The Mayor called for a moment of silence in memory of Alphonzo L.
Holland, Sr., 2003 Citizen of the Year and longtime City resident who passed
on Saturday, December 12. Instructed the City Attorney to prepare the
appropriate measure for adoption at a future Council Meeting.

Thursday, December 24 at 7:00 p.m., and Saturday, December 26 at 4:00 p.m.; and

2. PRESENTATIONS AND ACKNOWLEDGEMENTS:
A resolution naming David Stewart Wiley as the 2015 Citizen of the Year.
Adopted Resolution No. 40408- 122115. The Mayor presented a ceremonial
copy of the resolution to Mr. Wiley and his family in attendance.
Recognition of the Office of Communications on receipt of two Summit Awards
received from the PRSA Blue Ridge Chapter.
The Mayor presented the two Summit Awards to Melinda Mayo,
Communication and Media Officer and Timothy Martin, Communication and
Media Coordinator.
3. HEARING OF CITIZENS UPON PUBLIC MATTERS:
CITY COUNCIL SETS THIS TIME AS A PRIORITY FOR CITIZENS TO BE
HEARD. ALL MATTERS WILL BE REFERRED TO THE CITY MANAGER FOR
RESPONSE, RECOMMENDATION OR REPORT TO COUNCIL, AS HE MAY
DEEM APPROPRIATE.

4. CONSENT AGENDA:

ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED

called attention to one request for Closed Meeting from the City Manager.
C -1 Minutes of the regular meeting of Council held on Monday, July 20, 2015.
RECOMMENDED ACTION: Dispensed with the reading of the minutes and
approved as recorded.
C -2 A communication from the City Manager requesting that the Council convene
in a Closed Meeting to discuss the disposition of City -owned property located at
2750 Hoover Street, N. W., where discussion in an open meeting would adversely
affect the bargaining or negotiating strategy of the public body, pursuantto Section
2.2 -3711 (A)(3), Code of Virginia (1950), as amended.
RECOMMENDED ACTION: Concurred in the request.
C -3 Reports of qualification of the following individuals:
The Honorable Jacqueline Talevi as a City representative of the
Court Community Corrections Regional Program Community Criminal
Justice Board for a three -year term of office ending June 30, 2017;
Wilton C. Kennedy as a member of the Human Services Advisory
board for a four -year term of office ending November 30, 2019;
Susan Egbert as a member of the Roanoke Arts Commission for a
three -year term of office ending June 30, 2017;
Paula Page Williams as a Director of the Economic Development
Authority for a term of office commencing November 16, 2015 and
ending October 20, 2017; and
The Reverend Timothy Harvey as a member (Public) of the youth
Services Citizen Board to fill the unexpired term of office of Lorena
Wilson ending June 30, 2018.

Acceptance of a donation of 18 tracts of land affronting Peters Creek
Road, N. W., to the City of Roanoke from DAC, LLC, to improve
water quality and flood control for downstream properties.
Adopted Ordinance No. 40409- 122115 (7 -0).
COMMENTS OF CITY MANAGER.
The City Manager shared the following comments:
Holiday Schedule in Effect for Solid Waste, Recycling Collection
• City offices will be closed on Thursday and Friday, December 24 and 25, for
the Christmas holidays.
• As a result, all residents and business owners are asked to set out their
trash, bulk, and large piles of brush one day in advance.
• Likewise, residents and businesses with B week recycling service are asked
to set out their recycling carts one day in advance.

Roanoke 100 -Miler Program
• Registration is currently underway for the annual Roanoke 100 - Miler.
• This program, created by the Parks and Recreation Department, is a
community active - living campaign that challenges people to walk, run, hike,
pedal, paddle, or exercise their way to 100 miles (or more) in 100 days.
• Miles must be human - powered
• Dogs can participate in the program with their owners.
• Each year, more than 1,000 people participate in this program.
• The official start to the 2016 Roanoke 100 -Miler is January 7. The challenge
will end on April 15.

