Adoption of the schedule of Roanoke City Council meetings for Fiscal Year
2015-2016.

2. PRESENTATIONS AND ACKNOWLEDGEMENTS:
Presentation of appreciation from Rebuilding Together Roanoke to the City of
Roanoke in connection with the International Rebuilding Day held in April 2015.
The Mayor presented plaque to Dan Webb, Code Compliance Coordinator.
3. HEARING OF CITIZENS UPON PUBLIC MATTERS:
CITY COUNCIL SETS THIS TIME AS A PRIORITY FOR CITIZENS TO BE
HEARD. ALL MATTERS WILL BE REFERRED TO THE CITY MANAGER FOR
RESPONSE, RECOMMENDATION OR REPORT TO COUNCIL, AS HE MAY
DEEM APPROPRIATE.
Sharieff Perdue - Jones, Ben Early and Robert Gravely appeared before the
Council.
City Manager and City Attorney were asked to meet with Mr. Early to
discuss concerns regarding the bid proposal for taxi -cabs at the Roanoke -
Blacksburg Regional Airport; and the City Manager was instructed to
schedule, at a future date, a joint meeting of Council and the Airport
Commission, along with the Western Virginia Water Authority Board of
Directors.
4. CONSENT AGENDA
(APPROVED 6.0, with Item C -3 removed and considered
separately (5 -0, Vice -Mayor Trinkle abstaining)
ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE
CONSIDERED TO BE ROUTINE BY THE MEMBERS OF CITY COUNCIL AND
WILL BE ENACTED BY ONE MOTION. THERE WILL BE NO SEPARATE
DISCUSSION OF THE ITEMS. IF DISCUSSION IS DESIRED, THE ITEM WILL
BE REMOVED FROM THE CONSENT AGENDA AND CONSIDERED
SEPARATELY.
C -1 Minutes of the regular meeting of Council held on Tuesday, January 20,
2015.
RECOMMENDED ACTION: Dispensed with the reading of the minutes
and approved as recorded.
C -2 A communication from Mayor David A. Bowers requesting that Council
convene in a Closed Meeting to discuss vacancies on certain authorities, boards,
commissions and committees appointed by Council, pursuant to Section 2.2-
3711 (A)(1), Code of Virginia (1950), as amended. A list of current vacancies is
included with the agenda for this meeting.
RECOMMENDED ACTION: Concurred in the request.
C -3 A communication from the City Manager requesting that the Council
convene in a Closed Meeting to discuss the disposition of publicly -owned
properties located at 117 — 119 Norfolk Avenue, S. W., where discussion in an
open meeting would adversely affect the bargaining or negotiating strategy of the
public body, pursuant to Section 2.2 -3711 (A)(3), Code of Virginia (1950), as
amended.
RECOMMENDED ACTION: Concurred in the request.
(5 -0, Vice -Mayor Trinkle abstained from voting due to a conflict of interest,
being he is employed with Carillon Services, Inc.)
C -4 A communication from the City Manager requesting that the Council
convene in a Closed Meeting to discuss the disposition of City -owned properties
fronting along Jae Valley Road (State Route 116), and adjacent to Back Creek, a
tributary of the Roanoke River in Roanoke County, where discussion in an open
meeting would adversely affect the bargaining or negotiating strategy of the
public body, pursuant to Section 2.2 -3711 (A)(3), Code of Virginia (1950), as
amended.
RECOMMENDED ACTION: Concurred in the request.
C -5 A communication from the City Attorney requesting that Council convene
in a Closed Meeting for consultation with legal counsel to discuss the status of
litigation where such consultation in an open meeting would adversely affect the
negotiating or litigating posture of the public body, pursuant to Section 2.2-
3711(A)(7), Code of Virginia (1950), as amended.
RECOMMENDED ACTION: Concurred in the request.
C -6 Minutes of the Audit Committee held on Wednesday, June 3, 2015.

C -7 A communication from the City Attorney with regard to the regulation of
taxicabs.

C -8 A communication from Gayle Shrewsbury, Secretary, Western Virginia
Water Authority, transmitting a resolution expressing appreciation to Marc Fink
for his service as a City representative of the Western Virginia Water Authority
Board of Directors.

C -9 A communication from the Commonwealth of Virginia, Auditor of Public
Accounts, regarding cash receipts and disbursements of the Clerk of Circuit
Court for the Calendar Year 2014.

Valley- Alleghany Regional Commission for a three -year term of office
ending June 30, 2018;

3. Acceptance of a Child Abuse and Neglect Prevention Program

COMMENTS BY CITY MANAGER.
The City Manager offered the following comments:
July 4th Events
• Several activities were held over the weekend in conjunction with the
July 4 celebration.
The first TAP Hope Revolution — Fourth of July Freedom Fast
• The event was a day to celebrate 50 years of community service TAP has
provided the Roanoke Valley.
• Organizers say they pre -sold nearly 1,000 tickets and raised more than
$25,000.00. All proceeds go toward TAP. The money will be divided up
and go to programs like Project Discovery.
Fireworks
• The City's annual fireworks show was held at River's Edge Sports Complex.
• The weather cooperated and we had a great turnout for this event
• Citizens brought their lawn chairs and enjoyed music before the show — 94.9
Star Country and Winds of the Blue Ridge.
• Food vendors were on site.
• In addition to the City, sponsors included The Roanoke Times, WDBJ7, and
Downtown Roanoke, Inc.

Special Guest Will Visit Main Library This Week
• Virginia First Lady Dorothy McAuliffe will join Mayor Bowers at a session of
the Feed and Read program at the Main Branch Library at 11:30 a.m. on
Wednesday, July 8.
• Feed and Read is a summer partnership between the Libraries and the
YMCA of the Roanoke Valley to provide free healthy meals and educational
activities to children.
As part of the program, Ms. McAuliffe will read a book to the children.
• The visit is being organized through the Library of Virginia and the Governor's
Office, and Council members are welcome to attend.
• Feed and Read provides free meals to children under age 18 at five library
locations, Mondays through Fridays, from June 15 to August 14.
Youth Summit Scheduled for August
• The second annual Roanoke Youth Summit will be held August 1 at Patrick
Henry High School.
• Doors will open at 9:00 a.m.; the event will begin at 10 a.m. and end at 2:00
p.m.
• Discussion groups will be held for youth and their parents /guardians followed
by lunch and activities.
b. CITY ATTORNEY:

the final Lea Youth Outdoor Basketball League (LYOB) event on
Tuesday, July 7 at 6:00 p.m., at Melrose Park, adding that Mr. Jones
will be addressing the following topics: limportance of education;
and setting goals and working diligently to reach those goals;
b. Vacancies on certain authorities, boards, commissions and committees
appointed by Council.

A RESOLUTION establishing a meeting schedule for City Council for the Fiscal Year
commencing.luly I, 2015, and terminating June 30, 2016.
BE IT RESOLVED by the Council of the City of Roanoke as follows:
This resolution establishes a schedule of regular meetings for City Council for the
Fiscal Year commencing July 1, 2015, and terminating June 30, 2016,
2. For such fiscal year, City Council shall hold regular meetings on the first and third
Mondays of each month, at the following times of commencement:
(a) Unless otherwise provided by resolution of Council, each regular
meeting on the first Monday in each month shall commence at 9:00 a.m, for the
conduct of informal meetings, work sessions, or closed meetings. Thereafter,
Council shall take up the regular agenda at 2:00 p.m. Council may recess between
the 9:00 a.m. session and the 2:00 p.m. session. The regular meeting on the first
Monday in July, 2015, shall commence at 2:00 p.m. at which time Council shall take
up the regular agenda.
(b) Unless otherwise provided by resolution of Council, each regular
meeting on the third Monday in each month shall commence at 2:00 p.m. for the
conduct of regular business. The second meeting of each month shall be recessed
upon the completion of all business except the conduct of public hearings, and such
meeting shall be reconvened at 7:00 p.m. on the same day for the conduct of public
hearings.
3 . With regard to the regular meetings scheduled to be held on the first Monday
of each month, inasmuch as City officials and Council members will be attending the
Virginia Municipal League Annual Conference to be held on October 4 — 7, 2015, an
exception is noted herein and the regular meeting scheduled to be held on Monday, October 5, 2015,
is rescheduled to be held on Thursday, October 8, 2015, and shall commence at 9:00 a.m.
4. When any regularly scheduled Monday meeting shall fall on a holiday of the City,
such meeting shall be held on Tuesday next following.
5. All meetings of City Council shall be automatically adjourned at 11:00 p.m., unless a
motion setting a new time for adjournment be made, seconded, and unanimously carried.
6. All regular meetings of City Council shall be held in the Council Chamber, Room
450, of the Municipal Building, unless otherwise provided by resolution of Council., with the
exception of the 9:00 a.m. session of the regular meeting on August 3, 2015, which shall be held at
Round Hill Elementary School Cafeteria, 2020 Oakland Boulevard, Roanoke, Virginia 24012 at 9:00
a.m..
7. City Council may prescribe a day or time other than that established by this resolution
or a meeting place other than that established by this resolution by adoption of a resolution
establishing anew meeting day, place or time. City Council shall cause a copy of such resolution to
be posted adjacent to the door of the Council Chambers and inserted in a newspaper having general
circulation in the City at least seven days prior to the date of the meeting at such amended day, time
or place
8. This Resolution shall have no application to special meetings of City Council called
Pursuant to §10 of the City Charter.

