Council Member Cobb shared he recently conversed with a local storeowner who expressed concern with an uptick of shoplifting at his establishment; encouraged further education for local convenience stores with regard to the Plastic Bag Tax and use of reusable bags; and recommended review of the City Ordinance regarding snow removal on sidewalks in front of properties prior to 9:00 a.m., as it may be updated due to unreasonable requirements. b. In April of 2021 , Berglund Center staff applied for the SVOG. The City of Roanoke/Berglund Center was awarded $1 ,216,727.55 on August 4, 2021 . The Berglund Center subsequently applied for a supplemental grant amount from the SBA. In addition to the original award amount, on September 30, 2021 the Berglund Center was awarded an additional $2,819,042.20. The funds were received on October 6, 2021 . On November 7, 2021 , Berglund Center was eligible for an additional supplemental award of $2,017,884.88. The funds were received on November 15, 2021 . On January 10, 2022 Berglund Center received its fourth award of $1 ,913,003.17 from SBA. The funds were received on January 12, 2022. The total grant award is $7,966,657.80. The deadline for the project or performance period was amended to use for expenses through June 30, 2022. Administer the project(s) in accordance with guidelines applicable to Locally Administered Projects as published by the DEPARTMENT. e. Maintain accurate and complete records of each Project's development and documentation of all expenditures and make such information available for inspection or auditing by the DEPARTMENT. Records and documentation for items for which reimbursement will be requested shall be maintained for no less than three(3)years following acceptance of the final voucher on each Project. f. No more frequently than monthly, submit invoices with supporting documentation to the DEPARTMENT in the form prescribed by the DEPARTMENT. The supporting documentation shall include copies of related vendor invoices paid by the LOCALITY and an up-to-date project summary and schedule tracking payment requests and adjustments. A request for reimbursement shall be made within 90 days after any eligible project expenses are incurred by the LOCALITY. The foregoing notwithstanding,nothing in this subparagraph shall prevent the enforcement of the terms and conditions of this Agreement by or against either Party in a competent court of law. 8. The Parties mutually agree that no provision of this Agreement shall create in the public, or in any person or entity other than the Parties, rights as a third party beneficiary hereunder, or authorize any person or entity, not a party hereto, to maintain any action for, without limitation, personal injury, property damage, breach of contract, or return of money, or property, deposit(s), cancellation or forfeiture of bonds, financial instruments, pursuant to the terms of this Agreement or otherwise. Considerations: The Roanoke Valley Transportation Planning Organization (TPO) has awarded the City a Regional Surface Transportation Grant (RSTP) of $131 ,332 and a Highway Improvement Grant (HIP) of $1 ,118,668. The Virginia Department of Transportation has awarded the City a SmartSCALE grant of $5,928,491 . Total grant funds total $7,178,491 for the design, right of way acquisition, and construction of the project. There is not local match required. The City currently operates four Pelicans, and this type of sweeper has proven highly effective at removing gross and fine solids from the roadways at a relatively low cost to operate. The Pelican prevents accumulation of trash and other large debris in City storm drains and streams, allowing for maximum flood drainage capacity. Extension of Project/Budget Period Expiration Date EPA has not exercised the waiver option to allow automatic one-time extensions for non-research grants under 2 CFR 200.308 (d)(2). Therefore, if a no-cost time extension is necessary to extend the period of availability of funds the recipient must submit a written request to the EPA prior to the budget/project period expiration dates. The written request must include: a justification describing the need for additional time, an estimated date of completion, and a revised schedule for project completion including updated milestone target dates for the approved workplan activities. In addition, if there are overdue reports required by the general, administrative, and/or programmatic terms and conditions of this assistance agreement, the recipient must ensure that they are submitted along with or prior to submitting the no-cost time extension request. Disadvantaged Business Enterprise(DBEs) UTILIZATION OF SMALL MINORITY AND WOMEN'S BUSINESS ENTERPRISES GENERAL COMPLIANCE, 40 CFR, Part 33 The recipient agrees to comply with the requirements of EPA's Disadvantaged Business Enterprise (DBE) Program for procurement activities under assistance agreements, contained in 40 CFR, Part 33 except as described below based upon the associated class deviation. SIX GOOD FAITH EFFORTS,40 CFR, Part 33, Subpart C Pursuant to 40 CFR, Section 33.301, the