The City Manager shared the following comments:
Second Annual Roanoke Youth Summit
• Held on Saturday, August 1, at Patrick Henry High School
• This event was free and open to all rising middle and high school
students
• Purpose of the summit was to engage youth in conversations about
topics like:
o Police /community relations
o Help Save The Next Girl Project
o Preparing for and paying for college
• Separate conversations were held for both youth and their parents or
guardians
• Participants also enjoyed a lunch, a DJ, karaoke, and an obstacle
course.

• This past weekend (Sunday) Morris Day & The Time and Cameo
performed in Elmwood Park

Vice -Mayor Trinkle called attention to the announcement of Single
Stream Recycling was scheduled to commence on October 5, and
reminded everyone that the blue cans would be distributed for six
weeks prior to the collection.

appointed by Council.
Appointed Rachel H. Wheaton as a member of the Roanoke Public
Library Board to fill the unexpired term of Shawna A. Battle ending
June 30, 2017.
Reappointed Judy Jackson, Woody Deans and Stephen Willis as
members of the Roanoke Civic Center Commission for three -year
terms of office, each, ending September 30, 2018.
Reappointed John Fulton as a member of the Architectural Review
Board for a four -year term of office ending October 1, 2019.

Final Draft
Strategic Focus Area #1: Master teaching in a diverse urban
environment
1. Attract and retain highly qualified teachers who want to teach in an urban environment.
• RCPS has 100% highly qualified teachers as reported on the 2014 -2015 IPAL
(Instructional Personnel Verification of Licensure) state report. Steady progress was
made towards this goal with a baseline of highly qualified teachers in 2009 -2010 of
99.07 %. Teacher retention has increased 1% from a baseline of 88% in 2009 -2010 to
89% in 2013 -2014. During this five year time - frame, a retention high of 90.6% occurred
in 2011 -2012 and a low of 86.7% in 2012 -2013. Strategies used to meet this goal
included:
• Significant adjustments were made to the Teacher Salary Schedule to align the
salary schedule with similar school divisions. Additionally, step raises have been
given for the last three years resulting in a minimum of 2% salary increase each
year.
• Targeted recruiting bonuses have been used for hard -to -staff areas of
mathematics, science and special education.
o Additionally, ongoing bonuses and support have been put in place for
mathematics teachers.
o Full -time release mentors have been trained and serve all new teachers in
grades K -8 with support at the high school through embedded School
Improvement Officers and trained department chairs. Part -time mentors have
been provided to special education teachers.
• The hiring process focuses on identifying highly qualified candidates early in the
hiring season through job fairs, including the RCPS job fair (at least 100
candidates were interviewed and offered contracts as appropriate).
• The geographical recruitment area for RCPS teachers has been increased.
• We have increased recruiting efforts at historically black colleges and
universities (HBCUs).
The percentage of teachers who have voluntarily left has varied from year -to -year.
Variables include the influx of teachers who are only in the area fora few years due to
spouses enrolled in the Virginia Tech Carilion School of Medicine and Research Institute,
as well as spouse transfers associated with major corporations such as Norfolk
Southern, Advanced Auto Parts, and Wells Fargo. The district has consciously made the
decision to hire the most qualified applicant even when it is likely that the teacher will
only be in the area forthree years. Below is the percentage of teachers who voluntarily
left the district eitherthrough resignation or retirement since 2010 (the first yearthat
this metric was measured).

