The City Manager offered the following comments: City Pools Are Open for the Summer • After a one -year hiatus, the pools at Washington Park and Fallon Park will be open this summer beginning today, June 4. • Reopening the pools was made possible thanks to a fundraiser started by Roanoke attorney John Fishwick. Upon hearing the pools weren't going to open in 2020, he and other community members raised $53,000 for the cause. • The money raised was given to the City and is being used for pool staff wages. • While there are still some safety restrictions in place, the pools will be in operation and open to the public. • Information about daily hours of operation and pool rates can be found at www.PlayRoanoke.com. This summer Roanoke will roll out a traffic speed awareness campaign • The campaign is Phase 2 of the Pedestrian Safety Campaign conducted by the Transportation Division in 2020, through a grant with the Virginia Department of Motor Vehicles. • Last year's emphasis was on crosswalk safety — "Every Corner is a Crosswalk." • This year, the focus is on increasing awareness of speeding as a pedestrian safety issue, especially on priority minor arterials, neighborhood collectors, and residential streets in the City. • Plans include special events, neighborhood walks, contests, and other activities to engage and educate the community. • More information will be shared in the near future; the campaign will kickoff on June 22. b. CITY ATTORNEY: 1. Approval to amend and reordain Ordinance No. 40998 - 110617 to lower the insurance required of the property owner to maintain an encroachment from $2,000,000.00 in general liability insurance coverage to $300,000.00 in personal liability insurance coverage for a structure located at 2417 Guilford Road, S. W., into the right of way. Adopted Ordinance No. 42074 - 060721. (6 -0) 7 2. Amendment of Ordinance Nos. 41930, 41931, 41932, 41933, 41934, and 41935 - 122120 to provide for an effective date upon the date the integrated tax revenue system is successfully implemented, or January 3, 2022, whichever date comes earlier, for implementation has been delayed and is now expected to occur on October 19, 2021. MOTIONS AND MISCELLANEOUS BUSINESS: a. Inquiries and /or comments by the Mayor and Members of City Council. Council Member Cobb expressed thanks to Humble Hustle and Executive Director Xavier Duckett, for hosting `Chalk It Up' events across the city on Saturday, June 5, that expressed love and put smiles on faces. Mr. Cobb also praised the Carilion Clinic IRONMAN 70.3 Virginia's Blue Ridge event held on Sunday, June 6, which event brought approximately 2,500 competitors to the area who completed in a 1.2 -mile swim through Carvins Cove, a 56 -mile bike ride along the Blue Ridge Parkway, and a 13.1 -mile run on the Roanoke Greenway; and thanked the organizer of the events, which celebrated furiousness of all athletes. Vice -Mayor White -Boyd recognized and thanked former Council Member Michelle Davis for her efforts in getting the IRONMAN event to Roanoke; and Council Member Bestpitch thanked the hundreds of volunteers who made the event a success. Council Member Moon Reynolds inquired about the removal of Resource Officers from Roanoke City Public Schools; wherein, the City Manager advised that the School Superintendent had addressed the matter and Resource Officers would be returning to the Schools this fall. �11 b. CITY COUNCIL AGENDA REPORT To: Honorable Mayor and Members of City Council Meeting: June 7, 2021 Subject: Acceptance of the 2021 Financial Empowerment Center Implementation Grant Award Background: Cities for Financial Empowerment ( "CFE ") Fund, Inc. is an organization with a mission to help improve the financial stability of low and moderate - income households around the country. They do this by embedding financial empowerment strategies into local government infrastructures. In practical terms, CFE Fund's goal is to make free, one -on -one professional financial counseling a standard public service provided by the participating municipality. The CFE Fund, Inc. selected Roanoke for participation and previously gave the City a $150,000 "Implementation Grant" for the first year of operating a "Financial Empowerment Center ("FEC") in which the City offers no -cost financial counseling for low and moderate income individuals. The City has now been approved for the second year of the "Implementation Phase" of the Roanoke FEC. Considerations: City Council action is needed to accept the 2021 Financial Empowerment Center Implementation Grant award. The second year grant is for $100,000 and the City is required to make a matching $200,000 contribution to