2. PRESENTATIONS AND ACKNOWLEDGEMENTS:
Recognition of Roanoke Valley Television (RVTV) in receipt of the Award of
Distinction in the 17th Annual Communicator Awards. The Mayor recognized
Elaine Bays-Murphy, Director of Cable Access and Melinda Mayo, City
Public Information Officer.
3. HEARING OF CITIZENS UPON PUBLIC MATTERS:
CITY COUNCIL SETS THIS TIME AS A PRIORITY FOR CITIZENS TO BE
HEARD. ALL MATTERS WILL BE REFERRED TO THE CITY MANAGER FOR
RESPONSE, RECOMMENDATION OR REPORT TO COUNCIL AS HE MAY
DEEM APPROPRIATE.

CONSENT AGENDA

ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE
CONSIDERED TO BE ROUTINE BY THE MEMBERS OF CITY COUNCIL AND

SEPARATELY. The Mayor called attention to one public hearing request
for July 18 at 7:00 p.m., from the City Manager.

C-1 A communication from the City Manager requesting that Council schedule
a public hearing for Monday, July 18, 2011, at 7:00 p.m., or as soon thereafter as
the matter may be heard, to consider a request from Kuumba Community Health
and Wellness Center, Inc., d/b/a New Horizons Healthcare, a non-stock, not for
profit corporation, for tax exemption of personal property in the City located at
4910 Valley View Boulevard, N. W., Suite 310.
RECOMMENDED ACTION: Concurred in the request.
C-2 Reports of qualification of the following individuals:
The Honorable David A Bowers as a City representative (elected
official) of the Roanoke Valley-Alleghany Regional Commission for
a three-year term of office ending June 30, 2014;
Dustin R. Akers as a member of the Roanoke Neighborhood
Advocates to fill the unexpired term of Christina Brannan ending
June 30, 2012; and

Ahondryea Brooks as a member of the Mill Mountain Advisory
Committee for a three-year term of office ending June 30, 2014.
RECOMMENDED ACTION: Received and filed.

a. Presentation of the Leadership Building Program from the West End
Center for Youth. Becca Parrish, Office Manager, Spokesperson.

The West End Center youth demonstrated a leadership building
exercise.
7. REPORTS OF CITY OFFICERS AND COMMENTS OF
CITY MANAGER:
a. CITY MANAGER:
BRIEFINGS: NONE.
ITEMS RECOMMENDED FOR ACTION:
1. Acceptance and appropriation of funds for the FY 2010 State
Homeland Security Program Grant from Virginia Department of
Emergency Management to be used by the Fire/EMS Department
for HAZMAT Team equipment and training.
Adopted Resolution No. 39151-070511 and Budget Ordinance
39152 on first reading (4-0, Vice-Mayor Trinkle and Council
Members Bestpitch and Lea were absent.)
2. Acceptance and appropriation of funds from the Virginia
Department of Health to provide for the nutritional needs of children
and youth during the summer months through a Parks and
Recreation supervised Summer Nutrition Program.
Adopted Resolution No. 39153-070511 and Budget Ordinance
39154 on first reading (4-0, Vice-Mayor Trinkle and Council
Members Bestpitch and Lea were absent.)

3. Acceptance of the Mill Mountain Garden Club's donation of design
services, materials and labor necessary to develop an outdoor
classroom for Mill Mountain Park.
Adopted Resolution No. 39155-070511 (4-0).
4. Execution of a Letter Agreement between the City of Roanoke and
611 Jefferson, LLC, for access to parking permits for the Patrick
Henry Hotel Project and determination of the project's necessity
and appropriateness for the revitalization of Census Tract Eleven.
Adopted Resolution No. 39156-070511 (4-0).
COMMENTS BY CITY MANAGER.
Mr. Morrill announced that the SmartWay Connector Bus to the Lynchburg
Amtrak Station would begin on July 19, Valley Metro will offer a one-way
fare of $4.00, with a stop in Bedford, adding that the City will provide free
parking in the Roanoke Civic Center Parking lot for commuters. He also
mentioned that the recent storm event resulted in over 250 calls to the
E-911 Center, mostly to report power outages. He indicated that citizens
should call AEP at 1-800-956-4237 to report power outages.
The City Manager remarked that the City was looking for additional crews
to assist with brush pick up which was a result from the thunderstorm on
Monday, July 4. In closing, he mentioned that the Adopted Resource
Allocation Plan for Fiscal Year 2011-2012 was available online at
www.roanokeva.aov.

