2. PRESENTATIONS AND ACKNOWLEDGEMENTS:
Update from Red Cross Chapter regarding emergency efforts in Japan during the
earthquake and tsunami. Amy Whittaker updated the Council on the relief
efforts in Japan and advised that citizens can go to www.redcross.orQ to
make a donation.
3. HEARING OF CITIZENS UPON PUBLIC MATTERS:
CITY COUNCIL SETS THIS TIME AS A PRIORITY FOR CITIZENS TO BE
HEARD. MATTERS REQUIRING REFERRAL TO THE CITY MANAGER WILL BE

Leslie Matney appeared before the Council and expressed concern with
regard to the Greyhound Bus Station hours of operation.

(A)(19), Code of Virginia, as amended.
RECOMMENDED ACTION: Concurred in the request.
C-2 A communication from the City Clerk advising of the resignation of
Christina M. Brannan as a member of the Roanoke Neighborhood Advocates,
effective immediately.
RECOMMENDED ACTION: Accepted the resignation and received and
filed the communication.

RECOMMENDED ACTION: Received and filed.
C-4 Reports of qualification of Vice-Mayor David B. Trinkle as the City Council
representative to the Hotel Roanoke and Conference Center Commission, for a
term of four-years ending April 8, 2015; and Cynthia Lawrence as a member of the
Roanoke Regional Airport Commission, for a term of four-years ending March 9,
2015.

1 . Acceptance and appropriation of funds in connection with the Shelter
Plus Care Renewal Grant Award from the U. S. Department of
Housing and Urban Development.

2. Appropriation of additional funds for various social services programs.

4. Amendment of the City Code to reflect recent amendments to the
Virginia Uniform Statewide Building Code, which were adopted by the
State and enforced at the local level.

5. Execution of Amendment No.2 to the Agreement for Purchase and
Sale of Real Property with Scott and Ascension Horchler to extend
the timeframe of the real estate transaction on the Buena Vista
property.

COMMENTS BY CITY MANAGER.
Mr. Morrill shared an update on the budget process, reporting that staff is
currently working to develop the city's proposed Fiscal Year 2012 Budget. In
addition, he said Council will receive a briefing at their upcoming 9 a.m.
meeting on Monday, April 4; the proposed budget will be presented to City
Council on Monday, April 18; and the city will hold a public hearing on the
proposed budget on Thursday, April 28. He reminded citizens that they are
encouraged to review and give their feedback on the proposed budget at the
public hearing.
The City Manager also said the Leadership College is currently underway with
28 participants registered. He added that sessions are held on Tuesday
evenings at 6 p.m., and that the college is being offered from March 15
through May 10. In addition, he said Leadership College participants learn
best practices in organizing their community, how to access city services, and
gain a better understanding of city procedures.
b. DIRECTOR OF FINANCE:
1 . Authorization to execute an agreement to indemnify and hold
harmless the Virginia Employment Commission against third party
claims from the City's access to its information system.

2. Establishment of the percentage reduction for personal property tax
relief for the 2011 tax year.

a. A report of the Roanoke City School Board requesting appropriation of funds
for various educational programs; and a report of the Director of Finance

11. MOTIONS AND MISCELLANEOUS BUSINESS:
a. Inquiries and/or comments by the Mayor and Members of City Council.
Council Member Rosen shared the challenges of re-purposing the Huff
Lane property and said he has worked with the School Board and met
with neighborhoods to get citizen input on the matter. He also said the
city should move forward with identifying plans for this property.
Council Member Lea asked that City Council recognize Gloria Lindsay,
who works for Virginia Western Community College, for her efforts to
help students receive scholarships to get them back in college so they
can finish their education. He also reported that good things are
happening in girls basketball at Addison Middle School, with their team
being undefeated. And he asked that City Council recognize the teams
in the Star City Recreation Club for their positive accomplishments.
Council Member Bestpitch cited the recent Roanoke Times op-ed by
Barbara Dalhouse about the SPCA and the euthanasia of animals for
which they can't find homes, and encouraged citizens to spay or neuter
their pets. He also said the City Manager's op-ed in Sunday's Horizon
Section of the Roanoke Times was very helpful in clarifying where the
city is in the process of development for Elmwood Park, and he
encouraged citizen input on proposals. He also said citizens should
attend current events in Elmwood Park and see how the space is being
used. He added that this may help citizens to understand how modest
investments in the park would help improve it as a venue. In addition,
he noted that the Planning staff is working on revisions to the City of
Roanoke Zoning Ordinance, and has continued the process to April. He
said staff should make sure to publicize this process through
MyRoanoke and Facebook while still in the planning stage to invite
citizen input.

Schools for receiving the 2011 Virginia Index of Performance (VIP) Award from

Spring; Terri Pritchard, Grandin Court; and Eric Fisher, Preston Park; school
teachers; Dr. Bishop, School Superintendent; and Dave Carson, Chair, School

B. PUBLIC HEARINGS:
1 . Proposal of the City of Roanoke to convey a portion of a parcel of City-
owned property to the Virginia Department of Transportation (V DOT) to
support an improvement project at the intersection of Riverland Road,
Bennington Street, and Mount Pleasant Boulevard; and also convey to
VDOT a permanent maintenance easement to permit future maintenance of
proposed drainage improvements, and a temporary construction easement
to accommodate reconstruction of the entrances to Fire-EMS Station No. 11
on said parcel and construction of drainage improvements; convey to
Appalachian Power Company and Verizon permanent above ground and
underground utility easements to permit certain utility improvements,
relocation and maintenance of certain facilities owned by said companies;
and convey a temporary construction easement over a certain parcel to
VDOT to accommodate construction of the project. Christopher P. Morrill,

Call to Order:
Sherman Lea called the meeting to order at 4:10 pm. Mr. Lea, Dr. Trinkle, and Mayor Bowers
were in attendance. Dawn Mullins represented the Municipal Auditing Department.
Fixed Asset Inventory Count Report:
Ms Mullins apprised the Committee on the background and timing of the audit. She
gave a brief review of the report including objectives and results. The Committee
discussed the use of bar code scanning related to capital assets. The City does not
currently utilize this technology; however, it is in use at Roanoke City Public Schools.
There was additional discussion related to the Faster and Advantage systems, both of
which are used to track capital equipment. Although there is overlap between the
system information, each system performs a different function and is necessary.
Dr. Trinkle asked if we needed both Advantage and Faster. Ms. Shawver yes, we use
Advantage for other items, for example the conference room table. The overlap would
be fleet.

