INTRODUCTION AND CONSIDERATION OF ORDINANCES AND RESOLUTIONS: Council Member Ferris submitted a written report of the City Council Legislative Committee recommending adoption of the Proposed 2018 City of Roanoke Legislative Program. Adopted Resolution No. 41000 - 110617 adopting and endorsing a Legislative Program for the City to be presented to the City's delegation to the 2018 Session of the General Assembly; and authorizing the City's legislative liaison to advocate the positions of the City with respect to matters presented during the 2018 Session of the General Assembly. Annual City Neighborhoods' Harvesting of the Fruits' Potluck Dinner and Awards Celebration on Friday, November 10 at the Jefferson Center in Fitzpatrick Hall at 6:00 p.m. A Massed Band Concert commemorating the Vietnam War 501" Anniversary was held on Sunday, November 4, 2017 at the Salem Civic Center in Salem, Virginia. Hosted by the Roanoke Valley Vietnam War 50th Anniversary Committee, the event will be free to the public and feature performances of popular songs from the 1960 -70s from each of the high school bands in Roanoke, Roanoke County and Salem, as well as patriotic selections performed by a massed band under the direction of Maestro David Stewart Wiley. In commemoration of the Vietnam War 50`h Anniversary, a social event will be held at 7:00 p.m. on November 17, 2017, at the Vinton War Memorial in Vinton, Virginia, to honor Vietnam Veterans, their families, and partners who have supported the 501h Anniversary commemorative events. Veterans of the Vietnam War are those who served in the U.S. military between November 1, 1955 and April 30, 1975. The event will include light hors d'oeuvres, beverages, and music. The Summer Reading Program also includes the participation of the RCPS+ program attendees of Roanoke City Public Schools. Total participation in the Summer Reading Program rose by over 14% as compared to 2016. Participation in the program increased at all the library branches this past summer, with some participatory increases due to the closure of the Williamson Road Branch for its renovation /addition. In addition, overall attendance at events over the Summer increased by over 7% as compared to 2016. As illustrated on the attached, since the Program's inception in 2005, participation and attendance in the Program has steadily increased year over year. You will find outlined below a summary of accomplishments and challenges for the future. Accomplishments in the prior calendar year include: • Sales from the City Market Building tenants in calendar year 2016 totaled approximately $3 million. A 14% increase over the previous calendar year. • Tax revenue directly related to the Market Building totaled $210,000. • Rental income from Charter Hall for calendar year 2017 is expected to total approximately $80,000 and 2018 is on track to exceed that figure with $36,000 already booked. The few vacant tenant spaces from 2016 have been filled and the Market Building has returned to 100% occupancy. Our new restaurants provide greater food diversity in downtown Roanoke and we are proud to have several female and minority owned businesses. Over the past year the Foundation has worked with many non - profit organizations and community groups to host meetings, fundraisers, and other important community events in the common areas. This increased activity has driven a surge in foot traffic for the building resulting in increased sales for tenants and better citizen awareness of the building's offerings. As the anchor of the city's booming Market District, we are always conscious of the need for a clean and well maintained space. In our 2016 capital reserve study we identified several items that will require funding above and beyond operating expenses. Chief among the short-term maintenance items is replacing the chiller. A design study has been drafted and the project should be completed in the spring of 2018. The Market Building is thriving with new food, activity, and a clean and well maintained space. The Foundation Board of Directors would like to thank City Council for the financial support of the Market Building. The request was sent to all states participating in the national interstate mutual aid agreement. The EMAC request enables those states not impacted by severe weather events to share resources with those areas where resources have been exhausted during times of disaster. EMAC acts as a complement to the federal disaster response system, providing timely and cost - effective relief to preserve life, the economy, and the environment. A team from Roanoke Fire -EMS was deployed to Texas and incurred expenses in the amount of $60,239. In doing so, she had a survey of the Property completed by Balzer and Associates, Inc. Upon completion and review of the survey, it became apparent portions of a deck and a fence on the Property encroach into an adjacent unimproved public alley. The public alley is approximately 20 feet wide. The area of the unimproved public alley that is encumbered by the fence and deck is approximately 1,118 square feet. RL'rmmh Fnyineving COWOW Alllud rn l No 5.