Neighborhood Advocates for a three-year term of office ending June 30, 2014;
and King Tower as a member of the Roanoke Public Library Board for a
three:"year term of office ending June 30, 2014.

REGULAR AGENDA
5. PUBLIC HEARINGS:
a. Proposal of the City of Roanoke to grant an above ground utility
easement, with an approximate width of 15 feet, across City-owned
property located on Blue Hills Drive, N. E., and part of the Roanoke Centre
for Industry and Technology, to Appalachian Power Company, in order for
Appalachian Power Company to install support structures and related
cable/wires to transmit electric power to serve an adjoining privately
owned parcel of real estate. Christopher P. Morrill, City Manager.

CITY MANAGER:
a. CITY MANAGER:
BRIEFINGS: NONE.
ITEMS RECOMMENDED FOR ACTION:
1. Acceptance and transfer/appropriation of funds in connection with a
Criminal Justice System Improvement Grant from the Virginia
Department of Criminal Justice Services (DCJS) to purchase
mobile computer terminal mounts to be deployed in police vehicles.
Adopted Resolution No. 39174-080111 and Budget Ordinance
No. 39175-080111 (5-0).
2. Approval and execution of a Program Agreement between the City
of Roanoke and Coca Cola Bottling Company Consolidated
Operations, LLC, endorsing the City's participation in a "Recycle
and Win!" Program. Adopted Ordinance No. 39176-080111 (5-0).
COMMENTS BY CITY MANAGER.
The City Manager advised that the mosaics at the entrances to the Market
Building had been completed and citizens were welcome to take a look at
them. He further advised that the pedestrian bridge had received a new
coat of paint and a solid surface floor had been installed.
The City Manager advised that the Smartway Connector bus had 43
passengers on its inaugural run and it had been averaging 18 passengers
per day to the Lynchburg Amtrak Station and 15 passengers per day on
the return trip.
Mr. Morrill commended the Fire/EMS Department for their work at several
fires over the previous weekend and for helping barricade roads and
divert traffic after the recent large rain events.
Mayor Bowers inquired if the Smartway Connector had started running
from Blacksburg; whereupon, the City Manager informed that the
Smartway Connector originates from Blacksburg on Friday, Saturday and
Sundays. The Mayor further inquired as to what would happen if there
were more riders than capacity on the bus. The City Manager explained
that there was an agreement with the Lynchburg Bus Company to provide
buses in overflow situations.

The Mayor questioned when the Market Building would open. The City
Manager informed that the first event to be held in the newly renovated
Market Building would be the State of the City Address on August 25. He
further informed that the Market Building would be open Labor Day
weekend with a ribbon cutting ceremony on that Saturday.

10. INTRODUCTION AND CONSIDERATION OF
ORDINANCES AND RESOLUTIONS:
a. Ordinance No. 39167, on second reading, appropriating funds for various
educational programs. Adopted Budget Ordinance No. 39167-080111
(5-0 ).
b. Ordinance No. 39168, on second reading, appropriating funds for various
school capital projects. Adopted Budget Ordinance No. 39168-080111
(5-0 ).
c. Ordinance No. 39170, on second reading, designating Kuumba
Community Health and Wellness Center, Inc., d/b/a New Horizons
Healthcare, as a charitable organization and exempting from personal
property taxation certain personal property.
Adopted Ordinance No. 39170-080111 (5-0).
d. Ordinance No. 39171, on second reading, permanently vacating,
discontinuing and closing an approximately 33' wide, 127' long portion of
unimproved right-of-way on Wilson Street, adjoining 120 Penrod Avenue,
S. E. Adopted Ordinance No. 39171-080111 (5-0).
e. Ordinance No. 39172, on second reading, rezoning property located at
445 and 435 Elm Avenue, S. W., from RM-1 Residential Mixed Density
District to CN, Commercial-Neighborhood District.

the Roanoke Public Library Board for a term ending June 30, 2014.
Appointed Council Member Rafael Ferris to replace Vice-Mayor David
Trinkle as a City representative (elected-official) of the Roanoke
Valley-Alleghany Regional Comprehensive Economic Development
Strategy Committee ending March 31, 2014.
Appointed Kianna Wade to replace Dr. Frank Eastburn as a member
of the Roanoke Arts Commission for a term ending June 30, 2014.
Reappointed Derek Cundiff and John Fulton as members of the
Architectural Review Board for terms of four years, each, ending
October 1,2015. (Waived City residency for Mr. Fulton)
Reappointed Linda D. Frith and F. Gordon Hancock as Directors of
the Economic Development Authority for terms of four years, each,
ending October 20, 2015.
Appointed Vice-Mayor Trinkle (elected-official) and Council Member

