2. PRESENTATIONS AND ACKNOWLEDGEMENTS:
A resolution honoring the late Gus George Pappas, longtime resident and
patriarch of The Roanoke Weiner Stand, for his many contributions to the City of
Roanoke community.
Presentation of resolution was postponed indefinitely.
Recognition of Big Brothers Big Sisters of Southwest Virginia's partnership with
Roanoke Police: "Bigs in Blue" initiative.
Mayor Lea recognized big brother Officer Ryan Brady and Highland Park
Elementary student, little brother Robert Lewis.
A proclamation declaring the week of November 13 — 19, 2016 as Week of the
Family.
Mayor Lea presented ceremonial copies of proclamation to Ali Hamed-
Moore, ARCH/Trust House; Teresa Carpentieri, Children's Trust; and Nancy
Hans, Prevention Council.
A proclamation declaring Friday, November 11, 2016, as Veterans Day.
Mayor Lea presented ceremonial copies of proclamation to Major Deborah
Saunders and members of the United Black Veterans Society of Virginia.

The Mayor called attention to requests from the City Attorney for a public
hearing on Monday, November 21 at 7:00 p.m., with regard to granting,
confirming, and /or amending easements and other property rights to South
Commonwealth Partners, LLC in connection the Hampton Inn & Suites
Hotel at 27 Church Avenue, S.E. (adjacent to the Market Garage at 25
Church Avenue, S.E.) as set forth in the City Council Agenda Report dated
August 15, 2016; and Assistant City Manager for Community Development
regarding pool attendance for summer 2016. Both items to be received and
filed.

2016.

Public Meeting on Availability of HUD Funds
• Thursday, Nov. 10, 6 p.m.
• Emergency Operations Center, Room 159 South, in the Noel C.
Taylor Municipal Building.
• Interested parties will be informed of the availability of federal
funds from the U.S. Department of Housing and Urban
Development for the fiscal period beginning July 1, 2017.
Fall Leaf Collection Begins
• Collection starts next week on your regular trash collection day
• Brochures with this year's Leaf Collection Schedule were mailed
to all city residents
• The city will collect an unlimited number of biodegradable paper
bags filled with leaves, placed at the curb, on the following
weeks:
• November 14 - 17
• November 28 - December 1
• December 12 - 15
• Bulk and brush collection will continue on leaf collection weeks.
• More information about leaf collection is available by calling 853-
2000, Option 6.
Ice Skatina Returns to Elmwood Park
• There will be 100% chance of ICE in Downtown Roanoke's
Elmwood Park - November 23, 2016 — February 12, 2017.
• This is the second year for our "Elmwood on Ice" rink.
• New this year, we will have 5 Seal Ice Skating Aids that give
beginners something steady to hold on to while they learn to
skate or allow little (and big) skaters to take a load off and be
pushed around.
• Hours:
• Mondays and Tuesdays - Closed
• Wednesdays and Thursdays — 4:00 to 9:00 p.m.
• Fridays and Saturdays —11:00 a. m. to 10:00 p.m.
• Sundays —12:00 to 7:00 p.m.
• Admission is $6.00. Skate rentals are $2.00. Skate time is
unlimited on the day of purchase.
• Free on- street parking is available around Elmwood Park. In
addition, the Elmwood Park Garage and Lot are free every
weekday after 5:00 p.m. and all weekend.
Roanoke receives more national attention
• Roanoke was mentioned in a recent article published in the
Christian Science Monitor titled "Memo to the Next President."
• The article was written by Colin Woodward, the same person who
wrote the article about Roanoke published in Politico magazine in
September, and includes examples of how cities have recreated
themselves (including Roanoke).
The City Manager played a special video created by the City's
Economic Development Department with funding from AEP. He
added that the video focuses on quality of life and complements the
recent video produced by Visit Virginia's Blue Ridge.

Vice -Mayor Price encouraged all to vote on November 8, 2016.
Council Member Bestpitch announced a Veteran's Day program held
by the Local Daughters of the American Revolution will be held on
Friday, November 11, 2016 at Argon Circle near King George Avenue,
S. W. and 4`" Street, S. W. He also invited the public to attend the
Annual City Neighborhoods 'Harvesting of the Fruits' Potluck Dinner
and Awards Celebration scheduled for Friday, November 11, 2016 at
the Jefferson Center's Fitzpatrick Hall located at 541 Luck Avenue,
S. W. beginning at 6:00 p.m.
Mayor Lea announced the CIAA Football Championship game
scheduled for 2:00 p.m., Saturday, November 12, at the Salem
Football Stadium in Salem between Winston Salem State and Bowie
State University and Bowie State University.

INTRODUCTION
The City Council is pleased to commend this Legislative Program for consideration by
the 2017 Session of the General Assembly. The City Council, representing all the people of
our Six -Time All- America City, is uniquely qualified to understand the legislative needs of our
City. We are also focused on the development and promotion of our region, Virginia's Blue
Ridge. This Program is responsive to these needs. As a policy matter, we continue to believe
that local governments are the best vehicles for the delivery of many services to the public
because local governments are closest to the people and the most responsive. Our City Council
and City Administration collaborate with our regional partners to enhance economic
development and quality of life throughout the Roanoke Valley.
This Program is a combined Program for City Council and the School Board. You will
note that we have made a conscientious effort to pare our Program down to the issues that we
believe are most important to the citizens of this City. The City Council portion was prepared
by the City Attorney, Daniel Callaghan, with the assistance of comments, input, and
suggestions from Council Members, City administrators, the City's Legislative Liaison, and
our citizens. The School Board portion was prepared with the assistance of advice and
comments from Members of the School Board and administrators. The entire Program has
been carefully reviewed by City Council's Legislative Committee, which consists of all the
members of Council, and Annette Lewis and William Hopkins of the School Board. Upon the
recommendation of the Legislative Committee, the Program was adopted and endorsed by City
Council on October 17, 2016. See Resolution No. 40674 - 101716 a copy ofwhich is attached.
City Council and City Administration are committed to working with our regional
delegation to promote this Program and other issues that will arise during the 2017 Legislative
Session that impact our City and region. We are committed to maintaining regular
communications with our delegation and we encourage our Senators and Delegates to contact