Ms. Mullins pointed out that a response from the Department of Finance response was
also included in Committee packet.
The report was received and filed.
Purchasing Card Report:
Ms. Mullins briefed the Committee on the history and current year approach to the
engagement. She reviewed trend information contained in the report. The overall
decrease in purchasing card expenditures from 2007 through 2010 was discussed as a
result of the economic downturn. Ms. Shawver noted that Roanoke City Public Schools
stopped using City purchasing cards during this timeframe.
Budgetary line items most frequently charged were reviewed by Ms Mullins. Dr. Trinkle
asked what was included in the 2007 purchasing card expense line item. Ms. Shawver
responded this it is a budgetary line item utilized as a default to prevent monthly
purchasing card processing from being delayed when a department has not yet coded a
specific charge. It does not reflect fees or charges paid to the company related to
purchasing card privileges. Mr. Morrill noted Training and Development charges
decreased which demonstrates that the City has been investing less in staff
development.
There were no findings related to the report. Mr. Lea stated he was pleased with audit
results and the turn around in results from a few years ago. Ms. Shawver recognized
Municipal Auditing for their assistance with monitoring the program.
The numerous cost saving benefits related to having a purchasing card program were
discussed. The purchasing card rebate, which has decreased by about half over recent
years, was also considered by the Committee. The potential exists for additional cost
savings and increased rebates if Roanoke City Public Schools were to once again
participate in the program.
Mayor Bowers requested that the audit results be presented by Mr. Morrill at the next
City Council meeting.
The report was received and filed.
Council Appointed Expenditures Reports:
The Committee was briefed by Ms. Mullins on how the audit evolved and the
background of the report. It was noted that as Mr. Harmon is appointed by City Council,
he did not directly participate in the completion or review of audit work. Municipal
Auditing performed a detailed review of Fiscal Year 2010 4th-quarter expenditures by

City Council appointed officials and found they appeared reasonable and necessary.
Mayor Bowers inquired as to why certain cost centers were analyzed separately from
those of the corresponding director. Ms. Mullins responded that three cost centers were
separately analyzed because each had its own budget apart from that of the director's
cost center. Municipal Auditing performed some additional analysis on Council
appointed directorate expenditures for transparency purposes as spending this area is
not typically evaluated.
The Committee discussed reporting investigation results and assuring that individuals
who report allegations of fraud, waste, or abuse are made aware of the outcome. Dr.
Trinkle inquired if the City had a hotline. Ms Mullins reported that Municipal Auditing
went live with the fraud, waste, and abuse hotline in January. There have been no
reports to date. Anyone reporting an issue will be assigned an individual number so
he/she may log back in at anytime to check on the status of his/her issue. Additionally,
Ms. Shawver stated that audit reports are posted on the City's website. Mr. Lea
commented that it's essential to have a way to determine which reports are frivolous.
Ms. Mullins responded that the hotline allows users to choose from a variety of
categories when lodging a report. Dr. Trinkle inquired as to whether a 311 system could
take such a call. Mr. Morrill responded that such calls would be forwarded to Municipal
Auditing. There was no further discussion.
The report was received and filed.
Jail Cost Report Opinion:
Ms. Mullins briefly discussed the background of the annual Jail Cost Report, information
included in Item 63, and the role of Municipal Auditing in reviewing Item 63. There were
no issues with the 2010 review. The Committee did not have any questions or
comments.

Travel & Expense Policy for City Council - Proposed Revisions:
At the September 2010 Audit Committee meeting, Municipal Auditing recommended
City management consider revisions to the travel and discretionary expenditure policies
to better accommodate the needs of City Council. The City Manager's office undertook
this project. His staff surveyed other localities and found that very few have addressed
this issue. Additionally, they were not able to find any recommended practices and few
model policies. The Committee discussed the proposed policy revisions. Mayor
Bowers asked if the City Attorney, Director of Finance, and City Clerk have had a
chance review the revisions. Mr. Morrill responded they have and their
recommendations have been included. Dr. Trinkle commented that the changes seem
minimal; however, he is pleased that the issue is being addressed. Mayor Bowers

posed a question to the City Attorney as to whether approval of a discretionary
expenditure would require a formal vote of City Council. If so, the Mayor requested that
additional wording be added to allow the City Clerk to expend on behalf of City Council.

There was additional discussion related to cost centers providing funding for Council's
travel and discretionary expenditures.
Dr. Trinkle made a motion to move the draft travel and expense policy, including the
revised language related to the City Clerk, forward to City Council for further discussion
and a final vote. Mayor Bowers seconded the motion.
Briefing on Results from IRS Review:
Ms. Shawver stated that the IRS was on site October 27,2010 and October 28,2010.
Additional records were subsequently provided per their request. The Department of
Finance is awaiting a report and will share it the Committee upon receipt.
Call for other Business Requiring the Committee's Attention:
Ms. Mullins provided a handout to Committee members including a screen print of the
City's webpage link to the Fraud, Waste, and Abuse hotline, as well as a copy of
associated Frequently Asked Questions. The hotline went live in January and Mr.
Harmon has been working with the Office of Communications and Purchasing
Department to develop a roll-out plan which will include both employees and vendors.
Dr. Trinkle requested that Mr. Morrill make an announcement about the hotline at an
upcoming Council Meeting. Mr. Morrill will discuss the content and timing of the
announcement with Mr. Harmon.

