PRESENTATIONS AND ACKNOWLEDGEMENTS: NONE. 3. HEARING OF CITIZENS UPON PUBLIC MATTERS: City Council sets this time as a priority for citizens to be heard. All matters will be referred to the City Manager for response, recommendation or report to Council, as he may deem appropriate. Robert Gravely, 3360 Hershberger Road, N.W., appeared before the Council with regard to changes in the Roanoke community. 4. CONSENT AGENDA: (APPROVED 7 -0) All matters listed under the Consent Agenda are considered to be routine by the Members of City Council and will be enacted by one motion. There will be no separate discussion of the items. If discussion is desired, the item will be removed from the Consent Agenda and considered separately. C -1 Minutes of the regular meeting of City Council held on Thursday, October 4, 2018 and a recessed meeting on Friday, October 12, 2018; and a regular meeting on Monday, October 15, 2018. RECOMMENDED ACTION: Dispensed with the reading of the minutes and approved as recorded. 2 C -2 A communication from the City Manager requesting that Council schedule a public hearing to be held on Monday, November 19, 2018, at 7:00 p.m., or as soon thereafter as the matter may be heard, or such later date and time as the City Manager may determine, to consider the sale of approximately 11.813 acres of City -owned property located at 0, 2839 and 2903 Peters Creek Road, N. W., to CarMax Auto Superstore, Inc., for the purpose of constructing an automobile dealership. RECOMMENDED ACTION: Concurred in the request. C -3 A communication from the City Attorney requesting that Council schedule a public hearing to be held on Monday, December 17, 2018, at 7:00 p.m., or as soon thereafter as the matter may be heard, or such later date and time as the City Manager may determine, to consider an amendment to the Williamson Road Area Service District boundary to include a newly consolidated parcel. RECOMMENDED ACTION: Concurred in the request. C -4 A communication from Debbie Bonniwell, Chief Executive Officer, Blue Ridge Behavioral Healthcare Board of Directors, recommending concurrence in the reappointment of Colonel Bobby Russell as an At -large representative, commencing January 1, 2019 and ending December 31, 2021. RECOMMENDED ACTION: Concurred in the request. ITEMS RECOMMENDED FOR ACTION: 1. Acceptance of the Byrne Justice Assistance Grant funds from the Virginia Department of Criminal Justice Services for the Positive Action in Roanoke Project. The City Manager shared the following comments: Valley Metro Fare -Free Day • On November 6, Election Day, Valley Metro transportation will be fare - free on all fixed route service routes and STAR paratransit service. • This special promotion will enable citizens to utilize transit services to access polling locations within the City of Roanoke. • Fare -Free Day is also a good opportunity for those who do not normally use Valley Metro Services to try transit. • More information is available at www.valleymetro.com Virginia Veterans Parade • Saturday, November 10, 11 a.m. to 1:00 p.m. • Downtown Roanoke • Parade participants include military units from across Virginia, military marching units and individual veterans accompanied by military, college and high school bands. • This parade is one of the largest Veterans events in Virginia Leaf Collection Program • Collection starts next week on your regular trash collection day. • Postcards with this year's Leaf Collection Schedule were mailed to all city residents. • The city will collect an unlimited number of biodegradable paper bags filled with leaves, placed at the curb, on the following weeks: o November 12 -15 o November 26 -29 o December 3 -6 o December 10 -13 • No collection the week of November 19 (Thanksgiving week). • Bulk and brush collection will continue on leaf collection weeks. • More information about leaf collection is available at www.roanokeva.gov /leafcollection or by calling Solid Waste Management at 853 -2000, Option 1. Roanoke Retains Top Digital City Status • The Center for Digital Government has announced the winners of the 2018 Digital Cities Survey. Once again, the City of Roanoke ranked in the Top 10 Digital Cities for the 75,000 to 124,999 population category. • The organization is a national research and advisory institute focused on information technology policies and best practices in state and local government. 9 Roanoke was recognized for its: • Focus on strategy, shifting from a five -year strategic plan to one that is updated annually. • Use of the Lean Six Sigma methodology to evaluate business processes for the best way forward as far as efficiency is concerned. • Comprehensive social media activity with more than 50 accounts and a digital community size that exceeds 218,000 followers. • Expansion of its broadband connectivity to support local education and public libraries. o Installation of more resilient infrastructure. o Increase in the use of data analytics to measure overall performance and assist city police with crime analysis. 