Guns N Hoses Hockey
• Coming to the Berglund Center Coliseum on Saturday, January 16, at 6:00
P. M.
• Guns and Hoses is an annual charity ice hockey tournament to benefit the
Muscular Dystrophy Association.
• Each year, Roanoke -area firefighters (the "Hoses ") take on a team of
Roanoke -area police officers and law enforcement personnel (the "Guns ").
• During the last 10 years, Roanoke's Guns and Hoses has raised more than
$133,000 for the MDA, and more than 33,000 people have attended the
games.
• Ticket and parking information is available online at
www.theberglundcenter.com
Implementing LEAN: Operational Excellence for Local Government
• The City of Roanoke is partnering with Virginia Tech to deliverthis dynamic
process improvement conference.
• This event will be held March 3 - 4, 2016, at Hotel Roanoke.
• Focus will be on government partnership with Virginia Tech.
• Speakers will share the LEAN process with other local governments from
around the country.
• We hope this will become an annual event.
• Virginia Tech is considering creation of an academy for LEAN, and to
become a center for LEAN training.

funds for various educational programs; and a report of the Director of
Finance recommending that Council concur in the request. Donna

principles of Welcoming America for adoption at the 7:00 p.m. session

A RESOLUTION naming and honoring David Stewart Wiley, Music
Director and Conductor of the Roanoke Symphony Orchestra, as the City of
Roanoke's 2015 Citizen of the Year.
WHEREAS, Mr. Wiley holds a Doctor and Master of Music in
Conducting from Indiana University, Bloomington, Indiana; a degree in Piano
Performance with honors from the New England Conservatory of Music,
Boston, Massachusetts; and a degree in Religion, Summa Cum Laude, from
Tufts University, Medford, Massachusetts;
WHEREAS, Mr. Wiley began his position as Music Director and
Conductor of the Roanoke Symphony Orchestra in 1996 and is celebrating his
20o season with the Roanoke Symphony Orchestra;
WHEREAS, Mr. Wiley also serves as Music Director and Conductor of
New York's Long Island Philharmonic, and has conducted such distinguished
symphonies as Atlanta, Boston, Buffalo, Cincinnati, San Francisco, Milwaukee,
Indianapolis, Minnesota, Saint Louis, Oregon, Honolulu, and Utah, along with
symphony orchestras in most of the Stales;
WHEREAS, Mr. Wiley's summer engagements include the Aspen Music
Festival, Brevard Music Center, Garth Newel, Wintergreen, Park City,
Minnesota Orchestra Summerfest, Sitka (Alaska) and Prince Albert (Hawaii)
summer music festivals;
WHEREAS, before coming to Roanoke, Mr. Wiley served as Assistant
Conductor of the Minnesota Orchestra and the Indianapolis Symphony
Orchestra;
WHEREAS, from 1999 until 2006, Mr. Wiley was the Artistic Director
and Conductor of the Wintergreen Summer Music Festival, where he founded
the festival orchestra, created the academy, and led the festival to remarkable
artistic growth in seven years;
WHEREAS, as a solo pianist, Mr. Wiley has performed with numerous
major orchestras throughout the United States including Minnesota,
Indianapolis, Oregon, Honolulu, Wheeling, and West Virginia, and has
performed major concerti written by composers from the Baroque to
Contemporary periods of music, often conducting from the piano;
WHEREAS, Mr. Wiley has appeared as both a jazz and classical pianist
in Boston's Symphony Hall, and in recital and chamber music appearances
throughout the United States as well as in China, Russia, Romania, Germany,
Hungary, Italy, the Czech Republic, and Bulgaria;
WHEREAS, Mr. Wiley has received numerous awards in recognition of
his accomplishments in music, including the Aspin Conducting Prize, the
Distinguished Educator Award from Yale University, and a Conducting
Fellowship at Tanglewood;
WHEREAS, Mr. Wiley has devoted his time and efforts to support and
enhance the Roanoke community through his commitment to music education
throughout Roanoke by working with schools, arts organizations and other civic
institutions to bring the joy and beauty of classical music to residents
throughout the Roanoke Valley;
WHEREAS, Mr. Wiley was honored by the Roanoke Branch NAACP as
Citizen of the Year in the Arts, for his work to bring classical music to youth in
our minority communities;
WHEREAS, Mr. Wiley and his family demonstrate their leadership and
commitment as citizens of the Roanoke community through their service to
numerous community organizations and programs throughout the region,
including the JDRF Foundation, the Rescue Mission, Roanoke Valley Reads,
Kirk Family YMCA, Temple Emmanuel, and Christ Lutheran Church; and
WHEREAS, through his art and his service to his community, Mr. Wiley
has demonstrated his commitment to make the City of Roanoke a better place in
which to live, work, grow, and enjoy.

