The Council of the City of Roanoke is seeking applications for the following
current vacancies and /or upcoming expirations of terms of office:
Building and Fire Code Board of Appeals — one vacancy (Builder)

City Planning Commission — one vacancy
Equity and Empowerment Advisory Board - seven vacancies

The Mayor's Annual State of the City Address will be held on Thursday,
August 26, 2020 at 8:00 a.m., in the City Council Chamber, 215 Church
Avenue, S. W., Room 450, by electronic communication means. Playback to
be aired on RVTV Channel 3 on Friday, August 28, at 5:00 p.m. and
10:00 p.m.; and on Sunday, August 30, 5:00 p.m. and 10:00 p.m.
PRESENTATIONS AND ACKNOWLEDGEMENTS:
A proclamation declaring the 2020 as the year of the Virginians with Disabilities
Act and recognizing the 35th Anniversary of the Americans with Disabilities Act.
The Vice -Mayor presented Karen Michalski - Karney, Executive Director,
Blue Ridge Independent Living Center, with a proclamation declaring 35th
Anniversary of the enactment of the Virginians with Disabilities Act and
recognized the year 2020 as the year of the Virginians with Disabilities Act
and Americans with Disabilities Act.

RECOMMENDED ACTION: Dispensed with the reading of the minutes

C -2 A communication from Mayor Sherman P. Lea, Sr., requesting that
Council convene in a Closed Meeting to discuss vacancies on certain authorities,
boards, commissions and committees appointed by Council; and
appointments /reappointments of City Council assignments, pursuant to Section
2.2 -3711 (A)(1), Code of Virginia (1950), as amended. A list of current vacancies
is included with the agenda for this meeting.
RECOMMENDED ACTION: Concurred in the request.
C -3 A communication from the City Manager requesting that Council convene
in a Closed Meeting to discuss the disposition of an approximately 0.0160 acre
portion of City -owned property located at 0 Church Avenue, S. E., where
discussion in an open meeting would adversely affect the bargaining position or
negotiating strategy of the public body, pursuant to Section 2.2 -3711 (A)(3),
Code of Virginia (1950), as amended.
RECOMMENDED ACTION: Concurred in the request.
C -4 A communication from the City Manager requesting that Council schedule
a public hearing to be held on Monday, August 17, 2020, at 7:00 p.m., or as soon
thereafter as the matter may be heard, or such later date and time as the City
Manager may determine, in his discretion, to consider the sale of the former
Melrose Library to the City of Roanoke Redevelopment and Housing Authority.

COMMENTS OF THE CITY MANAGER.
The City Manager offered the following comments:
Financial Empowerment Center Launches
• Last week the City of Roanoke, in partnership with the National
Cities for Financial Empowerment Fund and Freedom First
Enterprises, announced the grand opening of Roanoke's Financial
Empowerment Center with a virtual ribbon - cutting event on
Facebook.
• The FEC will offer professional, one -on -one financial counseling
and coaching as a no -cost public service to local residents.
• Roanoke is one of more than two dozen cities and counties across
the country that has either launched or is working to launch local
FECs.
• This program is being coordinated by Brandon Meginley in the
Department of Economic Development.
All- America City Finalist
• Roanoke is excited to be a finalist for the 2020 All-America City
Award.
• The All-America City Award shines a spotlight on the incredible
work in communities across the country. By celebrating the best in
local innovation, civic engagement and cross - sector collaboration.
• The 2020 All-America City theme focuses on health and well -being
through civic engagement.
• In the past, City of Roanoke leaders have travelled to Denver,
Colorado to participate in competitions; however, this year's
competition will be hosted virtually at Charter Hall on August 17.
Star City Strong Recovery Fund
• Staff continues working with various partners and Task Force
members in developing implementation details that will enable
delivery of recovery funds.
• Anticipated distribution of certain funds will begin next week and
taking applications for funding for others in the upcoming weeks.

11. MOTIONS AND MISCELLANEOUS BUSINESS:
a. Inquiries and /or comments by the Mayor and Members of City Council.
OF
Council Member Bestpitch gave a status update on the development
of the Equity and Empowerment Advisory Board with regard to the
development characteristics, candidate questions, and timeline. He
advised selection of finalists and interviews will begin in October,
appointments made in November, and terms will begin January 1,
2021. Application deadline is September 30, 2020.
Council Member Bestpitch expressed concern with regard to the
continual spread of the Coronavirus; urged the public to protect
themselves and wear masks; suggested that City Council hold
Council meetings remotely through the Zoom platform to prevent
further transmission and spread of the virus.
Mayor Lea voiced concern with regard to the spread of Coronavirus
in connection with large crowds and parties in the community; stated
that the virus has gained momentum and opined the pandemic was
about the life and death of people.
Council Member White -Boyd (along with Dr. Elda Stanco- Downey,
Vivian Sanchez Jones, and Dr. Molly O'Dell) have worked with staff
to develop an outdoor community forum on COVID -19 testing
focused on the local Hispanic and African - American population to
encourage additional testing participation and safe practices. She
invited community leaders within the Hispanic and African - American
communities to attend the event on August 5 at Huff Lane Park at
5:30 p.m. In case of inclement weather, the event will be hosted at
Iglesia De Dios Pentecostal M.I. located at 2302 Oakland
Boulevard, N. W.