• RCPS implemented the Teachers for Tomorrow program in 2013 -2014 as part of the
Roanoke Technical Education Center offerings. In year one ofthe two -year program, 36

juniors and seniors participated. The intent is "to grow our own' by providing early
experiences in education and hopefully have students return as teachers to the Division.
2. Design and implement a comprehensive, urban - specific professional development program.
• Ongoing work must be done to hone our professional development to maintain an
urban focus and to fine -tune our efforts.
• Additional work must be done to improve teaching in our urban environment.
3. Design and implement a mentoring program to support new teachers.
• This goal has been met as evidenced by:
In 2009 -2010, Roanoke City Public Schools began a partnership with the New Teacher
Center jNTCj, based in Santa Cruz, California, to deliver extensive training for an
inaugural class of 30 mentors serving all schools K -12.
• The participants had three intensive days of training followed by two additional
sessions during the year.
• Twenty mentors continued training in year two. During this time, the Division
was fortunate to receive federal stimulus dollars which allowed funding for one
mentor for every elementary and middle school. High schools were served
through training provided to department chairs.
• Beginning in 2011 -2012, with the loss of stimulus dollars, the Division hired two
full -time mentors at the elementary level, two at the middle school level and
four part-time special education mentors. New mentors received the NTC
training through a program at Virginia Commonwealth University.
• This staffing model has continued to date and provides mentors for new
teachers. In addition, high school department chairs and the School
Improvement Officers have been trained as New Teacher Mentors. RCPS has
invested in new mentor training and now has three certified NTC mentors on
staff.
4. Design and implement coaching programs to support the growth of experienced teachers as
they continue to address changing needs and the challenges of educating urban children.
• School Improvement Officers who serve as instructional coaches have been placed at
both high schools.
• After receiving instructional coach training from the NTC, elementary reading specialists
provided classroom teachers with monthly professional development. This professional
development included: data analysis of SOL reading strands, Fountas and Pinnell reading
level assessments, small group reading instruction, and the implementation of a new
reading series.
• Leadership by mathematics coaches at the elementary and middle levels has continued,
and mathematics coaches have been added to each high school to promote excellence
in mathematics education.
• For the 2015 -2016 school year, instructional coaches will be placed in all Title I schools.
5. Implement and manage a new evaluation system improving the quality of instruction.
• The RCPS standards -based teacher evaluation document /tool was completed and fully
implemented in the 2011 -2012 school year.
• The RCPS teacher evaluation document has become a model for the Commonwealth of
Virginia and beyond.
• Ongoing professional development for administrators on the effective use of evidence -
based evaluations has improved the quality of instruction.

Strategic Focus Area #2: Create an optimal urban learning environment
1. Provide a rigorous, culturally responsive PK -12 curriculum.
• Curricula for each area are reviewed annually and revised as needed in response to
changes in Standards of Learning and to address strengths and weaknesses as indicated
by data.
• A new rigorous pre- kindergarten curriculum, Tools of the Mind, was adopted to address
key instructional building blocks for kindergarten readiness.
• A new reading /writing series was adopted in 2013 -2014 to address issues with rigor and
alignment.
• Leveled Literacy Intervention kits and the Fountas and Pinnell Benchmark Assessment
System were purchased to identify reading levels and address needs of struggling
learners.
• Professional development was provided to teachers at all grade levels to address needs
in reading and writing.
• Resources are aligned to instructional calendars which match state curriculum
frameworks in each core content area.
• Instructional time was increased in English and mathematics in elementary schools and
middle schools.
• The high school graduation rate has increased to 83.41% (2013- 2014).
• Laptop computers were provided for all students in grade 8 in 2014 -2015.
2. Attract and retain highly qualified administrative leaders who are committed to Roanoke City, its
schools, and, most of all, its students.
• Adjustments were made to the Principal and Assistant Principal salary schedules in
January 2013 to increase the competiveness of the administrators' salaries in
comparison to similar divisions. The Division has been successful in both attracting
administrators from other divisions as well as promoting from within the ranks.
3. Develop a leadership "bench" from within Roanoke City Public Schools.
• Since the program began in 2009, 123 teachers have participated in the Aspiring Leaders
program which is presented annually by the Superintendent and the Executive Director
for Human Resources.
o To date, 31 of the participants have gone on to become Assistant Principals or
Principals.
• RCPS partnered with Hampton University who received a federal grant to develop
school district leaders. Part of the program offered a Master's Degree in School
Administration from Hampton University at no charge to participants. RCPS
administrators served as Hampton University adjunct professors and delivered the
Master in Education program to the Southwest Virginia cohort with teachers from
Roanoke City and Martinsville. As a result, three RCPS teachers were identified to
participate in the program. Currently, two from the Roanoke cohort are now Assistant
Principals in the Division.
• The Division has established additional positions which provide leadership training and
leadership pathways.
o Teacher -on- Assignment is a position on a 10.5 month teacher contract which
requires an administrative endorsement. The person serving in this position is a
part of the school's administrative team and works with student discipline,
building organization, and instruction under the direction of the principal.