amended, the City Manager may accept a gift in excess of $5,000 only after adoption of an
ordinance or resolution by City Council.
THEREFORE, BE IT ORDAINED by the Council of the City of Roanoke that:
1. The City Manager is authorized to accept the donation of those parcels set out and
identified in the City Council Agenda Report dated December 21, 2015, upon certain terms and
conditions including receipt of satisfactory title reports that confirm that DAC, L.L.C, is the
owner of such parcels froc and clear of all Bens and encumbrances other that those casements
and restrictions of record acceptable to the City Manager and the City Attorney, from DAC,
L.L.C., for the benefit of the City's Storm Water Management System.
2. The City Manager is authorized to execute, in a form approved by the City
Attorney, the necessary documents to accept the conveyance of the fee simple interest of those
parcels set out and identified in the above mentioned Agenda Report, upon certain terns and
conditions including the condition regarding the receipt of satisfactory title reports, from DAC,
L.L.C., for the benefit of the City's Storm Water Management System.
3. Pursuant to Section 2 -265, Code of the City of Roanoke (1979), as amended,
DAC, L.L.C. is responsible for establishing the value of this donation.
4. This Council expresses its appreciation to DAC, L.L.C. for its generous donation
of these properties.
5. The City Clerk is directed to send an attested copy of this ordinance to DAC,

Background:
The owners of several parcels of property located in the North Peters Creek area,
DAC, L.L.C., have offered to donate to the City 18 parcels containing
approximately 12.62 acres of land. The assessed value of the land is $462,000.
The property, identified as Official Tax Nos. 6120417X, 6120443X, 6120418
through and including 6120429, and 6120439 through and including 6120442,
fronts and adjoins Peters Creek Road, NW, near and including where the east and
west forks of Peters Creek merge (see Exhibit A). The acquisition of these parcels
will benefit the City's Storm Water Management system and could be modified to
improve water quality and flood control for downstream properties. In accordance
with City's Revised Environmental Policy Relating to the Acquisition of Real
Property adopted by City Council on October 23, 2008, by Resolution No. 38256-
102308, a satisfactory environmental assessment has been completed.
Acceptance of these parcels will create no significant operational or maintenance
costs to the City. Acceptance of title to these parcels is subject to receipt of
satisfactory title reports for these parcels.

Considerations:
These parcels are in the Peters Creek watershed that will ultimately be used to
achieve three Stormwater Utility goals:
I. Minimize watershed hazard to public health, safety, and property by
constructing a Capital Improvement Program (CIP) project that would
both mitigate downstream flood hazards and improve downstream
water quality.
II. Connect citizens, businesses, students, and other stakeholders to the
Peters Creek watershed by engaging the community in the CIP project
design.
III. Maximize watershed resiliency and sustainability by designing the CIP
project to:
.Increase the capacity of the existing floodplain volume.
-increase the size and diversity of the existing riparian buffer.
.Better balance the downstream rainfall /runoff water balance.
Pursuant to Section 2 -263, Code of the City of Roanoke (1979), as amended, the
City Manager may accept a gift that is in excess of $5,000 only after adoption of
an ordinance by City Council that authorizes the acceptance of the gift.
Recommended Action:
Authorize the City Manager to execute the deeds and any other necessary
documents, subject to satisfactory titles for each of the parcels, and accept the
donation of property identified by Official Tax Nos. 6120417X, 6120443X,
6120418 through and including 6120429, and 6120439 and through and
including 6120442, with all such documents to be approved as to form by the City
Attorney. Said property rights may be accepted following satisfactory title
reports, as determined by the City Manager and the City Attorney.