Steering Committee of the Regional Sustainability Partnership for

CONCUSSIONS OVERVIEW
JULY 29, 2011
1. On July 1, 2011, Virginia Code ~22.1-271.5 dealing with "Policies on' concussions in student-athletes"
went into effect. The Virginia High School league (VHSl) indicates that the law requires the following:
Each local school division shall develop policies and procedures regarding the identification and
handling of suspected concussions in student-athletes. The established policies shall require:
· An annual review of concussion information provided by the school division to both
student-athletes and parents/guardians.
· After reviewing the short and long term health effects of concussions, each student-
athlete and the student-athlete's parent or guardian shall sign a statement acknowledging
receipt of such information, in a manner approved by the Board of Education.
· Student-athletes suspected by their coach, athletic trainer, or team physician of sustaining
a concussion or brain injury in a practice or game shall be removed from the activity at
that time. A student-athlete whohas been removed from play, evaluated, and suspected
to have a concussion or brain injury shall not return to play that same day nor until (i)
evaluated by an appropriate licensed health care provider as determined by the Board of
Education and (ii) in receipt of written clearance to return to play from such licensed
health care provider.
2. The National Federation of State High Schools Associations (NFHS) now includes in all of its rule
books the following:
Any contestant who exhibits signs, symptoms or behaviors consistent with a concussion (such as
loss of consciousness, headache, dizziness, confusion or balance problems) shall be immediately
removed from the [event] and shall not return to competition until cleared by an appropriate
health provider.
3. All RCPS coaches are now required to take the NFHS "Concussions in Sports - What You Need to
Know" course, which is offered online, and deliver their completion certificates to the relevant
Athletic Director before the start of their season. Additionally, at least one coach from each high
school team must attend a rules clinic prior to the start of their season. Concussions are discussed at
these meetings; the coaches are made aware of the state code and NFHS rule regarding concussions.
4. At its August 2011 regular meeting, the School Board will consider in second reading draft policy
JJAC entitled "Student Athlete Concussions During Extracurricular Activities." This draft policy meets
the requirements set forth in Virginia Code ~22.1-271.5.
5. The School Board will also be asked to approve at its August 2011 regular meeting the information
to be provided by the school division to student-athletes and parents/guardians regarding
concussions as well as the statement to be used acknowledging receipt of such information.

classrooms)

mobility device of choice. Wheelchairs must be permitted as a
means of transportation. "Others" must be permitted unless the
entity can demonstrate that this significantly alters programs or
creates a safety problem.

AN ORDINANCE authorizing the conveyance of a fifteen-foot wide above ground utility
easement across City-owned property located in the Roanoke Centre for Industry and Technology
(RCIT), designated as Tax Map No. 7230108, to Appalachian Power Company, upon certain terms and
conditions; and dispensing with the second reading by title of this ordinance.
WHEREAS, a public hearing at which all citizens had an opportunity to be heard with respect
to this matter was held by Council on August 1, 2011.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Roanoke that:
1. The City Manager and City Clerk are hereby authorized, for and on behalf of the City,
to execute and attest, respectively, the necessary documents providing for the conveyance of a fifteen-
foot wide above ground utility easement across City-owned property located in the Roanoke Centre for
Industry and Technology, designated as Tax Map No. 7230108, to Appalachian Power Company, to
install support structures, and related cables/wires, in order to transmit electric power to serve an
adjoining privately owned parcel of real estate designated as Tax Map No. 7250101, all as more
particularly set forth in the City Manager's letter to Council dated August 1, 2011.
2. All documents necessary for this conveyance shall be in a form approved by the City
Attorney.
3. Pursuant to the provisions of Section 12 of the City Charter, the second reading by title
of this ordinance is hereby dispensed with.

