Sincerely, David A. Bowers Mayor DAB:ctw Briefing #1 CITY COUNCIL AGENDA REPORT To: Honorable Mayor and Members of City Council Meeting: August 6, 2012 Subject: Fair Housing Board Annual Report to Council The Fair Housing Board is pleased to provide this Annual Report for 2012 to City Council. As you will read below, the Board undertook a number of activities during the past year and is looking to a new year of both opportunities and challenges. Purpose and Function: Under the City Code, the Fair Housing Board is to serve as a source of public information on fair housing through outreach, education and training. Through a modest annual allocation from the City's Community Development Block Grant (CDBG), detailed below, the Board has continued efforts to raise awareness. Membership: During the past year, the Board worked diligently to secure a full complement of members. This was accomplished by the appointment of three new members, bringing the Board to a full membership of 7 active and involved citizens. Unfortunately one member moved out of state and therefore had to resign. The Board is actively working to fill that vacancy. Outreach and Education Activities: The Fair Housing Board is pleased to report a significant increase in activities and outreach compared to prior years. In line with the Board's mission, two Fair Housing Seminar sessions were held at the Jefferson Center. The first session, held in October, 2011, was led by David Beidler of the Legal Aid Society and Grimes Creasy of the law firm Johnson Ayers & Matthews. This session focused on the legal aspects of the Fair Housing Act and drew 65 property managers, realtors and citizens. The April, 2012 session was led by Mally Dryden -Mason of the Virginia Fair Housing Office, and was similar to previous events and drew 235 participants. In August of 2011, the Board conducted a presentation to residents of Melrose Towers with about 40 in attendance. The Board also held a follow -up phone -in clinic. In February and again in May of 2012, the board conducted presentations to Trust House residents, with a total of 48 attending. The Board also conducted a presentation to Trust House staff in July with regards to identifying and reporting of fair housing complaints. 9 staff members attended. To accompany the proclamation of the month of April as Fair Housing Month, the Board held a poster contest for elementary school children. There were 39 entries, an increase from 12 last year. All entries were displayed in the Main library. The winning entry was displayed on a billboard and on the cover of the Fair Housing Board's booklet "Fair Housing: What You Need to Know ". The runner up entry was also displayed on a billboard. The Fair Housing Board sponsored and provided input for an Analysis of Impediments to Fair Housing Choice, which was presented to Council in a separate report in March. The Analysis of Impediments is a requirement of the Department of Housing and Urban Development of all localities utilizing HUD funds, and provides a comprehensive review of policies and practices affecting peoples' right to live anywhere they can afford. Additionally, the Board purchased and donated to all 18 City elementary schools copies of a book produced by the Greater New Orleans Fair Housing Action Center entitled The Fair Housing Five and the Haunted House, which tells the story of a group of children who investigate fair housing complaints against a landlord. Statistics: Given the Board's education and outreach focus, persons who contact the City about possible fair housing issues are provided information and referred to the Virginia Fair Housing Office for additional assistance and to file complaints, if they desire to do so. The Board periodically obtains the statistics on the complaints filed with the State. In addition, the Board also attempts to obtain data from local agencies such as TAP, Legal Aid and the RRHA that are often contacted by persons who believe a fair housing rights issue has occurred. This data helps the Board focus its education and outreach. For the July 2011 to June 2012 period, two incidents of alleged housing discrimination were reported by the local agencies to the Fair Housing Board. The protected classes affected were familial status (1) and disability (1). One of these incidents was filed by the complainants with the Virginia Fair Housing Office and /or the U.S. Department of Housing and Urban Development (HUD). Budget: As stated earlier, to help support its activities, the Board receives an annual CDBG allocation, currently set at $15,000. Based on prior activities, the budgeted uses planned for the FY 2012 -2013 period are shown in the table below. As recommended by the Analysis of Impediments, allocations to Fair Housing Board activities were increased to 1% of total CDBG funding. The additional $10,000 will be allocated to staff costs. Fair Housing Board 2012 -2013 Budget What Lies Ahead: For FY 2012 -2013, the Fair Housing Board has several priorities: The first priority will be to fill vacant positions and build cohesiveness among board members. This will be accomplished with board training and team