8. Inquiries and /or comments by the Mayor and Members of City Council. Mayor Lea announced the 2018 CIAA Football Championship at the Salem Stadium on Saturday, November 10. In honor of Veterans' Day, Council Member Bestpitch announced the City of Roanoke collaborated with the Roanoke Valley Veterans' Council for a tree planting in commemoration of the 100th Anniversary of World War I on Friday, November 9 at 10:00 a.m., at Argonne Circle, S. W. (Old Southwest/ 304 King George Avenue, S. W.). He acknowledged a $1,000.00 donation from Home Depot for twelve trees to be planted in the City. Council Member Bestpitch also encouraged citizens to vote on Tuesday, November 6; and questions about voting precincts, contact the Registrar's Office at (540) 853 -2281; and for transportation to the voter polls, call (844) 482 -8683. 10 Vice -Mayor Cobb commended the Roanoke Women's Foundation for their investment in the community; and he announced the Taubman Museum of Art celebrated its 10th Anniversary. b. (6 -0) Reappointments /appointments as follows: Reappointed Lew Bishop as a City representative of the Blue Ridge Behavioral Healthcare, Board of Directors, for a four -year term of office ending December 31, 2022. Appointed Reeves Bryant (R.B.) Lawhorn, Jr., as a City employee member of the Board of Trustees, City of Roanoke Pension Plan, to fill the unexpired term of office of Michael Shockley ending June 30, 2020. Appointed Robert Clement to replace Michael Woolwine as a member of the Board of Zoning Appeals for a three -year term of office, commencing January 1, 2019, and ending December 31, 2021. Reappointed Kermit "Kit" Hale; and appointed Pamela Smith and Frank Martin, III, commencing January 1, 2019, as members of the City Planning Commission for four -year terms of office, each, ending December 31, 2022. Appointed the Honorable Judge Frank W. Rogers, III, as the Juvenile Domestic and Relations Court representative of the Court Community Corrections Program, Regional Community Criminal Justice Board, to fill the unexpired term of office of the Honorable Judge Onzlee Ware ending June 30, 2020. Appointed LaKeevia Sinkford to replace Thomas Powers as a member of the Human Services Advisory Board for a four -year term of office, commencing December 1, 2018, and ending November 30, 2022. Bishop, New River Valley representative of the Roanoke Regional Airport Commission for an additional one -year term of office ending March 9, 2022. Dr. Bishop was initially appointed to serve a three -year term of office instead of a four -year term. A 45 -mile stretch of the Roanoke River which begins in Montgomery County and ends at Smith Mountain Lake. Stretching through the heart of the Cities of Salem and Roanoke before continuing on to the I scenic Roanoke River Gorge in Roanoke County, the Roanoke River Blueway is a unique outdoor recreation opportunity in Virginia's Blue Ridge Mountains. The City currently has two service districts, the Downtown Service District and the Williamson Road Area Service District. By Ordinance No. 41266- 091718, adopted by Roanoke City Council on September 17, 2018, City Council most recently expanded the Williamson Road Area Service District ( "District ") by amending Section 32 -103.2 of the City Code, to expand the District to include two parcels that were not previously contained within the District, at the request of the property owner. Since that time, another property owner, Star City Lodging, LLC, the owner of several parcels of real estate located along Williamson Road, has consolidated those parcels into two parcels now designated as Official Tax Map Nos. 3020203 and 3020207. As a result of the consolidation, all of the parcel being Official Tax Map No. 3020207 and only a portion of the parcel bearing Official Tax Map No. 3020203 are within the District. The City desires to amend the boundaries of the District to include all of the newly consolidated parcel bearing Official Tax Map No. 3030203 within the District. This amendment will avoid creating a `split' property for real estate tax purposes. The property owner is aware of this proposal and has not objected to such action. Considerations: Pursuant to state law, before a locality may amend a service district, a public hearing is required to be held by the governing body before it may consider the matter. The public hearing must be advertised once a week for three consecutive weeks in a newspaper in general circulation. The public hearing must be held no sooner than ten days after the date