Proposal to Ban the Box on City Applications Roanoke City Council By Shawn Hunter, Employment Specialist, Virginia CARES Greetings, my name is Shawn Hunter. I am the Employment Specialist at Virginia CARES. My job consists of me going out in the community meeting employers and helping match ex- offenders with jobs. Accomplishments Since January of this year until now we have helped 164 ex- offenders who have participated in our program find jobs. Once per month I visit the job sites and stay in contact with the clients and employers. As of today all of them are still maintaining employment. Employers are not considering or hiring individuals who check the box on applications A plethora of our participants who have submitted applications for jobs online or in- person have felt discouraged to continue job searching because they are never called for an interview. On numerous occasions I have went to places where participants have applied and talked to the hiring managers and had to persuade them to take a look at the application. It was only through my personal representation of them that employers gave them an interview otherwise they would not have been considered because they had checked the box. I ask all of you to please think about how many people that have not been considered at all because they checked that box. Discouraged individuals turn against society and lash out. If there is not opportunity what are they to do? Why Ban the Box on City Applications? The box on the application that asks the question, have you ever been convicted of a crime is a major barrier to employment of people with a criminal past. If this box is banned it will give individuals who have a criminal past at least the opportunity to receive an interview with an employer on an even scale and hopefully be able to impress the employer with their skills and qualifications first, without the stigma of a record. In -turn employers will be able to make individualized assessments instead of blanket exclusions and consider the age of the offense and its relevance to the job. We have been successful in finding ex- offenders jobs because I go to the employer and talk to them about our participants and their skills. This support that we offer is what opens the door for them to get the interview. If it wasn't for that, it is very likely that their application wouldn't even be reviewed nor would they receive an interview. Economy When these men and women receive jobs they feel a sense of self - value. They become tax - payers and consumers, which boosts the local economy. They are able to pay their fines, child- support etc. Most importantly, the recidivism rate drops, making Roanoke safer. Ladies and gentlemen, "banning the box' is about giving individuals a chance to become independent and productive citizens. As a representative of Virginia CARES I sincerely ask that Roanoke City Council will ban the box here in Roanoke. Ban the "Box" Comments to Roanoke City Council by Ted Edlich, President of TAP Thank you so much for the opportunity to speak. As you are aware TAP has been deeply involved in the re -entry of ex- offenders since 1978. TAP developed the first pre- and post - incarceration program in the Commonwealth of Virginia known as Virginia Community Action Reentry System (CARES). More than 30,000 prison inmates have gone through that program. Virginia CARES has consistently had a lower recidivist rate for its participants than the general prison population although our folks are more likely to have lower education levels, poorer work histories, more severe crimes and longer prison terms than average. Last year TAP's Virginia CARES program worked with 427 returning inmates in the City of Roanoke. Given that we in the U.S. imprison more people than any other country in the world including China and Russia, we have an increasing number of people leaving our prisons. The largest numbers of persons who go to prison are male. Of the 35,626 adult males in the City of Roanoke, approximately 7.8 % or 2,850 have been to prison and carry a felony on their record. However, since there are nearly twice as many persons convicted of felonies who do not end up in prison, the numbers of people in our city who have felony records are approximately 7,410 (just short of a fifth Roanoke's adult male population). The irony is that even though crime rates decrease incarceration rates increase. A Center of Economic and Policy Research paper concludes: "In absence of some reform of the criminal justice system, the share of ex- offenders in the working -age population will rise substantially in coming decades." The single determinant of successful reentry and reconnection with the community is employment. There is absolutely no debate about it. The key to productive citizenship is a job. While TAP works hard to help returning inmates find housing, reconnect with their families, support their children, pay their fines, court costs, and child support, we work extremely hard to help our clients find a job. We work to help them create a resume, present themselves in an interview, and access both additional education and a job. We work with area employers and match candidates who have completed our program with