The City Council meeting was reconvened at 12:03 p.m., with Mayor Lea presiding
and all members of the Council in attendance, with the exception of Council

A communication from Mayor Sherman P. Lea, Sr., requesting that Council convene in
a Closed Meeting to discuss vacancies on certain authorities, boards, commissions and
committees appointed by Council, pursuant to Section 2.2 -3711 (A)(1), Code of Virginia
(1950), as amended. A list of current vacancies is included with the agenda for this
meeting.

a Closed Meeting to discuss the 2017 Citizen of the Year Award, pursuant to Section
2.2 -3711 (A)(10), Code of Virginia (1950), as amended.

Meeting to discuss the disposition of approximately .3607 acres of City -owned property
located at 120 Church Avenue, S. E., where discussion in an open meeting would

arrived late.
Mayor Lea called for a Moment of Silence in memory of Thomas Cain who
passed away on June 29, 2017 and was memorialized on Saturday,
September 23, 2017 at Loudon Avenue Christian Church, who tirelessly
with the Roanoke community organizations and City officials to create
partnerships that would assist in creating healthy communities.
The Invocation was delivered by The Reverend Keith S. Wagner, Minister,
Roanoke Church of Christ.
At this point, Council Member Dykstra entered the meeting
(2:03 p.m.)
The Pledge of Allegiance to the Flag of the United States of America was
led by Mayor Sherman P. Lea, Sr.

to delete Section 3 titled "notifications" as a result of the

5. Execution of an extension of the Regional Collision Reporting
Center Agreement and First Supplement among the City of

COMMENTS OF THE CITY MANAGER.
The City Manager commented on the following items:
• CitvWorks Wpo VII: This event starts today and sessions will be
held through October 7 in Grandin Village.
This is a national idea exchange and festival conference for
anyone who is passionate about the work of placemaking and
creating stronger communities.
As City Manager, I have been invited to participate in a O &A with
attendees.
• Star City Reads Fall Festival: Saturday, October 7, 11 a.m. to 3
p.m. at Goodwill Industries of the Valleys, 2502 Melrose Avenue
NW, Suite D
Event includes a Petting Zoo, Skechers Shoe giveaway, free
books for kids and other activities
In anticipation of this event, this week Roanoke Public Libraries
took delivery of 40.000 books from the First Book Foundation.
These books will be given to children who attend the festival.
• Melrose Avenue Revitalization: An open forum will be held
Monday, Oct. 9, at 6 p.m., at the Goodwill Campus on Melrose
Avenue
Residents, business owners, and other stakeholders in the city's
Melrose- Orange Target Area are invited to participate.
Staff from the Department of Planning, Building & Development
will showcase a neighborhood development concept plan.
We encourage those who live and work in the Melrose- Orange
Target area to come out and give us your input on this plan.
`SolSmart Bronze' Award: Roanoke recently received this
designation, which is funded by the U.S. Department of Energy
SunShot Initiative, indicating our city is leading the region in solar
best practices.
A SolSmart designation is a signal that the community is "open
for solar business," helping to attract solar industry investment
and generate economic development and local jobs.
Roanoke is one of two cities in Viroinia to receive this award (the
other is Charlottesville).
Kudos to our Sustainability staff for the work they have done to
put Roanoke in the spotlight for solar energy. We will be inviting
them to attend a future City Council meeting so that we can
formally recognize their efforts to earn this recognition.

ORDINANCES AND RESOLUTIONS:
a. A resolution reappointing Duke Baldridge as a Director of the Economic
Development Authority for a four -year term of office ending October 20,
2021.

b. A resolution reappointing Vickie Bibee as a Director of the Economic
Development Authority for a four -year term of office ending October 20,
2021.

C. Adopted Resolution No. 40977 - 100517 urging the Commonwealth of
Virginia to protect the vital interests of localities within the Roanoke
Valley affected by the construction, operation, and maintenance of
the Mountain Valley Pipeline project (MVP Project) by (i) preventing
any increase in baseline, or annual, sediment loading for the
Roanoke River or any of its tributaries as a result of the MVP Project;
and (ii) holding the developers, owners, and operators of the MVP
Project financially responsible and accountable to construct,
operate, and maintain water quality improvements necessary to
mitigate any increased sediment loading.

Allegheny Regional Commission meeting.
Roanoke Valley - Alleghany Regional Commission 48th Annual Dinner

Recognize localities that received various awards at the Annual
Virginia Municipal League Conference in Williamsburg, Virginia on

DRAFT
Objective: To regulate the use of streets, sidewalks, greenways, parks, and other public property in the City
for all organized outdoor special events, with the purpose of:
• protecting the health and public safety of citizens,
• limiting the inconvenience to residents, businesses, places of worship and learning, and other
regular users of these facilities,
• establishing a straightforward and accountable process for event organizers, and
• enabling public agencies to manage these events in a cost - effective and well- coordinated way.
Legislative basis: This policy is adopted pursuant to the authority granted the City Manager under Section
30 -107, Code of the City of Roanoke (1979), as amended. Terms not defined in this Policy shall have the
meaning ascribed to such terms as set forth in Sections 30 -101 through 30 -108, Code of the City of Roanoke
(1979), as amended.
1. Special Event Definitions:
For the purpose of this Policy, a Special Event, also known as a public assembly, is defined as any
cohesive group of people, animals or vehicles, or combination thereof, upon any sidewalk, street,
alley or other portion of the public right -of -way, or within a public park, or on any public
property which is outdoors in the City of Roanoke and which group does not comply with normal
vehicular or pedestrian traffic, regulations or controls, or normal usage of the sidewalk, street,
alley or other portion of the public right -of -way, or park or public property. Such group includes
any gathering, demonstration or march, procession, running race, walk, block party, bicycle race,
ceremony, show, exhibition, festival or similar event. Filmingin public spaces throughout the City is
also included in this policy. Special Event categories are set forth as follows:
A Races. Walks, and Parades: Organized non - stationary activity involving running, biking, walking,
marching, or other means of transportation, utilizing a fixed course that involves the use or
obstruction of City street rights -of -way, City sidewalks, City parks or greenways.
B. General Events: Organized activity that has a stationary footprint in an identifiable location for a
specific duration of time, often involving amplified sound, food, beverage, merchandise displays,
and /or other forms of entertainment. Examples include festivals, performances, rallies, markets,
parties, weddings, conventions and other similar events
C. Neighborhood Block Parties: Organized small -scale activity that closes a limited number of
blocks on a low traffic volume, residential street. These small -scale gatherings are initiated by and
are intended to attract only local residents who live on or in close proximity to the street being
closed. They are not intended for the general public.
D. Filming: Organized activity involving film and /or still photography production that requires the
use of a public right -of -way, City park, or other City property.

Use of City parks, greenways, and plazas is additionally subject to any existing policies and procedures
of the City Parks and Recreation Department, and applicable provisions of City Code.
2. Program Administration:
Special Events within the City require the issuance of a Public Assembly Permit through the Public Works
Department in accordance with Sections 30 -103 through Section 30 -107, Code of the City of Roanoke
(1979), as amended. Pursuant to Section 30- 103(8), Code of the City of Roanoke (1979), as amended, the
requirement of a permit Shall not apply to:
A public assembly of fewer than one hundred (100) people in a public park or on
public property which is not a public street, alley or sidewalk, and which does not
involve the placement of a booth, stage or other temporary structure either within
the public parks or on public property;
Apublic assembly consisting of five (5) or fewer people on a public sidewalk which
does not impede the ordinary Row of pedestrians on a sidewalk;
Afuneral procession;
Recreational activities, including jagging or walking;
The United States Army, Navy, Air Force, or Coast Guard, the military forces of the state,
and the police or fire department of the city.
Far Special Events occurring in whole or in part in a city park, city plaza, greenway, or on other public
property, the Parks and Recreation Department is the primary point of contact.
For Special Events occurring in the public right -of -way, the Public Works Department is the
primary point of contact. The Public Works and Parks and Recreation Departments provide the following
services to organizers and permit applicants of proposed Special Events: scheduling of events; assistance with
obtaining necessary permits; reserving needed public space for events; and providing technical assistance and
advice.
The Director of the Department of Public Works, or designee, is responsible for issuance of the public assembly
permits and enforcement of Sections 30 -101 through Section 30 -108, Code of the City of Roanoke (1979), as
amended. The Public Works Department facilitates the review of each special event for compliance with
this policy. Upon receipt of a complete Public Assembly Permit application, the Public Works Director, or
their designee, in consultation with a Special Events Review Panel, shall issue a permit or, if deemed
necessary, shall place conditions upon, reschedule, relocate, or deny any requested Special Event that
does not meet this Policy and the requirements of applicable City Code or cannot otherwise be held as
proposed.
A. Special Events Review Panel (SERP). The City will maintain a Special Events Review Panel (SERP)
for coordination, notification, and collaborative purposes that will include representatives from
the following groups: Public Works, Risk Management, Fire - Emergency Management Services,
Parks and Recreation, Zoning, Police, and any other agency or organization needed to coordinate
specific events. SEEP members will review the Public Assembly Permit Application and offer
recommendations for approval or denial. The Public Works Department will facilitate meetings of
the SEEP to hear feedback and suggestions regarding current and future Special Events.
B. Communication. City staff will collaborate to issue weekly email notifications of street closures
related to Special Events authorized by the City Department of Public Works. City staff will
maintain a website that allows community members to view a master Special Events calendar,
which will provide details with respect to each Special Event. City staff will also maintain a
feedback form that members of the community can access to provide comments regarding Special
Events and their impacts on the community generally and the specific area in which the Special
Event was held and presented.