Backg rou nd:
Appalachian Power Company has requested a 15' above ground utility
easement across City-owned property, designated as tax map number
7230108. The purpose of the easement is to install support structures, and
related cable/wires, in order to transmit electric power to serve an adjoining
privately owned parcel of real estate designated as tax map number 7250101.
The City-owned property is located in the Roanoke Centre for Industry and
Technology (RClT) and is currently vacant. The granting of the easement will
not have an adverse impact on the future use or potential development of the
City-owned property. See Attachments #1 and #2.
Recommended Action:
Following a public hearing, authorize the City Manager to execute the
appropriate documents granting an above ground easement, for nominal
consideration, as described above to Appalachian Power Company, approved as
to form by the City Attorney.

made a part hereof
TOGETHER with the right to said APPALACHIAN, its successors and assigns, to
construct, erect, install, place, operate, maintain, inspect, repair, renew, remove, add to the number
of, and relocate at will, poles, with wires, cables, crossarms, guys, anchors, grounding systems and

referred to premises; the right to cut down, trim and/or otherwise control, and at Appalachian's
option, remove from said premises, any trees, overhanging branches, buildings or other obstructions
which may endanger the safety of, or interfere with the use of Appalachian's Facilities, and the right of
ingress and egress to and over said above referred to premises and any of the adjoining lands of the
Grantors at any and all times, forthe purpose of exercising and enjoying the rights herein granted, and for
doing anything necessary or useful or convenient in connection therewith. The Grantor hereby grants,
conveys and warrants to Appalachian Power Company a non-exclusive right of way easement for electric
facilities.
APPALACHIAN agrees to restore and repair any damage to GRANTOR'S property that
may be caused by the construction, operation, or maintenance of said easement. The GRANTOR
agrees that APPALACHIAN will not be expected to restore the property to the identical origmal
condition, but rather as near thereto as is reasonably practicable.
In the event APPALACHIAN should remove all of said Appalachian's facilities from the
lands of the GRANTOR, then all of the rights, title and interest of the party of APPALACHIAN
in the right of way and license hereinabove granted, shall revert to the GRANTOR, its successors
and assigns.
APPALACHIAN agrees to indemnify and save harmless the GRANTOR against any and
all loss or damage, accidents, or injuries, to persons or property, whether of the GRANTOR or
any other person or corporation, ansmg in any manner from the negligent construction,
operations, or maintenance, or failure to properly construct, operate, or maintain said
Appalachian's facilities.
TO HA VE AND TO HOLD the same unto Appalachian Power Company, its successors
and assigns.
Upon recordation ofthis agreement Appalachian accepts the terms and conditions
contained therein.

Criminal Justice Information Technology Improvement Grant
Background:
The Virginia Department of Criminal Justice Services (DCJS) distributes federal
funding through the Edward Byrne Memorial Grant Program. Byrne programs
"may consist of many initiatives including improvements to technology that will
enhance the functioning of the criminal justice system. The Police Department
regularly applies for grant funding under this program.
On June 20, 2011, DCJS awarded the Police Department $30,913 in funding to
be used for Criminal Justice Systems Improvement. This funding will be used to
acquire 41 new mobile computer terminal mounts to be deployed in police
vehicles. The new mobile computer mounts will significantly upgrade our
equipment in this area and -allow our vehicles to interface with the Automatic
Vehicle Locator system. There is a required $10,305 cash match associated with
this award. Matching funds are available in the local match funding for grants
account # 35-300-9700-5415.
Recommended Action:

Accept the Criminal Justice Systems Improvement Grant described above and
authorize the City Manager to execute the grant agreement and any related
documents; all such documents to be approved as to form by the City Attorney.
Adopt the accompanying budget ordinance to establish a revenue estimate in

