ANNOUNCEMENTS:
The Council of the City of Roanoke is seeking applications for the following
current vacancies and/or upcoming expirations of terms of office:
Building and Fire Code Board of Appeals — one vacancy (Architect)
Roanoke Public Library Board —two vacancies
Virginia Western Community College Local Advisory Board — one vacancy
Access the City's homepage to complete an online application for the
abovementioned vacancies.
2. PRESENTATIONS AND ACKNOWLEDGEMENTS:
A proclamation declaring May 15 - 21, 2022 as National Public Works Week.
Mayor Lea declared May 15 - 21, 2022 as National Public Works Week and
presented the proclamation to Mark Jamison, Director, Public Works.
A proclamation declaring Thursday, May 20, 2022 as Bike to Work Day.
Mayor Lea declared Thursday, May 20, 2022 as Bike to Work Day and
presented the proclamation to Barbara Duerk, Bicycle Enthusiast.
3. HEARING OF CITIZENS UPON PUBLIC MATTERS:
City Council sets this time as a priority for citizens to be heard. If deemed
appropriate, matters will be referred to the City Manager for response,
recommendation or report to the Council.
Cindy Vancott, 4527 Edgelawn Avenue, N. W., appeared before the Council
and spoke with regard to the Embassy Inn property and complained about
disruptive behavior in the neighborhood, such as dealing drugs and
prostitution.
Freeda Cathcart, 2516 Sweetbrier Avenue, S. W., appeared before the
Council on behalf of the Grandin Court Neighborhood Association, and
spoke with regard to adding stipulations to the deed with regard to the sale
of the Fishburn Cabin property.

4. CONSENT AGENDA:
(APPROVED 7-0)
All matters listed under the Consent Agenda are considered to be routine by the
Members of City Council and will be enacted by one motion. There will be no
separate discussion of the items. If discussion is desired, the item will be
removed from the Consent Agenda and considered separately.
C-1 Minutes of the regular meeting of City Council held on Monday, April 4,
2022; recessed until Monday, April 18, 2022, at 10:30 a.m.
RECOMMENDED ACTION: Dispensed with the reading of the minutes
and approved as recorded.
C-2 A communication from the City Manager requesting that Council schedule
a public hearing to be held on Monday, June 21, 2022, at 7:00 p.m., or as soon
thereafter as the matter may be heard, or such later date and time as the City
Manager may determine, in his discretion, on the issuance of General Obligation
Bonds not to exceed $48,120,000 million for qualifying capital improvement
projects and bond issuance costs.
RECOMMENDED ACTION: Concurred in the request.
C-3 A communication from the City Manager requesting that Council convene
in a Closed Meeting to discuss the disposition of an approximately one acre
portion of City-owned property located at 2424 Brambleton Avenue, S. W., where
discussion in an open meeting would adversely affect the bargaining position or
negotiating strategy of the public body, pursuant to Section 2.2-3711 (A)(3),
Code of Virginia (1950), as amended.
RECOMMENDED ACTION: Concurred in the request.
C-4 Reports of qualification of the following individuals:
Lori Baker-Lloyd as a member (Citizen a Large) of the Personnel
and Employment Practices Commission to fill the unexpired term of
office of Richard Morrison ending June 30, 2022;
John Francis, Jr., as a member of the Virginia Western Community
College Local Advisory Board for a four-year term of office
commencing July 1, 2022 and ending June 30, 2026;
Deatria Muse as a member of the Court Community Corrections
Program Regional Community Criminal Justice Board to replace
The Honorable Tim Allen for a three-year term of office
commencing July 1, 2022 and ending June 30, 2025; and

Christopher Ramey as a member (law enforcement) of the Towing
Advisory Board to replace Lieutenant James Price, Jr., for a term of
office ending October 31, 2024.

COMMENTS OF THE CITY MANAGER.
The City Manager offered the following comments:
Washington Park Basketball Court Dedication in honor of Ricky
Renell Wright
• Friday, May 20, at 4:00 p.m., at the Washington Park newly refurbished
basketball courts.
• Immediately following dedication, three on three basketball tournament,
weather permitting.
Economic Development Strategic Plan Kickoff
• Economic Development Strategic Plan Project kicked off last week, with
briefings and updates to come before the Council and public as it
advances.
Complete Neighborhood Center Analysis
• Project previously centered in the Gainsboro neighborhood, but work was
taking place all over the City.
• More information to come.
National Police Week
• As part of the National Police Week, National Peace Officers Memorial
Day on May 15 established by President Kennedy to honor men and
women killed in the line of duty.
• Fifteen Roanoke City Police Officers have died in the line of duty the first
patrol officer in 1892 and as recently as 1992.
8. REPORTS OF COMMITTEES:
a. A report of the Roanoke City School Board requesting appropriation of
funds for various educational programs; and a report of the City Manager
recommending that Council concur in the request. Donna Caldwell,

Vice-Mayor White-Boyd announced if anyone was interested in

Council Member Cobb updated the Council on the new Valley Metro
Transfer Station Project, noting that it was ahead of schedule in
some ways, three new electric buses purchased, and the
micro-transit "METROFLEX" program would launch soon for
Monday through Saturday service.