1. Call to Order:
Mr. Ferris called the meeting to order at 4:03 p.m.
2. Cherry Bekaert —Audit Plan for Year Ended June 30, 2015:
Mr. Churchman introduced himself and thanked the committee for their time. He reviewed Cherry
Bekaert's audit plan with the Committee. He began with a review of the engagement team and
services that will be provided. Mr. Churchman explained the contracted deliverables including various
financial statement and compliance reports. Mr. Churchman reminded the committee that Statements
of Economic Interests are now due twice annually, with the next filing due on June W. Mr. Ferris
responded that Mrs. Moon Reynolds has been reminding them of this deadline. Mr. Harmon asked if
there is a monetary penalty attached to late or missed filings. Mr. Churchman replied that there is not a
monetary penalty; it is more of a public perception issue. Audit timing was briefly discussed.

Mr. Churchman expressed his desire for an open dialog among City management, the Committee and
Cherry Bekaert. The firm has an open door policy, so if management or officials need advice at any
time during the year, please feel free contact him.
Mr. Churchman explained Cherry Bekaert's audit methodology, which is a top -down, risk -based
approach. They will tailor the audit program to the City's procedures. Members of their information
technology team will review access and security controls for major information systems that affect
financial reporting. Mr. Churchman pointed out that the financial statements are the responsibility of the
City. They will review the statements and let management know immediately if any issues are noted.
Mr. Harmon asked about Cherry Bekaert's philosophy of having two audit managers involved in the
engagement. Mr. Churchman clarified that one manager has background experience specifically
related to independent pension plans. The other has more experience with Auditor of Public Accounts
and Single Audit procedures. The firm thought this would be a good approach as retirement systems
are very complicated and they did not want to appear overwhelmed. Mrs. Mullins noted that the
Request for Proposal committee found having two audit managers very appealing, especially related to
the pension area.
Mr. Churchman reviewed new accounting pronouncement effective for Fiscal Year 2015 and noted that
only GASS 68 is expected to significantly impact the City's financial reporting. This standard is meant
to improve accounting and financial reporting for pensions. He also briefly discussed pronouncements
effective for Fiscal Year 2016, as well as proposed guidance related to Other Post - Employment Benefit
(OPEB) reporting. This guidance would require localities to report OPEB liabilities. Mr. Harmon asked
if OPEB is something the Audit Committee would like to hear more about at a future meeting. At
present, the City subsidizes the cost of retiree health insurance. Mr. Stovall commented that recent
changes to the Pension Plan will eliminate the health insurance subsidy benefit for new hires. Mr.
Harmon suggested that a presentation, including basics of the plan and the related OPEB liability might
be helpful. Mr. Ferris thought this was a good idea. Mrs. Satterwhite will take the request back to her
Finance counterparts.
3. Clerk of the Circuit Court
Mr. Harmon stated that the audit was completed according to the Virginia Auditor of Public Account
[APA] requirements and that there were no findings. The APA's final report will be provided to the
Committee once the APA has completed its portion of the audit and issued the report.
4. Other Business:
Mr. Harmon provided a brief overview of hotline activity this year. It has been very quiet with only one
(1) report received in 2015. He reviewed trends in hotline activity since its inception in 2012. A total
of 40 reports have been resolved with 18 substantiated, 18 unsubstantiated, and four (4) categorized as
having an outcome of `other'. Some of these concerns fell outside of Municipal Auditing's purview.
Mr. Harmon pointed out that May appears to be the most active month. He reviewed the outcome of

the two (2) most recently closed issues. Mr. Ferris commented that he is pleased reports have not
been frivolous in nature. Mr. Harmon responded that controls and culture in the City are pretty good.
Mr. Harmon reviewed the quarterly audit update including information on projects in process and on the
horizon. Mr. Churchman asked whether the City Council Expenditures audit is substantive in nature.
Mr. Harmon responded that it is an annual audit testing compliance with the Travel and Expense Policy
for City Council.
In reference to a planned Risk Management audit, Mr. Callaghan remarked that Municipal Auditing
needs to look at the 3`d party administrator aspect. Mr. Stovall stated that Risk Management recently
awarded a contract for 3" party administration of general liability claims, which will fundamentally
change the process.
Mr. Harmon discussed the status of Roanoke City Public Schools (RCPS) audits. Mr. Stovall asked if
RCPS audit reports are posted on Municipal Auditing's webpage. Mr. Harmon explained that they are
located on the BoardDocs section of the RCPS webpage, www.rcos.info.
Mr. Harmon touched on Municipal Auditing staffing. Mr. Ferris congratulated Mr. Harmon on being at
full capacity once again.

This letter responds to Council's request for information regarding the regulation of taxicabs operating
within the City of Roanoke and alternative regulatory approaches available to the City under applicable state
law and regulation. These inquiries arose from requests made by an operator of a taxicab company within the
City regarding the process to request an increase in taxicab fares in Roanoke. In April 2015, I advised Council
and this businessman that fares for taxicab services within the City are set by Council. Those rates appear in
Chapter 34 of City Code. Following these discussions, Council requested this additional report.
Background and Discussion.
The City is authorized to regulate taxicab operations within the City based upon authority from the
General Assembly. Specifically, the Roanoke City Charter (Section 2(12)) and State Code (Sections 15.2-
2015, 15.2 -2016, 46.2 -2000, 46.2 -2062, and 46.2 -2065) empower the City to regulate taxicab operations,
including establishing fare schedules. Importantly, white these charter and statutory provisions enable the City
to regulate this industry, the City is not mandated to regulate all aspects of the taxicab business. In addition,
these enabling laws provide the City with some flexibility in developing and implementing regulations. As an
example of this flexibility, Section 46.2 -2062, Code of Virginia (1950), as amended, provides:
A. The governing body of any county, city or town in the Commonwealth may
by ordinance regulate the rates or charges of any motor vehicles used
for the transportation of passengers for a consideration on any highway,
street, road, lane or alley in such county, city or town, and may prescribe
such reasonable regulations as to filing of schedules of rates, charges and
the general operation of such vehicles; provided that, notwithstanding
anything contained in this chapter to the contrary, such ordinances and
regulations shall not prescribe the wages or compensation to be paid to any
driver or lessor of any such motor vehicle by the owner or lessee thereof.
B. In considering rates or charges pursuant to this section, or financial
responsibility as provided by this chapter, the governing body may require
the owner or operator to submit such supporting financial data as may be
necessary, including federal or state income tax returns for the two years
preceding, provided that the governing body shall not require any owner or
operator to submit any audit more extensive than that conducted by such
owner or operator in the normal course of business. Such financial data shall
be used only for consideration of rates or charges, or to determine financial
responsibility, and shall be kept confidential by the governing body to which
it has been submitted. Nothing in this subsection shall make confidential any
certificate of insurance, bond, letter of credit, or other certification that the
owner or operator has met the requirements of this chapter or of any local
ordinance with regard to financial responsibility.
Based on these enabling laws, Roanoke has adopted Chapter 34, Vehicle for Hire, to regulate several
types of vehicles for hire, including taxicabs. This chapter of City Code includes comprehensive regulation of
the taxicab industry operating within the City. These regulations include permitting and licensing
requirements, minimum insurance coverage, and operational issues. Section 34 -130 establishes the rate
schedule for fares as follows:
Sec. 34 -130. - Rate schedule.
(a) The rates for taxicab and for -hire automobile service within the city shall be
such as are established from time to time by ordinance of the council of the
city. No different rates shall be charged or collected for such service.
(b) The rates to be charged and collected for taxicab service shall be determined
by accurate taximeters.
(c) The rates to be charged and collected for for -hire automobile service shall
be determined by accurate odometers.
(d) Waiting time shall include the time the vehicle is stopped in traffic or
stopped at the direction of the passenger. It shall also include time when the
vehicle slows to a speed at which the charges under the distance rates are
less than the charge for the time rates. Waiting time shall not include the
first three (3) minutes after the vehicle has arrived at the destination to
which it was called.
(e) When calls to a place of pick up are made to a taxicab or for-hire vehicle
located at a stand, no charge shall be made until the taxicab or for -hire
automobile arrives at the point of pickup.
(f) When a charge is made for waiting time, there shall be no charge for
mileage.
(g) The rates for services rendered by taxicabs and for -hire automobiles shall be
as follows:
(1) Distance rates:
a. For the first one- seventh (1/7) mile or fraction thereof,
three dollars and fifteen cents ($3.15).
b. For each additional one - seventh (1/7) mile or fraction
thereof, thirty cents ($0.30).
(2) Time rates: For each forty (40) seconds of waiting time, twenty cents
($0.20). While a charge is made for waiting time, there shall be no
charge for mileage under the foregoing distance rates.
(3) F.xira passengers: For each additional passenger, thirty cents
($0.30).
(4) Effective September 1, 2008, if the city manager determines that the
average cost per gallon of regular unleaded self- service gasoline in
the city as published by the American Automobile Association rises
above five dollars ($5.00) per gallon for a consecutive thirty -day
period, a surcharge of one dollar ($1.00) may be added to the current
meter charge for each trip. Such surcharge shall be included on the
rate card posted in each public vehicle. If the average cost per gallon
of regular unleaded self - service gasoline in the city drops below five
dollars ($5.00), the city manager may remove the surcharge of one
dollar ($ 1.00) from the meter charges for each trip. Such surcharge
may remain in effect until such time the city manager notifies
holders of permits for taxicab and for -hire service that the surcharge
is to be removed, in which case no surcharge shall be charged or
included on the rate card.
(h) A schedule of rates of those providing van service shall be filed with the city
manager. These rates shall be subject to review by city council, from time to
time at its discretion.
These rates may be changed by action of City Council
The Commonwealth also has some regulations applicable to taxicabs through the Virginia Department
of Motor Vehicles. A summary of those regulations is enclosed with this letter as Exhibit A.
As noted, the current enabling legislation affords the City some flexibility in adopting regulations of
this industry for the health, safety, and welfare of the public. One area in which localities have adopted
alternative approaches is the regulation of fares. A preliminary review of regulations adopted by other
localities suggests three general approaches to the regulation of fares; established fixed rates (Roanoke,
Lynchburg, Arlington County); established maximum rates (Blacksburg, Norfolk, Virginia Beach); open
market rates Charlottesville). The fixed rate regulations require all taxicab operators to charge the same rates.
The maximum rate approach requires all operators to charge no more than the maximum fares allowed by the
locality. In both alternatives, notice to the public of the rates being charged must be posted and available to
riders.
The approach adopted by Charlottesville is market driven. Specifically, the Charlottesville City Code
provides, in part, as follows:
Sec. 32 -91. - Taximeters required.
Taximeters of standard make and design, which shall calculate rates on the basis only of each
one -fourth mile traveled and certain time elapsed, shall be installed on all taxicabs operating in
the city. All taximeters installed pursuant to this section shall be calibrated to the rates which
the owner of the taxicab has on file with the chief of police, shall be sealed at all times when
the taxi is in operation and shall be subject to inspection by the chief of police at any and all
times. Such Taximeter shall be operated at all times within the city when anyone is riding in
the taxi other than the driver.
See. 32 -92. - Schedule of maximum rates.
(a) It shall be the policy of the city that taxicab rates shall be established by
open market competition. Every person owning or operating taxicabs
within the city shall file with the chief of police a schedule of the maximum
rates which that person will charge for service within the city. The schedule
shall conform to the following format:
(1) Charge for first one -tenth mile:
(2) Charge for each additional one -sixth mile:
(3) Charge for each additional one -sixth mile after

