Mayor Lea announced that Council Member Moon Reynolds requested to participate via Zoom in the 2:00 p.m. and 7:00 p.m. meetings of Council. Council voted unanimously to allow participation via Zoom. The Invocation was delivered by Council Member Joseph L. Cobb. The Pledge of Allegiance to the Flag of the United States of America was led by Mayor Sherman P. Lea, Sr. Welcome. Mayor Lea. NOTICE: Council meetings will be televised live and replayed on RVTV Channel 3 on Thursdays at 7:00 p.m., and Saturdays from 10:00 a.m. to 5:00 p.m.; and video streamed through Facebook Live at facebook.com/RoanokeVa. Council meetings are offered with closed captioning for the hearing impaired. 1 ANNOUNCEMENTS: The Council of the City of Roanoke is seeking applications for the following current vacancies and/or upcoming expirations of terms of office: Roanoke Neighborhood Advocates –one vacancy Roanoke Valley Regional Cable Television Committee – one vacancy Towing Advisory Board – one vacancy (Citizen at-large) Access the City's homepage to complete an online application for the abovementioned vacancies. 2. C-1 Minutes of the regular meeting of City Council held on November 1, 2021. RECOMMENDED ACTION: Dispensed with the reading of the minutes and approved as recorded. C-2 A communication from the City Manager recommending adoption of the Calendar of Events for Budget Development Activities for Fiscal Year 2022 — 2023. RECOMMENDED ACTION: Concurred in the request. 2 C-3 A communication from Debbie Bonniwell, Chief Executive Officer, Blue Ridge Behavioral Healthcare, requesting that Council ratify the appointment of Colonel Bobby Russell as an at-large member of the Board of Directors for a three-year term of office ending December 31, 2024. RECOMMENDED ACTION: Concurred in the request. C-4 Report of qualification of Amanda McGee as a member of the Board of Zoning Appeals for a three-year term of office, commencing January 1, 2022 and ending December 31, 2024. CITY MANAGER: BRIEFING: NONE. ITEMS RECOMMENDED FOR ACTION: 1. Appointment of Battalion Chief Trevor W. Shannon as the Emergency Management Coordinator for the City of Roanoke. Adopted Resolution No. 42231-122021. (7-0) 3 2. Amendment of the FY 2021 Asphalt Concrete Overlays Contract between the City of Roanoke and Boxley Materials Company. Adopted Resolution No. 42232-122021. (7-0) COMMENTS OF THE CITY MANAGER. The City Manager shared the following comments: 2021 Neighborhood Partnership Awards • This year's award winners will be announced at the beginning of City Council's 7 p.m. meeting tonight. • The City is proud to have this opportunity to recognize neighborhood organizations and individuals who have partnered with City departments, Schools, nonprofits, businesses, and institutions to make a difference in our community through their service. 2022 Solid Waste Collection & Hazardous Weather Preparation Guide • Residents will receive a copy of the Guide in the mail this month. • It contains information about year-round solid waste collection, including a calendar that shows when trash, recycling, and bulk and brush will be picked up. • The Guide also informs citizens about snow removal, flood preparedness, and offers emergency contact information. • A digital copy of the Guide is posted on the City's website in English and Spanish. Free Basketball Tournament, DJ Battle • Roanoke Parks and Recreation will offer two free events on Jan. 29: o A 3 vs. 3 Basketball Tournament at the Berglund Center, followed by a Battle of the DJs after party at the Eureka Recreation Center. • These events are free to the community to participate in and attend. They are part of the Star City Safe Initiative to offer expanded services and access to public facilities, to keep our youth and neighborhoods safe through programming and engagement. • Registration information is available online at PLAYRoanoke.com. 4 b. MUNICIPAL AUDITOR: 1. Amendment of Ordinance No. 42075-060721 to change the effective date of Ordinance Nos. 41931, 41932, 41934 and 41935- 122120, from July 1, 2021, until the date the integrated tax revenue system is successfully implemented, or July 1, 2022 whichever date comes earlier. Adopted Ordinance No. 42233-122021 and Resolution No. 42234-122021. (7-0) 8. REPORTS OF COMMITTEES: a. A report of the Roanoke City School Board requesting appropriation of funds for various educational programs; and a report of the City Manager recommending that Council concur in the request. A resolution commending the services rendered to the City of Roanoke by Melinda Mayo as Communication and Media Officer, on the occasion of her retirement. Adopted Resolution No. 42236-122021. (7-0) b. An ordinance to raise minimum wage for all public safety City employees and a one-time stipend to all full-time public safety City employees employed by the City. Adopted Ordinance No. 42237-122021. (7-0) C. An ordinance to raise minimum wage for all non-public safety City employees and one-time wage enhancement payment to certain employees employed by the City. Adopted Ordinance No. 42238-122021. (7-0) 5 d. An ordinance to pay 25 