C-1 A communication from the City Manager requesting that Council schedule a public hearing for Monday, September 19, 2011, at 7:00 p.m., or as soon thereafter as the matter may be heard, to consider the vacation of a previous storm drain easement and the placement of a new deed of reservation on City- owned property in connection with the development of the Riverside Corporate Centre. RECOMMENDED ACTION: Concurred in the request. C-2 A communication from the City Manager requesting that Council schedule a public hearing for Monday, September 19, 2011, at 7:00 p.m., or as soon thereafter as the matter may be heard, to consider granting the request of Newbern Properties, LLC, a public drainage easement across a portion of the former Countryside Golf Course. RECOMMENDED ACTION: Concurred in the request. 5 C-3 A communication from the City Clerk advising of the resignation of The Honorable Sherman P. Lea as a City representative of the Virginia Cares Board of Directors, effective immediately. RECOMMENDED ACTION: Accepted the resignation and received and filed the communication. C-4 A communication from the City Clerk advising of the resignation of Peter Clapsaddle as a member of the Local Board of Building Code Appeals, effective immediately. RECOMMENDED ACTION: Accepted the resignation and received and filed the communication. C-5 A communication from the City Clerk advising of the resignation of James D. Ritchie as a member of the Human Services Advisory Board, effective immediately. RECOMMENDED ACTION: Accepted the resignation and received and filed the communication. C-6 Annual report of the Economic Development Authority for Fiscal Year 2010-2011. RECOMMENDED ACTION: Received and filed. C-7 Reports of qualification of the following individuals: The Honorable David B. Trinkle as a City representative of the Steering Committee of the Regional Sustainability Partnership for a term of office ending June 30, 2013; Letitia Smith as a member of the Personnel and Employment Practices Commission for a three-year term of office ending June 30, 2014; Stephen S. Willis as a member of the Roanoke Civic Center Commission to fill the unexpired term of Laura Rawlings ending September 30,2012; F. Gordon Hancock as a Director of the Economic Development Authority ending October 20,2015; Mark S. Lawrence as a City representative of the Virginia Western Community College Board for a four-year term of office ending June 30, 2015; 6 Brownie E. Polly as a member of the Roanoke Civic Center Commission for a three-year term of office ending September 30, 2014. RECOMMENDED ACTION: Received and filed. REGULAR AGENDA 5. PUBLIC HEARINGS: NONE. 6. PETITIONS AND COMMUNICATIONS: a. A communication from the Commonwealth's Attorney recommending acceptance of funding from the State Compensation Board for the Regional Drug Prosecutor Grant; a communication from the City Manager recommending concurrence and appropriation of funds. Adopted Resolution No. 39191-090611 and Budget Ordinance No. 39192- 090611 (7-0). 7. REPORTS OF CITY OFFICERS AND COMMENTS OF CITY MANAGER: a. CITY MANAGER: BRIEFINGS: NONE. ITEMS RECOMMENDED FOR ACTION: 1. Adoption of a resolution to establish a national moment of remembrance of those persons who lost their lives in the terrorist attacks 10 years ago on September 11, 2001. Adopted Resolution No. 39193-090611 (7-0). 2. Adoption of a resolution requesting support of the Governor and Members of the General Assembly to reverse the $60 million annual reduction for FY2012 and to eliminate the same in the FY2013 and FY2014 State budgets. Adopted Resolution No. 39194-090611 (7-0). At this point (2:42 p.m.), Elder Lea left the meeting. 7 3. Adoption of a resolution requesting modification of the Roanoke Valley/Blue Ridge Parkway Trail Plan Environmental Assessment to include the eastern extension of the Roanoke River Greenway to Explore Park as part of a one-year pilot project. Adopted Resolution No. 39195-090611 (6-0). 4. Acceptance and appropriation of funds for Urban and Community Forestry Grants from the Virginia Department of Forestry. Adopted Resolution No. 39196-090611 and Budget Ordinance No. 39197-090611 (6-0). 5. Acceptance of donations from Pathfinders for Greenways and the Roanoke Valley Greenway Commission, respectively, in support of the development of the Roanoke River Greenway -- Bridge Street to Salem connection; and appropriation of funds in connection therewith. Adopted Resolution No. 39198-090611 and Budget Ordinance No. 39199-090611 (6-0). COMMENTS BY CITY MANAGER. The City Manager announced that the City of Roanoke has received approximately 3 inches of precipitation and is expecting an additional 2 inches as a result of Hurricane Lee. He advised that the Market Building Grand Re-Opening Celebration was a success with approximately 2,000 people in attendance throughout the day. He pointed out that the Henry Street Heritage Festival would be held on Saturday, September 17 in Elmwood Park and the Light it Up for a Cure Fire Prevention event would be held at the Roanoke Civic Center on Saturday, September 24. He advised that the Mill Mountain Star would return to white and would only be red, white and blue on highly patriotic days. At this point, the briefing on Economic Development Initiatives/Update was led by Robert Ledger, Manager, Department of Economic Development. 