Authorization for an Agreement with Coca-Cola Bottling Company
Consolidated for a "Recycle and Win!" Program
Background:
The City of Roanoke's curbside recycling program continues to be a strong
element of our environmental sustainability efforts. Representatives from Coca-
Cola Bottling Company Consolidated recently approached the City's Solid Waste
Management staff with an opportunity for City residents to participate in a
program to further enhance interest in curbside recycling.
Coca-Cola Bottling has the unique ability to communicate with and connect to
its strong consumer base in the community and desires to promote recycling
and environmental awareness within the City through the development,
implementation and administration of a program known as "Recycle and Win!".
Utilizing a list of mailing addresses of all City residences that have access to
our recycling program, Coca-Cola would send an educational mailer to all such
residences regarding the parameters of the City's recycling program as well as
instructions on how to participate in the "Recycle and Win" program. A resident
would participate by placing a program sticker (furnished by Coca-Cola) on a
curbside recycling bin (participation is strictly voluntary). A Coca-Cola "prize
patrol" would visit neighborhoods on recycling days each week for a period of
six months looking for curbside recycling bins that display the program sticker.
Each week, the prize patrol would select a minimum of ten eligible residents
that are determined to be recycling in accordance with the parameters of the
City's curbside recycling program as program winners. The prize patrol would
wo"rk to ensure that winners are distributed across the City. Each program
winner will receive a fifty dollar Kroger retail gift card which Coca-Cola will be
responsible for providing to each winner. All program expenses would be the
responsibility of Coca-Cola Bottling.
Considerations:
An agreement between the City of Roanoke and Coca-Cola Bottling that covers.
all necessary elements of the program will requ ire City Council authorization for
execution by the City Manager. A subsequent kick-off event for this program
will be scheduled during the September-October timeframe.
Recommended Action:
Authorize the City Manager to execute a Program Agreement between the City
and Coca-Cola Bottling Company Consolidated Operations LLC, substantially
similar to the one attached to this report, and to execute such other documents
and take further actions as may be necessary to implement, support, and
enforce such Agreement, with the form of such Agreement to be approved by
the City Attorney.

Recycle and Win! Program Agreement
This RECYCLE AND WIN! PROGRAM AGREEMENT (this "Agreement") is made and
entered effective as of the , 2011 (the "Effective Date") between CCBCC
OPERATIONS, LLC, with principal offices in Charlotte, NC (the "Bottler"), and the CITY OF
ROANOKE (the "City").
WHEREAS, the Bottler has the unique ability to communicate with and connect to its strong
consumer base in the community and desires to promote recycling and environmental awareness
within the City, through the development, impleme)1tation and administration of a program
known as "Recycle and Win!," which is more fully described in Exhibit A attached hereto (the
"Pro gram"); and,
WHEREAS, the City has, as one of its primary missions, the responsibility for responsible waste
management within the City limits and desires to promote such mission through its participation
in the Pro gram.
NOW, THEREFORE, in consideration of the mutual terms, provIsIons, covenants and
agreements made herein, and other good and valuable consideration, the receipt and sufficiency
of which are hereby acknowledged, the Bottler and the City agree as follows:
1. The term of this Agreement will commence on the Effective Date and shall end on
,2012, unless sooner terminated in accordance with Section 9.
2. Except as otherwise described herein, the Bottler will be responsible for developing,
implementing and administering the Program, and any and all expenses incurred in connection
therewith. Notwithstanding the foregoing, the City acknowledges and agrees that the Bottler
may, subject to prior written approval from the City, through the Department of Public Works
(Attention: Bob Bengtson), which approval shall not be unreasonably withheld, involve other
corporate partners in carrying out any of its obligations hereunder. .Attached hereto as Exhibit B
is a list of preapproved corporate partners. In the event that Bottler involves other corporate
partners, Bottler shall be responsible to the City for the conduct and activities of such corporate
partners with regard to the Bottler's obligations hereunder.
3. The Bottler will submit to the City's Department of Public Works (Attention: Bob
Bengtson), and the City, through its Department of Public Works, will have the right to approve
within thirty (30) days of receipt from the Bottler, which approval will not be unreasonably
withheld or delayed, any promotional or educational materials (including the Educational Mailer,
as defined below in Section 4) or any advertising campaigns prepared by the Bottler with respect
to the Program that include the City's name or logo(s). In the event that the City fails to provide
any response to the Bottler within such thirty (30) day period, such submission will be deemed