NATIONAL PUBLIC WORKS WEEK
WHEREAS, public works professionals focus on infrastructure, facilities,
emergency management, and services that are of vital importance to sustainable
and resilient communities and the public health, high quality of life, and well-
being of the people of the City of Roanoke;
WHEREAS, these infrastructure elements,facilities, and services could not be
provided without the dedicated efforts of public works professionals, who are
federally mandated first responders, and the engineers, managers, and employees
at all levels of government and the private sector, who are responsible for
rebuilding, improving, and protecting our nation's transportation, water supply,
water treatment and solid waste systems, public buildings, and other structures
and facilities essential for our citizens;
WHEREAS, it is in the public interest for the citizens, civic leaders, and
children in the City of Roanoke to gain knowledge and maintain ongoing interest
and understanding of the importance of public works first responders and public
works programs in their respective communities;and,
WHEREAS, the year 2022 marks the 62nd annual National Public Works Week
sponsored by the American Public Works Association.
NOW, THEREFORE, I, Sherman P. Lea, Sr., Mayor of the City of Roanoke,
Virginia, urge all citizens to pay tribute to our public works professionals,
engineers, managers, operators and employees and to recognize the substantial
contributions they make to protecting our national health,safety, and quality of
life, and do hereby proclaim May 15 - 21, throughout this great, seven-time All-
America City, as National Public Works Week.

BIKE TO WORKDAY
WHEREAS, the City of Roanoke recognizes healthy living for all Virginians and
promotes bicycling for transportation,recreation,fitness and fun;
WHEREAS,the City of Roanoke respects bicycling as a healthy activity that can
reduce the onset of chronic disease beginning in our children and is identifying
projects that connect our Commonwealth by walking and bicycling;
WHEREAS, the City of Roanoke supports the Police and Sheriff Department
employee cyclists;
WHEREAS, the City of Roanoke has contributed to the Commonwealth being
nationally ranked at#7 in bicycling friendliness because of success in providing
on road and off-road alternative transportation accommodations;
WHEREAS, the City of Roanoke acknowledges the positive economic impact of
off-road cycling and acknowledges that the International Mountain Bicycling
Association (IMBA) has awarded the Vizginia's Blue Ridge Region as a Silver-
Level Ride Center and claims the Blue Ridge Region of the Commonwealth as
America's East Coast Mountain Biking Capitol;and
WHEREAS, the City of Roanoke recognizes the positive economic impact of on-
road cycling and acknowledges that the Virginia Blue Ridge Region annually
hosts an Ironman competition and is the home base for the Virginia's Blue Ridge
TWENTY24 women's diverse professional and junior cyclists with plans to
announce USA Cycling events in 2022 and 2023;and
WHEREAS, May as Bike Month provides an opportunity to increase public
awareness of the healthy benefits of bicycling, to promote bicycle safety, and to
encourage bike riding through organized activities such as Bike-to-Work events,
club rides,family rides,and bike rodeos for children.
NOW, THEREFORE,I,Sherman P.Lea,Mayor of the City of Roanoke, Virginia
joins in recognition of bicyclist throughout our community, and do hereby
proclaim May 20, 2022, throughout this great, seven-time All America City as,

Background:
On May 9, 2022, City Council adopted the Capital Improvement Program (CIP)
Update for FY 2023-2027. The CIP includes bond issuance in FY 2023 in the
amount not to exceed $48,120,000 million for the following projects:
FY 2023
■ School Facility Maintenance and Improvements $12,750,000
■ Bridge Renovation 13,750,000
■ Libraries 300,000
■ Parks and Recreation Master Plan 2,750,000
■ Berglund Center Improvements 1 ,500,000
■ Stormwater Management 4,000,000
■ Curb, Gutter and Sidewalk Program 2,335,000
■ Street Paving and Streetscape Improvements 1 ,500,000
■ Fleet Capital Replacements 1 ,600,000
■ Technology Capital 3,330,000
■ Fire Facility Master Plan 500,000
■ Capital Building Maintenance 1 ,935,000
Total: $46,250,000
Considerations:
Council authorization of a public hearing on the issuance of debt is required to
ensure that the public hearing notices are published in accordance with State
Code requirements. The public hearing is to be scheduled for June 21 , 2022 at
7:00 p.m.
Recommended Action:
Authorize a public hearing to be scheduled at City Council's meeting on .June
21 , 2022, at 7:00 p.m., or as soon thereafter as the matter may be heard, or at
such later date and time as the City Manager may determine, on the issuance of
general obligation bonds not to exceed $48,120,000 million for qualifying
Capital Improvement Projects. This authorization includes authorization to
provide proper notification and publication of such public hearing in
accordance with State Code requirements on or about June 1 , 2022 and June 8,
2022.

Subject: Acceptance of funds from the Economic Development Authority of
the City of Roanoke for the Department of Economic Development
Strategic Plan
Background:
In October 2021 , the City of Roanoke (City) issued a Request for Proposal (RFP) 22-09-
27 seeking competitive proposals from qualified offerors to provide consulting services
related to the development of a strategic plan for the City's Department of Economic
Development. Due to the extensive scope of the undertaking, City Management
established that the amount for these services could not exceed $100,000.00. The City
intends to pay $50,000 of this amount from the City Manager's Contingency Fund. On
November 17, 2021 , the Economic Development Authority of the City of Roanoke (EDA)
voted to approve the City's request to fund the difference up to $50,000.00.
On April 29, 2022, the City entered into a contract totaling $98,118 with Ernst &
Young U.S., LLP (EY) to develop a strategic plan in accordance with the terms listed in
the RFP. The City intends to pay its $50,000 portion of this contract from the City
Manager's Contingency Fund. In addition, the EDA is prepared to transfer $48,118 to
the City for the remaining portion of the contract. This contract is for one year from
the date of execution.
Recommended Action:
Adopt the attached budget ordinance to accept the amount of $48,118 from the EDA
as its contribution toward the remaining amount of EY's contract for development of a
strategic plan for the City's Department of Economic Development. All documents are
subject to approval as to form by the City Attorney.

