The City Clerk's Office is accepting applications for two upcoming
vacancies on the Roanoke City School Board for three-year terms of office
expiring on June 30, 2022. Three-year terms of office will commence July 1,
2022 and end on June 30, 2025. Incumbent School Board Trustees are
Lutheria H. Smith and Joyce W. Watkins.

Trustees of the Roanoke City School Board are available on the City of

COMMENTS OF CITY MANAGER.
The City Manager thanked City staff that worked tirelessly to prepare for
the snow event and clear the sidewalks at the municipal facilities.
He highlighted the significance of the impact of COVID-19, noting that one
in four persons tested positive for COVID-19 and if the numbers continue
to rise within the workforce, it would affect the level of service provided by
the City to the citizens.

dissertation on cemeteries that were disrupted by construction

A RESOLUTION establishing a meeting schedule for City Council commencing January 1,
2022, and terminating December 31, 2022.
BE IT RESOLVED by the Council of the City of Roanoke as follows:
1. This resolution establishes a schedule of regular meetings for City Council
commencing January 1, 2022, and terminating December 31, 2022.
2. City Council shall hold regular meetings on the first and third Mondays of each
month, at the following times of commencement:
(a) Unless otherwise provided by resolution of Council, each regular
meeting on the first Monday in each month shall commence at 9:00 a.m. for the
conduct of informal meetings, work sessions, or closed meetings. Thereafter,
Council shall take up the regular agenda at 2:00 p.m. Council may recess between
the 9:00 a.m. session and the 2:00 p.m. session. The organizational meeting of City
Council on the first meeting in January, 2022, shall commence at 2:00 p.m. and
immediately following, Council shall take up the regular agenda.
(b) Unless otherwise provided by resolution of Council, each regular
meeting on the third Monday in each month shall commence at 2:00 p.m. for the
conduct of regular business. The second meeting of each month shall be recessed
upon the completion of all business except the conduct of public hearings, and such
meeting shall be reconvened at 7:00 p.m. on the same day for the conduct of public
hearings.
3. With regard to the regular meetings scheduled to be held on the first Monday of each
month, inasmuch as City officials and Council members will be attending the Virginia Municipal
League Annual Conference to be held October 1 - 4, 2022, an exception is noted herein and the
regular meeting scheduled to be held on Monday, October 3, 2022, is rescheduled to be held on
Thursday, October 6, 2022, and shall commence at 9:00 a.m.
4. When any regularly scheduled Monday meeting shall fall on a holiday of the City,
such meeting shall be held on Tuesday next following.
5. All regular meetings of City Council shall be held in the Council Chamber, Room
450,of the Noel C. Taylor Municipal Building,unless otherwise provided by resolution of Council,
with the exception of the 9:00 a.m. session of the regular meeting on August 1,2022,which location
has yet to be determined by the School Board,however,the meeting will begin at 9:00 a.m.,and after
recess, reconvene at Council Chamber.
6. A joint meeting with the Roanoke City School Board will be held on January 18,
2022, at 6:00 p.m. in Council Chamber, Room 450, of the Noel C. Taylor Municipal Building.
7. City Council may prescribe a day or time other than that established by this resolution
or a meeting place other than that established by this resolution by adoption of a resolution
establishing a new meeting day,place or time. City Council shall cause a copy of such resolution to
be posted adjacent to the door of the Council Chamber and inserted in a newspaper having general
circulation in the City at least seven days prior to the date of the meeting at such amended day,time
or place.
8. This Resolution shall have no application to special meetings of City Council called
pursuant to Section 10 of the City Charter.

