2. PRESENTATIONS AND ACKNOWLEDGEMENTS:
A proclamation declaring October 2022 as Community Planning Month.
Vice-Mayor White-Boyd declared October 2022 as Community Planning
Month and presented the proclamation to Jillian Papa Moore, Acting
Director, Planning, Building and Development.
A proclamation declaring Wednesday, October 19, 2022 as Chamber of
Commerce Day.
Vice-Mayor White-Boyd declared October 19, 2022 as Chamber of
Commerce Day and presented the proclamation to Joyce Waugh, President
and CEO; and Terry Durkin, President of Policy, Roanoke Regional
Chamber of Commerce.
Recognition of the 2022 Local Champion Award from the Virginia Municipal
League.
Vice-Mayor White-Boyd recognized and presented the Award to Jeffrey
Powell, Director, General Services.
3. HEARING OF CITIZENS UPON PUBLIC MATTERS:
City Council sets this time as a priority for citizens to be heard. All matters will be
referred to the City Manager for response, recommendation or report to Council, as he
may deem appropriate. Shawn Ayers, 1228 Hamilton Terrace, S. W., appeared before
the Council to recommend a condemned home for blight status and advised of needed
repairs to a home on Arbutus Avenue, S. E.
4. CONSENT AGENDA: APPROVED (5-0)
All matters listed under the Consent Agenda are considered to be routine by the
Members of City Council and will be enacted by one motion. There will be no separate
discussion of the items. If discussion is desired, the item will be removed from the
Consent Agenda and considered separately.
C-1. Minutes of the regular meeting of City Council held on Monday, September 19,
2022; and the recessed meetings held on Thursday, September 29, 2022 and
Friday, September 30, 2022.
RECOMMENDED ACTION: Dispensed with the reading of the minutes and
approved as recorded.
C-2. A communication from Vice-Mayor Patricia White-Boyd, requesting that Council
convene in a Closed Meeting to discuss the 2022 Citizen of the Year Award,
pursuant to Section 2.2-3711 (A)(10), Code of Virginia (1950), as amended.
RECOMMENDED ACTION: Concurred in the request.
C-3. A communication from the City Manager requesting that Council convene in a
Closed Meeting to discuss the disposition of an approximately one acre portion
of City-owned property located at 2424 Brambleton Avenue, S. W., where
discussion in an open meeting would adversely affect the bargaining position or
negotiating strategy of the public body, pursuant to Section 2.2-3711 (A)(3),
Code of Virginia (1950), as amended.
RECOMMENDED ACTION: Concurred in the request.
C-4. A communication from the City Manager requesting that Council convene in a
Closed Meeting to discuss the acquisition of property located in the southwest
area of the City near Franklin Road, where discussion in an open meeting would
adversely affect the bargaining position or negotiating strategy of the public
body, pursuant to Section 2.2-3711 (A)(3), Code of Virginia (1950), as
amended.
RECOMMENDED ACTION: Concurred in the request.
C-5. FY2023 City Manager Transfer Report.

Council Member Bestpitch expressed concern about naming City plazas
and asked the City Attorney to draft a measure to rename the plaza at Salem
and Norfolk Avenues in honor of John Noland.
Council Member Moon Reynolds spoke with regard to the Spring Hollow
Reservoir water contamination and suggested that the City Manager
schedule a briefing with the Western Virginia Water Authority for the
November 21 City Council Meeting.
Vice-Mayor White-Boyd reminded citizens that water in the City of Roanoke
was clean and safe.
2. Vacancies on certain authorities, boards, commissions and committees appointed
by Council. None.

Subject: 2021-2022 HUD Consolidated Annual Performance and Evaluation Report.
Background:
Federal law requires all participating jurisdictions that receive funds from the U.S. Department
of Housing and Urban Development (HUD) to submit a Consolidated Annual Performance and
Evaluation Report (CAPER) no later than September 30 following the close of the prior
program year. The City opened a 15-day public comment period that was properly advertised
in newspapers of general circulation beginning September 8, 2022 and expired on September
23, 2022, including a public hearing held by the HUD Community Resources staff in the Noel
C. Taylor Municipal Building September 23, 2022. The City made the draft CAPER available
to the public through a variety of means, including the City's website, by mail to citizens upon
request, at the City Municipal Building, at the City's Main Branch Library, and at the Roanoke
Redevelopment and Housing Authority's Executive Offices. No public comments were
received.
Considerations:
Submission of the CAPER to HUD is a required action to remain eligible to receive future HUD
funds. The CAPER was submitted for review to the HUD Richmond Field Office on
September 30, 2022.

2021 Comprehensive Annual Performance and Evaluation Report
Executive Summary
The 2021 CAPER covers the period from July 1, 2021,through June 30, 2022 (FY 22).The City
received $1,862,245 in Community Development Block Grant (CDBG), $675,808 in HOME
Investment Partnership Grant (HOME), and $153,124 in Emergency Solutions Grant (ESG)
entitlement funds to provide eligible services through the Community Resources division for 42
unique activities during the reporting period. This represents a 2.57% increase in overall
entitlement funding from FY 21. Additionally, the Community Resources (HCR) office continued
to manage and direct unspent CARES Act funds of$802,710 in CDBG-CV and $136,645in ESG-CV
that were allocated in April of 2020 to address the community's preparation, response and
recovery from the COVID-19 pandemic. CDBG-CV funds expended in the 2021 CAPER reporting
period were $8902,710.17 and $136,645 in ESG-CV funds. CDBG-CV funds are not required to
be spent until September 30, 2026, while ESG-CV funds must be expended by September 30,
2023. Other funds noted in the CAPER for FY 21-22 include $11,867 in program income from
loan repayments and a reprogramming of$233,071.63 of CDBG funding from prior years that
were not expended by the assigned projects. Public services represented $167,620 and
administration and planning expenses were $418,091. Both categories are within the
maximum allowed by HUD.
FY 21-22 represented the first full year of the City's commitment of CDBG and HOME funds in
the Belmont/Fallon Target Area (BFTA) per the City Council Policy on Use of HUD Funds. The
only remaining expenditures for the Melrose-Orange Target Area (MOTA) were related to the
Melrose Avenue Streetscape Improvement Project carried over from FY 20-21. This project was
delayed because of Coronavirus; City matching funds were pulled when there was the
anticipation of a shortage of funds for general operation. The City of Roanoke was able to
restore the matching funds from the general fund and the project has now been
completed. The ribbon cutting ceremony held on August 5, 2022 for this project marked the
final project in the Melrose-Orange Target Area and highlighted 5 years of investment in the
revitalizing of the community. While FY 20-21 was a transitional "bridge year" to wrap up
activities in the Melrose-Orange Target Area (MOTA) while beginning work in the
Belmont/Fallon Target Area, the majority of housing efforts were in MOTA.
The City of Roanoke has had success in the past with concentrating its entitlement funds into a
defined targeted area over multiple years, with the goal of encouraging revitalization and public
investment in those target areas. Projects for the 2021 CAPER, as well as the 2022 HUD Annual
Plan, include Homeownership, Major Rehab, Limited Repair, ADA Curb Ramp installation, and a
Community Streetscape project planned for the upcoming years. In addition, code
enforcement, emergency home repair and accessibility improvements for the handicapped
were activities funded for a City-wide impact. Additionally, several public services also served
the City as a whole from CDBG and CDBG-CV funds. HOME funds were utilized for the