SCOPE OF WORK
The following are the services and/or items that Contractor is required to provide.
A. Vision Development
Work with City leaders, Economic Development staff, business owners, and members
of the community to craft a vision and strategy centered on job creation, increasing
business investment, fostering innovation and entrepreneurship, and ensuring more
inclusive opportunities for all residents and business leaders.
B. Organizational Structure Review and Analysis
Review existing departmental operations and provide insights and recommendations
on how best to restructure the Department to meet the needs of citizens, businesses,
and entrepreneurs, as well as to ensure maximum competitiveness in the 21 sc Century.
C. Strategy Development
1. Determine departmental role in supporting economic and community partners,
including businesses, entrepreneurs, nonprofits, and the Economic Development
Authority of the City of Roanoke.
2. Give structure to departmental initiatives that are community development in
nature, including efforts to expand business opportunities and services in
traditionally underrepresented communities, implementation of the neighborhood
centers plan, and counseling services intended to improve the financial literacy
and stability of our residents.
3. Develop a roadmap defining the City's commitment to innovation and
entrepreneurship, including the role to be played by the Innovation Manager,
development of the Innovation Corridor, strategic use of the Roanoke Innovates
platform, and efforts to support the City's innovation ecosystem partners.
4. Formalize the Department's approach to the three traditional legs of the economic
development "stool" — business attraction, retention, and expansion — with

particular focus on strengthening attraction efforts.
5. Draft and Develop a Five-Year Strategic Plan.
From outreach data and facilitated strategic planning sessions, draft and develop a
five-year strategic plan for the Department of Economic Development.
This plan will include the following:
a. Findings from the public outreach;
b. Mission statement and vision that reflects the community's current and
future needs;
c. Prioritized goals and objectives for meeting those goals;
d. Evaluation of current priorities and recommendations for development of
different or new priorities as needed;
e. Performance criteria to measure the success of strategic directives;
f. Recommendations for method and timeline for plan updates and revisions;
g. Action items with a recommended schedule and strategies for
implementing the recommendations.
6. Present Draft Strategic Plan to City Leadership (including the Economic
Development Director) for input and recommended changes.
7. Finalize and Deliver Final Strategic Plan.
8. Future Consultation As Needed. Consultant shall make themselves available for
future consultation as to alignment of Strategic Plan with other, related City plans
and other major planning documents. (Compensation for this service is not
included in the contract amount, but will be negotiated at the time service is
requested.)

WHEREAS,the Fiscal Year 2022-2023 budget approved by City Council for the Roanoke Arts
Commission provides for funding in the amount of$336,500;
WHEREAS, in order for nonprofit agencies to obtain an allocation for such funds, it was
necessary for such agencies to file applications with the Arts Commission Agency Funding Advisory
Committee;
WHEREAS, requests for City funding in the total amount of$495,343 were received by the
Committee from twenty-six (26) agencies; and
WHEREAS, after studying each application and holding rating and allocation meetings, the
Committee recommended and the Arts Commission approved allocation of funding in the amount of
$336,500 to such agencies and the Arts Commission for Fiscal Year 2022-2023, subject to City Council

Subject: Recommendations of the Roanoke Arts Commission on Arts
and Cultural Agency Funding for FY 2022-2023
Background:
The Roanoke Arts Commission Agency Funding Advisory Committee budget, in
the amount of $336,500, was established by City Council with the adoption of
the General Fund budget for FY 2022-2023 on May 9, 2022.
A pre-proposal meeting was held in December 2021 to assist the agencies and
organizations with the application process. Applications that included
procedures and ratings criteria were distributed to all former recipients and
other interested organizations.
Applications from twenty-six (26) agencies totaling $495,343 were received as
indicated on Attachment A. These agencies each applied for funds to support
specific exhibitions, performances or educational programs.
Committee members thoroughly studied each application and interviewed
representatives of the applicant organizations prior to a rating and allocation
meeting held in April 2022. Through the application, organizations are required
to demonstrate how their proposal would support implementation of the City's
Arts and Cultural Plan or City Plan 2040. Agencies were also rated on other
indicators such as effective management, financial health, collaboration, equity
efforts, and if the proposed program meets a need in the community. The
committee also considered the report from the program monitor, Douglas
Jackson, Arts and Culture Coordinator, on the performance of the organizations
funded the previous fiscal year. The monitor collects quarterly reports and
conducts an annual site visit. The committee presented the recommendations
to the entire Roanoke Arts Commission and these recommendations were
unanimously approved on April 19, 2022 to present to City Council as attached.
Agencies were then notified of the Arts Commission recommendations and
tentative funding allocations, subject to final approval by City Council.
Considerations:
The funding criteria by which applications are scored also reflect the major
priority areas established by City Council in the Budgeting for Outcomes
process.
Recommended Action:
Concur with and approve the Roanoke Arts Commission's allocation for funding
various nonprofit agencies for fiscal year 2022-2023 as set forth in Attachment
A to this report.
Adopt the accompanying budget ordinance to transfer $336,500 as cited on
Attachment A from the Roanoke Arts Commission Agency Funding Advisory
Committee into accounts to be established by the Director of Finance within the
Roanoke Arts Commission budget.

Stormwater and Parks Projects.
Background:
On June 21 , 2021 , City Council approved the Capital Improvement Program (CIP)
Update for FY2022-2026. The CIP included planned debt issuance in FY 2022 in the
amount of $31 ,555,000. Included in this was $3,000,000 for Stormwater projects and
$3,000,000 for Parks and Recreation Master Plan projects. These funds were
appropriated in advance of the issuance of bonds on July 21 , 2021 with Budget
Ordinance 42119-07192 1 .
These funds had not been spent at a rate originally thought due to project delays and
supply chain issues. On April 28, 2022 $28,555,000 in General Obligation Bonds were
sold which excluded from the authorized issuance $1 ,000,000 from Stormwater
projects and $2,000,000 from Parks and Recreation Master Plan projects.
The delayed funds were included in the CIP update for FY2023-2027 on May 9, 2022.
Considerations:
Issuing debt close to the time of actual use is a good financial practice. City Council
authorization is required to de-appropriate the previously advance appropriated bond
fund that were not issued.
Recommended Action:
Adopt the accompanying budget ordinance to de-appropriate $1 ,000,000 from
Stormwater Capital Accounts and $2,000,000 Parks Capital Accounts.