o An Instructional Coach is also on a 10.5 month teacher contract and part of the
school's administrative team. The focus of the Instructional Coach is
instructional support and data analysis under the direction of the principal.
o The New Teacher Mentor position(s) provides an additional opportunity for
teachers who are most interested in working with those new to the profession.
4. Provide students with intentional and equitable opportunities to participate in enhanced arts,
athletics, and other activities.
• VH -1 Save the Music Foundation funding has provided musical instruments for all
elementary students.
o See Appendix B for information on the increase of fine arts courses available in
RCPS.
• During 2008-2009, RCPS sponsored ten athletic teams at the middle school level with
total of 1158 students on team rosters. During 2013 -2014, RCPS sponsored a total of 19
middle school athletic teams, an increase of 47% from five years earlier, with 1320
students on team rosters, a participation Increase of 12 %overthe five year period.
• During 2008 -2009, Patrick Henry and William Fleming High Schools sponsored a total of
46 athleticteams with 1218 students on team rosters. During 2013 -2014, the two high
schools sponsored 70 athletic teams, an increase of 34 %, from five years earlier, with
1278 students on team rosters, a participation increase of 5 %overthe five year period.
5. Achieve equity in staffing, facilities, and materials throughout the division.
• All teachers are highly qualified.
• The majority of mobile learning units (trailers) have been removed.
• Building maintenance was reorganized to better support school needs.
• Grounds maintenance has been outsourced, resulting in more attractive landscaping.
• Painting classrooms and schools has become an annual maintenance priority.
• All building managers meet with the principal weekly to walk through buildings and
identify issues that need to be addressed.
6. Promote respectful learning environments where students feel safe and individual differences
are appreciated.
• The number of incidents reported across all nine Safe Schools Information Resource
Categories (SSIR) decreased by 12% between 2009 and 2014 as enrollment increased.

9. Secure adequate funding and allocate financial resources equitably throughout the division.
• RCPS established a formula by which building allocations are determined each school
year based on school enrollment data, including the number of students qualified to
receive free or reduced price school lunch. By basing building allocations on a formula
directly tied to enrollment, RCPS ensures that the allocation of funding to each school is
determined in a uniform and equitable manner.
10. Ensure that facilities support an effective learning environment.
• A comprehensive Capital Improvement Plan is updated annually to reflect the needs of
the division.
• Building maintenance supervision was restructured in the 2010 -2011 school year.
Leadership is provided by Building Managers who take ownership of each school facility
and are responsible for building maintenance and operations.

• The RCPS teacher evaluation system is fully operational.

• A performance -based compensation program was piloted at schools that were in school
improvement. The results indicated that a performance -based compensation program
was not an effective means of increasing teacher morale and would require a great deal
more funding than was available.
6. Incorporate strategic communications best practices.
• The RCPS website is up -to -date and user - friendly.
• When this plan was written, there was no Facebook page; today, the Facebook page
receives more than 7,000 hits daily.
• The RCPS Twitter account reports information regularly.
• Communication in crisis situations has been applauded in many forums.
• We continue to be challenged by snow situations.