9. UNFINISHED BUSINESS:
a. Continuation of the matter with regard to an amendment of Section 21-81,
Discharqe of air qun, qravel shooter. pneumatic qun, etc., Code of the City
of Roanoke (1979), as amended, to prohibit the City of Roanoke from
enforcing an ordinance that prohibits the shooting of pneumatic guns on
private property, with permission of the owner of the property, if
reasonable care is taken to prevent a projectile from crossing the bounds
of the property, effective July 1, 2011. (Matter was tabled at the June 20,
2011 Council Meeting.) Matter was removed from the table for
reconsideration (4-0). Ordinance No. 39157 was adopted on first
reading (4-0, Vice-Mayor Trinkle and Council Members Bestpitch and
Lea werE! absent.) Adopted Resolution No. 39158-070511 (4-0).

The following individuals were reappointed/appointed by the Council:
Felicia Journiette was appointed as a member of the Roanoke
Neighborhood Advocates for a three-year term of office ending June 30,
2014.
Daniel Karnes was reappointed as a Commissioner of the City of Roanoke
Redevelopment and Housing Authority for a four-year term of office ending
August 31,2015.
Brownie E. Polly and Thomas Pettigrew were reappointed as members of
the Roanoke Civic Center Commission for three-year terms of office, each,
ending September 30,2014.
Adopted Resolution No. 39159-070511 appointing Richard Willis as School
Board Trustee to fill the unexpired term of Jason Bingham, commencing
July 5, 2011 through June 30, 2012.

A RESOLUTION establishing a meeting schedule for City Council for the Fiscal Year
commencing July 1,2011, and terniinating June 30, 2012.
BE IT RESOLVED by the Council of the City of Roanoke as follows:
1. This resolution establishes a schedule of regular meetings for City Council for the
Fiscal Year commencing July 1,2011, and terminating June 30, 2012.
2. For such fiscal year, City Council shall hold regular meetings on the first and third
Mondays of each month, at the following times of commencement:
(a) Unless otherwise provided by resolution of Council, each regular
meeting on the first Monday in each month shall commence at 9:00 a.m, for the
conduct of informal meetings, work sessions, or closed meetings. Thereafter,
Council shall take up the regular agenda at 2:00 p.m. Council may recess between
the 9:00 a,m, session and the 2:00 p,m. session.
(b) Unless otherwise provided by resolution of Council, each regular
meeting on the third Monday in each month shall commence at 2:00 p,m, for the
conduct of regular business. The second meeting of each month shall be recessed
upon the completion of all business except the conduct of public hearings, and such
meeting shall be reconvened at 7:00 p.m, on the same day for the conduct of public
hearings.
3, With regard to the regular meetings scheduled to be held on the first Monday of each
month, inasmuch as City officials and Council members will be attending the Virginia Municipal

be posted adjacent to the door of the Council Chambers and inserted in a newspaper having general
circulation in the City at least seven days prior to the date of the meeting at such amended day, time

Virginia Department of Emergency Management HAZMAT Grant
Acceptance
Background:
Roanoke Fire-EMS serves as the region's Hazardous Materials Team. The
Virginia Department of Emergency Management (VDEM) allocates funds each
year to regional HAZMAT Teams for related expenses. This year, the funding
allocated will be used for HAZMAT Team Equipment and Training.
On June 6, 2011, VDEM awarded the City of Roanoke funding in the amount of
$30,000 from the FY 2010 State Homeland Security Program Grant: HAZMAT
Team Equipment and Training from the National Preparedness Directorate,
United States Department of Homeland Security and administered by the
Commonwealth. This grant requires no matching funds from the City.
Considerations:
City Council action is needed to formally accept and appropriate these funds,
and authorize the Director of Finance to establish a revenue estimate and
appropriate funds to purchase the equipment and supplies in accordance with
provisions of this grant.
Recommended Action:
Adopt the accompanying resolution accepting the grant as described above and
authorizing the City Manager to execute any required grant agreements or
documents, such to be approved as to form by the City Attorney.
Adopt the accompanying budget ordinance to establish a revenue estimate in
the Grant Fund in the amount of $30,000 and appropriate funding in the same
amount to an expenditure account to be established by the .Qirector of Finance.