PROJECT DESCRIPTION:
The Richard H Poff Federal Office and Courthouse Building in Roanoke, VA, is a fourteen story modern structure containing
187,649 usable square feet, 255,700 rentable square feet and 316,369 gross square feet with 169 parking spaces situated on
1.3 acres. This 14 story building was constructed in 1975 with green tinted glass curtain walls on the north and south elevations
and brown brick on the east and west elevations. Tenants for the Poff Federal Building include the U.S. Department of Veterans
Affairs (VA) and the U.S. District Courts.
The project for this building will replace obsolete building systems, including the installation of a new high performance HVAC
system; replacement of the window curtain wall; renovations of public restrooms to meet current accessibility standards; lighting
upgrades with energy efficient fixtures and installation of a sustainable roofing system, including the installation of solar panels
on the roof to generate electricity.
PROJECT STATUS:
Design for the Poff Federal Building project was completed in February 2011. General contractor Balfour Beatty is currently
seeking sub-contractor bids.
In collaboration, the VA and GSA found suitable spaces to temporarily relocate the VA regional office during the
renovation project. These spaces are close to the current regional office location, located in the central business area,
and will house the major regional office components.
VA and GSA have worked together to determine how to most effectively and efficiently schedule renovations to minimize
disruption. Recognizing the criticality of VA's mission, GSA has locally dedicated move-coordination services to ensure
that VA's moves are seamless. Moves will take place on weekends. VA operations will be functional early Monday
morning after each move.
PROJECT SCHEDULE:
The VA will begin moves into temporary lease locations in Spring 2011, with construction for the Poff Federal Building Project to
begin in Summer 2011.

City of Roanoke Shelter Plus Care Home at Last Grant Renewal
Background:
A Shelter Plus Care grant allocation of $175,140 was awarded to the City of
Roanoke for a one-year period beginning July 11, 2011, through July 10, 2012.
A local in-kind dollar for dollar match of supportive services is required and has
been committed by the following agencies: Salem Department of Veterans
Affairs Medical Center, City of Roanoke Department of Social Services, Total
Action Against Poverty, Blue Ridge Independent Living Center, Blue Ridge
Behavioral Healthcare, City of Roanoke Health Department, Support Systems,
Inc., Dominion Day and the Roanoke Redevelopment and Housing Authority.
Permanent supportive housing continues to be identified as a top priority for.
the Blue Ridge Continuum of Care and the Roanoke Regional Advisory Council
on Homelessness. This program provides rental assistance and supportive
services to 24 disabled, homeless individuals and their families. Disabilities are
defined as serious mental illness, chronic substance abuse, AIDS or related
diseases and physical disabilities.
Recommended Action:
As fiscal agent, authorize the City Manager to accept the Shelter Plus Care
Renewal Grant Award in the amount of $175,140 from the U. S. Department of
Housing and Urban Development and execute the required grant documents on
behalf of the City; such documents to be approved as to form by the City
Attorney.
Adopt the accompanying budget ordinance to establish a revenue estimate in

Additional Funding for the Department of Social Services
Background:
The Department of Social Services has experienced an increase in demand for the
following services over the past year: Foster Care, Independent Living, Refugee
Resettlement and Day Care Services. The AFDC Foster Care program provides
financial assistance to foster parents on behalf of their children. The Independent
Living program provides financial assistance to former foster care recipients for
housing, counseling, employment, education and other services to complement
their efforts to achieve self-sufficiency. The Refugee Resettlement program
provides temporary financial assistance to eligible refugees. The Day Care
program provides assistance to people with day care services so that they can stay
employed. The services provided by these programs include therapeutic
treatments, medical services, speech and physical therapy, equipment purchases,
day care for children with special needs and regular day care. Foster Care,
Independent Living, Refugee Resettlement, and Day Care programs are sum
sufficient programs.
Considerations:
The Department of Social Services expenditures in these service areas are projected
at $8,384,059. Based on this projection, expenditures will exceed the current FY
2011 appropriation of $6,686,737 by $1,697,322. The increase of $1,697,322 will
be reimbursed by the Commonwealth of Virginia at 100% (no local match is
needed).
Recommended Action:
Adopt the accompanying budget ordinance to establish revenue estimates totaling
$1,697,322 and appropriate funding in the same amount to accounts to be

Virginia Recre~tional Trail Grant Application:
Roanoke River Greenway - Trailhead Development
Background:
The Roanoke River Greenway Trail is the Roanoke Valley's priority project for the
Greenway network. As a community effort, the Greenway has received widespread
support from citizens, neighborhood groups, businesses, civic organizations, and
local governments. The City has been committed to this project as a component of
our livability critical to health, environmental sustainability, active transportation,
and economic development. Roanoke has completed more than 6 miles of this 10-
mile effort to-date.
Considerations:
The section of trail that is currently being developed by the Army Corps of
Engineers (ACOE) connects Memorial Bridge Park to Bridge Street. The scope of
work performed by the ACOE only focuses upon trail development; therefore there
are no funds available to provide for access for citizens and visitors for this portion
of Greenway in the more western portions of the City. The Virginia Recreational
Trails program, administered through the Virginia Department of Conservation and
Recreation, is an 80-20 reimbursable grant program that could provide the
necessary funding to allow for trailhead development. Trailhead facilities would
include ADA compliant parking, informational kiosks, trash receptacles,
informational Greenway kiosks, and riparian sustainable landscaping. The City has
been a successful recipient of grants from this program previously on other trail
related projects, as managed through the Department of Parks and Recreation. It is
proposed that the City request a grant for $81,916 in state trails funds to support
the overall project value of $102,395. An in-kind matching component of $20,479
will be volunteer assisted labor and materials as donated by Pathfinders for
Greenways.
Recommended Action:
Authorize th Office of the City Manager to apply for Virginia Recreational Trail

The provisions, requirements and regulations contained in Part I Virginia
Construction Code, Part II Virginia Rehabilitation Code and Part III Virginia
Maintenance Code of the Virginia Unifonn Statewide Building Code (~ 2009
edition), and each of the component parts, including, but not limited to, the
International Building Code (~ 2009 edition), the lntemational Property
Maintenance Code (~ 2009 edition), the Intemational Plumbing Code (WGe
2009' edition), the Intemational Mechanical Code (~ 2009 edition), the
National Electrical Code (~ 2008 edition), the International Fuel Gas Code
(~ 2009 edition), the International Energy Conservation Code (~ 2009
edition), the International Residential Code for One and Two-Family Dwellings
(~ 2009 edition), and the Intemational Existing Building Code (WGe 2009
edition), including all supplements to such component paris, as the same may
from time to time be amerided by the State Board of Housing and Community.
Development, are hereby adopted by the city and incorporated herein by reference
as if set out at length herein. The Virginia Uniform Statewide Building Code
(~ 2009 edition), and its component parts, shall be controlling in the
construction, reconstruction, alteration, enlargement, repair, maintenance,
conversion or demolition of buildings and other structures contained within the
corporate limits of the city. Such code, or any of its components, shall be referred
to in this chapter as the building code. Copies of the building code shall be kept
on file in the office of the building commissioner and in the office of the city
clerk.