8. REPORTS OF COMMITTEES: a. A communication from Council Member Sherman P. Lea, Chairman, Audit Committee, recommending approval of certain revisions to the Council's Travel and Expense Policy. Approved (6-0). 8 9. UNFINISHED BUSINESS: a. Continuation of the matter with regard to a request of the Roanoke City School Board for approval of the Schools' renewal of the $10 million line of credit facility with Wells Fargo, National Association. (Matter was tabled at the August 15 meeting) (Matter continued until later date, while staff continues to seek a satisfactory solution) 10. INTRODUCTION AND CONSIDERATION OF ORDINANCES AND RESOLUTIONS: a. A resolution designating Council Member Sherman Lea as Voting Delegate and Council Member Anita Price as Alternate Voting Delegate for the Business Session and Chris Morrill, City Manager, as Staff Assistant in connection with the Annual Virginia Municipal League Conference to be held on October 2 - 4, 2011, in Henrico County, Virginia. Adopted Resolution No. 39200-090611 (6-0). 11. MOTIONS AND MISCELLANEOUS BUSINESS: a. Inquiries and/or comments by the Mayor and Members of City Council. Ms. Price reiterated that the Henry Street Heritage Festival would be held on September 17, commencing at 11:30 a.m., with many activities throughout the day and evening. b. Vacancies on certain authorities, boards, commissions and committees appointed by Council. FERGUSON ASSISTANT CITY ATfORNEYS August 19,2011 Honorable Mayor and Members of City Council Roanoke, Virginia Re: City Voting Precincts Dear Mayor Bowers and Members of Council: This is in response to Council's request that I provide an overview as to where the City stands in terms of its voting precincts meeting State requirements as to the number of registered voters in each precinct, and suggest options as to how the City might design a process to study the possibility of realigning and reducing the number of precincts. The City currently has 32 voting precincts (and one for absentee voters), each with its own polling place. These are set out in Article II, Election Districts; Voting Precincts and Places, of Chapter 10, Elections, of the City Code. According to the State Board of Elections, as of August 12, 2011, the City has 57,060 "active" and 4,650 "inactive" voters. (Pursuant to Sec. 24.2-428, Code of Virginia, registered voters are classified as "inactive" if the registrar believes they have changed addresses, and they fail to respond to a notice from the registrar asking them to confirm their current address.) This equates to an average of approximately 1,783 active voters per precinct; and approximately 1,928 per precinct including the inactive voters. Attachment A shows the registrant counts for each precinct in the City as of August 12, 2011. As you can see, the number of active voters in each precinct varies from a low of 969 for the Williamson Road No. 2 precinct, to a high of 3,719 for the Peters Creek precinct. Attachment B lists the current precincts with their polling places. Precinct boundaries throughout Virginia were "frozen" from February 1, 2009, until May 15,2011, so that the State could participate with the Census Bureau in a program to put voting precinct boundaries on the census maps and obtain 2010 population counts for each precinct. Now that the freeze has ended, the State has encouraged localities to review their precincts to see if any have grown too small or large to be efficient and cost effective. Requirements of State Law Sec. 24.2-307, Code of Virginia, (Attachment C) provides that precincts in cities shall have no more than 5,000 nor fewer than 500 registered voters. This section also requires local registrars to notify the locality's governing body whenever more than 4,000 persons have voted in a precinct in a presidential election. For applying these size requirements, "registered voters" means the voters on the registration system with active status and does not include inactive voters. Sec. 24.2-305, Code of Virginia (Attachment D) requires that each precinct must be "compact and contiguous" and have "clearly defined and clearly observable boundaries," such as roads, rivers, and other permanent features recognized on official maps. This requirement is intended to create precinct boundaries which are readily identifiable by voters, candidates, and election officials. Ideally and where