3. Application and Permitting Process
The City will establish a Special Event application and a planning guide that will outline the process,
timelines, application materials, checklists, notification requirements and additional information
necessary for event organizers to apply for an assembly permit. The goal of this Application Policy and
Procedure is to provide a predictable timeframe for approval and to enable agencies to anticipate the
impact of a Special Event and to plan accordingly.
A. Submittal Timeframe Special Event applications must be submitted according to the timelines for
each specific event type as outlined below, and will be accepted no more than one (1) year prior to
the proposed date of the Special Event. Submission of an application does not guarantee the issuance
of an assembly permit. Applications cannot be fully reviewed and approved until all required
Special Event information (e.g. projected attendance, Certificate of Insurance, site map, Emergency
Action Plan) has been received.
1. Races Walks and Parades. Applications must be received at least 120 calendar days prior
to the proposed date of the event. Processing and approving a race, parade, or walk route is
a complex process that requires coordination with numerous city departments and /or
other entities.
ii. General Events Applications for general events with less than 100 persons in attendance must
be received at least 30 calendar days prior to the proposed date of the event Applications for
general events with more than 100 persons in attendance or general events involving street
closures must be received at least 60 calendar days prior to the proposed date of the event.
Applications for all general events in Elmwood Park must be received at least 90 calendar days
prior to the proposed date of the event
iii. Neihborhooit Block Parties. Applications for neighborhood block parties must be received
at least 14 calendar days prior to the proposed date of the event. It is recommended that
organizers apply at least 45 calendar days prior to the event date if the block party might
utilize tents, amusement structures, fireworks, etc. as these devices involve special
permitting.
iv. Filming. Applications for filming must be received at least 14 calendar days prior to the
shoot date. It is recommended that applications for extensive filming spanning multiple
days or locations be submitted at least 30 calendar days in advance.
V. Late Applications: Pursuant to Section 30 -103 (c), Code of the City of Roanoke (1979), as
amended, the Public Works Director, or their designee, may consider late applications.
The City cannot guarantee that any event application will be reviewed if it is submitted in
less than the number of days prescribed above.
B. Fees for Damage or Loss of Property. The organizer and applicant of the Special Event shall be
responsible for producing the permit upon request of any City official throughout the duration of
the event. The City reserves the right to bill event organizers and applicants after the Special Event
for reimbursement of any extraordinary costs for such things as trash pickup, or repair of damage to
streets, sidewalks, structures, or other public property, caused by or directly related to the event. All
bills must be paid within 30 days of receipt. The organizers and applicants for any Special Event shall
indemnify and hold the City harmless from any and all claims, causes of actions, suits, and damages related
to the Special Event
C. Security Deposit For special events occurring within a City park, plaza, or greenway, the City Parks
and Recreation Department shall be consulted to determine applicable security deposits and rental fees.
For certain special events occurring in whole or in part within the public right-of-way or on public
property that is not a City park, plaza, or greenway, a refundable security deposit is required. The
security deposit must be paid no later than 21 (twenty -one) calendar days prior to the start of the Special
Event. The City reserves the right to revoke a Public Assembly Permit for non - payment of a required

security deposit. Cancellation of an event less than 72 hours before the scheduled start of the Special
Event will result in forfeiture of the security deposit. Deposits will be returned in full provided that the
event site is left in clean condition with no damage reported and all City property (e.g. barricades, traffic
cones, signs) delivered for the event is returned in good working order. Failure to comply with the
requirements of the Public Assembly Permit will result in loss of deposit, liability for repair and/or
additional clean -up fees as determined by the City, as well as potential denial of future applications.

D. Reservation of dates. Dates for Special Events will be reserved on the Special Event calendar based
on a first -come, first- served basis, and are subject to restrictions noted in this Policy and under
applicable provisions of City Code. Recurring Special Events will be given first priority to reserve
the same day of the same week of the following calendar year (e.g. the second Saturday of
February) or to reserve the same exact date of the following calendar year (e.g. February 14th).
Conflicts that arise due to these two different reservation methods (e.g. February 14th falls on the
second Saturday of February) will be handled by the Public Works Department, in consultation
with the Parks and Recreation Department, on a case -by -case basis. Determining first priority for
date reservation between conflicting Special Events will he at the discretion of the Director of
Public Works or designee. All recurring annual Special Events will need to receive a satisfactory
post event evaluation (see section 3.E) to retain first priority rights. Once an event organizer
receives their evaluation, they will have 30 calendar days to submit a letter of intent stating their
desire to hold the event with the same date and location the followingyear. This letter reserves the
date and location only and is not to be construed as an approval for the event. An official application
will still need to be submitted by the corresponding deadline (see Section 3.A).
E. Post- Special Event Evaluation Form. The Special Events Review Panel will utilize a Post- Special
Event Evaluation Form that will measure the success of event organizers in conforming to all
policies and permitted activities. This evaluation will help organizers of Special Events improve
events from year to year, identify issues which adversely impact public agencies, and provide the
approving agencies with a means to prioritize the reservation of dates in the approval process as
noted above. Special Events with an unsatisfactory evaluation risk losing the To eferred date, having
additional fees imposed, or the denial of permits for future events.
F. Notification Policy. The organizer and the applicant for an assembly permit for a Special Event shall be
responsible for notifying as soon as possible all businesses and residences which adjoin any right of way
which will be barricaded as a result of the Special Event in accordance with the terms and conditions of the
Public Assembly Permit issued for the Special Event
G. Appeal Procedure.
a. In some cases, permit applications may be denied. Reasons for denial may include, but are
not limited to, undue disruption to either pedestrian or vehicular traffic, undue
interference with movement of public safety equipment, undue interference with the
ability to provide public safety services, or interference with another permitted assembly.
It. Should an application be denied, the applicant may appeal the decision within ten (10)

business days of the date notice is given to the applicant by submitting a written notice of
appeal through the City Clerk to the City Manager. Additional detail may be found in
Section 30 -105, Code of the City of Roanoke (1979), as amended. All appeals shall be
subject to these procedures.
H. Applicability of City Code. All Special Events are subject to all applicable provisions of City Code
and all applicable rules, regulations, and policies adopted or enacted by the City Manager,
including, without limitation, revocation of a public assembly permit as set forth in Section 30-
106, Code of the City of Roanoke (1979), as amended.
4. Limitation on Special Events within the City:
The City of Roanoke is committed to supporting Special Events, recognizing the societal benefits,
enhanced quality of life, and economic development such events can generate. The City also recognizes
the need to balance the beneficial aspects of Special Events with public budget and staff constraints
and the interests of community members who are regular users of public streets, sidewalks, parks, and
greenways and are adversely impacted by their closure. Therefore, the following restrictions shall be
considered by the approving agencies in the reservation process.
A. Races Walks and Parades.
i. Overall limitation on annual events. To ensure public safety, the overall number of races,
walks, or parades that involve street, sidewalk and /or greenway closings within the City in
any calendar year may be limited according to the City's ability to provide the necessary
support personnel.
H. Limitation is sing the same or similar routes. Events using the same or similar
routes, including the same general geographic area, particularly involving heavily used
thoroughfares, should not be scheduled on the same day, subsequent days, or on
subsequent weekends within the year. Events that request use of certain high- impact areas
are subject to additional limitations as determined at the discretion of the Special Events
Review Panel. Though this section does not apply to street festivals, block parties, etc., the
SERE will consider the impact of such events when scheduling races and parades and may
require alternate dates or routes if a proposed event falls on the same or a subsequent
weekend to any other special event.
iii. Limitation o b of events on any given weekend. No more than 2 (two) race, walk
or parade events covered under this section shall be scheduled in any one weekend. No
more than 1 (one) of these events can be a major event that either involves a run or walk
of 10 kilometers or more in distance or the closure of the event route for more than 3
hours.
Limitation on use of public greenways. Events, both City produced and external, will be
limited to two (2) per month per greenway. Requests for additional events will be
considered on a case -by -case basis and will be at the discretion of the Parks and
Recreation Director. External events will be limited to registered charitable non -profit
organizations. Prior to planning an event which utilizes a public greenway, event
organizers shall consult the Parks and Recreation Department to determine availability,
restrictions and fees which may apply to the planned event.
iv. Standard Race Routes. A list of standard routes and venues for new race events is
contained in the City of Roanoke "Special Event Planning Guide ".
B. General Events, Neighborhood Block Parties, d Filming
i. Overall limitation on events. While there is no cap on the number of general events,
neighborhood block parties, or film production, the Special Events Review Panel has the