Amendment to City Code Section 7-5 Regarding Building
Regulations
Backg rou nd:
Effective March 1, 2011, the Virginia Department of Housing and Community
Development adopted the 2009 edition for Part I, Virginia Construction Code; Part
II, Virginia Rehabilitation Code; and Part III, Virginia Maintenance Code; of the
Virginia Uniform Statewide Building Code (USBC) for the purpose of establishing
minimum regulations to govern the construction and maintenance of buildings and
structures. The provisions of the USBC are based on nationally recognized model
building codes published by the International Code Council, Inc., and are made part
of the USBC by reference. The USBC also' contains administrative provisions
governing the use of the model codes and establishing requirements for the
enforcement of the USBC by the local building departments and other code
enfor;cement agencies. There is minimal financial impact of this recommendation.
Adoption of the USBC amendments will pose small training and materials cost to
the City which are budgeted. The amendments will not significantly impact permit
fee revenues obtained by the City though they will result in the use of updated
construction value tables which are used in the computation of permit fees.
Considerations:
Adopting the attached ordinance will amend the Code of the City of Roanoke
(1979), as amended (City Code), to reflect the recent amendments to the USBC
which were adopted by the State. Such amendments are enforced at the local level.

AN ORDINANCE authorizing the City Manager to execute an amended sales agreement
providing for a closing date for the conveyance of a 3.0 acre portion of City-owned property,
otherwise known as Buena Vista Center, bearing Official Tax No. 4130501, to Scott and
Ascension Horchler, upon certain terms and conditions; and dispensing with the second reading
by title of this ordinance.
WHEREAS, a public hearing was held on June 21, 2010, pursuant to SS15.2-1800(B)
and 15.2-1813, Code of Virginia (1950), as amended, at which hearing all parties in interest and
citizens were afforded an opportunity to be heard on such conveyance.
BE IT ORDAINED by the Council of the City of Roanoke that:
1. The City Manager and the City Clerk are hereby authorized, for and on behalf of
the City, to execute and attest, respectively, an amended sales agreement providing for a closing
date for the conveyance of a 3.0 acre portion of City-owned property, otherwise known as

Amendment No.2 to Sales Contract - Buena Vista Center
Background:
On June 21, 2010, by adoption of Ordinance No. 38863-062110, City Council
authorized the City Manager to enter into a sales contract, dated June 22, 2010,
for the disposition of a three acre tract containing the former Buena Vista
Recreation Center (tax map no. 4130501) to Scott and Ascension Horchler.
The purchase price is $75,000, and the contract contains a number of terms
and conditions which were to be met prior to the closing of the real estate
transaction. With the successful rezoning of the property on September 22,
2010, to a zoning classification that allows the existing structure to be used as
a single family residence, and the relocation of remaining tenant in the
building, the Virginia Department of Historic Resources, on October 1, 2010,
the contingencies related to the scheduling of the real estate. closing were
satisfied.
The sales contract contained a provIsion that closing on the real estate
transaction would take place within thirty days of the satisfaction of any
contractual contingences, which would be on or around November 1,2010.
On October 18, 2010, City Council authorized the City Manager to execute
Amendment No. 1 which provided an extension to the closing date to April 1,
2011.
Considerations:
The Horchlers relocated to Roanoke and remain in temporary residential
quarters. The Horchlers have not yet been able to obtain a contract on the sale
of their home in Midlothian, Virginia, and recently reduced the asking price to
expedite the sale. The Horchlers remain very interested in the Buena Vista
property, and have asked the City to consider an additional amendment to the
sales contract that would extend the timeframe during which the closing on the
Buena Vista property could take place and allowing them additional time to sell
their property in Midlothian.
Given the current real estate market, and the efforts by the Horchlers to this
point regarding their continued interest in the Buena Vista property, the
Administration is supportive of granting them such a request.

Amendment NO.2 has been drafted which would extend the timeframe of the
contract thereby requiring the real estate transaction on the Buena Vista
property to be closed within 30 days of the closing of the sale of the Horchler
property in Midlothian, Virginia, or no later than June 30, 2011.
All other terms and conditions contained in the Contract dated June 22, 2010,
as amended, between the parties will remain in full force and effect.
Recommended Action:
Authorize the City Manager to execute an Amendment No.2 to the Agreement
for Purchase and Sale of Real Property between the City and Scott and
Ascension Horchler, substantially similar in form to the one attached, and any
other appropriate documents, approved as to form by the City Attorney.