the second notice appears in the newspaper. Background: The Virginia Department of Criminal .Justice Services has awarded the City of Roanoke Federal funding from the Byrne ,Justice Assistance Grant (JAG) program for the Project titled, "Positive Action in Roanoke ". This funding will be used by Family Service Roanoke Valley (FSRV) to create and administer the Positive Action program in four public housing sites. The amount of the federal funding is $36,741 and FSRV is contributing $12,247 in matching funds for a program total of $48,988. FSRV will be reporting on the required match each quarter but it is not part of the funds that the City of Roanoke Finance Department is tracking. Positive Action is a research -based social - emotional learning curriculum that includes family engagement activities and a community service learning program for children in 3rd through 5th grade residing in the public housing neighborhoods. These children often face multiple risk factors that increase the likelihood of high rates of juvenile delinquency. This project proposes to increase protective factors of these children in order to decrease the rates of criminality, increase school success, and increase positive self- images and engagements with the community. The program also increases the positive knowledge skills of the parents through communication and relationship building activities. Considerations: A recent Needs Assessment was conducted in the largest Roanoke Redevelopment and Housing Authority neighborhood. This study showed that children residing in this neighborhood graduated from high school at lower rates than average, had lower standardized test scores in elementary years, and engaged in fewer after school programs that offer sports, arts enrichment, academic remediation and enrichment. The objectives of Family Service of Roanoke Valley's implementation of Positive Action will be to strengthen school, community, family and individual protective factors as well as increase parent and youth knowledge of the risks of anti - social behaviors. Recommended Action: Adopt a resolution accepting the Byrne Justice Assistance Program Grant funding from the Virginia Department of Criminal Justice Services Grant # 19- C4052AD1 5 for the Positive Action in Roanoke program. Authorize the City Manager to execute any forms required by the Virginia Department of Criminal Justice Services in order to accept these funds; such documents to be approved as to form by the City Attorney. The RYSE program was launched by United Way in May of 2016. The goal is to house the families of homeless children in the Roanoke Valley who are not qualified for other types of housing assistance. RYSE children are identified as homeless by the Department of Education — youth who "lack a fixed, regular, and nighttime residence ", such as youth whose families are staying in hotels /motels or in the homes of neighbors, friends, or family. Homeless families face an extremely expensive condition — staying in hotels /motels or with friends and family makes it difficult to provide home cooked meals, purchase supplies in cost - effective sizes, and provide the stability it takes to succeed in a job or in school. Despite the challenges faced by these families, government resources to assist the homeless are limited to individuals and families who have stayed on the street or in a shelter, and do not cover RYSE families. In the summer and fall of 2016, the RYSE pilot worked with 16 families to secure their housing and provide high quality case management to family members. In partnership with Roanoke City Public Schools, the Continuum of Care, Family Promise of Roanoke Valley, Salvation Army, ARCH, and the Council of Community Service's Community Housing Resource Center assisted these families. In its 2nd year, 25 families were collective served by this collaborative effort. Families were tracked on the By Name List kept by the Family Committee of the Blue Ridge Interagency Council on Homelessness. Section 1: Shared Project Goals For 2018 -2019, RYSE's goal is to stabilize 20 homeless families in their own safe and secure housing. We will achieve this goal by focusing on the identified families who have the greatest capacity for stabilizing with a boost from RYSE. United Way of Roanoke Valley along with our housing partners will support families with high - quality, strength -based case management to assist families in their search for housing and stability. Highlights of the overall design are as follows: • Identifying families who are living in transient housing, including doubled up with other families or staying in hotels /motels through our housing providers, 2 -1 -1, word of mouth, and Roanoke City Public Schools • Establishing a single point of entry