At 3:46 p.m., Mayor Lea declared the Council Meeting in recess for a

January 1, 2021 and ending December 31, 2023.
Reappointed Sarah Glenn, Karr! Atwood and James Smith as members of

Subject: Request Public Hearing to Sell Former Melrose Library also known as
Tax Map Number 2420206 to the City of Roanoke Redevelopment and
Housing Authority
Background:
The City of Roanoke Redevelopment and Housing Authority (RRHA) entered into a
short -term lease agreement on .January 22, 2020 to lease the former Melrose Library
building located at 2607 Salem Turnpike, N.W, Tax ID No. 2420206 (Property) with the
future intent to purchase the property. RRHA uses the property as the location of the
new HUD designated Envision Center. The EnVision Center is currently occupied by
RRHA, as well as other local community agencies that provide individuals and families
with services that assist toward self- sufficiency and self- determination. The center is
focused on four core pillars: 1) Economic Empowerment, 2) Educational Advancement,
3) Health and Wellness, and 4) Character and Leadership.
With RRHA operating this building, the partnership between the City and various other
agencies can continue toward implementation of the People chapter of the Choice
Neighborhood Plan that was completed in 2014.
City staff has prepared a proposed Contract for Purchase and Sale of Real Property to
convey the Property to RRHA under certain terms and conditions.
Under Section 15.2 -1800, et seq., Code of Virginia (1950), as amended, prior to
conveying City -owned property the City is required to give prior public notice, conduct
a public hearing, and adopt an ordinance by City Council.
Recommended Action:
Authorize the City Clerk to schedule and advertise a public hearing at City Council's
meeting on Monday, August 17, 2020, at 7:00 p.m. or as soon thereafter as the
matter may be heard, or at such other date

The Economic Development Authority of the City of Roanoke, Virginia was organized
pursuant to ordinance adopted by the City Council October 21, 1968. It has been in
continuous operation and has assisted the City's economic development efforts in
meeting to approve of small issue manufacturing and 501(c)(3) industrial development
revenue bond financings.

The EDA uses the City of Roanoke Economic Development Department's staff and
works in close conjunction with the Director of Economic Development.
The EDA meets the third Wednesday of every month. The meetings are held at 8:00
a.m. at the City of Roanoke, Department of Economic Development, 117 Church
Avenue, Roanoke, Virginia.
During the fiscal year ended June 30, 2020, the EDA held twelve (12) meetings; its

The EDA's Activities during the Fiscal Year ended June 30, 2020:
• Adopted a resolution providing initial approval of the issuance of up to $37,000,000 of
revenue bonds for the benefit of Virginia Lutheran Homes, Inc.
• Adopted a resolution authorizing the issuance and sale of revenue bonds in an amount
not to exceed $37,000,000 for the benefit of Virginia Lutheran Homes, Inc.
• Approved a fagade grant application from 211 1St Street LLC in the amount of
$25,000.00 for property located at 211 1St Street.
• Approved a fagade grant application from JS Project LLC in the amount of $25,000.00
for property located at 101 Jefferson Street, S.W.

A RESOLUTION authorizing the acceptance of the Virginia Homeless Solutions Program
Grant ( "Grant ") to the City of Roanoke ( "City ") by the Virginia Department of Housing and
Community Development ( "VDHCD ") in the amount of $102,440; authorizing the City of Roanoke
to be the fiscal agent for distribution of the grant proceeds; and authorizing the City Manager to
execute any documentation required to accept the Grant on behalf of the City, including
Memorandums of Understanding with certain provider agencies.
BE IT RESOLVED by the Council of the City of Roanoke that:
I . The City of Roanoke hereby accepts the Virginia Homeless Solutions Program Grant
by the VDHCD in the amount of $102,440, with a local in -kind match in the amount of $20,000 to
be provided by the City for the Central Intake program, a local in -kind match in the amount of
$3,383 to be provided by Safehome Systems, Inc., and a local in -kind match in the amount of
$10,000 to be provided by the Council of Community Services, such proceeds to be used during the
term of the Grant, beginning July 1, 2020, and ending June 30, 2021, all as more particularly set
forth in the City Council Agenda Report dated August 3, 2020. The Grant will be used by the City
and the provider agencies to assist eligible households experiencing homelessness to obtain and
maintain housing, upon the terms as more particularly set forth in the above referenced City Council
Agenda Report.
2. The City of Roanoke is authorized to be the primary fiscal agent for this Grant,
and shall be responsible for distributing the Grant proceeds to the provider agencies for services