AMENDMENT NO.2
AGREEMENT FOR PURCHASE AND SALE OF REAL PROPERTY
This Amendment No.2 is dated , by and between the CITY OF ROANOKE,
Virginia ("Seller") and SCOTT AND ASCENSION HORCHLER, husband and wife, 2911
Winterfield Road, Midlothian, Virginia 23113 ("Purchasers"),
WIT N E SSE T H:
WHEREAS, the parties entered into an Agreement for Purchase and Sale of Real Property dated June
22,2010, that provided for the sale of certain real property and improvements thereon located in the
City of Roanoke, Virginia, consisting of approximately 3.0 acres and improvements thereon, as the
same is described as Lot "A" on Exhibit 1 attached thereto, ("Property"), together with a twenty (20)
foot wide easement for ingress and egress to the Property across City of Roanoke Tax Parcel No.
4130501 to Penmar Avenue, as shown on the plat of subdivision described and referenced in Exhibit
l'

WHEREAS, the Agreement provided for the settlement on a date which is no later than thirty (30)
days after the contingencies contained in the Agreement were met or satisfied in their entirety, or at
an earlier date at the option of Purchaser; and
WHEREAS, the Purchasers have advised the Seller that they are unable to close on the Property until
their house in Midlothian, Virginia has sold.
WHEREAS, Amendment No.1 (Exhibit 2) was entered into on November 8,2010, extending the
Agreement for Purchase until April 1 , 2011. As of March 14, 2011, the purchasers have not sold
their residence in Midlothian, Virginia and are requesting another 90 day extension.
NOW, THEREFORE, in consideration ofthe mutual promises and covenants herein contained and as
set forth in the original Agreement, the Seller and Purchasers agree as follows:
Section 9. Settlement, is hereby amended and shall read and provide as follows:
9. SETTLEMENT. The Settlement shall be held at the offices ofthe Roanoke City
Attorney on or before either July 1, 2011, or the date thirty (30) days after the Purchasers sell
their residence in Midlothian, Virginia, whichever date is the earlier. Time is of the essence in this
Agreement.
All the terms and conditions ofthe original Agreement for Purchase and Sale of Real Property dated
June 22, 2010, shall continue in full force and effect except as modified above.

Agreement for Access for Virginia Employment Commission
Information Systems
Backgrou nd:
The Department of Billings and Collections utilizes the Virginia Employment
Commission's ("VEC") electronic information systems to access data to locate and
contact customers in order to collect delinquent accounts such as Personal
Property, Real Estate, and Business Licenses Taxes, as well as other taxes and
fees, Billings & Collections has used this database for twenty plus years and
finds this tool essential in the overall collections process. The cost of these
services is approximately $900 per year and is budgeted within the Billings and
Collections department.
The VEC has requested that the City execute a new agreement each year,
indemnifying and holding harmless the VEC for any claims brought against it by
anyone harmed by the City's use of this information system. Because such a
provision would constitute a waiver of the City's sovereign immunity, only City
Council can agree to such a provision. The VEC has declined to delete this
provision from the agreement,
Recommended Action:
Authorize the City Manager to execute the attached VEC agreement, which
requires the City to indemnify and hold the VEC harmless against third party
claims, including annual renewals of such agreement to be approved as to form
by the City Attorney.

VIRGINIA EMPLOYMENT COMMISSION
&
DEPARTMENT OF BILLING & COLLECTIONS, CITY OF ROANOKE
Virginia Employment Commission (VEC) as the record-keeping agency and
Deparbnent of Billings & Collections, City of Roanoke, hereinafter referred to as
the "Data User," wishing to facilitate the transmittal of information required by the
Data User in the performance of its public duties, do hereby agree as follows:
I. The Data User is hereby granted authority to directly access VEC record
files through on-line computer inquiry. This authorization is limited to staff
.involved in collection of fines, penalties and costs owed to the
Commonwealth as provided in Section 60.2-114C of the 'Code of Virginia.
Any data accessed may not be used for any other purpose whatsoever. The
Data User and VEC mutually agree that the screens to be provi~ed under
the terms of this agreement are as follows:
· VEC Benefits. inquiry which provides the data subjecfs address and
basic information pertaining to the payment of benefits to
unemployment insurance claimants (OG90)
· VEC Wage/Earnings inquiry containing wages for the most recently
reported calendar quarters (DG91)
II. The Data User will designate and authorize no more than a total of four (4)
specified agency employees as deemed necessary to have direct on-fine
data access. The Data User is responsible for ensuring access is granted
only to individuals having undergone a satisfactory criminal background
check no more than two (2) years prior to the date of this contract. The
Data User will ensure access to the data will be limited to the employees
specified in this contract and that individual records are accessed solely
for the purpose authorized. The Data User is responsible for maintaining a
list of employees with their assigned log-on identification numbers. This
agreement does not extend access authorization to any outside agent
under contract to the Data User for the purpose of collection of monies
owed to the Commonwealth or the political subdivision.
III. The. Data User will designate an External Security Officer (ESO) for the
agency. The ESO's role will be to ensure only the specified employees
designated by the Data User on the External Security Officer Attestation
and VEC Authorization form (IAA001) have access to the data and that all
required controls over data are being exercised per the terms and
conditions of this agreement The ESO will be required to attest to these
controls periodically. Any assignment changes to the ESO and users
designated for this agreement must be reported to VEC within 7 calendar
days. The ESO cannot be an end user of the system.

IV. The Data User agrees that information 'obtained from VEC data will be
disseminated and maintained in accordance with the provisions of the
Government Data Collection Dissemination Practices Act, Code of Virginia,
Title 2.2, Chapter 38, Section 2.2-3800 et seq.; and in compliance with the
Virqinia Unemployment Compcensation Act, Code of Virginia, TiUe 60.2,
Section 60.2-114 and Section 60.2-623. The Data User further agrees to
maintain the data accessed in a manner that ensures unauthorized persons
cannot acquire the information and all individuals with direct or indirect
access are advised of the circumstances under which access is permitted
and the sanctions imposed for its misuse. The Data User is subject to the
penalty specified in Section 60.2-114 of the Code, whereby unlawful access
or use of the information obtained constitutes a Class 2 misdemeanor.
Violations of such access by Data Us'er employees may result in
termination of access to VEC record files and reimbursement to VEC for
costs associated with special investigations/audits and any legal action
that ensues.
V. The Data User's access is subject to periodic audit by VEC. The Data User
is responsible for maintaining records to trace access to a bona fide
accounts receivable collection action for three years.
VI. VEC will maintain a log of data accessed by the Data User in order to meet
the provisions of the Government Data Collection & Dissemination
Practices Act as regards an individual's right to know who has had access
to his/her records.
VII. The Data User will be billed direcdycby the Virginia Information Technology
Agency (VITA) for its access costs associated with these transactions.
VIII. The Data User shall pay VEC an initial fee of Nine Hundred Thirty-One
Dollars ($931.00) for the 12-month period ending January 20, 2012. The
initial fee shall be paid in advance upon the execution of this agreement
Thereafter, annual renewal payments shall be due upon the anniversary
date of this agreement in an amount to be determined by the VEC as
reasonably necessary to cover its administrative costs. The VEC shall
notify the Data User at least thirty (30) days in advance of any increase in
its fees. Failure to pay any annual renewal payment shall result in the
immediate termination of this agreement and the Data User's access to the
VEC wage file. Notwithstanding any other provision of this agreement, the
VEC rese.rves the right to increase its administrative fees at any time after
thirty (30) days notice in writing to the Data User, to align them with the
VEC's costs for maintaining, monitoring, and auditing the on-line access to
VEC's wage file records. .
IX. VEC does notguarantee the completeness or accuracy of the data.