CITY COUNCIL AGENDA REPORT

Meeting: January 3, 2022
Subject: Schedule a Public Hearing to Enter into a Management Services
Agreement and Lease with the Roanoke-Blacksburg Innovation
Network for the Lease Conveyance of City-Owned Property
located at 709 South Jefferson Street
Background:
The City of Roanoke (City) will be entering into an agreement with the Roanoke-
Blacksburg Innovation Network, a Virginia non-stock corporation d/b/a Valleys
Innovation Council (VIC) concerning the property known as the former Gill
Memorial Hospital Building (Gill Memorial Building) located at 709 South
Jefferson Street (Official Tax Map No. 1020510). VIC currently operates the
Regional Acceleration and Mentorship Program (RAMP), which is headquartered
within the Gill Memorial Building.
The Virginia Western Community College Educational Foundation (VWCC) has
managed the Gill Building since RAMP's inception in 2017. Both the lease and
the Management Services Agreement between the City and VWCC are set to
expire on January 31 , 2022. VWCC declined to extend these agreements or to
enter into new ones.
VIC has expressed an interest to enter into a three-year lease agreement with
the City to serve as sub-landlord and property manager for the Gill Memorial
Property. The lease and the management of the Gill Memorial Property will be
contained in a Management Services Agreement and Lease (Agreement)
substantially similar to the lease and Management Agreement between VWCC
and the City.
The Agreement shall provide for a nominal annual rent of one dollar per year
for a term of three years, with two one-year options for renewal.
A public hearing is required to consider the lease of City property.
Recommended Action:
Authorize the City Clerk to schedule and advertise this matter for a public
hearing at City Council's meeting on January 18, 2022, at 7:00 p.m., or at such
time as the matter can be reached, or at such subsequent date and time as the
City Manager may determine, to consider the lease of the Gill Memorial Property
to VIC pursuant to the terms of the Agreement.

1. Call to Order:
Mr. Cobb welcomed everyone and called the meeting to order at 4:03 p.m.
2. Approval of the Minutes from the June 2, 2021 Meeting:
Mr. Cobb asked if there were any comments on or corrections to the June 2, 2021, meeting
minutes. Hearing none, Mr. Bestpitch made a motion to approve the minutes as written; Ms. White-
Boyd seconded. The minutes were received and filed.
3. Annual Simplified Comparative Report—2021:
Mr. Harmon began by recognizing Mr. Pendleton, who was the lead report preparer and one of its
original designers, as well as Ms. Spichek who was the primary reviewer. The report is prepared
using publicly available data from a variety of sources, including Virginia's Auditor of Public
Accounts (APA). Mr. Harmon noted that data in the report are for varying time periods and

suggested readers pay close attention to graph titles and labels. He also noted that comparative
data from the APA is not adjusted for cost of living and that the Roanoke region's cost of living is
nearly 20% less than the state as a whole.
While the City has a lower cost-of-living, it also has lower median incomes and housing values.
Incomes and property values significantly impact the City's tax base. Mr. Harmon noted that federal
and state transfers are significant contributors to the local economy.
The Committee discussed changes in demographic data and how census data is reported. Mr.
Cobb noted that the City's Hispanic demographic was projected to increase significantly by 2030
and that new census data shows Hispanics account for 8% of the City's population.
Next, Mr. Harmon talked about housing, noting that about half of Roanoke's population exceeds the
recommended maximum of 30% of household income being spent on housing. He noted this is
similar to the state overall.
Mr. Cobb commented on Lynchburg's poverty rate trending down. Mr. Harmon noted that localities
with a university, such as Lynchburg and Montgomery County, report some interesting data. It is
unclear how student populations factor into poverty, household incomes and other demographic
data.
The Committee next looked at real estate taxes. Mr. Harmon noted that residential properties made
up -74% of parcels but that commercial accounted for- 50% of the assessed value. The impact of
telecommuting is not yet known, but may negatively affect commercial property values.
The Committee discussed fiscal stress measures tracked by the State. The most recent report is
based on fiscal year 2018 data. It measures capacity to generate taxes based on property values,
gross incomes, and average tax rates in the state. Mr. Harmon noted that 95 of 133 localities have
more capacity than the City based on these factors. However, the City is collecting more of its
capacity than 118 localities and is at 141% of the state average. This suggests the City needs to
focus on improving incomes and housing values, as there is limited capacity to raise tax rates.
Looking at revenue per capita, Mr. Harmon noted the importance of transfers from federal and state
sources. Many of these dollars flow directly into the local economy as recipients purchase food and
other necessities.
The City's general fund balance could fund approximately 1.9 months of expenditures currently.
Mr. Harmon noted that the Government Finance Officers Association recommends localities
maintain fund balances to cover at least two month's expenditures.
The Committee looked at funding for the City's pension plan, which represents a significant
expenditure for the City. The average annual return-on-investment over the past ten years was
nearly 10%. Pension obligations are nearly 74% funded. Mr. Harmon noted that a smaller City