Summer Food Program
Background:
The City of Roanoke continues to provide for the nutritional needs of children and
youth during the summer months through a Parks and Recreation supervised
Summer Nutrition Program. Breakfast and lunch are provided to children
throughout Roanoke from mid-June through mid-August. An estimated 40,000
meals will be served this summer.
Federal funds, up to $175,000, have been awarded to the City by a grant from the
Virginia Department of Health. The City is reimbursed on a per meal basis for
meals actually served.
Considerations:
The Summer Food Program is partially funded through the United States
Department of Agriculture, Food and Nutrition Service with the Virginia Department
of Health serving as the sponsoring agency in Virginia. The program is similar in
concept to the National School Lunch Program with eligibility requirements much
like those used to determine eligibility for free or reduced priced meals during the
school year. The purpose is to provide nutritionally balanced, healthy meals to
children, ages one through eighteen, and those with special needs.
Recommended Action:
Accept the Summer Food Program grant in the amount of $175,000 and authorize
the City Manager and City Clerk to execute and attest respectively, an agreement
with the Virginia Department of Health and any other forms necessary to accept
such grant, approved as to form by the City Attorney.
Adopt the accompanying budget ordinance to establish a revenue estimate in the
amount of $175,000 and appropriate funding in the same amount into an
ex it re account to be established in the Grant Fund by the Director of Finance.

Donation from the Mill Mountain Garden Club
Backg rou nd:
Mill Mountain Park draws visitors from all over the City as well as from the
Roanoke Valley and beyond because of the unique recreational opportunities it
offers. These include panoramic views of the City and surrounding valley from its
summit; the Roanoke Star, a national landmark and symbol of civic identity for the
City; Mill Mountain Zoo; the Discovery Center, which offers a variety of family-
oriented environmental education programs; and hiking and biking trails that are
easily accessed by greenways from both the City and the Blue Ridge Parkway.
Considerations:
Located between the Discovery Center and the Mill Mountain Zoo lies the park's
Wildflower Garden, an outdoor educational and interpretive feature sponsored and
managed by the Mill Mountain Garden Club. While the area currently contains
many unique species of trees, grasses, and woody plants, the Garden Club would
like to establish a small outdoor classroom. To enhance Mill Mountain's
educational opportunities for both adults and children alike, the Garden Club
proposes to donate the design, materials, and labor necessary to develop the
outdoor classroom; a value of approximately $16,400. The Outdoor Classroom
will be composed of a series of low seating walls oriented around a center area for
display and presentation as shown in the attached illustrations. Parks and
Recreation staff would assist the Garden Club by providing earthwork and project
management functions.
Recommended Action:
Authorize the Office of the City Manager to accept the Mill Mountain Garden
Club's donation of design services, materials and labor nec~ssary to develop an
outdoor classroom for Mill Mountain Park.

Authorization for a Letter Agreement for Access to Parking Permits
for the Patrick Henry Hotel Project and Determination of the
Project's Necessity and Appropriateness for the Revitalization of
Census Tract Eleven
Background:
The renovation of the former Patrick Henry Hotel at 611 Jefferson Street, S.W.,
is a significant project for the 10r:Jg term growth and vitality of downtown
Roanoke. The $20 Million renovation project of this long vacant structure will
result in 132 new apartment dwellings and over 26,000 square feet of
additional active commercial and retail/restaurant space on one of Roanoke's
most important corridors, Jefferson Street. The project's permanent financing
is being undertaken through the Virginia Housing Development Authority
(VHDA). In order to facilitate this financing, VHDA has requested that the
developer of the project, 611 Jefferson, LLC, obtain access to off-street parking
in support of the project's 132 dwelling units during the term of the VHDA
permanent financing commitment, which is thirty years. In addition, VHDA
requires, as part of its financing due diligence, a determination by the City
Council that the nonhousing component of this mixed use development is
necessary and appropriate for the revitalization and for the continued
commercial and economic development of the Census Tract within which the
project is located, which is Census Tract Eleven (11).
Considerations:
A Letter of Agreement, a copy of which is attached to this report, dated July 6,
2011, has been developed that is acceptable to 611 Jefferson, LLC, and VHDA.
The Agreement contains the terms and conditions under which 140 parking
permits will be made available in the City's downtown parking system to
residents of the Patrick Henry ,^,ho ch90se to obtain parking from the City. The
parking permits would be m.ade available to residents upon request during the
term of the Agreement at the then current applicable posted residential parking
rate as established by the City Cou ncil. Residents of the Patrick Henry who
wish to obtain parking permits under this Agreement will be subject to all of
the terms and conditions to which all other residential parking customers in the
City's parking system must comply. The availability of parking permits in any
specific parking garage or lot will be at the sole discretion of the City parking
administration, but the City will use reasonable efforts to place customers in
parking facilities in closest proximity to the Patrick Henry.

