Council Member Cobb gave an update with regard to the construction of
the Valley Metro Transit Center entering Phase 2 on November 14, 2022.
He noted that the building will open as construction begins on the bus
lanes, with some buses stopping on Salem Avenue and some under the
canopy of the building.
Council Member Bestpitch acknowledged Mayor Lea's correspondence of
condolence to the Republic of Korea.
Vice-Mayor White-Boyd reminded citizens to vote on Tuesday, November
8.
Council Member Sanchez-Jones reminded the public that Valley Metro will
provide free rides to the polls on Tuesday, November 8.

Re: City Code Amendment to Chapter 12, Fire Prevention and
Protection, Code of the City of Roanoke (1979), by adding Article
IV, Smoke Alarms.
Also, City Code Amendment to Section 12-17, Violations, Article II,
Fire Prevention Code, Chapter 12, Fire Prevention and Protection,
Code of the City of Roanoke (1979), to make each day a violation
occurs a separate offense.
OVERVIEW
According to a 2021 report by the National Fire Protection Association, three out of five home fire
deaths occurred in properties with no smoke alarms present or where the smoke alarms failed to operate.
In addition, the death rate per 1,000 home structure fires is 55% lower in homes with working smoke
alarms compared to homes without.
Most structures built in the City of Roanoke since 1976 with a residential use (single family residences,
duplexes, apartments, and hotels/motels) have an enforceable requirement for smoke alarm installations.
Structures built before 1976, however, do not.
The City of Roanoke is proposing the adoption of an ordinance to require the installation of smoke
alarms in all buildings that:
1) Contain one or more dwelling units;
2) Any hotel or motel regularly used, offered for, or intended to be used to provide overnight sleeping
accommodations for one or more persons; and
3) Any rooming houses regularly used, offered for, or intended to be used to provide overnight sleeping
accommodations
This ordinance would not require installation of hard-wired smoke alarms,nor would this ordinance
require the upgrade of an existing smoke alarm installed pursuant to the building code in effect when the
building was constructed. This ordinance will be enacted based on authority granted by the General
Assembly in Section 15.2-922 of the Code of Virginia.
While the maximum penalty for failure to comply with this ordinance would be a Class 1 Misdemeanor
(12 months in jail and a$2,500 fine), our intent is to focus enforcement on buildings that are offered as
paid overnight accommodations (short term rentals, apartments, condominiums,hotels,motels, etc.) In
general, a failure to provide smoke alarms to a residence would only be charged as a misdemeanor when
the landlord in question has received at least three warnings for any property that they own or control.
Enforcement of this regulation will be shared by the Fire Marshal's Office and Code Enforcement. While
both agencies will be able to issue warnings, the Fire Marshal's Office will lead any potential criminal
enforcement actions.
The impact to existing landlords should be minimal. The Virginia Landlord Tenant Act already requires
landlords to provide smoke alarms in rental properties. This ordinance simply provides an enforcement
mechanism to the City for enforcement of this requirement in instances where a building owner fails to
provide these lifesaving devices. In addition, Fire-EMS and the Fire Marshal's Office will continue to
install smoke alarms free of charge whenever requested in the City.
Lastly, the amendment to Section 12-17 makes each day that the owner delay correcting a fire prevention
problem, a new offense. This will help motivate owns to quickly correct the problem which will help
save lives.
RECOMMENDATION
For the aforementioned reasons, I recommend that City Council adopt the attached ordinance adding the
new Smoke Alarm Article to the City Code. In addition, I recommend amending Section 12-17,
Violations, Article II, Fire Prevention Code, Chapter 12, Fire Prevention and Protection, Code of the City
of Roanoke (1979), to make each day a violation occurs a separate offense. The amendment to Section
12-17 makes each day that the owner delays correcting a fire prevention problem, a new offense. This
will help motivate owners to quickly correct the problem which will help save lives.