recipient agrees to make the following good faith efforts whenever procuring construction, equipment, services and supplies under an EPA financial assistance agreement, and to require that sub-recipients, loan recipients, and prime contractors also comply. Records documenting compliance with the six good faith efforts shall be retained: (a) Ensure DBEs are made aware of contracting opportunities to the fullest extent practicable through outreach and recruitment activities. For Indian Tribal, State and Local and Government recipients, this will include placing DBEs on solicitation lists and soliciting them whenever they are potential sources. (b) Make information on forthcoming opportunities available to DBEs and arrange time frames for contracts and establish delivery schedules, where the requirements permit, in a way that encourages and facilitates participation by DBEs in the competitive process. This includes, whenever possible, posting solicitations for bids or proposals for a minimum of 30 calendar days before the bid or proposal closing date. (c) Consider in the contracting process whether firms competing for large contracts could subcontract with DBEs. For Indian Tribal, State and local Government recipients, this will include dividing total requirements when economically feasible into smaller tasks or quantities to permit maximum participation by DBEs in the competitive process. (d) Encourage contracting with a consortium of DBEs when a contract is too large for one of these firms to handle individually. (e) Use the services and assistance of the SBA and the Minority Business Development Agency of the Department of Commerce. (f) If the prime contractor awards subcontracts, require the prime contractor to take the steps in paragraphs (a)through (e)of this section. CONTRACT ADMINISTRATION PROVISIONS, 40 CFR, Section 33.302 The recipient agrees to comply with the contract administration provisions of 40 CFR, Section 33.302 (a)-(d) and (i). BIDDERS LIST, 40 CFR, Section 33.501(b)and (c) Recipients of a Continuing Environmental Program Grant or other annual reporting grant, agree to create and maintain a bidders list. Recipients of an EPA financial assistance agreement to capitalize a revolving loan fund also agree to require entities receiving identified loans to create and maintain a bidders list if the recipient of the loan is subject to, or chooses to follow, competitive bidding requirements. Please see 40 CFR, Section 33.501 (b) and (c)for specific requirements and exemptions. FAIR SHARE OBJECTIVES, 40 CFR, Part 33, Subpart D A class exception to the entire Subpart D of 40 CFR Part 33 has been authorized pursuant to the authority in 2 CFR 1500.3(b). Notwithstanding Subpart D of 40 CFR Part 33, recipients are not required to negotiate or apply fair share objectives in procurements under assistance agreements. MBEMBE REPORTING-SPECIFIC CHANGES PURSUANT TO CLASS DEVIATION,40 CFR, Part 33, Subpart E When required, the recipient agrees to complete and submit a "MBEMBE Utilization Under Federal Grants and Cooperative Agreements" report(EPA Form 5700-52A) on an annual basis. The current EPA Form 5700-52A can be found at the EPA Grantee Forms Page at ht�s�liwww.e p.gov/grants/epa_grantee-forms. Reporting is required for assistance agreements where funds are budgeted for procuring construction, equipment, services and supplies (including funds budgeted for direct procurement by the recipient or procurement under subawards or loans in the"Other"category) with a cumulative total that exceed the threshold amount of$250,000, including amendments and/or modifications. When reporting is required, all procurement actions are reportable, not just that portion which exceeds$250,000. Annual reports are due by October 30th of each year. Final reports are due by October 30th or 90 days after the end of the project period, whichever comes first. This provision represents an approved deviation from the MBE/WBE reporting requirements as described in 40 CFR, Part 33, Section 33.502. D. Pre-Award Costs In accordance with 2 CFR 1500.8, the grantee may charge otherwise allowable pre-award costs (both Federal and non-Federal matching shares) incurred from 1/01/2020 to the actual award date provided that such costs were contained in the approved application and all costs are incurred within the approved budget period. Programmatic Conditions A. Eligible Activities The recipient must use this funding to address impacts of Hurricane Florence in counties with a FEMA Major Disaster Designation in the Commonwealth of Virginia. B. Performance Reporting and Final Performance Report Performance Reports-Content In accordance with 2 CFR 200.328, the recipient agrees to submit performance reports that include brief information on each of the following areas: 1)A comparison of actual accomplishments to the outputs/outcomes established in the assistance agreement work plan for the period; 2) The reasons why established outputs/outcomes were not met; and 3) Additional pertinent information, including, when appropriate, analysis and explanation of cost overruns or high-unit