and accurate count in 2010.

public hearing for Thursday, October 22,2009, at 7:00 p.m., or as soon thereafter
as the matter may be heard, to consider renewal for lease of space in the City
Market Building to Byron Penick, owner, Penick Incorporated, d/b/a New York Subs
Restaurant, month to month, not to exceed 12 months.
RECOMMENDED ACTION: Concurred in the request.
C-3 A communication from the City Manager requesting that Council schedule a
public hearing for Thursday, October 22,2009, at 7:00 p.m., or as soon thereafter
as the matter may be heard, to consider a request from Big Brothers Big Sisters of
Southwest Virginia, Inc., a Virginia non-stock, not for profit foundation, for tax
exemption of certain real property located at 124 Wells Avenue, N. W.
RECOMMENDED ACTION: Concurred in the request.
C-4 A communication from the City Manager requesting that Council schedule a
public hearing for Thursday, October 22,2009, at 7:00 p.m., or as soon thereafter
as the matter may be heard, to consider a request from the City of Roanoke to
establish a separate personal property tax rate for aircraft weighing 20,000 pounds
or more and "clean special fuel" vehicles.
RECOMMENDED ACTION: Concurred in the request.
C-5 Reports of qualification of Karena J. Clinton as a member of the Roanoke
Neighborhood Advocates for a term ending June 30, 2012; and Judy Jackson as a
member of the Roanoke Civic Center Commission for a term of three years ending

COMMENTS BY CITY MANAGER.
In response to a citizen's comments regarding the number of
employees involved with the mowing operations and number of Deputy
Chiefs employed with the Police Department, the City Manager stated
that there are approximately 15 Parks and Recreation employees
involved with the mowing operations; and two Deputy Chiefs of Police.
She announced that the newly constructed Fire Station No.3 will have a
community room and Satellite/Sub Police station.

At 4:13 p.m., the Council Meeting was declared in recess for Closed Meeting in
Room 451, Council's Conference Room.

CERTIFICATION OF CLOSED MEETING. (6-0)
Appointed Laura Rawlings to replace Thomas G. Powers, Jr. as a member of
the Roanoke Civic Center Commission for a three year term ending
September 30, 2012. Council waived City residency requirement for Laura
Rawlings in this instance.
Appointed Mark Futrell to fill as a member of the City Planning Commission to
fill the unexpired term of Richard A. Rife ending December 31, 2012.
Appointed Anna Balog to replace Earnestine Garrison as a member of the
Youth Services Citizen Board for a term ending May 31, 2012.
Reappointed Police Lieutenant James Fazio and Police Officers Tom Mealey
and Harold F. Wallick as members of the Towing Advisory Board for three
year terms each ending October 31, 2012.
The City Clerk was instructed to schedule interviews with the Council and the
following applicants to fill the vacancies on the Architectural Review Board
for terms ending October 1, 2013: Anne Beckett, Alison Blanton, Aaron
Copeland, and Jon Stephenson.
Interviews will be held on Monday, November 2 commencing at 12:00 noon in
the Council's Conference Room.

WHEREAS, October is annually recognized as National Breast Cancer
Awareness Month; statistically, one out of every eight women in America willface
breast cancer in her lifetime; 85% of women who get breast cancer do not have a
family history of the disease; low-income women throughout Southwest Virginia,
especially in rural counties, need breast cancer outreach, education, screening
and treatment; and
WHEREAS, in the service. area of the Greater Roanoke Chapter of Susan G.
Komen for the Cure, the breast cancer incidence rates among women in all but
one of our service area counties 'is estimated higher than the national and state
rates; the Komen Service area death rate is higher than the state average and
results in an estimated 113 women dying from breast cancer each year; and
WHEREAS, based on our area's higher incident rate, it is estimated that 566
women will develop breast cancer each year; women unscreened each year in our
Komen service area are estimated as 80,788 of eligible women age 40 and over;
as a result of higher incidence rates for breast cancer in our area, an estimated
114 breast cancers go undiagnosed each year; of women diagnosed with breast
cancer, some will die from the disease; mammography, an x-ray of the breast, is
the Gold Standard for detecting breast changes that may be cancer long before
physical symptoms can be seen or felt.
NOW, THEREFORE, I, David A. Bowers, Mayor of the City of Roanoke,
Virginia, urge all women to get mammograms on a regular basis, do hereby
. proclaim Monday, Ocibber:5, 2009, throughout this great All-America City, as