workforce has fewer employees paying into the fund while the number of retirees drawing pensions
continues to increase.
The Committee discussed expenditures on Health and Human Services. Expenditures are
comparatively high regionally, but are largely funded by state and federal transfers. These inject
money into the local economy as they are spent on goods and services, not saved. Ms. White-
Boyd asked about local dollars spent on human services. Mr. Harmon noted that the State funds
close to 80% of services for children. Comparatively, Roanoke spends significantly more on health
and human services than other cities.
Related to education, the data shows enrollment in K-12 is steady and increasing. The Committee
discussed the comparatively higher proportion of City students who move directly into the workforce
or who have no plans after graduation. Mr. Harmon referred members to a recent audit of Career
and Technical Education for more information about the school division's career counseling and
education efforts.
Finally, the Committee discussed the three areas that accounted for- 80% of all expenditures:
Education, Public Safety, and Health and Human Services.
The data shows the City spent more per student (- $15,000) than other localities in the region. The
Committee discussed the meaning of the state composite index which determines how much
education funding the state provides a locality. The City's composite index score is 0.3416 which
translates to the state funding - 65 cents of every dollar the state estimates will be needed to meet
its mandated standards of quality. Most localities, including the City, spend significantly more than
the state estimate.
Roanoke spends $777 per capita on public safety, including law enforcement, corrections and
Fire/Emergency Medical Services. This is just above the state average for cities, which is favorable
given the City's cost of living advantages.
Related to health and welfare, the City spends $612 per person. This is 31% higher than the state
average for cities, and more than surrounding localities, with the exception of Lynchburg.
Mr. Cobb asked about demographic data for teachers and staff. Mr. Pendleton responded that
such data was not listed with student enrollment data. Mr. Spencer commented that the school
administration publishes an annual report card that includes staff demographic data. Mr. Cobb
noted that he had not seen this breakdown for some time and was curious how staff compared to
students. Mr. Spencer responded that he believes they are going in the right direction. The report
is publicly available on the school division's website.
Mr. Bestpitch asked about the potential value of the report for strategic planning. Mr. Cowell agreed
that it is valuable information and noted that an earlier version was utilized at a Council retreat.
Additionally, the report is used by the City's Revenue Team. Mr. Bestpitch commented that the
report would be useful in identifying areas for improvement. Mr. Cowell agreed and noted the

