Council meetings are offered with closed captioning for the hearing impaired. 1 ANNOUNCEMENTS: The Council of the City of Roanoke is seeking applications for the following current vacancies and/or upcoming expirations of terms of office: Building and Fire Code Board of Appeals — one vacancy (Architect) Roanoke Arts Commission — one vacancy Roanoke Public Library Board —two vacancies Virginia Western Community College Local Advisory Board — one vacancy Visit Virginia's Blue Ridge — one vacancy Access the City's homepage to complete an online application for the abovementioned vacancies. 2. PRESENTATIONS AND ACKNOWLEDGEMENTS: Recognition of Officers in the Roanoke City Police Department. Mayor Lea recognized the Officers in attendance on receiving the distinguished Award of Valor from the Roanoke City Police Department for their acts of selflessness. 3. HEARING OF CITIZENS UPON PUBLIC MATTERS: City Council sets this time as a priority for citizens to be heard. If deemed appropriate, matters will be referred to the City Manager for response, recommendation or report to the Council. David Garland, 3704 Round Hill Avenue, N. W., appeared before the Council with regard to options for filling the City Council vacancy and requested that the Economic Development Authority proactively review prior and new CARES grant awards for fraud or misuse. Barbara Duerk, 2607 Rosalind Avenue, S. W., appeared before the Council to thank the Council for supporting events in Roanoke and urged citizens to walk, bike or bus on May 20. Shaheed Omar, 1430 Chapman Avenue, S. W., appeared before the Council to offer opinion with regard to the treatment of Council Member Robert Jeffrey. Owen McGuire, 2514 Brambleton Avenue, S. W., appeared before the Council to share information with regard to the disposition of the 2424 Brambleton Avenue property. 2 4. CONSENT AGENDA: (APPROVED 6-0) All matters listed under the Consent Agenda are considered to be routine by the Members of City Council and will be enacted by one motion. There will be no separate discussion of the items. If discussion is desired, the item will be removed from the Consent Agenda and considered separately. C-1 Minutes of the regular meeting of City Council held on Monday, February 7, 2022. RECOMMENDED ACTION: Dispensed with the reading of the minutes and approved as recorded. C-2 A communication from Mayor Sherman P. Lea, Sr., requesting that Council convene in a Closed Meeting to discuss the two upcoming vacancies on the Roanoke City School Board expiring June 30, 2022, pursuant to Section 2.2- 3711 (A)(1), Code of Virginia (1950), as amended. RECOMMENDED ACTION: Concurred in the request. C-3 A communication from the City Attorney requesting that Council convene in a Closed Meeting to discuss the acquisition of publicly owned property, where discussion in an open meeting would adversely affect the bargaining position or negotiating strategy of the public body, pursuant to Section 2.2-3711 (A)(3), Code of Virginia (1950), as amended. RECOMMENDED ACTION: Concurred in the request. C-4 A communication from the City Attorney requesting that Council convene in a Closed Meeting for consultation with legal counsel to discuss a personnel matter requiring the advice of counsel, where discussion in an open meeting would adversely affect the bargaining position or negotiating strategy of the public body, pursuant to Section 2.2-3711 (A)(7), Code of Virginia (1950), as amended. RECOMMENDED ACTION: Concurred in the request. C-5 A communication from the City Manager requesting that Council convene in a Closed Meeting to discuss the disposition of an approximately one acre portion of City-owned property located at 2424 Brambleton Avenue, S. W., where discussion in an open meeting would adversely affect the bargaining position or negotiating strategy of the public body, pursuant to Section 2.2-3711 (A)(3), Code of Virginia (1950), as amended. RECOMMENDED ACTION: Concurred in the request. 3 C-6 Report of qualification of the following individuals: Ralphel Lee and Luke W. Priddy as members of the Parks and Recreation Advisory Board for three-year terms of office, each, commencing April 1, 2022 and ending March 31, 2025; and Donna Davis as a member of the Roanoke Arts Commission to fill the unexpired term of office of Tranay Wilson ending June 30, 2022; Dr. Brenda Russ as a member of the Equity and Empowerment Advisory Board to fill the unexpired term of office of Dr. Elda Stanco Downey ending December 31, 2023; Angela Williams as a member of the Gun Violence Prevention Commission to replace Taisha Steele for a three-year term of office commencing April 1, 2022 and ending March 31, 2025. Acceptance of the Promoting Safe and Stable Families - COVID funds from the Virginia Department of Social Services to assist families with housing related costs such as rent, deposits, utilities, furniture and similar material supports to promote family stability. Adopted Resolution No. 42310-032122 and Budget Ordinance No. 42311-032122 (6-0). 