WHEREAS, the Family Violence Coordinating Council is committed to
educating the public on domestic violence for the enhanced
safety of all citizens; and
WHEREAS, domestic violence can affect anyone regardless of age, race,
gender or socio-economic status; and
WHEREAS, many victims are ashamed to seek help, thus continuing to
suffer through years of terrifying and dangerous abuse;
children often witness domestic violence, while feeling
helpless to stop the abuse of the victim; and
WHEREAS, domestic violence can change from day to day, but seldom
changes for the better unless someone intervenes; dealing
effectively with domestic violence requires a coordinated and
integrated response from many different groups and social
agencies; and
WHEREAS, the Family Violence Coordinating Council works
continuously and cooperatively to improve and increase the
resources available to victims of family violence in the
Roanoke Valley,
NOW, THEREFOR,E, I, David A. Bowers, Mayor of the City of Roanoke,
Virginia, urge all citTzeriiLto work in conjunction with the Family Violence.
Coordinating Council to recognize domestic violence in our community
and encourage victims to seek help, and do hereby proclaim October,
2009, throughout this great All-America City, as

WHEREAS, an accurate census count is vital to our community and
residents' well-being by helping planners determine where to
locate schools, day-care centers, roads and public
transportation, hospitals and other facilities, and is' used to
make decisions concerning business growth and housing
needs; and

Pursuant to the requirements of the Virginia Code, the City of Roanoke is
required to hold a public hearing if it wishes to consider a change in a tax levy.
Two changes are being recommended by the administration. The first would
establish a separate personal property tax rate, as permitted by state code, of
$.45 per $100 of assessed value for aircraft having an empty gross weight
equal to or greater than 20,000 pounds. Aircraft weighing less than 20,000
pounds will continue to be assessed at $1.06 per $100 of assessed value.
It is also recommended that the City establish a personal property tax incentive
of 10% for citizens who own "clean special fuel" vehicles.
It is recommended that a public hearing be advertised on the above matters for
Council's regular meeting to be held on Thursday, October 22, 2009 at 7:00
p.m.

Subject: Edward Byrne Memorial Justice Assistance Grant
The Edward Byrne Memorial Justice Assistance Grant Program (JAG) allows
states and units of local governments to support a broad range of activities to
prevent and control crime based on their own needs and conditions. The JAG
program is administered by the Bureau of Justice Assistance Office of Justice
Programs. On September 22,2009, the Sheriff's Office was awarded $169,491 in
JAG program funding. There is no required match.
The awarded funding will be used to purchase cameras, DVR's, keyboards,
portable radios, and gang radio chargers to be installed at the jail and courthouse
facilities. The purpose of this upgrade is to enhance the city's ability to respond
to threats directed at the buildings, judiciary, and courthouse community.
Recommended Action:
Accept the Edward Byrne Memorial Justice Assistance Grant (JAG) described
above and authorize the City Manager to execute the grant agreement and any
related documents; such documents to be approved as to form by the City
Attorney.

Acceptance
Background:
The Virginia Office of EMS supports local fire and EMS departments throughout
the state by offering grants for personal protective equipment. Roanoke Fire-
EMS has been awarded a grant totaling $14,460 to purchase personal protective
equipment consisting of surgical masks for use during a state declared
pandemic, such as an outbreak of H 1 N 1. This grant does not require local
matching funds.
Considerations:
City Council action is needed to formally accept and appropriate these funds,
and authorize the Director of Finance to establish revenue estimates and
appropriations to purchase the personal protective equipment in accordance
with provisions of this grant.
Recommended Action:
Accept the grant as described above and authorize the City Manager to execute
any required grant agreements or documents, such to be approved as to form

Background:
The Fire Programs Fund was established by the General Assembly during the
mid 1980s. Program guidelines require that funds received are non-
supplanting and may not be used to replace existing local funding. Funds must
be used in accordance with the provisions established by the State Department
of Fire Programs.
The City of Roanoke's FY10 allocation of $261 ,849 from the Department of Fire
Programs was deposited into account 35-520-3339.

