Recognition of the Platinum Certification Award presented to the City of Roanoke
at the 2012 Virginia Municipal League Conference in Williamsburg, Virginia.
The Mayor read the plaque presented to the City at the conference.
A proclamation declaring October 2012 as Diversity Awareness Month.
The Mayor presented the proclamation to Gwin Ellis, Organization
Development and Learning Coordinator; and Members of the Diversity
Advisory Council.

CITY COUNCIL SETS THIS TIME AS A PRIORITY FOR CITIZENS TO BE

a public hearing for Monday, October 15, 2012, at 7:00 p.m., or as soon
thereafter as the matter may be heard, to consider a request from Roanoke
Valley Swimming, Inc., a non - stock, not for profit corporation, for tax exemption
of real property in the City located at 1130 Overland Road, S. W.
RECOMMENDED ACTION: Concurred in the request.
C -2 A communication from the City Manager requesting that Council schedule
a public hearing for Monday, October 15, 2012, at 7:00 p.m., or as soon
thereafter as the matter may be heard, to authorize a contract for the sale of City -
owned property located at 2051 Blue Hills Drive, N. E., to the Roanoke
Cooperative Association, Limited, commonly known as the Roanoke Natural
Foods Co -op operation of an urban farm.
RECOMMENDED ACTION: Concurred in the request.
C -3 A communication from the City Manager requesting that Council schedule
a public hearing for Monday, October 15, 2012, at 7:00 p.m., or as soon
thereafter as the matter may be heard, to consider a lease agreement for City -
owned property located at 1970 Blue Hills Drive, N. E., to the Roanoke
Cooperative Association, Limited, commonly known as the Roanoke Natural
Foods Co -op to establish and operate an urban farm to provide locally -grown
produce.
RECOMMENDED ACTION: Concurred in the request.
C -4 Reports of qualification of the following individuals:
The Honorable William D. Bestpitch as an Elected Official
representative of the Roanoke Valley - Alleghany Regional
Commission for a three -year term of office ending June 30, 2015;
and as a City representative of the Virginia's First Regional
Industrial Facility for a four -year term of office ending June 30,
2016;
Princess Moyer as a member of the Roanoke Neighborhood
Advocates to replace Braxton Naff for a term of office ending
June 30, 2015; and
Charles E. Hunter, III, as a member of the Economic Development
Authority for a four -year term of office ending October 20, 2016.
RECOMMENDED ACTION: Received and filed.

ITEMS RECOMMENDED FOR ACTION:
Amendment of Chapter 6, Animals and Fowl, Code of the City of
Roanoke (1979), as amended, in order to clarify "zoned for
agricultural use" and to update for consistency with the Code of
Virginia (1950), as amended, and the City's Zoning Ordinance.
Adopted Ordinance No. 39514-100112 (6.1, Council Member
Bestpitch voting no).
2. Authorization to submit application to the Virginia Department of
Transportation Revenue Sharing Program to request Fiscal Year
2014 funding in order to complete seven City projects.
Adopted Resolution No. 39515 - 100112 (7 -0).
COMMENTS BY CITY MANAGER.
The City Manager shared the following comments:
Roanoke recognized for Bright Ideas in Government
• Last week, Harvard's Ash Center for Democratic Governance and Innovation
recognized Roanoke for its "Technology Initiatives for Building Placards"
program.
• The city's entry was its idea to apply Quick Response (QR) codes to permit
placards, linking customers to the Online Permit Center where they can see new
building activity and the daily inspections calendar online via smartphones or
tablets
• Roanoke's idea was selected as one of 111 innovative government initiatives
included in the Ash Center's 2012 Bright Ideas in Government cohort.
• Roanoke Times editorial page gave a nod to this recognition in its Sept. 29
Saturday Shorts section.
Fall Waterways Cleanup 2012
• Volunteer teams from all over the Roanoke Valley will join forces to remove trash
from our streams, creeks, and rivers and their vicinities. An after - cleanup
celebration will be held at Wasena Park. Sponsors will supply food, drink, and
entertainment.