feasible, precincts should be drawn so as to avoid so-called "split precincts" that result in voters in the same precinct voting in different House of Delegates, State Senate, or congressional contests, which causes confusion for voters and peadaches for election officials. (The City's GIS office is preparing maps showing the City's current precincts and polling places which should be available soon.) Sections 24.2-310 and 24.2-310.1, Code of Virginia (Attachments E and F respectively) require that there be one polling place for each precinct, located (i) within the precinct or within one mile of the precinct boundary, (ii) in a building which meets accessibility requirements, and (iii) within a public building where practicable. Sec. 24.2-306, Code of Virginia, provides that no change in any local precinct or polling place may be made within the sixty days preceding a general election, Notice of any change must be advertised in a newspaper once a week for two successive weeks, advising where descriptions and maps of proposed boundary and polling place changes may be inspected. Notice of any adopted change in any precinct boundary or polling place must be mailed to every registered voter in the affected precinct at least fifteen days prior to the next election. (Sec. 24.2- 310 sets out the procedures to be followed in the event of the relocation of a polling place because of an emergency - as sometimes results as a consequence of storms, floods, fires, structural damage, etc...) Such notice should not be sent until "preclearance" by the United States Justice Department has been received (a process explained below). Preclearance Any revision of the City's precinct boundaries or changes in polling places must be "precleared" by the United States Justice Department pursuant to the requirements of Section 5 of the Voting Rights Act, as amended in 2006, before they can be implemented. The Department's standards of review are set out in the Act and include such things as the reasons and justification for the proposed change, whether a jurisdiction has used objective guidelines in making the change, whether minority group. members participated in the decision-making process, and the like. The Department has sixty days from the date of receipt of a submission to object to the change. It may request additional information within that sixty days. The Department then will have a new sixty-day period from the date of receipt of the additional information in which to object to the change. In our experience, it usually takes sixty days for the Department to advise that it has no objection to proposed changes. Document2 Analysis The City's current precinct boundaries and polling places conform to the requirements of State law, and there is no legal reason requiring any changes in them. The State Board of Elections' web site has statistical information on the number of precincts in each locality and the number of registered voters in each (Virginia has a total of 2,373 precincts). In my own unscientific perusal of the statistics, it doesn't appear to me that Roanoke's precincts are out of line in any way with those of other localities, some have smaller numbers of registered voters per precinct, some larger. It appears that rural areas may have more precincts with smaller numbers of registered voters than more urbanized areas. Be this as it may, the City of Roanoke Electoral Board has indicated that combining several of the City's existing precincts could save money and be more efficient, since each polling place requires five officers of election and voting machines, and it is becoming increasingly more difficult to find polling locations that meet all Federal and State requirements, such as accessibility. ) Process I would suggest that Council meet with the Registrar and Electoral Board to discuss a process for going forward with a review of the City's current precincts. Since public participation and the opportunity to comment is essential, Council may wish to consider establishing a committee to study the matter, make recommendations, and seek broad public input. Once consensus is reached, the proposed realignment can be scheduled for a public hearing before Council so that Council can act to approve the proposed changes. If Council wants to effect changes in precinct boundaries to be effective for the May 2012 local general election, it would need to approve the changes by December or early next January, to give time to seek preclearance and for the Registrar to send out the' required notices to voters before the election. The general registrar shall notify the governing body whenever the number of voters who voted in a precinct in an election for President of the United States exceeds 4,000. Within six months of receiving the notice, the governing body shall proceed to revise the precinct boundaries, and