development of single-family LMI home ownership. ESG and ESG-CV funds were used to
support programs and activities to address homelessness and at-risk populations. City Council
Policy on the use of HUD funds sets an objective to designate at least 51%of CDBG and HOME
non-administrative funds into targeted areas. During this Program Year the City focused 67.5%
of the funds into BFTA and MOTA.
All funds provided under the CDBG, CDBG-CV, HOME and ESG programs addressed high priority
objectives identified in the Consolidated Plan. No activity was denoted to be less of a priority
than any other activity as all activities aim to assist low-income families to achieve their highest
and best attainments in life. Most funding was targeted towards BFTA so that the impact of all
funds could be felt in real and lasting positive effects in this neighborhood. CDBG, HOME and
ESG funds were utilized to benefit a variety of races and ethnicities equitably. No one race was
given priority over others. All programs are operated as a first come, first served basis
regardless of race or ethnic background, with income being a prime determinant of eligibility.
The City of Roanoke's partners contributed significantly to the development and preservation
of safe, decent, and affordable housing units. As the Annual Action Plan was developed during
COVID-19, it was unclear how many housing units would be rehabilitated or
constructed. Partners continued to ensure that those most in need, were provided with
rehabilitated units for homeownership and/or housing units were preserved for those to
remain. All housing repair and/or rehabilitation costs are becoming costlier and skilled
construction labor more scarce. The need to make these repairs and rehabs are even more
important, but the disruptions in supply chains and rising costs is posing a challenge. Policies
on per unit spending limits for limited repair and major rehabilitation projects will be addressed
for the 2023 Annual Plan.
The global health crisis over the last few years has strained our homeless response system.
CDBG and ESG funds were used to boost the homelessness prevention and rapid re-housing
programs. While efforts to prevent homelessness increased, there was also a notable increase
in the average lengths of time people were experiencing homelessness. Our street outreach
and coordinated entry staff have partnered with the local housing authority to streamline
access to emergency housing vouchers. The City is facilitating a coordinated entry refinement
lab, which is allowing our community to review and improve our coordinated entry process.
Continued energy is directed towards increasing staffing levels within our homeless response
system so that intensive supportive services are provided.
The City staff meets regularly with social service and public and private housing organizations in
conjunction with the Roanoke Regional Housing Network,the Blue Ridge Interagency Council
on Homelessness, Blue Ridge Continuum of Care, and the Roanoke Neighborhood Revitalization
Partnership. In addition, a staff member is assigned as a liaison to the City's Fair Housing Board,
which provides training and interaction on fair housing and accessibility issues to more than
300 individuals each year. The COVID-19 pandemic has slowed down in-person training and
meeting, but it has not slowed our involvement with other organizations and agencies. It has

forced us to develop new ways to interact, Zoom Meetings, GoToMeeting, conference calls,
social media, etc. These new tools may be with us into the future.
In order to overcome impediments to fair housing choice,the City has a Fair Housing Board that
works to provide education and outreach on the topic of fair housing choice to local residents
and housing professionals. Approximately 150 people attended two training topics offered
during the program year. The City has translated its Fair Housing brochures into Spanish and
has used artwork for our Fair Housing campaign that includes Spanish verbiage. The City's Fair
Housing Board is made up of a cross section of the community both racially and by gender,
including two members with disabilities.
The Community Resources Division maintains a Risk Analysis policy that requires that each
activity undertaken with federal funds have a completed risk analysis worksheet as part of the
project file. This worksheet determines whether or not there must be on-site monitoring or
whether the activity can receive desk monitoring. All CDBG and HOME projects that have liens
placed against the property have ownership and occupancy should be verified annually through
a bulk mailing. This ensures that the properties remain the primary residence of the funding
beneficiary. All ESG funded properties are monitored annually to ensure that their facilities
pass the necessary inspections and that the individuals residing in those facilities are protected.
There were no changes in the program objectives for Program Year 2021 from the 2020-2024 5
Year Consolidated Plan. The City still invests a majority of CDBG and HOME funds into targeted
areas. This policy encourages public investment, increases the chances that such targeted
areas will reduce blighting influences, and become a revitalized neighborhood with
opportunities for all socioeconomic classes to reside. These strategies also intend to
deconcentrate poverty and ensure that all individuals have equitable and inclusive
opportunities as citizens of Roanoke.
ESG funded two shelter organizations during this program year. Over the last two years, our
community has seen a staggering increase in the number of people experiencing unsheltered
homelessness, and with that, decreases in the numbers of individuals staying in emergency
shelters. Just in this last year, our Point in Time Count numbers have reflected this shift in
homelessness. In 2021, 12 individuals were counted as being "unsheltered" on a single night in
January while 238 were in shelter. In 2022, 38 people were counted as being "unsheltered"
(over 200% increase) and 178 sheltered (25%decrease) in the month of January. In July, there
were 91 people that were counted as experiencing "unsheltered" homelessness on a single in
night, a 139% increase from the winter count. The City of Roanoke recognizes this shift in
homelessness in our community. Within the last year, an interdepartmental workgroup has
formed to discuss challenges and formulate solutions around the growing number of people
experiencing unsheltered homelessness.

Using CDBG and HOME funding, Habitat for Humanity acquired/rehabilitated existing housing

The City of Roanoke partnered with Renovation Alliance,Total Action for Progress, and Blue
Ridge Independent Living Center to rehabilitate existing housing units.

Children's Trust Advocacy Center coordinates a community response to child abuse by bringing
together people and services for a child's need during the investigation and prosecution of
cases. Created is an environment that is safe and ensures that a child centric approach to
healing.

The City of Roanoke's Planning, Building, and Development Department administers Code
Enforcement of building maintenance, zoning, and all nuisance codes, ensuing health and
safety. CDBG partnered with other local funds to support three inspectors for zones 1, 2, and 7.
These three zones are in census tracts that meet HUD eligibility. During the program year, 741
nuisance citations were issued and 497 (67%) were corrected by the owner of the property to
promote safe and decent housing. Maintenance code violations cited were 117, but only 67
maintenance violations cleared (57%). A total of 179 Rental Certificates were issues within
these zone.
Public Facilities

The City of Roanoke's Transportation division managed the installation of handicapped curb
cuts in BFTA utilizing CDBG funds. CDBG-CV CARES Act funds were also provided for
renovations to ARCH Service's Trust House.
CV-Public Services
93 persons assisted
The COVID-19 Housing Stabilization for Families in Need Program managed by the Council of
Community Services provided rental assistance to Roanoke tenants who were financially
impacted by the COVID-19 pandemic. Program funding was in the form of a grant to assist
eligible affected tenants in paying rent to assist residents who were financially impacted by
COVID-19 and who are at risk for eviction action. This was part of the CDBG CARES Act funds.
176 persons assisted
Total Action for Progress provided emergency rent assistance to prevent homelessness utilizing
CDBG-CV funds through CARES Act allocation.
5,198 persons assisted
Council of Community Services manages the Homeless Management Information System for
the Blue Ridge Continuum of Care. CARES Act funds were provided for a much needed
software and systems upgrade.
8 persons assisted
Family Services of Roanoke Valley provided mental health counselling and support services for
Residents of Roanoke Redevelopment and Housing Authority (RRHA) sites: Lansdowne, Hunt
Manor, Melrose Towers, Villages of Lincoln,Jamestown Place, Morningside Manor, Bluestone,
and Indian Village. This service was in response to a rise in mental health demands since the
onset of the COVID-19 pandemic.
CV-Emergency Small Business Grants
12 businesses assisted in PY 2021 and 14 total businesses served since PY 2019
Small businesses were negatively impacted by COVID-19 with loss of business/revenue. The
small businesses were provided with grants to assist with payroll, rent, utilities, and inventory.
CDBG CARES funding allowed the businesses to continue operations. During PY 2021, $167,746

in CDBG-CV funds were granted, with $200,000 expended during the program partnership with
Freedom First Credit Union.
Emergency Solutions Grant Annual &CV funds
101 persons assisted with emergency shelter