The Agreement also provides for conditions under which the City could
terminate the Agreement, including certain reductions in the size of the City's
parking system during the Agreement's term; in the event of non-appropriation
of funds to operate the parking system; and upon certain reductions to the
number of, or cessation of the use of, the residential units in the Patrick Henry
project du ring the term of the Agreement.
The City's role in facilitating, supporting, and sustaining the long term
revitalization of this significant historic landmark structure located along the
Jefferson Street corridor is a key component of the goal of maintaining
downtown Roanoke as the center of the region. The Patrick Henry project also
supports the City's efforts to expand housing choices in downtown and adds to
the expansion of commercial and retail opportunities along a corridor which
links the core of downtown to the emerging medical and research campus at
the Riverside Center immediately to the south.
Therefore, the City Council should make the determination that the nonhousing
portions of this project are necessary and appropriate for the revitalization of
Census Tract Eleven (11), and will facilitate and support the continued
commercial and economic development of the tract, as required by the VHDA.
Recommended Action:
Approve the terms of the Letter Agreement between the City and 611 Jefferson, I
LLC, as set forth in the attachment to this report, and determine that the "
non housing portions of this project are necessary and appropriate for the
revitalization and for the continued commercial and economic development of
Census Tract Eleven (11 ).
Authorize the City Manager to execute any necessary documents, provide
additional information, and to take any necessary actions to advise the VHDA of
Council's determination set forth above and/or document such determination.
Authorize the City Manager to execute a Letter Agreement between the City and