3. The City Manager is hereby authorized to execute and file, on behalf of the City, the

4. The City Manager is further directed to furnish such additional information as may be

Subject: Virginia Department of Housing and Community Development -
Virginia Homeless Solutions Program (VHSP) Grant Award
Background:
As the grantee, the City of Roanoke received notification on July 1, 2020 of
award from the Virginia Department of Housing and Community Development
(DHCD) in the amount of $102,440 through the Virginia Homeless Solutions
Program (VHSP) grant. The VHSP grant is a state and federally funded program
through the State General Fund and the federal Emergency Solutions Grant
(ESG). These funds will support Continuum of Care (CoC) strategies and
homeless service and prevention programs aimed at reducing the number of
individuals /households who become homeless; shortening the length of time
an individual or household is homeless; and reducing the number of
individuals /households that return to homelessness.
These funds will be distributed as follows: City of Roanoke Central Intake
($59,233); the Council of Community Services planning activities ($33,218) and
Safehome Systems in Covington ($8,212). The City will be serving as fiscal
agent for these funds and entering into a contractual agreement with the
Council of Community Services and Safehome Systems to provide such planning
and emergency shelter services, per the attached memorandum of
understanding. These funds must be expended or obligated during the award
period of July 1, 2020 to June 30, 2021.
Grantees are required to provide a 25% community -wide match with local or
private funds for the entire DHCD -VHSP award amount. Match
contributions /types for this grant include: the City of Roanoke is providing
$20,000 of "in- kind" space contribution for the Central Intake program;
Safehome Systems is providing an in -kind match of $3,383 and the Council of
Community Services is providing an in -kind match of $10,000.
Recommended Actions:
Authorize the application and accept the Department of Housing and
Community Development VSHP grant in the amount of $102,440 and authorize
the City Manager to execute the grant documents associated with this funding.
All documents shall be approved as to form by the City Attorney.
Adopt the accompanying budget ordinance to establish a revenue estimate in
the amount of $102,440 and to appropriate the same amount to expenditure
accounts to be established by the Director of Finance in the Grant Fund.

This Grant Agreement is made by and between the Virginia Department of Housing
and Community Development ( "DHCD"), and City of Roanoke ( "Grantee ") for the
period July 1, 2020 to June 30, 2021 in the amount of $102,440. Included in the
amount is $102,423 in state general funds to be expended for outreach, emergency
shelter operations, targeted prevention activities, rapid re- housing activities,
centralized /coordinated entry, CoC planning, HMIS, and /or administration as indicated
in the DHCD approved budget. Also included is $17 in federal funds to be expended for
rapid re- housing and /or administration expenses incurred July 1, 2020 — March 31,

The Grantee was identified as part of the community's emergency response system to
homelessness in the 2020 -2022 Homeless and Special Needs Housing (HSNH) Virginia
Homeless Solutions Program (VHSP) application submitted by the lead agency (or designee)
of the continuum of care (CoC) or balance of state local planning group (LPG). Activities
funded through this grant will be provided at the Grantee location(s) identified in DHCD's
Centralized Application Management System (CAMS).
DHCD administers the Commonwealth of Virginia's homeless services resources through
the VHSP. The Grant, which is the subject of this Agreement, is comprised of state funds
through State General Fund appropriations and an allocation from the United States
Department of Housing and Urban Development (HUD) authorized under the Emergency
Solutions Grant for federal fiscal year 2020; the federal grant number is E20DC510001 and
the Catalog of Federal Domestic Assistance (CFDA) number is 14.231. The Grant is subject
to the terms, guidelines and regulations set forth in the 2020 -2022 Homeless and Special
Needs Housing Guidelines document, any subsequent amendments, the CoC /LPG proposal
as amended through negotiations with DHCD, the DHCD approved Grantee budget, HUD
regulations 24 CFR Part 576, as amended, which are incorporated by reference as part of
this Agreement, the laws of the Commonwealth of Virginia and federal law.
I. Scope of Services
The VHSP goals are to assist households experiencing homelessness to quickly
regain stability in permanent housing and to prevent households from becoming
homeless. This funding will support coordinated community -based activities that
are designed to reduce the overall length of homelessness in the community, the
2020 -2021 VHSP Grant Agreement 1 of 8
number of households becoming homeless, and the overall rate of formerly
homeless households returning to homelessness.
VHSP funds may be used for one or more of the following activities as detailed in
the HSNH guidelines and must coincide with the year one request submitted by
the CoC /LPG lead agency and approved by DHCD:

• Rapid Re- housing

II. Conditions
A. Service Provision
The Grantee is responsible for coordination of VHSP activities with other
CoC /LPG VHSP Grantees and mainstream resources. The Grantee must
assure non - duplication of services with other VHSP Grantees.
B. Reimbursement
Funds are disbursed on a reimbursement based on payment dates.
Grantees must submit remittances in DHCD's Centralized Application and
Management System (CAMS) and be able to provide documentation that
the work and services occurred within the grant period and the expenses
were paid appropriately by the Grantee. Grantees may elect to submit
remittances on a monthly or bi- monthly basis, the chart below reflects
monthly submission dates. The option selected should be adhered to
throughout the year. Supporting documentation must clearly indicate the
period for which the reimbursement is requested.