importance of investing in things that promote job creation. He cited a successful $3.2 billion
public-private partnership agreement in Henrico County as an example. Mr. Bestpitch agreed. Mr.
Cowell added that the report may also be of benefit to others in the community. Mr. Harmon noted
that the report is sent to various agencies such as the Roanoke Regional Partnership, the Chamber
of Commerce, the Water and Airport Authorities and others on the department's distribution list.
Ms. White-Boyd asked if the entire report is available online; Mr. Harmon confirmed it the report is
on Auditing's webpage. She noted that it might also be valuable to the Western Virginia Workforce
Development Board.
Mr. Bestpitch asked if the City's real estate rehabilitation abatement program is improving housing
conditions and increasing values. Mr. Harmon responded that an earlier audit on the program
indicated it has helped raise assessed values. The Committee then discussed the importance of
code enforcement in improving housing conditions and assessments. The discussion touched on
the importance of the general district court helping hold owners accountable for compliance.
Hearing no further questions or discussion, the report was received and filed.
4. Council Expenditures Audit:
This was the annual review of City Council expenditures for Fiscal Year 2021. Mr. Harmon noted
there were no findings. There were more Council members included in this year's report than in the
past due to having two new members and terms now running January to December instead of July
to June.
Mr. Cobb opened the floor to questions or comments. Hearing none, the report was received and
filed.
5. Clerk of the Circuit Court Audit:
Mr. Harmon noted that the Auditor of Public Accounts (APA) provided the audit program for this
audit. Municipal Auditing performed part of the program and the results were good.
Mr. Cobb asked if there were any further questions or comments. Hearing none, the report was
received and filed.
6. Annual Report—Audit Committee:
Mr. Harmon presented the annual report for Fiscal Year 2021 [FY21]. Municipal Auditing serves the
City of Roanoke, Roanoke City Public Schools [RCPS] and Valley Metro. Mr. Harmon noted that
the PCI implementation consumed about 40% of the Auditing department's capacity. Audit hours
for RCPS were in line with expectations to provide one full time equivalent. Mr. Harmon stated that
69% of overall hours were used directly on audits, which was in-line with similar sized governments
per the most recent Association of Local Government Auditors survey, which was 68%.

The City hires external auditors to provide opinions on its financial statements, which are prepared
by the Department of Finance. Municipal Auditing maintains the contract and coordinates with staff
of both entities, on an arms-length basis. During Fiscal Year 2021, Finance staff had challenges
completing the required work and audit opinions were not submitted by their due date. Internally,
assignments completed were slightly below target, primarily due to additional staff commitment to
the PCI project. The majority of findings were successfully resolved.
Mr. Harmon noted there were only two [2] performance audits completed in FY21. One was School
Safety and Security, the other was Building Inspections. Mr. Bestpitch asked about fire drills. Mr.
Harmon responded that the School Board had requested that drills be included in the audit.
Auditors found that the number and timing of drills did not comply with state requirements.
Mr. Harmon reminded the Committee that the Building Inspections audit was discussed at the
December 2020 meeting. Permits with no inspections requested and buildings not having elevator
and cross connection inspections performed timely were the primary issues. Mr. Bestpitch asked
who is responsible for ensuring elevator inspections are done. Mr. Harmon responded that the
City's Building Commissioner is responsible per State Code.
Mr. Harmon briefly discussed advisory services, such as serving on the Information Technology
Committee. He noted that the PCI system is expected to go-live in October 2021.
Related to investigations, Mr. Harmon referred the Committee to the synopsis included in the back
of the report. He then asked for any questions or comments the Committee might have.
Mr. Cobb asked how audit hours are tracked. Mr. Harmon explained that all assignments are given
an engagement number. Auditors track their time on each engagement using an Excel
spreadsheet, which is then imported into an Access database for analysis and reporting.
Hearing no further questions or discussion, the report was received and filed.
7. PCI Project Update:
Ms. Burkett thanked the Committee for the opportunity to provide an update on the project and
proceeded with the briefing as follows:
• Significant progress was made during the quarter, but the team did not meet its quarterly goals.
The team continues working towards an October go-live date. PCI has had its Chief Information
Officer and a Developer on-site to work through issues. Everyone involved is pressing to
complete the project.
• Decisions on processes, such as how trust taxes should be processed, have been settled.
Checks and returns will be received in the Treasurer's Office, where they will be handled using
a batch process. Returns will then be sent to the Commissioner's Office for review. Ms. White-