(6) Additional charge per trip between the hours of
10:00 p.m. and 6:00 a.m.:
(7) Charge for additional passengers:
(8) Charges for loading of laundry, groceries,
luggage or other special services:
(b) Any owner of a taxicab wishing to change his rate schedule shall file a
proposed new schedule with the chief of police at least thirty (30) days
before the new schedule may take effect. A notice shall be posted in that
owner's vehicle or vehicles indicating that the proposed change has been
filed and the proposed effective date. At the end of the thirty -day period the
owner may implement the new rates, provided a certificate is obtained from
the chief of police indicating that the meter has been changed to reflect
accurately the new rates and that the new rates have been displayed on the
exterior or interior of the taxicab as required by Section 32 -93.
(c) Each owner's tiled rates, when effective, shall constitute the maximum
charges which the owner or his employee may charge for taxicab service
within the city. However, nothing shall prevent an owner or operator from
charging less than the rate shown on the meter or offering discounts for
elderly or handicapped persons, frequent riders or other classes of
customers.
See. 32 -93. - Display of rates.
(a) A card displaying the rates of fare currently on file with the chief of police
for each taxicab shall be posted in a prominent place in that taxicab. Such
card shall state that the driver may offer to charge less than the amount
shown on the meter, but may never charge more than the metered price plus
applicable surcharges for night time.
(b) In addition, the currently filed rate schedule shall be displayed on both sides
of the exterior of every cab in letters at least three (3) inches high, in the
to= prescribed in Section 32 -92.
(c) As an alternative to exterior posting of rates, rates may be posted on the
interior of each rear door window in letters at least one - eighth inch high, in
the form prescribed in Section 32 -92 so as to be visible from the outside of
the vehicle, provided, that any vehicle with rates so posted must be equipped
with horizontally and vertically adjustable outside rear view mirrors
installed on both sides of such vehicle in such a manner as to provide the
driver a rearward view along both sides of the vehicle for a distance of at
least two hundred (200) feet.
I have not had an opportunity to review the system in Charlottesville with the city attorney or others
within that locality. I would like to know the more about the taxicab business in Charlottesville before
recommending this type of fare setting system. I would also want to discuss this type of system with the City
Manager, Assistant City Manager Townsend, Police Chief Perkins, and Senior Assistant City Attorney
Spencer and solicit their perspectives and advice on the merits of such a change.
Recommendation.
A preliminary review of regulations adopted by localities in the Commonwealth suggests that a
comprehensive regulatory scheme is appropriate, especially in larger localities. This review also notes
alternative approaches to the regulation of fares within localities. If Council desires further consideration of an
alternative system of fare setting for taxicabs operating within the City, 1 will conduct additional research on
the system adopted in Charlottesville, meet with various constituencies within the City administration, and
provide a recommendation to Council. I also recommend that consideration of any change also consider the
input and comments from taxicab operators, riders, and the public generally.

• You cannot pick up passengers at a public transportation terminal (such as a bus
station, airport, train, station, etc.) and deliver them to another public

• Advertisements for your services may not contain untrue, misleading or
deceptive information.
• Your vehicle must have the word or words "taxicab", 'taxi ", or "cab" permanently
affixed to its exterior in letters at least three inches in height and have a roof sign.
The markings and roof sign, taken together, shall clearly reflect that the motor
vehicle is operating as a taxicab or performing a taxicab service.

Thanking Marc Fink for his Service as a Director of the Authority
WHEREAS, the Wester Virginia Water Authority (the "Authority"), a public service
authority formed and existing in accordance with the provisions of Chapter 51 of Title 15.2 of
the Code of Virginia, 1950, as amended, the Virginia Water and Waste Authorities Act §§ 15.2-
5100 -15.2 -5158 (the "Act "), has benefited from the insightful service and good judgment of its
director, Marc Fink; and
WHEREAS, heretofore on June 18, 2007 the City Council of the City of Roanoke,
Virginia, appointed Marc Fink to serve a four -year term as a director of the Wester Virginia
Water Authority and, when that term ended, reappointed him May 2, 2011 to serve a second
four -year tens; and,
WHEREAS, Marc Fink has graciously and capably served in such position, combining
good - humored and astute leadership with a common sense approach to problem solving; and,
WHEREAS, Marc Fink has tendered his resignation as a Director after serving the
customers of the Authority with distinction for eight years; and,
WHEREAS, Marc Fink unofficially claimed the title of "Voluntary Inspector" for the
Crystal Spring Project, which he monitored during routine neighborhood walks; and,
WHEREAS, Marc Fink has been known to support innovative solutions to improve
service to the Authority's customers, demonstrated a commitment to regionalism, has been a
friend to both management and staff, always commending employees on accomplishments; and,
WHEREAS, the Authority has determined to present this Commendation Resolution for
Mr. Fink's outstanding contributions to the success of the Authority in spite of the fact that it
may cause the meeting to last longer than the prescribed time;
NOWTHEREFORE, be it resolved by the Directors of the Western Virginia Water
Authority that they extend their heartfelt thanks and gratitude to Marc Fink for his dedicated
service to the Authority and its customers, and that they send him on his way with warm regards
and best wishes for his continued health and success.
AND BE IT FURTHER RESOLVED, that a certified copy of this resolution be

A RESOLUTION authorizing the acceptance of funding for the regional drug prosecutor's
office from the Compensation Board of the Commonwealth of Virginia and authorizing the
acceptance, execution, and filing of appropriate documents to obtain such fiords.
BE IT RESOLVED by the Council of the City of Roanoke as follows:
The City of Roanoke hereby accepts funding for the regional drug prosecutor's office
in the total amount of $106,701.00 from the Compensation Board of the Commonwealth of Virginia
through June 30, 2016.
2. The City Manager is hereby authorized to accept, execute, and file on behalf of the
City of Roanoke any and all documents required to obtain such funding. All such documents to be
approved as to form by the City Attorney,
3. The local share for Fiscal Year 2015 -2016 shall be in the amount of $55,375.00.
The City Manager is further directed to Furnish such additional information as maybe