In order to keep in compliance with the Revenue Sharing program and VDOT,
the City will need to execute new SPAA (copies attached). In doing so, the SPAA
will be in effect until the project is completed. The City will also need to sign
updated Appendices for each of the active or completed but unclosed Revenue
Sharing projects (copies attached).
VDOT is also requesting each locality, by resolution: 1 ) provide assurance of its
commitment to funding of the projects under the SPAA and in meeting its
financial obligation under the Program; and 2) provide a designation of
signature authority so there is no question regarding commitment of funds and
signature authority.
Recommended Action:
1 . Authorize the City Manager to execute the Virginia Department of
Transportation's SPAA, approved as to form by the City Attorney, to
permit continuance of currently funded Revenue Sharing Projects.
2. Agree to commit to fund the City's local share of preliminary engineering,
right of way, and construction of the projects under agreement with
VDOT in accordance with the project agreement financial documents.
3. Authorize the City Manager to negotiate and execute such further
documents and take such further actions with VDOT as needed to
advance transportation projects and as may be necessary to implement,
administer, and enforce the VDOT SPAA, with any such documents to be
approved as to form by the City Attorney.

STANDARD PROJECT ADMINISTRATION AGREEMENT

THIS AGREEMENT, is hereby made and executed the date of the last signature set forth
below, by and between the CITY OF ROANOKE, VIRGINIA, hereinafter referred to as the
LOCALITY and the Commonwealth of Virginia,Department of Transportation, hereinafter
referred to as the DEPARTMENT. The DEPARTMENT and the LOCALITY are collectively
referred to as the"Parties".
WHEREAS,the LOCALITY has expressed its desire to administer the work described in
Appendix A, and such work for each improvement shown is hereinafter referred to as the
Project; and
WHEREAS,the funds shown in Appendix A have been allocated to finance the
Project(s) and the funding currently allocated or proposed for the project(s) does not include
Federal-aid Highway funds; and
WHEREAS, both parties have concurred in the LOCALITY's administration of the
phase(s) of work for the respective Project(s) listed in Appendix A in accordance with applicable
federal, state and local laws and regulations.
NOW THEREFORE, in consideration of the mutual premises contained herein,the
parties hereto agree as follows:
1. The LOCALITY shall:
a. Be responsible for all activities necessary to complete the noted phase(s) of each
Project shown in Appendix A, except for activities, decisions, and approvals which
are the responsibility of the DEPARTMENT, as required by federal or state laws and
regulations or as otherwise agreed to, in writing,between the parties.
b. Receive prior written authorization from the DEPARTMENT to proceed with the
project.
c. Administer the project(s) in accordance with guidelines applicable to Locally
Administered Projects as published by the DEPARTMENT.
d. Provide certification by a LOCALITY official of compliance with applicable laws
and regulations on the State Certification Form for State Funded Projects or in
another manner as prescribed by the DEPARTMENT.
e. Maintain accurate and complete records of each Project's development of all
expenditures and make such information available for inspection or auditing by the
DEPARTMENT. Records and documentation for items for which reimbursement

will be requested shall be maintained for not less than three (3) years following
acceptance of the final voucher on each Project.
f. No more frequently than monthly, submit invoices with supporting documentation to
the DEPARTMENT in the form prescribed by the DEPARTMENT. The supporting
documentation shall include copies of related vendor invoices paid by the
LOCALITY and also include an up-to-date project summary and schedule tracking
payment requests and adjustments.
g. Reimburse the DEPARTMENT all Project expenses incurred by the DEPARTMENT
if due to action or inaction solely by the LOCALITY the project becomes ineligible
for state reimbursement, or in the event the reimbursement provisions of Section
33.2-214 or Section 33.2-331 of the Code of Virginia, 1950, as amended, or other
applicable provisions of state law or regulations require such reimbursement.
h. On Projects that the LOCALITY is providing the required match to state funds, pay
the DEPARTMENT the LOCALITY's match for eligible Project expenses incurred
by the DEPARTMENT in the performance of activities set forth in paragraph 2.a.
i. Administer the Project in accordance with all applicable federal, state, and local laws
and regulations. Failure to fulfill legal obligations associated with the project may
result in forfeiture of state-aid reimbursements
j. If legal services other than that provided by staff counsel are required in connection
with condemnation proceedings associated with the acquisition of Right-of-Way, the
LOCALITY will consult the DEPARTMENT to obtain an attorney from the list of
outside counsel approved by the Office of the Attorney General. Costs associated
with outside counsel services shall be reimbursable expenses of the project.
k. For Projects on facilities not maintained by the DEPARTMENT, provide, or have
others provide, maintenance of the Project upon completion, unless otherwise agreed
to by the DEPARTMENT.
2. The DEPARTMENT shall:
a. Perform any actions and provide any decisions and approvals which are the
responsibility of the DEPARTMENT, as required by federal or state laws and
regulations or as otherwise agreed to, in writing, between the parties.
b. Upon receipt of the LOCALITY's invoices pursuant to paragraph Lf, reimburse the
LOCALITY the cost of eligible Project expenses, as described in Appendix A. Such
reimbursements shall be payable by the DEPARTMENT within 30 days of an
acceptable submission by the LOCALITY.
c. If appropriate, submit invoices to the LOCALITY for the LOCALITY's share of
eligible project expenses incurred by the DEPARTMENT in the performance of
activities pursuant to paragraph 2.a.