the program. The City's matching funds include $40,000 which has already been appropriated in the City's Fiscal Year 2021 budget as one -time funds through budget ordinance 41762-061520 which will be used toward the operation of the FEC. Subject to appropriation in the FY22 Adopted Budget, an additional contribution of $50,000 will made by the City in the form of an in -kind match of seventy -five percent of the salary of the Local Government Manager (Financial Stability Specialist) who is the City's direct manager of the program. The remaining funds will be provided by (a) the City's Financial Counseling Provider, Freedom First Enterprises, which has agreed to pay the salary of two full time employees to work towards providing counseling services; (b) a portion of a state and local government financial wellness grant, which is part of a new initiative by the Wells Fargo Foundation, in collaboration with the Center for State and Local Government Excellence, the International Public Management Association for Human Resources and National Association of State Treasurers' Foundation; and (c) a community grant from Carilion Clinic. Recommended Action: Accept the grant as described above and authorize the City Manager to execute any required grant agreements, to be approved as to form by the City Attorney. Adopt the accompanying budget ordinance to establish a revenue estimate in the Grant fund of $100,000 from the CFE. Revenue estimates of the local match will consist of a Third Party donation in the form of an in -kind match from Freedom First Enterprises of $106,724, an in -kind match of $50,000 for salary and benefits subject to appropriation in the FY22 Adopted Budget in the General Fund, and transfer funding in the amount of $40,000 from the Miscellaneous account 01-300-9410-2170. Provided such fee is paid within fifteen days of the original date due a penalty of two (2) percent will be assessed but if any amount of such fee remains due and owing on or after the sixteenth day after the original date due an additional eight (8) percent penalty will be assessed on the remaining amount due The stormwater utility fee may be billed separately or may be combined with other billings, and, when combined, payment will be applied first to any applicable solid waste collection fees, then to any applicable stormwater utility fee, and then to all other taxes and fees, as determined by the city treasurer, in accordance with section 15.2- 2114.G, Code of Virginia (1950), as amended. Provided, however, where any such account has one or more delinquent amounts past due, payment will be applied first to such fee or tax, together with any ,PI& cumulative interest and penalties thereon, that is the most delinquent before the payment will be applied to any current amounts due. 2. Section 14.1 -5(d), Fees for collection, of Article I, In General, of Chapter 14.1, Solid Waste Management, of the Code of the City of Roanoke (1979), as amended, is hereby amended and re- ordained to read and provide as follows: Sec. 14.1 -5. Fees for Collection (d) Pursuant to section 15.2 -105, Code of Virginia (1950), as amended, the failure to pay the full amount of the solid waste collection fee when due will be assessed a penalty of ten (I o) perc wo (2) percent if the tax is paid in full within fifteen days of the original date due but if any amount of such fee remains due and owing on or after the sixteenth day after the original date due an additional eight (8) percent penalty will be assessed on the remaining amount due and incur interest at the rate of ten (10) percent per annum. 3. To: Honorable Mayor and Members of City Council Meeting: June 7, 2021 Subject: Amend and Reordain Section 11.5 -8, Billing, penalties, and interest, Chapter 11.5 Stormwater Utility and Section 14.1 -5, Fees for collection, Article I, In General, Chapter 14.1, Solid Waste Management Background: By Ordinance No. 41932 - 122120, adopted December 20, 2020, City Council amended and reordained Section 32 -19, Penalty and interest on delinquencies - Generally, Article II, Real Estate Taxes Generally, Chapter 32, Taxation, Code of City of Roanoke (1979) as amended ( "City Code "), to provide for a graduated penalty for payments of real estate taxes made after the original date due the City of Roanoke. The amendments provided for a penalty in the amount of two percent (2%) of the tax due, provided the payment was made within fifteen days of the original date due. After the sixteenth day following the original due date, an additional eight percent (8%) penalty is added to any additional amounts due remaining unpaid. Pursuant to Section 11.5-1 et seq., City Code, the