Subject: Acceptance of Funding for Drug Prosecutor
Background:
Federal funding was made available to the Commonwealth of Virginia to be
used for the development of several Multi jurisdictional Special Drug
Prosecutors statewide. The positions were developed to coordinate
prosecutorial efforts among independent jurisdictions, reduce fractional and
duplicate prosecutions, enhance the recovery of criminal assets, and utilize
federal, state and local resources to assure maximum prosecutorial
effectiveness and to provide specialized prosecutorial resources to the regional
drug enforcement effort. The Commonwealth's Attorneys of Craig County,
Franklin County, Roanoke County, and the Cities of Roanoke and Salem applied
on October 9, 1987, to the Commonwealth's Attorneys' Services Council, the
State agency responsible for the administration of the grant money, to fund a
Multi - Jurisdictional Special Drug Prosecutor. City Council accepted the Multi -
jurisdictional Special Drug Prosecutor Grant in April, 1988, and a full -time
Special Drug Prosecutor was hired in July, 1988. Annual re- application for this
funding is required.
Considerations:
On April 15, 1994, funding for the Drug Prosecutor's Office was transferred
from the Commonwealth's Attorneys' Services Council to the Compensation
Board. The Compensation Board approved funding for the Drug Prosecutor in
the amount of $106,701 effective May 1, 2015, and funding will continue
through June 30, 2016. A local match is required. The local match is $55,375
for a total funding of $162,076. Funding for the local share is available in the
General Fund - Transfer to Grant Fund (account number 01 -250- 9310- 9535).
Recommended Action:
Authorize the application for the Grant and accept funding from the
Compensation Board in the amount of $106,701 with the City providing local
match funding in the amount of $55,375. Authorize the City Manager to
execute the requisite documents to obtain the funding from the Compensation
Board. All such documents shall be reviewed and approved as to form by the
City Attorney.
Adopt the accompanying budget ordinance to establish revenue estimates for
$106,701 in state grant funds and $55,375 in local match, to transfer local
match funding from the General Fund Transfer to Grant Fund account (01 -250-
9310- 9535), and to appropriate funding totaling $162,076 per attachment 1

Assessment Grant to fund environmental assessments in the City on eligible properties and
related activities, and authorizing execution of any required documents on behalf of the City in
connection with such grant under certain conditions.
BE IT RESOLVED by the Council of the City of Roanoke as follows:
The City Manager is hereby authorized on behalf of the City to accept a U.S.
Environmental Protection Agency Brownfield Assessment Grant in the amount of $200,000,
with no local match, to provide funds to update property databases, engage property owners and
the general public, and conduct environmental site assessments on select properties that wish to

Subject: EPA Hazardous Site Brownfield Assessment Grant
Background:
The U.S. Environmental Protection Agency (EPA) administers a Brownfield
Redevelopment Program that annually awards grants to states, tribal
authorities, and local governments. The intent of these grants is to foster
economic development by reducing or mitigating any real or perceived
environmental hazards. The EPA has awarded the City of Roanoke a
Brownfields Hazardous Site Assessment grant in the amount of $200,000 to
fund environmental assessments in the City on eligible properties. Roanoke's
Rail Corridor Planning Area will be the focal point of this grant; however,
properties anywhere in the City may be eligible for use of these funds. The
"Rail Corridor Planning Area" is the subject of the Brownfield Rail Corridor
Revitalization Plan, completed in 2012 with funding from an EPA area -wide
planning grant. The corridor covers approximately 558 acres from 5" Street,
N.W. and S.W., on its eastern edge to 24" Street, N.W. and S.W., on its western
edge. The corridor's southern boundary follows Patterson Avenue, S.W., and
the northern boundary follows Loudon Avenue, N.W. There are approximately
sixty brownfield eligible properties and sites within the corridor. The corridor
also overlaps with the Choice Neighborhoods planning area, for which the City
has partnered with the Roanoke Redevelopment and Housing Authority in
applying to the Department of Housing and Urban Development for over $20
million of funding to implement the Choice Neighborhood Transformation Plan.
No matching funds are required from the City. Funds from the grant will be
used to update the property databases, engage property owners and the
general public, and conduct environmental site assessments on select
properties that wish to participate. This grant also furthers the implementation
of the City -Wide Brownfield Redevelopment Plan previously adopted by Council
in 2008 as a component of the City's comprehensive plan, Vision 2001 - 2020.
Considerations:
City Council action is needed to formally accept and appropriate this grant to
fund such uses as established in a cooperative agreement - between the EPA and
the City, and to establish necessary guidelines for the use of the funds. A copy
of such agreement is attached to this letter.
Recommended Action:
Accept the grant as described above and authorize the City Manager to execute
any required grant agreements, or related documents, such to be approved as
to form by the City Attorney. Further authorize the City Manager to execute
any necessary additional documents, provide any additional information, and to
take any necessary actions in order to obtain, accept, receive, implement, use,
and administer such grant, including establishing guidelines for the use of such
grant funds.

1.0 PROJECT OVERVIEW
Roanoke established a formal brownfield redevelopment program and, subsequently, adopted a City-
Wide Brownfield Redevelopment Plan in 2008. The Brownfield Plan was developed based on public input to
create a broad vision and policy framework for sustainable brownfield reuse including: (1) converting
underused industrial property along the Roanoke River to a linear park space with complementary commercial
and residential uses; (2) reusing sites in the urban core for housing, small businesses and/or entrepreneurial
and technology ventures that will create diverse, walkable and livable neighborhoods; and (3) reinforcing
viable industrial corridors by encouraging reuse of underused properties for expansion of existing businesses
and attracting strategic new industry.
Roanoke has no shortage of brownfield properties with which to continue our brownfields program. As
part of this initiative the City will conduct Phase I and Phase I I Environmental Site Assessments (ESAs) on key
brownfield sites that are identified and determined as priorities through a community- oriented inventory and
planning process. Cleanup and redevelopment planning will be conducted for sites requiring cleanup activities.
The City will manage the grant using an in -kind contribution of our own personnel to ensure that as much of
the grant funding as possible will be dedicated to the initiative's three primary tasks: 1) Community Outreach,
2) Site Assessment, and 3) Cleanup and Redevelopment Planning.
The City will continue to use its staff to operate its brownfield program, thus no personnel or fringe
benefits are budgeted. The City's Brownfield Team consists of:
• Frederick Gusler, Senior City Planner— Mr. Gusler has been the brownfield coordinator since 2010.
He also leads long -range planning efforts such as neighborhood plans and the City's planning of HUD
funds.
• Christopher Blakeman, Environmental Administrator —Mr. Blakeman oversees the City's operation to
ensure compliance with OSHA and other regulations, and provides technical assistance under the
brownfield program,
• Brandon Turner- Economic Development Specialist — Mr. Turner is responsible forthe administration
of the City's Enterprise Zone program and is staff support to the City's Economic Development
Authority. He is actively involved with business expansion and retention activities, and marketing the
brownfield program.
The City's organizational structure provides support to the Brownfield Team for implementation of and
accountability for the appropriate use of grant funding through the Department of Finance, Department of
Management and Budget, and an internal Municipal Auditing Department, as well as procured independent,
external auditing. The City Attorney's Office and Purchasing Division provide staff support for review of
Cooperative Agreements, the development of contracts and sub - agreements that meet EPA requirements and
ensure that procurement of consulting and other services meet federal, commonwealth, and local
requirements. The City currently has four environmental consulting firms pre - qualified to provide Phase I and
Phase 11 ESAs as well as cleanup planning services for brownfeld sites. As projects are initiated, the City will
request competitive bids from the pre - qualified consultants.
2.0 SCOPE OF WORK (Project Task Descriptions)
The City of Roanoke will use funding for community outreach, site assessment, and
cleanup/redevelopment planning on potential brownfield sites. The estimated costs are based on our previous
grant experience and estimates provided by the four consulting firms selected to provide brownfield support
services. As such, funds will be used to complete the following tasks:
Task 1 - Community Outreach
Roanoke has a long history of working with its neighborhood groups. The City will work with these
neighborhood groups and others to identify and set priorities for the brownfeld sites and also help formulate of
redevelopment plans at selected sites. Regular community meetings will be held to gather input, and the
project will be discussed at the City's Council meetings, which are open to the public. Other community
outreach already planned for community development will provide an excellent opportunity to inform and
educate the community about brownfields and to secure community recommendations for grant
implementation. The City will prepare outreach materials and distribute them to local stakeholder groups, such
as information sheets, a project brochure, and a website page will provide up to date intonation about the
brownfelds program. To assist in these efforts, $3,000 of the budget is requested to complete this task for supplies
or the purchase of items needed to successfully go into the community and clearly present project information.
In addition to the funds requested above, the City of Roanoke estimates a contribution of $25,000 of in-
kind resources (labor) to prepare for, travel to and from, and facilitate public meetings; provide oversight and
direction; and review /approve outreach materials (web design, brochures, fact sheets, etc.). As was the case
with previous EPA brownfield grants, the City's staff will administer the grant and aside from supplies, no other
funds are needed for administration. The Brownfield program is recognized as a priority in the City's budget by
continuing to devote a portion of staff time to it, and by maintaining contracts
Task 2 — Program Development
To remain apprised of the latest issues involved in brownfield redevelopment and to network with other
towns /municipalities implementing brownfield programs, we are requesting JIM for travel expenses. We
anticipate attendance at the EPA's National Brownfield Conference as well as state or regional conferences,
workshops, and pertinent training sessions.
Task 3 — Brownfield Inventory
Roanoke has done several inventories; a DEQ petroleum and dry cleaner map and database was created
and later updated and is frequently used to identify properties for eligibility, and a preliminary inventory of
properties was identified in the Rail Corridor. However, funds are requested to continue to update this
inventory by soliciting public input, compiling available historic information and regulatory data, and identifying
site with high redevelopment potential. Properties will then be prioritized for assessment. We are requesting
$5,000 for a qualified consultant to complete this task.
Task 4 — Site Assessments
Prior to this application, the City updated its generic Quality Assurance Project Plan (CAPP), and it was
approved by the EPA in 2014. The QAPP is used accordingly as a reference and project guide for the
environmental consultants under contract to the City. Once properties are prioritized based on the criteria in
2.a.iii, consultants will conduct mostly Phase I and II environmental site assessments (ESAs), but also
asbestos - containing materials and lead -based paint surveys, endangered species and cultural /historical
resources surveys, and other relevant environmental assessments as approved by EPA.
Phase I ESAs conducted under this project will be performed by qualified contractors and in accordance
with American Society for Testing and Materials (ASTM) Standard E1527 -13 and the EPA All Appropriate
Inquiry (AAI) Final Rule. Phase II ESAs will be conducted by qualified contractors in accordance with ASTM
E1903 -11. Approximately 5 Phase I ESAs costing $3,000 each will be completed along with three Phase II
ESAs at an average cast of approximately $44,000 per assessment. Cost estimates are based upon invoices
from previous brownfield assessments completed for the City. In addition to completing Phase I and II ESAs,
consultants will complete site - specific Quality Assurance Project Plans (QAPPs) and Health & Safety Plans
(HSPs) prior to initiating field work.
Task 5 - Redevelopment Planning
The ultimate goal for redevelopment is to provide potential site developers andlor other stakeholders with
documents that quantify and qualify the environmental risks on a particular property. Subsequent to
assessment activities, the City will develop remediation and cleanup plans on sites determined to be the
highest priority. These activities will include the development of an Analysis of Brownfield Cleanup Alternatives
(ABCA) which will identify potentially applicable remediation alternatives and estimate the nature, extent,
duration, and cost of implementing site remediation activities. Data from Phase II ESAs in conjunction with any
other data from environmental assessments available for the property will be used as the basis for evaluating
potential remedial alternatives for a brownfield site. We anticipate developing 3 detailed ABCAs at a cost of
approximately $6,000 per document. Additionally, we are planning one major visioning session with the public
for a cost of approximately $10,000. Sites selected for redevelopment will be based on reuse alternatives
identified through community outreach activities and the environmental impacts associated with the properties.