Background:
The Virginia Department of Transportation (V DOT) awarded the City $75,000
for the construction of a two-stage pedestrian crossing on 10th Street to
facilitate the crossing of 10th Street by Lick Run Greenway users. Those
improvements have been completed and the two-stage crossing is operational.
Considerations:
As originally envisioned, the crossing was to consist of the construction of a
pedestrian refuge island in the middle of 10th Street and the installation of
flashing lights and pedestrian push buttons to enhance the safety of the at-
grade crossing of the Lick Run Greenway. The island was ultimately
constructed as part of the Lick Run Greenway construction, so funds received
for the crossing project were only used to pay for the flashing lights and
pedestrian push buttons. Total construction cost for this effort was $16,850.
Remaining funds have been reallocated by VDoT to the 13th Street/Hollins Road
project, an ongoing urban project included in the VDoT Six-Year Improvement
Plan.

As a result, the remaining funds that were identified in the capital account as
appropriated from State grant funds should be un-appropriated and the revenue
estimate modified for this capital account.
Recommendation:
Adopt the accompanying budget ordinance to reduce the revenue estimate by
$58,150 and deappropriate the same amount of the funds identified as
appropriated from State grant funds in the project capital account, 08-530-
9832.

WHEREAS, a Design Public Hearing was conducted on December 2, 2008, in the City of
Roanoke by representatives of the Virginia Department of Transportation, after due and proper
notice, for the purpose of considering the proposed design of 13th Street and Hollins Road Project
UOOO-128-l13, UPC 688, in the City of Roanoke, at which hearing drawings and other pertinent
information were made available for public inspection in accordance with state and federal
requirements;
WHEREAS, all persons and parties in attendance were afforded full opportunity to
participate in the public hearing;
WHEREAS, representatives of the City of Roanoke were present and participated in the
hearing;
WHEREAS, the Council has previously requested the Virginia Department of Transportation
to program this project; and

WHEREAS, the Council has considered all of the foregoing matters.
THEREFORE, BE IT RESOLVED by the Council of the City of Roanoke that:
1. The location and maj or design features of the proposed proj ect as presented at the
Public Hearing are approved.

Background:
The Virginia Department of Transportation (VDOT) has programmed a street
improvement project along the 13th Street and Hollins Road corridor between
Dale Avenue and Orange Avenue. The project consists of the construction of a
bridge to eliminate an at-grade rail crossing, intersection improvements, and
the addition of curb, gutter, sidewalk, bike lanes, and other streetscape
amenities.
Considerations:
VDOT and the City of Roanoke held a citizen information meeting on May 17,
2006 and a public hearing on December 2, 2008 to gather public comments.
Those comments have been considered and incorporated as appropriate. The
City's street design team reviewed the plans and suggested revisions that have
been incorporated.
Pertinent design features included with the project include a bridge over
Norfolk Southern's rail lines, improvements at the intersection of Hollins Road
and Orange Avenue, construction of roundabouts at intersections with Tazewell
and Wise Avenues; the addition of curb, gutter, and sidewalk; bike lanes to

accommodate on-street bicyclists, separation between the shared-use path and
the street to permit street trees, and enhanced street lighting.
Right of way acquisition is currently scheduled to begin in FY2010 with
construction anticipated to follow in. FY2014. Total project cost is
approximately $39 million for which the City will be responsible for
approximately $1.1 million. The 13th Street/Hollins Road project account
currently has $257,358 budgeted from local funds which will qualify as part of
the $1.1 million required local match. The remaining local share of funding in
the amount of $842,642 will be provided and transferred from Capital
Improvement Reserve - VDOT Match, as funds are made available annually, to
the 13th' Street/Hollins Road project account #08-530-9598.
Recommended Action:
Adopt the accompanying resolution approving the major design features of this
project and requesting that VDOT acquire all rights of way necessary for this
project and convey said rights of way to the City at the appropriate time.

identical original condition, but rather as near thereto as is reasonably practicable.
In the event APPALACHIAN should remove all of said Appalachian's facilities from the
lands of the GRANTOR, then all of the rights, title and interest of the party of
APPALACHIAN in the right of way and license hereinabove granted, shall revert to the
GRANTOR, its successors and assigns.
APPALACHIAN agrees to indemnify and save harmless the GRANTOR against any
and all loss or damage, accidents, or injuries, to persons or property, whether of the GRANTOR
or any other person or corporation, arising in any manner from the negligent construction,
operations, or maintenance, or failure to properly construct, operate, or maintain said
Appalachian's facilities.