• The Division makes every effort to be transparent in all of its operations.
• "Respect" is difficult to gauge. However, a top priority is to maintain open
communication channels with our constituencies.
• Frequent robocalls are made to parents /guardians to update them on a variety
of issues, including upcoming events, school closings, and crisis situations.
• The RCPS website is updated every day.
• RCPS has a strong social media presence on both Facebook and Twitter.
2. Create a database and develop individualized profiles of the Valley's businesses, and
community, civic, and faith -based organizations.
• This has been completed.
3. Gain an understanding of and be responsive to business and community organization needs.
• There have been multiple meetings throughout the years with the Chamber of
Commerce and community and business organizations to determine their needs.
Examples:
o The Career and Technical Advisory Board has a pulse on the needs of
community and business organizations working hand -in -hand with over 20
organizations throughout the Roanoke Valley.
o Virginia Western Community College, through its Foundation, has assessed
community needs and communicated with RCPS to ensure that opportunities
for student post- secondary education needs are met.
o As part of an effort to improve healthy living, RCPS has engaged in a number of
garden projects: Fishburn Park environmental focus school, James Madison
Middle - Food for Thought Garden, a community collaborative with Virginia
Western Community College, and several Positive Action Toward Health (PATH)
gardens— Hurt Park, Fallon Park, and Garden City.
o Congregations in Action (CIA), a coalition of over 50 churches and synagogues,
supports many of our schools through provision of food backpacks for
weekends, tutoring, mentoring, and school supplies.
o Collaboration with the Virginia Tech Carilion School of Medicine and Research
Institute, led by Drs. Craig and Sharon Ramey, has elevated the level of data
tracking and analysis, with an emphasis on early childhood education.
4. Pursue collaborations that simultaneously address critical RCPS needs and provide a direct or
indirect benefit to participating businesses and community, civic, and faith -based organizations.
• Examples:
o More than 400 RCPS students have enrolled at Virginia Western Community
College through the Community College Access Program.
o For the past four years, the Director of Career and Technical Education has been
working with Work Force Development and Virginia Western Community
College to collaboratively identify critical work force needs in the Roanoke
Valley and to develop programs for RCPS students in those areas.
o There has been a deliberate effort to increase industry certifications that will
allow students to be career or college ready. In 2008 -2009, only 109 students

earned industry certifications. In 2014, 971 students earned industry
certifications.
o RCPS continues to partner with Commonwealth Catholic Charities to address
the needs of the Division's English Language Learners and their families.
o The partnership program between the Roanoke Symphony Orchestra (RSO) and
RCPS is extensive and designed to reach our diverse student population. The
work of the conductor of the RSO with RCPS students is unheard of in other
localities. The flexibility of the program allows directors, teachers, and
administrators to fashion each visit based on program strengths and
weaknesses. Access to professional musicians and high quality programming
are essential in a student's music education and overall development.
o Numerous civic and business organizations partner with RCPS to enhance the
quality of life for many RCPS students, including:
• Elks Lodge #197 donated $1,000 in the summer of 2014 to buy school
supplies for students. In the summer of 2015, the Elks received a
national grant for $2,000 to buy school supplies for our students.
• Walmart has donated thousands of dollars over the years to help RCPS
buy school supplies for students. In the summer of 2014, RCPS and
Walmart re- launched the program with a new name and a new focus.
Walmart donated $2,400 to RCPS to buy school supplies. Additionally,
the Load the Bus for Kids campaign brought in a record amount of
donations from shoppers.
• The Foundation for Roanoke Valley donated $2000 in the winter of 2015
to allow RCPS to buy new winter coats for children.
• The Oliver Hill Foundation, in partnership with Big Brothers Big Sisters of
Southwest Virginia, connects mentors to RCPS students.
• Interactive Achievement Foundation for Kids provides opportunities for
students to attend the Kids Code Camp and the STEM Camp at the
Roanoke Valley Governor's School.
• United Way of Roanoke Valley directed over $850,000 of its annual
community investments investments in quality early education and
youth development programs and health services to intentionally
support RCPS students in achieving their academic goals.
Establish the desired return on investment for each collaborative effort.
• The RCPS Career and Technical Education Foundation has raised nearly $50,000 in the
period from 2009 -2014 to provide assistance with costs of uniforms, dual enrollment,
industry certifications and other miscellaneous needs for RCPS students.
• Over $15,000 in scholarship money has been provided by the Career and Technical
Education Foundation for our students to pursue higher education in a career field of
their choice.
Establish a link between RCPS Strategic Plan and other organizations' strategic plans.
• Many community organizations mention the RCPS Strategic Plan in their strategic plans.

