize
businesses. While there is an existing opening to the northwest near the ball
fields, we know that it will not be used by those accessing destinations to the south
or east. Pedestrians naturally seek the shortest distance of travel.
Staff expects that legitimate openings in the fence will be used instead of
repeatedly cutting holes in the fence. The openings and pathway are being created
along a public right-of-way along the edge of Huff Lane Park.
This approach is consistent with Crime Prevention Through Environmental Design
(CPTED) principles as it controls access and encourages pedestrian traffic to use
legitimate routes that are in the open and subject to natural surveillance.
Attached is a map showing the location of the path and the proposed new fence
openings. Construction began in late September and is being performed by City
crews. So far, a stone base for the path has been laid and an opening in the fence
has been created at Valley View Boulevard.
City Administration acknowledges and shares residents' concerns about pedestrian
access through illegal openings in the fence. This plan of action is an appropriate
response given that efforts to prevent pedestrian access in this location have been
unsuccessful. This path will provide convenient pedestrian access from the
neighborhood and will be what we hope is. a permanent solution.