Council of Community Services, Family Promise, and Total Action for Progress provided financial
services that prevented homelessness for 148 individuals. ARCH, Family Promise, Rescue
Mission Ministries, and Total Action for Progress all provided emergency shelter beds for
individuals and families experiencing homelessness. The Council of Community Services
provided emergency shelter case management to individuals staying the non-congregate
emergency shelter.
Miscellaneous Notes
HCR has added a Community Resources Specialist I to replace the vacated Planner I position to
focus staffing on an increasing project management workload and will work closely with
Planning division staff on housing related issues. We have also added a new position of
Community Resources Specialist II for Compliance & Capacity. This new position will allow the
City to improve monitoring of subrecipients (as required by HUD) and protect the City's position
as the responsible party of federal funding,The CRS II C&C position will also assist smaller non-
profits to better develop organizational capacity to apply for/manage HUD funds successfully.
All administrative and planning costs are within cap limits that HUD allows within each grant
program.

A RESOLUTION authorizing the acceptance of the Virginia Department of Transportation

2. The City Manager or his designee is hereby authorized to accept,execute,and file on

documents are to be approved as to form by the City Attorney.
3. The City Manager or his designee is further directed to furnish such additional
information as may be required in connection with the acceptance of the foregoing funding or with

Background:
The stormwater improvement project includes the installation of curb, gutter, and stormwater
infrastructure along Hollins Road, N.E., between the intersections of Liberty Road, N.E., and
Palmer Avenue, N.E. Once complete, the project will alleviate ponding water in the sump of
the road.
Considerations:
In September 2019, the City applied for VDOT Local Revenue Sharing Funds for the Hollins-
Liberty Road Drainage Improvements Project in the amount of$216,841. There is a local
match requirement in the amount of$216,841. The local match is funded in the Hollins
Drainage Improvements multi-year account (Acct 03-530-3033).
Recommended Action:
Accept VDOT's award of$216,841 of Local Revenue Sharing funds. Authorize the City
Manager or his designee to execute the VDOT Standard Project Administration Agreement for
State-Aid Projects, Appendix A, and Appendix B documents. Such documents shall be in a
form approved by the City Attorney.
Authorize the City Manager or his designee to take such further actions and execute such
further documents, approved as to form by the City Attorney, as may be necessary to obtain,
accept, implement, administer, and use such funds identified above.
Adopt the accompanying Budget Ordinance to establish revenue estimates for the funding
sources identified above and appropriate funding in the same amount to the existing
expenditure account (Acct 03-530-3033), Hollins Drainage Improvements.

STANDARD PROJECT ADMINISTRATION AGREEMENT

THIS AGREEMENT, is hereby made and effective the date of the last(latest) signature
set forth below, by and between the CITY OF RONAOKE, VIRGINIA, hereinafter referred to as
the LOCALITY and the Commonwealth of Virginia, Department of Transportation, hereinafter
referred to as the DEPARTMENT. The DEPARTMENT and the LOCALITY are collectively
referred to as the "Parties."
WHEREAS, the LOCALITY has expressed its desire to administer the work described in
Appendix A, and such work for each improvement shown in Appendix A is hereinafter referred
to as the "Project;" and
WHEREAS, the funds shown in Appendix A have been allocated to finance the Project
and the funding currently allocated or proposed for the Project does not include Federal-aid
Highway funds; and
WHEREAS, the LOCALITY is committed to the development and delivery of the
Project in an expeditious manner; and
WHEREAS, the LOCALITY is responsible for administering the Project in accordance
with DEPARTMENT guidelines, including the most current Locally Administered Projects
Manual("LAP Manual"), and with the program specific requirements shown in Appendix B,
based on the nature of the allocated funding for the Project as shown in the Appendix A; and
WHEREAS, the LOCALITY's governing body has by resolution, demonstrated the
LOCALITY'S commitment to provide local funding for the Project as contemplated by this
Agreement and further, by resolution or otherwise, authorized its designee to execute this
Agreement, and said authorizations are attached hereto.
WHEREAS, the Parties have concurred in the LOCALITY's administration of all phases
of work for the Project in accordance with applicable federal, state and local laws and
regulations.
NOW THEREFORE, in consideration of the mutual premises contained herein, the
Parties hereto agree as follows:
1. The representations, covenants and recitations set forth in the foregoing recitals are
material to this Agreement and are hereby incorporated into and made a part of this
Agreement as though they were fully set forth in this Section 1.
2. The LOCALITY shall:
a. Be responsible for all activities necessary to complete the noted phase(s)of the Project
as shown in Appendix A, except for activities, decisions, and approvals which are the

responsibility of the DEPARTMENT, as expressly required by federal or state laws
and regulations, or as otherwise agreed to,in writing,between the Parties. Every phase
of the Project will be designed and constructed to meet or exceed current American
Association of State Highway and Transportation Officials standards when the
facilities are locally maintained and shall further comply with all supplementary
standards established by the DEPARTMENT when the facilities are maintained by the
DEPARTMENT.
b. Meet all funding obligation and expenditure timeline requirements in accordance with
all applicable federal and state laws and regulations, all applicable Commonwealth
Transportation Board and DEPARTMENT policies, and those additional requirements
as identified in Appendices A and B to this Agreement. Noncompliance with this
requirement may result in deallocation of the funding from the Project, rescission of
state funding match, termination of this Agreement, or the DEPARTMENT denial of
future requests to administer projects by the LOCALITY, all of which actions are at
the discretion of the DEPARTMENT or as can be taken pursuant to applicable laws,
regulations or policies.
c. Administer the Project in accordance with the DEPARTMENT's most current LAP
Manual and other guidelines applicable to Locally Administered Projects as published
by the DEPARTMENT.
d. Provide timely certification by a LOCALITY official of the LOCALITY'S compliance
with applicable laws and regulations on the State Certification Form for State
Funded Projects or in another manner as prescribed by the DEPARTMENT.
e. Maintain accurate and complete records of the Project's development as required in the
LAP Manual and any supplemental guidance and directives of the DEPARTMENT and
retain documentation of all expenditures and make such information available for
inspection or auditing by the DEPARTMENT upon request. Records and
documentation for the Project shall be maintained for no less than three (3) years
following the DEPARTMENT'S acceptance of the final voucher on the Project.
£ At least quarterly, but no more frequently than monthly, submit invoices with
supporting documentation to the DEPARTMENT in the form prescribed by the
DEPARTMENT. The supporting documentation shall include copies of vendor and
contractor invoices paid by the LOCALITY, an up-to-date Project summary and
schedule, and a summary of all payment requests, payments and adjustments. A
request for reimbursement shall be made within 90 days after any eligible project
expenses are incurred by the LOCALITY. Reimbursement for eligible expenditures
shall not exceed funds allocated each year for the Project by the Commonwealth
Transportation Board in the Six Year Improvement Pro am.
g. Reimburse the DEPARTMENT for all Project expenses incurred by the
DEPARTMENT if, due to action or inaction of the LOCALITY, the Project becomes
ineligible for state reimbursement, or in the event the reimbursement is required by the