2017 Legislative Program
In addition to the local and regional issues discussed below, the Roanoke City Council incorporates
the 2017 Legislative Program and policv statements of the Virginia Municipal League into the Cih'

I. BUDGET. LOCAL AID. AND LOCAL REVENUES
A. Budget and Unfunded Mandates
The City of Roanoke strongly urges the General Assembly to maintain its commitment to localities by
avoiding reductions in local aid. Budget challenges should not be used to shift state service or financial
responsibilities from the Commonwealth to localities-. Moreover, the General Assembly should oppose any
new mandates on localities that arc not fully funded by the Commonwealth. The City also opposes the
continuation of state mandates for which the Commonwealth proposes to shift the fiscal responsibility for
such programs to localities. Roanoke specifically requests the General Assembly to fund the obligations of
the Commonwealth set forth in the Line of Duty Act (Sections 9.1 -400 through 9.1 -408, Code of Virginia
(1950) as amended).
B. Local Law Enforcement Funding
Roanoke formally requests that the General Assembly increase HB 599 funding. Local law enforcement
agencies confront significant increases in expenses as communities demand improvements in law
enforcement practices. As one example, police departments around the Commonwealth are acquiring new
equipment and technology to provide body wom cameras for their officers. This recent development comes
with significant costs that will increase as technologies improve. The General Assembly should consider
these costs and help localities fund these costs. At a minimum, the General Assembly should not limit or
eliminate the ability of police departments to use funds from existing forfeiture of property programs
involving criminal enterprises.
C. Enhance Local Revenue Collections
Pavment of Interest by Localities for Refunds Attributable to Taxpaver Error
The City also recommends amendments to Section 58.1 -3916 to eliminate the requirement that localities
pay interest on refunds at the same rate that localities charge for delinquent taxes in circumstances where
the erroneous assessment is attributable solely to filings made by the taxpayer. A locality should be
required to pay interest on such refunds at the lesser of (i) the rate charged for delinquent taxes; or (ii) the
average rate earned by the locality during the period in which the amount of the refund were held by the
locality. As an example, a taxpayer could overpay its business tax and apply for a refund based upon a
deduction not originally taken by the taxpayer. Under current state code, the locality is required to pay the
amount of the refund, together with interest at 10% per annum. This rate of return greatly exceeds current
market rates. Taxpayers should not enjoy a windfall return at the expense of the locality for mistakes made
by the taxpayer.
D. Tax reform
The City welcomes a discussion, review, and reformation of the current tax structure in the
Commonwealth. Meaningful tax reform can only be achieved through a comprehensive effort; piecemeal
attempts will not address this critical economic issue. An essential component of any debate on
meaningful tax reform must begin with a serious study of the current tax preferences provided to a myriad
of interests. These tax preferences cost the Commonwealth billions in revenues annually. Additionally, tax
reform must be a balanced approach that allows localities some flexibility in establishing a local tax
structure that supports the local and regional economy. An example of a balanced approach is maintaining
the current availability of rehabilitation tax credits to allow the restoration and reuse of buildings in
communities like Roanoke. This program allows a locality to improve its tax base, enhance its economic
core, and improve the quality of life within the community. These factors demonstrate the net benefit to
localities and the Commonwealth and therefore warrant the continuation of this tax credit program.
The City urges the General Assembly to refrain from creating further exemptions that are applicable to
local revenue sources. The expansion of exemptions with respect to local taxes by the General Assemble
limits the ability of localities to allocate the necessary costs of local government across all members of the
community. Continued expansion of these exemptions is, in effect, an unfunded mandate imposed on
localities.