discretion to disallow any event if it will create an undue burden on a particular
geographic area or the City as a whole.
C. Event Priority.
1. Events Produced by the C' . Events produced by the City of Roanoke have priority use of
any public property or right -of -way. Other applications for special events are processed
in order of receipt and subject to the requirements in section 3.
ii. Annual Events. Applicants who held an event the previous year and achieved a
satisfactory post -event evaluation have priority for the same time and location the
following year, subject to future compliance with section 3.D.
in. Downtown Roanoke Events. The following items shall be considered by the Special
Events Review Panel when reviewing applications for Special Events in the Downtown
District:
a. Positive and negative impacts to commerce at the Historic Roanoke City Market.
b. Positive and negative impacts to other businesses, merchants, schools, and places
of worship.
c. Impacts to pedestrian and vehicular traffic flow and public transportation,
particularly during regular weekday business hours.
d. Ability of the City to provide necessary public safety and support personnel.
e. Suitability of the chosen venue for the size and scope of the proposed Special
Event.
5. Annual Policy Review:
Each year City staff, in conjunction with the SERE, will review the Special Event Policy. Revisions may
be made based on the prior years' experience and with the input of stakeholders.

aware, Virginia Code § 58.1 -3376 authorizes the Board to employ clerical and other

Subject: FEMA Assistance To Firefighters Grant Acceptance
Background:
Roanoke Fire -EMS has been awarded funding from the 2016 Assistance to
Firefighters Grant Program in the amount of $1 million. This grant funding will
be used to purchase new Self Contained Breathing Apparatus (SCBA) airpacks
and accessories for City firefighters. The Fire Department's current SCBA
equipment will expire in 2018 so it is necessary to replace this equipment.
This grant does require a match from the City of Roanoke totaling $308,958
which will be provided through capital project funds.
Considerations:
City Council action is needed to formally accept and appropriate these funds,
and authorize the Director of Finance to establish revenue estimates and
appropriations to purchase the equipment and supplies in accordance with
provisions of this grant and to establish matching funds totaling $308,958.
Recommended Action:
Accept the 2016 Assistance to Firefighters Grant Program as described above
and authorize the City Manager to execute the grant agreement and any related
documents. All documents shall be approved as to form by the City Attorney.
Adopt the accompanying budget ordinance to establish a revenue estimate in
the Grant fund for $1 million. The match, totaling $308,958, will be provided
from capital project finds. Appropriate total funding in the amount of
$1,000,000 into accounts to be established by the Director of Finance in the
Grant Fund.

The purpose of the Assistance to Firefighters Program is to protect the health and safety of the public and
firefighting personnel against fire and fire - related hazards.

I. Assurances, Administrative Requirements and Cost Principles
Recipients of DHS federal financial assistance must complete OMB Standard Form
4246 Assurances - Non- Construction Programs. Certain assurances in this document
may not be applicable to your program, and the awarding agency may require
applicants to certify additional assurances. Please contact the program awarding
office if you have any questions.
The administrative requirements and cost principles that apply to DHS award
recipients originate from:
2 C.F.R. Part 200, Uniform Administrative Requirement, Cost Principles, and Audit
Requirements for Federal Awards, as adopted by DHS at 2 C.F.R. Part 3002,
II. Acknowledgement of Federal Funding from DHS
All recipients must acknowledge their use of federal funding when issuing statements,
press releases, requests for proposals, bid invitations, and other documents describing
projects or programs funded in whole or in part with Federal funds.
III. Activities Conducted Abroad
All recipients must ensure that project activities carried on outside the United States are
coordinated as necessary with appropriate government authorities and that appropriate

licenses, permits, or approvals are obtained.
IV. Age Discrimination Act of 1975
All recipients must comply with the requirements of the Age Discrimination Act of 1975
(42 U.S:C:. g. 61011 e1,), which prohibits discrimination on the basis of age in any
program or activity receiving Federal financial assistance.
V. Americans with Disabilities Act of 1990
All recipients must comply with the requirements of Titles I, II, and III of the Americans
with Disabilities Act, which prohibits recipients from discriminating on the basis of
disability in the operation of public entities, public and private transportation systems,
places of public accommodation, and certain testing entities (42 U. S.C."12101- 12213).
VI. Best Practices for Collection and Use of Personally identifiable Information (Pill
All recipients who collect Pit are required to have a publically- available privacy policy
that describes what PII they collect, how they use the PH, whether they share Pit with
third parties, and how individuals may have their PII corrected where appropriate.
Award recipients may also find as a useful resource the DHS Privacy Impact
Assessments: Privacy Guidance and Privacy template respectively.
VII. Title VI of the Civil Rights Act of 1964
All recipients must comply with the requirements of Title VI of the Civil Rights Act of 1964
(42 U.S.C. 6 2000d et sgq.), which provides that no person in the United States will, on the
grounds of race, color, or national origin, be excluded from participation in, be denied the
benefits of, or be subjected to discrimination under any program or activity receiving
Federal financial assistance. Implementing regulations for the Act are found at 6 C.FR.
Part 21 and 44 C.F.R. Part 7,
VIII. Civil Rights Act of 1968
All recipients must comply with Title VIII of the Civil Rights Act of 1968, which prohibits
recipients from discriminating in the sale, rental, financing, and advertising of dwellings, or
in the provision of services in connection therewith, on the basis of race, color, national
origin, religion, disability, familial status, and sex (42 t1S.C. 113601 et sea.), as
implemented by the Department of Housing and Urban Development at 24 C.F.R. Part 100.
The prohibition on disability discrimination includes the requirement that new multifamily
housing with four or more dwelling units -i.e., the public and common use areas and
individual apartment units (all units in buildings with elevators and ground -floor units in
buildings without elevators) -be designed and constructed with certain accessible features
(see 24 C. F S 100 201).
IX. Copyright
All recipients must affix the applicable copyright notices of 17 U.S.C' &§ 401 or 402 and an
acknowledgement of Government sponsorship (including award number) to any work first
produced under Federal financial assistance awards, unless the work includes any
information that is otherwise controlled by the Government (e.g., classified information or
other information subject to national security or export control laws or regulations).
X. Debarment and Suspension
All recipients must comply with Executive Orders 12549 and 12689, which provide
protection against waste, fraud and abuse by debarring or suspending those persons
deemed irresponsible in their dealings with the Federal government.