Background:
As the result of official School Board action at its December 8, 2015 meeting, the Board

The Title I, Part D, Neglected, Delinquent Literacy Coaching 2015 -16 grant of $2,000
provides funds to support literacy initiatives at the Roanoke Valley Juvenile Detention
Center. This program will be fully reimbursed by federal funds and will end September
30, 2017.
Recommended Action:
We recommend that Council concur with this report of the School Board and adopt the
attached budget ordinance to establish revenue estimates and to appropriate funding
as outlined.

A RESOLUTION memorializing the late Roy Cornelius Kinsey, Jr., a native of
Roanoke and creator of the Star on Mill Mountain.
WHEREAS, the members of Council learned with sorrow of the passing of Mr.
Kinsey on Monday, November 23, 2015;
WHEREAS, Mr. Kinsey grew up in Roanoke on Highland Dairy Farm, knew
hard work, and understood how to improvise, making tools and equipment on the spot
for the farm and, later, for the family's sign company business;
WHEREAS, Mr. Kinsey frequently walked from his parents' home over the hills
to Woodrum Field (now Roanoke - Blacksburg Regional Airport), where he would
"hang out" hoping for a plane ride with one of the local pilots;
WHEREAS, Mr. Kinsey signed up in Roanoke for the Air Corps in July 1941
and was called up, arriving in San Antonio, Texas in December 1941, where he was
processed and sent to pilot training in Tulip, Texas;
WHEREAS, after earning his wings, Mr. Kinsey was sent on to Enid, Oklahoma
for instrument and multi - engine training where he proved to be an excellent pilot;
WHEREAS, after graduation, Mr. Kinsey earned an assignment to the Training
Command as a flight instructor, and spent the following two years training new pilots
at the rate of eight every two months or approximately 100 wartime combat pilots;
WHEREAS, Mr. Kinsey was assigned as a re- training pilot for high- ranking,
highly skilled combat pilots returning from overseas actions to instruct veteran combat
pilots in the rules offlying in civilian airspace within the United States and introduce
them to instruments and mu /d- engine operations, and as apart of this assignment, Mr.
Kinsey flew all over the United States in more than 30 different types of aircraft
selected by his students;
WHEREAS, flying became a lifetime joy for Mr. Kinsey from childhood on
through the war and afterwards as a member of the Acorn Flying Club;
WHEREAS, after returning from the war, Mr. Kinsey helped run his father's
business, the Roy C. Kinsey Sign Co., which opened the first neon sign plant in
Virginia in 1933 and constructed hundreds of large neon signs in multiple states across
the Southeast United States;
WHEREAS, Mr. Wiley has received numerous awards in recognition of

WHEREAS, the Applicant has petitioned this Council to exempt certain real property of the
Applicant from taxation pursuant to Article X, Section 6(a)(6) of the Constitution of Virginia;
WHEREAS, a public hearing at which all citizens and other interested persons had an opportunity
to be heard with respect to the Applicant's petition was held by Council on December 21, 2015;
WHEREAS, the provisions of subsection B of Section 58.1 -3651, Code of Virginia (1950), as
amended, have been examined and considered by the Council;
WHEREAS, the Applicant agrees that the real property to be exempt from taxation is certain real
estate, including the land and any buildings and improvements located thereon, situated at 1718 Salem
Avenue, S.W., 0 Salem Avenue, S.W., 712 Patterson Avenue, S.W., and 0 Campbell Avenue, S.W.,
Roanoke, Virginia, and identified, respectively, as Official Tax Map Nos. 1211605, 1211604,1112822,
and 1112820 (collectively the "Properties "), which Properties are owned by the Applicant, and that the
entirety of the Properties shall be used by the Applicant exclusively for charitable or benevolent
purposes on a non -profit basis, and
WHEREAS, in consideration of Council's adoption of this Ordinance, the Applicant has
voluntarily agreed to pay each year a service charge in all amount equal to twenty percent (20 %) of the
City of Roanoke's real estate tax levy, which would be applicable to the Properties were the Properties
not exempt from such taxation, for so long as the Properties are exempted from such taxation.
THEREFOR 131; IT ORDAINED by the Council of the City of Roanoke as follows:
Council classifies and designates Applicant, the Roanoke Community Garden
Association, Incorporated, as a charitable or benevolent organization within the context of Section
6(a)(6) of Article X of the Constitution of Virginia, and hereby exempts from real estate taxation certain
real estate, situated at 1718 Salem Avenue, S.W., 0 Salem Avenue, S.W., 712 Patterson Avenue, S.W.,
and 0 Campbell Avenue, S.W., Roanoke, Virginia, identified, respectively, as Official Tax Map Nos.
1211605, 1211604,1112822, and 1112820, and owned by the Applicant. Continuance of this exemption
shall be contingent on the continued use of the Properties by Applicant in accordance with the purposes
designated in this Ordinance, as further stated in the City Council Agenda Report dated December 21,
2015.
2. In consideration of Council's adoption of this Ordinance, the Applicant agrees to pay
to the City of Roanoke, on or before October 5 of each year, a service charge in an amount equal to
twenty (20 %) percent of the City of Roanoke's real estate tax levy.
3. This Ordinance shall be in full force and effect on January 1, 2016 if, by such time, a
copy, duly executed by an authorized officer of the Applicant, has been filed with the City Clerk.
4. The City Clerk is directed to forward an attested copy of this Ordinance, after it is
properly executed by the Applicant, to the Commissioner of the Revenue, and the City Treasurer for
purposes of assessment and collection, respectively, of the service charge established by this Ordinance,
and to Mark Powell, President/Director, and the authorized agent of Roanoke Community Garden
Association Incorporated.
5. Pursuant to Section 12 of the City Charter, the second reading of this ordinance by title
is hereby dispensed with.