Transportation infrastructure is essential to economic development, community strength, and quality of
life. Transportation infrastructure also contributes to improvements in environmental quality and energy
conservation. Roanoke applauds the continued efforts of the Govcmor and the General Assembly in
developing, promoting, and funding a comprehensive and diverse transportation plan for the
Commonwealth, and the Roanoke region. The Commonwealth and Roanoke are active partners in the
return of passenger rail to the Star City within the next two years. Roanoke appreciates and applauds this
commitment from the Commonwealth. Roanoke supports further expansion of passenger rail service
throughout Southwest Virginia.
A. Hiehwav Infrastructure
The City urges Congress, the Federal Highway Administration, Governor, General Assembly, and the
Virginia Department of Transportation to take all steps necessary to pursue all available funding for
improvements to expand and improve the reliability of Interstate 81 and commence construction of
Interstate 73 from Interstate 81 to the North Carolina border, including improvements to Interstate 581 and
re- designation of Interstate 581 to Interstate 73. These projects are critical components in the improvement
of transportation infrastructure in the Roanoke Valley and Southwest Virginia. Improvements in
transportation infrastructure and facilities are essential to the maintenance and expansion of economic
development and to improve the safety and reliability of corridors throughout our region. These projects
are Roanoke's highest transportation and economic development priorities.
B. Regional Transportation District
The City supports legislation to establish a regional transportation district to support the development and
expansion of transportation infrastructure throughout the region. The expansion of transportation
infrastructure will enhance and improve economic development opportunities within our region and
contribute to the improvement of the quality of life for all residents of our region.
C. Public Transit Funding
Roanoke strongly encourages the General Assembly to maintain support for local public transit programs
such as the Valley Metro bus service in Roanoke. Local bus service is a critical component of the overall
transportation system in our community and is an important component of our community's quality of life.
For many Roanoke residents, bus service is an essential service. A quality bus service will reduce traffic
congestion and energy consumption. Roanoke opposes any changes in funding formulas that would reduce
current funding for Valley Metro bus system.
III. REGIONAL DEVELOPMENT
Virginia's Blue Ridge is a vibrant area that provides its residents with an exceptional quality of life. The
region is ripe for the expansion of development. Regional collaboration is the critical component in
continuing the recent successes of our region in bringing exciting new development and economic
opportunities to Virginia's Blue Ridge. Roanoke City is committed to working with its local partners in
promoting the region and advocating for opportunities that the General Assembly can and should support.
IV. ECONOMIC DEVELOPMENT
A. Historic Rehabilitation Tax Credit Program
Roanoke has utilized Virginia's historic Rehabilitation Tax Credit program in collaboration with private
developers to encourage creative and innovative reuse of historic structures within the City. This tool
produces tangible economic benefits that have revitalized development in our City. Historic tax credits
encourage private investment to preserve the historic character of our neighborhoods and business districts
and spur growth. Roanoke urges the General Assembly and its Joint Subcommittee to Evaluate Tax
Preferences to support the Historic Rehabilitation Tax Credit program and reject effort to weaken or
eliminate this program.
B. Inland Port Facilitv
The recently completed upgrade of the Panama Canal presents exciting opportunities for the
Commonwealth of Virginia to become the United States center for international trade and distribution east
of the Mississippi River. The Roanoke Region and New River Valley, ideally located at the intersection of
Interstates 81 and 77, Route 460, and Heartland and Crescent corridors operated by Norfolk Southern, are
experiencing economic expansion by companies with international reach and demand. Our region is also
just a few hours away from producers with similar distribution interests in neighboring states. Our region is
ideally situated to capitalize upon this significant economic opportunity and facilitate economic
development throughout the Commonwealth of Virginia. Roanoke encourages and supports any efforts by
the Port of Virginia to evaluate the merits of establishing an inland port facility in the Roanoke Region and
the New River Valley.