Boyd commended these offices on making these difficult decisions. Mr. Cobb was pleased that
more vendor staff are coming on site.
• Questions about the real estate data conversion were recently resolved and the real estate
database has been delivered.
• Development of Interfaces and Forms is progressing.
• November 18, 2021, has been identified as a fall back date for go live should extra time be
required. Under this scenario, cutover work would begin on November 10th. Ms. White-Boyd
asked what happens from the 10th to the 18th. Ms. Burkett responded that this time is used to
convert the data from the legacy systems and move it into the new system. Staff will perform
additional testing and continue to familiarize themselves with the new system during this time.
• No additional project costs have been identified at this point in time.
• Auditing will provide a status update to the Committee on October 1.
Mr. Cobb thanked Mr. Harmon and Ms. Burkett for the update. Hearing no further questions or
discussion, the update was received and filed.
8. Other Business:
Mr. Harmon reminded the Committee that the December meeting will be Monday, December 20th at
1:00 PM.
Mr. Cobb will report on the Audit Committee's work at the upcoming Council Meeting. He asked if
there would be value to doing a deeper dive into the Simplified Comparative Report at a morning
briefing session. Ms. White-Boyd asked if Mr. Harmon could do a summary presentation. He
affirmed he could and requested that Committee Members let him know if they have any feedback
or suggestions.

Subject: American Rescue Plan Act (ARPA) and Star City Strong: Recovery
and Resiliency Advisory Panel Recommendations
Background:
On March 1 1 , 2021 , the American Rescue Plan Act (ARPA) was signed into law
by President Joe Biden establishing the Fiscal Recovery Funds which are
intended to provide governments support in their response to the impacts of
COVID-19. The City of Roanoke was awarded the amount of $64,576,671 . On
June 30, 2021 , these funds were appropriated by City Council through Budget
Ordinance 42093-063021 . This action appropriated the total funds but did not
allocate funds to specific program initiatives. $24,633,386 was appropriated to
the General Fund for intended revenue replacement funds.
In July of 2021 , the City Council formed the Star City Strong: Recovery and
Resiliency Advisory Panel to seek citizen input. The stated objective of the
Advisory Panel was "to consider the challenges confronting the City from the
COVID-19 pandemic disaster and the opportunities available to the community
through the American Rescue Plan Act, and to make recommendations to City
Council regarding the use of the funds." With Council's final determination and
approval at the September 20, 2021 Council meeting, staff has moved forward
with the recommendations of the Advisory Panel. It is hereby necessary to
itemize the project list and to appropriate and allocate fund amounts to
projects.
It was also subsequently determined by the panel and City Council that all
$64,576,671 would be attempted to be spent on projects identified by the
Panel and endorsed by City Council rather than rely solely on the ability to
recapture revenue replacements.
Lastly, on November 15, 2021 funding was appropriated for the ARPA SLFRF
Municipal Utility Relief Program in the amount of $417,282. These funds were
appropriated into the City's ARPA funds mentioned above. It has since been
determined these funds should be tracked separately and therefore should be
moved to their own independent Grant Fund account.
Considerations:
The City of Roanoke must allocate the amount of $39,943,285 and appropriate
the lost public sector revenue portion for each of the projects recommended by
the Advisory Panel.
With both that allocation and appropriation, the full amount of $64,576,671 will
be available to recover from the COVID-19 pandemic, remain resilient, and be
prepared for future emergencies.
Finally, re-allocate $417,282 appropriated for the APRA SLFRF Municipal Utility
Relief Program to accounts that will allow better tracking of this program that is
separate and independent from the ARPA Advisory Panel recommendations.
Recommended Action:
Adopt the accompanying budget ordinance to establish a revenue estimate in
the Grant Fund of $24,633,386 and reallocate remaining appropriated funds to
accounts established by the Director of Finance.

Subject: Star City Soccer Foundation Donation for Futsal Court in
Preston Park
Background:
In early 2020, the Star City Soccer Foundation contacted the City about their
desire to partner on the development of a futsal court in Preston Park. The
existing facility there was being utilized in that manner for some time, but was
not designed to accommodate it. The Star City Soccer Foundation agreed to
provide partial funding for the project through fundraising efforts, and is
donating $10,000 towards to total cost of the project.
Considerations:
The Star City Soccer Foundation has confirmed its intent to donate $10,000 to
the futsal court at Preston Park. In exchange for their donation, the Star City
Soccer Foundation will receive a $10,000 credit towards reservation fees for the
futsal court.
Recommended Action:
Adopt a resolution accepting the $10,000 donation from the Star City Soccer
Foundation. Adopt the accompanying budget ordinance to establish a revenue
estimate and to appropriate funding of $10,000 in account 08-620-9071 , Parks
and Recreation Court Conversion Project.