Association, Inc.
Background:
The Roanoke Community Garden Association, Inc. (RCGA), is a Virginia non -
stock, not - for - profit corporation which owns certain real property located at
1718 Salem Avenue, S.W. and adjacent property at 0 Salem Avenue, S.W.,
depicted as Official Tax Map Numbers 1211605 and 1211604, respectively, as
well as property located at 712 Patterson Avenue, S.W. and adjacent property at
0 Campbell Avenue, S.W., depicted as Official Tax Map Numbers 1112822 and
1112820, respectively. RCGA desires these properties be designated as exempt
from real estate taxes pursuant to the provisions of the Code of Virginia. RCGA
is a Roanoke -based charitable organization that serves the City of Roanoke by
providing mainly low- income residents access to local, fresh produce by
providing and maintaining community gardens and educational and recreational
spaces. At present, annual real estate taxes on the four parcels are $366 on a
total assessed value of $30,000.
Considerations:
On May 19, 2003, City Council approved a revised policy and procedure in
connection with requests from non - profit organizations for tax exemption of
certain property in the City by Resolution 36331- 051903, with an effective date
of January 1, 2003. Based on this policy and procedure, the RCGA has provided
the necessary information required for applications for exemptions that would
take effect January 1, 2016.
As noted above, the assessed value of the real property at the four locations is
$30,000 with annual taxes due of $366. The organization is current on its
taxes. In lieu of the $366 in real estate taxes, the organization would agree to
pay to the City an annual service charge equal to twenty percent of the tax levy
on the parcel for as long as the exemption continues. In this case, based on
the current assessed value, the service charge amount would be $73.
Consequently, the City would be foregoing $293 in annual real estate revenue.
The Commissioner of the Revenue has determined that the organization is not
exempt from paying taxes by classification or designation under the Code of
Virginia. The IRS recognizes the organization as a 501(c)(3) tax - exempt
organization.
Notification of a public hearing to be held December 21, 2015, was duly
advertised in the Roanoke Times.
Recommended Action:
Adopt an ordinance to authorize the RCGA's exemption from real property
taxation pursuant to Article X, Section 6 (a) 6 of the Constitution of Virginia,
effective January 1, 2016.