any newly established or redrawn precinct shall have no more than 5,000 registered voters. For town elections held in November, the town shall use the polling places established by the county for its elections. B. The governing body of each county, city, and town shall provide funds to enable the electoral board to provide adequate facilities at each polling place for the conduct of elections. Each polling place shall be located in a public building whenever practicable. If more than one polling place is located in the same building, each polling place shall be located in a separate room or separate and defined space. C. Polling places shall be accessible to qualified voters as required by the provisions of the Virginians with Disabilities Act (9 51.d::1 et seq.), the Voting Accessibility for the Elderly and Handicapped Act (42 U.S.c. 9 1973ee et seq.),and the Americans with Disabilities Act relating to public services (42 U.S.C. 9 12131 et seq.). The State Board shall provide instructions to the local electoral boards and general registrars to assist the localities in complying with the requirements of the Acts. D. If an emergency makes a polling place unusable or inaccessible, the electoral board shall provide an alternative polling place and give notice of the change in polling place, including to all candidates, or such candidate's campaign, appearing on the ballot to be voted at the alternative polling place, subject to the prior approval of the State Board. The electoral board shall provide notice to the voters appropriate to the circumstances ofthe emergency. For the purposes of this subsection, an "emergency" means a rare and unforeseen combination of circumstances, or the resulting state, that calls for immediate action. E. It shall be permissible to distribute campaign materials on the election day on the property on which a polling place is located and outside of the building containing the room where the election is conducted except (i) as specifically prohibited by law including, without limitation, the prohibitions of 9 4.'L?:.2Q1 and the establishment of the "Prohibited Area" within 40 feet of any entrance to the polling place or (ii) upon the approval of the local electoral board, inside the structure where the election is conducted, provided that a reasonable person would not observe any campaigning activities while inside the polling place. The local electoral board may approve campaigning activities inside the building where the election is conducted pursuant to clause (ii) when an entrance to the building is from an adjoining building, or if establishing the 40-foot prohibited area outside the polling place would hinder or delay a qualified voter from entering or leaving the building. F. Any local government, local electoral board, or the State Board may make monetary grants to any non- governmental entity furnishing facilities under the provisions of 9?~?-=~.9.1 or?-..1~-=-lmI for use as a polling place. The proposed easement supported construction of a new storm drain pipe from the intersection of Reserve Avenue and Jefferson Street to the Roanoke River needed for the development of the Riverside Corporate Centre. The Plat showing the proposed easement was recorded in M B 1 Page 3598 in the Office of the Clerk of the Circuit Court of the City of Roanoke. During project construction the pipeline alignment was modified to avoid site features and existing landscaping, and the pipeline was not installed within the approved easement area. The easement previously approved has been revised to reflect the actual location of the storm drain pipe. It is necessary to vacate the previous easement and reserve a new easement corresponding to the actual installed pipe alignment. A public hearing is required before the Deed of Reservation may be revised. Considerations: The Deed of Reservation will allow the placement of a public storm drain easement on the above referenced parcel in connection with the development of the Riverside Corporate Centre. The positions were developed to coordinate prosecutorial efforts among independent jurisdictions, reduce fractional and duplicate prosecutions, enhance the recovery of criminal assets, and utilize federal, state and local resources to assure maximum prosecutorial effectiveness and to provide specialized prosecutorial resources to the regional drug enforcement effort. The Commonwealth's Attorneys of Craig County, Franklin County, Roanoke County, and the Cities of Roanoke and Salem applied on October 9, 1987, to the Commonwealth's Attorneys' Services Council, the State agency responsible for the administration of the grant money to fund a Multi-jurisdictional Special Drug Prosecutor. City Council accepted the Multi- jurisdictional Special Drug Prosecutor Grant in April, 1988, and a full-time Special Drug Prosecutor was hired in july, 