City assesses a stormwater fee on each qualifying parcel of real estate based on the parcel's impervious surface cover. Section 11.5-8 of City Code provides that the stormwater utility fee shall be billed and subject to the same penalties and interest as prescribed in Section 32 -19 of City Code (i.e. ten (10) percent). The stormwater fee is billed on the same schedule as real estate taxes, and included on the same statement. Pursuant to Section 14.1 -5 of City Code, the City assesses a fee for the collection of solid waste from parcels of qualifying real estate. Like the stormwater fee, the solid waste fee is combined with the real estate tax billing and payable on the same schedule. Failure to pay the solid waste collection fee when due results in a penalty of ten (10) percent of the amount of such fee being assessed. Considerations: The above cited sections of City Code that authorize penalties to be assessed on stormwater utility fees and solid waste collection fees that are paid late do not allow for a graduated penalty to be applied in the same manner as late paid real estate taxes. The City Treasurer, City Auditor, and relevant City staff recommend that Section 11.5 -8(a), Billing, penalties, and interest, and Section 14.1- 5(d),Fees for collection, of City Code be amended to provide the same graduated penalty for the stormwater utility fee, and the solid waste collection fee, respectively, as afforded real estate payments paid after the original date due (i.e. a penalty in the amount of two percent (2%) assessed on the amount due, provided the fees are paid within fifteen days of the original due date, with an additional eight percent (8%) penalty assessed on all remaining fees due on or after the sixteenth day following the original due date). Amending the City Code in this manner will provide uniformity and consistency among real estate tax, stormwater utility fee, and solid waste collection fee payments, which are combined and billed on the same statement, which will further assist taxpayers. Recommended Action: Adopt the attached ordinance amending and reordaining Chapter 11.5, Stormwater Utility, Section 1 1.5 -8(a), Billing, penalties, and interest, and Section 14.1 -5(d), Fees for collection, Article I, In General, Chapter 14.1 , Solid Waste Management, in the manner set forth above, and provide for an effective date of January 3, 2022, or the date that the City's integrated tax and treasury system is successfully implemented, whichever date comes earlier. CITY COUNCIL AGENDA REPORT To: Honorable Mayor and Members of City Council Meeting: June 7, 2021 Subject: Amend and Reordain Section 32 -124, When due and payable, Article IV, Tax on Real Estate and Tangible Personal Property of Public Service Corporations, Chapter 32, Taxation, Code of the City of Roanoke (1979) to Change the Due Date of the First Installment of Real Estate Taxes. Background: Section 32 -122 of the Code of the City of Roanoke ( "City Code ") authorizes the City of Roanoke, in part, to assess and collect a tax upon the real estate and real estate improvements of public service corporations assessed by the state corporation commission or the state department of taxation, at "one hundred (100) percent of fair market value and not in the process of equalization by such commission or department, at the rate of one dollar and twenty -three cents ($1.23) on every one hundred dollars ($100.00) of such assessed value." Section 32 -124 of City Code provides that such tax shall be due and payable during the tax year for which the same are assessed in two (2) installments, with the first installment being due on October 5, and the second installment being due on April 5. In the event the state corporation commission does not complete its regular assessment of such real estate and real improvements for the current year in time for the October 5 installment to be assessed and billed, Section 32 -124 of City Code provides that such assessment shall be based on the preceding year's assessment. When the city receives the current year's assessment from the state corporation commission for the second installment due on April 5 to be properly assessed, Section 32 -124 provides that the total of such real estate taxes for the current tax year shall be adjusted between the city and any public service corporation affected on the basis of the assessment by the state corporation commission for the current year. Considerations: The Commissioner of Revenue does not usually receive current year's assessment of real estate and real estate improvements of public service corporations from the state corporation commission until late September of