The Roanoke Community Garden Association, Inc., filed a petition in the

The Roanoke Community Garden Association desires to be an organization designated pursuant to the

the provisions of Article X, Section 6 (a)(6) of the Constitution of Virginia so long as your Petitioner is
operated not for profit and the property so exempted is used in accordance with the purpose for which
the Petitioner is classified. RCGA serves the city of Roanoke by providing mainly low- income residents
with access to local, fresh produce through developing and maintaining community gardens.
Additionally, RCGA provides sound educational opportunities to its participants and the public alike, free
of charge. Currently, RCGA administers six community gardens, has developed or improved four
elementary school gardens, and is serving hundreds of gardeners in Roanoke City. RCGA's gardens
provide a catalyst for community development, stimulate social interaction, encourage self - reliance, and
produce nutritious foods while improving the quality of life for people in the garden. The education
programs at these sites and throughout the area serve not only to enrich minds and encourage healthy
eating, but also serve to build healthy communities as people gather for recreation, planting,
workshops, classes, and general fun together.
2. Your Petitioner agrees to pay to the City of Roanoke, an annual service charge in an amount equal to
twenty percent (20 %) of the City of Roanoke tax levy, which would be applicable to this real estate, were
our organization not be tax exempt, for as long as this exemption continues.
3. Your petitioner acknowledges and agrees that it will immediately notify both the City of Roanoke
Commissioner of the Revenue and the City of Roanoke Treasurer in writing in each instance when the
property, or any portion thereof, is being leased to a third party and provide the City with a copy of the
fully executed lease. Your petitioner agrees to include a provision in all leases of the property that such
third parties shall be responsible for paying the City applicable leasehold taxes that may be assessed by
the City. Petitioner acknowledges that if the foregoing conditions are not met, the City reserves the right
to terminate the tax exempt status of the property.
4. Your Petitioner, if located within a service district, agrees to pay to the City of Roanoke an annual
service charge equal to the additional service district tax that would be levied for as long as this
exemption continues.
5. Your Petitioner agrees to provide information to the Director of Real Estate Valuation upon request to

(A): Your Petitioner was granted exemption from taxation pursuant to Section 501 (c)
of the Internal Revenue Code of 1954 on Feb 21, 2009.
2. (Q): Whether a current alcoholic beverage license for serving alcoholic beverages
has been issued by the Alcohol Beverage Control Board to such organization for use
on such property.
(A): NO
3. (Q): Whether any director, officer or employee of the organization has been paid
compensation in excess of a
reasonable allowance for salaries or other compensation for personal services which
such director, officer or employee actually renders.
(A): Board of directors is unpaid. Staff has not been paid any amounts which could be
deemed excessive or exorbitant.
4. (Q): Whether any part of the net earnings of such organization inures to the benefit
of any individual, and whether any significant portion of the service provided by such
organization is generated by funds received from donations, contributions or, local,
state or federal grants. As used in this subsection, donations shall include the
providing of personal services or the contribution of in -kind or other material services.
(A): NO
5. (Q): Whether the organization provides services for the common good of the
public.
(A): Your Petitioner provides services for the common good of the public in as much
as it develops community gardens, provides education to the public, develops
educational summer programs for youth, provides volunteer opportunities to
thousands of people, etc.
6. (Q): Whether a substantial part of the activities of the organization involves
carrying on propaganda, or otherwise attempting to influence legislation and whether
the organization participates in, or intervenes in, any political campaign on behalf of
any candidate for public office.
(A): NO. RCGA has a policy in line with IRS guidelines prohibiting such activities.
7. (Q): Whether any rule, regulation, policy or practice of the organization
discriminates on the basis of religious conviction, race, color, sex or national origin.
(A): NO
8. (Q): Whether there is a significant revenue impact to the locality and its taxpayers
of exempting the property.
(A): NO
9. (Q): Any other criteria, facts and circumstances, which the governing body deems
pertinent to the adoption of such ordinance.
(A): N/A
THEREFORE, your Petitioner, Roanoke Community Garden Association, Incorporated, respectfully
requests to the Council of the City of Roanoke that this real or personal property, or both, of your
Petitioner be designated exempt from taxation so long as your Petitioner is operated not for profit and
the property so exempt is used for the particular purposes of providing mainly low- income residents
access to local, fresh produce by providing and maintaining community gardens and recreational spaces.
Additionally, RCGA provides sound educational opportunities to its participants and the public alike, free
of charge. RCGA's gardens provide a catalyst for community development, stimulate social interaction,
encourage self - reliance, and produce nutritious foods while improving the quality of life for people in
the garden. The education programs at these sites and throughout the area serve not only to enrich
minds and encourage healthy eating, but also serve to build healthy communities as people gather for
recreation, planting, workshops, classes, and general fun together.