approved by the City. Bottler shall ensure that all printed promotional or educational materials
related to the Program and distributed to the public will be printed on recycled paper.
4. Prior to implementing the Program, the Bottler will prepare an Educational Mailer that
will include reasons to recycle, what items can and cannot be recycled, how to recycle in
accordance with the parameters ofthe City's curbside recycling program and instructions on how
to participate in the Program, including a statement that, by placing a Program sticker on a
curbside recycling bin, the resident consents to the visual observation of the contents of any
curbside recycling bin by members of the Prize Patrol. The City will provide the Bottler with a
list of mailing addresses of all residences that have access to the City's curbside recycling
program. The City may update the list as more residences receive access to curbside recycling.
The Bottler will be responsible for mailing the Educational Mailer, along with the participation
stickers, to all such residences. Bottler will make good faith efforts to ensure that Program
stickers are distributed only within the City limits to residents with access to curbside recycling.
5. Upon request by the City, the Bottler will provide educational materials and a list of
F AQs for designated City staff to enable them to provide interested residents with information on
the Program. The information provided by the City will be in addition to the educational
material and participation sticker mailed by the Bottler.
6. The parties agree that City shall be the primary source of information regarding the
Program. As such, the Bottler may refer any and all citizen questions and inquiries regarding the
Program including, but not limited to, prize winners and prize winner selection methodology to
City. The parties further agree that City is the primary source of information regarding the
City's curb side recycling program. As such, the Bottler shall refer any and all citizen questions
and inquiries regarding the City's curb side recycling program, other than with respect to the
Program, to the City.
7. The Bottler will follow all applicable laws and regulations in developing, implementing
and administering the Program. This shall include, but is not limited to, all applicable laws and
regulations governing contests, sweepstakes, and promotions. In addition, Bottler will be
responsible for securing all necessary permissions and approvals for use of third-party
trademarks, service-marks, copyrighted material, and other intellectual property.
8. Either party will have the right to terminate this Agreement at any time during the term of
this Agreement if the other party breaches any material term or condition of this Agreement and
fails to cure such breach within fourteen (14) calendar days after written notice of the breach is
received by such party. .
9. Any and all notices or communications between the parties with respect to this
Agreement shall be deemed given when made in writing and delivered by hand or sent by fIrst-
class mail (registered or certified, with return receipt requested), overnight courier (guaranteeing
next business day delivery) or by facsimile (followed by first class mail confirmation), to the
address of the party appearing under its name on the signature page below (or to such other
address as may be designated in a notice given hereunder).

10. This Agreement shall not be assigned or transferred by either party without the prior
written consent of the other party. This Agreement shall be binding upon and shall inure to the
benefit ofthe parties hereto and their respective successors and permitted assigns. No waiver by
any party of any breach by another party of any provision hereof shall be deemed to be a waiver
of any other breach thereof or as a waiver of any such or other provision ofthis Agreement. This
Agreement is made and executed with the intention that the construction, interpretation and
validity hereof shall be determined in accordance with and governed by the laws of the
Commonwealth of Virginia. This Agreement constitutes the entire contract between the parties
with respect to the subject matter hereof and supersedes and cancels all prior or
contemporaneous oral, or written contraCts and understandings with respect to the subject matter
hereof All Exhibits attached hereto are hereby incorporated herein by reference. This
Agreement may not be changed or modified orally, but only by an instrument in writing, signed
by the parties hereto, which instrument states that it is an amendment to this Agreement. Except
as equity may require, should any provision of this Agreement or any part thereofbe held to be
invalid or unenforceable, the same shall not affect or impair any other provision of this
Agreement or any part thereof, and the invalidity or unenforceabi1ity of any provision of this
Agreement shall not have any effect on or impair the obligations of a party with respect to the
remaining provisions of this Agreement. This Agreement may be executed in multiple
counterparts, each of which shall be deemed an original and all of which shall constitute one
Agreement.
11. The parties hereto for themselves, their agents, officials, employees and servants agree
not to discriminate in any manner on the basis of race, color, creed, national origin, sex, age,
handicap, or sexual ori~ntation with reference to the subject matter of this contract, no matter
how remote.
12. In consideration of the signing of this agreement and the payment of $1 by the City to the
Bottler, the Bottler agrees to rent the Vehicle described in paragraph fo'urteen to the City. The
City acknowledges that its agreement to comply with the obligations and limitations set forth
herein is an express condition to Bottler renting the Vehicle for use by the City exclusively in
City business conducting the Recycle and Win program, and the City agrees to comply with the
same.
13. Vehicle. For purposes of this Agreement, the "Vehicle" shall be a passenger vehicle and
refer to the s ecific vehicle described below:

14. Term and Termination. The City shall be entitled to possession and use ,of the Vehicle
exclusively for use in conducting the Recycle and Win program and events relating thereto,
beginning on , 2011 and terminating , 2012; In the event that the City
breaches this Agreement, Bottler believes in its sole discretion that the City is failing to comply
with its obligations under this Agreement, or the City fails to maintain or upon request fails to
provide timely confirmation of agreed upon maintenance of the Vehicle in good and clean