each year. This does not give sufficient time to prepare and bill public service corporations for the tax in time for the October 5 due date. Such taxes are rarely paid by the October 5 due date for this reason. The Commissioner of Revenue and relevant city staff recommend that Section 32 -124 of City Code be amended to change the due date of such taxes from October 5 to December 5. Amending the City Code in this manner will allow the Commissioner of Revenue to properly assess public service corporations its real estate tax based on the current year's assessment by the state corporation commission, as the Commissioner would have received the current year's assessment from the state corporation commission in time to bill public service corporations for a December 5 due date. Recommended Action: For the aforementioned reasons, I recommend that City Council adopt the attached ordinance amending Section 32 -124, When due and payable, Article IV, Tax on Real Estate and Tangible Personal Property of Public Service Corporations, Chapter 32, Taxation, Code of the City of Roanoke (1979) as amended. -------------------------- Robert S. GRTC agrees that the encroachment shall be removed at any time from the right -of -way upon written demand of the City of Roanoke, and that such placement and removal of the encroachment shall be at the sole cost and expense of GRTC. GRTC agrees that it shall be responsible for the installation, maintenance, operation, cleaning, repair, restoration, of the encroachment, and it shall replace any damage to the bus shelter, and any damage to the land, caused by the placement and removal of the encroachment, at GRTC's sole cost and expense. 3. GRTC, its grantees, assigns, or successors in interest, shall, for the duration of this permit, maintain on file with the City Clerk's Office evidence of insurance coverage for such bus shelter in an amount not less than $2,000,000 of general liability insurance. The certificate of insurance must list the City of Roanoke, its officers, agents, and employees as additional insureds, and an endorsement by the insurance company naming these parties as additional insureds must be received within thirty (30) days of passage of this ordinance. The certificate of insurance shall state that such insurance may not be canceled or materially altered without thirty (30) days written advance notice of such cancellation or alteration being provided to the Risk Management Officer for the City of Roanoke. 4. Dear Mayor Lea and Members of Council: By Ordinance No. 40998 - 110617, adopted November 6, 2017, City Council authorized the encroachment of a deck and fence, approximately 1,118 in area, extending from residential property at 2417 Guilford Road, S.W. ( "Property "), into the public right of way of an alley adjacent to the Property. The Property was then owned by Jennifer Suttles, and the authorization for the encroachment, and the terms and obligations required of the Property owner to maintain the encroachment were made binding on Jennifer Suttles, and her successors and assigns in title. Among the conditions in the ordinance required to be complied with by the Property owner was that the Property owner must maintain two million dollars ($2,000,000) of general liability insurance coverage. The Property is now owned by Joseph C. Gallucci who desires to sell the Property. However, because of the amount of the insurance required to maintain the encroachment, he is encountering difficulty in selling the Property to a prospective purchaser due to the lending requirements of the prospective purchaser's lender. The cost of purchasing general liability insurance in the amount required by the ordinance is unduly burdensome for a residential property owner. Relevant City staff, including Jackie Clewis, Risk Manager, recommend that Ordinance No. 40998- 110617 be amended to impose a requirement of three hundred thousand ($300,000) in personal liability insurance coverage instead of $2,000,000 in general liability insurance coverage that must be maintained by the Property owner for the encroachment. Ms. Clewis advises that this amount is an appropriate amount of coverage for an encroachment from residential property, and should adequately protect the City against any claims arising brought against the City arising from the encroachment into the public right of way. For the aforementioned reasons, I recommend that City Council amend and reordain Ordinance No. 40998 - 110617, adopted by City Council on November 6, 2017, to lower the insurance required of the Property owner to maintain the encroachment from $2,000,000 in general liability insurance coverage to $300,000 