C. Reporting
Grantees must submit reports as required by DHCD. Such reports may
include, but are not limited to, outcomes and performance reports. Any
required reports and their due dates will be announced by DHCD along with
any relevant instruction. Submission of reports implies approval from the
executive director and is considered final. DHCD reserves the right to
withhold reimbursement payments if the Grantee fails to submit the reports.
Year -End Report
The Grantee must submit a year -end report no later than the fifth day of July
2020.
D. Continuum of Care Participation
Grantees must actively participate in the Homeless Management
Information System (HMIS) and regional continuum of care or balance of
state local planning groups. In addition, Grantees must assure full
participation in annual point -in -time and housing inventory counts.
E. Accounting
The Grantee must adhere to Generally Accepted Accounting Principles
(GAAP). The Grantee shall establish and maintain separate accounts within
its existing accounting system or set up accounts independently. The
Grantee shall record in its accounting system all grant payments received
pursuant to the grant and all other match funds provided for, accruing to, or
otherwise received on account of the grant.
All costs charged to the grant shall be supported by properly executed
payrolls, timesheets, contracts, or vouchers evidencing in proper detail the
nature and propriety of the charges. All checks, payrolls, contracts,
vouchers, or other accounting documents pertaining in whole or in part to
the grant shall be clearly identified, readily accessible, and separate and
distinct from all other such documents. Such documents shall reside at the
offices of the grantee.
F. DHCD Notification
Grantee must notify DHCD of any potentially illegal act, such as misuse of
grant funds or fair housing violations, immediately upon knowledge of such
act. In addition, Grantee must notify DHCD should any other local, federal
or state agency uncover evidence of any potentially illegal act.
Grantee must notify DHCD if there is a change in agency management
and /or fiscal personnel. Failure to do so will constitute a finding and may
result in repayment of funds by the Grantee, the de- obligation of current
funding and the preclusion of future funding.

G. Audit
All grantees, sub - grantees, CHDOs, and sub - recipients, localities,
developers, or any other organizations that receive funding during a
specific program year are required to submit one of the following financial
documents: Financial Statement * *, Reviewed Financial Statement
prepared by an independent Certified Public Accountant (CPA), Audited
Financial Statement prepared by an independent CPA or an 2 CFR 200
Subpart F Audit (Single Audit) prepared by an independent CPA. Please
see the table below to determine which document your organization is
required to submit.
The threshold requirements outlined below are the minimal standards
required by DHCD. We strongly encourage all organizations receiving
funds from DHCD to undertake the highest level of financial management
review to ensure practices and procedures are fully examined and
evaluated.

Entities shall file the required financial document in the Centralized

the end of their fiscal year or 30 (thirty) days after it has been accepted

H. Compliance
Grantees with outstanding audit findings, IRS findings, DHCD monitoring
findings or other compliance issues are not eligible to receive allocations.
DHCD will work with all interested parties toward the resolution of
unresolved matters, where appropriate.
I. Maintenance of Records
Records shall be readily accessible to DHCD, appropriate state and federal
agencies, and the general public during the course of the grant agreement
and shall remain intact and accessible for five years thereafter. The
exception is in the event that any litigation claim or audit is started before
expiration of the five year period, the records shall be retained until such
action is resolved.
J. Costs Incurred Prior To Grant Agreement Execution
No costs incurred prior to the start of the contract period shall be eligible for
reimbursement with grant funds, unless incurred costs are authorized in
writing by DHCD.
K. Expenditure Review
DHCD will monitor expenditure rates to ensure state resources are
maximized. Failure to expend funds proportionately throughout the
contract period may result in the de- obligation of funds. DHCD reserves
the right to de- obligate funds at any time during the contract period and
reallocate as deemed appropriate within the CoC /LPG or statewide based
on compliance, performance, need, and available funding.
L. Termination, Suspension, Conditions
If through any cause, the Grantee fails to comply with the terms, conditions
or requirements of the contract documents, DHCD may terminate or
suspend this Agreement by giving written notice of the same and specifying
the effective date of termination or suspension at least five (5) days prior to
such action.
In the case of contract violation by the Grantee, DHCD may request that all
or some of the grant funds be returned, even if the Grantee has already
expended the funds. The Grantee agrees to return such funds as requested
by DHCD within 30 days of the written request.

M. Subsequent Contracts
The Grantee shall remain fully obligated under the provisions of the Grant
Agreement notwithstanding its designation of any subsequent or third
parties for the undertaking of all or part of the activities for which the Grant
assistance is being provided to the Grantee.
The Grantee agrees to ensure that any contractor or subcontractor who is
not the Grantee shall comply with all the lawful requirements of the Grantee
necessary to ensure that the project for which this assistance is being
provided under this Agreement are carried out in accordance with the
Grantee's Assurances and Certifications.
N. Default
A default is any unapproved use of grant funds. Upon due notice to the
Grantee of the occurrence of any such default and the provision of a
reasonable opportunity to respond, DHCD may take one or more of the
following actions:
(1) direct the Grantee to submit progress schedules for completing
approved activities;
(2) issue a letter of warning advising the Grantee of the default,
establishing a date by which corrective actions must be completed and
putting the Grantee on notice that more serious actions will be taken if the
default is not corrected or is repeated;
(3) direct the Grantee to suspend, discontinue or not incur costs for the
affected activity;
(4) require the Grantee to reimburse DHCD for costs inappropriately
charged to the program;
(5) other appropriate action including , but not limited to, any remedial
action legally available, such as affirmative litigation seeking declaratory
judgment, specific performance, damages, temporary or permanent
injunctions and any other available remedies.
No delay or omissions by DHCD in exercising any right or remedy
available to it under the Agreement shall impair any such right to remedy
or constitute a waiver or acquiescence in any Grantee default.
O. Conflict of Interest
Grantees shall ensure that the provision of any type or amount of assistance
may not be conditional on an individual's or family's acceptance or
occupancy of housing owned by the grantee, the sub - grantee, a parent
organization, or subsidiary. Grantees /sub - grantees, parent organizations,
or subsidiaries may not administer rapid re- housing or prevention
assistance and use the assistance for households residing in units owned
by the grantee /sub - grantee, parent organization, or subsidiary.