and screening for families to be connected with the appropriate housing intervention through Roanoke City's Central Intake • Connecting RYSE- eligible families with case managers to help the family achieve their goals and navigate housing options • Implementing a 2- generation approach by establishing stronger partnerships with existing programs serving children, primarily out of school time care programs, health programs, and skills building programs, and programs helping adults achieve better income and health 1111a?,e RYSE: Rehousing Youth for Success in Education MEMORANDUM OF AGREEMENT Evaluation Plan: a. Families will work with the case manager to identify their goals, strengths, barriers, and housing status. Additionally, RYSE will assess program success with input from our housing partners with the structure provided by the Family Initiative of the Blue Ridge Interagency Council on Homelessness and the Continuum of Care, as well as input from Roanoke City Public Schools. Section 2: lead Agency Responsibilities As the lead agency, United Way agrees to convene and oversee the implementation of RYSE. Specifically, UWRV agrees to: A. House and staff the partnership and provide resource development, fiduciary oversight, financial management, administrative services, and back -office functions related to the program. B. lead with multiple partner support: facilitate the smooth flow of information between the different groups within the partnership, the development of key messages and materials for external audiences, including target families /neighborhoods, secure funding and resources necessary to advance the work, provide logistical support to bring together the necessary community partners to support the project. C. Work with RCPS, Central Intake, CHRC, and Case Management agency(s) to guide partner outcome measures, data collection for assessments, and analysis. D. Respond to Central Intake in a timely manner to confirm approval of RYSE prevention funds for identified eligible clients. E. Follow -up with families served with RYSE Prevention Funds to provide financial empowerment and coaching support through its Financial Stability Strategies staff. F. Develop and communicate RYSE outcomes to partners and the community. G. Acknowledge Central Intake's partnership with UWRV and RYSE in press materials and digital communications about the program, including success stories and program updates. H. Provide representation and have active participation in the Blue Ridge Inter - agency Council on Homelessness' Family Initiative and the Continuum of Care, where ongoing planning and governance for the execution of the RYSE program occurs alongside other partners. However, all RYSE Prevention Funds allotted for the year must be spent by June 30, 2019. Section 5: Modification or Termination of the Agreement A. This Agreement may only be modified by a written agreement duly signed by authorized representatives of both Central Intake and United Way. B. Either party may terminate this Agreement by providing written notice to the other party at least thirty (30) days prior to the intended date of termination. If terminated, payment hereunder will be prorated through the actual date of termination. C. United Way shall provide Central Intake prompt notice of any significant problems it perceives with regard to their performance of obligations under this Agreement. Such notice shall identify the problems clearly. Central Intake shall receive an opportunity to respond to the notification and correct the problem as needed. United Way and Central Intake will agree to specific timelines for correction. A revision to the previously established funding period could be part of the response by United Way. If the problem is not or cannot be resolved, United Way reserves the right to terminate this Agreement and its investment upon the provision of written notice to Central Intake. D. United Way and Central Intake shall affect termination of this Agreement through respectful processes and dialogue. United Way and Central Intake shall, prior to release, mutually agree upon the content, timing, and form of any and all press releases regarding the termination of this Agreement. Roanoke adopts the building codes by reference in Section 7 -5 of the Code of the City of Roanoke (1979) (City Code). The Statewide Fire Prevention Code is adopted in Section 12 -6 of the City Code. The 2012 editions were adopted on November 17, 2014. Considerations: Adoption of new code editions occurs on a three -year cycle and the year of adoption typically follows a few years behind the nominal edition year. Thus, VDHCD adopted the 2015 codes in 2018. VDHCD adopts the codes published by the International Code Council with state amendments to reflect special