Re: Letter Agreement
Dear Mr. Walker:
The City of Roanoke owns, operates, and manages a public parking
system in its downtown which is currently comprised of seven parking
garages and six off-street parking lots which contain a total of
approximately four thous~nd one hundred (4,100) parking spaces. This
is a letter agreement (the "Agreement") between the City of Roanoke,
Virginia (the "City") and 611 Jefferson, LLC (the "Company"), its
successors and assigns, that provides, to the extent permitted bylaw,
access to public parking for individual residents of residential dwelling
units (as defined in Appendix A. Definitions of Section 36.2 Zoning, of
the Code of the City of Roanoke, 1979, as amended) to be located in the
former Patrick Henry Hotel mixed use project located in downtown
Roanoke, at 611 Jefferson -Street, S.W., which is being developed by the
Company. The City agrees to make available for such residents a total of
140 parking permits for use in off-street parking garage or parking lot
facilities that the City owns, operates, and manages under the following
terms and conditions:
1. The determination of availability of Rarking permits in any
specific parking garage or parking lot owned, operated, and
managed by the City will' be at the City's sole discretion,
provided the City will use reasonable efforts to make parking
available to the residents at facilities closest in proximity to the
Patrick Henry Hotel.
2. The parking permits will be made available to residents of the
Patrick Henry facility during the term of this Agreement at the
then current applicable posted residential parking rate, or other
applicable rate, established and as modified from time to time
by the City Council of the City of Roanoke. All such parking
permits for residents who qualify shall be subject to the terms
and conditions of any application and/or agreement documents
that other residential parking patrons are subject to, as well as
any other requirements for such permits that may be
promulgated from time to time by the City Manager or City
Council for the use of such permits. Currently, qualified
residents of the Central Business District, as defined in
Resolution No. 39104-050911, may apply for monthly
residential parking permits at rates varying from $8.75 tol
$17.50 per permit per month.
3. The City will make available a total of 140 parking permits for
such residents in the Patrick Henry fadlity for the duration of
the project's original thirty (30) year financing term with the
Virginia Housing and Development Authority ("VHDA"). The
(ity acknowledges and agrees this Agreement may be assigned,
in its entirety but not in part, to VHDA or a successor owner of
the Patrick Henry Hotel during the term of this Agreement, but
under no circumstances shall the term of this Agreement
exceed a total of 30 years from the date of the original closing
on the VHDA financing agreement. Notwithstanding anything
in this paragraph to the contrary, this Agreement shall
terminate if the Company refinances its loan with VHDA with
another lender.
4. The City's obligations under this Agreement to provide access
as set forth above to such parking permits is specifically subject
to the following conditions:
a. The availability of funds and the appropriation of such \,
funds by the City Council as may be necessary to
operate and manage the City's parking garages and
lots.
b. The City maintaining ownership, operation, and
management of parking garages and lots through the
duration of the agreement; provided if more than
2,500 of the parking spaces currently managed by the
City are sold or transferred to a single third party (or
more than one party if part of a single transaction or
series of transactions to individuals or entities having a
common control group) during the term of this
Agreement then this Agreement shall be binding on
such successor. Except as provided in the preceding
sentence, should the total number of parking spaces in
such facilities fall below one thousand (1,000) during
the term of this Agreement, this Agreement may be
terminated by the City in its sole discretion.
c. If more than twenty five percent (25%) of the residential
dwelling units i~ Patrick Henry facility are no longer
used as active residential dwelling units during the
term of this Agreement, or if the Patrick Henry Hotel
shall close or cease operation of the residential
dwelling units in their entirety for any consecutive
twelve (12) month period, this Agreement may be
terminated by the City in its sole discretion.
d. In the event of a breach by the City under the terms of
this Agreement, the Company, its successors and/or
assigns, shall give written notice to the City setting
forth the nature of the breach and the City shall have
thirty (30) days following receipt of the notice to cure
the breach, provided that if the cure cannot be
reasonably completed within thirty (30) days following
the City's receipt of written notice the City shall be
granted additional time to cure the same provided it
diligently proceeds to do so. All notices to the City
shall be sent via overnight delivery or certified mail,
return receipt requested to: City Manager, City of
Roanoke, 215 Church Avenue, S.W., Suite 364,
Roanoke, VA 24011. Should the City fail to cure any
default within the time period set forth in the
preceding sentence, the City shall be deemed in
default, of this Agreement and the Company may
exercise all rights and remedies available to it under
Virginia law, provided the City's liability, if any, shall be
limited to an amount not.to exceed the lesser of (i) the
actual cost of any excess amount that it would cost the
Company to provide such parking permits over what
the City would have charged to provide such parking
permits or (ii) an amount not to exceed a total of
$100,000.
e. The City shall not be liable for its inability to perform
its obligations under this Agreement by reason of
strikes, lock-outs, casualties, acts of God, labor
troubles, failure of power, governmental laws or
regulations, riots, insurrection, war or other causes
beyond the reasonable control of the City.
5. The Company shall indemnify and hold harmless the City, its
Parking Management Company (if any), and their officers,
agents, and employees against any and all liability, losses,
damages, claims, causes of action, suits of any nature, costs,
and expenses, including reasonable attorney's fees, resulting
from or arising out of the Company's, its assignees, or their
employees, agents, or subcontractors actions, activities, or
omissions, negligent or otherwise, on or near the City's

property or the area where any services are to be provided, or
arising in any way out of or resulting from any of the matters or
items involved in or covered by this Agreement, and this
includes, without limitation, any fines or penalties, violations of
federal, state, or local laws or regulations, personal injury,
wrongful death, or property damage claims or suits.
If the Company agrees to the terms and provisions set forth herein,
please have an authorized representative sign and return to me the
original of this letter. Thank you for your cooperation in this matter.