Individuals (employees, agents, consultants, officers, or elected or
appointed officials of the grantee or sub - grantee) may not both participate
in decision - making related to determining eligibility and receive any
financial benefit. This financial benefit may not be received by the specific
individual, any member of his /her immediate family or a business interest.
The restriction applies throughout tenure in the position and for a one -year
period following tenure.
P. Religious Influence
The Grantee may not engage in inherently religious activities, such as
worship, religious instruction, or proselytization as part of the programs or
services funded under VHSP. If an organization conducts these activities,
then they must be offered separately, in time or location, from the programs
or services funded under VHSP and participation must be voluntary for
program participants.
III. Additional Assurances
A. Grantee will give the DHCD, the Comptroller, HUD and any other authorized
state or federal representatives access to and the right to examine all
records, books, papers, or documents related to the Grant.
B. In accordance with federal law, grantee will provide that no person shall be
discriminated against on the basis of race, color, religion, sex, or national

Memorandum of Understanding
Between the City of Roanoke and the Council of Community Services
The Blue Ridge Continuum of Care (CoC) is the lead entity for the Department of Housing and
Community Development (DHCD),Virginia Homeless Solutions Program (VHSP). The agencies
listed below are entering into a Memorandum of Understanding (MOU) to provide for
coordination activities, project evaluation, CoC application activities, developing a CoC system,
training related to the emergency crisis response system, and VHSP compliance activities.
History of the Relationships
The Council of Community Services (Council) provides strong leadership for organizations and
individuals in the areas of planning, information, and referral services to improve the quality of life
in our communities. The Council was established to promote the welfare of the Roanoke Valley
community through the provision of a forum for the expression and the study of community needs;
the survey and evaluation of resources available; the improvement of existing resources; and the
establishment of new resources.
The City of Roanoke has partnered with the Council to deliver strategic planning to the CoC since
2006. Since that time we have collaborated on numerous projects to align our community outcomes
with federal and state plans addressing homelessness.
Development of the Application
The City of Roanoke, in collaboration with community partner agencies developed the DHCD-
VHSP grant application to include a planning component. Planning processes create a mechanism
to incorporate and coordinate key events throughout the year such as 1) the CoC's grant
applications to the U.S. Department of Housing and Urban Development and to DHCD; 2) the
annual Point -in -Time Count and Survey of the Homeless; 3) use of HMIS and other data tracking
tools to track system -level outcomes; 4) affordable housing study. The planning process results in
clearly defined roles and responsibilities for each part of the system. The planning process increases
collaboration among providers and better positions the CoC to be competitive for funding
opportunities locally and at the state and federal levels.
Ill. Roles and Responsibilities
The roles and responsibilities of partner agencies have been identified as follows:
Citv of Roanoke will:
1. Serve as fiscal agent for the sub - recipient contract award totaling $33,218.
2. Review and monitor monthly invoices for payment to the Council.
3. Provide co- leadership in carrying out the responsibilities of the MOU partner agency.
4. Attend training directly related to the implementation provisions of this MOU.
Council of Community Services will:
1) Action: Provide quarterly updates on DHCD -VHSP funded agencies at BRICH and CoC
meetings.
Deliverables:
• Collect monthly information from DHCD -VHSP funded agencies to include data
quality and timely spending of project funds.
• Share reports at the CoC and BRICH meetings on a quarterly basis.
2) Action: Execute quarterly HELPS meetings.
Deliverables:
• Organize and maintain partner list for HELPS communications.
• Create and distribute monthly agendas and minutes.
• Facilitate meetings.
• Track attendance.
3) Action: The completion and timely submission of the DHCD grant application and renewal
paperwork, in conjunction with CoC Lead.
Deliverables:
• Co -write the DHCD grant application with CoC Lead and VHSP recipients
• Assist with submitting the full application every two years, which includes gathering
required supplemental documentation and completing narrative descriptions. Next
complete application due spring 2022.
• Assist with submitting the renewal paperwork every two years, which includes
gathering required supplemental documentation and completing narrative descriptions.
Next renewal due date is spring 2021.
4) Action: Increase community awareness of CoC work as well as share available funding
opportunities that support the CoC mission.
Deliverables:
• Share local, state, and federal information related to homelessness and CoC work
through multiple media outlets such as the BRICH and CCS websites, CCS and CoC
Facebook pages, CoC Facebook group, as well as other available media outlets.
• Research and share funding opportunities through communication channels
identified above.
• Continue to develop information and communication channels through website and
social media updates. Draft press releases as needed.
IV. Timeline
The grant eriod for this collaborative effort coincides with the DHCD -VHSP grant period