available jobs. It is also true than an increasing barrier to finding employment is a felony. A felony becomes a red flag that often prevents the opportunity for employment even though all crimes and all felonies are not the same. The "box' on employment applications that calls for disclosure of felony activity across the board becomes a broad brush that eliminates further contact with an employer and the opportunity of an employer to make an individual judgment on the value of that prospect to the company. TAP has banned the box on our employment forms. We will continue to do background checks on positions that require them. However, we will no longer give even the appearance of a sweeping discrimination of a candidate because of a felony conviction on an application. The City of Danville has banned the box on municipal job applications. We urge the City of Roanoke to do the same. CITY COUNCIL AGENDA REPORT To: Honorable Mayor and Members of City Council Meeting: July 7, 2014 Subject: Acceptance of Certified Local Government Grant Funds for Survey of Belmont Historic District Background: Virginia's Department of Historic Resources (DHR) is required by provisions of the National Historic Preservation Act to grant at least 10% of its annual Historic Preservation Fund monies to Certified Local Governments (CLG) in the state. The CLG Grant Program can be used for a variety of projects including surveys, National Register nominations, preparation of preservation plans, and educational events. The Department of Planning, Building, and Development applied for funds to conduct a survey of the Belmont Historic District in preparation for a nomination for the Virginia Landmarks Register and National Register of Historic Places. By letter dated May 28, 2014, DHR awarded the City of Roanoke a CLG Grant in the amount of $25,000. As a condition of receiving the grant, the City is required to provide a local match of $20,000. Considerations: The survey project will implement policies and a specific action of Vision 2001- 2020 which recommends historic designation as a method to contribute to revitalization through improved property maintenance and economic incentives for rehabilitation. Specifically, the survey and nomination implement action EC A26 to undertake a comprehensive inventory of historic and cultural properties and districts in the City and consider historic districts, where applicable. The matching funds will be transferred from the City's existing grant match account to a project account. City Council action is needed to authorize the City Manager to execute the agreement with DHR, and to formally accept and appropriate the grant funds to support the survey and inventory project. Recommended Action: Authorize the City Manager to execute any required grant agreements or documents such to be approved as to form by the City Attorney, and to take any necessary actions to revise, implement and administer such grant. Adopt the accompanying budget ordinance to establish a revenue estimate for state grant funds in the amount of $25,000, and appropriate funding of the same into accounts to be established by the Director of Finance in the Grant Fund. Transfer funding in the amount of $20,000 from the local grant match account. 0§-iisiop ker-. orrill Ci ty Manager Distribution: Council Appointed Officers Brian Townsend, Assistant City Manager for Community Development Michael B. ATTEST: City Clerk, mCITY COUNCIL AGENDA REPORT 1W To: Honorable Mayor and Members of City Council Meeting: July 7, 2014 Subject: Appropriation from the Economic and Community Development (E &CD) Reserve and Appropriation of Residual Bond Funding Background /Considerations: On June 16, 2014, Council authorized the issuance and advance appropriation of FY 2015 bond funding for the FY 2015-2019 Capital Improvement Program (CIP). In addition to the bond issuance and appropriation, Council authorized the appropriation of funds from the E &CD reserve which was not included in the budget ordinance that was adopted. The funds from the E &CD reserve were authorized to supplement and fund three projects: The first project will supplement funding previously allocated to complete drainage and stormwater management improvements in the Roanoke Centre for Industry and Technology. The supplemental funding needed is $200,000. The second project will improve garage technology for customers and support the operation of the proposed Hampton Inn and Suites located above the Market Garage by funding necessary parking systems equipment and related improvement to the garage. This project is estimated at $125,000. The third project will fund construction and installation of a signature destination playground at Elmwood Park pursuant to the overall facility Master Plan and in support of the Main Library improvements currently underway. This project is estimated at $265,000. The playground has been designed by in- house staff. Proceeding with construction and installation will depend on identifying supplemental financial support through sponsorships. Additionally, residual bond proceeds of $452,000 from the Digital Radio Project were remaining after the project's completion. In order to stay within arbitrage regulations, bond