1988. Annual re-application for this funding is required. Considerations: On April 15, 1994, funding for the Drug Prosecutor's Office was transferred from the Commonwealth's Attorneys' Services Council to the Compensation Board. The Compensation Board approved funding for the Drug Prosecutor in the amount of $96,944 on May 1,2011, and funding will continue through June 30, 2012. The local match is $30,535 for a total of $127,479. Funding for the local share is available in General Fund - Transfer to Grant Fund (account number 01-250-9310-9535). Recommended Action: Accept funding from the Compensation Board in the amount of $96,944 with the City providing local match funding in the amount of $30,535. Authorize the City Manager to execute the requisite documents to obtain the funding from the Compensation Board. All such documents shall be reviewed and approved as to form by the City Attorney. WHEREAS, State financial assistance for mandated and high priority programs, including public education, health and human services, public safety and constitutional officers, is $800 million less in FY12 than in FY09; WHEREAS, cities and counties must balance their budgets during a time in which future state assistance is umeliable, federal stimulus dollars are dwindling, and real estate assessments are declining; WHEREAS, the Appropriation Act contains $60 million in across-the-board cuts to cities and counties for both FYll and FY12, under which localities are required to either elect to take reductions in particular state aid programs, or to send the State a check for the amounts determined by the Department of Planning and Budget ("Local Aid to the State"); WHEREAS, the reductions are applied to essential services, including law enforcement, jail administration; foster care and child protection services, election administration and social services; WHEREAS, the City .of Roanoke does not have the authority to unilaterally decide to discontinue providing services such as election administration or to refuse to house and care for State prisoners in local and regional jails; WHEREAS, the State budget cuts are not accompanied by any reductions in state- imposed mandates, standards and service requirements, nor do they provide any administrative flexibility for local agencies; - WHEREAS, the City of Roanoke remitted $1,458,982 in FYll and will be required to remit another $1,497,985 in FYI2; WHEREAS, cities and counties will have provided the State with $220 million by the close ofFYI2 for this "Local Aid to the State" program; WHEREAS, these reductions shift State costs to local taxpayers and artificially increases the amount of state surplus revenue; WHEREAS, State revenues have begun to recover and the State is expecting to have a revenue surplus for the second year in a row; WHEREAS, revenue collections for the City of Roanoke continue to reflect the struggling housing market; and WHEREAS, the State should not shift its share of the costs for mandates and responsibilities to local governments; NOW THEREFORE BE IT RESOLVED by the Council of the City of Roanoke that: I. C ' 2 CITY COUNCIL AGENDA REPORT To: Meeting: Subject: Honorable Mayor and Members of City Council September 6, 2011 Resolution to Request Restoration of Funding to Localities Background: Du ring the 2008 Session of the General Assembly, one of the strategies utilized to balance the budget for the Commonwealth of Virginia was the implementation of State Reductions in Aid to Localities which totaled $50 million. The reduction was increased to $60 million during the 2010 General Assembly. The State based the reductions on the level of funding that is provided to localities for various offices and programs. The office and programs included that impact the City of Roanoke include: · Registrar/Electoral Board · Sheriff/Jail · Commissioner of the Revenue · Com monwealth Attorney · Treasurer · Library Aid · Rolling Stock Tax · Recordation Tax · Social Service - Comprehensive Services Act · Social Service - General Relief · House Bill 599 - Local Law Enforcement · Virginia Juvenile Community Crime Control Act (VJCCCA) · Juvenile Detention Center Considerations: The Commonwealth of Virginia Department of Planning and Budget, as it has since the inception of the reductions, outlines three methods, one of which may be selected to manage the reduction in the flow of revenue from the State to each locality. They are: · Reduce direct revenue for each program based on the State calculated reduction for each program; or · Reimburse the state for the revenue reduction; or · Use a combination of direct program revenue reductions and reimbursement payment. The City of Roanoke uses the reimbursement method and reimburses the State for the revenue reduction. Since FY, 2009, the City has returned approximately $3.8 million, with approximately $1.5 million