2012 Virginia Women's Conference
• Senator Mark Warner, Virginia Tech Roanoke Center, Hollins University, the City
of Roanoke, and the Roanoke Valley Convention & Visitors Bureau will host the
2012 Virginia Women's Conference in October. The conference, now in its third
year, will explore tools for success by providing advice from experts on health,
careers, personal development, business, education, finance and retirement.

Elmwood Park Improvement Project
• Last week the City received three bids for the project, higher than the project
budget.
• Mr. Morrill gave an overview of the city's efforts to build an amphitheatre, starting
with 2007 when the idea first began -- to 2010 when City Council decided that
given the current economic situation the idea for a new amphitheatre should be
scaled back to overall improvements to Elmwood Park.
• The city's options now are to remove features, rebid the project, or move forward
and fully fund the project with surplus money identified in the current city budget.
He asked City Council for direction on how to move forward.

Reappointed Cheryl Hartman as a member of the Human Services

Mayor Bowers and Members of the Roanoke City Council.
I am scheduled to appear before Council on October 1, 2012 as a member of the
public. I listened intently to the various presentations regarding the Market Square
Update on September 17, 2012. 1 examined, as closely as I could, the plan on the easel
and the two plans on the walls.
I made some notes, as best I could, with respect to the plan and the effect on the
Vendors.
It was very difficult to understand what was being displayed. When I got home, I
knew why it was so difficult. Some years ago there was a song entitled "Green Door,
what's that secret you're keepin'. The trees masked the vendor stalls and tables and
chairs for outdoor dining to a great extent, almost as if they were keepin' a secret.
Five minutes doesn't give me, or anyone else, enough time to respond to the
briefing of Mr. Luther and Mr. Thornton (even assuming there are only a few public
comments).
1 would, nevertheless, request Council to take two actions prior to October 1,
assuming, of course that Council has not individually, or collectively, already have de-
cided that the plan is a good thing. One member yesterday spontaneously burst out with
"I totally like it"
I am reminded of a story about a Judge who told a lawyer "don't confuse me with
facts, my mind is made up."
First, 1 would ask you to get a copy of the plan that does not have any trees on it.
I recognize that the trees area major part of the update. Without the trees, however, you
cannot see what is expected to happen, to the vendor stalls. If AECOM does not have an
"treeless" copy of the plan, I still would like to have a print of the plan as presented yes-
terday on the easel. I don't think that AECOM would provide me with a copy but they
might accommodate City Council.
Second, I would ask you to give me an opportunity to explain the effect of the plan
on the vendor stalls and to offer an alternate plan, still within the concept, but which
might not require any relocation of vendors. I would be delighted if Mr. Luther and Mr.
Thornton could be present for questions to me, questions from me, and questions from
Council to the three of us.
I also recall that the South lane of Campbell Ave. abutting Market Square on the
plan looked as if it was not to be used for vehicle traffic in the future.
I look forward to seeing you on October 1.