provisions of§ 33.2-214 or § 33.2-331 of the Code of Virginia (1950) as amended, or
other applicable provisions of state law or regulations.
h. On Projects that the LOCALITY is providing the required match to state funds,pay the
DEPARTMENT the LOCALITY's match for eligible Project expenses incurred by the
DEPARTMENT in the performance of activities set forth in paragraph 2.a.
i. Administer the Project in accordance with all applicable federal, state, and local laws
and regulations. Failure to fulfill legal obligations associated with the Project may
result in forfeiture of state-aid reimbursements
j. If legal services other than that provided by staff counsel are required in connection
with condemnation proceedings associated with the acquisition of Right-of-Way, the
LOCALITY will consult the DEPARTMENT to obtain an attorney from the list of
outside counsel approved by the Office of the Attorney General. Costs associated with
outside counsel services shall be reimbursable expenses of the Project.
k. Provide, or have others provide, maintenance of the Project upon completion, unless
otherwise agreed to by the DEPARTMENT. Where the Project results in physical
construction, the LOCALITY will continue to operate and maintain the Project in
accordance with the final constructed design as approved by the DEPARTMENT. The
LOCALITY agrees that any modification of the approved design features, without the
approval of the DEPARTMENT, may, at the discretion of the DEPARTMENT, result
in restitution either physically or monetarily as determined by the DEPARTMENT.
3. The DEPARTMENT shall:
a. Perform any actions and provide any decisions and approvals,within a reasonable time,
which are the responsibility of the DEPARTMENT, as required by federal and state
laws and regulations or as otherwise agreed to, in writing, between the parties.
b. Upon receipt of the LOCALITY's invoices pursuant to paragraph 2.f, reimburse the
LOCALITY the cost of eligible Project expenses, as described in Appendix A. Such
reimbursements shall be payable by the DEPARTMENT within 30 days of an
acceptable submission by the LOCALITY.
c. Where applicable, submit invoices to the LOCALITY for the LOCALITY's share of
eligible Project expenses incurred by the DEPARTMENT in the performance of
activities pursuant to paragraph 2.a. and 3.a.
d. Audit the LOCALITY's Project records and documentation as may be required to
verify LOCALITY compliance with applicable laws and regulations.
e. Upon LOCALITY'S request, make available to the LOCALITY guidelines to assist
the Parties in carrying out responsibilities under this Agreement.

4. If designated by the DEPARTMENT, the LOCALITY is authorized to act as the
DEPARTMENT's agent for the purpose of conducting survey work pursuant to § 33.2-
1011 of the Code of Virginia (1950), as amended.
5. Nothing in this Agreement shall obligate the Parties hereto to expend or provide any funds
in excess of funds agreed upon in this Agreement or as shall have been included in an
annual or other lawful appropriation. State and federal Project funding is limited to those
identified in the Appendix A of this Agreement and is allocable only upon LOCALITY'S
compliance with all requirements of this Agreement. In the event the cost of all or part of
the Project is anticipated to exceed the allocation shown on Appendix A, the Parties agree
to cooperate in seeking additional funding for the Project or to terminate the Project before
Project costs exceed the allocated amount. Any requested increase in federal or state
funding is subject to DEPARTMENT policy and procedures applicable to the funding
source and is not guaranteed.
6. Nothing in this Agreement shall be construed as a waiver of the LOCALITY's or the
Commonwealth of Virginia's sovereign immunity.
7. The Parties mutually agree and acknowledge, in entering this Agreement, that the
individuals acting on behalf of the Parties are acting within the scope of their official
authority and capacity and the Parties agree that neither Party will bring a suit or assert a
claim against any official, officer, or employee of either Party, in their individual or
personal capacity, for a breach or violation of the terms of this Agreement or to otherwise
enforce the terms and conditions of this Agreement The foregoing notwithstanding,
nothing in this subparagraph shall prevent the enforcement of the terms and conditions of
this Agreement by or against either Party in a competent court of law.
8. The Parties mutually agree that no provision of this Agreement shall create in the public,
or in any person or entity other than the Parties, rights as a third party beneficiary
hereunder, or authorize any person or entity, not a party hereto, to maintain any action for,
without limitation, personal injury, property damage, breach of contract, or return of
money, or property, deposit(s), cancellation or forfeiture of bonds, financial instruments,
pursuant to the terms of this Agreement or otherwise. Notwithstanding any other provision
of this Agreement to the contrary, unless otherwise provided, the Parties agree that the
LOCALITY or the DEPARTMENT shall not be bound by any agreements between either
party and other persons or entities concerning any matter which is the subject of this
Agreement, unless and until the LOCALITY or the DEPARTMENT has, in writing,
received a true copy of such agreement(s) and has affirmatively agreed, in writing, to be
bound by such Agreement.
9. This Agreement may be terminated by either Party upon 30 days advance written notice to
the other Party. Eligible Project expenses incurred through the date of termination shall be
reimbursed in accordance with paragraphs, 2.g., 2.h, and 3.b, subject to the limitations
established in this Agreement and Appendix A. Upon termination and unless otherwise
agreed to, the DEPARTMENT shall retain ownership of plans, specifications, and right of
way for which state funds have been provided, unless all state funds provided for the

Project have been reimbursed to the DEPARTMENT by the LOCALITY, in which case
the LOCALITY will have ownership of the plans, specifications, and right of way.
10. Prior to any action pursuant to paragraphs 2.b or 2.h of this Agreement, the
DEPARTMENT shall provide notice to the LOCALITY with a specific description of the
LOCALITY'S breach of this Agreement. Upon receipt of a notice of breach, the
LOCALITY will be provided the opportunity to cure such breach or to provide a plan to
cure to the satisfaction to the DEPARTMENT. If, within sixty (60) days after receipt of
the written notice of breach,the LOCALITY has neither cured the breach,nor is diligently
pursuing a cure of the breach to the satisfaction of the DEPARTMENT, then upon receipt
by the LOCALITY of a written notice from the DEPARTMENT stating that the breach has
neither been cured, nor is the LOCALITY diligently pursuing a cure, the DEPARTMENT
may exercise any remedies it may have under this Agreement or at law or in equity.
11. THE LOCALITY and DEPARTMENT acknowledge and agree that this Agreement has
been prepared jointly by the Parties and shall be construed simply and in accordance with
its fair meaning and not strictly for or against any Party.
12. THE LOCALITY and the DEPARTMENT further agree that should Federal-aid Highway
funds be added to the Project, this Agreement is no longer applicable. The LOCALITY
and the DEPARTMENT mutually agree that they shall then enter into a Standard Project
Administration Agreement for Federal-aid Projects upon execution of which this
Agreement shall be terminated.
13. THIS AGREEMENT, when properly executed, shall be binding upon both Parties, their
successors, and assigns.
14. THIS AGREEMENT may be modified only in writing by mutual agreement of the
Parties.