budgeted to be returned to the Commonwealth in FY 201 2. Operationally, the City has reduced expenditure budgets accordingly to accommodate the required reductions. In light of these reductions combined with the economic downturn, we have experienced significant reductions in City operations. VML has asked that each locality's governing body adopt a resolution asking the Governor and members of the General Assembly to support the reversal of the $60 million annual reduction for FY 2012 and eliminate the Aid to Localities reduction in the budget submitted for FY 2013 and FY 2014. Recommended Action: '--. A public forum was held on September 1, and written comments will be accepted until September 12, 2011. This Plan eliminates provisions contained in earlier drafts for extending the Roanoke River Greenway to Explore Park and provisions for developing an integrated system of trails that can -be shared by hikers, equestrians and mountain bikers. The plan includes as an alternative volunteer construction of a shared use trail along the road connecting the Parkway to Explore Park. The Plan continues to propose closing approximately 40 unauthorized social trails that provide access to the Parkway for non-motorized users and replacing them with eight authorized trails when resou rces are available. In 2007 the City of Roanoke responded to the first Trail Plan Environmental Assessment with a letter supporting the Chestnut Ridge Loop for a one-year pilot project to evaluate allowing Parkway trails to be shared by hikers, equestrians and mountain bikers; supporting completion of connections to the Mill Mountain trail system; and legitimizing social trails wherever feasible. In 2008, the City responded to the Parkway's draft General Management Plan, which did not include mention of the shared use pilot project for the Chestnut Ridge Loop, by requesting a revision to the Plan to include mountain bike access to Parkway trails. Considerations: An interconnected trail sysl~m is important to Roanoke's healthy living initiatives, quality of life and unique community brand, and completion of the Roanoke River Greenway is our area's number one recreational goal. The proposal to eliminate the Greenway extension across the Parkway to Explore Park was developed by the Parkway without consulting the Greenway Commission or local governments. The Parkway provides no justification for this change, which effectively prohibits the Greenway Commission from pursuing grant funding to complete the Greenway. 1 2 Closing approximately 40 social trails severely limits access to the Parkway and its trail system by hikers, equestrians and cyclists who live in and visit the Roanoke Valley. Most of the unofficial social trails are short, virtually invisible, have been in place for many years and have minimal environmental impact. The National Park Service's environmental assessment indicates that all environmental impacts from expanded trail use and expanded trails are manageable, and documents that mountain biking and hiking have similar environmental impacts, which are less than equestrian impacts. Continuing to restrict Chestnut ,Ridge more severely than the adjacent City trails on Mill Mountain is a disappointing limit on the local community, tourists, Parkway visitors and Roanoke Campground users. The Parkway did not recognize the substantial fundin'g and labor expended by the Greenway Commission and volunteers in rebuilding Chestnut Ridge Loop to the standards requested by Parkway staff to accommodate shared use by hikers, equestrians and mountain bikers. Recommen'ded Action: Approve the attached resolution supporting modification of the Roanoke Valley/Blue Ridge Parkway Trail Plan Environmental Assessment to include ,the eastern extension of the Roanoke River Greenway to Explore Park, the one year pilot project to evaluate !shared use of the Chestnut Ridge Loop by hikers, equestrians and mountain bikers, and leaving the social trails open until feasible alternative paths are funded and developed. Two grants of $12,410 each were awarded on 8/15/11. For the first grant, the Urban Forestry Planner will share Urban Tree Canopy data from VDOF and i-Tree data from Virginia Tech with the public, examine reforestation opportunities in the City, publicize urban forestry activities and maintain the Commemorative Tree Program. With the second grant, the Urban Forestry Planner will coordinate the Roanoke Tree Steward Program. There are currently 43 Tree Stewards, each of whom took 30 hours of class work/Held training and will give back 30 hours of volunteer work in their first year (20 hours in subsequent years). They care for City-owned trees, plant trees and seedlings, and educate the public with programs and with booths at events such as Earth Day. The Urban Forester's time with these programs serves as match to the grants. All