The proposal to close Catawba Hospital was eliminated from the budget adopted during the 2016 Session
of the General Assembly. The urgent issue of adequate, available and accessible mental health care services
remains. The City supports actions by the General Assembly to consider all aspects of mental health care
for citizens throughout our region and the Commonwealth. These considerations should include legislation
to encourage and assist public - private initiatives to address these needs. Furthermore, our local and
regional jails are no substitute for a statewide mental health program to address the needs of citizens with
mental conditions.
VI. PUBLIC SAFETY
An issue that affects communities throughout the United States is the illegal use of firearms. The City urges
Congress and the General Assembly to initiate efforts to adopt pragmatic and effective measures,
applicable throughout the country and the Commonwealth, that address this issue. The issue of reducing
the illegal use of firearms while protecting individual rights is not solely a local or regional issue. An
effective response can only be achieved through a collaborative federal and statewide approach.
As an initial step, the City encourages the General Assembly to add the City to the list of 13 localities
listed in Section 18.2- 287.4, which lists localities where carrying certain loaded semi- automatic firearms is
prohibited.
The City also encourages the General Assembly to authorize localities to adopt measures to limit, prohibit,
or restrict the possession offirearns within local public buildings-.
VII. ADMINISTRATIVE MATTERS
A. Stormwater Utility Fees
The City strongly supports the General Assembly in its efforts in refusing to create exemptions from local
stornwater utility fees for special interest groups or industries. This issue involves the protection of our
environment and all businesses, interests, and individuals need to pay their fair share to address this critical
Issue.
B. Advertisina Citv Procurements
The City supports changing the public notification process competitive negotiation procurement set forth in
Section 2.2- 4302.2 (2) to mirror the process presently established for competitive sealed bidding in Section
2.2- 4302.1 (2). The current process for competitive sealed bidding allows for public notification through
the website maintained by the Virginia Department of General Services or other appropriate websites.
Localities may also publish a notice in a newspaper of general circulation. The current process for
competitive negotiation procurement requires localities to publish notice in a newspaper. This change will
allow localities to determine the benefits of alternative publications and whether those benefits warrant the
expenditure of public funds to advertise an RFP in the local newspaper. Publishing the procurement on e-
Va and on the localities website would negate any requirement to publish the procurement in the local
newspaper. Publishing procurements in the local newspaper does not represent the same reach into the
government vendor community as publishing on State and local electronic procurement websites. This
amendment will allow localities to make the decision on the efficient use of limited resources.
C. Additional General District Court Judge
Roanoke wants to be responsive to its citizens, especially in circumstances where property owners are not
in compliance with city code requirements. Presently, city code enforcement actions before the General
District Court are limited to one (1) hearing day each calendar month. This limitation causes delays for the
City planning and code enforcement staff. In addition, citizens generally, including landlords and tenants,
and citizens dealing with traffic enforcement issues, experience significant inconvenience and delays with
the lack of an additional General District Court judge. The General Assembly can provide relief from these
delays by funding and appointing another judge for the General District Court. One General District Court
judge retired in October, 2013 and that position has remained unfilled. As a result, judges from Roanoke
County hold sessions in Roanoke City on certain days during each month. Prior to the retirement of one of
the three General District Court judges in 2013, code enforcement cases were scheduled on two (2) days
each calendar month. Roanoke urges the General Assembly to take action to provide Roanoke with a third
General District Court judge.
D. Plastic Bags
The City supports legislation that will enable the City to charge and collect a fee for the use of plastic
shopping bags provided by retailers to its customer. The goal of such legislation is to provide the City with
a revenue source to fund clean -up actions associated with persistent littering, often in the form of plastic
bags discarded by customers of retail stores. These clean -up activities will assist the City in meeting its
mandated MS4 stormwater permit requirements and enhance the livability and attractiveness of The Star
City of The South.
E. Charter Amendments
The City requests the General Assembly to amend the City's Charter to reduce the requirement that the
City Council meet at least two times during each month. The City requests an amendment that will require
Council to schedule at least one regular session during each calendar month. The schedule of sessions for
the year beginning each July I shall be set at the Council organizational meeting on the first Monday of
July. The organizational meeting shall constitute a regular meeting of Council for the month of July. This
charter change will provide the Council with flexibility in setting its schedule and remaining transparent to
the public in setting that schedule.
F. Smoking in Public Parks
Current state code allows localities to adopt regulations that designate areas in which smoking inside
certain public facilities is prohibited. Public facilities are limited to indoor facilities. Localities should be
given the authority to designate areas within outdoor facilities such as public parks where smoking is
prohibited. Such regulations could prohibit smoking within the entire outdoor public facility. . The
legislation would enable localities to adopt measures; the legislation should not mandate action by
localities.
G. Local Reeulation of Short Term Rentals
Roanoke adopted an ordinance to address the desire of homeowners to rent rooms within their homes for
limited stays by guests and the concerns of residents that their residential neighborhoods are becoming
commercial districts. The local ordinance is tailored to the unique characteristics of Roanoke's residential
districts. The Commonwealth should not usurp this critical local control from localities. Any legislation to
regulate operations of short term rentals, such as AirBnB, should not include any preemption of this
essential local control of development.
H. Blight _
Blighted properties present significant challenges for localities in their efforts to revitalize, support, and
sustain their neighborhoods. The General Assembly has provided localities with several tools to address the
issue of blighted properties. One challenge persists, however, with respect to the ability of a locality to take
immediate action to remove a property that presents a real and imminent danger to public health and safety
if a building is in such a deteriorated condition that it presents an immediate risk of collapse. Section 15.2-
906 authorizes localities to adopt ordinances to establish procedures for removal of deteriorated buildings.
That procedure requires prior notice to the property owner and lien holders of record. Section 15.2 -906 also
allows for an expedited process in limited circumstances. Roanoke recommends that this statute be
amended to allow a locality to take expedited action, without compliance with the various notice
provisions, if the building is in immediate danger of collapse. This suggested standard is consistent with
provisions of the Statewide Building Code.
1. Miscellaneous code changes
The City recommends the following technical changes to state code:
Amend several section of State Code to provide that various nuisance liens have the same priority and
duration as unpaid local real estate tax liens. Currently, state code provides that nuisance liens have the
same priority as "unpaid local taxes." The State Code sections that require this amendment include Section
15.2 - 901 B, Section 15.2 -906 (4), Section 15.2 -907 (3), Section 15.2 -908, Section 15.2 -908.1 (3), and
Section 15.2 -1115 B.
Amend Section 15.2 -2314 to clarify the protection afforded localities from costs that could be assessed by
a court in an appeal of a decision of the local board of zoning appeals. Prior to 2010, the board of zoning
appeals was the local governmental body that was named in an appeal. Amendments to State Code in 2010
mandated that the `local goveming body" be named in an appeal. The limitation on the assessment of costs
was not changed. The recommended amendment would provide that costs cannot be assessed against the
locality or the local governing body.
City of Roanoke Public Schools
2017 Legislative Program
SCHOOL START DATE
The City and the Schools support amendments to Virginia Code Section 22.1 -79.1 that would afford the
Roanoke City School Board the discretion to select the School Start Date that best suits the needs of its
students and those of the school division. The control of the public school calendar by the local school
board would provide local flexibility and control over opening dates to allow the Roanoke City School
Board to have time to provide for required remediation and teacher training. Additionally, it would allow
the Roanoke City School Board to ensure its schedule does not conflict with the articulation agreement
with Virginia Western Community College (Virginia Code Section 23- 9.2:3.02) which allows dual
enrollment opportunities for its students. RCPS would be able to schedule exams for dual enrollment
classes based upon the Virginia Western Community College exam schedule. Furthermore, RCPS believes
that additional instructional days prior to administering the Standards of Leaning (SOL) tests would result
in improved student performance on the SOL tests.
II. FUNDING FOR EDUCATION
The State has a constitutional duty to meet its education funding obligations. The City and the Schools
encourage you to do everything possible to significantly increase spending on public education. The
Roanoke City Schools is operating with the same level of state funds provided in 2009. The City and
Schools support full finding of State education programs including the Standards of Quality, incentive,
categorical, and school facilities programs. The City and Schools oppose changes in methodology and
changes in the division of financial responsibility that result in a shift of funding responsibility from the
State to localities. As an example, the City and Schools oppose the elimination or decrease of State
funding for State mandated benefits for school employees.
The City and the Schools oppose policies that lower State contributions to education under the Standards of
Quality or other programs, but do nothing to address the cost of meeting the requirements in the Standards
of Accreditation and Standards of Learning. The State should not continue to maintain and increase
educational requirements while at the same time decreasing State funding. The challenges confronting local
schools- are compounded because the actual costs incurred by local school divisions in meeting mandates
are often much greater than estimated by the Commonwealth. Additionally, the increase in classroom rigor
as a result of changes in student performance requirements should be supported by an increase in teacher
instructional knowledge and skills. Funds should be allocated to support continuing education for teachers.
Funding for education includes an emphasis on access to enhanced technology to assist all students for the
challenges presented by technology based SOL tests. Roanoke City Public Schools has initiated a program
to provide eighth graders with lap top computers to address this challenge. As a part of its effort to fulfill
its constitutional obligation to education funding, the Commonwealth must include funding for technology
that enhance learning as well as the staff development needed for teachers.