conditions and policy in Virginia. Codes are uniform throughout Virginia and for the most part throughout the United States. The Construction Code, the Existing Building Code, and the Maintenance Code are collectively referred to as the Uniform Statewide Building Code. Adoption of the code will require purchase of code books for inspectors and plan reviewers, an expense that was anticipated in the FYI budget. In the coming months, inspectors and plan reviewers will attend training sessions that highlight the code changes. No changes to the fee compendium are required. Past code language has referred to a specific edition year when adopted. The new language proposed provides for automatic local adoption of any future editions adopted by VDHCD as authorized by Virginia Code Section 1 -220. Uniform Statewide Building Code (USBC) You may already be aware that the 2015 Virginia USBC was effective September 4, 2018. The USBC includes the Virginia Construction Code, Virginia Existing Building Code and the Virginia Maintenance Code. As has been the case historically, there is a one year grace period for permit applicants to choose either the 2012 VA Codes or the newly effective 2015 Codes. We are pleased to announce that the Virginia Department of Housing and Community Development (DHCD) will be providing each jurisdiction with a complete set of custom books with Virginia amendments as soon as the publication of those documents has been finalized. We anticipate the custom codes to be available by they end of the year. In the meantime, the complete regulations of amendments to the national model codes are available on our website at this link: 2015 Regulations Statewide Fire Prevention Code (SFPC) The Virginia SFPC is scheduled to have an effective date of October 16, 2018. The later effective date is the result of extensive work undertaken over the past three years, at the direction of the Board of Housing and Community Development (BHCD), to remove provisions of the SFPC that do not comport with Virginia statutory authority. Virginia law authorizes the SFPC for operation and maintenance to the extent that it does not affect the method of construction. The work done by stakeholders was limited to removing construction requirements that only apply to new construction and replacing them with maintenance language. Previous attempts at clarifying relied on administrative language being added in Chapter One of the SFPC reminding users that construction related provisions in the SFPC were not enforceable. Unfortunately this resulted in confusion. While the Virginia SFPC and Virginia Maintenance Code have always required buildings to be maintained in accordance with the code under which they were legally constructed, it was brought to our attention during this code update process that some jurisdictions did not have complete technical libraries needed to enforce prior code requirements. To that end, DHCD has purchased a complete library of every code ever enforced in Virginia from the early 1970's to current day for each jurisdiction that enforces the USBC. Those libraries were distributed in April and are in PDF format. As always, DHCD is committed to providing technical resources and assistance to jurisdictions. Existing buildings. This chapter shall not supersede provisions of the Fire Prevention Code promulgated by the Board under § 27 -97, that prescribe standards to be complied with in existing buildings or structures, provided that such regulations shall not impose requirements that are more restrictive than those of the Uniform Statewide Building Code under which the buildings or structures were constructed. Subsequent alteration, enlargement, rehabilitation, repair, or conversion of the occupancy classification of such buildings and structures shall be subject to the construction and rehabilitation provisions of the Building Code. The Fostering Connections to Success and Increasing Adoptions Act of 2008 allows the state to offer Title IV -E Guardianship Assistance Payments for children who meet Title IV -E Kinship Guardianship eligibility requirements. Considerations: Because KinGAP was implemented after budget allocations were completed for fiscal year 2019, all allocations for these Budget Lines are requested through the VDSS Budget Request System process in fiscal year 2019. No initial allocations were made. The City of Roanoke DSS has the first KinGAP case in the VDSS system, and has both requested and been granted $13,500 to cover the costs for this case. There is no local match for the current fiscal year. City Council authorization is needed to accept and appropriate the funding. Hill Climb was one of the top vote recipients in the People's Choice balloting held after the installation of the nine new art