IN THE COUNCIL OF THE CITY OF ROANOKE, VIRGINIA
AN ORDINANCE amending and reordaining Chapter 12, Fire Prevention and Protection,
Section 12-17, Violations, and adding a new Article IV, Smoke Alarms, Code of the City of
Roanoke (1979) as amended.
BE IT ORDAINED by the Council of the City of Roanoke as follows:
1. Chapter 12, Fire Prevention and Protection, Code of the City of Roanoke(1979), as
amended, is hereby amended and reordained to read and provide as follows:
CHAPTER 12 —FIRE PREVENTION AND PROTECTION
Sec. 12-17. Violations.
It shall be unlawful for any owner or any other person, firm, or corporation to violate any
provisions of the Statewide Fire Prevention Code, or the City of Roanoke Fire Prevention Code.
Any such violation shall be deemed a Class 1 misdemeanor, and any owner, or any other person,
violation shall be unshed in accordance with the
firm, or corporation convicted of such vio p
provisions of Section 18.2-11 of the Code of Virginia(1950), as amended, and each day of a
continuing violation may be prosecuted as a separate offense once the responsible party has been
notified.
ARTICLE IV. SMOKE ALARMS
Sec. 12-32. Definitions.
For the purpose of this article, the following words and phrases shall have the meanings
ascribed to them by this section:
Dwelling. Any building containing one(1) or more dwelling units.
Dwelling unit. A room or combination of rooms containing living, sleeping and kitchen
facilities for one(1) family.

Hotel. Any building which is regularly used, offered for use, or intended to be used to
provide overnight sleeping accommodations for one (1) or more persons for compensation.
Motel. Any building or collection of buildings which is regularly used, offered for use, or
intended to be used to provide overnight sleeping accommodations for one(1) or more persons
for compensation.
Owner. The holder of title in fee simple; any person, group of persons, company,
association or corporation in whose name tax bills on the property are submitted; or any person
who alone or jointly or severally with others:
(1) Shall have legal title to any building unit with or without accompanying actual
possession thereof; or
(2) Shall have charge, care or control of any building or building unit as owner, executor,
administrator, trustee, guardian of the estate of the owner, mortgage vendee in
possession, assignee of rents, lessee or other person, firm or corporation in control of a
building, or their duly authorized agent.
Any such person, group of persons, company, association or corporation shall have joint
and several responsibility for compliance with the provisions of this article.
Roominghouse. A dwelling regularly used, offered for use or intended to be used to provide
overnight sleeping accommodations for one(1) or more persons for compensation.
Sec. 12-33. Smoke alarms required.
It shall be unlawful for the owner of any building to occupy, lease or rent any dwelling or
dwelling unit or to operate, use or permit any building, or part thereof,to be operated or used as a
hotel, motel or rooming house until smoke alarms have been installed in it in conformance with
the provisions of the Uniform Statewide Building Code. Smoke alarms installed pursuant to this
section shall be installed only in conformance with the provisions of the Uniform Statewide
Building Code and shall be permitted to be either battery operated or AC powered. Such
installation shall not require new or additional wiring and shall be maintained in accordance with
the Statewide Rire.Prevention Code (§ 27-94 et seq.) and subdivision C 6 of§ 36-105, Part III of
the Uniform Statewide Building Code.
Sec. 12-34. Certification.
The owner of any rented or leased dwelling unit shall provide to each tenant at the
beginning of each tenancy, and at least annually thereafter, a certificate stating that all smoke
alarms are present, have been inspected by the owner, his employee, or an independent
contractor, and are in good working order.
Sec. 12-35. Maintenance.
(a) Smoke alarms located in public or common areas of multi-family buildings shall be
maintained in good working condition by the owner.

shall be the responsibility of the tenant in accordance with § 55.1-1227 of the Code of
Virginia (1950), as amended, as applicable.
Sec. 12-36. Records.
The owner of any building subject to this article shall maintain records of the inspections,

Sec. 12-37. Exemptions.
Nothing herein shall require the upgrading of any smoke alarms provided by the building
code in effect at the time of the last renovation of such building, for which a building permit was
required, or as otherwise provided in the Uniform Statewide Building Code.
Sec. 12-38.Violations.
Any person violating a provision of this article shall be guilty of a Class 1 misdemeanor.
2. This Ordinance shall be in full force and effect immediately upon its adoption.
3. Pursuant to Section 12 of the Roanoke City Charter, the second reading by title

1.1 Acres and Improvements — Former Fishburn Park Caretaker's Cottage.
Background:
The City of Roanoke is proposing to sell approximately 1.1 acres of land which includes the
former Fishburn Park Caretaker's Cottage located at 2424 Brambleton Ave., S.W. (Property),
the Property being a portion of Tax Map Number 1470301, to Keri and Justin vanBlaricom
(`Buyer"). The Buyer proposes to pay Ten Dollars ($10.00) for the Property in order to restore
the building and use it as a Coffee House Cafe.
Buyer shall not be obligated to purchase the property without successfully obtaining a final
approval from the City of Roanoke to rezone the Property to an appropriate zoning district that
permits, as a matter of right, the construction of the use contemplated by the Contract.
Proposed Deed restrictions will require the Buyer to (i) commence Construction Activity by 90
days after the Closing Date; (ii) invest a minimum of $150,000 in building construction and
equipment; and (iii) achieve Substantial Completion of Construction by 12 months after the
Closing Date. In the event the buyer sells, or otherwise conveys the Property, or any part of
the Property, at any time within four years of the date the final permanent certificate of
occupancy is issued, the buyer shall repay to the city $83,000, whether or not the Property has
depreciated or appreciated in value.
A public hearing is required for the sale of city-owned property. Subject to City Council's
concurrence with this request, a copy of the proposed Contract for Purchase and Sale of Real
Property will be placed with the City Clerk for review prior to the public hearing. Pursuant to
the requirements of State Code, notice of the public hearing must be advertised at least seven
days prior to the public hearing. The public hearing would occur on November 21, 2022, or at
such later date as the City Manager determines.
Recommended Action:
Authorize the scheduling and advertising of the proposed sale of the Property for a public