(116. 1]) 2 CITY COUNCIL AGENDA REPORT To: Honorable Mayor and Members of City Council Meeting: November 6, 2017 Subject: Amendment No. 5 to Contract with Crouch Engineering, Inc. for Additional Architectural & Engineering (A /E) Design and Construction Phase Services for Roanoke River "Bridge the Gap" Greenway Background: The City entered into a Contract with Crouch Engineering, Inc. dated December 5, 2014, in the amount of $599,511, to provide design, railroad coordination, and construction administration services for the Roanoke River "Bridge the Gap" Greenway, from Bridge Street to Aerial Way Drive. Amendment Nos. 1 thru 4 have been executed, all providing additional funding for design services needed to continue moving the project forward. Total contract amount to date is $832,158. Amendment No. 5 is needed to complete construction services for the current contract underway, Segment 1, and provide services for the final phase of construction, Segment 2. The consultant's costs to support the City during construction on Segment 1 have exceeded initial estimates. Additional hours were expended responding to requests for information, review of shop drawings, and coordination with the Virginia Department of Transportation (VDOT), and Norfolk Southern (NS). During construction, unexpected subsurface conditions were encountered during drilling operations for bridge support piers which required additional shaft analysis by the designer and design modifications to the current contract. Additionally, the City and its consultant are still in the process of receiving design approval for modification to a NS bridge. The bridge modification is needed for the greenway alignment to transverse underneath. Considerations: As the designer of record, the City desires to have Crouch Engineering, Inc. continue to provide services for the project. Crouch Engineering, Inc. has submitted a proposal to complete the services required for the project for an additional fee of $182.943. In addition to the above fee, other project expenses connected with the project design may involve encountering other unexpected conditions similar to those in the past that may necessitate Crouch Engineering, Inc. providing services over and above those referenced above. Therefore, future amendments may be needed to the Contract with Crouch Engineering, Inc. to perform additional services as the project develops. However, the total of such other amendments is not expected to exceed an additional $36,588 over and above the previously mentioned $182,943 for total Contract Amendments not to exceed $219,531. Funding is available in the project account 08- 620 -9201, Roanoke River Greenway - Bridge the Gap. Tdnkle Re: Report of City Council Legislative Committee Recommendation to Adopt Proposed 2018 City of Roanoke Legislative Program Mayor Lea and Members of Council_ The City Council Legislative Committee proposes to you its recommendation that City Council adopt the 2018 Legislative Program, a copy of which proposal is attached. The proposed 2018 Legislative Program proposes several positions regarding major policies that will be considered by the General Assembly during its 2018 session. These policy statements include fiscal issues (state budget, state support, and local revenues), technology and infrastructure (broadband and expansion of interstate highways within the Roanoke Valley), environment (stonnwatei and sediment control, regulation of plastic bags), economic development (maintenance of tax incentive programs, elimination of further restrictions on localities), and education (full funding and establishing school opening date by school districts). The program also endorses the 2018 VML Legislative Program The proposed 2018 Legislative Program also establishes three (3) local priorities for the 2018 session: Authorization to allow localities to adopt ordinances limiting smoking in outdoor public places; Authorization to use third party collection services for certain fees and taxes due localities; and allowing school districts to establish the school start date. The Legislative Committee approached the development of the proposed 2018 Legislation Program with the benefit of the critique provided by our legislative delegation during the discussions on the City's 2017 Legislative Program. Our delegation urged the City to create a cohesive, concise, and focused program. The Legislative Committee believes that this proposal achieves this objective. The legislative Committee recommends that City Council adopt the attached resolution to approve the 2018 Legislative Program, as presented. The General Assembly must vigilantly and effectively avoid enactment of any further unfunded mandates to localities and initiate procedures to review, assess, and eliminate existing and burdensome mandates imposed on localities. Unfunded mandates include mandatory tax exemptions to specific groups of individuals. as worthy and deserving as they Wray be. The General Assembly must provide localities kith common sense tools to