building exercises, utilizing City of Roanoke Human Resources and other sources. The second is to organize and prepare for Fair Housing Seminars. A recommendation coming from the Analysis of Impediments was for the Fair Housing Board to concentrate its efforts more on active outreach rather than on advertising. Thus, the Board has plans to increase the number of seminars for Realtors, property managers, property owners and mortgage lenders from semi annually to 3 times per year. The board will continue to schedule presentations to both resident groups and staff of residential programs such as Trust House. Third, the Board will continue to strive to further enhance its efforts in raising public awareness regarding fair housing rights and responsibilities. The board will continue to distribute its booklet "Fair Housing: What Everyone Should Know ", continue its advertising and billboard campaign, and contract with an agency to provide paired testing of rental properties. Using the results of this testing, the Board will tailor outreach programs to inform both property owners and the public. Background South Commonwealth Partners, LLC, a South Carolina Limited Liability Company (Purchaser), is seeking to purchase an approximately 11,500 square foot ground floor portion of the Market Garage and a portion of the associated air rights above the facility located at 25 Church Avenue, SE (Tax Map No. 401 5004) from the City of Roanoke (City) for $800,000 in order to develop a hotel on a portion of the property. Purchaser intends to convert the 9,689 square feet of City -owned first floor vacant retail space as well as an additional 1,811 square feet in the garage for use as a full - service lobby and additional hotel - related operations. Purchaser also intends to acquire a portion of the air rights above the Garage upon which Purchaser will construct a hotel of approximately 123 rooms. Upon approval and execution of a Sales Contract, the City and Purchaser will also negotiate a separate, but related, Development Agreement outlining the specific roles and responsibilities of the parties for the development of the hotel, as well as a Parking Agreement, and a Maintenance Agreement. A proposed Sales Contract and detailed report to the City Council will be included in the August 20, 2012 agenda package. Recommended Action: Authorize the scheduling and advertising of a public hearing for the proposed sale of an approximately 11,500 square foot portion of the Market Garage and a portion of the associated air rights to South Commonwealth Partners, LLC., such public hearing to be held on August 20, 2012, at 7:00 pm. 2 l7"'--- - - - - -- Christopher P. Morrill City Manager Distribution: Council Appointed Officers R. Brian Townsend, Assistant City Manager for Community Development Susan Lower, Director of Real Estate Valuation Robert Ledger, Economic Development Manager Marc Nelson, Special Projects Coordinator Y _ c uo I COUNCIL CITY - es • • REPORT t- To: Honorable Mayor and Members of City Council Meeting: August 6, 2012 Subject: Public Hearing for Authorization of the Issuance of Debt for School Capital Projects Background: The Commonwealth has granted Roanoke City Public Schools an opportunity for $2,014,210 in interest -free Qualified Zone Academy Bonds (QZAB). The QZAB initiative is a federal program that allows lenders, private business and schools to form a mutually beneficial partnership to support education. The QZAB allocation can be applied to certain schools with 35 percent or greater free lunch eligibility and that meet certain other requirements. As a result of the low cost of borrowing associated with QZABs, we may benefit from using this allocation in lieu of the City's typical general obligation bonds to fund eligible school projects. These QZABs must be issued by December 31, 2012. The FYI - 17 adopted Capital Improvement Program (CIP) includes planned debt issuance of $2 million in FYI and $5 million in FYI for School Capital Projects. Based on the timing requirements of the QZAB program, projects initially planned for FYI will be best suited for this program. To proceed with the required process, a public hearing on issuance of this debt will be needed. Issuing debt of approximately $2,015,000 in FYI 3 rather than FY14 will have a minimal impact on the City's debt policy and on school debt service expenditures. It will have no impact on the long term amount of debt issued as it represents an increased in planned issuance in FYI and corresponding decrease in FYI 4. Recommended Action: Authorize a public hearing to be scheduled at City Council's 2:00 p.m. meeting on September 4, 2012, or as soon thereafter as the matter may be heard, on the issuance of a general obligation bond not to exceed $2,014,210 for qualifying School Capital Projects. This will entail proper notification of such public hearing on or about August 20`h and 271°. L0 ANN H. SHAWVER Director of Finance Distribution: Council Appointed Officers Rita D. ATTEST: City Clerk. CITY COUNCIL AGENDA REPORT To: Honorable Mayor and Members of City Council Meeting: August 6, 2012 Subject: Acceptance of Continuation