Subject: May Financial Report - City of Roanoke
The following financial report provides commentary on the City's financial results for the
first eleven months of this fiscal year. .
General Fund revenues through May of FY11 are 1.9% or $4,231,000 above last year as
presented in the accompanying financial statement. Real Estate Tax collections through
May have increased 0,9% compared with last year. The City achieved the real estate
estimate for FY11, Sales tax revenue increased 2.4% in FY11 through May when
compared to FY10. This important revenue continues to improve as economic recovery
occurs. Other local taxes, such as Utility Consumer, Transient Occupancy, Motor Vehicle
License and Telecommunications taxes have increased. The most notable impact to the
Other Local Tax category is the increase in the Prepared Food and Beverage Tax due to
the tax rate increase from 5% to 7%.
General Fund expenditures through May of FY11 are 3,3% or approximately $7.6 million
below FY10, largely driven by decreased costs in Judicial Administration, Public Safety,
Public Works, Health and Welfare, Parks, Recreation and: Cultural, Community
Development and Transfers to the Debt SeNice Fund. Education, the largest expenditure
category, grew 7.1 % based on an increase in City support to schools in order to offset
State funding reductions. Variances are discussed in greater detail in the expenditure
section of this narrative.

Revenues:
The current revenue budget for FY11 represents a 1.2% decline compared to the prior
year budget, The largest decrease was the Intergovernmental category. Commentaries on
significant variances are shown below.
General Property Taxes increased 1.7% or $1,737,000 compared to FY1 0 due to growth in
real estate assessments, most notably due to new construction, Personal property tax
revenue increased compared to FY1 0 as a result of increased billings for new vehicles and
is expected to end the year with an increase of 1.5%.
Other Local Taxes increased 9.6% or $5,381,000 compared to FY10. The main driver for
this large increase is the rate change in the Prepared Food and Beverage Tax. Adjusted
for the rate change impact, this category grew 2.8% or $1,693,000. Several of our local
taxes are trending higher than the prior year. Utility Consumer, Transient Occupancy and
Motor Vehicle License taxes have increased by 4.4%, 9.0% and 16.0%, respectively. The
increase in Utility Consumer tax is driven by an increase in water and electric
consumption when compared to FY10 where consumption was down. Transient
Occupancy tax has shown improvement since March 2010. Motor Vehicle License taxes
increased due to vehicle activities and collections through debt set off. Business in the
lodging industry, which is a function of occupancy and room rates, improved as the
economy stabilized, and collections of delinquent amounts have boosted current year
revenues, Some of our other local taxes declined in FY11 as a result of continued
economic challenges. Cigarette and recordation taxes have declined compared to last
fiscal year by 5.6% and 6.1 %, respectively, The cigarette tax continues to decline which is
consistent with the national trend in the number of smokers. Recordation taxes are
following trends in the real estate market where sales continue to be depressed.
Permits. Fees. and Licenses increased 17.8% or $134,000 compared to FY10. New
construction has increased, resulting in growth in permit revenues. Large building
permits obtained in FY11 include construction for the City Market Building, Brandon Oaks
Apartments, and others.
Fines and Forfeitures increased 12.7% or $197,000 compared to FY10 due to an increase
in General District court fines. Additionally, the parking ticket fee increased effective July
1, 2010, which aided in an increase in parking ticket revenue for FY11.
Revenue from the Use of Money and Property declined 43.1 % or $238,000 compared to
FY10. The loss of rental income from the Commonwealth Building was the largest factor
in this decline. The relocation of the Health Department from a City-owned building to
the Civic Mal/location also contributed to the decline in rental income.
Intergovernmental revenues decreased 5.3% or $2,711,000 compared to FY10 due
primarily to a timing difference in receipt of funds under HB599 for Law Enforcement.
This variance will be resolved in June FY11. Also contributing to the variance are
decreases in the Shared Expenses category, related to the Compensation Board. For