proceeds must be shown as fully committed to a designated project. Reallocation of funding between the Digital Radio Project and Public Library project will ensure compliance with these regulations. General revenue funding in the amount of $452,000 used in the Main Library renovation project will be exchanged with the Digital Radio Project residual bond proceeds. Council must authorize the reallocation of unappropriated Series 2013A bond funding from the Digital Radio Project to the Public Library project which will be used for the Main Library Renovation. Recommended Action: Adopt the accompanying budget ordinance to appropriate funding from the E &CD reserve to the Capital Projects Fund accounts to be established by the Acting Director of Finance and adopt the accompanying reallocation resolution and budget ordinance to appropriate residual bond funding from the Digital Radio Project to the Public Library project account. - ---------------------- Christopher P. This will be matched with $1.12 million in Virginia Department of Transportation Revenue Sharing funds. One such project is the installation of storm drains in the Narrows Lane Drainage Project in the general vicinity of Narrows Lane and the 4600 block of Van Winkle Road, SW. This area suffers from an inadequate drainage system evidenced by flooding on private properties. Runoff from the public right of way may contribute to flooding of private properties. Constructing the proposed storm drain system on Narrows Lane and Van Winkle Road would correct known drainage problems in this area. The City will need to acquire real property rights from private property owners in order to construct, operate, and maintain the proposed storm drainage system. Considerations: City Council action is necessary to authorize the acquisition of real property rights needed for the Narrows Lane Drainage Project. The real property rights needed are outlined below, but are subject to minor variation of location and extent pending final engineering design details. Such renewal of the Temporary Right -of- Entry Agreement will permit access by the City to the Norfolk Southern Property in connection with the Project, all as more fully set forth in the City Council Agenda Report dated July 7, 2014, with such document to be approved as to form by the City Attorney. 2. Authorize the City Manager to take such further actions and execute any additional documents, approved as to form by the City Attorney, as may be needed to implement, administer, and enforce such renewal of the Temporary Right -of -Entry Agreement, including obtaining any required insurance coverages, and /or to obtain permission to access the Norfolk Southern Property for this Project. ATTEST: io&ymoo^ \ City Clerk. y 2014 6 19 - R -NS Right of Entry renewal Bridge the Gap Greenway final.doc 2 G~ CITY COUNCIL AGENDA REPORT To: Honorable Mayor and Members of City Council Meeting: July 7, 2014 Subject: Norfolk Southern Railway Company Right -of -Entry for Roanoke River "Bridge the Gap" Greenway from Bridge Street to Salem Background: The City has constructed approximately seven (7) miles of greenway along the Roanoke River. The existing greenway begins near the 13`h Street Bridge, SE, and continues upstream to Bridge Street, SW. The last piece of the Roanoke River Greenway remaining within the City limits is from Bridge Street upstream to the City of Salem boundary. City of Roanoke (City) staff and its consultants are currently working on the design for the Roanoke River "Bridge the Gap" Greenway from Bridge Street to the City of Salem boundary in the Blue Ridge Industrial Park. Norfolk Southern Railway Company (Norfolk Southern) owns approximately 60% of the land targeted for the construction for this last piece of the City's portion of the Roanoke River Greenway. By Resolution No. 39700-070113, dated July 1, 2013, Council authorized the City Manager to execute a Temporary Right -of -Entry Agreement between Norfolk Southern Railway Company and the City of Roanoke to allow City staff to perform topographic survey studies for the Bridge the Gap project. The Agreement authorized by the Resolution identified above has expired. City staff is again seeking access to Norfolk Southern property to produce construction documents. To continue the City's efforts, a renewed Right -of- Entry to Norfolk Southern property is required. Consideration: Council authority is required before the Right -of -Entry document may be executed because the Right -of -Entry document requires the City to indemnify and hold harmless, to the extent permitted by Virginia law, Norfolk Southern against all claims arising from the City's exercise of the Right -of -Entry. Norfolk Southern will not waive this requirement. Agreeing to indemnify and hold Norfolk Southern harmless from such claims is a waiver of the City's sovereign immunity. Before City staff and the City's consultant can access Norfolk Southern property, the City must execute a Temporary Right -of -Entry document from Norfolk Southern, similar in form to the copy which is attached as Attachment A. The Right -of -Entry document requires the City to pay a Norfolk Southern application fee and obtain special insurance. Such costs are