6.0 Leveraging: Firm commitments of leveraged funding described in the applicant's proposal are
referenced below. These commitments must be tracked in the quarterly progress reports as
well as ACRES leveraged funds. Since these commitments can come from public or private
sources, there is the possibility that the commitments might not materialize through no fault of
the grantee. Since there is an uncertainness about these funds, they are not included on the

Homeless Solutions Grant Award
Background:
As the grantee, the City of Roanoke received notification of award from the
Department of Housing and Community Development (DHCD) in the amount of
$90,685 through the Virginia Homeless Solutions Program (VHSP) grant. The
VHSP is a state and federally funded program through the State General Fund
and the federal Emergency Solutions Grant (ESG) to support Continuum of Care
(CoC) strategies and homeless service and prevention programs aimed at
reducing the number of individuals /households who become homeless;
shortening the length of time an individual or household is homeless, and,
reducing the number of individuals /households that return to homelessness.
These funds will be used to support the following programs: City of Roanoke
Central Intake ($54,893); the Council of Community Services planning activities
($26,792) and Safehome Systems in Covington ($9,000). The City will be
serving as fiscal agent for these funds and entering into a contractual
agreement with the Council of Community Services and Safehome Systems.
These funds must be expended or obligated during the award period of July 1,
2015 to June 30, 2016.
Grantees are required to provide a 25% community -wide match with local or
private funds for the entire DHCD -VHSP award amount. Match
contributions /types are as follows: the City of Roanoke is providing $15,000 of
"in- kind" space contribution for the Central Intake program; Safehome Systems
is providing an in -kind match of $9,000.
Recommended Actions:
Authorize the application and accept the Department of Housing and
Community Development grant in the amount of $90,685 and authorize the
City Manager to execute the grant documents associated with this funding. All
documents shall be approved as to form by the City Attorney.
Adopt the accompanying budget ordinance to establish a revenue estimate in
the amount of $90,685 and to appropriate the same amount to expenditure

Subject: Child Abuse and Neglect Prevention Program Grant
Background
Beginning in January 2014, the City of Roanoke Department of Social Services
(DSS) partnered with Blue Ridge Behavioral Health (BRBH) and Intercept Youth
Services to develop a parent program for parents at risk of abusing and /or
neglecting their children. This parenting initiative includes a classroom and in-
home practice component and is focused primarily on parents with children
ages 5 to 12 years old. It has been funded primarily through state /federal
Promoting Safe and Stable Families (PSSF) funds. PSSF funds can only fund three
classes of 15 people per year. Due to the popularity and initial success of the
initiative DSS submitted a grant proposal to Virginia DSS State Office to fund
additional classes which will focus on serving 45 parents with children ages 0 to
5 years, as well as young parents, and Latino parents. PSSF funds will continue
to fund classes for 46 parents of children 6 years and older.
The City of Roanoke's DSS has been awarded a Child Abuse and Neglect
Prevention Program grant to provide parenting classes with an in -home
component to 45 parents of children 0 -5 years old identified by DSS as at risk
of abusing and neglecting their children. The program is entitled "Parenting
Little Ones ". The award is for $50,000 and will be used to pay for the classroom
and in -home components, translators for Latino parents, bus passes to assist
families with transportation to the class, and child care while the parents attend
the class.
This award requires a 25% match of local funds. The total match is $16,666,
$9,384 is in -kind and the remaining $7,282 is a cash match which can be
provided from the Grant Matching account 35- 300 - 9700 -5415. The award is
available starting July 1, 2015.
Recommended Action:
Accept the Child Abuse and Neglect Prevention Program grant and authorize
the City Manager to execute the grant agreement and any necessary documents
to be approved as to form by the City Attorney.
Adopt the accompanying budget ordinance to establish a revenue estimate in
the Grant Fund for $57,282, transfer funding in the amount of $7,282 from
account 35- 300 - 9700 -5415 (Local Match Funding for Grants) to provide the
local match funding, and appropriate total funding of $57,282 into accounts to

Subject: Easement Request from Western Virginia Water Authority Located at
Round Hill Elementary School
Background:
In an effort to increase the fire flow to the neighborhood southeast of Round Hill
Elementary, the Western Virginia Water Authority ( "Authority "), is looking into ways to
connect the area to the 12" waterline currently on Valley View Blvd, NW, thereby
creating a loop that would increase the flow to the area. To accommodate this
connection, and as part of renovations to Round Hill Elementary School, located on
City -owned property designated as Tax Map No. 2250102, the Authority requests the
City to grant the Authority a 20 ft. public waterline easement. This easement will
allow a 250 foot extension of the 12" waterline on Valley View Blvd to serve the new
fire protection vault for the school.
Considerations:
Current fire flow tests performed by the City's Fire Department on hydrants located
on Courtland. Rd, Valley View Ave, and Oakland Blvd, NW show an average flow
between 250 for 500 gallons per minute, while flows done in the Valley View Blvd
area average between 1,000 to 2,500 gallons per minute. A connection between the
two areas would provide a loop in the water distribution system and increase fire flow
availability at the Round Hill Elementary school and in the Oakland Blvd NW area.
The additions to the school require an additional fire hydrant be located near the
front of the school. If the water extension could be completed in time, the possibility
exists for the hydrant to be installed on a public main which would be maintained by
the Authority and such installation will benefit the school.
Recommended Action:
Authorize the City Manager to execute the appropriate easement agreement with the
Western Virginia Water Authority granting an approximately 20 ft. public waterline
easement for a future connection to Round Hill Elementary. The form of such
easement agreement to be approved as to form by the City Attorney.