XI. Drug -Free Workplace Regulations
All recipients must comply with the Drug -Free Workplace Act of 1988 (41 U.S.C. 6 701 et
seg.), which requires that all organizations receiving grants from any Federal agency
agree to maintain a drug -free workplace. DHS has adopted the Act's implementing
regulations at 2 C,F._R Part 3001.
XII. Duplication of Benefits
Any cost allocable to a particular Federal award provided for in 2 C.F R. Part 200 Subpart
E may not be charged to other Federal awards to overcome fund deficiencies, to avoid
restrictions imposed by Federal statutes, regulations, or terms and conditions of the
Federal awards, or for other reasons. However, this prohibition would not preclude the
non - Federal entity from shifting costs that are allowable under two or more Federal
awards in accordance with existing Federal statutes, regulations, or the terms and
conditions of the Federal awards.
XIII. Energy Policy and Conservation Act
All recipients must comply with the requirements of 42 U. S,C, § 6201 which contain policies
relating to energy efficiency that are defined in the state energy conservation plan issues
in compliance with this Act.
XIV. Reporting Subawards and Executive Compensation
a. Reporting of first -tier subawards.
1. Applicability. Unless you are exempt as provided in paragraph d. of this award
term, you must report each action that obligates $25,000 or more in Federal funds
that does not include Recovery funds (as defined in section 1512(a)(2) of the
American Recovery and Reinvestment Act of 2009, Pub. L. 111 -5) for a subaward
to an entity (see definitions in paragraph e. of this award term).
2. Where and when to report.
i. You must report each obligating action described in paragraph a.1. of
this award term to http.//wwwfsrs.gov.
ii. For subaward information, report no later than the end of the month
following the month in which the obligation was made. (For example, if the
obligation was made on November 7, 2010, the obligation must be
reported by no later than December 31, 2010.)
3. What to report. You must report the information about each obligating action

v. A Federal agency, but only as a subrecipient under an award or

2. Executive means officers, managing partners, or any other employees in
management positions.
3. Subaward.
i. This term means a legal instrument to provide support for the
performance of any portion of the substantive project or program for
which you received this award and that you as the recipient award to an
eligible subrecipient.
ii. The term does not include your procurement of property and services

needed to carry out the projector program (for further explanation, see
Sec. .210 of the attachment to OMB Circular A -133, "Audits of States,

iii. A subaward may be provided through any legal agreement, including an
agreement that you or a subrecipient considers a contract.
4. Subrecipient means an entity that:
i. Receives a subaward from you (the recipient) under this award; and
ii. Is accountable to you for the use of the Federal funds provided by the
subaward.
5. Total compensation means the cash and noncash dollar value earned by the
executive during the recipient's or subrecipient's preceding fiscal year and includes
the following (for more information see 17 CFR 229.402(c)(2)):
i. Salary and bonus.
ii. Awards of stock, stock options, and stock appreciation rights. Use the
dollar amount recognized for financial statement reporting purposes with
respect to the fiscal year in accordance with the Statement of Financial
Accounting Standards No. 123 (Revised 2004) (FAS 123R), Shared
Based Payments.
iii. Earnings for services under non - equity incentive plans. This does not
include group life, health, hospitalization or medical reimbursement plans
that do not discriminate in favor of executives, and are available generally
to all salaried employees.
iv. Change in pension value. This is the change in present value of defined
benefit and actuarial pension plans.
v. Above - market earnings on deferred compensation which is not
tax - qualified.
vi. Other compensation, if the aggregate value of all such other
compensation (e.g. severance, termination payments, value of life
insurance paid on behalf of the employee, perquisites or property) for the
executive exceeds $10,000.
XV. False Claims Act and Program Fraud Civil Remedies
All recipients must comply with the requirements of 31 U. S.0 63729 which set forth that no
recipient of federal payments shall submit a false claim for payment. See also 38 U. S. C..§
3801 -3812 which details the administrative remedies for false claims and statements
made.
XVI. Federal Debt Status
All recipients are required to be non - delinquent in their repayment of any Federal debt.
Examples of relevant debt include delinquent payroll and other taxes, audit disallowances,
and benefit overpayments. See OMB Circular. A -129 and form SF -4248, item number 17
for additional information and guidance.

XVI I. Fly America Act of 1974
All recipients must comply with Preference for U.S. Flag Air Carriers: (air carriers holding
certificates under 49 U S C 8 41102) for international air transportation of people and
property to the extent that such service is available, in accordance with the International
Air Transportation Fair Competitive Practices Act of 1974 (49 U.S.C. ?40118) and the
interpretative guidelines issued by the Comptroller General of the United States in the
March 31, 1981, amendment. to Comptroller General Decision B- 138942.
XVIII. Hotel and Motel Fire Safety Act of 1990
In accordance with Section 6 of the Hotel and Motel Fire Safety Act of 1990, 15 U.S.C.
2& 225a all recipients must ensure that all conference, meeting, convention, or training
space funded in whole or in part with Federal funds complies with the fire prevention and
control guidelines of the Federal Fire Prevention and Control Act of 1974, as amended,
15 U.S.C. §2225.
XIX. Limited English Proficiency (Civil Rights AM of 1964. Title VII
All recipients must comply with the Title VI of the Civil Rights Act of 1964 (Title VI)
prohibition against discrimination on the basis of national origin, which requires that
recipients of federal financial assistance take reasonable steps to provide meaningful
access to persons with limited English proficiency (LEP) to their programs and services.
Providing meaningful access for persons with LEP may entail providing language
assistance services, including oral interpretation and written translation. In order to
facilitate compliance with Title VI, recipients are encouraged to consider the need for
language services for LEP persons served or encountered in developing program
budgets. Executive Order 13166, Improving Access to Services for Persons with Limited
English Proficiency (August 11, 2000), requires federal agencies to issue guidance to
recipients, assisting such organizations and entities in understanding their language
access obligations. DHS published the required recipient guidance in April 2011, DHS
Guidance to Federal Financial Assistance Recipients Regarding Title VI Prohibition
Against National Origin Discrimination Affecting Limited English Proficient Persons, 76
Fed. Reg. 21755- 21768, (April 18, 2011). The Guidance provides helpful information
such as how a recipient can determine the extent of its obligation to provide language
services; selecting language services; and elements of an effective plan on language
assistance for LEP persons. For additional assistance and information regarding
language access obligations, please refer to the DHS Recipient Guidance

XX. Lobbving Prohibitions
All recipients must comply with 31 U.S.C.. §1352, which provides that none of the funds
provided under an award may be expended by the recipient to pay any person to
influence, or attempt to influence an officer or employee of any agency, a Member of
Congress, an officer or employee of Congress, or an employee of a Member of
Congress in connection with any Federal action concerning the award or renewal.
XXI. Non - supplanting Requirement
All recipients who receive awards made under programs that prohibit supplanting by law
must ensure that Federal funds do not replace (supplant) funds that have been budgeted
for the same purpose through non - Federal sources. Where federal statues for a
particular program prohibits supplanting, applicants or recipients may be required to
demonstrate and document that a reduction in non - Federal resources occurred for
reasons other than the receipt of expected receipt of Federal funds.

XXII. Patents and Intellectual Property Rights
Unless otherwise provided by law, recipients are subject to the Bavh -Dole Act Pub. L No
96_517, as amended, and codified in 35 U.S.C. g 200 of seq. All recipients are subject to
the specific requirements governing the development, reporting, and disposition of rights
to inventions and patents resulting from financial assistance awards are in 37 C.F.R. Part
401 and the standard patent rights clause in 37 C.F.R. § 401.14.
XXIII. Procurement of Recovered Materials
All recipients must comply with section 6002 of the Solid Waste Disposal Act, as amended
by the Resource Conservation and Recovery Act. The requirements of Section 6002
include procuring only items designated in guidelines of the Environmental Protection
Agency (EPA) at 40 C.F.R. Part 247 that contain the highest percentage of recovered
materials practicable, consistent with maintaining a satisfactory level of competition,
where the purchase price of the item exceeds $10,000 or the value of the quantity
acquired by the preceding fiscal year exceeded $10,000; procuring solid waste
management services in a manner that maximizes energy and resource recovery; and
establishing an affirmative procurement program for procurement of recovered materials
identified in the EPA guidelines.
XXIV. Contract Provisions for Non - federal Entity Contracts under Federal Awards
a.Corltracts for more than the simplified acquisition threshold set at $150.000.
All recipients who have contracts exceeding the acquisition threshold
currently set at $150,000, which is the inflation adjusted amount determined
by Civilian Agency Acquisition Council and the Defense Acquisition
Regulation Council as authorized by 41 CS.C. §1908, must address
administrative, contractual, or legal remedies in instance where contractors
violate or breach contract terms and provide for such sanctions and penalties
as appropriate.
b.Contracts in excess of $10.000.
All recipients that have contracts exceeding $10,000 must
address termination for cause and for convenience by the
non - Federal entity including the manner by which it will be
effected and the basis for settlement.
XW.. SAFECOM
All recipients who receive awards made under programs that provide
emergency communication equipment and its related activities must comply
with the SAFECOM Guidance for Emergency Communication Grants,
including provisions on technical standards that ensure and enhance
interoperable communications.
XXVI. Terrorist Financing E.O. 13224
All recipients must comply with US,_Executive Order 13224 and U.S. law that
prohibit transactions with, and the provisions of resources and support to,
individuals and organizations associated with terrorism. It is the legal