activities are consistent with the Urban Forestry Plan adopted as an element of Vision 2001-2020. Considerations: City CounCil action is needed to formally accept and appropriate the grant funds and to authorize execution of. Memoranda of Agreements (MOA) between VDOF and the City. Copies of the MOAs are attached to this letter. Overhead costs that will be allowed for match can be negotiated on a project- by-project basis. ' (4) ASSISTANCE: The Party of the First Part agrees upon request of the Party of the Second Part to furnish, or otherwise make available to the Party of the Second Part, copies of existing non-proprietary materials in the possession of the Party of the First Part that are reasonably related to the subject matter of this agreement and are necessary to the Party of the Second Part for completion of his performance under this agreement. If a notice of breach is given and the Party ofthe Second Part has not substantially corrected the breach within the sixty (60) days of receipt of the written notice, the Party of the First Part shall have the right to terminate this Agreement. In tl}e event of rescission, revocation or termination, all documents and other materials related to the performance of this Agreement shall become the property of the Department of Forestry. , (8) COLLATERAL CONTRACTS: Where there exists any inconsistency between this Agreement <l;nd other provisions of collateral contractual agreements which are made a part of this Agreement by reference or otherwise, the provisions of this Agreement shall control. (4) ASSISTANCE: The Party of the First Part agrees upon request of the Party of the Second Part to furnish, or otherwise make available to the Party of the Second Part, copies of existing non-proprietary materials in the possession of the Party of the First Part that are reasonably related to the subject matter of this agreement and are necessary to the Party of the Second Part for completion of his performance under this agreement. If a notice of breach is/given and the Party of the Second Part has not substantially corrected the breach within the sixty (60) days of receipt of the written notice, the Party of the First Part shall have the right to terminate this Agreement. In the event of rescission, revocation or termination, all documents and other materials related to the performance of this Agreement shall become the property of the Department of Forestry. Developing the 2.6 miles of trail is expected to cost $6-7 million. In cooperation with the Regional Greenways Commission, the City plans to apply annually for maximum Transportation Enhancement Program fundinguntil this critical trail connection is completed. The first grant request of $957,300 has been submitted. In addition to the grant requests, continued support will be required for the project from citizens, neighborhood groups, businesses, civic organizations, and local governments. Considerations: The City has been notified that the Board of Pathfinders for Greenways, Inc. has voted to transfer $100,000 of its Bridge the Gap funds to the City and the Greenway Commission has voted to transfer $25,000 for a total of $125,000 to support the development of the Roanoke River Greenway - Bridge Street to Salem connection. In conjunction with other capital funds, this transfer will allow the engineering and design of this trail section to begin. The anticipated cost of the engineering and design phase is approximately $700,000. Trinkle The Honorable Mayor and Members of the Roanoke City Council Roanoke, Virginia Dear Mayor Bowers and Members of Council: At its September 1, 2010 meeting, the Audit Committee reviewed a report on City Council Expenditures for the year ending June 30, 2010. In the report's conclusion, Municipal Auditing encouraged City Council and administrators to develop a more practical and thorough policy for discretionary expenditures. City officials researched model discretionary expenditure policies and based on a sample of policies from other local governments developed revisions to the Travel and Expense Policy for City Council, originally adopted by City Council at its April 21, 2008 meeting to include discretionary expenditures. At its meeting held on March 1, 2011, the Audit Committee reviewed the revisions, offered suggestions and asked that the final revisions be shared with the Council for its input and final adoption. The proposed changes to the Council's Travel and Expense Policy are outlined as follows: Sect 1. Original Policy Subjected Members of City Council to all City Administrative Procedures pertaining to purchasing, travel, and business expenses. Entitled "Gratuities" [Moved to Section 8] Proposed Revision Provides exceptions, as described in Section 7 of the Travel & Expense Policy. 6. 