FY11, the Compensation Board cut funding for Constitutional Offices. Additionally, a
reduction of funding from the State for jail per diems contributes to the decrease.
Partially offsetting the variance is an increase in the Social Services category. Foster care
activities have increased significantly compared to FY1 O.
Miscellaneous revenues increased 20.8% or $114,000 compared to FY10 due primarily to
an increase in delinquent real estate tax sales proceeds in FY11.
Expenditures:
The current fiscal year 2011 General Fund expenditure budget totals $255.9 million and
represents a 1.4% or $3.6 million decrease from the May FY10 budget. Included in the
budget is funding of approximately $599,000 to cover contracts and purchase orders
made during fiscal year 2010 but not paid by the end of that year. All categories of the
FY11 General Fund budget are lower than in FY10 with the exception of the Transfer to
School Fund and Non-departmental, which fluctuates based on transfers to other funds
which are somewhat nonrecurring. Based on this, expenditure variances as discussed in
the following sections will focus on performance that varies from the budgeted
expectation.
General Government expenditures increased 1,9% or $209,000 compared to FY10
primarily due to a change in the allocation of technology maintenance contract costs in
FY11. Previously, costs were billed monthly through the Department of Technology to
the General Fund. Currently, contracts are fully obligated in the General Fund. By the
close of the fiscal year, the effect of this change will be zero,
Public Works expenditures were budgeted to decrease 6.8% from the FY10 budget.
Actual expenditures for FY11 decreased 10.4% or $2.4 million compared to FY10. The
expenditure variance is due primarily to a decrease in snow removal. In addition, this
category was impacted by a timing difference in contracting for paving planned for this
year. Also contributing to the variance is a decline in Solid Waste Management tipping
fees,
Transfers to Debt Service Fund declined 14.3% or $3.1 million from the prior year as of
May. The Series 1999A and 1999B bonds were paid off in FY1 O. In addition, the issuance
of Series 2010A and 2010C Refunding Bonds decreased the required funding of FY11
debt service for the City and Schools.
Nondepartmental expenditures increased 11.5% or $492,000, due to transfers to the
Capital Projects Fund for the Aviation Drive and Towne Square Boulevard Intersection
Improvement project. A decline in transfers to the Grant Fund partially offsets the
increase.

Civic Facilities Fund
For FYll year-to-date, the Civic Center has held 244 events with 247,033 attendees. This
was 10.6% or 29 less events, but 17.3% or 36,377 more attendees than for the same time
period of FYl 0, Event highlights for May included Cirque du Soleil, Beauty and the Beast,
which added a second show to meet demand, and a sold out James Taylor concert.
Cirque du Soleil was the highest revenue generating show in the 40-year history of the
Civic Center, grossing over $1,250,000 in ticket sales.
Global Spectrum's Net Operating Income for the month was $219,000, decreasing the
year-to-date combined Operating Loss to approximately $1,222,000. This is a $300,000
improvement compared to the total fund operating performance for the same eleven
month period in FY10, Global Spectrum's rolling forecast of operations continues to
project a larger loss than their adopted FYll budget, currently by $114,000. Provided
Global Spectrum's forecast holds true, their FYll performance would be approximately
30.4% or $235,000 better than their FYl 0 performance.
Parking Fund
The City's Parking Fund operates seven garages and six surface lots with a total FYll
budget of just over $3,0 million. While each facility generates varying levels of income or
loss, the Parking Fund as a whole meets all cash flow needs, including debt service,
without General Fund subsidy and generates working capital to fund facility
improvements and repairs.
The FY11 year-to-date operating revenues are up 5.9% or $145,000 compared to FYl O. A
revitalized Market Garage continues to lead the way, accounting for nearly two thirds of
the revenue increase. Elmwood Park Garage, Center in the Square Garage, and Church
Avenue Garage continue to exceed FY10 results. Tower Garage remains behind FY10,
displaying the poorest performance of all locations, relative to the previous fiscal year.
This is due to the loss of parkers from several large corporate customers. Gainsboro
Garage and Higher Education Center Lot also remain significantly behind last year in
revenues. The decline at these two locations is due to the elimination of paid parking for
employees by the Higher Education Center and increased street parking by students. In
all, nine facilities are ahead of FYl 0 revenues, three are behind FY10, and one is even.
Three of the garages have exceeded their total FYll revenue projections in only eleven
months. On .the expense side, spending levels are under those of FYl 0 in maintenance
and utilities. FYll Operating Income improved 49% or $245,000 compared to FYl O. This
is a function of a combination of 5.9% improvement in revenues coupled with a 5.1 %
decline in expenses. The increase in Interest Expense reflects the additional debt burden
incurred to renovate Market Garage, approximately $25,000 per month.
City of Roanoke Pension Plan
The Pension Trust Fund experienced an investment return of 27.1% for the fiscal year-to-
date through May 2011, led by strong performance in the domestic and international