XXVII. Title IX of the Education Amendments of 1972 (Eaual O000rtunity in
Education Act)
All recipients must comply with the requirements of Title IX of the Education
Amendments of 1972 (20 U.S.C. 111681 et se n.), which provides that no
person in the United States will, on the basis of sex, be excluded from
participation in, be denied the benefits of, or be subjected to discrimination
under any educational program or activity receiving Federal financial
assistance. Implementing regulations are codified at 6 C.F.R. Part 17 and 44
CF R. Part 19
XXVIII. Trafficking Victims Protection Act of 2000
All recipients must comply with the requirements of the government-wide
award term which implements Section 106(g) of the Trafficking Victims
Protection Act (TVPA) of 2000, as amended (22 U.S.C. 117104). This is
implemented in accordance with OMB Interim Final Guidance, Federal
Register, Volume 72, No. 218, November 13, 2007. Full text of the award
term is located at 2 CFR § 175.15.
XXIX. Rehabilitation Act of 1973
All recipients of must comply with the requirements of Section 504 of the
Rehabilitation Act of 1973, 29 U.S.C. 6 794, as amended, which provides that
no otherwise qualified handicapped individual in the United States will, solely
by reason of the handicap, be excluded from participation in, be denied the
benefits of, or be subjected to discrimination under any program or activity
receiving Federal financial assistance. These requirements pertain to the
provision of benefits or services as well as to employment.
XXX. USA Patriot Act of 2001
All recipients must comply wth requirements of the Uniting and
Strengthening America by Providing Appropriate Tools Required to Intercept
and Obstruct Terrorism Act (USA PATRIOT Act), which amends 18 U.S.C. §§
175 -175c. Among other things, the USA PATRIOT Act prescribes criminal
penalties for possession of any biological agent, toxin, or delivery system of
a type or in a quantity that is not reasonably justified by a prophylactic,
protective, bona fide research, or other peaceful purpose.
XXXI. Use of DHS Seal. Logo and Flags
All recipients must obtain Di approval prior to using the DHS seal(s),
logos, crests or reproductions of flags or likenesses of DHS agency
officials, including use of the United States Coast Guard seal, logo, crests or

XXXIII. DHS Specific Acknowledgements and Assurances
All recipients must acknowledge and agree -and require any sub - recipients,
contractors, successors, transferees, and assignees acknowledge and
agree -to comply with applicable provisions governing DHS access to

XXXV. Animal Welfare Act of 1966
All recipients of financial assistance will comply with the requirements of the
Animal Welfare Act, as amended (7 U.S.C. §2131 at seq.), which requires
that minimum standards of care and treatment be provided for vertebrate
animals bred for commercial sale, used in research, transported
commercially, or exhibited to the public. Recipients must establish
appropriate policies and procedures for the humane care and use of animals
based on the Guide for the Care and Use of Laboratory Animals and comply
with the Public Health Service Policy and Government Principles Regarding
the Care and Use of Animals.
XXXVI. Protection of Human Subjects
All recipients of financial assistance will comply with the requirements of the
Federal regulations at 45 CFR Part 46, which requires that recipients comply
with applicable provisions /law for the protection of human subjects for
purposes of research. Recipients must also comply with the requirements in
DHS Management Directive 026 -04, Protection of Human Subjects, prior to
implementing any work with human subjects. For purposes of 45 CFR Part
46, research means a systematic investigation, including research,
development, testing, and evaluation, designed to develop or contribute to
general knowledge. Activities that meet this definition constitute research for
purposes of this policy, whether or not they are conducted or supported
under a program that is considered research for other purposes. The
regulations specify additional protections for research involving human
fetuses, pregnant women, and neonates (Subpart B); prisoners (Subpart C);
and children (Subpart D). The use of autopsy materials is governed by
applicable State and local law and is not directly regulated by 45 CFR Part
46.
XXXVII. Incorporation by Reference of Notice of Funding Opportunity
The Notice of Funding Opportunity for this program is hereby incorporated
into your award agreement by reference. By accepting this award, the
recipient agrees that all allocations and use of funds under this grant will be in
accordance with the requirements contained in the Notice of Funding
Opportunity.
XXXVIII. Acceptance of Post Award Changes
In the event FEMA determines that charges are necessary to the award
document after an award has been made, including changes to period of
performance or terms and conditions, recipients will be notified of the
changes in writing. Once notification has been made, any subsequent request
for funds will indicate recipient acceptance of the changes to the award. If you

Subject: State and National Register Historic District Nomination of the
Belmont Area
Background:
The Virginia Department of Historic Resources (VHDR) awarded a $12,500 grant
to the City to prepare a nomination of the Belmont neighborhood for inclusion
on the Virginia Landmarks Register and the National Register Historic Places.
The grant requires a $12,500 match from the City .
In 2015, a partial survey of the historic resources within the Belmont area was
conducted. Certified Local Government ( "CLG ") matching grant funds were used
for the project but were not sufficient to complete it. The next step is to
complete the survey, prepare the nomination, and submit it to VDHR for
consideration.
Considerations
Owners of properties in the State and the National Register Historic Districts are
eligible to take advantage of federal and state tax credits for improvements
made to rehabilitate their properties. Listing is therefore an important tool for
revitalization.
Designation as a state and national register historic district does not mean that
local historic district regulations will apply to the neighborhood. Much of the
neighborhood is already covered by the Neighborhood Design District Overlay
and has been since 2005. No application of the City's H -2 Historic
Neighborhood Overlay is planned.
Historic survey and nomination work requires the expertise of a consultant with
highly - specialized knowledge and skills to document the architectural character
of structures and prepare the nomination form.
Recommended Action:
Accept the awarded $12,500 CLG grant from the Virginia Department of
Historic Resources to enable the City to hire consultant to assist the Planning,
Building and Development Department staff in the nomination process of the
Belmont Area to be listed in the State and the National Register Historic
Districts.
Adopt the accompanying budget ordinance to appropriate matching funds of
$12,500 from 35- 300 - 9700 -5415 into expenditure accounts to be established
in the Grant Fund by the Director of Finance.

Subject: Fiscal Year 2017 Revenue and Expense Reclassifications
Background
Annually, City Council adopts a fiscal budget identifying anticipated revenues
and expenditures. Periodically throughout the year, adjustments are made to
both revenues and expenditures to recognize unanticipated budgetary
activities.
Staff is currently working to close out Fiscal Year 2017 and has identified
revenues and expenditures which need reclassification.
Considerations:
City Council action is required to revise FY2016 -2017 estimates for certain
revenues and to increase appropriations. Recognition of revenues from grants,
donations, cost sharing and shared cost activities impacting the General Fund,
Capital Projects Fund, and the Grant Fund is needed. Appropriation of
expenditures impacting the General Fund, Capital Projects Fund, and the Grant
Fund related to administrative expenditures and program and project costs is
also necessary.
Recommended Action:
Adopt the accompanying budget ordinance to reclassify and to more clearly
identify the respective revenues and appropriations.

Subject: Amendment to Extraterritorial Arrest Agreement
Background:
The City of Roanoke, County of Roanoke, City of Salem, and Town of Vinton last
updated the current extraterritorial arrest agreement in April of 2013. The
purpose of the last amendment was to expand the extraterritorial arrest
agreement to include the City of Salem and the Town of Vinton. The
extraterritorial arrest agreement allows officers of participating jurisdictions to
enforce any violation of state law in the participating jurisdictions.
The current extraterritorial arrest agreement requires that arrest notifications
take place via the Roanoke Area Criminal Justice Information Network (RACJIN).
Beginning in January of 2015, the City of Roanoke, County of Roanoke, City of
Salem, and Town of Vinton ceased using RACJIN and began utilizing the State-
wide Law Enforcement Information Exchange (LINX).
Considerations:
As a result of participation in the LINX system and the discontinuance of the
RACJIN system, the requirement for notifications is no longer needed. The
requested amendment of the existing agreement will delete Section 3
"Notifications." All other provisions of the existing agreement will remain
unchanged.
The amendment to the Extraterritorial Arrest Agreement was approved by the
Roanoke County Board of Supervisors on July 25, 2017 and was executed by the
Roanoke County Administrator on July 26, 2017.
Recommended Action:
Amend and enact the Extraterritorial Arrest Agreement described above and
authorize the City Manager to execute the amendment and any related
documents, all such documents to be approved as to form by the City Attorney.