d. Audit the LOCALITY's Project records and documentation as may be required to
verify LOCALITY compliance with applicable laws and regulations.
e. Make available to the LOCALITY guidelines to assist the parties in carrying out
responsibilities under this Agreement.
3. Appendix A identifies the funding sources for the project, phases of work to be
administered by the LOCALITY, and additional project-specific requirements agreed to
by the parties. There may be additional elements that, once identified, shall be addressed
by the parties hereto in writing,which may require an amendment to this Agreement.
4. If designated by the DEPARTMENT, the LOCALITY is authorized to act as the
DEPARTMENT's agent for the purpose of conducting survey work pursuant to Section
33.2-1011 of the Code of Virginia, 1950, as amended.
5. Nothing in this Agreement shall obligate the parties hereto to expend or provide any
funds in excess of funds agreed upon in this Agreement or as shall have been included in
an annual or other lawful appropriation. In the event the cost of a Project is anticipated to
exceed the allocation shown for such respective Project on Appendix A, both parties
agree to cooperate in providing additional funding for the Project or to terminate the
Project before its cost exceeds the allocated amount, however the DEPARTMENT and
the LOCALITY shall not be obligated to provide additional funds beyond those
appropriated pursuant to an annual or other lawful appropriation.
6. Nothing in this agreement shall be construed as a waiver of the LOCALITY's or the
Commonwealth of Virginia's sovereign immunity.
7. The Parties mutually agree and acknowledge, in entering this Agreement, that the
individuals acting on behalf of the Parties are acting within the scope of their official
authority and the Parties agree that neither Party will bring a suit or assert a claim against
any official, officer, or employee of either party, in their individual or personal capacity
for a breach or violation of the terms of this Agreement or to otherwise enforce the terms
and conditions of this Agreement The foregoing notwithstanding, nothing in this
subparagraph shall prevent the enforcement of the terms and conditions of this
Agreement by or against either Party in a competent court of law.
8. The Parties mutually agree that no provision of this Agreement shall create in the public,
or in any person or entity other than parties, rights as a third party beneficiary hereunder,
or authorize any person or entity, not a party hereto, to maintain any action for, without
limitation, personal injury, property damage, breach of contract, or return of money, or
property, deposit(s), cancellation or forfeiture of bonds, financial instruments, pursuant to
the terms of this of this Agreement or otherwise. Notwithstanding any other provision of
this Agreement to the contrary, unless otherwise provided, the Parties agree that the
LOCALITY or the DEPARTMENT shall not be bound by any agreements between the
either party and other persons or entities concerning any matter which is the subject of

this Agreement, unless and until the LOCALITY or the DEPARTMENT has, in writing,
receive a true copy of such agreement(s) and has affirmatively agreed, in writing, to be
bound by such Agreement.
9. This agreement may be terminated by either party upon 30 days advance written notice.
Eligible Project expenses incurred through the date of termination shall be reimbursed in
accordance with paragraphs Lf, l.g, and 2.b, subject to the limitations established in this
Agreement and Appendix A. Upon termination and unless otherwise agreed to, the
DEPARTMENT shall retain ownership of plans, specifications, and right of way for
which state funds have been provided, unless all state funds provided for the Project have
been reimbursed to the DEPARTMENT by the LOCALITY, in which case the
LOCALITY will have ownership of the plans, specifications, and right of way.
THE LOCALITY and DEPARTMENT acknowledge and agree that this Agreement has
been prepared jointly by the parties and shall be construed simply and in accordance with its fair
meaning and not strictly for or against any party.
THE LOCALITY and the DEPARTMENT further agree that should Federal-aid
Highway funds be added to the project, this agreement is no longer applicable and shall be
terminated. The LOCALITY and the DEPARTMENT mutually agree that they shall then enter
into a Standard Project Administration Agreement for Federal-aid Projects.
THIS AGREEMENT, when properly executed, shall be binding upon both parties, their
successors, and assigns.
THIS AGREEMENT may be modified in writing by mutual agreement of both parties.

reimbursements shall be payable by the DEPARTMENT within 30 days of an
acceptable submission by the LOCALITY.
C. If appropriate, submit invoices to the LOCALITY for the LOCALITY's share of
eligible project expenses incurred by the DEPARTMENT in the performance of
activities pursuant to paragraph 2.a.
d. Audit the LOCALITY's Project records and documentation as may be required to
verify LOCALITY compliance with applicable laws and regulations.
e. Make available to the LOCALITY guidelines to assist the parties in carrying out
responsibilities under this Agreement.
3. Appendix A identifies the funding sources for the project, phases of work to be
administered by the LOCALITY, and additional project-specific requirements agreed to
by the parties. There may be additional elements that, once identified, shall be addressed
by the parties hereto in writing, which may require an amendment to this Agreement.
4. If designated by the DEPARTMENT, the LOCALITY is authorized to act as the
DEPARTMENT's agent for the purpose of conducting survey work pursuant to Section
33.2-1011 of the Code of Virginia, 1950, as amended.
5. Nothing in this Agreement shall obligate the parties hereto to expend or provide any
funds in excess of funds agreed upon in this Agreement or as shall have been included in
an annual or other lawful appropriation. In the event the cost of a Project is anticipated to
exceed the allocation shown for such respective Project on Appendix A, both parties
agree to cooperate in providing additional funding for the Project or to terminate the
Project before its cost exceeds the allocated amount, however the DEPARTMENT and
the LOCALITY shall not be obligated to provide additional funds beyond those
appropriated pursuant to an annual or other lawful appropriation.
6. Nothing in this agreement shall be construed as a waiver of the LOCALITY's or the
Commonwealth of Virginia's sovereign immunity.
7. The Parties mutually agree and acknowledge, in entering this Agreement, that the
individuals acting on behalf of the Parties are acting within the scope of their official
authority and the Parties agree that neither Party will bring a suit or assert a claim against
any official, officer, or employee of either party, in their individual or personal capacity
for a breach or violation of the terms of this Agreement or to otherwise enforce the terms
and conditions of this Agreement The foregoing notwithstanding, nothing in this
subparagraph shall prevent the enforcement of the terms and conditions of this
Agreement by or against either Party in a competent court of law.