costs. Additionally, the recipient agrees to inform EPA as soon as problems, delays, or adverse conditions which will materially impair the ability to meet the outputs/outcomes specified in the assistance agreement work plan are known. Performance Reports-Frequency The recipient agrees to submit annual performance reports electronically to the EPA Project Officer within 90 days after the annual reporting period ends on December 31 st. The final project report is due within 90 days of the budget/project period end date. Subaward Performance Reporting The recipient must report on its subaward monitoring activities under 2 CFR 200.33 1td}. Examples of items that must be reported if the pass-through entity has the information available are: 1. Summaries of results of reviews of financial and programmatic reports. 2. Summaries of findings from site visits and/or desk reviews to ensure effective subrecipient performance. 3. Environmental results the subrecipient achieved. 4. Summaries of audit findings and related pass-through entity management decisions. 5. Actions the pass-through entity has taken to correct deficiencies such as those specified at 2 CFR 200.33 , 2 CFR 200.207 and the 2_CFR_Part 20.0.338 Remedies for Noncompliance. C. State Grant Cybersecurity (a)The recipient agrees that when collecting and managing environmental data under this assistance agreement, it will protect the data by following all applicable State law cybersecurity requirements. (b) (1) EPA must ensure that any connections between the recipient's network or information system and EPA networks used by the recipient to transfer data under this agreement, are secure. For purposes of this Section, a connection is defined as a dedicated persistent interface between an Agency IT system and an external IT system for the purpose of transferring information. Transitory, user-controlled connections such as website browsing are excluded from this definition. If the recipient's connections as defined above do not go through the Environmental Information Exchange Network or EPA's Central Data Exchange,the recipient agrees to contact the EPA Project Officer(PO) and work with the designated Regional/Headquarters Information Security Officer to ensure that the connections meet EPA security requirements, including entering into Interconnection Service Agreements as appropriate. This condition does not apply to manual entry of data by the recipient into systems operated and used by EPA's regulatory programs for the submission of reporting and/or compliance data. (2)The recipient agrees that any subawards it makes under this agreement will require the subrecipient to comply with the requirements in (b)(1) if the subrecipient's network or information system is connected to EPA networks to transfer data to the Agency using systems other than the Environmental Information Exchange Network or EPA's Central Data Exchange. The recipient will be in compliance with this condition: by including this requirement in subaward agreements; and during subrecipient monitoring deemed necessary by the recipient under 2 CFR 200.331(d), by inquiring whether the subrecipient has contacted the EPA Project Officer. A favorable background investigation and fingerprint check for recipients (and their employees or program participants)who require more than six (6) months of unescorted physical access to EPA facilities. Recipients, their employees, or program participants may not be permitted access to EPA facilities until meeting these requirements. F. Quality Assurance Quality Management Plan (QMP) In accordance with 2 CFR 1500.11, the recipient shall continue to implement and adhere to the Quality Management Plan (QMP) submitted to EPA. The QMP should be updated annually or as necessary based on the EPA QA/R-2. EPA Requirements for Qualitv Management Plans. This quality assurance requirement applies to all grants, cooperative agreements, contracts and interagency agreements that involve the use of environmental data. If not included under the approved QMP, a stand-alone QAPP is required for those projects/activities that result in the collection, production and/or use of environmental information, metrics or data. The recipient agrees to ensure that an approved site specific QAPP is completed for each project. No environmental data collection, production, or use may occur until the QAPP is reviewed and approved by the EPA Project Officer and Quality Assurance Regional Manager or through authorized delegation under an EPA approved recipient QMP based on procedures documented in the QMP. A copy of the approved QAPPs must be retained with the recipient's official records for this Agreement. Quality Assurance Proiect Plan (QAPP) In accordance with 2 CFR 1500.11, the recipient must develop and implement quality assurance and quality control procedures, specifications and documentation that are sufficient to produce data of adequate quality to meet project objectives. Recipients implementing environmental programs within the scope of the assistance agreement must submit to the EPA Project Officer an approvable Quality Assurance