Subject: FY 22 HRSA PRF Phase 4 Relief Funding
Background:
In September 2021 , the United States Department of Health and Human Services
("HHS") announced the distribution of $178 billion in Provider Relief Funds ("PRF") for
hospitals and other healthcare providers on the front lines of the coronavirus response.
This funding is designed to support healthcare-related expenses or lost revenue
attributable to the COVID-19 Pandemic. The funds are open to all providers regardless
of network affiliation or payer contracts. HHS is working through the Health Resources
and Services Administration ("HRSA"), to facilitate delivery of the funds.
On December 16, 2021 , the City of Roanoke received its Phase 4 payment allocation,
from HRSA, which totaled $195,069. These funds were awarded as a revenue
supplement for EMS calls. The funds will be used to cover increased costs associated
with EMS delivery to include staffing, medical supplies, equipment and Personal
Protective Equipment ("PPE").
Recommended Action:
Accept the FY Coronavirus Aid, Relief, and Economic Security Act - Provider Relief Fund
allocation described above, and authorize the City Manager to sign an attestation
confirming receipt of the funds and to agree to the Terms and Conditions of payment,
all approved as to form by the City Attorney.
Adopt the accompanying budget ordinance to establish a revenue estimate in the
amount of $195,069, and to appropriate funding in the same amount into an account
to be established by the Director of Finance in the Grant Fund.

Services Administration (HRSA), is pleased to inform you that your organization will
receive a Provider Relief Fund Phase 4 payment.
How are payment amounts determined?
You will receive one consolidated payment that includes the total amount of any base
payment and/or bonus payment you qualified for based on the information in your
application and administrative claims data.
Base payments are calculated as a percentage of expenses and revenues reported in your
application for the period from July 1, 2020 to March 31, 2021. Percentages are determined
by provider size:

Bonus payments are calculated based on Medicare, Medicaid, and CHIP administrative
claims data from January 1, 2019 through September 30, 2020. HRSA then adjusted the
claims to the available funds, resulting in bonus payments of approximately 0.3% of the
provider's total Medicare, Medicaid, and CHIP administrative claims.

How will payments be distributed?
UnitedHealth Group, HRSA's contractor, will deliver the funds via their Automated Clearing
House (ACH). The automated payments will be sent via Optum Bank to the group's central
billing office. All payments are made to provider filing organizations based on their T1 Ns.
What action should I take?
Within 90 days of receiving this payment, you must sign an attestation confirming receipt of
the funds and agreeing to the Terms and Conditions of payment. Should you choose to
reject the funds, you must also complete the attestation to indicate this and return the funds
within 15 calendar days. The Provider Relief Fund Payment Attestation Portal will guide you
through the attestation process to accept or reject the funds. Not returning the payment
within 90 days of receipt will be deemed as acceptance of the Terms and Conditions.
Please note that per the Terms and Conditions, recipients consent to HHS publicly
disclosing the payment they receive. PRF payment recipients are ,posted online in a public
dataset, and Phase 4 payments that recipients have attested to will be reflected in this
dataset.