Subject: Appropriation of Bond Funds
for Countryside Golf Course
Capital Improvements
Background:
A Request for Proposals (RFP) was issued on April 1, 2009 for the
Management and Operation of the City of Roanoke's Countryside Golf
Course. As a part of the RFP process, certain improvements were identified as
being critical to the successful future operation of the course.
On July 20, 2009, City Council approved the Capital Improvement Program
(C1P) Update for FY 2010-2014 and, subsequently, modified the update on
August 3, 2009. The CIP included planned bond issuance for FY 2010 in the
amount of $13.945 million, which City Council authorized on September 8,
2009, for several projects which included $6.74 million for Parks and
Recreation Master Plan activities, and priority projects, including a potential
allocation of $2.0 million for capital improvements to the Countryside Golf
Course. The ordinance was approved by City Council, after a second reading
on September 21, 2009.

Considerations:
Necessary capital improvements have been identified with a total estimated
cost not to exceed $1.5 million. The improvements include:
. Golf course irrigation system renovation
. Cart path renovation
. Clubhouse renovation
. Pavilion/Driving Range improvements
These improvements will be implemented as City of Roanoke capital projects.
Recommended Action:
Adopt the accompanying budget ordinance to appropriate funding, in
advance of debt issuance, in the amount of $1.5 million to an account to be
established in the Capital Projects Fund by the Director of Finance.

Subject: July and August Financial Report - City of Roanoke
The following financial report provides commentary on the City's financial
resu Its for the first two months of this fiscal year. Financial Statements are
included for both the month of Ju Iy and the two months ended August 31 .
Many of our local taxes are trending lower due to the negative impact of the
national economic decline. Real Estate Tax collections, however, have
increased and the total levy, for FY10 grew 2% over FY09 as a result of
commercial growth and new construction. A number of other important local
taxes are on a downward trend. Sales tax revenues, which began to decline in
January 2009, are 16.8% lower this year for July sales. Food and Beverage,

Transient Occupancy, and Cigarette taxes have also declined 3.1 %, 8.7%, and
4.9%, respectively. Also negatively impacting the City's revenues are State
budget reductions of over $900,000.
The current expenditure budget for FY1 0 represents a 1.4% decrease from the
budget as of August FY09 due primarily to budget reduction measures
including reductions in the number of employee positions, employee benefits,
and programs and services. The City is continuing to manage expenses and
we are slightly under prior year through August.
Revenues:
The City's revenue recognition practices call for the accrual back to the. prior
year of revenues received within the first sixty days of a fiscal year provided
the taxes relate to the period through June 30th. Therefore, for example,
real estate and personal property taxes collected during July and August, but
billed by Ju ne 30th, must be reported as revenue of fiscal year 2009. This
practice results in many low, or even negative, revenue amounts as of the
end of our second fiscal month, August. This is most apparent in the local
tax and Intergovernmental categories. Also, variances in the amounts carried
back from one fiscal year to another can cause large fluctuations in
comparability. The City's revenue trends will smooth and become more
meaningful for comparison after the first quarter of the year.
Commentaries on significant variances ar,e shown below.
Intergovernmental revenues decreased $ 881,000 from last year. This
category is also impacted heavily by the revenue recognition policy. The
variance is primarily due to the timing of collections of Comprehensive
Services Act reimbursements. It is important to note that this category will