In response to discussions and questions raised during the August 3 Joint Meeting, the following
information is provided:
The Mayor asked for information surrounding the PALS (Phonological Awareness Literacy
Screening) and SOL (Standards of Learning) reading /writing measures; attached is information
presented graphically which depicts how RCPS students are progressing.
The two assessments are different, and the Standards of Learning reading test is administered
for the first time to students in the third grade. PALS consists of three instruments — PALS -PreK
for preschool students, PALS -K for kindergartners, and PALS 1 -3 for students in grades one
through three. Assessments are designed to identify students in need of additional reading
instruction beyond that provided to typically developing readers. PALS also informs teacher's
instruction by providing them with explicit information about their students' knowledge of
literacy fundamentals. Mid -year assessment and PALS Quick Checks allow for ongoing student
progress monitoring throughout the year.
Mr. Rosen asked for the overall graduation rate for RCPS; the rate is close to 88 %.
Mr. Ferris requested information surrounding the District's plans to outsource Food Services.
School Board Attorney Tim Spencer will provide additional information. At this time the District
plans to use local vendors if food quality meets the nutritional standards. Current employees
will be a major consideration in any food services outsourcing. This has always been the case in
the District's other outsourcing efforts.
Council also requested information regarding the fund balance. A written summary of the
Board's discussions regarding fund balance during its August 11 retreat is forthcoming.

will work with the group to develop a relocation brochure and foster a working partnership to
promote RCPS and the City of Roanoke.

Subject: Request a Public Hearing for the Vacation of an Existing Access
Easement and Dedication of a New Access Easement to Benefit
Tax Map No. 4030306R
Background:
By Deed dated November 6, 2002, the City acquired a variable width access
easement across certain property designated as Official Tax Map No. 4030306
( "Property') from the then owner of the property, Electric Railway Company.
The access easement was acquired by the City in connection with the Roanoke
River Flood Reduction Project. This access easement is primarily for access to
the flood control berm along this portion of the Roanoke River for the City of
Roanoke and Corps of Engineers.
The current owner of the property, Roanoke River Investments LLC ( "RRI "), has
requested vacation of the easement and proposes to dedicate a new variable
width permanent access easement to benefit real estate owned by the City and
designated as Official Tax Map Number 4030306R, across property owned by
RRI designated as Official Tax Map No. 4030306.
The access easement is being requested to be relocated to facilitate
development in this area on Official Tax Map Number 4030306 as part of the
overall Bridges Development Project.
Recommended Action:
Authorize the scheduling and advertising of a public hearing for the vacation of
the existing access easement and dedication of a new permanent access
easement, to the Roanoke River Investments LLC on August 17, 2015 at 7:00
pm, or such later date and time as the City Manager may determine.

Subject: Request a Public Hearing to Receive Public Comment on the
City's Draft Consolidated Annual Performance and Evaluation
Report (CAPER) for its Federal Housing and Urban Development
(HUD) Funded Programs
Background:
Each year the City is required to develop a Consolidated Annual Performance
and Evaluation Report (CAPER) for submission to HUD which includes a review
of the specific community development and housing activities that were
undertaken during the recently concluded program /fiscal year, and identifies
the amount of funding that benefited low -to- moderate income persons. Once
the CAPER is drafted, HUD requires that the draft be made available to the
public for a 30 day review and comment period prior to its finalization and
submittal to HUD.
The City makes the draft CAPER available to the public through a variety of
means, including the City's website, by mail to citizens upon request, at the
City Municipal Building, at the City's Main Branch library, and at the Roanoke
Redevelopment and Housing Authority's Executive Offices. Public comment
may be made directly to City staff in various forms (written, in person, email, or
telephonic) any time during the 30 day comment period. In addition, during
the 30 day comment period as part of the City's HUD Citizen Participation Plan,
a public hearing is required to be held to receive comment on the draft CAPER.
Comments received during the public comment period will be considered
during the finalization of the CAPER and will be incorporated as part of the
Report.
This year the 30 day public comment period on the draft CAPER will begin on
August 10, 2015 and run until September 10, 2015. It is proposed that City
Council hold its public hearing to receive public comment on the CAPER at its