Appendix B—Special Funding Program Conditions and Requirements

SMART SCALE
Administration of this Project, including but not limited to Project estimate, schedule and
commitment to funding, is subject to the requirements established in the Commonwealth
Transportation Board's (CTB's) most current Policy for Implementation of the SMARTS CALE
Project Prioritization Process, the applicable requirements of the Code of Virginia, and VDOT's
applicable Instructional and Informational Memoranda.
Without limiting the foregoing, this Project has been selected through the Smart Scale (H132)
application and selection process and will remain in the Six-Year Improvement Plan as a funding
priority unless certain conditions set forth in the CTB's most current Policy for Implementation
of a Project Prioritization Process arise. Pursuant to the CTB's Policy for Implementation of a
Project Prioritization Process, this Project will be re-scored and/or the funding decision re-
evaluated if any of the following conditions apply: a change in the scope, an estimate increase,
or a reduction in the locally/regionally leveraged funds. Applications may not be submitted in a
subsequent SMART SCALE prioritization cycle to account for a cost increase on a previously
selected project.
This Project shall be initiated and at least a portion of the Project's programmed funds expended
within one year of the budgeted year of allocation or funding may be subject to reprogramming
to other projects selected through the prioritization process. In the event the Project is not
advanced to the next phase of construction when requested by the CTB, the LOCALITY or the
localities within the metropolitan planning organization may be required, pursuant to § 33.2-214
of the Code of Virginia, to reimburse the DEPARTMENT for all state and federal funds
expended on the Project.
Revenue Sharing
This Project shall be administered in accordance with VDOT's most current Revenue Sharing
Program Guidelines.
Without limiting the foregoing, the Project shall be initiated such that at least a portion of the
Revenue Sharing Funds are expended within one year of allocation. For any project that has not
been initiated within one year, the CTB has the discretion to defer consideration of future
allocations until the project moves forward. Further, if the Project has not been initiated within
two fiscal years subsequent to the allocation of Revenue Sharing Funds, the Revenue Sharing

Funds for the Project may be subject to deallocation from the Project at the discretion of the
CTB.

twenty-five (25) deputy sheriff recruits, a sign-on bonus of $5,000 to become deputy sheriff's
with the Roanoke City Sheriffs Office; and dispensing with the second reading of this

WHEREAS, because of the nationwide "recruiting crisis" of deputy sheriffs, the City's
Sheriff s Office has been struggling to retain and attract deputies; and
WHEREAS, in an effort to help our Sheriff address this nationwide recruiting crisis, the
City Manager is seeking authorization to institute a program to pay new recruits a sign-on bonus
of up to $5,000.
BE IT ORDAINED by the Council of the City of Roanoke as follows:
1. The City Manager is authorized to institute a program to pay up to twenty-five
(25) deputy sheriff recruits for the Roanoke City Sheriffs Office, a sign-on bonus of up to
$5,000,beginning with the August recruit class.

Background:
Due to the number of vacancies and the nation-wide difficulty recruiting deputy sheriffs, the
City Manager is seeking authorization to implement a program consistent with that previously
provided for police department recruitment, to pay new recruits a sign on bonus of$5,000 to
assist the Sheriffs Office.
Considerations:
The anticipated cost for implementation is estimated to be $167,500 for 25 new recruits,
including fringe benefits.
Recommended Action:
Authorize the City Manager or his designee to implement the sign on bonus program for the
Sheriff's Office to pay new recruits a sign on bonus of$5,000.

WHEREAS, the Compensation Board for the Commonwealth of Virginia approved a
tenure adjustment program for Compensation Board funded deputy sheriffs to address salary pay
compression within the Commonwealth's Sheriff's Offices; and
WHEREAS, in an effort to aid the Sheriff in addressing pay compression within the City
of Roanoke's Sheriff's Office, the City Manager is seeking authorization to institute a tenure
adjustment program for all incumbent sworn deputy sheriffs who have been employed by the
City of Roanoke Sheriff's Office for a minimum of three years with a cap of thirty years an
increase of$100 per year of service.

Subject: Ordinance to Implement a Tenure Compensation Adjustment for the
Sheriffs Department.
Background:
On July 7, 2022, the Compensation Board for the Commonwealth of Virginia (Compensation
Board) approved a tenure adjustment program for Compensation Board funded deputy sheriffs
to address salary pay compression within the Commonwealth's Sheriff's Offices. This tenure
adjustment required the City to provide a tenure adjustment of$100 per year of non-
interrupted service for each Sheriff Deputy that has 3 or more years of service, up to a
maximum of 30 years of service.
By implementing this tenure adjustment, the City will be addressing pay compression within
the City of Roanoke's Sheriff's Office resulting from the implementation of the Compensation
Board's fiscal year 2023 salary increases for Compensation Board funded deputy sheriffs.
Considerations:
The anticipated cost for implementation is estimated to be $195,310.68, including fringe
benefits.
Recommended Action:
Authorize the City Manager or his designee to implement the tenure adjustment program for
all incumbent sworn deputy sheriffs who have been employed by the City of Roanoke Sheriff's
Office for a minimum of three years with a maximum of thirty years, with an increase of$100
per year of service.

Background:
As the result of official Roanoke City School Board action on Tuesday, October 11, 2022, the
Board respectfully requests that City Council appropriate funding as outlined in this report.
This program provides federal Title 1, Part D Neglected and Delinquent funds to support
literacy initiatives at the Roanoke Valley Juvenile Detention Center. This appropriation aligns
the total with the revised award amount. This program will be fully reimbursed by federal funds
in the amount of$23,185 and will end September 30, 2023. This is a continuing program.
The General Assembly approved state funding to support equipment for Career and Technical
Education (CTE) programs. This program will be paid for by the Commonwealth's Lottery
Proceeds Fund. The program will be fully reimbursed from state funds in the amount of
$13,508 and will end May 19, 2023. This is a continuing program.
The General Assembly approved state funding for Workplace Readiness Skills (WRS) for the
Commonwealth Examinations, including pretests, and/or other Board-approved industry
certification assessments for Career and Technical Education (CTE) programs. The program
will be fully reimbursed from state funds in the amount of$2,397 and will end May 19, 2023.
The General Assembly approved state funding for Career and Technical Education (CTE)
student industry certification examinations, licensure tests, and occupational competency
assessments. Reimbursement is restricted to industry certification exams, licensure tests or
occupational competency assessments that have been approved by the Board of Education
for the student-selected verified credit option. This program will be paid for by the
Commonwealth's Lottery Proceeds Fund. The program will be fully reimbursed from state
funds in the amount of$10,339 and will end May 19, 2023.
The General Assembly approved state funding to update Career and Technical Education
(CTE) equipment to industry standards, providing students with classroom experiences that
translate to the 21st Century workforce. This program will be paid for by the Commonwealth's
Lottery Proceeds Fund. The program will be fully reimbursed by state funds in the amount of
$10,519 and will end May 19, 2023.
The General Assembly approved state funding to support industry credentialing testing
materials for students, and professional development for instructors, in science, technology,

engineering, mathematics and health sciences (STEM-H) Career and Technical Education
(CTE) programs. This program will be paid for by the Commonwealth's Lottery Proceeds
Fund. The program will be fully reimbursed from state funds in the amount of$3,883 and will
end May 19, 2023.
The School Resource Officer (SRO)/School Security Officer (SSO) Incentive Grant Program
provides funding to localities to place either a School Resource Officer or School Security
Officer in elementary and secondary schools where none currently exist. Specifically, these
funds will be used to provide twelve SSOs at the following elementary schools: Crystal Spring,
Fairview, Fallon Park, Grandin Court, Highland Park, Lincoln Terrace, Monterey, Preston Park,
Roanoke Academy for Math and Science, Round Hill, and Westside and one additional SSO
at John P. Fishwick Middle school. This is a pass through from the City of Roanoke. The
program will be fully reimbursed from state funds in the amount of$648,661 and will end June
30, 2023. This is a new program.
Recommended Action:
We recommend that Council concur with this report of the School Board and adopt the
attached budget ordinance to establish revenue estimates and to appropriate funding as
outlined.