8. The Parties mutually agree that no provision of this Agreement shall create in the public,
or in any person or entity other than parties, rights as a third party beneficiary hereunder,
or authorize any person or entity, not a party hereto, to maintain any action for, without
limitation, personal injury, property damage, breach of contract, or return of money, or
property, deposit(s), cancellation or forfeiture of bonds, financial instruments, pursuant to
the terms of this of this Agreement or otherwise. Notwithstanding any other provision of
this Agreement to the contrary, unless otherwise provided, the Parties agree that the
LOCALITY or the DEPARTMENT shall not be bound by any agreements between the
either party and other persons or entities concerning any matter which is the subject of
this Agreement, unless and until the LOCALITY or the DEPARTMENT has, in writing,
receive a true copy of such agreement(s) and has affirmatively agreed, in writing, to be
bound by such Agreement.
9. This agreement may be terminated by either party upon 30 days advance written notice.
Eligible Project expenses incurred through the date of termination shall be reimbursed in
accordance with paragraphs IS, l.g, and 2.b, subject to the limitations established in this
Agreement and Appendix A. Upon termination and unless otherwise agreed to, the
DEPARTMENT shall retain ownership of plans, specifications, and right of way for
which state funds have been provided, unless all state funds provided for the Project have
been reimbursed to the DEPARTMENT by the LOCALITY, in which case the
LOCALITY will have ownership of the plans, specifications, and right of way.
THE LOCALITY and DEPARTMENT acknowledge and agree that this Agreement has
been prepared jointly by the parties and shall be construed simply and in accordance with its fair
meaning and not strictly for or against any party.
THE LOCALITY and the DEPARTMENT further agree that should Federal-aid
Highway funds be added to the project, this agreement is no longer applicable and shall be
terminated. The LOCALITY and the DEPARTMENT mutually agree that they shall then enter
into a Standard Project Administration Agreement for Federal-aid Projects.
THIS AGREEMENT, when properly executed, shall be binding upon both parties, their
successors, and assigns.
THIS AGREEMENT may be modified in writing by mutual agreement of both parties.

THIS AGREEMENT, is hereby made and executed the date of the last signature set forth
below, by and between the CITY OF ROANOKE, VIRGINIA, hereinafter referred to as the
LOCALITY and the Commonwealth of Virginia, Department of Transportation, hereinafter
referred to as the DEPARTMENT. The DEPARTMENT and the LOCALITY are collectively
referred to as the "Parties".
WHEREAS, the LOCALITY has expressed its desire to administer the work described in
Appendix A, and such work for each improvement shown is hereinafter referred to as the
Project; and
WHEREAS,the funds shown in Appendix A have been allocated to finance the
Project(s) and the funding currently allocated or proposed for the project(s) does not include
Federal-aid Highway funds; and
WHEREAS, both parties have concurred in the LOCALITY's administration of the
phase(s) of work for the respective Project(s) listed in Appendix A in accordance with applicable
federal, state and local laws and regulations.
NOW THEREFORE, in consideration of the mutual premises contained herein, the
parties hereto agree as follows:
1. The LOCALITY shall:
a. Be responsible for all activities necessary to complete the noted phase(s) of each
Project shown in Appendix A, except for activities, decisions, and approvals which
are the responsibility of the DEPARTMENT, as required by federal or state laws and
regulations or as otherwise agreed to, in writing, between the parties.
b. Receive prior written authorization from the DEPARTMENT to proceed with the
project.
c. Administer the project(s) in accordance with guidelines applicable to Locally
Administered Projects as published by the DEPARTMENT.
d. Provide certification by a LOCALITY official of compliance with applicable laws
and regulations on the State Certification Form for State Funded Projects or in
another manner as prescribed by the DEPARTMENT.

e. Maintain accurate and complete records of each Project's development of all
expenditures and make such information available for. inspection or auditing by the
DEPARTMENT. Records and documentation for items for which reimbursement
will be requested shall be maintained for not less than three (3) years following
acceptance of the final voucher on each Project.
f. No more frequently than monthly, submit invoices with supporting documentation to
the DEPARTMENT in the form prescribed by the DEPARTMENT. The supporting
documentation shall include copies of related vendor invoices paid by the
LOCALITY and also include an up-to-date project summary and schedule tracking
payment requests and adjustments.
g. Reimburse the DEPARTMENT all Project expenses incurred by the DEPARTMENT
if due to action or inaction solely by the LOCALITY the project becomes ineligible
for state reimbursement, or in the event the reimbursement provisions of Section
33.2-214 or Section 33.2-331 of the Code of Virginia, 1950, as amended, or other
applicable provisions of state law or regulations require such reimbursement.
h. On Projects that the LOCALITY is providing the required match to state funds, pay
the DEPARTMENT the LOCALITY's match for eligible Project expenses incurred
by the DEPARTMENT in the performance of activities set forth in paragraph 2.a.
i. Administer the Project in accordance with all applicable federal, state, and local laws
and regulations. Failure to fulfill legal obligations associated with the project may
result in forfeiture of state-aid reimbursements
j. If legal services other than that provided by staff counsel are required in connection
with condemnation proceedings associated with the acquisition of Right-of-Way, the
LOCALITY will consult the DEPARTMENT to obtain an attorney from the list of
outside counsel approved by the Office of the Attorney General. Costs associated
with outside counsel services shall be reimbursable expenses of the project.
k. For Projects on facilities not maintained by the DEPARTMENT, provide, or have

career and technical education. Expenditures must be consistent with the
approved local plan and budget and must be made during the July 1 , 2021 to
June 30, 2022 school year. This award will be fully reimbursed from federal
funds in the amount of $4,378 and will end June 30, 2022.
Recommended Action:
We recommend that Council concur with this report of the School Board and
adopt the attached budget ordinance to establish revenue estimates and to
appropriate funding as outlined.