Good Afternoon to all of you.
We, the undersigned, would like to go on record to express our very grave concerns for the pro-
posed "Renovations" to the vendor area of the Historic Market Square.
We are very concerned about the impact this change will bring to the "Image of the Historic Mar-
ket Square. The farmers who established this concept a mere 120 years ago have given our city
a very unique position very few areas can boast about The Historic Farmers' Market impacts our
standing in national rankings and helps to keep us as one of America's All American Cities.
We also have very serious concerns about rushing this project forward, without enough
consideration being given to the impact this drastic "renovation "will bring to the entire City Mar-
ket Area.
With the upcoming scheduled closing, in October, of Elmwood Park, we are asking you to
do an impact study regarding the possible adverse consequences these changes will have on
Market Square. If you are in the Square on a regular basis, as we are, you realize how unmanage-
able this situation may become. We have been told that it has been said, in a newspaper, that all
the players are "on board."
We don't know who the players are; but "players" must include small business owners
and vendors who are also business owners in the Market District We would like to be included
in the meetings of the players so we can, at least, have an opportunity to get into the game.
We formally request, as business owners and taxpayers, that we have regular meetings
with you. We would like to see the actual designs for the "renovation" of Market Square, and to
have a voice in the project before the actual "renovation" is approved by Council, and before
construction is begun.
It is spite of problems with parking, for 30 years we have chosen to locate our business
here on the Historic Farmers' Market because it is unique. Many of the vendors have been here
for many more years. We all remain because we love the area -- despite the disruptions we have
been forced to endure during the past 24 months: renovations to the Roanoke City Market Build-
ing; renovation to Center in the Square, with one -half of Market Square being totally closed off
for construction, and Elmwood Park yet to come. Is it any wonder that local residents have said
time, after time, that they don't come down to the Market due to having to fight the "mess ?" We
witness this on a daily basis as we talk to our customers and visitors from all over the globe.
We are proud to be a small business that has been welcoming customers and
visitors for 30 years in the Historic Market District and proud to be part of an All American City
for many of those years. We are confident that vendors also share that pride. Please make us
proud that you really care for all of us and that you also are proud of the Historic Roanoke City
Market District. Our goal should be to do something to help the farmers, and to retain the
Historic Farmers concept. Thank you for your immediate consideration.

I am contacting you on behalf of the Mill Mountain Advisory Committee (MMAC), of
which I am serving as Chairman.
Thank you for your time.
The Committee has several concerns we would like to address.
To clear up any confusion, I would like to provide some background information, and I
quote from the Bylaws of the MMAC:
"MMAC functions as an advisory Committee to Council regarding appropriate
maintenance and improvements for Mill Mountain Park consistent with The Fishburn
Grant.
The committee is dedicated to making Mill Mountain as accessible and pleasurable to
all persons while preserving the environmental and aesthetic integrity of the mountain.
The MMAC is composed of 9 members appointed by City Council. One shall represent
the Mill Mountain Garden Club, one shall represent the Mill Mountain Zoo and one shall
be a representative of the Fishbum Family."
While the Committee does not have the authority to make decisions and act
independently, we take our responsibility to serve the City of Roanoke and it's citizens
very seriously. The completion of the Mill Mountain Management Plan in 2005 was the
culmination of years of collaborative work.
We recognize Mill Mountain as the centerpiece and signature of our wonderful City and
therefore appreciate the importance of the Committee's work in advocating for it.
The Mill Mountain Garden Club established and continues to maintain the Wildflower
Garden, built the outdoor amphitheater /classroom and brought American Chestnut
Trees to the Mountain.
The Zoo, of course, is a major tourist attraction and educational force serving Southwest
Virginia.
And without the generosity of the Fishburn Family, none of this would be possible.
Our latest project is to proactively address the issue of the crumbling wall along
Prospect Road. As you know, this portion of the Greenway provides access to the
Mountain for thousands of walkers, runners, hikers, bikers and horseback riders every
year. In addition, it is an important leg of the Blue Ridge Marathon, the path for Bicycle
Races and many charitable walks. These activities all positively impact Roanoke's
Tourism industry. The road must be protected for the safety and enjoyment of the
community.
Working closely with the Parks and Rec Department, we are in the process of assessing
the wall's condition and investigating solutions and possible funding sources.
Mayor Bowers attended our September 27, 2012 meeting and was briefed on the
Committee's work to date.
At that meeting he informed us that the Committee may be disbanded.
This was shocking news to all of us.
I can assure Council that I was not made aware of this in advance nor was there any
"misunderstanding or miscommunication ".
At this time, we have before Council for approval the names of designated Garden Club
and Zoo Representatives, a well as four Citizens at Large seeking to fill the remaining
two seats.
The caliber of these candidates is quite impressive and they would all bring a passion to
their service. Leaders in several local businesses, a Virginia Tech Professor in the
Department of Fish and Wildlife Sciences, a retired citizen and Army Veteran who hikes
the mountain regularly... all are willing to serve the City of Roanoke in this capacity.
Citizen interest in Mill Mountain is evident.
Several current members have extended their service past their terms due to a delay in
the appointment process by Council.
We are anxious and excited to have these new members join us!
In a Saturday, September 29 telephone conversation with Committee Member Louise
Kegley, Vice Mayor Trinkle expressed concern that the Garden Club was over
represented on the Committee. Currently, the only active member of a Garden Club is
the one required Mill Mountain Garden Club representative.
He also expressed concern that the committee did not reflect diversity. We represent
many walks of life and race. Specifically to the question of race he posed to Mrs.
Kegley, two of the nine members serving on the Committee over the past six years were
African American.
Members of this Committee walk the mountains, clear the trails and devote countless
volunteer hours to keeping Mill Mountain accessible to those who enjoy it. Committee
members spearheaded the effort to restore the Historic Toll Booth by forming a Public -
Private Partnership with the City.
The Fishburn Family, who above all others deserves this City's gratitude, should always
be honored with a place at the table where their voice is heard and their desires
respectfully considered.
Should this Committee be disbanded, I will be saddened and shocked by this sudden
and unexpected action.