operating order, the Bottler may immediately terminate this Agreement. The City shall be
entitled to perform maintenance itself, or to select the firm to perform maintenance. Upon
expiration or early termination of this Agreement, the City shall be responsible for returning the
Vehicle to the Bottler at the place at which the Bottler first made the Vehicle available or such
other place in the City of Roanoke as the Bottler deems appropriate to the City in the same
condition in which it was made available, ordinary wear and tear excepted.
15. Use. The City agrees that the Vehicle will be operated solely by the City's employees in the
performance of the Recycle and Win program and events ancillary thereto, and the City agrees
not to allow the Vehicle to be operated by any third parties. Except as otherwise set forth herein,
the City shall be responsible for all loss or damage to the Vehicle occurring while in the City's
possession as a result of the negligence or willful misconduct of its employees or agents. The
City shall be responsible for the costs of operating and normal maintenance ofthe Vehicle during
the term of this Agreement, including fuel costs and oil changes. All other long-term
maintenance or repair shall remain the responsibility of the Bottler as owner of the vehicle.
16. Operators. The City shall have the sole responsibility for selecting individuals to operate
the Vehicle in a safe manner, for ensuring that such individuals are fully authorized to do so, and
the City acknowledges and agrees that Bottler shall have no involvement in determining which
of the City's employees operate the Vehicle.
17. Taxes. The City shall bear the cost of all municipal fines, fees, charges or costs arising from
the use and operation of the vehicle, including, but not limited to, parking and traffic tickets.
The Bottler shall be responsible for the cost of registering the vehicle and obtaining an
appropriate license plate. The City shall ensure that the Vehicle is only used for purposes for
which it is properly registered.
18. Insurance. The City shall procure and maintain, throughout the term of this Agreement, the
insurance coverages set forth in Exhibit C hereto, and shall otherwise comply with the
obligations set forth therein. User shall provide CCBCC evidence of its compliance through valid
certificates of insurance.
19. All matters relating to this contract shall be governed by the laws of the Commonwealth of
Virginia, without regard to its choice oflaw provisions, and any action relating to this agreement
shall be brought in the appropriate court within the jurisdiction ofthe City of Roanoke, Virginia.

Program Description and Particulars
. The City acknowledges that the Program will be open to all residences of the City of
Roanoke that have access to the City a curbside recycling program and participation will be
strictly voluntary on the part of the persons residing therein ("Eligible Residents").
. In order to participate in the Program, Eligible Residents will place a "Recycle and Win!"
sticker (the "Sticker") on their curbside recycling bins. Eligible Residents are not required to
purchase, or recycle packaging from, any particular products or brands in order to participate
orwm.
. Following the distribution of the Educational Mailer to Eligible Residents, a team of the
Bottler's employees selected by the Bottler (the "Prize Patrol") will visit Roanoke
neighborhoods on recycling days each week looking for curbside recycling bins that display
the Sticker C'Participating Bins"). The prize patrol will inspect, and will have the right to
inspect, the contents of any Participating Bins in order to determine whether it appears that
the Eligible Residents are recycling in accordance with the parameters of the City's curbside
recycling program. For the avoidance of doubt, the location, day and time of any and all
visits will be determined by the Bottler.
. Each week, the prize patrol will select a minimum of ten (10) Eligible Residents that it
determines are recycling in accordance with the parameters of the curbside recycling
program as Program winners. Notwithstanding the requirement in the preceding sentence
that there be a determination of recycling in accordance with the parameters of the curbside
recycling program, a resident whose recycling bin displays a Sticker but whose recycling has
already been picked up will be an Eligible Resident.
· Each Program winner will receive a fifty dollar ($50.00) Kroger retail gift card. Upon
confirmation of the winners by the prize patrol to the Bottler, the Bottler shall either mail the
gift cards to Program winners or mail a notice to Program winners with instructions for
claiming a gift card.
· During the term of this Agreement, the Bottler shall provide gift cards to a minimum of two
hundred sixty (260) Program winners (for a total of$13,OOO in prize winnings).
· The members and vehicles of the prize patrol will at all time be clearly identifiable to
Eligible Residents as part ofthe Program through the use of signage and uniform clothing.
· The Bottler will support the Program through local media and advertising and point-of-sale
materials in retail stores.