X. VEC reserves the right to deny at any time direct access to the Data User
either temporarily or permanently if the on-line workload impacts VEC
production or for such other reason as VEC deems necessary.
XI. In accordance with IT Security Standard, COV ITRM Standard t 501-01,
Section 9.5 Data Breach Notification, if the Data User knows or reasonably
suspects that any citizen personally identifiable information obtained
. through this Inter-Agency Agreement has been lost, stolen or otherwise
subject to unauthorized access, the Data User shall immediately notify the
Information Security Officer (ISO) at the Virginia Information Technologies
Agency and VEC. The notification must include the following information:
. Cause(s) of the breach incident
. Date(s) of the breach incident
. Estimated size of the affected population (number of citizen records)
. The type of data exposed
. Any mitigating factors
XII. Should an unauthorized disclosure of an individual's personally identifiable
information take place as noted in Section IV or XI, VEC and the Data User
shall jointly participate in the investigation of the incident; however, VEC,
as the data owner, shall have control over any decisions regarding external
reporting. The Data User shall indemnify and hold VEC harmless from all
costs including fines .and penalties, related to the investigation, notification
to affected individuals, and remediation of the data breach.
Notwithstanding any other provision of this Agreement, VEC reserves the
right to immediately terminate this Agreement if it determines the data
breach was caused by Data User's negligent failure to implement and
enforce adequate internal controls. VEC further reserves the right to
suspend the Data User's access during the investigation of any data
breach.
XIII. VEC or the Data User may terminate this agreement without cause with
thirty days notice in writing to the other party.
XIV. VEC has the right to implement additional controls over the maintenance
and safekeeping of the data. The Data User will be responsible for
implementing and maintaining any additional controls.
XV. This agreement shall be effective upon execution by aU parties, including all
forms and addenda, and receipt by VEC of the payment specified in Section
VIII. Except as stipulated in Sections X and XI, this agreement shall remain
in effect until January 20,2012 and may be renewed by mutual consent.
XVI. Expiration of this agreement without renewal will result in the automatic
termination of the Data User's access to the data.

A RESOLUTION setting the allocation percentage for personal property tax relief
in the City of Roanoke for the 2011 tax year.
WHEREAS, in accordance with the requirements set forth in Section 58.1-3524 (C) (2)
and Section 58.1-3912 (E) of the Code of Virginia, as amended by Chapter 1 of the Acts of
Assembly and as set forth in item 503.E (Personal Property Tax Relief Program or "PPTRA") of
Chapter 951 of the 2005 Acts of Assembly, qualifying vehicles with a taxable situs within the
City commencing January 1, 2011, shall receive personal property tax relief; and,
WHEREAS, this Resolution is adopted pursuant to Ordinance 37221-101705 adopted by
City Council on October 17,2005.
NOW THEREFORE BE IT RESOLVED by the Council of the City of Roanoke as
follows:
1. That tax relief shall be allocated such as to provide 100% tax relief for qualifying
personal use vehicles valued at $1,000 or less.
2. That qualifying personal use vehicles valued at $1,001-$20,000 will be eligible for
64.97% tax relief.
3. That qualifying personal use vehicles valued at $20,001 or more shall only receive
64.97% tax relief on the first $20,000 of value.
4. That all other vehicles which do not meet the definition of "qualifying" (for example,
including but not limited to, business use vehicles, farm use vehicles, motor homes, etc.) will not
be eligible for any form of tax relief under this program.
5. That the percentages applied to the categories of qualifying personal use vehicles
are estimated fully to use all available PPTRA funds allocated to the City of Roanoke by the
Commonwealth of Virginia.

Adoption of Tax Year 2011 Personal Property Tax Relief Percentage
Background:
The Personal Property Tax Relief Act (PPTRA) provides relief to owners of personal use
motor vehicles state wide. City Council adopted components of the amended Act in
October 2005. The City uses the "Specific Relief" method to allocate the relief at the
same percentage across the board to the first $20,000 of personal vehicle value.
Vehicles valued at $1,000 and below are exempt from taxation.
Consideration:
City Council is required by the Commonwealth to annually adopt a resolution setting the
percentage reduction in personal property for that year. City staff computed the
effective reimbursement rate using the PPTRA Allocation Model, developed by a working
group of local officials and used across the Commonwealth. The percentage reduction
is calculated to distribute the $8,075,992 block grant allocation from the
Commonwealth in the manner described above. The allocation model applies a five
year average of personal property data to the vehicle levy from the last prior year.
When the prior year levy and the calculated averages increase, as is the case this year,
the relief percentage decreases. In effect since there is a fixed grant amount, the lower
the average levy, the larger share each taxpayer receives.
The rate as computed for tax year 2011 is 64.97%, down from the 2010 rate of 67.23%.
Recommended Action:
Adopt the attached resolution which establishes the percentage reduction for
personal property tax relief at 64.97% for the City of Roanoke for the 2011 tax