Funding of Edward Byrne Memorial Justice Assistance Grant UAG) Funding — Intensive Supervision Juvenile Probation Program Background: The Virginia Department of Criminal Justice Services has awarded the City of Roanoke federal funding from the Edward Byrne Memorial justice Assistance Grant program for an Intensive Supervision Juvenile Probation Program for the third consecutive year. The amount of the grant is $48,748 for a one year term beginning July 1, 2012. The grant requires a local match of $3,451. The local match is available and will be transferred from the Grant Matching Fund account (35-300-9700-5415). An additional transfer from the General Fund to the Grant Fund (01- 250- 9310 -9535) in the amount of $1,332 will be needed to fund the 3% pay raise effective July 1 , 2012. The Intensive Supervision Juvenile Probation Program is operated by the City of Roanoke Human Services Department, Juvenile Justice Services Division with a cooperative supervision agreement with the 23 -A Court Service Unit (CSU). The funding provides for one Specialized Probation Officer to handle an intensive caseload of high risk youth with drug trafficking offenses. The focus of this program is to reduce recidivism of non - violent offenders and improve the outcomes of youth in aftercare and reentry. The program uses the "Intensive Supervision Juvenile Probation" evidence -based strategy from the Office of Juvenile Justice and Delinquency Prevention (OJJDP) Model Programs Guide. The program has four intensive program phases designed to provide assessment and supervision, counseling, community service and reparation, and preparation for the youth's independent functioning in the community. Considerations: Services for this specialized population of juvenile offenders will continue uninterrupted as they progress through program phases. More frequent and intensive probation supervision and intervention leads to the goals of reduction of number of youth with drug trafficking offenses, prevents recidivism, and diverts juvenile offenders from more serious crimes that can lead to incarceration. In the program's first year, no youth participating in the program were charged with new drug offenses. Recommended Action Adopt a resolution accepting the Edward Byrne Memorial Justice Assistance Grant funding from the Virginia Department of Criminal Justice Services Grant # 1 3- C2134AD1 1 for the Intensive Supervision Juvenile Probation Program. Authorize the City Manager to execute any forms required by the Virginia Department of Criminal Justice Services in order to accept these funds; such documents to be approved as to form by the City Attorney. Adopt the accompanying budget ordinance to establish revenue estimates for Federal grant funds of $48,748. Transfer funding in the amount of $3,451 from the Grant Matching Account fund (35- 300 - 9700 - 5415), and $1,332 from the General Fund (01- 250- 9310 -9535) to the Grant Fund. ATTEST:,,.A City Clerk. * CITY COUNCIL AGENDA REPORT To: Honorable Mayor and Members of City Council Meeting: August 6, 2012 Subject: Positive Action in the City of Roanoke Background: In May, 2012, the City of Roanoke, in collaboration with Family Service of Roanoke Valley, applied to the Virginia Department of Criminal Justice Services under the juvenile Justice and Delinquency Prevention Title II Grant Program, to fund a research -based prevention program found to be effective at significantly enhancing academic achievement, family relationships, violence prevention and substance use avoidance. As the grantee, the City of Roanoke has received notification of award in the amount of $65,000 in Federal funds, with a required local match of $32,500, which will be provided by Family Service of Roanoke Valley in the form of "in -kind services ", for a total award of $97,500. These funds must be expended or obligated during the award period of July 1, 2012, tojune 30, 2013. Consideration: The City of Roanoke Title II prevention proposal will replicate the Positive Action youth crime and substance use avoidance model program with 150 City of Roanoke children, enrolled in four after school programs. The goal is to engage 150 first through eighth graders and their families July 1, 2012 - June 30, 2013, in the evidence -based Positive Action program model. Services will be provided by prevention specialists of Family Service of Roanoke Valley (FSRV), working with the Boys and Girls Club of Southwest Virginia (Roanoke City's Ninth Street site), the West End Center, Hurt Park's Community Learning Center, and Lincoln Terrace's Community Learning Center. The long term goal is to prevent youth crime (including substance abuse) by strengthening pro - social community involvement and family engagement. Annually, planned outcomes are to document increased protective factors like commitment to learning (improved school attendance and grades), perception of harm of substance use, social competency and anger management skills, parental comprehension of the importance of modeling healthy and productive behaviors, and positive parental disciplinary skills. Recommended Action: Accept the Department of Criminal