AMENDMENT TO EXTRATERRITORIAL ARREST AGREEMENT
THIS AMENDMENT, made and entered into this day of , 2017, by
and between the CITY OF ROANOKE, VIRGINIA, a municipal corporation of the
Commonwealth of Virginia, hereinafter referred to as "Roanoke," the COUNTY OF
ROANOKE, VIRGINIA, a political subdivision of the Commonwealth of Virginia,
hereinafter referred to as "County," the TOWN OF VINTON, a municipal corporation of
the Commonwealth of Virginia, hereinafter referred to as "Vinton," and the CITY OF
SALEM, VIRGINIA, a municipal corporation of the Commonwealth of Virginia, hereinafter
referred to as "Salem."
WHEREAS, the City of Roanoke, Virginia, County of Roanoke, Virginia, Town of
Vinton, Virginia and City of Salem, Virginia entered into an Extraterritorial Arrest
Agreement dated April 18, 2013; and
NOW THEREFORE, in consideration oftheforegoing and othergood and valuable
consideration, the parties agree as follows:
Paragraph 3 of the original Extraterritorial Arrest Agreement is deleted in its
entirety; and the entirety of the Amended Agreement is set forth below.
WITNESSETH
WHEREAS, officers of the Town of Vinton, County of Roanoke, and the cities of
Roanoke and Salem police departments have occasion during the course of their
employment as town, county, and city police officers to be on duty outside the corporate
boundaries of the political subdivision which employees them; and
WHEREAS, it is the intent of Roanoke, Salem, Vinton, and the County to bestow
extraterritorial arrest powers upon such officers who, while on duty outside the corporate
boundaries of the political subdivision which employees them, observe certain offenses
committed in their presence, without the creation of any additional liability for the political
subdivision where the arrest occurs or its officers and employees; and
WHEREAS, Section 15.2 -1736 of the 1950 Code of Virginia, as amended,
provides that the governing bodies of localities may, by proper ordinances or resolutions,

enter in and become a party to contracts or mutual aid agreements for the use of their
joint forces, both regular and auxiliary, their equipment and materials to maintain peace
and good order.
NOW, THEREFORE, for and in consideration of the undertakings of the parties to
this Agreement, Roanoke, Salem and the County covenant and agree, each with the other
as follows:
1. Definitions -As used in this Agreement, the following words and phrases shall have
the meanings ascribed to them in this section.
Roanoke- Shall mean the City of Roanoke, Virginia.
Salem- Shall mean the City of Salem, Virginia.
County Shall mean the County of Roanoke, Virginia.
Town- Shall mean the Town of Vinton, Virginia.
Extraterritorial Arrest Power- Shall mean the right, power and authority of
an officer of the City of Roanoke, County of Roanoke, City of Salem, of
Town of Vinton police department while in Roanoke County, the City of
Roanoke, Salem, or Vinton to stop and effect arrests and otherwise enforce
the law with respect to any violation of a state law which an officer would be
required to act upon if working a regular tour of duty in their jurisdiction of
employment. This section does not apply to, or include officers working in
any off duty capacity, otherwise referred to as secondary police related
employment.
Office r- Shall mean any sworn officer of the respective police departments
of Roanoke, Salem, Vinton, and the County.
On Duty Shall mean working an assigned tour with the employment law
enforcement agency.
Off Du tv- Shall mean that period of time during which an employee would
not normally be scheduled or required to engage actively in the performance

of police duties. This section does not apply to, or include officers working
in and off duty, secondary police related employment.
State Code- Shall mean the (1950) Code of Virginia, as amended.
2. Extraterritorial Arrest Power- An officer in Roanoke, Salem, Vinton or the County
shall possess extraterritorial arrest power while on duty when any violation of state
law becomes known to the officer, or probable cause exists to effect an arrest. This
section is not inclusive of any individual city, county, or town codes which
reciprocal agreements do not cover.
Any officer effecting or attempting to effect an extraterritorial arrest under or
pursuant to this Agreement shall have the same rights, powers and authorities as
the officer would possess in making or attempting to make an arrest in the political
subdivision employing the officer under similar circumstances. Nothing in this
Agreement shall be construed as requiring an officer to effect an extraterritorial
arrest.
3. Responsibility of the Parties- Roanoke, Salem, Vinton, and the County agree that
to the extent permitted by applicable law, each party to this Agreement will be
responsible for the actions, inactions or violations of its officers, employees, and
agents in connection with any extraterritorial police activity contemplated under
this Agreement, but nothing contained herein shall be construed as a waiver of
the sovereign immunity of any locality.
4. Operational Policies- Any officer effecting an extraterritorial arrest shall comply
with the operational policies of his own department. Roanoke, Salem, Vinton, and
the County agree to hold their own officers, respectively, responsible and
accountable for compliance with operational policies of the employing department.
5. Cooperative Joint Operations- Pursuant to this Agreement, a law enforcement
officer from any of the participating localities who has the rank of lieutenant or

higher may coordinate with a law enforcement officer of another participating
locality of the rank of lieutenant or higher to coordinate a joint law enforcement
operation that they believe will serve to better protect the health, safety and welfare
of the citizens of their respective locality and the Roanoke Valley.
6. No Effect on Existing Powers -This Agreement shall not supersede, restrict, limit
or otherwise impair or affect extraterritorial arrest powers already existing pursuant
to § 15.2 -1724. Police and other officers may be sent beyond territorial limits; §
15.2 -1727. Reciprocal agreements with localities outside the Commonwealth; §
15.2 -1728. Mutual aid agreements between police departments and federal
authorities; § 15.2 -1729. Agreements for enforcement of state and county laws by
federal officers on federal property; § 15.2 -1730. Calling upon law- enforcement
officers of counties, cities or towns for assistance; § 19.2 -77. Escape, flight and
pursuit; arrest anywhere in Commonwealth; § 19.2 -249. Offenses committed on
boundary of two counties, two cities, or county and city, etc.; where prosecuted; §
19.2- 249.1. Offenses committed within towns situated in two or more counties;
where prosecuted; § 19.2 -250. How far jurisdiction of corporate authorities
extends; and other sections of the State Code or any authority or power existing
under the City of Roanoke Charter of 1952 or the City of Salem under the City of
Salem Charter.
7. Rights of Officers- While acting under or pursuant to this Agreement, any city
officer in the county, any town officer in the city or county, or any county officer in
the city shall have all the Immunities from liabilities and exemptions from laws,
ordinances and regulations and shall have all the pension, relief, disability,
Workers' Compensation and other benefits enjoyed by the officer while performing
his/her respective duties within the territorial limits of his /her political subdivision.
8. No Backup- This agreement shall not be construed as requiring any city officer to
act in the county or town, any town officer to act in the city or county, or any county
officer to act in the city or town upon request to supplement or replace routine
patrol or enforcement activities.

9. loss or Damage to Equipment- The localities shall have no liability for any
destruction, loss or damage of any motor vehicle, equipment or personal property
owned and operated by the other localities in the exercise of extraterritorial arrest
power under or pursuant to this agreement.
10.Immunities- This agreement shall not be construed to impair or affect any
sovereign or governmental Immunity or official immunity that may otherwise be
available to the localities, any officer, agent or employee of the localities.
11. Termination- Any parry to this agreement shall have the right to terminate this
agreement, with or without cause, by giving written notice to the chief
administrative officer of the other parties by certified mail, return receipt requested.
Any termination shall be effective 10 days after receipt of notice of termination.
12.Completeness of Agreement -This agreement represents the entire and integrated
agreement between Roanoke, Salem, Vinton, and the County and supersedes ail
prior negotiations, representations or agreements, either oral or written. This
agreement may be amended only by written instrument signed by authorized
representatives of Roanoke, Salem, Vinton, and the County.
13.Gender- Any word importing the masculine gender used in this agreement may
extend to and be applied to females as well as males
14. Effective Date- This agreement shall be effective immediately upon its execution
by ail of the parties hereto.