AN ORDINANCE to readopt and reenact the Code of the City of Roanoke (1979), as
amended; and dispensing with the second reading of this ordinance by title.
WHEREAS,by Ordinance No. 25043, adopted April 7, 1980,this Council adopted and
enacted a new code for the City of Roanoke entitled the Code of the City of Roanoke (1979)
(hereinafter sometimes referred to as the "City Code");
WHEREAS, such Code, as amended, contains certain provisions which incorporate by
reference portions of the Code of Virginia(1950), as amended, (hereinafter "State Code");
WHEREAS, from time to time, certain of these State Code sections which are
incorporated by reference in the City Code have been amended by the General Assembly;
WHEREAS,such amendments are a matter of public record which are set forth in the Acts
of Assembly and supplements and replacement volumes of the State Code; and
WHEREAS,it is the desire of this Council that those provisions of the City Code which
adopt by reference State Code provisions shall be fully consistent with enactments of the most
recent Session of the General Assembly.
THEREFORE, BE IT ORDAINED by the Council of the City of Roanoke that:
1. The Code of the City of Roanoke(1979),as amended,a copy of which is on file
in the City Clerk's Office, consisting of Chapters 1 through 36.2, each inclusive, is hereby
readopted and reenacted. Such Code amendments heretofore and hereafter adopted shall continue
to be known as the Code of the City of Roanoke (1979), as amended.
2. With respect to sections or provisions of the State Code incorporated by
reference in the City Code, Council recognizes any amendments made to such sections or
provisions of the State Code by the most recent Session of the General Assembly and hereby
expresses the intent and ordains that such amendments to sections or provisions of the State
Code incorporated by reference in the City Code shall be included in the City Code verbatim
as enacted by the most recent Session of the General Assembly.
3. Any reference in the City Code to any section, article or chapter from former
Titles of the State Code shall be deemed and construed to apply to the successor section,
article or chapter of the State Code, comparable sections being set out in Tables of
Comparable Sections for certain Repealed and Revised Titles published in Volume 10.
4. Pursuant to Section 12 of the City Charter,the second reading of this ordinance
by title is hereby dispensed with.

Re: Reenactment of City Code
Dear Mayor Lea and Council Members:
Since 1982, City Council has reenacted and recodified the City Code on an annual basis in order
to properly incorporate in the Code amendments made by the General Assembly at the previous
Session to State statutes that are incorporated by reference in the City Code. This procedure ensures
that the ordinances codified in our Code incorporate the most recent amendments to State law.
Incorporation by reference is frequently utilized in local codes to preclude having to set out
lengthy provisions of State statutes in their entirety. In addition, the technique ensures that local
ordinances are always consistent with the State law as is generally required.
The procedure whereby a local governing body incorporates State statutes by reference after
action of the General Assembly has been approved by the Attorney General. See Report of the
Attorney General (1981-1982) at 272. I recommend that Council adopt the attached ordinance to
readopt and reenact the Code of the City of Roanoke (1979), as amended. If the attached ordinance is
not adopted, City Code sections incorporating provisions of the State Code amended at the last Session
of the General Assembly may not be deemed to include the recent amendments and may be
impermissibly inconsistent which could result in the dismissal of criminal prosecutions under these
City Code sections.

AN ORDINANCE establishing the base salaries for the newly elected Commissioner of
the Revenue and Sheriff for the City of Roanoke; authorizing the City Manager to execute
contracts with both Constitutional Officers; and dispensing with the second reading of this
Ordinance by title.
WHEREAS, Antonio Hash was elected as the new Sheriff for the City of Roanoke by the
voters of the City of Roanoke at the general election held on November 2, 2021;
WHEREAS, as a result of the general election held on November 2, 2021, Ryan
LaFountain was elected by the voters as the City's new Commissioner of the Revenue; and
WHEREAS, City Council desires to provide the same base salary to each of these newly
elected Constitutional Officers as their predecessors.
THEREFORE, BE IT ORDAINED by the Council of the City of Roanoke that:
1. The base salary for the newly elected Commissioner of the Revenue, Ryan
LaFountain, will be $158,972, beginning January 1, 2022, conditioned upon his office entering
into and honoring a performance agreement with the City of Roanoke.
2. The base salary for the newly elected Sheriff for the City of Roanoke, Antonio
Hash, will be $141,075,beginning January 1, 2022.
3. The City Manager is hereby authorized for and on behalf of the City of Roanoke
to execute contracts with both newly elected Constitutional Officers for the City to provide
payroll and human resource services to both offices.