At a prior City Council briefing on the Franklin Road Bridge replacement project, it was
requested that staff evaluate the feasibility of a 'raised cycle track" for bicycle
accommodations on the new bridge. Specific attention was directed to the recent
improvements to the bridge on Memorial Avenue over the Roanoke River, as well as details
noted at bridges in other cities where vehicular, bicycle, and pedestrian traffic facilitates
are at three separate levels.
Our engineering consultant, AECOM, re- examined the provision of bicycle
accommodations on the bridge structure. The existing bridge structure does not provide
bicycle accommodations other than within the vehicular travel lanes. The design plan for
the replacement structure includes standard width sidewalks on the bridge structure and
curbside bike lanes in both directions. The extension of the raised sidewalk on the south
edge of the Memorial Avenue Bridge structure connects the Roanoke River Greenway at
each end of the bridge and provides an uninterrupted path for greenway trail users
crossing the bridge. While Franklin Road provides important access from the Old
Southwest neighborhood to the recreational facilities along the Roanoke River, it is not a
part of the local greenway network and is not designated for further development as such.
Also, the proposed grade of the Franklin Road Bridge (8 %) is considerably greater than the
Memorial Avenue Bridge (.5 %).
As a result of the evaluation and the factors referenced above, the Franklin Road Bridge
would not be considered the most viable location for the raised cycle track concept. It is
recommended that the Franklin Road Bridge replacement project proceed based on the
proposed design which includes one northbound travel lane and two southbound travel
lanes, with bike lanes along the outside lanes and a sidewalk along each edge of the
structure.

Subject: 2016 Virginia Sexual and Domestic Violence Victim Fund Grant
Background
The Department of Criminal justice Services of the Commonwealth of Virginia
has awarded the Roanoke Police Department $31,588 in grant funding as part
of the Virginia Sexual and Domestic Violence Victim Fund. There is no local
match requirement. The Roanoke Police Department will use the award to
partially fund its existing Sexual Violence Specialist position.
The Sexual Violence Specialist was previously funded into a full -time employee
position through a combination of general funds and grant funds in the
absence of alternative grant funding sources.
The 2016 Virginia Domestic Violence Victim Fund grant is not sufficient to fully
cover the salary and benefits of a full time position. To maintain the position as
a full time employee at current salary and benefit levels, the City of Roanoke
will be required to provide an additional $19,882 in funding to the 2016
Virginia Domestic Violence Victim Fund grant.
The Sexual Violence Specialist is an essential employee who provides services to
the victims of sexual assault. The Sexual Violence Specialist investigates sexual
violence offenses, ensures that victims receive support services throughout
their case, and prepares cases for prosecution. Beyond the services that the
employee provides in a grant funded capacity, the individual also serves as the
Hispanic Outreach Coordinator for the Roanoke Police Department. The
Hispanic Outreach Coordinator coordinates community events, assists in
criminal investigations, and works to improve community relations.
Recommended Action:
Accept the 2016 Virginia Domestic Violence Victim Fund grant described above
and authorize the City Manager to execute the grant agreement and any related
documents; all such documents to be approved as to form by the City Attorney.
Adopt the accompanying budget ordinance to establish a revenue estimate in
the Grant fund for State grant funds of $31,588, transfer funding in the amount
of $19,882 from the Grant Match account (35-300-9700-5415) to provide local
funding, and appropriate total funding of $51,470 for salary and benefits into
accounts to be established by the Director of Finance in the Grant Fund.