AN ORDINANCE exempting from personal property taxation certain personal property
located in the City of Roanoke and owned by Kuumba Comm~ity Health & Wellness Center,
Inc., d/b/a New Horizons Healthcare an organization devoted exclusively to charitable or
benevolent purposes on a non-profit basis; providing for an effective date.
WHEREAS, Kuumba Community Health & Wellness Center, Inc., d/b/a New Horizons
Healthcare, (hereinafter "the Applicant"), has petitioned this Council to exempt certain personal
property of the Applicant from taxation pUrsuant to ArticleX, Section 6(6) of the Constitution of
Virginia;
WHEREAS, a public hearing at which all citizens had an opportunity to be heard with
respect to the Applicant's petition was held by Council on July 18,2011;
WHEREAS, the provisions of subsection B of Section 58.1-3651, Code of Virginia
(1950), as amended, have been examined and considered by the Council; and
WHEREAS, the Applicant agrees that the personal property to be exempt from taxation
is certain personal property, including machinery, tools, and equipment, which shall be used by
the Applicant exClusively for charitable purposes on a non-profit basis.
THEREFORE, BE IT ORDAINED by the Council of the City of Roanoke as follows:
1. Council classifies and designates Kuumba Community Health & Wellness Center,
Inc., d/b/a New Horizons Healthcare, as a charitable organization within the context of Section
6(6) of Article X of the Constitution of Virginia, and hereby exempts from personal property
taxation certain personal property, machinery, tools, and equipment, owned by the Applicant,
which property is used exclusively for charitable purposes on a non-profit basis; continuance of

this exemption shall be contingent on the continued use of the personal property in accordance
with the purposes which the Applicant has designated in its application.
2. This Ordinance shall be in full force and effect on January 1,2012.

Commissioner of the Revenue, the City Treasurer, and to Eileen G. Lepro, Executive Director of
Kuumba Community Health & Wellness Center, Inc., d/b/a New Horizons Healthcare.

WHEREAS, Earl Slusser filed an application with the Council of the City of Roanoke,

vacate, discontinue and close a certain public right-of-way described hereinafter;
WHEREAS, the City Planning Commission, after giving proper notice to all concerned
as required by S30-14, Code of the City of Roanoke (1979), as amended, and after having

WHEREAS, a public hearing was held on such application by City Council on July 18,

result to any individual or to the public from permanently vacating, discontinuing and closing
such public right-of-way.

related facilities that may now be located in or across such public right-of-way, together with the
right of ingress and egress for the maintenance or replacement of such lines, mains or utilities,
such right to include the right to remove, without the payment of compensation or damages of
any kind to the owner, any landscaping, fences, shrubbery, structure or any other encroachments
on or over the easement which impede access for maintenance or replacement purposes at the
time such work is undertaken; such easement or easements to terminate upon the later
abandonment of use or permanent removal from the above-described public right-of-way of any
such municipal installation or other utility or facility by the owner thereof
BE IT FURTHER ORDAINED that the applicant shall submit to the Subdivision Agent,
receive all required approvals of, and record with the Clerk of the Circuit Court for the City of
Roanoke, a subdivision plat, with such plat combining all properties which would otherwise
dispose of the land within the right-of-way to be vacated in a manner consistent with law, and
retaining appropriate easements, together with the right of ingress and egress over the same, for
the installation and maintenance of any and all existing utilities that maybe located within the
right-of-way.

amended, and the Official Zoning Map, City of Roanoke, Virginia, dated December 5,
2005, as amended, to rezone certain property within the City.
WHEREAS, Terry Wayne Cundiff and Valerie S. Eagle and Piedmont Property,
LLC have made application to the Council of the City of Roanoke, Virginia ("City
Council"), to have the property located at 445 Elm Ave., S.W. and 435 Elm Ave., S.W.,
bearing Official Tax Map Nos. 1020113 and 1020114, rezoned from RM-l Residential
Mixed Density District, to CN, Commercial-Neighborhood District.
WHEREAS, the City Planning Commission, after giving' proper notice to all
concerned as required by S36.2-540, Code of the City of Roanoke (1979), as amended,
and after conducting a public hearing on the matter, has made its recommendation to City
Council;
WHEREAS, a public hearing was held by City Council on such application at its
meeting on July 18, 2011, after due and timely notice thereof as required by S36.2-540,

and citizens were given an opportunity to be heard, both for and against the proposed

WHEREAS, this Council, after considering the aforesaid application, the
recommendation made to City Council by the Planning Commission, the City's
Comprehensive Plan, and the matters presented at the public hearing, finds that the public

appointed.

of the Virginia Freedom of Information Act. The Act requires that you be provided with a
copy within two weeks of your appointment and each member is required "to read and
become familiar with provisions of the Act."