eliminate unnecessary expenses such as the payment of interest, at statutory interest rates, oil refunds based solely on taxpayers' errors or mistakes. The General Assembly should enable all localities with the authority to implement a tax amnesty program similar to initiatives afforded the Commomvealth and the City of Richmond. Localities would then he able to establish programs to address their specific challenges in collecting overdue taxes and thereby alleviate economic pressures exerted on communities by delinquent taxpayers. - Technology and Infrastructure Policy The General Assembly should eliminate impediments facing localities from bringing 21" Centup technology to their citizens. the Commonwealth and the City must develop partnerships among federal, state. and local constituencies to expand highway infrastructure development throughout Virginia's Blue Ridge. including the expansion oft -73. Environmental Policy The City opposes any efforts by the General Assembly to mandate further exemptions from payment of local stormNcater utility fees. In addition, the City requests the General Assembly to hold localities harmless from any costs associated with increases in the load of sediment and other pollutants of concern that enter [eaters of the Commomvealth, including ricers, streams, and tributaries, where such increases in the Total Maximum Dail% Load for a locality are attributable to projects and developments approved by the Commomvcalth that include crossings of bodies of water within the Commomvealth. The City supports prodding localities with the option. not the mandate, to regulate the use of plastic bags and disposable extruded pul7stvrcne (Styrofoam) food and beverage containers «ithin their communities. Economic Development Policy The City encourages- the General Assembly to maintain existing toots, including historic lax credits, to encourage development and redevelopment throughout the City and Virginia's Blue Ridge Region. The City supports continuation and increased finding for the Commomvealth's Opportunity Fund (COF). This important economic development incentive program has played a major role in several Roanoke job creation projects. The COF is an essential tool when competing with other states who often offer lucrative incentive packages to prospective companies. The City encourages the General Assembly to refrain from enacting further limitations on planning, development, and zoning tools that localities may use in regulating and promoting development within their communities. Education Policy The City and Roanoke City Public Schools urge the General Assembly to fully fund its obligations to public education, including funding for technology needed to meet the SOL requirements and enhance teaming by all children. The City and Roanoke City Public Schools urge the General Assembly to maintain the ability of Roanoke City Public Schools to set the start date for its school year. 2018 VML Legislative Program The City endorses and supports the 2018 VML Legislative Program. 1) R V 1 1 1),A I E: 1 1.116? 0 1- 2018 Legislative Priorities The City requests its legislative delegation to patron and support the to] Ioraing legislative initiatives: I . Authorize localities to adopt ordinances limiting smoking within designated areas of outdoor public spaces. This proposal requires an amendment to the Virginia Clean Air Act (Sections I5? -2820 through 15.2- 2833). 2. Authorize treasurers and localities to retain third party collection sermes to collect any delinquent amount due a locality, including local taxes and fees, and reduce the delinquency period from six (6) months to three (3) months before collections activities may be commenced with the use of third party collection agencies. State Code currently limits the ability of the treasurer or director of finance in the use of third party collection agencies and also requires that such obligations be delinquent for at least six (6) months before such collection activities may be initiated. One fee affected by these limitations is delinquent parking citations. This proposal requires amendments to Sections 58.1 - 3919.1 and 58.1 -3934 Authorize localities and school districts to establish the school year start date. The City enjoys an exception that allows Roanoke Public Schools to start before Labor Da}. Flexibility in establishing the school start is critical to the education of the children. This Flexibility allows school districts to coordinate programs and educational opportunities. this proposal requires amendments to Chapter 211. 