Subject: Request a Public Hearing Authorizing a Contract for the Sale of
a City -Owned Property Located at 2051 Blue Hills Drive, NE,
Identified as Tax Map No. 7230108.
Background:
Roanoke Cooperative Association, Ltd., commonly known as the Roanoke Natural
Foods Co -op ( "Co -op "), desires to establish and operate an urban farm to provide
locally -grown produce. No such operations exist in Roanoke. Since fall 2011, City
staff has worked with the Co -op to identify properties in the City to support such
an operation. A surplus property located within the Roanoke Center for Industry
and Technology (RCIT) has been identified as an appropriate location for the farm
operation.
The site proposed for sale is a 17.5 acre parcel (Tax Map No. 7230108) that is
occupied by two buildings. The site has a large detention pond for stormwater
management that handles the drainage for a portion of RCIT. The site, known as
Heritage Point, has a barn that was gifted to the City for use by the mounted patrol
program. The program was discontinued, so the barn is no longer needed by the
City. The site also contains a cabin constructed circa 1830, which is in severe
disrepair. The Co -op had a restoration expert assess the cabin, who determined it
can be restored and placed into productive use. This parcel is not subject to the
restrictive covenants in place at RCIT.
The Co -op proposal indicates the property would be used for row crops, gardens,
greenhouses, fruit trees, and nut trees. Chickens would be pastured on the
property for egg production. The barn would be used as the center of the
operation. The Co -op has indicated a desire to restore the cabin and use it in the
operation, possibly as a residence for an on -site farm manager.
The property has multiple legal and physical encumbrances that limit or preclude
its usefulness for other commercial or industrial development:
• A stormwater detention pond occupies about one -third of the site. The city
will need to establish a maintenance easement on this facility.
• Multiple drainage and sanitary sewer easements traverse the property.
• The parcel has an irregular shape due to the routing of the adjacent right -of-
way of Blue Hills Drive.
• Access is currently provided by an unimproved gravel road.
The proposed purchase price is $30,000, based on the existing encumbrances on
the land and a commitment to stabilize the cabin. The sales contract
acknowledges that the property is being sold at a significant discount. The
contract provides that this discount —equal to the assessed value of the buildings
today, minus the purchase amount —would be recaptured by the City if the
property is sold within ten years of the closing date.
A public hearing is required to consider a contract for sale of the property.

Background
Roanoke Cooperative Association, Ltd., commonly known as the Roanoke Natural

only 2 % -3 acres of usable land. The parcel has limited usefulness for commercial
or industrial development and would not support the scale of industrial
development encouraged in the RCIT. This parcel is subject to the restrictive
covenants in place at RCIT that govern use of all parcels in RCIT.
The proposed term of the lease is five years. Rent would be a nominal rate of
$100.00 per year. The Co -op would have the option to purchase the property for
$30,000 at any time prior to the expiration of the lease term.
A public hearing is required to consider the proposed lease agreement.
Recommended Action:
Authorize the scheduling and advertising of this matter for a public hearing on
October 15, 2012, at 7:00 P.M.