be impacted by over $900,000 in additional Commonwealth budget
reductions to constitutional officers as well as reduced funding for law
enforcement, libraries, and various social services.
Charges for Services decreased $385,000 or 25.9% compared to FY09 due to
a timing difference and a change in revenue recognition policy. This change
was implemented July 1, 2009. Though it impacts results in the current
report, this is not expected to alter revenue in this category for the fiscal year
as a whole.
Expenditures:
The fiscal year 2010 General Fund expenditure budget totals $257.9 million
and includes funding of approximately $1 million to cover contracts and
purchase orders made during fiscal year 2009 but not paid by the end of that
year. The General Fund expenditures and encumbrances through August
were $47.8 million. Compared to the prior year, these expenditures, in total,
represent a decrease of 0.2% or approximately $107,000. Both increases and
decreases are discussed in the following sections.
Public Works expenditures fell 12.9% or $1.0 million due primarily to a
decrease in Street Paving costs. FY09 costs were higher than normal due to
carry over FY08 contracts.
Health and Welfare expenditures increased 17.7% over FY09. There was a lag
in payments last year due to the restructuring of service categories which
caused systematic changes that took time to implement. This timing
difference should be rectified in the second quarter of the fiscal year. Also
contributing to the variance is an increase in foster care, daycare, and

adoption services which are used on an as-needed basis and fluctuate
depending on the number of children in the programs.
Parks. Recreation and Culture expenditures declined 10.8% or $271,000 due
in part to decreased expenditures in the Roanoke Arts Commission and Parks
and Recreation Administration. Roanoke Arts Commission expenditure
reductions of 20% were planned for FY1 0 including the elimination of funding
for the Arts Festival. The variance for Parks and Recreation Administration
costs is due to the reduction in Event Zone expenditures and decreased
advertising.
Transfers to Debt ,Service Fund increased 17.9% or $714,000 compared to
FY09. This large variance is due to the increase in the payment amount on
the certain refunding bonds. The payment amount was much smaller in the
beginning years and increased starting in FY10.
Nondepartmental. expenditures increased 42.7% or $317,000. There has
been a significant increase in transfers to the Grant Fund as of August
compared to the prior fiscal year. However, this variance is related to timing
and we expect overall expenditures to be within budget for the year.
Civic Facilities Fund:
With Global Spectrum managing the Civic Center, there were improvements
in the quality of events as evidenced in July and August. Eighteen events
were held during August, with one near sell out, bringing the number of
FY10 events up to 34. In addition, total paid attendance through August was
19,408. This put the Civic Center ahead of budget by 3,558 attendees and 5
events. We expect to see improvements in the financial performance as the
economy rebounds.

The financial statements for this year do not portray the prior year results as
comparable since many of the specific line comparisons are not meaningful.
Comparisons between years will focus on the Operating Income or Loss
measure as well as the Change in Net Assets which provides a meaningful
comparable basis.
The Operating Loss for 2010 fiscal year to date worsened by $52,000 or 15%
when compared to fiscal 2009. From a year-to-date perspective, the Civic
Center is showing a Change in Net Assets of ($446,000) which is slightly
worse than last year. The impact of the change in our economy over the
past year offsets much of the positive progress made on the operational
front at the Civic Center.
Parking Fund:
Operating Income for the 2010 fiscal year to date reflected a decline of
$101,000 or 57%. This decline was the result of an 11 % decrease in revenues
and a 1 5% increase in expenses.
~ A reduction of more than 500 leased spaces by two major customers has
had a significant negative impact on revenues for Church and Tower
garages.
~ A major customer is a month behind on their parking payment,
accounting for about $1 5,000 of the revenue shortfall.
~ Decreased Operating Income is driven by utility and maintenance
expenses.

~ Change in Net Assets is driven by poorer operating performance plus
additional interest expense.
Market Building Fund:
The Market Building results reflect an additional operating loss of $3,000 in
the current year compared to the prior year. Revenues were down 12% which
was partially offset by a decrease of 3.4% in expenses.
~ There were two more vacancies in the Market Building in FY10 than there
were at this same time in FY09.
~ Change in Net Assets of $2.2 million is driven by a transfer from the
Capital Projects Fund for Market Building renovations.
In closing, we start out the fiscal year 2010 with many challenges and much
hope that the national economy will begin to recover from the past two years'
down turn. The City responded to the changing environment and continues
to be proactive in addressing financial responsibilities as we begin the year.