WHEREAS, in October of 1985 the County of Roanoke and the City of Roanoke
entered into an extraterritorial agreement which granted arrest powers to the County
Sheriffs deputies and the City's police officers for certain traffic related offenses; and
WHEREAS, in April of 1991 an amended extraterritorial agreement was executed
by the County and the City to reflect the establishment of the Roanoke County Police
Department and certain technical amendments to the Virginia Motor Vehicle Code; and
WHEREAS, in April of 2013 an amended extraterritorial agreement was executed
by the County of Roanoke, the City of Roanoke, the City of Salem and the Town of
Vinton expanding the arrest powers of officers in those jurisdictions to any violation of
state law and to extend that authority to off -duty officers, except those engaging in off -
duty secondary police related employment outside their normal jurisdictions, as a
concrete example of governmental cooperation; and
WHEREAS, in April 2013 the police departments in the Roanoke Valley were
using the Roanoke Area Criminal Justice Information Network ( RACJIN) system to
share information. The current extraterritorial arrest agreement references RACJIN and
requires a notification of extraterritorial arrests if that system is not used. RACJIN is no
longer being used as all of the participating agencies are participating in the State -wide
LINX system. Since that time, the regional information sharing system used by the

police departments has changed. As a result, the requirement for notifications is no
longer needed. The requested revision of the agreement will delete Section 3
"Notifications." All other provisions of the existing agreement will remain the same; and
WHEREAS, Section 15.2 -1736 of the 1950 Code of Virginia provides that the
governing bodies of localities may enter in and become a party to contracts or mutual
aid agreements for the use of their joint forces, both regular and auxiliary, their
equipment and materials to maintain peace and good order; and
WHEREAS, Section 15.2 -300 of the 1950 Code of Virginia provides for the joint
exercise of powers by political subdivisions of the Commonwealth of Virginia; and
WHEREAS, the first reading of this ordinance was held on June 27, 2017, and
the second reading was held on Tuesday, July 25, 2017.
NOW THEREFORE BE IT ORDAINED by the Board of Supervisors of Roanoke
County as follows:
That the County Administrator is hereby authorized, by and on behalf of
the County of Roanoke, to enter into and execute a Revision of the Extraterritorial

Background:
The City of Roanoke, County of Roanoke, and City of Salem entered into the
Roanoke Valley Regional Collision Reporting Center (RASS) agreement in April
2016. The purpose of the agreement was for RASS to facilitate collision
reporting in partnership with the police departments of the participating
jurisdictions. The initial term of the agreement was for an eighteen (18) month
pilot program and the RASS agreement is currently scheduled to terminate on
November 30, 2017.
The RASS agreement as previously adopted allows it to be extended to
November 30, 2021, unless sooner terminated or further extended. The RASS
agreement also provides that if such extension occurs, as of each five (5) year
anniversary date of November 30, 2021, the term of the agreement will
automatically be extended for two additional five (5) year terms beyond the
then existing date of termination, unless one or more of the participating
localities chooses to withdraw from the agreement.
In March of 2017, the County of Roanoke and RASS entered into an additional
memorandum of understanding, in which RASS agreed to provide Roanoke
County police officers with computer tablets to enable officers to upload
photographs of crash - scenes (where one or more vehicles was disabled) to
RASS's secure data management system.
Considerations:
Pursuant to Article III, Section 3 -1 of the RASS agreement, the agreement will be
extended to November 30, 2021. Thereafter, the agreement will automatically
be extended for two additional five (5) year terms beyond the then existing date
of termination, unless one or more of the participating localities chooses to
withdraw from the agreement.
The First Supplement to the RASS agreement will require RASS to provide
tablets to the Roanoke Police Department at no expense to the City of Roanoke.
The tablets will allow officers to take and upload photographs to RASS's
National Law Enforcement Telecommunications System secure facility. RASS
staff will thereafter attach all applicable on -scene photographs to the
appropriate collision report and the photographs will be securely stored in
RASS's propriety Collision Reporting & Occurrence Management System
( "CROMS "). Photographs submitted to RASS and entered into the CROMS system
will be shared with the Roanoke Police Department via CROMS. Photographs will
also be provided to insurers with the individual vehicle insurance claims
resulting from the collision; in accordance with the provisions of the Code of
Virginia Section 46.2 -380. The Roanoke Police Department will have access to
information and photographs in CROMS for at least thirty -six (36) months after
the termination of the Agreement. RASS will continue to have access and use
the information only as allowed by the Code of Virginia.
The First Supplement will also clarify that RASS, in the operation of the Collision
Reporting Center, will not provide towing or storage services to any third party
within the Roanoke Valley. During the term of the agreement, neither RASS, nor
any entity in which RASS has any interest, shall operate any automobile body
repair shop, automobile rental facility, or motor vehicle towing or storage
business within the Roanoke Valley (each, a "Restricted Business ") and shall
ensure that no director, officer or employee of RASS or any of its affiliated
companies operates or has any direct or indirect interest in or control over any
Restricted Business.
The participating jurisdictions and RASS further agree that all other terms and
conditions set forth in the original Agreement, not specifically amended and /or
modified by this First Supplement, shall remain in full force and effect; and that
the agreement and the First Supplement represent the entire agreement
between the parties.
Recommended Action:
Approve the extension of the First Supplement amending the Regional Collision
Reporting Center Agreement. Authorize the City Manager to execute the
agreement in a form substantially similar to that which is attached to this

THE ROANOKE VALLEY REGIONAL

This First Supplement to the Roanoke Valley Regional Collision Reporting Center
Agreement (hereinafter the "First Supplement ") is between the City of Roanoke, ( "Roanoke
City "); the County of Roanoke, ( "Roanoke County"); and the City of Salem, ( "Salem "), each of
which is a political subdivision or municipality of the Commonwealth of Virginia (the
"Participating Localities "), and Roanoke Accident Support Services Ltd., a corporation
organized under the laws of Virginia (`BASS ").
This amended agreement will become effective when all parties have signed it. The date
of this First Supplement will be the date that it is signed by the last party to sign it (as indicated
by the date associated with that party's signature).
The parties entered into the Roanoke Valley Regional Collision Reporting Center
Agreement (hereinafter the "Agreement ") in April 2016 for RASS to facilitate collision reporting
in partnership with the police departments of the Participating Localities. Pursuant to Article III,