Subject: Amendments to Two Contracts for the Transportation
Structures Inspection Program (2014 -2018) Year Two of Five
Background:
In 1978, Congress passed the Surface Transportation Act, requiring that all
bridges and culverts over 20 feet in length, including 'off Federal Aid System"
structures, and overhead traffic signs be inspected annually or biannually,
depending on construction type. Inspections are due this calendar year on 6S
structures in the City of Roanoke.
A Contract dated June 30, 2014, was issued to AECOM Technical Services, Inc.
( AECOM) for the Transportation Structures Inspection Program (2014 -2018) with
years two thru five to be negotiated based on the number of structures to be
inspected in each of those subsequent years. A similar Contract dated July 8,
2014, was also issued to Mattern & Craig, Inc. for the program as the inspection
of the structures is rotated among different consultants. Amendments are now
needed for year two. AECOM has agreed to inspect 35 structures for the cost of
$91,603.00 for year two. Mattern & Craig, Inc. has agreed to inspect 30
structures for the cost of $91,589.52 for year two.
In addition to the inspection services, and as allowed under the original
Contracts, each firm has been asked by the City to provide additional
engineering design services for repairs relating to specific transportation
structures. AECOM will provide the requested structural repair and joint
closures design services for the Franklin Road Bridge over Roanoke River and
Walnut Avenue Bridge over Norfolk Southern Railway for $22,288.00 and
rehabilitation drawings for the 13" Street, SW Bridge over Norfolk Southern
Railway for $82,988.00. Total additional services for AECOM are expected to be
$105,276.00. Mattern & Craig, Inc. will provide the requested roadway and
bridge replacement study for Berkley Road Bridge over Glade Creek for
$29,950.00 and a bridge rehabilitation design for the Brandon Avenue Bridge
over Murray Run for the cost of $51,800.00. Total additional services for
Mattern & Craig, Inc. are expected to be $81,750.00. The City Engineer has
also recommended that $5,000 be added to each Contract to cover any
contingencies that may arise during the provision of the professional services
for year two. This wD result in a total Amendment amount for AECOM of
$201,879.00 and a total Amendment amount for Mattern & Craig, Inc. of
$178,339.52.
Considerations
City Council approval is needed to pay for such additional services through
Amendments to the current Contracts.
Funding in the amount of $380,218.52 for the two (2) second -year Amendments

Background:
Roanoke Fire -EMS serves as the region's Level III Hazardous Materials Response
Team. Every five years the City of Roanoke signs a new contract with the
Virginia Department of Emergency Management (VDEM) agreeing to maintain
this response. As part of this contract, the Roanoke Fire -EMS Department
receives funds from VDEM to reimburse the Hazardous Materials Response
Team for the equipment, labor, and other costs associated with hazardous
materials emergency responses. Additional funds are also available for
specialized training for the Hazardous Materials Response team.
Considerations:
City Council action is needed to accept and appropriate funds received for
reimbursement to the City of Roanoke for hazardous materials responses and
specialized training.
Recommended Action:
Adopt the accompanying budget ordinance to increase the revenue estimate in
the grant fund in the amount of $31,457 and appropriate funding of $31,457 in
a project account established by the Director of Finance.

WHEREAS, the Contract was amended July t, 2014 to adjust the monthly fee and to increase
the scope of services to provide for on- street parking enforcement and administration services
(Amendment No. 1) and, pursuant to the provisions of Amendment No. 1, the monthly fee for the
period of July 1, 2014 to June 30, 2015 was increased to $96,411.46;
WHEREAS, the Contract was amended April 1, 2015 to reduce the scope of services and
decrease the Contract amount due to the sale of Williamson Lot, located at 206 Williamson Road, S.E
(Amendment No. 2), and pursuant to the terms of Amendment No. 2, the monthly fee for the period of
April I, 2015 to June 30, 2015 was reduced to $94,871.93;
WHEREAS, a third Amendment is now needed to adjust the monthly fee for the period of July
1, 2015 to June 30, 2016 (Amendment No. 3) which, pursuant to the provisions of Amendment No. 3,
the monthly fee will be reduced to $93,706.43, as a result of cost- saving measures, retroactive to July 1,
2015;
W HERE AS, in reviewing Amendment No. 3, it was discovered that, as a result of an inadvent at

In reviewing Amendment No. 3, we discovered that the increase in the monthly Contract antount set forth in
Amendment No. 1 ($96,411.46) increased the Contract amount more than 25% over the original Contract
amount by approximately $3,100 per month and Amendment No. 1 should have been presented to City
Council for authorization. This mistake occurred due to an inadvertent miscalculation. The services provided
under Amendments No. I and 2 were completed as of June 30, 2015. The monthly fee after Amendment No.
3 remains slightly over the 25% threshold (approximately $335.00 per month).
Lancor has executed Amendment No. 3 and agrees to the new reduced monthly fee.
Considerations
City Council approval is needed to ratify, confirm, and authorize Amendment No. 1 and Amendment No. 2,
and authorize Amendment No. 3 to the current Contract, retroactive to July 1, 2015. Funding in the amount of

AN ORDINANCE to readopt and reenact the Code of the City of Roanoke (1979), as
amended; and dispensing with the second reading of this ordinance by title.
WHEREAS, by Ordinance No. 25043, adopted April 7, 1980, this Council adopted and
enacted a new code for the City of Roanoke entitled the Code of the City of Roanoke (1979)
(hereinafter sometimes referred to as the "City Code ");
WHEREAS, such Code, as amended, contains certain provisions which incorporate by
reference portions of the Code of Virginia (1950), as amended, (hereinafter "State Code ");
WHEREAS, from dine to time, certain of these State Code sections which are
incorporated by reference in the City Code have been amended by the General Assembly;
WHEREAS, such amendments are a matter of public record which are set forth in the Acts
of Assembly and supplements and replacement volumes of the State Code; and
WHEREAS, it is the desire of this Council that those provisions of the City Code which
adopt by reference State Code provisions shall be fully consistent with enactments of the most
recent Session of the General Assembly,
THEREFORE, BE IT ORDAINED by the Council of the City of Roanoke that:
1. The Code of the City of Roanoke (1979), as amended, a copy of which is on file
in the City Clerk's Office, consisting of Chapters I through 36.2, each inclusive, is hereby
readopted and reenacted. Such Code amendments heretofore and hereafter adopted shall continue
to be known as the Code of the City of Roanoke (1979), as amended.
2. With respect to sections or provisions of the State Code incorporated by
reference in the City Code, Council recognizes any amendments made to such sections or
provisions of the State Code by the most recent Session of the General Assembly and hereby
expresses the intent and ordains that such amendments to sections or provisions of the State
Code incorporated by reference in the City Code shall be included in the City Code verbatim
as enacted by the most recent Session of the General Assembly.
Any reference in the City Code to any section, article or chapter from former
Titles of the State Code shall be deemed and construed to apply to the successor section,

Since 1982, City Council has reenacted and recodified the City Code on an annual basis in order
to properly incorporate in the Code amendments made by the General Assembly at the previous
Session to State statutes that are incorporated by reference in the City Code. This procedure ensures
that the ordinances codified in our Code incorporate the most recent amendments to State law.
Incorporation by reference is frequently utilized in local codes to preclude having to set out
lengthy provisions of State statutes in their entirety. In addition, the technique ensures that local
ordinances are always consistent with the State law as is generally required.
The procedure whereby a local governing body incorporates State statutes by reference after
action of the General Assembly has been approved by the Attorney General. See Report of the
Attorney General (1981 -1982) at 272. 1 recommend that Council adopt the attached ordinance to
readopt and reenact the Code of the City of Roanoke (1979), as amended. If the attached ordinance is
not adopted, City Code sections incorporating provisions of the State Code amended at the last Session
of the General Assembly may not be deemed to include the recent amendments and may be
impermissibly inconsistent which could result in the dismissal of criminal prosecutions under these
City Code sections.