2017 VML Legislative Program Education Funding A strong public school system is essential to economic development and prosperity. The state must be a reliable funding partner in accordance with the Virginia Constitution and state statutes. The Standards of Quality should recognize the resources, including positions, required for a high - quality public education system. VML opposes changes in methodology and changes in the division of financial responsibility that result in a shill of funding responsibility from the slate to localities. Further, VML opposes policies that lower state contributions but do nothing to address the cost of meeting the requirements of the Standards of Accreditation and Standards of Learning. Any approach to improving low - perforating schools must include adequate state financial support. VML supports increased stale funding for the Virginia Preschool Initiative, the K -3 reduced class size program and Early Reading Intervention program. VML also supports increased slate stipends for highly effective teachers in high - poverty schools, and other innovative programs for teachers and students. State and Local Government Fiscal Relationship Governance at the local level becomes ever more challenging as the Commonwealth and the Federal government add new programs, or modify existing program guidelines, and promulgate complex regulations and higher standards for local governments to implement. It is not uncommon for the state and federal governments to either underfund their share of the costs or to ignore them altogether. To that end, the Virginia Municipal League holds as essential these principles on local taxing and budget authority. • Specific local revenue authority and sources cannot be further restricted without Post granting and providing alternative revenue authority with reliable, sustainable revenue sources. This includes, without limitation, the BPOL and M &T taxes. • Local governments should be involved in any discussions relating to local taxing authority including legislation that exempts specific industries from local taxes and fees. • Local general fund revenue and special funds cannot be confiscated or re- directed to the state treasury. • Placing additional administrative burdens on local governments without sufficient resources or administrative Flexibility jeopardizes the quality of services delivered at the local level. Local governments cannot be expected to bear the expenses related to the imposition of new funding requirements or the expansion of existing ones on services delivered at the local level without a commensurate increase of state financial assistance or new local taxing authority. • Shifting traditional state funding responsibilities onto local governments for services including public education, law enforcement, and public safety activities and any core services affecting local government, is bad fiscal policy, resulting in stress on local finances without reductions in overall program costs. • Imposing state fees, taxes or surcharges on local government services impedes transparency at both the state and local level. • Any efforts at tax reform must begin with a thorough examination of state tax reform and the financing of state services. The State should reform its own tax structure before taking on the topic of local taxes. State and /or local tax changes should not negatively affect local revenues. • State budget cuts to state mandated and other high priority programs should specify the programs to be affected by the cuts. The Commonwealth should: • Enter into a dialogue with local governments to examine state requirements and service expansions that can be suspended or modified to alleviate to the degree possible the financial burden on state and local taxpayers. • Examine models in other states that allow for modernizing stale and local taxing authority. • Develop spending and revenue priorities that support economic development, public safety, education and other public goals. State tax credits, tax deductions and tax relief policies must receive the same scrutiny as spending programs as part of the prioritization process. • In times of revenue crises, review ways to increase revenues to meet constitutional and statutory obligations to Virginia citizens after all other actions have been taken. • Include local government representatives on any "blue ribbon" commission or other body established by the stale that has as its purpose changes to local revenue authority or governance. State Assistance to Local Police Departments (HB 599) Almost 70 percent of Virginians live in communities served by police departments. The state created a program of financial assistance to local police departments, but has increasingly de- emphasized this funding obligation as a priority. VML. calls for the state to honor its commitment to public safety by funding the program as stipulated in the Code of Virginia. Taxing, Licensing, and Regulating Internet -based Businesses and Services If the Commonwealth should take action to regulate private enterprises employing a business model that emphasizes the use of the Internet to either provide retail or facilitate lodging or ride - sharing services, then local government interests should be acknowledged and localities should be included in the decision - making. As general principles, VML believes state and local policies should (1) encourage a level playing field for competing services in the market place; (2) seek to preserve and /or replace local and state lax revenues; (3) ensure safety, reliability, and access for consumers, providers, and