particularly described hereinafter; and dispensing with the second reading of this
ordinance by title.
WHEREAS, Carilion Clinic Properties, LLC filed an application with the Council
of the City of Roanoke, Virginia ("City Council"), in accordance with law, requesting
City Council to alter and close the public right-of-way described hereinafter;
WHEREAS, the City Planning Commission, after giving proper notice to all
concerned as required by §30-14, Code of the City of Roanoke (1979), as amended, and
after having conducted a public hearing on the matter, has made its recommendation to
Council;
WHEREAS, public hearing was held on such application by City Council on
October 17, 2022, after due and timely notice thereof as required by §30-14, Code of the
City of Roanoke (1979), as amended, at which hearing all parties in interest and citizens
were afforded an opportunity to be heard on such application;
WHEREAS, it appearing from the foregoing that the land proprietors affected by
the requested closure of the subject public right-of-way have been properly notified; and
WHEREAS, from all of the foregoing, City Council considers that no substantial
inconvenience will result to any individual or to the public from altering and closing of
such public right-of-way, and that such alteration will promote the safety and welfare of
those using the subject public right-of-way and the right-of-way in the vicinity of the
right-of-way to be closed.
THEREFORE, BE IT ORDAINED by the Council of the City of Roanoke,
Virginia as follows:
1. The public right-of-way situated in the City of Roanoke, Virginia, and
more particularly described as follows:

west from Williamson Road S.E., to a dead end, and being adjacent to
property located at 927 Williamson Road, S.E., Official Tax Map No.

be, and hereby is, altered and closed, as described in such Application.
2. Upon meeting all conditions to the granting of the application, the
applicant shall deliver a certified copy of this ordinance for recordation to 4 the Clerk of
the Circuit Court of Roanoke, Virginia, indexing the same in the name of the City of
Roanoke, Virginia, as Grantor, and in the name of the petitioner, and the names of any
other parties in interest who may so request, as Grantees. The applicant shall pay such
fees and charges as are required by the Clerk to effect such recordation.
3. Upon recording a certified copy of this ordinance with the Clerk of the Circuit
Court of the City of Roanoke, Virginia, the applicant shall file with the Engineer for the
City of Roanoke, Virginia, the Clerk's receipt, demonstrating that such recordation has
occurred.
4. The applicant shall submit a subdivision plat to the Subdivision Agent, receive
all required approvals thereof, and record the plat with the Clerk of the Circuit Court for
the City of Roanoke. Such plat shall combine all properties which would otherwise
dispose of the land within the right-of-way to be vacated in a manner consistent with law,
and retain appropriate easements for the installation and maintenance of any and all
existing utilities that may be located within the right-of-way, including the right of
ingress and egress. The applicant would be required to show a 20-foot easement to the
Western Virginia Water Authority along the full length of the existing sewer line in the
Highland Avenue SE right-of-way.
5. Prior to receiving all required approvals of the subdivision plat referenced
in the previous paragraph, the applicant shall, as consideration pursuant to §15.2-2008,
Code of Virginia (1950), as amended, for the vacated right-of-way, either provide to the
Treasurer for the City of Roanoke a certified check or cash in the amount of$124,300 or
provide a bond to offset the valuation with improvements to be made within the public
right of way that are approved by the Planning Commission Agent.
6. If the above conditions have not been met within a period of twelve (12)
months from the date of the adoption of this ordinance, then such ordinance will be null
and void with no further action by City Council being necessary, unless extended by the
Agent for the Planning Commission for an additional six (6) months prior to the end of
the twelve (12) month period.

as requested, contingent upon the following conditions:

Background:
The applicant seeks to vacate an approximately 13,084+/- square foot residual
portion of right of way for Highland Avenue SE adjacent to 927 Williamson Road
SE. Previous portions of Highland Avenue SE between Williamson Road and
,Jefferson Street had been vacated in the past for the purpose of medical facility
development. Due to steep grades and development, it is very unlikely that this
portion would be constructed.

Proposed Use/Development:
The applicant will incorporate the vacated right of way into a master
development plan. The applicant owns property on both sides of the right of
way and has plans to demolish the existing buildings and incorporate the land
into medical facility development.
Considerations:
The primary consideration in vacating a public right-of-way is any inconvenience
that the vacation may create.
Impact of Street Vacation to Public Accessibility:
This vacation will have no impact on public accessibility, as the portion of right
of way presently contains no public access and is used and is maintained as a
parking lot for the two vacant adjoining buildings formerly used for retail use.
Impact of Street Vacation to Public Services:
The proposed vacation does not impact City of Roanoke public services.
There is an 8" sanitary sewer main that extends approximately 150 feet into the
right of way proposed to be vacated. The applicant would be required to show
a 20-foot easement around the main on the final required plat.
Consistency with Comprehensive Plan:
City Plan 2040, the City's Comprehensive Plan, states that Roanoke will
"encourage active, productive uses of land and preclude unproductive uses of
land." By vacating this section of right of way, the city will be divesting itself of
land that serves no functional public purpose and allow for redevelopment of a
productive use.
City Plan 2040 Livable Built Environment policy also "supports
development/redevelopment of commercial centers to compliment surrounding
neighborhoods". This vacation would allow for a larger redevelopment of
vacant properties within the existing hospital and medical facilities that would
complement the surrounding downtown.
The Downtown Plan:
POLICY 1 -F: "Support Downtown Roanoke's position as the regional center for
the Virginias Blue Ridge area. The applicant plans to incorporate the existing
right of way into a larger development plan for a medical facility that continues
to be a major influence in the Roanoke area.

POLICY 2-13: "Repair voids in the streetscape and improve the pedestrian realm,
while supporting infill development." The Mill Mountain Greenway passes
adjacent to this section of Highland Avenue. Pedestrian experience will be
enhanced by development made possible by this closure action.
Comments on Application:
Public Utilities:
There is an 8" sanitary sewer main that extends approximately 150 feet into the
right of way proposed to be vacated. The applicant would be required to show
a 20-foot easement around the main on the final required plat.
No comments were received from, Roanoke Gas, Appalachian Power Company,
or Verizon. Cox Cable approved the application.
City Departments:
No adverse comments were received by city departments.
Planning Commission Work Session:
Commissioners commented that redevelopment within this area would greatly
improve the visual impact. The expansion of the medical campus that this
vacation would facilitate is a much anticipated event.
Planning Commission Meeting:
The Planning Commission held a public hearing on Monday, October 11 , 2022.
By a vote of with 7-0, the Commission recommended approval of the vacation
as requested, contingent upon the conditions enumerated herein.
Public Comments:
No public comments received.
Conclusions and Recommendations:
The application is consistent with the City's Comprehensive Plan and the
Downtown Plan and would not create an inconvenience to the public. Staff
recommends vacation of the right-of-way as requested subject to the conditions
stated above.