Subject: Amendment of Chapter 6, Animals and Fowl, of the Code of the
City of Roanoke (1979), as amended
Background
Chapter 6, Animals and Fowl, of the Code of the City of Roanoke (1979), as
amended ( "Chapter 6 "), establishes regulations on the keeping of certain
animals within the City. Chapter 6 contains several references to "zoned for
agricultural use" in designating areas where the keeping of certain animals is
permitted. Clarifying when property should be considered "zoned for
agricultural use" in Chapter 6 would help ensure that the Zoning Ordinance is
administered consistent with Chapter 6. In addition, other requirements of
Chapter 6 should be updated to provide consistency with the Code of Virginia
and our Zoning Ordinance.
Sec. 6 -7, Limitation on keeping cattle sheep, goats and swine, contains three
main provisions:
1. Prohibits keeping certain livestock in areas that are not "zoned for
agricultural uses."
2. Permits such livestock to be kept in certain types of enclosures for
particular purposes provided the enclosure is 300 feet from any building used
for residential purposes.
3. Permits livestock to be kept on farms more than five (5) acres, regardless
of zoning.
The proposed amendments specify that the areas in which livestock may be
kept be limited to zoning districts that permit an "agricultural operation" by-
right or by special exception. In addition, this section permits the temporary
holding of livestock, regardless of zoning designation. Such activity would be
incompatible in most areas of Roanoke. The location of such activity should be
limited to properties on which the activity is permitted by the zoning
designation. Finally, the reference to "cattle, sheep, goats, and swine" is not
sufficiently inclusive of the types of animals that are often kept as livestock and
should be amended to use broader taxonomic names. This definition is
consistent with the way the Code of Virginia currently defines livestock.
Sec. 6 -81, Shelters, requires that shelter of at least 60 square feet per animal be
provided for equine animals. This section also requires that such shelters
constructed after January 1, 1979, observe a 300 foot setback from any
property line and that any shelter built prior to such date may be relocated on
the same parcel but must observe the same 300 -foot setback requirement.
Where the parcel is zoned for agricultural use, such setbacks are not required.
As with livestock, whether or not equine animals are permitted on a parcel is
appropriately regulated by zoning. Likewise, the location of shelters is more
appropriately controlled by existing dimensional regulations and supplemental
regulations of the zoning ordinance. Accordingly, the proposed amendments
delete the setback requirements from this chapter of the City Code.
Sec. 6 -95. Limitations on keeping, regulates the number of poultry animals that
may be kept on a parcel that is not "zoned for agricultural use." Up to ten birds
may be kept on a parcel containing less than 20,000 square feet. Up to 40
birds may be kept on a parcel that has 20,000 square feet or more. Where the
parcel is zoned for agricultural use or is an existing farm of five acres or more,
there is no limit on the number of birds.
This section also contains a reference to land "zoned for agricultural use" that
should be updated. The verbiage should also be revised to improve clarity.
The proposed amendments achieve both goals but do not change the number
of birds that may be kept on a given parcel.
Considerations:
The proposed amendments replace the reference to "zoned for agricultural use"
with wording that allows livestock, equine animals, and poultry in zoning
districts in which the keeping of such animals is allowed as -of -right or by
special exception.
The amendments define livestock in a manner which is more inclusive in terms
of the types of animals that could be kept as livestock. Below is a summary of
the descriptions of the cited taxonomic families and orders:
Bovidae is a family of animals that includes cows, bison, sheep, and
goats.
Camelidae is a family of animals that includes camels, llamas, and
alpaca.
Cervidae is a family of animals that includes deer and elk.
Equidae is a family of animals that includes horses, donkeys, and mules.
Ratite is an order of animals that includes flightless birds such as
ostriches and emus.
Suidae is a family of animals that includes pigs.
Leporidae is a family of animals that includes rabbits and hares.
Finally, the proposed amendments modify sections that currently conflict with
zoning regulations with respect to where keeping of certain animals is
permitted. The location of activities would thus be appropriately governed by
the applicable zoning regulations.
Recommended Action:
Adopt the attached ordinance amending Chapter 6 of the City Code.