anticipated to be approximately $2,000, but any costs would be covered by the funds already in the account for this Project. The Right -of -Entry Agreement is for a three month period and will need to be renewed continually through the design of the project. Recommended Action: Authorize the City Manager to execute a Temporary Right -of -Entry document with Norfolk Southern substantially similar in form to the Temporary Right -of- Entry document attached to this Report as Attachment A. Such document is to be approved as to form by the City Attorney. Authorize the City Manager to also take such further actions and execute any additional renewals and /or documents, approved as to form by the City Attorney, that are needed to implement, administer, and enforce the above Temporary Right -of -Entry document and /or to obtain permission to access Norfolk Southern property for the duration of this Project. Spencer Steven J. Talevi David L. Collins Heather P. Ferguson Laura M. Carini Assistant City Attorneys Since 1982, City Council has reenacted and recodified the City Code on an annual basis in order to properly incorporate in the Code amendments made by the General Assembly at the previous Session to State statutes that are incorporated by reference in the City Code. This procedure ensures that the ordinances codified in our Code incorporate the most recent amendments to State law. Incorporation by reference is frequently utilized in local codes to preclude having to set out lengthy provisions of State statutes in their entirety. In addition, the technique ensures that local ordinances are always consistent with the State law as is generally required. The procedure whereby a local governing body incorporates State statutes by reference after action of the General Assembly has been approved by the Attorney General. See Report of the Attorney General (1981 -1982) at 272. I recommend that Council adopt the attached ordinance to readopt and reenact the Code of the City of Roanoke (1979), as amended. If the attached ordinance is not adopted, City Code sections incorporating provisions of the State Code amended at the last Session of the General Assembly may not be deemed to include the recent amendments and may be impermissibly inconsistent which could result in the dismissal of criminal prosecutions under these City Code sections. MERCHANT ANDREA F. TRENT Acting Director of Finance Assistant Director of Finance July 7, 2014 Dear Mayor Bowers and Members of City Council: Subject: May FYI Financial Report - City of Roanoke The following financial report provides a summary of the City's financial results for the eleven months ended May 31, 2014. General Fund The current revenue projection for FYI is $1.5million or 0.6% below the adopted estimate mainly due to the underperformance in sales tax and communications tax revenue. The City has continuously analyzed its revenue estimates in light of recent economic trends. Expenditure adjustments were made to ensure that FYI expenditures align with the revised revenue forecast. Civic Facilities Fund Through May, the net operating loss for Global Spectrum, which manages the Civic facilities, was approximately $196,000 below the FYI operating budget. Global Spectrum's current forecast projects that performance will be approximately $169,000 less than budgeted for the fiscal year. The year -to -date operating loss through May was primarily due to lower than expected attendance at concerts, changes in event dates and increased utilities expense. Parking Fund Through May, approximately 95.3% of anticipated revenue has been realized. The operating income, before the net decrease of non - operating expenses and transfers was approximately $609,000. After non - operating expenses and transfers, the fund's net position was approximately ($175,000). The Center in the Square Garage saw a significant increase in revenue due to the reopening of the Center in the Square attractions after building renovations were completed in May 2013. Elmwood Park Garage and Campbell Garage also showed strong performance. Special projects such as research regarding parking meters, technology improvements, credit card acceptance and other advancements in Parking Management are ongoing. Honorable Mayor and Members of Council July 7, 2014 Page 2 Citv of Roanoke Pension Plan The Pension Trust Fund experienced an investment gain of 18.82% for the fiscal year -to -date through May 2014, which reflects gains in all categories of the investment portfolio. Investment performance for this period was above the Policy Portfolio benchmark performance of 17.24% due to performance in the domestic equity, and fixed income asset classes. Closing The City's fiscal 2014 revenues through May increased 0.8% compared to FYI 3, lagging the budgeted increase of 2.1 %, mainly as a result of a timing difference in certain general property and local tax payments, as well as the underperformance of sales tax. Expenditures are expected to remain within the revised revenue projection for the year as a whole. The City's financial performance will continue to be carefully monitored by the various departments which are involved with oversight of the City's budgeting and financial processes.