Background:
On October 20, 2014, City Council authorized the City Manager to submit an
application to the Virginia Department of Transportation (VDOT) for funds from
VDOT's FY 2016 Transportation Revenue Sharing Program in the total amount
of $10,000,000, which required a City match of $10,000,000. Funds were
requested for the following projects:
1. Franklin Road Bridge Replacement.
2. Annual Citywide Street Paving Program (Resurfacing).
3. Citywide Bridge Maintenance.
4. Citywide Sidewalk Maintenance.
5. Citywide Curb, Gutter, and Sidewalk (New Construction).
6. Citywide Storm Drain Improvements.
7. Orange Avenue /King Street Intersection Improvements.
Considerations:
City staff has been notified that VDOT has awarded the City a total of
$10,000,000 from VDOT's FY 2016 Transportation Revenue Sharing Program.
Per the City's Programmatic Project Administration Agreement with VDOT for
Revenue Sharing Projects, dated September 9, 2013 (which is valid for a three -
year period), a copy of which is attached, the City is required to match the
amount of $10,000,000.
Funds are to be allocated for the seven (7) projects as set forth below.
Franklin Road Bridge Replacement - $3,000,000. City match funding will
be provided by using $3,000,000 from the City's planned FY 2016 capital
project funds for the replacement of City bridges through the planned
issuance of bonds.
Annual Citywide Street Paving Program (Resurfacing) - $3,000,000. City
match funding will be provided by using $3,000,000 from the City's
planned FY 2016 Paving Program.
3. Citywide Bridge Maintenance - $500,000. City match funding will be
provided by using $500,000 from the City's planned FY 2016 Bridge
Maintenance Program.
4. Citywide Sidewalk Maintenance - $130,000. City match funding will be
provided by using $130,000 from the City's planned FY 2016 Sidewalk
Maintenance Program.

AN ORDINANCE providing for the acquisition of real property tights needed by the
City in connection with the Oliver Road /Troy Avenue Stonmwater Drainage Improvements
Project ( "Project "); authorizing City staff to acquire such property rights by negotiation for the
City; authorizing the City Manager to execute appropriate acquisition documents: and
dispensing with the second reading of this Ordinance by title.
BE IT ORDAINED by the Council of the City of Roanoke as follows:
The City wants and needs certain real property rights, to include permanent
easements of variable length and width, and such other real property interests as needed, as set
forth in the City Council Agenda Report dated August 3, 2015, for the Oliver Road /Troy Avenue
Stonmwater Drainage Improvements Project, in the general vicinity of the 3900 and 4000 Blocks
of Oliver Road, N.E., Roanoke, Virginia, and 100, 200, and 300 Blocks of Troy Avenue, N.E.,
Roanoke, Virginia, within the Preston Park neighborhood, and surrounding streets. The proper
City officials and City staff are hereby authorized to acquire by negotiation for the City the
necessary real property interests and appropriate ancillary rights with respect to the real property
parcel referred to in the above mentioned City Council Agenda Report and any other real
property parcels needed flu the Project for such consideration as the City Manager may deem
appropriate. All requisite documents shall be approved as to form by the City Attorney.
2. The City Manager is further authorized to execute appropriate acquisition
documents far the above mentioned parcel(s) for such consideration as deemed appropriate for
the necessary interests, provided, however, the total consideration offered or expended, including