A RESOLUTION supporting an application acrd authorizing the City Manager to
submit such application to the Virginia Department of Transportation (VDOT) for funds
from VDOT's Revenue Sharing Program in the amount of 58,250,000 for FY 2014 for
certain projects; and authorizing the City Manager to take certain actions in connection
with such projects.
WHEREAS, the City of Roanoke desires to submit an application for an
allocation of funds up to $8,250,000 for any funds provided by VDOT for the projects
referred to in the City Council Agenda Report dated October 1, 2012, to this Council, and
which will require the City to provide matching funds of $8,250,000.
THEREFORE, BE IT RESOLVED BY THE Council of the City of Roanoke that:
L The City Council hereby supports the application referred to herein and
hereby authorizes the City Manager to submit such application to VDOT for funds from
VDOT's Revenue Sharing Program for FY2014 in the amount of $8,250,000 for the
following seven projects:
a. Franklin Road Bridge over Norfnik Southern Railway Bridge Replacement
b. City -Wide Bridge Maintenance.
e. City -Wide Paving Program (Resurfacing).
d. City -Wide Storm Drain Improvements.

Background:
The Virginia Department of Transportation's (VDOT) Revenue Sharing Program
is again available to cities for FY 2014. This program provides additional
funding for use by the City to construct or improve its infrastructure systems.
The maximum amount made available to localities is $10 million for FY 2014.
These funds are matching funds in the following percentages: (50% State / 50%
City).

For the FY 2014 application, the City will request $8,250,000 dollars from
VDOT, which will require a City match of $8,250,000 dollars. Staff identified
seven projects for which to request VDOT revenue sharing program funds.
These projects are:
1. Franklin Road Bridge over Norfolk Southern Railway Bridge Replacement.
City match funding will be provided by using $1,800,000 from the City's
planned FY 2014 capital project funds for Bridge Repair and Replacement
through the planned issuance of bonds.
2. City -Wide Bridge Maintenance. City match funding will be provided by using
$500,000 from the City's planned FY 2014 general fund revenues for Bridge
Maintenance.
3. City -Wide Paving Program (Resurfacing). City match funding will be provided
by using $3,275,000 from the City's planned FY 2014 general fund revenues
forthe Paving Program.
4. City -Wide Storm Drain Improvements. City match funding will be provided
by using $1,120,000 from the City's planned FY 2014 capital project funds
for the Neighborhood Storm Drain Program through the planned issuance of
bonds.
5. City -Wide Curb, Gutter, and Sidewalk (New Construction). City match
funding will be provided by using $750,000 from the City's planned FY 2014
capital project funds for Curb, Gutter, and Sidewalk (New Construction).
6. City -Wide Curb, Gutter, and Sidewalk (Repair). City match funding will be
provided by using $205,000 from the City's planned FY 2014 general fund
revenues for Curb, Gutter, and Sidewalk (Repair).
Roanoke River Greenway Construction for the connection between Roanoke
and Salem. City match funding will be provided by using $600,000
combined from:
o Pathfinders Donations $400,000
o Planned FY 2014 capital project
Funds Greenways and Trails $200,000
Recommended Action:
Authorize the City Manager to submit an application to VDOT for VDOT's
Revenue Sharing Program requesting $8,250,000 for the above - listed projects.
Authorize the City Manager to take such further actions and execute such
documents, approved as to form by the City Attorney, as necessary to submit
the above application and to furnish such additional information and /or
documents as may be required for such application.