AN ORDINANCE permanently vacating, discontinuing and closing an approximately

S.E., Official Tax Map No. 4122022, as more particularly described hereinafter; and dispensing
with the second reading of this ordinance by title.
WHEREAS, Kathryn Reyna filed an application on April 1, 2022 with the Council of the
City of Roanoke, Virginia ("City Council"), in accordance with law, requesting City Council to
permanently vacate, discontinue and close a certain public right-of-way described hereinafter;
WHEREAS, the City Planning Commission, after giving proper notice to all concerned
as required by §30-14, Code of the City of Roanoke (1979), as amended, and after having
conducted a public hearing on the matter, has made its recommendation to Council;
WHEREAS, a public hearing was held on such application by City Council on May 16,
2022, after due and timely notice thereof as required by §30-14, Code of the City of Roanoke
(1979), as amended, at which hearing all parties in interest and citizens were afforded an
opportunity to be heard on such application; and
WHEREAS, from all of the foregoing, City Council considers that no inconvenience will
result to any individual or to the public from permanently vacating, discontinuing and closing
such public right-of-way.

THEREFORE, BE IT ORDAINED by the Council of the City of Roanoke, Virginia, that
the public right-of-way situated in the City of Roanoke, Virginia, and more particularly
described as follows:
Portion of a Street right-of-way adjacent to 1037 Highland Avenue, S.E.,
bearing Official Tax Map No. 4122022, consisting of approximately 3,920
square feet along 11th Street, S.E. between Highland Avenue, S.E., to the
north and an alley to the south
be, and is hereby permanently vacated, discontinued and closed, and that all right and interest of
the public in and to the same be, and hereby is, released insofar as City Council is empowered so
to do with respect to the closed portion of the right-of-way, reserving however, to the City of
Roanoke and any utility company or public authority, including, specifically, without limitation,
providers to or for the public of cable television, electricity, natural gas, telephone service, or
stormwater, an easement for sanitary sewer and water mains, television cable, electric wires, gas
lines, telephone lines, stormwater facilities, and related facilities that may now be located in or
across such public right-of-way, together with the right of ingress and egress for the maintenance
or replacement of such lines, mains or utilities, such right to include the right to remove, without
the payment of compensation or damages of any kind to the owner, any landscaping, fences,
shrubbery, structure or any other encroachments on or over the easement which impede access
for maintenance or replacement purposes at the time such work is undertaken; such easement or
easements to terminate upon the later abandonment of use or permanent removal from the above-
described public right-of-way of any such municipal installation or other utility or facility by the
owner thereof.
1. The applicant shall, upon meeting all other conditions to the granting of the
application, deliver to the Clerk of the Circuit Court of the City of Roanoke, Virginia, a certified
copy of this ordinance for recordation where deeds are recorded in such Clerk's Office, indexing

the same in the name of the City of Roanoke, Virginia, as Grantor, and in the name of the
applicant, and the names of any other parties in interest who may so request, as Grantees, and
pay such fees and charges as are required by the Clerk to effect such recordation.
2. The applicant shall, upon a certified copy of this ordinance being recorded by the
Clerk of the Circuit Court of the City of Roanoke, Virginia, file with the City Engineer for the
City of Roanoke,Virginia, the Clerk's receipt, demonstrating that such recordation has occurred.
3. The applicant shall submit a subdivision plat to the Agent for the Planning
Commission, receive all required approvals of, and record the plat with the Clerk of the Circuit
Court for the City of Roanoke. Such plat shall combine all properties which would otherwise
dispose of the land within the right-of-way to be vacated in a manner consistent with law, and
retain appropriate easements for the installation and maintenance of any and all existing utilities
that may be located within the right-of-way, including the right of ingress and egress.
4. If the above conditions have not been met within a period of one year from the
date of the adoption of this ordinance, then such ordinance shall be null and void with no further
action by City Council being necessary, unless extended by the Agent for the Planning
Commission for an additional six (6)months prior to the end of the one year period.

11 th Street SE between Highland Avenue SE to the north and an
alley to the south of the subject property.
Recommendation
The Planning Commission held a public hearing on Monday, May 9, 2022. By a
vote of 5-0 with Ms. Smith and Ms. Atwood absent, the Commission
recommended approval of the vacation as requested, contingent upon the
following conditions:
1 . Upon meeting all conditions to the granting of the application, the
applicant shall deliver a certified copy of this ordinance for recordation to
the Clerk of the Circuit Court of Roanoke, Virginia, indexing the same in
the name of the City of Roanoke, Virginia, as Grantor, and in the name of
the petitioner, and the names of any other parties in interest who may so
request, as Grantees. The applicant shall pay such fees and charges as
are required by the Clerk to effect such recordation.

Background:
The applicant seeks to vacate an approximately 3,920 square foot portion of
right of way adjacent to her property at 1037 Highland Avenue SE. This section
of right of way appears to be a holdover from the original subdivision layout
dated 1889 when 1 V' Street SE, then referred to as Tayloe Street, may have
been planned to be wider than the present day 54 feet. At some point in the
1920s, consideration may have been given to vacating the subject right of way,
as a map was produced for W. H. Bohon in 1927 noting that the strip was not
used for street purposes. Vacating this portion would create consistency in the
width of 1 V' Street SE with the neighboring blocks.
Proposed Use/Development:
The applicant will incorporate the vacated right of way into her existing yard
and maintain it as such. The vacation would also allow the applicant to install a
fence to deter people at the adjacent bus stop from wandering onto her
property.
Considerations:
The primary consideration in vacating a public right-of-way is any inconvenience
that the vacation may create.