in personal liability insurance coverage. These amendments are summarized as follows: 1. Ordinance No. 41931 - 12210- This ordinance amended Section 32- 226.1, Penalty for late remittance or false return (Admissions Tax) Section 32- 247.1, Penalty for late remittance or false return (Transient Occupancy Tax), and Section 32 -295, Penalty for late remittance or false return (Food and Beverage Tax), to provide a flat ten percent (10 %) penalty to the amount of such taxes then due and owing if the seller did not file the tax return or pay the tax within the time required. Previously, theses sections provided for a staggered penalty in the amount of ten (10 %) percent if the failure was not for more than thirty days, with an additional five percent (5 %) of the total amount tax owed for each additional thirty days during which the failure continued, not to exceed twenty five percent (25 %) of the taxes collected or $10.00, whichever was greater. 2. Ordinance No. 41932 - 122120- This ordinance amended Section 32 -19, Penalty and interest on delinquencies - Generally (Real Estate Taxes) and Section 32 -106, Penalty and interest on delinquencies- General ly'-- to provide a reduced penalty in the amount of two percent (2 %) in the event of late payments, provided the tax due is paid in full within fifteen days of the original due date. If the tax is not paid in full within fifteen days of the original due date, an additional eight percent (8 %) will be applied to the amount due. Originally, these sections provided for a ten percent (10 %) penalty to be applied for any payment made after the due date. 3. Ordinance 41933 - 122120- This Ordinance amended subsection (d) of Section 32 -104, levied; rate. (Personal Property Tax) which relates to the special personal property tax rate for motor vehicles which use clean special fuels to provide that the credit the property owner receives in the amount of ten percent (10 %) shall be applied before the state's personal property tax relief has been applied. Previously, this section provided that the ten percent credit is to be applied after the state's personal property tax relief (PPTRA) has been applied to the tax. 4. Ordinance 41934 - 122120- This Ordinance amended Section 32 -155, Penalty upon bank for failure to comply with article (Bank Franchise Tax) to make the penalty assessed against a bank that pays the bank franchise tax late 5 %, consistent with current state code requirements. Currently, that section provides that the penalty will be not less than one hundred but no more than five hundred, which is what state code previously provided before being amended several years ago. 5. Ordinance 41935 - 122120- This Ordinance amended Section 19 -20, When application due; when tax payable; extensions; penalty and interest for late payment; report and collection of delinquencies (License Taxes) to clarify that the penalty for delinquent license taxes shall be applied from the day following the original due date of the tax; and 6. Ordinance 41930 - 1221120- This Ordinance authorized the City Treasurer to waive interest charges for the Transient Occupancy Tax and Admission Tax, to charge a penalty of ten percent of original total tax collections, and suspend minimum dollar penalties for such taxes. This amendment was necessitated by the need for the City Treasurer to provide for efficiencies in the collection and administration of those taxes and the Food and Beverage Tax until the City's new integrated tax revenue system could be implemented. The above Ordinances all had effective dates of July 1, 2021, with the exception of Ordinance 41930- 1221120 which had an effective date of January 1, 2021, and was to remain in effect until the City's integrated tax revenue system was implemented or June 30, 2021, whichever date came earlier. These changes were designed to coincide with the launch of the integrated tax revenue system that was expected to launch July 1, 2021. Implementation of the integrated tax revenue system has been delayed, and is now expected to occur on October 19, 2021. City staff recommends that the aforementioned ordinances be further amended to become effective upon the date the integrated tax revenue system is successfully implemented, or January 3, 2022, whichever date comes earlier. For the aforementioned reasons, I recommend that City Council adopt the attached Ordinance amending Ordinance Nos. 41931 - 12210, 41932 - 122120, 41933 - 122120, 419341- 122120, 41935- 122120, and 41930 - 1221120 to provide for an effective date upon the date the integrated tax revenue system is successfully implemented, or January 3, 2022, whichever date comes earlier.