7. Changes title to "Community Events" Inserts "Rewards and Special Recognitions" section for recognizing: 1. Exceptional Performance 2. Retirements 3. Serious Illness or Death 4. Council recognizes the responsibility of its Members to represent the City on various occasions, and it is the intent of this policy to guide Council Members as to the appropriateness of incurring expenses for such occasions. Council also acknowledges the need for an equ itable policy, one that is in keeping with its obligation to be accountable to the citizens of the City of Roanoke. The following provisions relating to travel and other reimbursable expenses shall apply to the Members of City Council: 1. Members of City Council shall be subject to City Administrative Procedures pertaining to purchasing, travel, and business expenses, except as otherwise provided in Subsection 7. 2. Documentation: It shall be the duty of the City Clerk's Office to prepare the required documents for travel and business expenses. for Members of Council as prescribed by administrative procedures. The Member of Council for whom forms are prepared shall review them for accuracy and personally sign the forms. The Director of Management and Budget shall review these forms for completeness and compliance with City policy before signing as approver. 3. Budgeting: Each Member of City Council shall be allocated funds for phone and internet services, dues and memberships, training, business meals, gratuities, and postage through the City's annual budgeting process. Budget transfer requests must be justified in writing and shall require approval by a simple majority of the other Members of City Council. 4. Meals with Members of Council, Council-Appointed Officers, or members of City boards and commissions will be reimbursed to the extent funding is available. Meals that are principally related to understanding and promoting the mutual interests of the citizens of Roanoke shall qualify for reimbursement to the extent funding is available. The names of the persons who dined, the purpose of the meeting and an itemized receipt must be provided to the City Clerk's Office for appropriate processing. 5. Boards and Commissions: Travel is authorized for Members to attend meetings of the Virginia Municipal League and the National League of Cities, and for service on committees or as officers of such organizations. In addition, the Mayor is authorized to attend the annual conference of the U. S. Conference of Mayors. Travel is also authorized for Council Members to attend meetings of organizations or groups to which they have been appointed by Council to represent the City. All other travel by Members of Council shall be approved in advance by the Council. If advance approval by Council is not feasible, advance approval from the Mayor shall be obtained. The City Clerk shall sign all travel vouchers submitted by Council Members certifying that the travel has been approved by Council and is in compliance with this policy. 6. Community Events: As government dignitaries, Members of City Council are expected to represent the City at events hosted by charities and other public service oriented organizations. The cost of admission to such events will be paid by the City to the extent provided for within each Council Member's budget. A printed invitation or announcement of the event indicating the date, sponsoring organization and costs must be provided to the City Clerk's Office for payment or reimbursement. 7. Rewards and Special Recognition: Roanoke City Council believes that, under certain circumstances, it is appropriate to recognize hard work, exceptional achievements and certain critical events relating to its employees and citizens. In this regard, Council's appreciation may be expressed through the provision of a tangible reward or a non-monetary expression of gratitude or sympathy. Therefore, City Council may elect to approve the expenditure of City funds for recognitions that generally fall within the following categories: 1) Exceptional performance of an employee, individual, or g rou p; 2) Retirement of an employee or individual who has rendered ~xceptional service, extraordinary longevity, etc.; 3) Serious illness or death; 4) Other: It is acknowledged that occasions may arise that are worthy of recognition by City Council which are not otherwise addressed in this Policy. In such cases, the City Clerk may expend funds for such purpose, after having obtained the informal concurrence of a majority of the members of City Council.. 8. The City Clerk's Office shall provide an overview of appropriate administrative procedures and a copy of this policy to the Members of Council, as well as any future revisions. 9. The City Clerk's Office shall provide Members of Council with a monthly report of detailed expenditures. 10. ,The Municipal Auditing department shall review Council expenditures annually for compliance with this policy.