Justice Services Juvenile Justice and Delinquency Prevention Title II grant in the amount of $65,000 and authorize the City Manager to execute the grant documents substantially similar in form to the attached contract with Family Service of Roanoke Valley. All documents shall be approved as to form by the City Attorney. Adopt the accompanying budget ordinance to establish a revenue estimate in the amount of $65,000 and to appropriate the same amount to Fees for Professional Services in an account to be established by the Director of Finance in the Grant Fund. - -- - ----- - - - - -- Christopher P. The City of Roanoke will contract services with Family Service of Roanoke Valley as the professional provider of the prevention program entitled Positive Action in the City of Roanoke. Family Service is a private, not- for -profit agency who has provided human services in the City of Roanoke for 110 years. During the past 15 years this agency has specialized in youth development and prevention programming applying the best practices of service learning, parent education and prevention- focused life skills development among Roanoke City's youth. This expertise provides justification for purchasing the professional services of Family Service of Roanoke Valley. Personnel /employees — City of Roanoke is the fiscal agent and project administrator for the project, which will be implemented by Family Service of Roanoke Valley on a purchased professional services basis. 2. Consultants: a. For individuals to be reimbursed for services on a fee basis, list each type of consultant or service, the proposed daily fee rate, and the amount of time to be devoted to such services. b. Family Service is the organizational consultant through whom the following services would be purchased, including the subcontracted services from the after school program partners. To implement Positive Action the model calls for adequate staffing to provide social competency sessions weekly, service learning weekly, a series of seven parent education classes, and a series of seven counseling group sessions. To adequately staff Positive Action 1 FTE is recommended approximately per 65 youth. In Roanoke the target is to reach 200 youth and the following staffing structure would be made possible by the proposed budget, relying on the extensive partnerships with the after school program partners. Family Service of Roanoke Valley would staff Positive Action as follows: Project Director (salary) $54.17 /hour X 240 hrs = $13,000 In -kind of $54.16 X 238 hrs = $ 13,000 Program Coordinator (salary + benefits)$23.33 /hr X 620 hrs = $14,464 Amt funded by DCJS Prevention Grant = $ 14,464 In kind of $23.33 X 150 hrs = $ 3,500 Prevention Specialist (salary+benefits) $17.42/hr X 2,260/ hrs = $39,369 Amt funded by DCJS Prevention Grant = $ 39,369 Total to be funded by DCJS for Family Service staffing = $ 53,833 Total to be provided in kind for Family Service staffing = $ 16,500 After school program partners (9 program sites) would provide the after school setting where Positive Action will occur, providing on site supervision as follows: West End Center provides a site serving 2nd through 5th graders, the Presbyterian Community Center will provide one site for 3rtl through 51h graders, Boys and Girls Clubs of SW Virginia serves 3rd through 5`" graders , Community Youth Program at St. John's has 4" through 51" graders, YMCA has K thru Soh graders, Lincoln Terrace School has 4'" and 5'" graders, Fairview School 4`" and 51" graders, Garden City School 4P and 5'" graders, and Hurt Park School has 4t" and 5'" graders. Each of nine partner sites spends approximately $116 per child per 30 days of services (30 weeks of the school year which is 36 weeks long — allowing for first 5 weeks of start up time and ending one week before school ends): $116 X 200 children = $23,200. ATTEST: ry t1r! City Clerk. CITY COUNCIL AGENDA REPORT To: Honorable Mayor and Members of City Council Meeting: August 6, 2012 Subject: Project Back on Track in the City of Roanoke Background: In May, 2011, the City of Roanoke, in collaboration with Carilion Clinic Department of Psychiatry and Behavioral Medicine, applied to the Virginia Department of Criminal Justice Services under the Juvenile Justice and Delinquency Prevention Title II Grant Program, to fund an evidence -based treatment program designed to reduce youth substance use and youth crime. Family Service of Roanoke Valley will continue to work with Carillon Clinic to provide the wraparound case management, service learning, life skills and parent education services integral to the evidence -based program model and Carillon Clinic will oversee the project, directly providing the counseling and psychiatric services. As the grantee of such funds, the City of Roanoke has received notification of award in the amount of $31,482 in Federal funds. There is no local funding match requirement for this grant. These funds must be expended or obligated during the award period of July 1 , 2012, thru June 30, 2013. Consideration: Project Back on Track is an evidence -based program model that Carilion Clinic has adopted for