The following financial report provides a summary of the City's financial results for the
eleven months ended May 31, 201 S.
General Fund
Year -to -date general fund revenue recognized was 87.7% of FYI estimated revenue.
However, several significant revenue reimbursements from the Commonwealth, such
as Personal Property Tax Relief, Street Maintenance, and certain local tax revenues will
be received in the next month. FYI 5 revenue by year -end is projected to exceed the
FYI adopted budget by approximately $4.9 million. FYI year -to -date revenues
increased 3.5% or $7.7 million compared to the same period in FY14. The increase
was primarily due to higher General Property, Sales, Meals, Business License and
Transient Occupancy tax revenues. Total local tax revenues are projected to exceed
FYI budget in the amount of $3.5 million. Also contributing to the increase were
increased reimbursements from the Commonwealth for Street Maintenance. The
increase was partially offset by the reinstatement of Local Aid to the Commonwealth
and a refund of prior year's bank franchise fees to Bank of America. The City revised
the FYI revenue estimates for certain revenues and increased appropriations in June
to recognize the positive revenue performance impact and associated expenditure
impact such as increase in the school funding. The City has continuously analyzed its
revenue estimates in light of recent economic trends.
Year -to -date expenditures in FYI increased 0.9% or $2.2 million compared to the
same period in the prior year. It is expected that expenditures will remain within the
current budget for the year.
Stormwater Utility Fund
FYI is the first year of operations for the Stormwater Utility Fund. Stormwater fee
revenue year -to -date as of May 31, 2015 was $1.8 million, or 105.7% of FY15
anticipated revenues, which was ahead of target. Operating expense was $1.7 million,
or 61.8% of the expense budget resulting in an operating gain of $104,000. Net
position after transfers and contributions was approximately $576,000.
Civic Center Fund
FYI S year -to -date net change in position was a loss of $958,000 compared to the
budgeted loss of 51.2 million. The year -to -date operating revenue through May was
$1.8 million lower than the budgeted revenues primarily due to lower than expected
ticket revenue as a result of the timing and type of events. Correspondingly, operating
expense was $2.0 million lower than budgeted. The operating loss was approximately
$181,000 less than the fiscal year to date budgeted operating loss. The current
forecast indicates the center's performance will be approximately $216,000 below
budget.
Parking Fund
Through May, approximately 96.2% of anticipated operating revenue has been realized.
Market Garage revenues declined due to the impact of construction of the Hampton Inn
& Suites project. Gainsboro Garage revenues significantly decreased following the
reopening of the Poff Federal Building and the relocation of tenants back to the
building. Elmwood and Church Avenue Garages outperformed the prior fiscal year.
Williamson Lot has stopped generating revenue because the property was sold in
March 2015. On Street Parking revenues increased compared to the prior fiscal year.
Operating expenses decreased 1.0% or $25,000 from the prior year. Operating
income, before the net decrease of non - operating expenses and transfers, was
approximately $563,000. After non- operating expenses and transfers, the fund's
change in net position was approximately $144,000.
Closing
In closing, the national unemployment rate ticked up slightly to 5.5% in May, but
overall, the labor market remained strong. The U.S. economy is growing moderately
after a first quarter contraction. The Federal Reserve is likely to raise interest rates as
soon as September.
The City's general and local tax revenues increased 4.0% in FYI compared to the
same period last year, indicating a growing local economy. However, while most other
local tax revenues have increased compared to FYI 4, several have not yet recovered to
pre- recessionary levels.
Expenditures are expected to remain within the budget for the year as a whole

FY15 General Fund Overview
• Year -to -date general fund revenue recognized was 88% of FY15
estimated revenue. Significant revenue reimbursements from the
Commonwealth, such as personal property tax relief, street
maintenance and certain local taxes to be received in the next month.
• Through May, actual FY15 revenues have increased
3.5% compared to FY14. The projected FY15 revenue by year-
end is 1.9% or $4.9 million higher than FY15 adopted budget.
• The City's sales, lodging and meals taxes performed well
and contributed to strong local tax revenue growth.
• Expenditures increased 0.9 % or $2.2 million, compared to the same
period FY14. Departmental expenditures are expected to remain
within budget.

Through May
• Total revenues through May were 3.5% higher than the prior
year. Total general property and local taxes were up 4.0%
compared to last year, indicating a growing local economy.
• Departmental expenditures continue to be monitored and are
expected to remain within budget.
• In May, the national unemployment rate ticked up slightly to
5.5 %, but overall labor market remained strong.
• The U.S. economy is growing moderately after a first quarter
contraction. Federal Reserve is likely to raise interest rates as
soon as September.

(a) Appheabday. The supplemental regulations set out in this section shall
apply to bed and breakfast and homestay establishments permitted by this
chapter as of light or by special exception.

(c)(b) Genefal�, Stand ards for bcd and breakfast establishments.
(1) Such establishments shall be located within a single - family
detached dwelling.
(4)(2) No exterior changes to the single - family detached dwelling
occupied by the bed and breakfast shall be permitted unless such
change is required by the Zoning Administrator for safety proposes
or such change can be shown to be in harmony with the structure's
architectural and historic value.
(2)(3) The owner of the single- family detached dwelling occupied by the
bed and breakfast establishment shall reside in the dwelling.
M(4) No more than six (6) guest sleeping rooms shall be utilized for a
bed and breakfast establishment and the number of guest occupants
shall not exceed twelve (12).
(4)(5) Rooms shall be rented only on a daily basis.
(5)(6) One (1) sign attached to the building shall be permitted. Such sign
shall have a sign area not exceeding two (2) square feet and shall
not be illuminated.
(6)(7) Only accessory uses or structures which are incidental and
subordinate to a single- family detached dwelling shall be permitted
in conjunction with a bed and breakfast establishment.
(c) Standards for homestay establishments.
(1) No changes shall be made to the exterior of the building occupied
by the homestay.
(2) The homestay shall have no more than two (2) bedrooms for guests
and shall accommodate no more than four (4) total guests.
(3) Rooms shall be rented only on a daily or weekly basis. Stays shall
not exceed 14 days.
The owner or leaseholder shall also occupy the dwelling unit
during guest stays.

Sec. 36.2 -418. Motor vehicle or trailer painting and body repair .

standard set forth in subsection (a), above, a motor vehicle or trailer
painting and body repair establishment in the Light Industrial District (1 -1)
or the Heavy Industrial District (1 -2) shall be subject to the following
Ieq uiremcnts:
(2) The outdoor storage area shall be accessory to a building on the
same lot and shall have a maximum area of no greater than eighty
(80) percent of the gross floor area of the building.; and
Sec. 36.2 -429. Temporary uses.
(e) Public events. For purposes of this section, a "public event" means an
event, series of events, or organized activities for a historical, social,
educational, cultural, or special theme, held for a limited period of dine
and open to the public. Temporary public events shall include, without
limitation, carnivals, festivals, exhibits, outdoor dance, fundraisers, fairs,
and concerts. Camping areas for tents and recreational vehicles may be
established on properties within 1,000 feet of the public event for the
duration of the public event. Public events, including associated
temporary structures such as tents, shall be permitted as set forth in Table
429 -1, except that
(1) The following public events shall be exempt from the requirements
of a zoning permit:
(A) Events that use no tents or air - supported structures that
(i) Cover an area greater than nine hundred (900)
square feet; or
(ii) Have an occupant load greater than fifty (50)
persons.
(B) Events that use no temporary structures greater than one
hundred twenty (120) square feet in area;
(C) Events that are accessory in nature to the primary use of the
property on which the event is being held;
(D) Events that do not use amusement devices requiring a
building permit; and
(E) Events lasting four (4) days or less.

(2) A temporary structure, including any tent, may be permitted to
remain on site for a period of not more than two (2) calendar days
following the time period for which the zoning permit for the
temporary public event is issued;
(3) Adequate provision shall be made for utility services; and
(4) Such public event shall not occur between the hours of 2 :00 a.m.
and 6:00 aan.

Sec. 362 -540. Zoning amendments.
M Notice of hearing. Prior to conducting any public hearing required by this
chapter before the City Council or the Planning Commission, notice shall
be given as required by Section 15.2 -2204 of the Code of Virginia (1950),
as amended The expense of advertising shall be home by the applicant.
Fees for such advertisements shall be as set forth in the City of Roanoke's
Fee Compendium and as adopted by City Council in accordance with
Section 15.2 -107 of the Code of Virginia (1950), as amended. Any
affidavits required by Section 15.2 -2204, Code of Virginia (1950), as
amended, shall be filed with the City Clerk. In addition, and as a courtesy
to the general public, at least ten (10) business days prior to the public
hearing before the Planning Commission, the Zoning Administrator shall
erect a sign indicating the zoning district requested, identification of the
subject property, and the time, date, and place of such public hearing as set
forth in the schedule below:

(b) Procedures.
(1) Applications for special exceptions may be made by any property
owner, tenant, government official, department, board, or bureau.
Such application shall be filed with the Zoning Administrator in
accordance with rules adopted by the Board of Zoning Appeals.
Upon receipt of a complete application for a special exception, the
Board of Zoning Appeals shall hold a public hearing after giving
notice as provided in Section 15.2 -2204, Code of Virginia (1950),
as amended. However, when giving any required notice to the
owners, their agents, or the occupants of abutting property and
property immediately across the street or road from the property
affected, the Board may give such notice by first class mail rather
than by registered or certified mail. In addition to meeting the
requirements of Section 15.2 -2204, and as a courtesy to the general
public, the Zoning Administrator shall erect a sign indicating the
nature of the special exception requested, identification of the
subject property, and the time, date, and place of such public
hearing at least ten (10) business days prior to the public hearing
before the Board of Zoning Appeals. Failure by the zoning
administrator- to comply with the requirement of posting a sign on
the subject property shall not be a ground for cancelling,
rescheduling or continuing a public hearing at the request of any
applicant or interested person or entity on any matter otherwise
properly advertised for public hearing in accordance with Section
15.2 -2204 of the Code of Virginia (1950), as amended. No