necessary to mitigate any increased sediment loading.
WIIFREAS, the Roanoke River and its tributaries provide cotton recreational
opportunities to the Roanoke Valley that are an essential component in the expansion of the
regional economy, creation of thousands oh new jobs, and enhancement of the quality of life in
Virginia's Blue Ridge;
WHEREAS, the Upper Roanoke River and many of its tributaries have been listed on the
United States Fnvimmnental Protection Agency's 303(d) list as "impaired" for excessive
sediment loading, and the Virginia Department of Environmental Quality (DEQ) has created the
Upper Roanoke River Implementation Plan for remediation of water quality impairments
including excessive sediment loading;
WHEREAS, the Final Environmental Impact Statement (FEIS) prepared for the MVP
Project estimates the MVP Project will increase the baseline sediment load in the Upper Roanoke
River by at least 2 %, a conservative estimate given that the FEIS does not include a study of the
estimated sediment load increases resulting from project construction in areas located
downsnceun of the Jcflcison National Forest, even though the MV), Projcct construction area
plans indicate that the project will cross the Upper Roanoke River and its tributaries as many as
100 l0 110 limes hetween the City of Roanoke and the .Jefferson National Forest, potentially
liwling the Spring I tallow Drinking Water Reservoir and the river's traverse into and through the
City of Roanoke;
WIIERFAS, based upon the DEQ's Upper Roanoke River Implementation flan,
mitigating the estimated 2% base sediment load increase as a result of the MVP Project will cost
approximately 36 million dollars;
WIIEREAS, the Upper Roanoke River Implementation Plan estimates for constructing
Stormwater Best Management Practices to remediate existing impairments within the City of
Roanoke will exceed 100 million dollars, and as such, the City of Roanoke will not have
sufficient resources to construct additional Stormwater Best Management Practices to remediate
any new and anticipated impairments resulting from the MVP;
WHEREAS, Stormwater Best Management Practices (BMPs) currently listed in DEQ's
Clearinghouse are the only BMPs that can lawfully be applied to the MVP Project, yet those
BMPs were not designed, tested, or approved for the specific parameters and constraints of
extreme slope conditions inherent to mountainside pipeline construction;
WHEREAS, DEQ is developing a voluntary Memorandum of Agreement (MOA) for
local governments to ensure Erosion and Sediment as well as Stormwater Management
compliance with regular site visits and to review and comment on the construction plans and
details for the MVP Project;
WIligWAS, thorough review of the MVP PrnjcCl construction plans by the Cily of
Roanoke is vital to the City's ability to evaluate potential environmental impacts on the Roanoke
River watershed within City limits;
WHEREAS, the risk of pipeline exposure after installation due to potential insh'etm
erosion as well as using riprap to repair stream banks in lice of woody and herbaceous vegetated
riparian buffers are both pronounced environmental coil axns that need to be addressed; and
WHEREAS, the Commonwealth of Virginia most ensure that the vital interests of all
localities within the Roanoke Valley are protected liom increased sediment load in the Roanoke
River and its tributaries that will occur Font the development, construction, operation, and
maintenance of the MVP Project.
NOW, THEREFORE, be it resolved by the Council of the City of Roanoke, Virginia that:
City Council urges the Commonwealth of Virginia, through the General
Assembly and the Office of the Governor, to impose significant safeguards on the MVP Project
to eliminate any increase in baseline sediment loads for the Roanoke River and its tributaries
from the development, construction, operation, and maintenance of the MVP Project.
2. City Council urges the Commonwealth of Virginia, through the General
Assembly mud the Office of the Governor, to establish standards of financial responsibility and
accountability for the developers, owners, and operators of the MVP Project, including adequate
bonding or other security to cover the anticipated costs to mitigate any increases in sediment
loads in the Roanoke River or any of its tributaries as a result of the construction, operation, and
maintenance of the MVP Project.
3. City Council urges the Commonwealth of Virginia, through DEQ, to require the
developers, owners, and operators of the MVP Project to supplement the current proposed
S toIin wa t el Rest Management Practices with additionally engineered Stormwater Best
Management Practices that demonstrate, through additional modeling, a zero increase in baseline
seelimcnl loads during and aRa construction of the MVP Project,
4. City Council urges the Commonwealth of Virginia, through DEQ, to perform
comprehensive stream water quality monitoring before, doing, and alter construction of the
MVP Project and continue downstream water quality monitoring of erosion and sediment control
devices during construction of the MVP Project and Stormwater Best Management Practice
discharges aficr construction of the MVP Project.
5, City Council directs the City Clerk to provide attested copies of this Resolution to
the Governor of the Commonwealth of Virginia, the President of the Virginia Senate, The

A RESOLUTION urging the President of the United States and the United Slates Congress
to continue the federal Historic Tax Credit program.
WHEREAS, the current federal Historic Tax Credit program (FITC) was established by
Congress and President Ronald Reagan as a critical catalyst in attracting capital for historic
rehabilitation projects that help stimulate local economies;
WHEREAS, since its inception, private investments supported by the HTC have created
over 2.4 million jobs, rehabilitated more than 42,000 buildings, and revitalized downtowns
throughout the United States;
WHEREAS, recognizing the importance of this successful federal economic development
program, the Commonwealth of Virginia and more than 30 other states have enacted
complementary state historic tax credit programs to help revitalize the commercial downtowns of
their communities;
WHEREAS, over the life of this program, the HTC has generated $29.5 billion in federal
tax revenues compared to $25.2 billion in credits allocated —more than paying for itself; and
WHEREAS, the federal HTC program, in conjunction with Virginia's Historic
Rehabilitation Tax Credit program, has been utilized by the City, in collaboration with private
developers to encourage creative and innovative reuse of historic stiuctures within the City, and
such development has produced tangible, significant, and lasting economic benefits which have
preserved the historic character of our neighborhoods and revitalized our business districts.
NOW THEREFORE be it resolved by the Council of the City of Roanoke, Virginia that:
City Council urges the President of the United States and the United States
Congress to continue the federal Historic Tax Credit program as a critical economic development
tool for states and localities throughout the United States.

REGIONAL LEADERS SURVEY SUMMARY
The Roanoke Valley Allegheny Regional Commission (RVARC) has contracted with the South East Regional
Directors Institute (SERDI) to conduct a strategic assessment of the commission to assist in enhance the
role and support of RVARC in the region and to its member local governments. Doe of the tools being used
by SERDI to gather information for the assessment was to conduct an online regional leaders survey.
Participants in the survey were RVARC Board members, local government officials, and other regional
partners. Their responses follow..

COMMISSION WHAT COMES TO MIND?
• I am afraid I do not understand this question. I am very familiar with RVARC and
have served as a commissioner for over twenty years. So the commission comes
to mind when I hear it referenced.
• Transportation planning.
• Regional cooperation.
• Cooperation and collaboration across jurisdictions.
• Planning and grant assistance to local communities; and, taking a position on
issues that impact the area.
• Regional Planning.
• Staff that works there. Potential funding, support, projects.
• Regional Partnership.
• A group of very dedicated residents who put their ideas and energy together to
make this a better Valley in which to live, work, and play.
• Interregional cooperation on transportation, economic, and quality of life
initiatives.
WHAT DO YOU THINK IS THE ROLE/PURPOSE FOR THE RVARC?
• The Regional Commission serves two primary purposes. To serve as a regional
forum for communication and action among the participating localities in a variety
of areas affecting community planning, economic development, use and
management of resources, etc. The second purpose is to support the functions of
and serve as the Transportion Planning Organization for the metropolitan area
for purposes of state and federal transportation planning and funding allocations.
• MPO management, workforce development, quality of life enhancement, grants
management for local governments.
• Promote engagement among localities in the region.
• To promote regional collaboration and project development of mutual interest.
• Regional Planning & Resource Coordination.
• To assist local governmental cooperation and state and local cooperation
addressing regional based problems /issues of greater than area significance.

I know that it is a conduit for federal transportation funding, manages workforce
development efforts, coordinates regional planning efforts and manages some
grants for local government. Also it provides programs for alternative
transportation.
• Valuable research and analysis for member local governments.
• Learning more every day since serving on its Board.
• Serves as one of Virginia's Planning District Commissions, initiated by Virginia
State Statute to provide regional transportation planning; serve as a
demographics clearing house; provide local government planning & community
development assistance (i.e. planning, grants, etc.).
• That they include grant application assistance, management services for
implementation of programs, mapping services, transportation planning.
• Commissioner for past 5 years.
• Sustainability, transportation, economic development, broadband.
• They bring local government and citizen organizations together to draft long term
strategies for development of the region.
• I know they strive to be responsive to the partner counties beyond their state
mandated goals.

RVARC does an excellent job of providing resources and ideas for regional

governments that do not have dedicated staff in those areas of planning and
grant writing.

• The RVARC already has different jurisdictional representation in its function as
the RVARC and as the TPO. The RVARC has long been an advocate for and a
participant in dialogue among contiguous regional organizations, such as Region
2000 to the East and the New River Planning District to the South and West. We
also enjoy the joint membership of Franklin County with the Western Piedmont
PDC. As the greater region realizes the importance and enjoys the success of
broader regional efforts and opportunities, it will be a challenge for the RVARC to
serve as the vital connector among these groups and regions. We already
cooperate with the Economic Development Partnerships in our area and in these
other regions, but identifying the roles and maintaining the resources needed to
effectively guide and manage these larger regional efforts will be a challenge.

Professionals.
• Economic Development and clear vision of strategies and goals.
• Infrastructure improvements, specifically transportation issues at the state level
(i.e. HB2 /Smart Scale procedures) and holistic broadband improvement for the
entire region.

Feds, and support for finding other public and private funding for collaborative

• In assisting the TPO with its function of allocating available RSTP funds as a
TMA, I still sense some tension among the RVARC staff and the staff of the
localities and local organizations, which needs to be addressed. I am not sure
how this should be done but it is a concern to me.
• Have it less dominated by Roanoke City issues.
• Add more staff.
• More affective communication to local governing bodies to relay mission and
goals.
• Completion, accountability, and presentation of annual work program
deliverables to the local governing bodies.

Nothing ... they ALL do a great job.
• Larger focus on overall ED thru job creation /retention, company attraction, Higher
education and job training, tourism promotion. Local ED Departments, and
organizations like VBR and the RRP would appreciate the help and resources of
the RVARC. All of the aforementioned are done by various other PDC's around
VA.
• Monthly visit to the Alleghany Highlands.
• Not settling for the status quo - look for innovative and new ways to get things
done, and being tenacious to build support and make it happen.
• Maybe rotate the meetings and have the area counties host them once per year?