Program Report
Attached for City Council's information is a summary of the activities and
attendance for the Library's 2016 Summer Reading Program. As indicated in
the report, overall attendance at events this past summer increased by more
than twenty six percent (26 %) over 201 S. This increase is especially
encouraging since it was accomplished with one of the Library Branches
(Williamson Road) closed for renovations. The report also illustrates the
number of events and attendance by Branch location.
In addition, the number of events put on during the summer of 2016 increased
by over fourteen percent (14 %). Please let me know if there are any questions.

The following financial report provides commentary on the City's financial results for the
three months ended September 30, 2016.
General Fund
The FYI adopted revenue estimate was 3.0% over FYI actual revenues. Through
September, FYI year -to -date revenues were $55.9 million, or 19.9% of the adopted
revenue estimate for the year. Significant tax revenues, such as Real Estate, Personal
Property and Business License taxes are not due until later in the year. Year to date
revenues increased 11.9% or $6.0 million compared to the same period in FYI 6. The
increase was primarily due to the timing of the receipt of the first half of the Real
Estate taxes due October 5'h. Real Estate taxes were $4.4 million or 17.1% higher
compared to FYI 6.
First quarter other local tax revenue represents 15% of budget and compares well to
other local tax revenue in the first quarter of FY 2016. Despite the local tax category
comparing well to last year, sales tax, which includes sales for July and August of
2016, is 3.6% less than FY 2016 and 6.2% less than year -to -date budget. Lodging tax
is 4.5% less compared to the same time period last year and 8.5% less than the year -to-
date budget. Meals tax is currently performing in line with both the previous year and
the year -to -date budget.
Through September, expenditures were $78.8 million, or 27.8% of the adopted
expenditure budget for the year. Year -to -date expenditures increased by 8.6% or $6.2
million compared to the prior year. The increase was mainly related to the timing of
contracts for the health department, medical services for the Jail inmates, street paving
and capital projects.
Stormwater Utility Fund
Year -to -date stormwater fee revenue as of September 30, 2016 was $1.8 million, or
31.0% of FYI anticipated revenues. Operating expenses were $571,000, or 11.1 %of
the expense budget resulting in an operating gain of $1.2 million. Change in net
position, after transfers and contributions, was a gain of approximately $1.0 million.
Stormwater fees are being charged using a phased in approach. In FYI 6, which was
the second year of implementing the fee, the approved fee was 60 cents per billing
unit of impervious service. In FYI 7, the approved fee increased to 90 cents per billing
unit. This is the third and final year of the phased in approach.
Civic Center Fund
FYI year -to -date change in net position was a loss of $745,000 compared to the
budgeted loss of $1,007,000. The year -to -date operating revenue through September
was $56,000 lower than the budgeted revenues but $995,000 higher than the prior
year primarily due to the timing of events. Correspondingly, operating expenses were
$285,000 lower than budgeted and $924,000 higher than the prior year. The
operating loss was approximately $229,000 less than the fiscal year -to -date budgeted
operating loss. FYI operating loss was a $71,000 improvement over the prior year.
Parking Fund
Through September, approximately 26.5% of anticipated operating revenue has been
realized. Increases in Market garage revenues were partially related to the completion
of the hotel construction. Gainsboro garage and the Higher Ed Center lot have
increased occupancy from the prior fiscal year. Elmwood garage and lot revenues were
lower than the prior year due to decreases in Anthem and Meridium employee parking.
Operating expenses decreased 3.5% or $19,000. Operating income, before the net
decrease of non - operating expenses and transfers was approximately $390,000. After
non - operating expenses and transfers, the fund's change in net position was
approximately $285,000.
Economic Summary
The State's 2016 General Fund Budget experienced a shortfall in revenues of $279.3
million. Since FY 2016 revenue collections were lower than that threshold, a revision
to the official estimate of general fund revenue collections was required.
The revised interim forecast reduces revenue in FY 2017 by $564.4 million as growth
falls from 3.2% in the official forecast to 1.7 %. When combined with transfers from
other funds to the general fund, total general fund resources fall by $582.1 million in
FY 2017. The combination of the revenue shortfall for FY 2016 ($279.3 million) and
the projected reduction of general fund resources in FY 2017 ($582.1 million) totals
$861.4 million and must be addressed immediately to keep the first year of the
enacted biennial budget in balance.
Strategies to address the 8861.4 million shortfall include: the automatic withdrawal of
the authority to grant pay increases to state employees and state - responsible local
employees and the reversion of unexpended discretionary balances at the end of FY
2016 as part of the executive branch agency 2017 Savings Plan. The 2017 Savings
Plan required certain State agencies to submit across the board decreases, similar to
the fiscal controls Roanoke has instituted in the past. The withdrawal of pay increases
to state - responsible local employees will have a minimal impact for the City of
Roanoke. The impact the 2017 Agency Savings Plan will have on the City of Roanoke is
not yet known.
At the state level, results for the first quarter of fiscal year 2017 indicated September
was a significant month for revenue collections. Estimated payments from individuals
and corporations were all due in September, along with regular monthly collections in
withholding, sales taxes, and other sources.
Total general fund revenue collections fell 2.4% in September. Collections of
withholding, corporate and recordation taxes exceeded expectations, while sales tax
receipts declined. On a fiscal year -to -date basis, total revenue collections rose 3.6 % in
September, ahead of the annual forecast of 1.7% growth.
Economic expansion should continue, albeit at a slower pace than expected. This is
reflected by the Federal Reserve's announcement that is it maintaining the federal
funds target rate at the range of 0.25% to 0.50 %.
Closing
City management will continue to monitor revenues closely especially given the current
downward trend in other local taxes. The Revenue team will convene to analyze the
data to better understand drivers behind the trend. If this revenue trend continues,
expenditures will be controlled to end the year with a balanced budget. This financial
report contains results for the first quarter. Going forward, financial reports will be
issued monthly to ensure Council is apprised of financial results in a timely manner.