the public; and (4) protect local government's ability to regulate businesses whether they are traditional, electronic, Internet - based, virtual or otherwise. Transportation and Transit Funding VML recognizes the importance and critical support provided by the Commonwealth for local and regional transportation and transit capital needs. To that end, VML believes the projected decline in state funding over the upcoming biennia will negatively affect the movement of people and goods, thereby hindering economic development, jeopardizing public safety and degrading the quality of life in our localities. The state should continue to financially support transportation and transit capital needs, exploring all options including the issuance of Commonwealth bonds. VML supports adequate funding of the Smart Scale (HB 2) program in addressing transportation and transit needs. Access to Healthy Food VML supports approaches (including but not limited to the Virginia Grocery Investment Fund) to provide financial and technical support for businesses to expand and ensure greater access to healthy food for residents of the Commonwealth. Roadway Maintenance Payments; Bicycle Lanes VML supports the ability of cities and towns that receive roadway maintenance payments from the Commonwealth based on moving -lane miles of roadway to not see their payments reduced if moving -lane miles of roadway are converted to bicycle -only lanes. Municipalities will not reduce their funding after a conversion. Landscape Materials VML supports the ability of localities to regulate the use of specific landscape cover materials or the retrofit of existing landscape cover materials for the health, safety, and welfare of their citizens. Local Authority to Regulate Plastic Bags VML requests that the General Assembly grant localities the authority to regulate and curtail the use of retail plastic bags. This authority would provide local governments an additional tool to reduce litter and improve local water quality. Lottery for Localities VML requests that the General Assembly authorize the Joint Legislative Audit and Review Commission to study the feasibility of dedicating additional lottery dollars to local governments. As part of the study, JLARC should identify and evaluate the potential impacts of the "Lottery for Localities" proposal on other state financial aid programs, including school funding, and the proposal's possible financial impact on lottery sales. Municipal Net Metering VMI. requests that the General Assembly grant local governments the right to aggregate the electric load of their buildings, facilities, and any other governmental operations for the purpose of net energy metering. Additionally, VML requests that the General Assembly raise the net - metering limit from 1,000 kilowatts to 2,000 kilowatts for non- residential customers. Price Floor for Regional Gas Taxes VML supports an amendment to Virginia Code § 58.1 -2295 that would establish a protective floor price for the 2.1 percent regional gas tax, such as was done for the statewide fuels tax in §58.1 -2217. Such a floor concept is essential to provide a more stable, dedicated revenue source needed for long -term financing of regional projects. Regional Greenhouse Gas Initiative & Commonwealth Resilience Fund VML urges the General Assembly to address greenhouse gas emissions targets through a Regional Greenhouse Gas Inventory (RGGI) carbon credit auction, and /or a carbon emissions tax. All proceeds derived from the auction of credits should be used to establish the "Commonwealth Resilience Fund," a special state - dedicated fund to assist localities in addressing flooding, energy efficiency improvements, and economic development. State Corporation Commission Jurisdiction over Local Utilities Because the State Corporation Commission lacks jurisdiction over local government utilities under the Virginia Constitution, the General Assembly should not enact any legislation that purports to grant the SCC any regulatory powers over local utilities. Stormwater Utility Charges VML opposes further amendments to the regulation of stormwater that would require a locality to waive stormwater charges. Water Quality Funding / Wastewater Discharge and Pollutant Allocation Limits VML requests that the General Assembly provide sufficient appropriations to the Water Quality Improvement Fund (WQIF) to fulfill point source upgrade contracts with local governments as well as cost -share payments to farm operators for the implementation of agricultural best management practices. Additionally, VML requests that the General Assembly provide sufficient appropriations, including dedicated revenues to the Stormwater Local Assistance Fund (SLAF) to address costs associated with permit requirements tied to federal Municipal Separate Storm Sewer Systems (MS4) and new EPA regulations. VML opposes any legislation that would reduce or limit local government's sewage discharge capacity, including nutrient allocations, as such capacity and allocations are critical to our members' economic development efforts.