Background:
As the result of official School Board action at its March 21 st meeting, the Board respectfully
requested that City Council appropriate funding as outlined in this report.
The Mentor Teacher Program for Hard-to-Staff Schools grant of $11 ,142 provides funding to
support the division in enhancing the mentor teacher program in designated schools.
Funding is provided based on the number of teachers with zero years experience in the
, designated Hard-to-Staff Schools. The program is 100% funded by state funds and will end
June 30, 2011.
The Title I School Improvement 1 003(a) program grant provides federal funds of $13,350 to
aid the division in efforts to increase student learning at low-performing schools. The
program also will help fund the opportunity for students to choose a higher-performing
school as an alternative. The School Improvement 1 003(a) fund grants were originally made
to Addison Middle School and Hurt Park and Round Hill Elementary Schools. The revised
additional amount reflects the additional award received for Lincoln Terrace Elementary. The
program will be fully reimbursed by federal funds and will end September 30, 2011.
The Title I School Improvement 1003 (g) grant will use federal funds of $179,167 to aid the
division in its effort to increase student learning at low-performing schools. The program
also will help fund the opportunity for students to choose a higher-performing school as an
alternative. The School Improvement 1003(g) award was revised to include funding for
Fleming High School. The original award included support for Addison Middle School and
Hurt Park Elementary School. The program will be fully reimbursed by federal funds and will
end September 30,2013.
Recommended Action:
We recommend that you concur with this report of the School Board and adopt the attached
budget ordinance to establish revenue estimates and to appropriate funding as outlined.

Acceptance of the Huff Lane Elementary School Property
Backg rou nd:
Pursuant to the joint policy of the City and the School Board entitled "Use of
City-Owned Property by School Board", on February 8, 2011 the School Board
adopted a Resolution declaring that the Huff Lane Elementary School property
was no longer needed for school purposes. The policy requires the City
Council, if it desires to accept such property, to then act to accept the property
and release it from being used for school purposes within sixty (60) days of the
School Board's action.
Considerations:
Acceptance of the property from the School Board will allow the City to
undertake appropriate steps for the consideration of the reuse and/or
disposition of the property.
Recommended Action:
Adopt a Resolution accepting the Huff Lane Elementary School property from
the School Board, and direct the City Manager to undertake such follow-up
actions as contained in Section V(E) Inspection of the Policy.

2011 VIRGINIA INDEX OF PERFORMANCE AWARDS
(VIP)
Governor McDonnell and the Board of Education announced on
Thursday, January 13, 2011 that 728 schools and nine school
divisions earned 2011 Virginia Index of Performance awards for
advanced learning and achievement. The incentive program, which
was created by the Board of Education in 2007, recognizes schools
and divisions that achieve excellence goals and far exceed minimum
state and federal accountability standards.
Crystal Spring Elementary and Grandin Court Elementary were two of
the 323 schools to earn the Board of Education Excellence Award,
the second-tier honor in the VIP program. These schools and
divisions also have met all state and federal accountability
benchmarks for at least two consecutive years and have made
significant progress toward goals for increased student achievement
and expanded educational opportunities set by the board.
Preston Park was one of 289 schools that earned the Board of
Education Competence to Excellence Award for having met all state
and federal benchmarks for at least two consecutive years and are
making progress toward the goals of the Governor and the Board of
Education.
ROANOKE'S FIRST YOUTH NEIGHBORHOOD ORGANIZATION
Nine youth from Roanoke attended the Virginia Statewide Neighborhood
Conference with the assistance of Roanoke Schools in Chesterfield, Virginia,
in 2009. Upon their return, they decided to establish a youth group.
Because of their enthusiasm they were asked to help plan the youth
workshops for the 2010 conference. (nYouth Cafen a component of the
conference) which was held here in Roanoke last year. After the conference
the group organized and are now being sponsored by the Melrose/Rugby
Neighborhood Forum where Estelle McCadden is the President of the
neighborhood organization. Thus, we now have Roanoke's first Youth
Neighborhood Organization.
Some of the projects planned are: plant a small garden and sell the produce
from it, have a fun day in June 2011 and have the neighborhood organizations
of the city send youth representatives to learn how to organize a group ~
their area.

Intersection Improvements
VDOT Project UOOO-128-132
Background:
The Virginia Department of Transportation (VDOT) has programmed an
intersection improvement project at the intersection of Riverland Road,
Bennington Street, and Mount Pleasant Boulevard. The project is currently in
the right of way acquisition phase with construction scheduled for the summer
of 2012.
Considerations:
The City of Roanoke owns two parcels of land which will be affected by the
proposed improvements. More specifically, these parcels include tax parcel
4250203, on which Fire Station No. 11 (Bennington Street, S.E.) is located, and
tax parcel 4350701, on which a portion of the Roanoke .River Greer)way exists.
A portion of the Fire Station property, tax parcel 4250203, is to be acquired by
VDOT as right of way to support the project. This area, of variable length and
width totaling 13,591 square feet, more or less, to be conveyed in fee simple,
includes property across the front of the Fire Station parcel immediately
adjacent to the intersection and will accommodate the construction of curb,
gutter, and sidewalk. Also, on the Fire Station parcel, the City is asked to
provide:
. a temporary construction easement to VDOT, of variable length and
width totaling 27,619 square feet, more or less, to accommodate
reconstruction of the entrances to the station and construction of
drainage improvements,
. a permanent drainage easement to VDOT, of variable length and width
totaling 9,851 square feet, more or less, to permit future maintenance
activities on the prqposed drainage improvements,
· a permanent utility easement to Verizon, of variable length and width
totaling 11,720 square feet, more or less, to permit relocation and
future maintenance of above ground and underground utilities owned
by Verizon, and
· a permanent utility easement to' Appalachian' Power Company, of
variable length and width totaling 3,920 square feet, more or less, to .
permit relocation and future maintenance of above ground and
underground utilities owned by Appalachian Power Company.
The project will not affect the physical location of the Fire Station and
appropriate measu res will be incorporated to maintain access for fire apparatus
both during and after construction.
On tax parcel 4350701, on which the Greenway is located, the City is asked to
provide only a temporary construction easement, of variable length and width
totaling 8,306 square feet, more or less, to accommodate construction of the
project. Any disru ption of the use of the Greenway will be carefully coordinated
with the City to minimize inconvenience to Greenway users. Any work that may
preclude use of the Greenway will be done at night when the Greenway is
closed.
The City Manager, with Council's concurrence, has previously indicated to
VDOT (letter dated October 29, 2009) that the City would dedicate any. City-
owned property required for right of way purposes. Further, no compensation
is expected for any City-owned property requ ired for easement pu rposes.
City Council held a public hearing at its March 21,2011 meeting, at which time,
an opportunity was provided for public comment on the proposed conveyance.
Recommended Action:
Authorize the execution of the appropriate acquisition documents by the City
Manager, such documents to be approved as to form by the City Attorney.