replication in the City of Roanoke to address the problem of disproportionate minority contact and substance use among adolescents (ages 1 2 -1 7). In Year II, the expansion to include the County of Roanoke and the City of Salem was successful in bringing the project to its potential capacity. No Roanoke City client was placed on awaiting list. All were served upon referral in a timely manner. In Year III it is proposed to again include service to County of Roanoke and City of Salem youth, in addition to the priority population of City of Roanoke youth. Project Back on Track uses counseling (individual, group, and family therapy), parent education, psycho - educational life skills, case management, and mentoring and service learning to reduce the substance use - related criminal behaviors of juveniles referred by the courts, professionals or schools. Project Back on Track in Roanoke is completing its second year of implementation, demonstrating success at keeping youth and their families engaged in its intensive set of services. Nationally, the project documented its success as a diversionary program, decreasing criminal recidivism and reducing substance using behaviors. In Year III it is the project goal to engage a total of 25 youth and 25 parents /legal guardians (prioritizing African American clients) to achieve the objective of avoiding subsequent criminal offenses and abstinence from substance use. In Year III (July 1, 2012 - June 30, 2013), the Carilion Clinic will continue to assume the role as lead agency in the project through contracted services with the City of Roanoke and the procurement of appropriate services from Family Service of Roanoke Valley. Recommended Action: Accept the Virginia Department of Criminal Justice Services Juvenile Justice and Delinquency Prevention Title II grant in the amount of $31,482, and authorize the City Manager to execute the grant documents substantially similar in form to the attached contract with Carilion Medical Center D /B /A Carilion Clinic (Psychiatry and Behavioral Medicine). All documents shall be approved as to form by the City Attorney. Adopt the accompanying budget ordinance to establish a revenue estimate in the amount of $31,482 and to appropriate the same amount to Fees for Professional Services in an account to be established by the Director of Finance in the Grant Fund. 3 `_ - - - - -- Christopher P. Carilion Medical Center Page 2 Project Back on Track programming will include counseling, service learning, life skills, case management, mentoring, psychiatry and parenting classes to address a vital community priority: to reduce youth crime and to impact a prevalent cause of youth crime, substance abuse, among our youth. Another aim of the project is to impact the problem of disproportionate minority contact. ARTICLE II GOALS AND OBJECTIVES The Project Back on Track proposal "a written in response to the recent surveys showing the problematic substance use among the Roanoke Valley's youth: especially cocaine, marijuana, prescription drugs (opiates), alcohol, ecstasy, and heroin use. Such substance use contributes significantly to youth crime. . Substance use in the Localities exceeds national levels; in the case of cocaine by two times the national level, in the case of heroin by three times the national level, and in the case of methamphetamines and ecstasy by two times the national level. These statistics indicate the need for Project Back on Track, proven to effectively reduce youth substance use across gender and racial differences. In Year III the project goal is to engage at least 25 Roanoke Valley youth ages 13 — 17 and 25 parents/legal guardians to achieve the objectives of: (1) avoiding subsequent criminal offenses and (2) preventing further substance use among the youth participants. After the completion of the project, VDOT transfers any acquired rights -of -way and easements to the City of Roanoke for operating and maintenance purposes. Recently, VDOT, upon a review of their records, confirmed that two projects undertaken in the City during the 1970's and 1980's were never closed out formally with the transfer of acquired rights -of -way and related easements to the City from VDOT. The first project was improvements to Franklin Road, S.W. between Brandon Avenue, S.W. and McClanahan Street, S.W., and the second project was improvements to Hershberger Road, N.W. between Cove Road, N.W. and Williamson Road, N.E.. Considerations: VDOT staff has prepared documents to formally transfer the rights -of -way acquired associated with these specific capital improvement projects: 0101 - 128 -102, RW -201 (Hershberger Road: Cove Road to Williamson Road) 0220 -128 -103, RW -201 (Franklin Road: Brandon Avenue to McClanahan Street) Since both projects were completed several decades ago, the City has been maintaining these acquired rights -of -way. Action by the City at this time does not change or alter previous or ongoing responsibilities of the City for maintenance of these streets. Copies of the proposed Quitclaim Deeds prepared for these two projects by VDOT for the City's consideration and execution are attached to this