Honorable Mayor and Members of City Council,
On behalf of the Market Building Foundation Board of Directors, I am pleased to present the annual report
of the City Market Building. You will find outlined below a summary of accomplishments and challenges
for the future.
Accomplishments in the prior calendar year include:
• Total sales from the City Market Building tenants in calendar year 2015 totaled approximately
$2.6 million.
• Total local tax revenue directly related to the Market Building totaled $186,500.
• Rental income from Charter Hall for calendar year 2016 is expected to total approximately
$107,000.
• The boiler system has been replaced. This mitigates on -going maintenance issues and will result
in energy efficiency.
As outlined in the 2015 Annual Report, multiple tenant leases expired during the current year. There have
been several renewals, with two open tenant spaces at this time. The current tenant occupancy rate is
82 %. It is expected that the occupancy rate will return to 100% in the near future.
Because of the central role the Market Building plays as the anchor of the Market District, capital
maintenance is an important long -term focus of the Foundation for this city -owned building. To get a
better understanding of the capital expenditures likely to be needed in the future, the Foundation
commissioned a capital reserve study in 2016. The study identified capital maintenance items that will
require funding above and beyond the standard operating expenses. Capital maintenance items on the
short-term horizon include the replacement of the chiller, repair /replacement to individual air
conditioning units in tenant spaces, and repair or maintenance to interior and exterior surfaces of this
historic building.
Overall, the Market Building continues to be a vibrant retail hub within the Market District. Restaurants
in the building are enjoying brisk business during lunch hours and those with outward facing dining rooms
have become more successful due to the enclosed patio spaces created in partnership with the
Foundation. Charter Hall is an active venue hosting receptions, business meetings, and other special
events. In the coming year, our organization is committed to increasing the usage of the common areas
for community events and welcoming the public for our unique food offerings and first class event facility.

On August 15, 2016, City Council authorized the scheduling of a public hearing for Monday, September
19, 2016, at 7:00 p.m., or at such time as the matter may be reached, or at such other date and time as the
City Manager may determine, to consider granting, confirming, and/or amending easements and other
property rights granted to South Commonwealth Partners, LLC (Developer) in connection with the
development and operation of the Hampton Inn & Suites Hotel at 27 Church Avenue, S.E. (adjacent to the
Market Garage at 25 Church Avenue, SE.). The public hearing was scheduled by the City Manager for
Monday, October 17, 2016, at 7:00 p.m., or such later time as the matter may be reached. Council
conducted the public hearing and granted the requested easements.
During the public hearing, I informed Council that the parties discovered that an easement which the
parties assumed had been granted to AEP for electric service for the Hotel should have been granted to
Developer. I advised Council that we intended to present this matter at a subsequent public hearing.
The new easement is a 10' wide easement containing approximately 1,118 sq feet of land, to bring electric
service to the Hotel. The proposed easement will encumber portions of City -owned property situated at 25
Church Avenue, S.E. (Official Tax Map No. 4015004) and 106 Franklin Road, S.E. (Official Tax Map No.
4015003).
Based on the foregoing, the request is that Council ratify its authorization that a public hearing may be held
in this matter for Monday, November 21, 2016, at 7:00 p.m., or at such time as the matter may be reached,
or at such later date and time as the City Manager may determine. Under state code, this matter must be
advertised once a week for two consecutive weeks and the first ad appears in The Roanoke Times today,
November 7, 2016.
Action Requested:
Ratify and confirm that Council's authorization of a public hearing with regard to granting, confirming,
and /or amending easements and other property rights to South Commonwealth Partners, LLC in connection

The City pools at Fallon and Washington Parks were opened for approximately
10 weeks this past summer season from June 3rd through August 14". The

period. The Washington Park pool was open on Monday, Tuesday and
Thursday for the season, and was operated and open to the public additionally
on Friday, Saturday, and Sunday under an agreement with the YMCA.
Attendance at the pools for this season and in comparison to past seasons is
outlined on the attached spreadsheet. Public swimming comprised
approximately 77% of the overall attendance at the Fallon Park Pool, but only
34% of overall attendance at the Washington Park Pool. Operating
expenditures are outlined in the attachment. Revenues related to the pool
operations are outlined as well, and when calculated, result in an overall net
operating cost of approximately $80,000 over the ten week period for the
combined pool operations. The operating expense figures exclude any
annual /seasonal maintenance costs of preparing pools for operation.

Under the Influence (DUI) Task Force Grant (CM16- 00157)
Background
The City of Roanoke, County of Roanoke, and City of Salem have been awarded
a 2017 Virginia DMV grant to start a multi - jurisdictional DUI Task Force. The
purpose of this task force is to deploy additional officers throughout the
Roanoke Valley for the purpose of deterring, detecting and apprehending
intoxicated and impaired drivers.
Each agency was granted an individual grant award. The first year of this grant
will be used for salary and fringe benefits for two (2) Roanoke police officers in
addition to the City's currently authorized compliment, purchasing equipment
and acquiring vehicles.
Virginia DMV intends to award several additional grants to support ongoing
salary and fringe benefit costs. Virginia DMV will pay for all employee expenses
including overtime.
The conditions of this grant are that all task force vehicles must be identical
beyond electronic equipment and agency specific markings. The City of
Roanoke will be responsible for an in -kind match of fuel and maintenance on
the vehicles. There is no funding match requirement.
Considerations:
To comply with the 2017 grant, the City will hire two (2) additional officers to
maintain the City's current compliment of officers and comply with fuel and
maintenance requirements of the grant. The net staffing impact of
participation with the DUI Taskforce will be an increase of two (2) grant funded
positions.
Recommended Action:
Accept the 2017 Virginia DMV DUI Taskforce grant described above and
authorize the City Manager to execute the grant agreement and any related
documents; all such documents to be approved as to form by the City Attorney.
Adopt the accompanying budget ordinance to establish a revenue estimate in
the amount of $310,254 and appropriate funding in the same amounts into
accounts to be established by the Director of Finance in the Grant Fund.