V. Termination
This Memorandum may be terminated by the City of Roanoke or the Council of Community

Discussions have taken place with program partners regarding the utilization of VHSP funds.
They will continue the collaborative effort to serve victims of domestic violence in the rural
area. Additionally, collaborating parties have given input into project development, approved
the program budget(s), and continue to be involved planning and moving our Continuum
forward.
III. Roles and Responsibilities
The roles and responsibilities of partner agencies have been identified as follows:
City of Roanoke will:
1. Serve as fiscal agent for Safehome Systems in Covington, Virginia.
2. Receive quarterly program reports from agency director.
Upon receipt of verified invoice from agency, prepare payment for utilities for the

emergency shelter operations.
Safehome Systems Inc. will:
1. Provide emergency shelter to residents of SafeHome Systems.
2. Submit financial and program reports to the City of Roanoke as directed.
3. Submit monthly invoices for utility payments by the 10th working day of each month.
IV. Timeline
The roles and responsibilities described above are contingent on successful application of
receiving requested funding for this project. The beginning and end dates of this collaborative
effort would coincide with the grant period.

project.

Accept VDOT's award of $2,818,704 of SMART SCALE funds. Authorize the City

Federal -aid Projects and Appendix A document similar to the ones attached to

THIS AGREEMENT, made and executed in triplicate this day of

referred to as the LOCALITY and the Commonwealth of Virginia, Department of
Transportation, hereinafter referred to as the DEPARTMENT.
WHEREAS, the LOCALITY has expressed its desire to administer the work
described in Appendix A, and such work for each improvement shown is hereinafter
referred to as the Project; and
WHEREAS, the funds shown in Appendix A have been allocated to finance each
Project; and
WHEREAS, the LOCALITY is committed to the development and delivery of
each Project described in Appendix A in an expeditious manner; and;
WHEREAS, both parties have concurred in the LOCALITY's administration of
the phase(s) of work for the respective Project(s) listed in Appendix A in accordance with
applicable federal, state, and local law and regulations.
NOW THEREFORE, in consideration of the mutual premises contained herein,
the parties hereto agree as follows:
The LOCALITY shall:
a. Be responsible for all activities necessary to complete the noted phase(s) of each
Project shown in Appendix A, except for activities, decisions, and approvals
which are the responsibility of the DEPARTMENT, as required by federal or
state laws and regulations or as otherwise agreed to, in writing, between the
parties. Each Project will be designed and constructed to meet or exceed current
American Association of State Highway and Transportation Officials standards
or supplementary standards approved by the DEPARTMENT
b. Meet all funding obligation and expenditure timeline requirements in
accordance with all applicable federal and state laws and regulations, and
Commonwealth Transportation Board and DEPARTMENT policies and as
identified in Appendix A to this Agreement. Noncompliance with this
requirement can result in deallocation of the funding, rescinding of state
funding match, termination of this Agreement, or DEPARTMENT denial of
future requests to administer projects by the LOCALITY.

c. Receive prior written authorization from the DEPARTMENT to proceed with
preliminary engineering, right -of -way acquisition and utility relocation, and
construction phases of each Project.
d. Administer the project(s) in accordance with guidelines applicable to Locally
Administered Projects as published by the DEPARTMENT.
e. Maintain accurate and complete records of each Project's development and
documentation of all expenditures and make such information available for
inspection or auditing by the DEPARTMENT. Records and documentation for
items for which reimbursement will be requested shall be maintained for no less
than three (3) years following acceptance of the final voucher on each Project.
f. No more frequently than monthly, submit invoices with supporting
documentation to the DEPARTMENT in the form prescribed by the
DEPARTMENT. The supporting documentation shall include copies of related
vendor invoices paid by the LOCALITY and an up -to -date project summary
and schedule tracking payment requests and adjustments. A request for
reimbursement shall be made within 90 days after any eligible project expenses
are incurred by the LOCALITY. For federally funded projects and pursuant to
2 CFR 200.338, Remedies for Noncompliance, violations of the provision may
result in the imposition of sanctions including but not limited to possible denial
or delay of payment of all or a part of the costs associated with the activity or
action not in compliance.
g. Reimburse the DEPARTMENT all Project expenses incurred by the
DEPARTMENT if, due to action or inaction solely by the LOCALITY,
federally funded Project expenditures incurred are not reimbursed by the
Federal Highway Administration (FHWA), or reimbursements are required to
be returned to the FHWA, or in the event the reimbursement provisions of
Section 33.2 -214 or Section 33.2 -331 of the Code of Virginia, 1950, as
amended, or other applicable provisions of federal, state, or local law or
regulations require such reimbursement.
h. On Projects that the LOCALITY is providing the required match to state or
federal funds, pay the DEPARTMENT the LOCALITY's match for eligible
Project expenses incurred by the DEPARTMENT in the performance of
activities set forth in paragraph 2.a.
i. Administer the Project in accordance with all applicable federal, state, or local
laws and regulations. Failure to fulfill legal obligations associated with the
project may result in forfeiture of federal or state -aid reimbursements
j. Provide certification by a LOCALITY official that all LOCALITY
administered Project activities have been performed in accordance with all
federal, state, and local laws and regulations. If the LOCALITY expends over
$750,000 annually in federal funding, such certification shall include a copy of