Project Plan (QAPP) at least 30 days prior to the initiating of data collection or data compilation. The Quality Assurance Project Plan (QAPP) is the document that provides comprehensive details about the quality assurance, quality control, and technical activities that must be implemented to ensure that project objectives are met. Environmental programs include direct measurements or data generation, environmental modeling, compilation of date from literature or electronic media, and data supporting the design, construction, and operation of environmental technology. The QAPP should be prepared in accordance with EPA QA/R-5: EPA Requirements for Quality_ Assurance Proiect Plans. No environmental data collection or data compilation may occur until the QAPP is approved by the EPA Project Officer and Quality Assurance Regional Manager. When the recipient is delegating the responsibility for an environmental data collection or data compilation activity to another organization, the EPA Regional Quality Assurance Manager may allow the recipient to review and approve that organization's QAPP. Strategic Planning Process This document represents an update to the previously adopted Strategic Plan adopted in February of 2021 —prompted by the continued need to address recovery from COVID-19 and the intentional advancement of equity and well-being within the communitiy. The City has engaged in strategic thinking for many years. Much of what is included in this plan has for a number of years, been included in the annual budget and other policy documents. The process used in the development of this plan was an enhancement to that used in crafting the previous version. This update was built upon the framework of: • Listen • Learn • Discuss • Present • Act The first step in this process was listening to the community regarding the City's seven priorities, the strategies used to progress on those priorities and the outcomes that are sought. This was achieved through virtual conversations involving focus groups led by Council. These focus groups complemented the earlier virtual conversations led by Council. The virtual conversations were accompanied by key stakeholder interviews. Interviews were conducted with key stakeholders regarding the priorities and the strategies currently used to advance on the priorities. Finally, this was all further complemented by a broad discussion of the community's response to and recovery from COVID via the Star City Strong Recovery and Resiliency Advisory Panel. 5 The second step was learning from the community and the staff about each of the seven priorities,the strategies used to progress on those priorities and the outcomes that have been achieved. This occurred during the most recent Council Strategic Plan retreat. This step included presentation of information, studies, briefings, etc. by senior City staff and other content experts. The third step in this process was the Council discussing what they heard and learned regarding each of the seven priorities,the strategies used to progress on the priorities and the outcomes that have been achieved and/or are sought. This was done at the most recent Council Strategic Plan retreat. The fourth step proposed in this process was presenting the draft strategic plan and items that warrant further development. For example, implementation of the various initiatives and programs supported by ARPA funding and other state and federal funding. As the work on these progress they will be incorporated into further discussions with Council and where appropriate into the development of annual budgets or policy documents. The final step proposed in this process is qqtna upon any revisions in priorities and strategies. Some of this action may come about as a result of a working group's efforts along the way,while the majority will come about via formal adoption of a revised Strategic Plan and the proposal and adoption of the FY23 budget. Much of the groundwork for this step was set at the most recent Council Budget Planning Retreat held prior to the kick-off of the annual budget process and will be concluded upon adoption of the FY23 and FY24 budgets. This process has been designed to be responsive to the discussion held by Council in the adoption of the FY22 budget;timely and meaningful - bridging the political call for action and the necessary bureaucratic work of devising legislation and formulating budgets. This intentional process is necessary both to better the chances that quality and sustainable strategies are the result and also in response to the continued economic uncertainty associated with COVID-19. The Council will review the Strategic Plan on an annual basis, making adjustments as appropriate, following a process similar to that used in the creation of previous plans. Additionally, City Management will provide the Council with regular progress reports on the Plan and a performance measure report annually. 6 Community Profile The City of Roanoke is a mid-size independent city with a population of approximately 100,000 located within a region with a population of approximately 350,000.