police officer recruits a sign-on bonus. Adopted Ordinance No. 42239-122021. (7-0) e. An ordinance to approve a one-time payment of $2,000.00 to all full-time public safety employees employed by the City during a certain period. Adopted Ordinance No. 42240-122021. (7-0) f. The use plateaued in the Summer, but there was still an overall 17% rease year over year. (*many caveats). ■ "Local" trails were more likely to report positive perspectives on the increase, long distance trails saw it as a mixed bag. Water Trails had specific issues in this time of closures and concerns with new users. ■ Natural surface trails, such as hiking trails, expressed concerns about overuse. CITY COUNCIL AGENDA REPORT To: Honorable Mayor and Members of City Council Meeting: December 20, 2021 Subject: Final Amendment to the FY21 Asphalt Concrete Overlays Contract with Boxley Materials Company Background: The City of Roanoke entered into a contract, dated .July 13, 2020, with Boxley Materials Company to provide asphalt concrete overlays and pavement profiling of various streets within City limits. The amount of this contract was $3,294,218.90. Several arterial streets in the paving contract were accepted for paving by VDOT in their State of Good Repair Program. As a result, 22 additional residential street segments were added to the City's FY21 paving location list. For some street segments, additional asphalt quantities were required for flares, tie-ins, and thin surface layers beyond the quantities originally estimated. Lane configurations were changed on Colonial Avenue and Brandon Avenue to improve safety for motorists, pedestrians, and cyclists, including the addition of dedicated green bike lanes. The actual amount of pavement markings and green bike lane paint exceeded original cost estimates due to field revisions deemed necessary for the safe transition of cyclists on Colonial Avenue between Wonju Street and the 220 Expressway off ramp. This safer transition was accomplished by lengthening the dedicated green bike lane on Colonial Avenue. Additional funding for traffic markings at these locations has been secured. A contract amendment in the amount of $24,151 .44 is required for the work described above. Paving operations and reconfigured traffic markings provide improved rideability and safer roadway conditions for pedestrians, motorists, and cyclists in the City. Change Order Nos. 1 -3 increased the amount of the Contract to $3,852,249.90. Change Order No. 4 was approved by City Council pursuant to Resolution No. 42178-101821 and increased the contract amount to $4,167,661 .36. Considerations: City Council approval is needed to amend the FY21 Asphalt Concrete Overlays and Pavement Profiling contract and increase the original contract value by a total of 27.2% to $4,191 ,812.80. WHEREAS, by Resolution No. 41102-041618, adopted by Roanoke City Council on April 16, 2018, City Council authorized the City Treasurer to (1) waive interest charges for Transient Occupancy Tax and Admission Tax, (2) charge a penalty of ten percent (10%) of total original tax collections for late payment of Admission Tax, Prepared Food and Beverage Tax, and/or Transient Occupancy Tax, and take such other actions as necessary to provide for the implementation, enforcement, and administration of that Resolution, to ensure the efficient operations of the City Treasurer's Office until a new integrated tax revenue system could be implemented, WHEREAS, Resolution No. 41102-041618, by its terms, sunset on December 31, 2020, before the new integrated tax revenue system could be implemented, WHEREAS, City Council adopted Resolution No. 41930-122120 on December 21, 2020, authorizing the City Treasurer to continue the aforementioned changes until the new integrated tax revenue system was fully implemented or June 30, 2021, whichever date first occurred. 1 WHEREAS, due to the need for customization and further testing of certain components of the new integrated tax revenue system, implementation of such system has been delayed until a date on or before July 1, 2022, City staff desires that the actions authorized the City Treasurer by Resolution No. 41102-041618 continue until July 1, 2022, or until the new integrated tax revenue system is implemented, whichever comes first, all in order to ensure the efficient operations of the City Treasurer's Office. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Roanoke as follows: 1. Dear Mayor Lea and Members of Council: Background: By Resolution No. 41102-041618, adopted by City Council on April 16, 2018, the City Treasurer was authorized to perform the following actions relating to trust taxes: (1) waive interest charges for the Transient Occupancy Tax and Admission Tax retroactive from March 1, 2018 through December 31, 2020, (2) assess a penalty of ten percent (10%) for late payment of the Admission Tax, Prepared Food and Beverage Tax, and Transient Occupancy Tax, and(3) suspend minimum dollar penalties due for the Admission Tax, Prepared Food and Beverage Tax, and Transient Occupancy Tax. These changes were necessitated due to administration of these taxes being transferred from the Department of Finance to the Commissioner of Revenue and City Treasurer. It was recommended that these changes be made due to the complexity of applicable law and the limitations of the City's software that processes interest and penalties for these taxes. These software limitations required manual adjustments to be made by staff, creating potential problems that would exceed the nominal dollar amounts generated by penalties and interest for these taxes. Resolution No. 41102-041618 authorized these changes to continue until the City implemented a new integrated tax revenue system("PCI"), or December 31, 2020,whichever date came first. On December 21, 2020, City Council adopted Resolution No. 41930-122120 authorizing the City Treasurer to continue these changes until PCI was fully implemented or June 30, 2021, whichever date first occurred. Additionally, City Council adopted Ordinances Nos. 41931-122120, 41932- 122120, 41934-122120, and 41935-122120, to authorize the following additional actions under the City Code: 1. Ordinance No. 41931-12210. This Ordinance amended Section 32-226.1, Penalty for late remittance or false return(Admissions Tax) Section 32-247.1, Penalty for late remittance or false return(Transient Occupancy Tax),and Section 32-295,Penalty for late remittance or false return(Food and Beverage Tax),to provide a flat ten percent(10%)penalty to the amount of such taxes then due and owing if the seller did not file the tax return or pay the tax within the time required. Ordinance No. 41932-122120. This Ordinance amended Section 32-19, Penalty and interest on delinquencies-Generally (Real Estate Taxes) and Section 32-106, Penalty and interest on delinquencies-Generally, (Personal Property Tax)to provide a reduced penalty in the amount of two percent (2%) in the event of late payments, provided the tax due is paid in full within fifteen days of the original due date. If the tax is not paid in full within fifteen days of the original due date, an additional eight percent (8%) will be applied to the amount due. Originally, these sections provided for a ten percent(10%) penalty to be applied for any payment made after the due date. 3. Ordinance No. 41934-122120. This Ordinance amended Section 32-155, Penalty upon bank for failure to comply with article(Bank Franchise Tax)to make the penalty assessed against a bank that pays the bank franchise tax late 5%, consistent with current state code requirements. Currently, that section provides that the penalty will be not less than one hundred but no more than five hundred, which is what state code previously provided before being amended several years ago; and 4. Ordinance No.41935-122120. This Ordinance amended Section 19-20,When application due,• when tax payable; extensions; penalty and interest for late payment; report and collection of delinquencies (License Taxes) to clarify that the penalty for delinquent license taxes shall be applied from the day following the original due date of the tax. The above referenced Ordinances had effective dates of July 1,2021 and were intended to coincide with the launch of PCI, which, at that time, was expected to occur on or before July 1, 2021. Because PCI was not able to be launched on or before July 1, 2021, City Council adopted Ordinance No. 42075-060721 on June 7, 2021, which amended Ordinances Nos. 41931-12210, 41932-122120, 41934-122120, and 41935-122120 by changing the effective date of such Ordinances from July 1,2021,until the date PCI was successfully implemented or January 3,2022, whichever date came earlier. Considerations: Due to the need for customization and further testing of the real estate billing component of the PCI system,we are rescheduling system go live to be completed no later than July 1,2022. WHEREAS, Dr. Hartman has focused her career on science-drive►h approaches to the prevention of'school dropouts, teen pregnancy, obesity, and substance misuse, and worked primarily with youth, until her shift into the addiction treatment field; WHEREAS, as a Junior League volunteer, Dr. Hartman brought a teen pregnancy prevention program to Roanoke and was named the Director of Youth Development at Family Service of Roanoke Valley, where she worked for 15 years; WHEREAS,after retiring from Family Service of Roanoke Valley,Dr. Hartman began her work with Carilion Clinic, establishing an adolescent addiction treatment program called Back on Track; WHEREAS, as a current faculty member of the Virginia Tech Carilion School of'Medicine,Dr. Hartman serves as the school's grants project director; WHEREAS, Dr. Hartman has led grant projects, including a childhood obesity prevention program that created school gardens in Roanoke City elementary schools; WHEREAS, Dr. Hartman has worked directly with her husband, Dr. David Hartman, to develop Carilion's office-based opioid treatment program and serves as program manager; WHEREAS, Dr. Hartman has been an active member of the Kiwanis Club of Roanoke, and served as president during the 2019-2020 club year; WHEREAS, under Dr. Hartman's