Background
The Virginia Department of Emergency Management (VDEM) is the distributing
agency for State Homeland Security Program (SHSP) grant funding from the U. S.
Department of Homeland Security (DHS) Federal Emergency Management
Agency (FEMA). The purpose of the SHSP is to award grants to states to assist
state and local governments in support of the implementation of Homeland
Security Strategies to address the identified planning, organization, equipment,
training, and exercise needs to prevent, protect against, mitigate, respond to,
and recover from acts of terrorism and other catastrophic events.
On October 17, 2016, VDEM awarded the City of Roanoke $25,000 through its
FY 2016 SHSP grant program. The SHSP grant funding will allow the Roanoke
Police Department to purchase communications equipment for its tactical
response team. The communications equipment will protect officers by
upgrading current communications capabilities. There is no local funding
match required for this grant.
Recommended Action:
Accept the State Homeland Security FY16 grant described above and authorize

The United States Department of Justice: Office of Justice Programs has

the FY 16 Body -Worn Camera Policy and Implementation Program:

The City of Roanoke will be required to match this grant award with a
corresponding cash match of $90,000.
The Roanoke Police Department will use the award to develop, update, expand
and support its existing body worn camera program. This grant will pay for
approximately 120 police body cameras and accessories, support equipment,
server space, and conference costs.

requires that the Roanoke Police Department continue its community outreach,

for the Elmwood Art Walk (CM16- 00158)
Background:
The Roanoke Arts Commission (RAC) proposed, and City Council approved its
FY 2017 work plan on September 19, 2016. One of the elements of that work
plan was to purchase Descending Night by Jack Howard Potter, a sculpture in
the Elwood Art Walk temporary show "The Natural City ". Descending Night was
one of the top vote recipients in the People's Choice balloting held after the
installation of all ten works in May 2015. The other works will be picked up by
the artists this month and the RAC will issue a call to artists for nine new
sculptures to be placed in Elmwood in May 2017. The RAC desires to keep one
piece from the inaugural show and deemed Descending Night as most suitable
due to its low maintenance materials, workmanship and high polling. It will
remain in its current location. In order to purchase the piece at the cost of
$18,000 the Arts Commission secured a donation for half of that amount from
Downtown Roanoke Inc. (DRI).
Considerations:
The gift from DRI will be for $9,000. Pursuant to City Code Section 2 -263, when
the value of a gift, grant, devise or bequest is more than five thousand dollars
($5,000), acceptance shall be by ordinance or resolution of the City Council.
Recommended Action:
Accept the $9,000 donation from Downtown Roanoke Inc. to purchase
Descending Night.

the City in the total amount of $353,000 for Highway Safety Improvement Program funds for FYI 7

BE IT RESOLVED by the Council of the City of Roanoke as follows:
The City of Roanoke hereby accepts the VDOT award in the total amount of$353,000
for the highway Safety Improvement Program for FY17, for two (2) separate projects, with no
required local match from the City, which projects enhance safety for motorists, bicyclists and
pedestrians, all as more fully set forth in the City Council Agenda Report dated November 7, 2016,
2. City Council hereby authorizes the City Manager to execute any documents necessary
to receive such award, with Stich documents to be approved as to farm by the City Attorney.
3, The City Manager is hereby authorized to take such further actions and execute such
further documents as may be necessary to obtain, accept, implement, administer, and use such funds
in the total amount of 5353,000 from VDOT, for the above mentioned projects, with any such

Subject: Acceptance of FYI Virginia Department of Transportation
(VDOT) Highway Safety Improvement Program -
Authorization for Signal Improvement and Appropriation of Funds
(CM 16- 00150)
Background:
The Federal Highway Safety Improvement Program (HSIP) is a federally funded
program aimed at reducing fatal and serious injury crashes on roadway
segments and intersections. This Program is funded with 90% Federal funding
and 10% State funding. No local match is required. The Transportation Division
submitted proposals to VDOT and has been awarded funding for two separate
projects. The first will upgrade traffic signals to include a Flashing Yellow Arrow
at five signalized intersections. The proposed project is expected to reduce
rear -end and left -turn crashes at the following locations:

These projects will be administered directly by the City of Roanoke Traffic
Engineering staff, with an estimated completion cost of approximately $88,000.
The second project will reconstruct the traffic signal at the Orange Avenue /
Hollins Road intersection. The proposed project will upgrade the existing span
wire to mast arm poles as well as replace the signal equipment. This project will
be administered directly by VDOT and the estimated completion cost is
approximately $265,000.
Considerations
While no local funding is required for the Flashing Yellow Arrow upgrade
project, the City will administer all phases of this project. VDOT will approve
locality actions at various stages of project implementation and will reimburse
the City upon completion of different phases.
VDOT will administer the project for the traffic signal reconstruction. No local
funding is required.
Recommended Action:
Accept funding for the two projects in the amount of $88,000 for the Flashing
Yellow Arrows and $265,000 for the traffic signal reconstruction at Orange
Avenue and Hollins Road.
Adopt the accompanying budget ordinance to establish a revenue estimate in
the amount of $88,000 and appropriate the same into a new capital account to
be established by the Director of Finance.
Authorize the City Manager to execute, on behalf of the City of Roanoke, all
necessary agreements required in conjunction with the project; such
agreements to be approved as to form by the City Attorney.