Highland Avenue Closure Request
Carilion Clinic is requesting that a small section of Highland Avenue be closed/vacated to accommodate
the future development of the Innovation Corridor in the area between Williamson Road and Jefferson
Street.Should the City approve the street closure we would like to request up to 12 months to submit the
necessary legal documentation and record the vacation plat.
The cost of the right of way may be offset, partially or fully, by pedestrian accommodation and street
improvements provided by Carilion Clinic along Williamson Road, Albemarle Avenue and/or Jefferson
Street within three years after the recording of the vacation plat.The value of the street improvements
will be approved by Roanoke City Staff.

Background:
The owner of the subject property desires to develop the property at 3529 and a
portion of the surrounding 3531 Franklin Road SW, for a new financial institution
with the proposed building situated on the existing parcel boundary. The
current zoning of the property is CG, Commercial General District, for the corner
parcel and CLS, Commercial-Large Site District, for the surrounding parcel.
Although the property could be combined, it would leave separate zoning
districts on the new combined parcel and the differences in zoning district
regulations in the area of the new building would create difficulty in building
design.
The owner has proposed to rezone to CLS, Commercial - Large Site District, with
conditions, so that the future parcel has one uniform zoning district designation.
Proposed Use/Development:
The owner proposes to demolish the existing restaurant on the property
located a 3529 Franklin Road SW, combine the property at 3529 Franklin and a
portion of 3531 Franklin Road SW, and build a new financial institution.
The concept plan shows a new building set close to Franklin Road SW, but is
non-binding. If the zoning amendment were approved, the development of the
property would be subject to the standards of the CLS, Commercial - Large Site
District, and supplemental regulations and development standards of the
zoning ordinance. The applicant is aware that the impervious surface area
maximum in the CLS District is reduced from the CG District and that the scope
of the project would require the development to meet the 80% maximum.
The applicant has proffered conditions related to the placement of the building,
fa4ade transparency, and entrance location on the future combined parcel that
would further regulate development of the property.
Proffered Conditions Requested to be Adopted:
The applicant has requested the following proffered conditions be adopted as
they pertain to Official Tax Nos. 5500118 and a portion of 5500124, as
described by the metes and bounds description defining the subject area:
1 . The principal structure constructed within the bounds of the subject
parcel or portion thereof as included in this rezoning shall be no farther
than sixty-five (65') from Franklin Road.
2. Minimum transparency for principal structures for the ground floor shall
be 33% and upper floor shall be 20% for both street frontages.

3. The principal building entrance shall be on the Franklin Road facing
facade or within the first 2/5th of a side facade measured from the
Franklin Road facing facade.
Considerations:
Compatibility with Surrounding Land Uses:
The property is located on Franklin Road SW, at the northwest corner of the
intersection with Duke of Gloucester Street SW. The surrounding properties
consist of a variety of financial institution, medical clinic, used motor vehicle
sales and service establishment, hotel, self-storage building, and vacant uses:
■ To the northeast are a financial institution and medical clinic in CG,
Commercial-General District, with other commercial uses beyond.
■ To the southeast are a motor vehicle sales and service establishment and
hotel in CG, Commercial-General District,
■ To the southwest are a self-storage building and vacant property in CLS,
Commercial-Large Site District, with an eating establishment, motor
vehicle service establishment, and retail sales establishment in property
zoned CG, Commercial-General District, beyond.
■ To the northwest is a parking lot from a previous Kmart in property
zoned CLS, Commercial-Large Site District, and other commercial uses
beyond.
The future land use plan from the City Plan 2040 designates this area for
Commercial Corridor and Commercial - Large Scale use.
Applicability/Appropriateness of Proposed Zoning District:
The purpose of the CLS District is to accommodate multiple buildings and uses
that are large in scale and generally characterized by multiple tenants or uses on
a single zoning lot which share common parking, curb cuts, driveways, and
access to and from streets. These uses and areas are heavily dependent on the
motor vehicle and tend to result in large parking areas and outdoor display of
merchandise. CLS District uses include large motor vehicle sales and service

This application is intended to unify zoning on commercial corner property located at 3529
Franklin Road SW,Tax Parcel#5500118.This small 0.51313 acre corner property with
dimensions of approximately 150' X 150' containing 22,352 square feet was created in
1979 to accommodate construction of a Red Lobster restaurant and is currently zoned CG.
The Applicant requests rezoning of the parcel to the CLS zoning district to facilitate the
combination of the parcel with its adjoiner, also owned by the Applicant, establishing a
uniform zoning across all of its property, approximately14.5 acres in total.
The Applicant anticipates the removal of the existing Red Lobster building,to be replaced
by construction of a new first-class two-story commercial office building of approximately
14,000 sq. ft.The new office building will become headquarters to a large,new-to-market
financial institution providing substantial investment and employment to the Roanoke
area.The new office building will represent a multi-million dollar investment by the
owners and be positioned in a highly visible location directly in front of the large acre block
of property held by the Applicant for future development.Accordingly,the new office
building will promote architectural interest through abundant glazing and will be
attractively landscaped in order to assure it will have a positive influence as well as
preserve full latitude in future development/build-out of the Applicants adjacent
property.
Were the new office development to proceed without the proposed rezoning,the resulting
split-zoned parcel would present a significant impediment to obtaining financing for the
facility,both for construction and in the future,as most lenders will avoid the uncertainty
of a site and building subject to more than one zoning classification. The same condition is
a significant constraint on building placement for the design team currently working to
create an attractive,high-impact and highly functional site to benefit the Applicant,the City
of Roanoke and most importantly the Tenant and their clients.
The property is benefited by both a signalized intersection at the corner of Franklin Road
and Duke of Gloucester as well as multi-directional median crossover on Franklin Road.
The Applicant's engineers consulted with the City's traffic engineers and concluded there
would likely be no adverse traffic impact in the area as result of the rezoning.A trip
generation analysis comparing the trips ends for the proposed use of the property
compared with the current use shows the difference in the number of anticipated trips to
be very small.A summary of that analysis is attached.
Likewise,no adverse impacts to the surrounding area are anticipated.To the contrary the
proposed use of the property will not only promote and maximize development of the
balance of the site,but as encouraged by the City's Comprehensive Plan,including the
Franklin Road/Colonial Avenue neighborhood plan,this gateway location to the City will
symbolize progress and convey a strong sense of quality to neighbors and passers-by alike.

This application is intended to unify zoning on commercial corner property located at 3529
Franklin Road SW,Tax Parcel#5500118.This small 0.51313 acre corner property with
dimensions of approximately 150' X 150' containing 22,352 square feet was created in
1979 to accommodate construction of a Red Lobster restaurant and is currently zoned CG.
The Applicant requests rezoning of the parcel to the CLS zoning district to facilitate the
combination of the parcel with its adjoiner, also owned by the Applicant, establishing a
uniform zoning across all of its property, approximately 14.5 acres in total.
The Applicant anticipates the removal of the existing Red Lobster building,to be replaced
by construction of a new first-class two-story commercial office building of approximately
14,000 sq.ft.The new office building will become headquarters to a large,new-to-market
financial institution providing substantial investment and employment to the Roanoke
area.The new office building will represent a multi-million dollar investment by the
owners and be positioned in a highly visible location directly in front of the large acre block
of property held by the Applicant for future development.Accordingly,the new office
building will promote architectural interest through abundant glazing and will be
attractively landscaped in order to assure it will have a positive influence as well as
preserve full latitude in future development/build-out of the Applicants adjacent
property.
Were the new office development to proceed without the proposed rezoning,the resulting
split-zoned parcel would present a significant impediment to obtaining financing for the
facility,both for construction and in the future,as most lenders will avoid the uncertainty
of a site and building subject to more than one zoning classification. The same condition is
a significant constraint on building placement for the design team currently working to
create an attractive,high-impact and highly functional site to benefit the Applicant,the City
of Roanoke and most importantly the Tenant and their clients.
The property is benefited by both a signalized intersection at the corner of Franklin Road
and Duke of Gloucester as well as multi-directional median crossover on Franklin Road.
The Applicant's engineers consulted with the City's traffic engineers and concluded there
would likely be no adverse traffic impact in the area as result of the rezoning.A trip
generation analysis comparing the trips ends for the proposed use of the property
compared with the current use shows the difference in the number of anticipated trips to
be very small.A summary of that analysis is attached.
Likewise, no adverse impacts to the surrounding area are anticipated.To the contrary the
proposed use of the property will not only promote and maximize development of the
balance of the site,but as encouraged by the City's Comprehensive Plan, including the
Franklin Road/Colonial Avenue neighborhood plan,this gateway location to the City will
symbolize progress and convey a strong sense of quality to neighbors and passers-by alike.