the LOCALITY's single program audit in accordance with 2 CFR 200.501,
Audit Requirements.
k. If legal services other than that provided by staff counsel are required in
connection with condemnation proceedings associated with the acquisition of
Right -of -Way, the LOCALITY will consult the DEPARTMENT to obtain an
attorney from the list of outside counsel approved by the Office of the Attorney
General. Costs associated with outside counsel services shall be reimbursable
expenses of the project.
1. For Projects on facilities not maintained by the DEPARTMENT, provide, or
have others provide, maintenance of the Project upon completion, unless
otherwise agreed to by the DEPARTMENT.
m. Ensure compliance with the provisions of Title VI of the Civil Rights Act of
1964, regulations of the United States Department of Transportation (USDOT),
Presidential Executive Orders and the Code of Virginia relative to
nondiscrimination; and as a sub - recipient of federal funds, adopt and operate
under the DEPARTMENT's FHWA- approved Disadvantaged Business
Enterprise (DBE) Program Plan in accordance with 49 CFR Part 26.
The DEPARTMENT shall:
a. Perform any actions and provide any decisions and approvals which are the
responsibility of the DEPARTMENT, as required by federal and state laws and
regulations or as otherwise agreed to, in writing, between the parties and
provide necessary coordination with the FHWA as determined to be necessary
by the DEPARTMENT.
b. Upon receipt of the LOCALITY's invoices pursuant to paragraph l.f.,
reimburse the LOCALITY the cost of eligible Project expenses, as described in
Appendix A. Such reimbursements shall be payable by the DEPARTMENT
within 30 days of an acceptable submission by the LOCALITY.
c. If appropriate, submit invoices to the LOCALITY for the LOCALITY's share
of eligible project expenses incurred by the DEPARTMENT in the performance
of activities pursuant to paragraph 2.a.
d. Audit the LOCALITY's Project records and documentation as may be required
to verify LOCALITY compliance with federal and state laws and regulations.
e. Make available to the LOCALITY guidelines to assist the parties in carrying
out responsibilities under this Agreement.

Appendix A identifies the funding sources for the project, phases of work to be
administered by the LOCALITY, and additional project - specific requirements

DEPARTMENT's agent for the purpose of conducting survey work pursuant to
Section 33.2 -1011 of the Code of Virginia, 1950, as amended.
Nothing in this Agreement shall obligate the parties hereto to expend or provide
any funds in excess of funds agreed upon in this Agreement or as shall have been
included in an annual or other lawful appropriation. In the event the cost of a
Project is anticipated to exceed the allocation shown for such respective Project on
Appendix A, both parties agree to cooperate in providing additional funding for the
Project or to terminate the Project before its costs exceed the allocated amount,
however the DEPARTMENT and the LOCALITY shall not be obligated to provide
additional funds beyond those appropriated pursuant to an annual or other lawful
appropriation.
6. Nothing in this Agreement shall be construed as a waiver of the LOCALITY's or
the Commonwealth of Virginia's sovereign immunity.
7. The Parties mutually agree and acknowledge, in entering this Agreement, that the
individuals acting on behalf of the Parties are acting within the scope of their
official authority and the Parties agree that neither Party will bring a suit or assert
a claim against any official, officer, or employee of either party, in their
individual or personal capacity for a breach or violation of the terms of this
Agreement or to otherwise enforce the terms and conditions of this
Agreement. The foregoing notwithstanding, nothing in this subparagraph shall
prevent the enforcement of the terms and conditions of this Agreement by or
against either Party in a competent court of law.
The Parties mutually agree that no provision of this Agreement shall create in the
public, or in any person or entity other than the Parties, rights as a third party
beneficiary hereunder, or authorize any person or entity, not a party hereto, to
maintain any action for, without limitation, personal injury, property damage,
breach of contract, or return of money, or property, deposit(s), cancellation or
forfeiture of bonds, financial instruments, pursuant to the terms of this Agreement
or otherwise. Notwithstanding any other provision of this Agreement to the
contrary, unless otherwise provided, the Parties agree that the LOCALITY or the
DEPARTMENT shall not be bound by any agreements between either party and
other persons or entities concerning any matter which is the subject of this
Agreement, unless and until the LOCALITY or the DEPARTMENT has, in
writing, received a true copy of such agreement(s) and has affirmatively agreed,
in writing, to be bound by such Agreement.