4 2. Acceptance of funds from the Virginia Department of Social Services for the Chafee Independent Living Center youth transportation assistance program. Authorization to submit to the Virginia Department of Transportation the required forms to identify the streets added or deleted from the City street system used to determine State Maintenance Payment eligibility. ATTEST: City Clerk. r _ _ O CITY COUNCIL AGENDA REPORT To: Honorable Mayor and Members of City Council Meeting: March 21, 2022 Subject: Promoting Safe and Stable Families - COVID Funding Background: In January 2022, the City of Roanoke Department of Social Services (DSS) was notified of the availability of funding from the Virginia Department of Social Services (VDSS) who announced that the Promoting Safe and Stable Families Program (PSSF) received additional funding authorized by Division X (Supporting Foster Youth and Families Through the Pandemic) of the Consolidated Appropriations Act 2021 , Public Law (P.L.) 116-260 in response to the COVID-19 pandemic and public health emergency. Additional funding may be used for client purchases of services and goods and requires no local match. Roanoke City DSS submitted an application for the funds and was granted $16,435. These funds must be used by September 30, 2022 and will be used primarily to assist families with housing-related costs, such as rent, deposits, utilities, furniture, and similar material supports to promote family stability. Considerations: City Council authorization is needed to accept and appropriate these funds. Recommended Action: Accept the present amount of $16,435 in funding from the Commonwealth of Virginia for Promoting Safe and Stable Families - COVID funds. Adopt the accompanying budget ordinance to increase the revenue estimate in the amount of $16,435 and to appropriate the same to the expenditure account for Social Services programs. ------- ---------------------- Robert S. CITY COUNCIL AGENDA REPORT To: Honorable Mayor and Members of City Council Meeting: March 21 , 2022 Subject: Chafee Independent Living Transportation Assistance Program Funds Background: In January 2022, the City of Roanoke Department of Social Services (DSS) was notified of the availability of funding from the Virginia Department of Social Services (VDSS) who announced that funding was available to aid youth in the Chafee Independent Living program with costs associated with transportation. These funds can be used to support Chafee Program eligible youth, ages 14 up to 23, with transportation assistance as the department determines up to $4,000 per youth. Considerations: The total allocation is $30,860 and has no local match. These funds must be used before September 30, 2022, but staff are being encouraged to use the funds prior to the end of the FY22 budget cycle as no funds were requested in the FY23 budget for this due to the timing of the announcement. These costs may be related but not limited to: • DMV learner's and driver's license fees vehicle insurance for at least 6 months • driver's education classes / driving school • behind the wheel services to obtain the 40 hours of practice driving (required to get a driver's license) testing fees • roadside assistance • vehicle purchase • vehicle repairs • other driving and transportation related expenses City Council authorization is needed to accept and appropriate these funds. ATTEST: r City Clerk. - - - CITY COUNCIL AGENDA REPORT To: Honorable Mayor and Members of City Council Meeting: March 21 , 2022 Subject: Annual Submission of Street Inventory to VDOT for Maintenance Payment Eligibility Background: Section 33.2-319 of the Code of Virginia establishes the eligibility criteria of localities for receiving funds from the Virginia Department of Transportation (VDOT) for street maintenance. It specifies two functional classifications of roadways (Principal/Minor Arterials and Collector/Locals) and establishes a base payment rate per lane mile for each classification of roadway. These rates are adjusted annually by VDOT based upon a statewide maintenance index of unit costs for labor, equipment, and materials used by VDOT on roads and bridges. Typically, the City submits a list of streets either added to, or deleted from, the City system to VDOT once a year. Upon approval of this list, VDOT adjusts the annual reimbursement received by the. City for street maintenance activities. Eligible expenditures include costs for maintenance of streets, landscapes, sidewalks, curb and gutter, traffic signals, bridges, signs and pavement markings, and snow removal. Considerations: To streamline this recurring process, a single resolution may be used to authorize the City Manager or his designee to make submissions as required for all future years. This resolution is attached to the appropriate forms at the time of each submission. A council update will be provided at each submission to VDOT. The section of the Code of Virginia cited in the previous resolution is inaccurate, and the resolution is no longer acceptable by VDOT for submission. The previous resolution No. 37009-040405 would be superseded by this new resolution. That tax relief shall be allocated such as to provide 100% tax relief for qualifying personal use vehicles valued at $1,000 or less. 2. That qualifying personal use vehicles valued at $20,001 or more shall only receive 45.9%tax relief on the first $20,000 of value. 4. That all other vehicles which do not meet the definition of "qualifying" (for example, including but not limited to, business use vehicles, farm use vehicles, motor homes, etc.) will not be eligible for any form of tax relief under this program. 