Background:

Background:
The VDOT Revenue Sharing Program is again available to cities for FY 2018.
This program provides additional funding for use by the City to construct or
improve its infrastructure systems. The maximum amount made available to
localities is $10 million for FY 2018. These funds are matching funds on a 50%
State / 50 %City basis.
Considerations:
For the FY 2018 application, the City will request $10 million from VDOT, which
will require a City match of $10 million. Staff identified seven projects for
which to request VDOT revenue sharing program funds. These projects are
1. 10'" Street Improvements (New Construction) - $720,000. City match will be
provided by using $720,000 from the FY 2018 capital project funds for
Street Improvements through the planned issuance of bonds.
2. Citywide Storm Drain Improvements - $2,930,000. City match funding will
be provided by using $2,000,000 from the FY 2018 capital project funds for
the Neighborhood Storm Drain Program through the planned issuance of
bonds and $930,000 from Stormwater Utility.
3. Tinker Creek Greenway Improvements from Orange Avenue to Mason Mill
Road - $2,100,000. City match will be provided by using $2,100,000 from
the FY 2018 capital project funds for Parks and Recreation Master Plan -
Greenways and Trails (New Construction) through the planned issuance of
bonds.
4. Citywide Streetscape Improvements - $500,000. City match funding will be
provided by using $500,000 from the FY 2018 capital project funds for
Streetscape Projects (New Construction) through the planned issuance of
bonds.
S. Roanoke River Greenway Bridge the Gap - $1,500,000. City match will be
provided by using $1,500,000 from capital project funds to be identified
during the capital project planning process.
6. Citywide Curb, Gutter, and Sidewalk (New Construction) - $1,500,000. City
match funding will be provided by using $1,500,000 from the FY 2018
capital project funds for Curb, Gutter, and Sidewalk (New Construction)
through the planned issuance of bonds.
7. Colonial Avenue Improvements - $750,000. City match funding will be
provided by using $750,000 from funding previously appropriated to the
project account.
Recommended Action:
Authorize the City Manager to submit an application to VDOT, approved as to
form by the City Attorney, for VDOT's Revenue Sharing Program requesting $10
million for the above - listed projects.
Authorize the City Manager to take such further actions and execute such
documents, approved as to form by the City Attorney, as necessary to submit

community improvement activities, and environmental mitigation. These funds
require a 20% local fund match.
The City is proposing improvements to pedestrian infrastructure along the west
side of Business 220 / Franklin Road, from the 3100 block to the 3700 block, a
distance of approximately 4,000 feet. Improvements will include sidewalk
construction, improved pedestrian crosswalks and pedestrian signals, and
additional drainage improvements as warranted by sidewalk construction. The
total project is estimated to cost $1,416,313.
Considerations:
The FYI TA application will request $250,000 for improving pedestrian signals
at crosswalks which includes the required 20% local fund match of $50,000 to
be provided from the City's Capital Reserves. The additional funds needed for
the project will be obtained through applications for Smart Scale, Highway
Safety Program and other grant funds.
Recommended Action:
Authorize the City Manager to submit an application to VDOT for VDOT's FYI
Transportation Alternatives program requesting $250,000 for the above listed
project.
Authorize the City Manager to take such further actions and execute such
documents, approved as to form by the City Attorney, as necessary to submit
the above applications and to furnish such additional information and /or
documents as may be required for such application.

Subject: Acquisition of Real Property Rights for Oakland
Boulevard /Sunrise Avenue Stormwater Drainage Improvements
Project (CM16- 00153)
Background:
As part of the FY 2017 Capital Improvement Program, City Council
appropriated $1.62 million for storm drain improvement projects. These
appropriated funds will be matched with $1.61 million in Virginia Department
of Transportation Revenue Sharing funds plus an additional $1,000,000 in
Stormwater Utility operating funds.
One of the projects to be funded by this combined FY 2017 funding
appropriation is the Oakland Boulevard /Sunrise Avenue Stormwater Drainage
Improvements project which includes the installation of storm drain pipes and
structures, utilizing stormwater best management practices. This project is in
the general vicinity of the Roundhill Avenue, N.W. between Oakland Blvd., N.W.
and Huntington Blvd., N.W., 2800 block of Oakland Blvd., and the intersection
of Oakland Blvd., and Sunrise Avenue within the Roundhill neighborhood.
This neighborhood suffers from an inadequate drainage system at intersection
of Oakland Blvd., N.W. and Sunrise Avenue, N.W. and lacks storm drain systems
in some areas evidenced by flooding on private properties along the 2800 and
2900 blocks of Oakland Blvd., N.W. Runoff from the public right of way
contributes to flooding of private properties. Constructing the proposed storm
drain system for this project would correct known drainage problems in this
neighborhood and improve water quality in the Tinker Creek watershed.
In order to construct, operate, and maintain the proposed improvements, the
city will need to acquire real property rights from various private property
owners.
Considerations:
City Council action is necessary to authorize the acquisition of real property
rights needed for the Oakland Boulevard /Sunrise Avenue Stormwater Drainage
Improvements Project. The real property rights needed are outlined below, but
are subject to minor variation of location and extent pending final engineering
design details.
Funding for acquisition of the real property rights will be available in project
account 03 -530 -3014 Stormwater Improvements.
Permanent drainage and temporary construction easements of variable length
and width are required to accommodate construction activities and will affect
nine (9) properties in the general vicinity identified above. The City may also
need to acquire various other property rights involving the properties listed
below and other properties which have not yet been identified for this project.