(c) Standards for considering a variance. Notwithstanding any other
provision of law, general or special, a variance shall be granted if the
evidence shows that the strict application of the terms of the ordinance
would unreasonably restrict the utilization of the property or that the
granting of the variance would alleviate a hardship due to a physical
condition relating to the property or improvements thereon at the time of
the effective date of the ordinance, and
(1) the property interest for which the variance is being requested was
acquired in good faith and any hardship was not created by the
applicant for the variance;
(2) the granting of the variance will not be of substantial detriment to
adjacent property and nearby properties in the proximity of that
geographical area;
(3) the condition or situation of the property concerned is not of so
general or retuning a nature as to make reasonably practicable the
formulation of a general regulation to be adopted as an amendment
to the ordinance;
(4) the granting of the variance does not result in a use that is not
otherwise permitted on such property or a change in the zoning
classification of the property; and
(5) the relief or remedy sought by the variance application is not
available through a special exception process or the process for

(d) Conditions and guarantees. In granting a variance the board
may impose such conditions regarding the location, character and other
features of the proposed structure or use as it may deem necessary in the
public interest, and may require a guarantee or bond to ensure that the
conditions imposed are being and will continue to be complied with.
(e) Conforming status. Notwithstanding any other provision of law, general
or special, the property upon which a property owner has been granted a
variance shall be treated as conforming for all purposes under state law
and the zoning ordinance; however, the structure permitted by the variance
may not be expanded unless the expansion is within an area of the site or
pail of the structure for which no variance is required under the zoning
ordinance. Where the expansion is proposed within an area of the site or

part of the structure for which a variance is required, the approval of an
additional variance shall be required.

shall fix a reasonable tune for the hearing of the appeal and make
its decision within ninety (90) calendar days of the filing of the

agents, or the occupants of abutting property and property
immediately across the street or road from the property affected,

Sec. 36.2 -563. Appeals from board of zoning appeals.

(d) If, upon the hearing, it shall appear to the court that testimony is necessary
for the proper disposition of the matter, it may take evidence or appoint a
commissioner to take evidence as it may direct and report the evidence to
the court with his findings of fact and conclusions of law, which shall
constitute a part of the proceedings upon which the determination of the
court shall be made. The court may reverse or affirm, wholly or partly, or
may modify the decision brought up for review.
(f) In the case of an appeal by a person of any decision of the Board of
Zoning Appeals that denied or granted an application for a variance, ee

Appeals shall be presumed to be correct. The petitioner may rebut that

(g) In the case of an appeal by a plasm, of any decision of rho board of zoning
appeals- that denied or granted application for a special exception, the
decision of the board of zoning appeals shall be presumed to be correct.
The petitioner may rebut that presumption by showing nr the satisfaction
Of the court that the board of Zoning appeals applied erroncoos principles
of law, or where the discretion of the board of Zoning appeals is involved,
the decision of the board of zoning appeals was plainly wrong, was in
violation of file purpose and intent of the zoning ordinance, and is not
fairly debatable.
(g)(h) Costs shall not be allowed against the Board, unless it shall appear to the
court that it acted in bad faith or with malice in making the decision
appealed fiom. In the event the decision of the Board is affirmed and the
court finds that the appeal was frivolous, the court may order the person or
persons who requested the issuance of the writ of certiorari to pay the
costs incurred in making the reform of the record pursuant to the writ of
certiorari. If the petition is withdrawn subsequent to the Sling of the
return, the Board may request that the court hear the matter on the
question of whether the appeal was frivolous.

Sec. 36.2 -571. Zoning violations.
(b) Procedures upon discovery of violation. If the Zoning Administrator finds
that any provision of this chapter is being violated, the Zoning
Administrator shall provide a written notice to the owner or the person
responsible for such violation, indicating the nature of the violation and
ordering the action necessary to correct it.

Sec. 36.2 -644. Overall tree canopy requirements.
(a) Definition of tree canopy. For purposes of this section, "tree canopy" shall
include all areas of coverage by existing plant materials exceeding five (5)
feet in height, and the extent of planted tree canopy at maturity shall be
based on the "canopy at 20 years" as set forth in Table 642 -1. Where an
existing tree is not listed in Table 642 -1, "canopy at maturity" shall be
based on the published reference text, Manual of Woody Landscape
Plants, fifth edition, 1998, by Michael A. Dirt.
(b) Applicability
(1) This section shall apply to any development that requires
submission of a comprehensive development plan or it basic

(I) The non -Icgal staff of the governing body may have ex pmts
comnuntications with a member of the board prior to the bearing
but may not discuss the facts or law relative to a parlicular case.
Thu applicant, landowner or his agent or attorney may have ex
panic communications with it mcmbcr of the board prior to the
herring but may not discuss the facts or law relative to a particular
case. If any ex prate discussion of facts or law in fact occurs, the
party engaging in such communication shall inform the other petty
as soon as practicable and advise the other party of the substance
Of such communication. For purposes of this section, regardless of
whether all parties participate, ex parte communications shall not
include (i) discussions as part of a public meeting or (ii)
discussions prior to a public meeting to which staff of the
governing body, the applicant, landowner or his agent or attorney
are all invited.
(2) Any materials relating to a particular case, including a staff
recommendation or report furnished to a member of the bond,
shall be made available without cost to such applicant, appellant or
other aggrieved person, as soon as practicable thereafter, but in no
event more than three business days of providing such materials to
a member of the board. If the applicant, appellant or other
aggrieved person requests additional documents or materials be
provided by the locality other than those materials provided to the
board, such request shall be made pursuant to Section 2.2 -3704 of
the Code of Virginia (1950), as amended. Any such materials
furnished to a member of the bond shall also be made available for
Public inspection pursuant to subsection F of Section 2.2 -3707 of
the Code of Virginia, (1950), as amended.
(3) For the proposes of this section, "non -legal staff of the governing
body" means any staff who is not in the Office of the City
Attorney for the City of Roanoke, or for the board, or who is
appointed by special law or pursuant to Section 15.2 -1542 of the
Code of Virginia (1950), as amended. Nothing in this section shall
preclude the board from having ex parte communications with any
attorney m' staff of any attorney where such communication is
protected by the attorney - client privilege or other similar privilege
m' protection of confidentiality.
(4) This section shall not apply to cases where au application for a
special exception has been filed pursuant to Section 36.2 -560.
Sec. 36.2 -837. Powers and duties.
(a) Appeals to the Board. The Board shall have the power to hear and
decide appeals from any order, requirement, decision, or
determination made by the Zoning Administrator in the

administration or enforcement of this chapter, pursuant to the
procedures of Section 36.2 -562. The decision on such appeal shall
be based on the board's _judgment of whether the zoning,
administrator was correct. 'rile determination of the zoning

appeal, the zoning administrator shall explain the basis for his or
her determination after which life appellant has the burden of proof

from the terns of this chapter, pursuant to the procedures and
standards set forth in Section 36.2 -561. The burden of proof shall
be on the applicant to prove by a preponderance of the evidence
that his application meets the standards for a variance as defined in
Appendix A and the criteria set forth it, Section 36.2 -561.

(c) Modifications. The Zoning Administrator shall have the authority
to grant a modification from any provision of this chapter with
respect to physical requirements on a tot, including but not limited
to size, height, location, or features of or related to any building,
structure, or improvements, pursuant to the procedures and
standards set forth below.
(3) The Zoning Administrator shall authorize a modification
only if the Zoning Administrator finds in writing all three

(B) That such hardship is not shared generally by other
properties in the same zoning district and the same

(C) That the authorization of such modification will not
be of substantial detriment to adjacent property and
that the character of the zoning district will not be
changed by the granting of the modification.
Appendix A. Definitions

Campground: an establishment that provides campsites for temporary occupancy
by rccreational vehicles, tents, or other such enclosures designed as temporary
living quarters., and that provides ou -site restroom and bathing facilities.

Homestay: an establishment that offers for compensation a portion of any
dwelling unit for overnight stays to guests, and not meeting the definition of a bed
and breakfast.
Variance: a reasonable deviation from those provisions regulating the shape, size
or area of a lot or parcel of land, or the size, height, area, bulk or location of a
building or stnreture when the strict application of the zoning ordinance would

Appendix B. Submittal requirements
B -1. Basic Development Plan

(b) A basic development plan submitted for approval shall include a
completed application form, accompanied by payment of the
required fees, and three (3) copies of a survey plot plan or a basic
site plan drawing outlining the following information:

(10) Delineation of all landscaping required pursuant to the
regulations of Article 4 and Article 6 of this chapter,
including:
(A) Location, size, and description of all required
planting areas and planting materials; however,
such details on required tree canopy need not be
specified and may be substituted by a statement on
the plan indicating the amount (square feet) of
required overall tree canopy to be provided before a
certificate of occupancy is issued.
2. This ordinance will become effective immediately upon adoption.
Pursuant to the provisions of Section 12 of the City Charter, the second reading of
this ordinance by title is hereby dispensed with.