Subject: Acquisition of Real Property Rights for Oliver Road /Troy
Avenue Stormwater Drainage Improvements Project
Background:
As part of the FY2016 Capital Improvement Program, City Council appropriated
$1.92 million for Stormwater improvement projects. These appropriated funds
will be matched with $1.62 million in Virginia Department of Transportation
Revenue Sharing funds plus an additional $500,000 in Stormwater Utility
operating funds.
One of the projects to be funded by this combined FY2016 funding
appropriation is the Oliver Road/Troy Avenue Stormwater Drainage
Improvements project which includes the installation of storm drain pipes and
structures, and stormwater best management practices. This project is in the
general vicinity of the 3900 and 4000 blocks of Oliver Road; and 100, 200, and
300 blocks of Troy Avenue within the Preston Park neighborhood.
This neighborhood suffers from lack of storm drain systems evidenced by
standing water on road pavement and private properties at the intersection of
Oliver Road and Troy Avenue. Stormwater runoff from public right of way
contributes to flooding of private properties. Constructing the proposed storm
drain system for this project would correct known drainage problems in this
neighborhood and improve water quality in the Tinker Creek watershed.
In order to construct, operate, and maintain the proposed improvements, the
City will need to acquire real property rights from a private owner.
Considerations:
City Council action is necessary to authorize the acquisition of real property
rights needed for the Oliver Road /Troy Avenue Stormwater Drainage
Improvements Project. The real property rights needed are outlined below, but
are subject to minor variation of location and extent pending final engineering
design details.
Funding for acquisition of the real property rights will be available in project
account 03 -530 -3014, Stormwater Improvements.
Permanent drainage easements of variable length and width are required to
accommodate construction activities and will affect one (1) property in the
general vicinity identified above. The City may also need to acquire various
other property rights involving the property listed below and other properties
which have not yet been identified for this project. The property that has been

Subject: Agreement Requiring City to Indemnify and Hold Harmless
Carilion Property Management
Background:
The City of Roanoke is hosting the Roanoke GO Outside Festival which begins at
5:00 p.m., on Friday, October 16, 2015, and concludes at 5:00 p.m., on Sunday,
October 18, 2015, at River's Edge Sports Complex. This annual event draws
nearly 10,000 people and encourages healthy, active outdoor recreation. By
combining the things outdoor enthusiasts love - camping, music, gear, races
and demonstrations, the Roanoke GO Outside Festival is a celebration of
everything outdoors. While various events and races will take place throughout
the region, Rivers Edge Sports Complex North (Reserve Avenue) will serve as the
festival headquarters. There will be activities to keep citizens of all ages and
interests engaged and entertained.
In order to provide adequate parking for this event at Rivers Edge Sports
Complex, Carilion Property Management, owner of 6 Riverside Parking Garage,
is requiring the City of Roanoke to sign an Agreement for this purpose. The
Agreement contains a provision requiring the City of Roanoke to indemnify and
hold Carilion Property Management harmless, and to defend it in the event
Carilion Property Management incurs any damages, or if anything is damaged
during the City of Roanoke's use of the premises. An indemnification and hold
harmless provision constitutes a waiver of sovereign immunity, and any
contract containing such a provision must be authorized by City Council. The
City has requested that Carilion Property Management delete this provision;
however, Carilion Property Management has declined to do so.
Attached is a resolution which authorizes the City Manager to execute an
Agreement which allows the City to use a parking facility owned by Carilion
Property Management and which requires indemnification and holding harmless
Carilion Property Management in the event of alleged damages arising out of
the City's use of the parking facility, such Agreement to be approved as to form
by the City Attorney.
Considerations:
This Agreement would require the City of Roanoke to waive its sovereign
immunity for the purpose of and during the time of parking for the event at
Rivers Edge Sports Complex.
Recommended Action:
Approve the attached resolution and authorize the City Manager to execute the
Agreement, in a form approved by the City Attorney, and take such other
actions as may be required under that Agreement.

Carilion Property Management agrees to allow the City of Roanoke use of the 6
Riverside Parking Garage for parking of patrons attending The Roanoke GO

This agreement may be rescinded or amended at any time by Carilion Property
Management.
The City of Roanoke agrees to indemnify and hold harmless Carilion Health
System and all its affiliated companies, including Carilion Property Management,
from any and all liabilities arising out of the use of the said parking garage. They
also agree to leave the parking garage in the same manner, as before occupancy
and if need arises to have parking garage cleaned due to their use, they will be
responsible for this cost. Security services will also be provided at these
locations during the event.