equity allocations, as well as the convertible bond allocation. Investment performance for
this period was well ahead of the Policy Portfolio return benchmark of 23.5%.. For the
eleven month period ending May 31, 2011, Plan Net Assets increased $55.6 million. The
net increase is a result of $9.2 million in employer contributions and $72,9 million in net
investment gains offset by $26.5 million in benefit payments and Plan administrative
expenses. Benefits Paid to Participants increased 2.5% due to higher retirement
allowances having been earned by more recent retirees, while Administrative expenses
inclined modestly.
In closing, the national economy continues to improve as seen in the first quarter 2011
GDP growth of 1.8% and the seventh quarter of consecutive growth. Local tax revenue
results vary by tax, although the Total Local Tax Revenues are stable and showing
improvement. The unemployment rate remains a challenge to growth, however,
improvement of 1% from April of 2010 to 2011, 7.2% to 6.2% respectively, is a positive
sign. The housing market and commercial real estate markets remain depressed without
signs of improvement. As a result, real estate taxes remain a concern for the future. The
City has managed expenditures well for the first eleven months of FY11 and revenues
performed better than anticipated. As a result, budget revisions were made in early June
to utilize available resources in the current fiscal year. The City is in good overall

A RESOLUTION expressing City Council's extreme displeasure with State legislation
that became effective July 1, 2011, invalidating all local ordinances that prohibit the use of
pneumatic guns on or within private property with permission of the owner or legal possessor of
the property when conducted with "reasonable care to prevent a projectile from crossing the
bounds of the property," and calling for the repeal of such legislation.
WHEREAS, the City of Roanoke has prohibited since at least 1909 the discharge,
anywhere within the City, of air-guns and similar implements (Code of the City of Roanoke
1909, Sec. 399);
WHEREAS, by the enactment of SB 757 during the last seSSIOn of the General
Assembly, the General Assembly invalidated all existing local ordinances "that prohibit the use
of pneumatic guns in or within private property with permission of the owner or legal possessor
of the property when conducted with reasonable care to prevent a projectile from crossing the
bounds of the property;"
WHEREAS, the prohibition of the discharge of air-guns and similar pneumatic weapons
in the City is a prudent measure that helps ensure the public safety, health, and welfare,
especially given the City's high population density of over 2,200 persons per square mile, and the
narrowness and small size of many lots within the City;
WHEREAS~ pneumatic guns include rifles and pistols that fire .22 caliber pellets - the
same caliber as the smallest rifle caliber, and they reportedly have killing power at close range
and the ability to kill small animals at fifty yards;
WHEREAS, the "reasonable care" requirement enacted by the General Assembly works
only so long as a shooter doesn't miss the backstop that is intended to provide the reasonable
care;
WHEREAS, law enforcement officers are concerned that the resemblance of some
pneumatic weapons to even more lethal weapons will cause problems for officers responding to
calls, and having to make split-second decisions about how to respond appropriately;
THEREFORE, BE IT RESOLVED by the Council of the City of Roanoke that:
1. Council expresses its extreme displeasure at the enactment of the General
Assembly of Senate Bill 757.
2, Council calls upon the General Assembly to repeal Chapter 832 of the Virginia
Acts of Assembly, 2011 Reconvened Session, which enacted Senate Bill 757.
3. The City Clerk is directed to send attested copies of this Resolution to the
Governor and to all members ofthe General Assembly,

At its June 20, meeting, Council tabled a proposed ordinance that would amend Section 21-81,
Discharge of air guns. gravel shooters. pneumatic guns. etc" of the City Code in order to conform it with
changes in State law effective July 1, 2011. As drafted, that ordinance provided for dispensing with the
second reading of the ordinance by title, which would have required the affirmative vote of five members of
Council. Since it is anticipated that only four members of council will be present at Councils July 5
meeting, I have revised the ordinance to delete the'tlispensing with the second reading' provision, so that the
ordinance may be adopted on first reading by the affirmative vote of four members of Council. The revised
ordinance is enclosed.
As requested, I have also prepared and enclose for your consideration a resolution expressing Councifs
displeasure at the adoption of the amendment in State enabling legislation, and requesting that it be
repealed,