Impact of Street Vacation to Public Accessibility:
This vacation will have no impact on public accessibility, as the portion of right
of way presently contains no public access and appears, acts as, and is
maintained as included with the applicant's property.
Impact of Street Vacation to Public Services:
The proposed vacation does not impact City of Roanoke public services.
The proposed vacated right of way will not have an impact on public services as
there appears to be no public or private utilities within the bounds of the
proposed vacated area.
Consistency with Comprehensive Plan:
The City's Comprehensive Plan states that Roanoke will "encourage active,
productive uses of land and preclude unproductive uses of land." By vacating
this section of right of way, the City will be divesting itself of land that was once
intended for street use but made irrelevant and unnecessary by development
patterns in the area.
The Morningside/Kenwood/Riverdale Neighborhood Plan states in reference to
street width that streets "should be kept at minimum necessary to
accommodate vehicular traffic and on-street parking." By vacating this section
of right of way, the City will be reducing the potential for street over-widening.
Comments on Application:
Public Utilities:
There are no public utilities located within the subject section of right of way.

Location and description of street or alley to be closed: My home is at 1037 Highland Avenue SE.I just bought it
in August of 2021.Looking at the GIS maps,I noticed my property(at the corner of Highland and 11th Street)has a massive 30-
foot setback from 11th Street,when it appears that every other house in a several-block radius has 10-foot setbacks on front and
side.This setback is so huge that my longstanding carport and even a small corner of my house sit outside the line.I would like to
be able to plant trees or perhaps install a fence near the sidewalk like other homeowners in my neighborhood have.As it stands now,
nearly all of my nice big yard on the 11th Street side sits outside the setback and so it's effectively not mine.
Proposed use of vacated street or alley: As I mentioned,I'd like the freedom to use(nearly)my whole yard like my
neighbors have.One of the reasons I chose this house was because of the big,relatively flat yard. I would like to plant a couple of
trees,and one day install a white picket fence.Being a comer lot with a bus stop,I have a lot people wandering through my
yard and a fence would stop or reduce this trespassing,but this setback is preventing me from protecting my property.

Subject: Appropriation of FY 2021 Year-End Funds for use in FY 2022
Background:
Upon conclusion of the Fiscal Year 2020-2021 year-end General Fund revenues
totaled $309,988,125 and expenditures totaled $294,474,360 leaving residual
funds of $15,513,765. This was a result of conservative revenue estimates and
enhanced expenditure restrictions due to COVID-19 as well as utilization of
CARES Act grant funds to supplement public safety measures due to the
pandemic. These year-end funds are now available for uses for which they were
preliminarily identified and discussed at the Council Budget Retreat on
November 29, 2021 . Since that time $6,885,000 were transferred to various
uses as part of the FY 2021 close-out and are therefore included in the
expenditure figure above.
Identified uses and balance sheet accounts where they are recorded are as
follows:

An additional adjustment of $6,140 was made after the determination of
assigned fund balance amounts. This difference is reflected in unassigned fund
balance which carries a balance of $36,959,110 at year end dune 30, 2021 .
Citizens were heard on this matter at a City Council meeting on April 26, 2022
and again at a Public Hearing on May 16, 2022 prior to consideration of the
following recommended actions.
Considerations:
With completion of the FY2020-21 Audit having occurred, it is now appropriate
to move assigned year-end funding to the appropriate accounts as originally
planned. For the first four items listed above no action is necessary; however,
the last three listed for Star City Safe Initiative/Parks Deferred Maintenance,
Various City Capital Projects and Public Safety Retention Bonus are needed for
FY22 expenditures totaling $10,277,378 and must now be allocated to project
accounts. In some cases, funds were advanced during the year through City
Manager Transfers to the projects from existing sources such as Capital
Improvement Reserve and City Manager Contingency. In these cases, it is
appropriate to reimburse these accounts for the funds that were advanced.
Recommended Action:
Adopt the accompanying Budget Ordinance to appropriate assigned fund
balance amounts in the General Fund and establish related revenue accounts
and transfers to capital projects in the Capital Projects Fund and ARPA grant in
the Grants Fund.

NOTICE OF PUBLIC HEARINGS
The Council of the City of Roanoke will consider an amendment to the aggregate amount of its FY
2021-2022 annual budget in the following respects, in connection with appropriation of funds for the
General Fund. A Public Hearing will be heard on the Fiscal Year 2021-2022 Appropriation of funding
from the General Fund Assigned Fund Balance in the amount of $10,277,378. Funding shall be
used for restoring Capital Project Account balances relating to the following:
Parks Deferred Maintenance $1,465,000
Star City Safe 250,000
Public Safety Retention 2,000,000
Gainsboro Neighborhood Improvements 5,000,000
Neighborhood Initiatives 500,000
Juvenile Court Renovations 760,000
Diversity and Inclusion Support 50,000
Other Capital Projects 252,378
Pursuant to Section 15.2-2507, Code of Virginia (1950), as amended, notice is hereby given that on
Monday, May 16, 2022 at 7:00 p.m., or as soon thereafter as the matter may be heard, Roanoke
City Council will hold a meeting in City Council Chamber, Noel C. Taylor Municipal Building, 215
Church Avenue, S.W., Roanoke, Virginia, for the purpose of holding a public hearing on the Fiscal
Year 2021-2022 Appropriation of funding from the General Fund Assigned Fund Balance. All
persons who register as set forth below shall be afforded an opportunity to speak and state their
views concerning all aspects of the budget within such reasonable time limits as shall be established
by City Council. Written comments of interested citizens also will be received by the City Clerk at
any time prior to the hearing. All persons wishing to address City Council must sign—up with the City
Clerk's Office by emailing clerk(a�roanokeva.gov or by calling (540)853-2541 by 4:00 p.m. on
Monday, May 16, 2022.