leadership, Kiwanis adapted many of its programs to at the community during the COVID-19 pandemic, including recruiting volunteers for vaccination clinics, allocating grant funds to local charities, and starting a partnership with Roanoke City Public Libraries to make video books available to teachers and the children within the community; WHEREAS,front 2018 to 2020, Dr. Hartman successfully led the campaign to raise the funds and construct Centennial Playground, a $400,000 children's playground in Northwest Roanoke, which Kiwanis gave free and clear to the City of Roanoke upon its completion; WHEREAS,Dr. Hartman is leading a second phase to this playground that will rehabilitate nearby Horton Branch with natural plantings, a walking trail, and environmental education facilities; WHEREAS, Dr. Hartman has been involved with a number of charities in the Roanoke Valley over the years, and was instrumental in founding the Community Youth Program,based out of St. John's Episcopal Church; WHEREAS, City Council desires to recognize Dr. Hartman for her outstanding accomplishments and the devotion of her time to serve her community and the City of Roanoke. The result would be that the parcel would continue to be zoned 1-1 , Light Industrial District, with a condition that the property be developed per a proffered development plan. The applicant plans to use the existing building and development of the site and only add an outdoor storage area in the northeast corner of the site, behind and beside the adjacent commercial parcels to the east. The proposed change allows for an existing industrial property on a commercial corridor to be reused in a manner that is appropriate to the surrounding area. The platted alley runs between 2231 Windsor Avenue SW and 2227 Windsor Avenue SW and terminates at the main alleyway. Proposed Use/Development: The application was filed by the owner of 2227 Windsor Avenue SW with a letter of support from the owner of 2231 Windsor Avenue SW. The vacation of the alleyway will provide additional space for the yard of 2227 Windsor Avenue SW and an easement will be put in place to provide parking to 2231 Windsor Avenue SW. Considerations: The primary consideration in vacating a public right-of-way is any inconvenience that the vacation may create. Impact of Alley Vacation to Public Accessibility: The alley has functioned as a driveway for the adjacent properties, 2227 and 2231 Windsor Avenue SW. The alley connects to the main alley from Windsor but does not extend across Windsor Avenue. The alley was created as part of the original Grandin Place subdivision as it represented the westernmost extent 2 of the development. Originally the alley extended across the other side of Windsor Avenue SW to connect to the main alley on that southern side of Windsor. The alley on the south side of Windsor was later vacated. Both alleys were incorporated into the adjacent subdivision, of which 2231 Windsor Avenue was to be included. As the right-of-way in question is no longer the westernmost extent of residential development, the alley is not needed for a means to connect to the alley and turnaround. Impact of Street Vacation to Public Services: The proposed vacation does not impact delivery of any city services or services from utility companies. There is an existing sewer line and a stormwater drain that run through the alley and a vacation would need to include an easement for both utilities along the entirety of the vacated alley. Consistency with Comprehensive Plan: City Plan 2040, the City of Roanoke Comprehensive Plan, supports maintaining neighborhood character. The Greater Raleigh Court Neighborhood Plan does not specifically address alleys except to note homes within the neighborhood typically have an alley behind them. The proposed vacation would not affect the neighborhood character or access along the main alley running behind the houses along Windsor Avenue SW, and therefore would be consistent with City's Comprehensive Plan and the Greater Raleigh Court Neighborhood Plan. Comments on Application: Public Utilities: Cox Cable was amenable to the vacation. Roanoke Gas was amenable to the vacation stating that no service lines or mains run between the properties. The Western Virginia Water Authority was amenable to the vacation if an easement is placed along the entirety of the alley that will provide access to the existing sewer line running through the alley. The City's Stormwater utility was amendable to the vacation if an easement is placed along the entirety of the alley that will provide access to the existing storm drain running through the alley. No comments were received from Verizon and Appalachian Power Company. 3 City Departments: All City Departments are amenable to the vacation. The Fire Marshall's Office and the Building Division had comments on the location of the property lines that will be addressed in the subdivision process if the alley vacation is approved. The Transportation Division had comments that the cross-access easement should be addressed on the plans submitted during the subdivision process.