9. This Agreement may be terminated by either party upon 30 days advance written
notice. Eligible Project expenses incurred through the date of termination shall be
reimbursed in accordance with paragraphs Lf, I.g., and 2.b, subject to the
limitations established in this Agreement and Appendix A. Upon termination, the
DEPARTMENT shall retain ownership of plans, specifications, and right of way,
unless all state and federal funds provided for the Project have been reimbursed to
the DEPARTMENT by the LOCALITY, in which case the LOCALITY will have
ownership of the plans, specifications, and right of way, unless otherwise mutually
agreed upon in writing.
10. Prior to any action pursuant to paragraphs Lb or l.g of this Agreement, the
DEPARTMENT shall provide notice to the LOCALITY with a specific description
of the breach of agreement provisions. Upon receipt of a notice of breach, the
LOCALITY will be provided the opportunity to cure such breach or to provide a
plan to cure to the satisfaction to the DEPARTMENT. If, within sixty (60) days
after receipt of the written notice of breach, the LOCALITY has neither cured the
breach, nor is diligently pursuing a cure of the breach to the satisfaction of the
DEPARTMENT, then upon receipt by the LOCALITY of a written notice from the
DEPARTMENT stating that the breach has neither been cured, nor is the
LOCALITY diligently pursuing a cure, the DEPARTMENT may exercise any
remedies it may have under this Agreement.
THE LOCALITY and DEPARTMENT acknowledge and agree that this
Agreement has been prepared jointly by the parties and shall be construed simply and in
accordance with its fair meaning and not strictly for or against any party.
THIS AGREEMENT, when properly executed, shall be binding upon both parties,
their successors, and assigns.
THIS AGREEMENT may be modified in writing by mutual agreement of both
parties.

A RESOLUTION supporting four applications and authorizing the City Manager to
submit such applications to the Virginia Department of Transportation (VDOT) for funds from
the Smart Scale Program for certain projects; and authorizing the City Manager to take certain
actions in connection with such projects.
WHEREAS, the City of Roanoke desires to submit applications for an allocation of funds
provided by VDOT from the Smart Scale Program for the projects referred to in the City Council
Agenda Report dated August 3, 2020, to this Council.
THEREFORE, BE IT RESOLVED BY THE Council of the City of Roanoke that:
1. The City Council hereby supports the applications referred to herein and hereby
authorizes the City Manager to submit such applications to VDOT for funds from VDOT's
Smart Scale Program for the following four projects, as more particularly described in the City
Council Agenda Report dated August 3, 2020:
a. Orange Avenue (Route 460) at Blue Hills Drive.
b. Orange Avenue (Route 460) at King Street.
C. Orange Avenue (Route 460) at Seibel Drive /Hickory Woods.
d. Valley View Boulevard and Aviation Drive.
2. The City Manager is further authorized to take such further actions and execute such
further documents, approved as to form by the City Attorney, as may be necessary to submit the
above applications and to furnish such additional information as may be required for such
applications.

Subject: SMART SCALE Resolution of Support for FY 2022 Applications
Background:
Authorized by the Virginia General Assembly in 2014, SMART SCALE is a biannual
statewide prioritization process for the funding of transportation projects using the
following criteria: improvements to safety, congestion reduction, accessibility, land
use, economic development and the environment. As a locality with a population under
200,000, the City is eligible to submit a maximum of four (4) applications to be scored
and ranked against other proposed transportation projects throughout the
Commonwealth.
Considerations:
For the current Smart Scale application period, City staff plans to submit the following
four (4) applications for funding:
• Orange Avenue (Route 460) at Blue Hills Drive - The project includes turn
restrictions, signal phase reductions, and geometric changes to preserve
existing capacity and provide additional capacity along the 460 corridor. Total
estimated cost of $3.38 million.
• Orange Avenue (Route 460) at King Street - The project includes turn
restrictions, signal phase reductions, and geometric changes to preserve
existing capacity and provide additional capacity along the 460 corridor. Also
included is a thru cut at King Street, a median break west of King Street and at
Lynn Brae Drive. Total estimated cost of $2.75 million.
• Orange Avenue (Route 460) at Seibel Drive /Hickory Woods - The project
includes geometric changes along with turn restrictions to existing intersections
and adjacent median openings to best maintain and preserve capacity along 460
corridor. Total estimated cost of $325,000.
• Valley View Boulevard and Aviation Drive - This project would provide pedestrian
accomodations from the Roanoke - Blacksburg Regional Airport to Valley View
Mall. Total estimated cost of $3.48 million.
One of the program requirements is a resolution of support from the local governing
body that will be included with the applications.
The Roanoke Valley Transportation Planning Organization, on behalf of the City of
Roanoke, plans to submit one (1) application associated with the City's improvements
to the Route 460 corridor.
• Orange Avenue (Route 460) Improvements between 11 `h Street, NE and Gus
Nicks Blvd. These improvements consist of the implementation of alternative
intersection configurations, modifications/ closures of some median breaks and
some restrictions on turning/ through movements throughout the corridor.
These changes are intended to preserve and enhance capacity along the Orange
Ave (Route 460) corridor.
The Roanoke Valley Transportation Planning Organization, on behalf of the County of
Roanoke, plans to submit two (2) applications associated with other improvements to
the Route 460 corridor.
• Route 460 at West Ruritan Intersection Improvements - This project would
construct a Thru Cut at the intersection of Route 460 and West Ruritan Road to
prohibit northbound and southbound movements to cross Route 460.
• Route 460 Intersection from Carson Road to Huntridge Road. This project would
improve a series of intersections with Innovative Intersections and improve
pedestrian accommodations.
Recommended Action:
Adopt the accompanying resolution in support of the City's applications as well as the
applications from Roanoke County and the Transportation Planning Organization,
recognizing the regional significance of this corridor.
Authorize the City Manager to take such further actions and execute such documents,
approved as to form by the City Attorney, and to furnish additional information and /or
documents as may be required for the City's Smart Scale applications.