A RESOLUTION authorizing the proper City officials to make boundary amendments to
the City's Enterprise Zone One A that will add certain areas not currently within Enterprise Zone
One A to Enterprise Zone One A; authorizing the City Manager to apply to the Virginia
Department of Housing and Community Development (VDHCD) for approval of such boundary
amendments; and authorizing the City Manager to take such further action as may be necessary
to obtain and implement such boundary amendments.
WHEREAS, there are certain areas currently located outside the City's Enterprise Zone
One A that are contiguous to them that are not currently a part of such Zone areas, but that can
be added to them and that will benefit from the designation of those additional areas as part of
such Zone areas, as set forth in the City Council Agenda Report dated October 17, 2022;
WHEREAS, the Virginia Enterprise Zone Grant Act of 2005, as amended, authorizes the
amendment of existing Enterprise Zone areas to delete and to add areas to such Zone and its
noncontiguous Subzones, thereby making qualified business firms within such areas eligible for
Enterprise Zone benefits;
WHEREAS, the addition of certain areas as part of the City's Enterprise Zone One A, as
set forth above, has a potential to stimulate significant private sector investment within the City
in areas where such business and industrial growth could result in much needed growth and
revitalization; and
WHEREAS, this Council, acting in its capacity as the governing body of the City of
Roanoke, has held a public hearing on the above mentioned proposed boundary amendments, at

which public hearing citizens and parties in interest were afforded an opportunity to be heard on
such proposed boundary amendments to Enterprise Zone One A.
THEREFORE, BE IT RESOLVED by the Council of the City of Roanoke as follows:
1. The City of Roanoke is hereby applying for amendments to the City's Enterprise
Zone One A which amendments will add additional areas to Zone One A which are currently
outside such Zone areas. Such amendments are more fully shown on the map(s) attached to the
City Council Agenda Report dated October 17, 2022, and more fully described in such Report.
2. The City Manager is hereby authorized to apply, on behalf of the City, to the
VDHCD for the above mentioned boundary amendments to the City's existing Enterprise Zone
One A pursuant to the applicable provisions of the Virginia Enterprise Zone Grant Act, as
amended, which boundary amendments will add to Zone One A certain areas not currently
within them, all as more fully set forth in the above mentioned Agenda Report.
3. Council hereby certifies that it held a public hearing as required by the Virginia
Enterprise Zone Grant Act Regulations.
4. The City Manager is authorized to submit to the VDHCD all information
necessary for the application for the boundary amendments to the City's Enterprise Zone One A,
for the Department's review and consideration and to take such further action as may be
necessary and/or execute any additional documents as may be necessary to meet other program
requirements or to establish the boundary amendments as set forth above. The City Clerk is
authorized to execute and attest any documents that may be necessary or required for the
application or for the provision of such information. Such authority shall continue throughout
the life of such Zone One A.

5. Local incentives applicable for Enterprise Zone One A shall also be applicable for
any new areas covered by such approved boundary amendments.
6. Any such approved boundary amendments will be retroactive to the date as
provided by such approval from the VDHCD.

Subject: Enterprise Zone Boundary Adjustment
Background:
Since the designation of the City of Roanoke Enterprise Zones, Enterprise Zone One A and its
Subzone B have undergone amendments to the zone boundary and local incentives. In
accordance with state regulations, each zone has a maximum acreage limit equal to seven
percent of total City acreage. Zone boundary and incentive amendments are permitted by
state regulations once a year. In an effort to best utilize Enterprise Zone incentives, City staff
recommends the boundary amendments set forth below that would add approximately 11.75
acres to Zone One A.
Considerations:
The Zone One A boundary addition amendment adds (i) approximately 0.7244 acres,
consisting of property located on Moorman Ave NW, west of 10th Street NW, and east of 11 th
Street NW; (ii) approximately 0.98 acres, consisting of property located on Orange Avenue
and west of Hollins Road.;(iii) approximately 4.0716 acres, consisting of property located on
Plantation Road, north of Orange Avenue, and south of Kanter Road; (iv) approximately
1.7438 acres, consisting of property on Aerial Way Drive SW and east of Peters Creek Road;
(v) approximately 3.7821 acres, consisting of property located on Brandon Ave, east of
Westland Road, and south of Old Salem Rd and property located on Old Salem Road SW,
east of Westland Road and north of Brandon Avenue; (vi) approximately 0.1105 acres,
consisting of property located on Marshall Avenue SW, east of 8th St and north of Day
Avenue; (vii) approximately 0.2764 acres consisting of property located on Melrose Avenue
NW, east of Monroe Street, south of Virginia Avenue, and west of Van Buren St and; (viii)
approximately 0.0615 acres consisting of property located on Jefferson Street, south of Gilmer
Ave, and north of Wells Avenue.
Adding the above properties to the City's Enterprise Zone One A will generate additional
opportunities for revitalization where buildings and sites are currently vacant, underutilized,
undeveloped, or development is pending. A map showing each boundary addition
amendment is attached hereto and has been on file since September 28, 2022 in the City
Clerk's Office (Attachment 1). The parcels shown in red on the map in Attachment 1 represent
properties proposed for addition into Zone One A.
In accordance with the Virginia Department of Housing and Community Development's
(VDHCD) Virginia Enterprise Zone Program regulations, the local governing body must hold at

least one public hearing affording citizens and interested parties an opportunity to be heard
before submitting an amendment application to the Department for consideration. Such public
hearing is scheduled for Roanoke City Council's regularly scheduled public hearing session on
October 17, 2022 at 7:00 p.m. Upon the approval of City Council, the boundary amendments
will be submitted to the VDHCD. Such amendments are subject to the approval by the
VDHCD. If approved, the amendments are retroactive to January 1, 2022, a date approved by
the VDHCD.
Recommended Action:
Absent comments at the public hearing requiring further consideration, adopt a resolution to
modify, as set forth above, the boundaries of Enterprise Zone One A, subject to approval by
the VDHCD, with an effective date retroactive to a date approved by the VDHCD, as set forth
above. Furthermore, authorize the City Manager to apply to the VDHCD for approval of the
above mentioned amendments and to take such further action and/or to execute such
additional documents as may be needed to obtain or confirm such amendments and to meet
the Program requirements throughout the life of the Zones.