report for the City Council's information. Recommended Action: Authorize the acceptance of the Operating Rights -of -Way described above, and authorize the City Manager to execute the attached deeds for transfer of Operating Rights -of -Way from VDOT to the City of Roanoke. Such deeds shall be approved as to form by the City Attorney. Christopher P. The Purchaser has proposed the construction of two hotels and one restaurant on the Property. Under the terms of the contract, Purchaser entered into a 60 day Due Diligence Period originally scheduled to expire on May 27, 2012. This period was extended to August 7, 2012 after Purchaser encountered unexpected development constraints related to the existing condition and location of the Property which will impact the cost to develop the Property as proposed. These conditions are as follows: (1) Water Service to the Site - An evaluation of the existing infrastructure by Purchaser's consultant revealed that the six (6) inch water line that presently services the Site is insufficient to meet the proposed needs of the development. Discussions between City staff and representatives from the Western Virginia Water Authority confirmed the existence of two nearby eight (8) inch systems (located in the development to the south and across Valley View Boulevard), each of which could potentially provide adequate water service to the Site. Estimates provided by the Purchaser's consultant determined the costs associated with necessary line extensions and tapping into either of these systems to be approximately $78,000. (2)Asbestos Removal Costs - Purchaser's environmental consultant documented the presence of asbestos in multiple areas of the former school building in addition to those previously identified in the materials and reports provided by the City. This presence will increase the demolition cost of the project. Estimates obtained by the consultant place the cost of removal at no more than $150,000. Considerations These conditions not only affect the Purchaser, but would also likely impact any other responsive offers the City received for the Site. As such, the City and the Purchaser have agreed to a reduction of the purchase price in order to acknowledge these Property constraints and facilitate the necessary extension of water lines to the site as well as the removal of asbestos from the former school building as part of the demolition process, as outlined in the attached document titled "Amendment No. 1 to Purchase and Sale of Real Property" (Amendment). The amended purchase price will be $1,735,000. This Amendment will also add an additional clause that makes closing on the sale of the Property contingent upon the Purchaser having acquired any easements necessary to development the Property as set forth in the Agreement. All other provisions of the Agreement dated March 28, 2012 will remain in full force and effect. Recommended Action Authorize the City Manager to execute an Amendment No. 1 to the Agreement for the Purchase and Sale of Real Property, between the City and NDRA II, LLC in a form substantially similar to the one attached, with the form of such Amendment No. 1 to be approved by the City Attorney. Authorize the City Manager to take such actions and execute such documents as necessary to implement, administer, and enforce such Amendment No. 1 to the Agreement. Christopher P. In the period since May 2012, the Governor has signed a final budget, which enabled the Virginia Department of Education to issue a revised revenue calculation model. This model suggests that RCPS revenue will be approximately $25,000 higher than previously estimated. The Board has also acted to implement changes in the Virginia Retirement System under which employees will pay 1% of the 5% employee contribution in 2012 -13, offset by a hold harmless salary increase of 1.07125 %. This action increased expenditures by approximately $220,000. The School Board thanks you for your approval of the request as submitted. Sincerely, s., Cindy H. The March adoption met the timing requirements set forth in the Charter of the City of Roanoke. On May 8, 2012, the School Board adopted an amendment to include changes contained in the Conference Committee's proposed state budget and updated revenue forecast. This budget was adopted by City Council on May 14, 2012. The final budget was signed by the Governor in May 2012. The Virginia Department of Education was able to issue a revised revenue calculation model. The model suggests that RCPS revenue will be approximately $27,000 higher than previously estimated. The School Board has also acted to implement changes in the Virginia Retirement System (VRS) under which employees will pay 1% of the S% employee contribution in 2012 -13, offset by a hold harmless salary increase of approximately 1.07 %. This will increase expenditures by approximately $215,000. Revenue and expenditure estimates for the Food Services and Athletics Funds have been adjusted to reflect anticipated programs for 2012 -13. Additional expenditures of $438,000 required to coverthe VRS and Athletics Fund increases will be funded by General Fund reserves.