works in May 2017. The other works will be picked up by the artists in November 2018 and the RAC will issue a call to artists for eight new sculptures to be placed in Elmwood in May 2019. The RAC desires to keep one piece from the current show and deemed Hill Climb as most suitable due to its low maintenance materials, workmanship and high polling. It will remain in its current location. In order to purchase the piece at the cost of $9,500 the Arts Commission secured a donation from the Visit Virginia's Blue Ridge Foundation (VVBRF). CITY COUNCIL AGENDA REPORT To: Honorable Mayor and Members of City Council Meeting: November 5, 2018 Subject: Acceptance of FYI and FY20 VDOT Revenue Sharing Program Award - Authorization for New Projects and Appropriation of Funds Background: On October 16, 2017, City Council authorized the City Manager to submit an application to the Virginia Department of Transportation (VDOT) for funds from VDOT's FYI Transportation Revenue Sharing Program in the amount of $5,000,000, and an additional $5,000,000 from VDOT's FY20 Transportation Revenue Sharing Program, which required a total City match of $10,000,000. Funds were requested for the following projects: 1 . Roanoke River Greenway Bridge the Gap (New Construction) 2. Huntington Boulevard Curb, Gutter and Sidewalk (New Construction) 3. Citywide Stormwater Improvements (New Construction) Considerations: City staff has been notified that VDOT has awarded the City a total of $4,926,776 from VDOT's FY19 Transportation Revenue Sharing Program and $3,924,357 from VDOT's FY20 Transportation Revenue Sharing Program. Per the City's Programmatic Project Administration Agreement with VDOT for Revenue Sharing Projects, dated September 9, 2013 and the Extension Addendum for Revenue Sharing Projects dated May 31, 2016 (which is valid until June 30, 2019), copies of which are attached, the City is required to match the amount of $8,851,133. VDOT has awarded Revenue Sharing funds for all three (3) of the projects identified above and as set forth below. 1. Roanoke River Greenway Bridge the Gap - $2,836,522. City match funding for the FYI Revenue Sharing funds of $1,817,356 is available in the project account from the City's FY2019 BAN Funds. City match funding for the FY20 Revenue Sharing funds of $1,019,166 will be provided through the City's FY20 planned capital improvements funds. 2. Huntington Boulevard Curb, Gutter, and Sidewalk (New Construction) - $2,203,827. City match funding of $1,200,000 for the FYI Revenue Sharing funds is available in the project account from the City's FY2019 BAN Funds. The additional $1,003,827 in matching funds will be provided through the City's FY20 planned capital improvements funds. 3. Citywide Storm Drain Improvements - $3,810,784. City match funding for the FYI Revenue Sharing funds of $2,009,868 is available in the project accounts from the City's FY2019 BAN Funds. City match funding for the FY20 Revenue Sharing funds of $1,800,916 will be provided through the City's FY20 planned capital improvements funds. This Council Report is requesting acceptance, authorization, and appropriation of Revenue Sharing funds in the amount of $8,851,133 for all projects listed above. Recommended Action: Accept VDOT's award of Transportation Revenue Sharing Program funds in the amount of $8,851,133 which will be allocated as set forth above among the three (3) projects, with the City providing local matching funds in the amount of $8,851,133. Authorize the City Manager to take such further actions and execute such further documents as may be necessary to obtain, accept, implement, administer, and use such funds in the amount of $8,851,133 in Revenue Sharing Program Funds for the three (3) projects as referred to above. Authorize the City Manager to execute the VDOT Appendix A documents. Such Appendices shall be in a form approved by the City Attorney. Adopt the accompanying Budget Ordinance to establish revenue estimates for the FYI and FY20 VDOT funds and appropriate funding in the same amount to the expenditure accounts as follows: a. The foregoing notwithstanding, nothing in this subparagraph shalt prevent the enforcement of the terms and conditions of this Agreement by or against either Party in a competent court of law. 9. The Parties mutually agree that no provision of this Agreement shall create in the public, or in any person or entity other than parries, rights as a third party beneficiary hereunder, or authorize any person or entity, not a party hereto, to maintain any action for, without limitation, personal injury, property damage, breach of contract, or return of money, or property, deposit(s), cancellation or forfeiture of bonds, financial instruments, pursuant to the terms of this of this Agreement or otherwise.