Roanoke City Council
Thank the Planning Department Chris Chittum, Tom Carr, Daniel Dart
(Parks and Rec). Mr. Chittum came to two of our neighborhood
meetings and has been very responsive.
Thank the Planning Commission for their efforts over the last six
months. They engage the neighbors who attended every work
session.
A special thanks to Rick Williams for coming to one of our meetings
and taking a second look around the property on his own. AND for
putting up with my YouTube clips and all the other material I
inundated him with.
It was a true interactive partnership that if followed five years ago
would have save a lot of heartache.
I strongly recommend this inexpensive process for all future projects.
The expertise in the Planning Department is underrated.
There are several important items I'd like to bring to your attention
and consideration.
The most important is certainty of the plan. The Planning Commission
agreed at their Thursday meeting to strike any leasing of the
designated green space for lease or future sale. The portion on
Portland designated for urban agriculture is an exception.
Page 14 shows a good picture for passive natural area is preferred
with the anticipated greenway feeder trails. Page 15 showing
vineyards and orchards is not practical in the residential
neighborhood.
Our neighborhood strongly requests that you consider the $1.5 million
in Parks and Rec be used for the "greening" of the Countryside
property. As the Planning Commission agreed it would spruce
up/clean up the dilapidated look of the property since the golf course
closed. I understand from the March 7 briefing that the City Manager
recommends this investment.
Not only will it improve the economic outlook of the property but also
it will go a long way in healing the wounds the neighborhood has
endured over the last five years.
In addition we would like to be included on the evaluation team as
detailed on page 25. One or two neighbors associated with their
particular area. I feel sure something can be worked out to include a
member of the neighborhood. We don't care who the responder is
just what they are proposing.
I'm speaking now for the Countryside Drive neighbors. Their property
is the most effected. Their backyards are limited by an alleyway/right
of way so they have very little usable space in their back yards. Their
front yard view of the tenth fairway compensated for that. I am asking
for them that you consider leaving the 10th fairway void of
development.
As far as the immediate future. Spring is coming and the fairway
grass is growing again. We ask that you please consider mowing the
center portions of the 10th, 11 th 12th fairway. The 50-foot mowing
around the homes still leaves the unsightly middle. With the large
mowers already there it would take little time and effort to finish up
the center portions where residential homes reside.
I also ask that the cement barricades be removed from the cart paths.
That would leave only the barricades at the entrance and pavilion.
The barricades removed on Mattaponi have not caused a problem.
All people do is walk around the cart path barriers anyway.
Yes we miss the golf course and to some there will be nothing that
will every replace it. When it was closed we knew it was the end.
Again it would go a long way if the greenway feeder trails and natural
areas would be address sooner then later.

RE: Disposition of Huff Lane Park Property
We the Dorchester Court Neighborhood Association (herein the "Association") would like the Honorable
City Council Members and the City of Roanoke (herein the "City') to consider our opinion in the
Disposition ofthe Huff Lane Park Property, (herein the "Park"). Thank you in advance for your attention
to this matter. We think there are a lot of things that we agree upon and one of them is that for the
future of our children, the City needs more Parks and Recreation. Once the land is sold off, we cannot
return to a Park-that is gone forever.
The Association feels that the Park is not a Fund Raiser for Round Hill School. The Park is an entity unto
itself for future generations of children. Once the Park is leveled, the entire Park should be dedicated as
this was the Grantor's wishes. The issue is not the school, but the greater good, and that is the land for
the entire community-especially the children. We have a large tax base to pay for schools, a food tax
and many other resources to pay for Round Hill School. Don't hold the Park Ransom for Round Hill.
In addition, it is not practical to invade the neighborhood or to eliminate any section of the park or to
break the barrier of Valley View mall as proposed by Court Rosen to the Association at our meeting. As
it stands now, the property is land-locked and it should remain so. If any building is placed on the
property it should be accessible only by a few cars or by foot, like rest rooms, or picnic shelters, or a
concession stand for the ball park. In other words, the scheme of the land would be suitable for
Recreation only and the Association feels very strongly about that.
Mr. Court Rosen asked to enter a dialog about this at one other meeting and then the next meeting he
brought plans for a supposed hotel. This offended the Association because we didn't really feel like we
had a choice in the matter. We don't feel like anything commercial would be beneficial as it would add
traffic to the neighborhood and would further blight an already existing problem as evidenced by past
problems with buildings in the area. Further, we just do not think it is prudent to connect with Valley
View. A Hotel next to a Park is not proper. It just doesn't fit the scheme of things.
The Association feels like we need to look at this in a "Green" way. The Association would like a fitness
trail or a Recreation Center, perhaps a YMCA would not be out ofthe question. We need to dream big
here for our children's future. We don't need to "cut off the nose to spite the face," because we don't
need any more hotels or shops as evidenced by the decline in the economy and the closing of
Crossroads and Tanglewood stores, and dozens of strip malls. Even Valley View property is turning over
weekly. What happens when a motel or other store doesn't pan out and the next owner isn't thinking
green and wants to pave the whole lot? What could the Association do then?
The Association remains confident that the City will do what is best for the Association AND for Round
Hill School in the long run, which is to make a Park out of the ENTIRE lot. This is more futuristic thinking
and is a real "WIN" for everyone. The Association feels that building more commercial property is a
losing proposition for everyone, especially Mother Nature. We need more Parks, especially within the
City proper. Let's continue to work on what we agree upon. Thank you.