5. That the percentages applied to the categories of qualifying personal use vehicles are estimated fully to use all available PPTRA funds allocated to the City of Roanoke by the Commonwealth of Virginia. (Vehicles valued at $1 ,000 and below are exempt from taxation.) The amount of relief each locality receives from the Commonwealth has been fixed since 2006. The City of Roanoke budgets in anticipation of receiving $8,075,992 annually. Considerations: City Council is required by the Commonwealth to annually adopt a resolution setting the percentage reduction in personal property for that year. City staff computed the effective reimbursement rate using information provided by the Commissioner of the Revenue and trend data. The percentage reduction is calculated to distribute the $8,075,992 block grant allocation from the Commonwealth in conformance with the state code. The rate as computed for tax year 2022 is 45.9%, a decrease from the 2021 rate of 52.1%. The tax year 2022 rate is based on historical growth rates of qualifying vehicles. Recommended Action: Adopt the attached resolution which establishes the percentage reduction for personal property tax relief at 45.9% for the City of Roanoke for the 2022 tax year. Robert S. The purpose of the Project was to enhance the connection between Orange Avenue and Williamson Road, and make design improvements to enhance the flow of traffic while creating a bicycle and pedestrian friendly environment. The Project has been completed, and VDOT, per its standard operating procedure, desires to convey the residual rights-of-way and other property interests remaining from the Project to the City for the locality to maintain. The Commonwealth of Virginia, through the Commissioner of Highways, has executed a quitclaim deed dated August 4, 2021, conveying these property interests to the City. A copy of the August 4, 2021, quitclaim deed is attached to this letter. The property interests are described in the deed as being: [A]ll the lands and permanent easements lying on both sides of the centerline of 10th Street, and between the left and right limits of the existing and proposed right-of-way lines including connections to various streets; those permanent easements lying outside of the proposed right-of- way limits; and being a portion of the lands or property interests acquired by the Commonwealth of Virginia for public street purposes from various parties as such parcels are shown on the Right-of-Way and Utilities Division Conveyance Report dated August 4, 2021, a copy of which is attached to the deed. The 2021 -22 Title III, Part A, Limited English Proficient (LEP) grant was awarded to Roanoke City Public Schools from federal funding to support programs to improve the education of limited English proficient children and youth by helping them learn English and meet challenging state content and achievement standards. The program will be fully reimbursed by federal funds in amount of $165,212. This appropriation aligns the total with the revised award amount. The grant period will end September 30, 2023. The program provides that option through a high school equivalency credential plus college and workforce readiness skills. The program will be fully reimbursed by state funds in amount of $41 ,164 and will end ,June 30, 2022. This award represents funding provided by United Healthcare Vision as part of a national public awareness campaign focused on children's eye health and helping support the well-being of young people as they spend more time using digital devices for learning and fun. These funds will be used to help meet the needs of students, as well as provide educational materials to help reduce the risk of digital eye strain amid increased use of screen time by children and adults. This is a new award in amount of $20,000. Recommended Action: We recommend that Council concur with this report of the School Board and adopt the attached budget ordinance to establish revenue estimates and to appropriate funding as outlined. Proposed Use/Development: The developer would like to close the alleys by barricade to provide a safer environment for the future tenants by eliminating vehicular traffic and loitering while providing lighting and maintenance of the outdoor space. The alley to the west of the 117 Franklin Road and the alley running parallel to Franklin Road to the rear of 117 Franklin Road will be closed by barricade with the applicant taking over the maintenance and liability of the alleyway. 2 The applicant proposes putting up a gate at the entrance of these alleys to make them pedestrian only and to limit access through the gates to tenants of the two buildings (120 Luck and 1 1 7 Franklin). The property at 120 Luck Avenue SW has also been recently redeveloped to include apartments and the closure of the alley to the general public would also be beneficial to that property owner. Considerations: The primary consideration in closing a public right-of-way is any inconvenience that the vacation may create. Impact of Street Vacation to Public Accessibility: Both alleys proposed for vacation and closure by barricade provide no public connections as they terminate into private property (portions of the alleys that would have provided connections have already been vacated). The applicant would like to continue this pattern through closure by barricade of the alleys as proposed. Impact of Street Vacation to Public Services: The closure by barricade of the alleys will still require some coordination with public utilities. Access will need to be granted when necessary to the Western Virginia Water Authority for a sewer line located in both alleys and to Roanoke Gas for a gas line located in the side alley to the west of Franklin Road. The City will also require access as needed for inspection of the right of way along both alleys and for access to a stormwater facility located in the rear alley to the north of 1 1 7 Franklin Road. The maintenance for the right-of-way will be conditioned to be the responsibility of the applicant. If at any time the closure by barricade is officially removed, the maintenance will revert back to the City of Roanoke.