Background:
Boxfit is a nonprofit organization that uses boxing, fitness, and mentorship as means to
develop young people in a positive and progressive way. The program provides young people
with an outreach program that focuses on creating and maintaining a safe and healthy
atmosphere that allows them to find a new way to channel their own emotions and energy
towards something constructive. The program also works to inspire and cultivate an interest in
boxing as well as fitness overall. Most importantly, the program works to encourage the
highest level of confidence out of every child in the program.
Boxfit is in need of a facility to provide this program to the community and was recently
awarded a grant from the Roanoke Gun Violence Prevention Commission to apply toward the
operating costs of the program.
Considerations:
The Norwich Recreation Center has not had public hours for more than 10 years and is used
primarily for storage and occasional recreational programming. Having secured adequate
space to store the Department's equipment elsewhere, the Norwich Recreation Center would
be an ideal place to house this program. Making this space available for the Boxfit program
may lead to other collaborative programming efforts with the Department.
A public hearing is required for the lease of city-owned property. Subject to City Council's
concurrence with this request, a copy of the proposed Lease will be placed with the City Clerk
for review prior to the public hearing. Pursuant to the requirements of State Code, notice of

Considerations:
The Roanoke City Public Libraries, as a co-applicant, will receive funds for the multi-year grant
from the schools to facilitate the services in the grant agreement. The grant provides $47,600
annually for the current year to pay for Library Literacy Specialist salaries to provide reading
and math tutoring to students. The grant does not provide funds for FICA and therefore $3,642
is needed as a voluntary local match, for a total of$51,242.
Recommended Action:
Accept the funds from the U.S. Department of Education via the Roanoke City Public Schools
as described above and authorize the City Manager or his designee to execute any required
agreements or documents, all documents to be approved as to form by the City Attorney.
Adopt the accompanying budget ordinance to transfer funding in the amount of $51,242 from
the Grant Match account 01 250 9310 9535, establish a revenue estimate in the amount of
$47,600 into accounts to be established in the Grant Fund by the Director of Finance.

WHEREAS. RCPS was awarded the Title IV Part B 21st Century Community Learning Center federal
grant (**Grant") from the Virginia Department of Education, to obtain and provide for its students 'lst-
century skills" that include but are not limited to, collaboration. digital literacy.. critical thinking, and
problem-solving to help such students thrive and compete in the modern globalized world:
WHEREAS, Roanoke Public Libraries desires to help RCPS implement the grant by providing certain

The RCPS --'I" Century Community Learning Centers and their eonumurity partners provide enriching
instructional prograrluning that supplements what is offered during the regular school day to give students
supportive learning opportunities that are engaging and focused on the educational and or developmental
needs of each participating student. These instructional offerings will be designed to support achievement
of one or more of the objectives written into each school's grant related to student achievement in the areas
of English reading and writing and.or mathematics or to support character development and life skills
attainment. Roanoke Public Libraries provides a literacy specialist to work with students reading below
grade level, staff professional development, family engagement events, field trips, and book giveaways.
ARTICLE III
1
(1) Commercial General Liability-. Conunercial General Liability insurance coverage on an occurrence
basis insuring against all claims,loss,cost.damage.expense or liability-from loss of life or damage
or injury to persons or property arising out of any of the Nyork or activity under or by virtue of this
Agreement. The minimum limits of liability for this coverage shall be S 1.000.000 combined single
limit for any one occurrence and S 1.000.00O aggregate. `
(2) Contractual Liability. Contractual Liability insurance
(3) Workers' Compensation. Workers' Compensation insurance covering Roanoke Public Libraries'
statutory obligation under the laws of the C'oi�nonwealth of Virginia and Employer's Liability
insurance for all its employees engaged in work under this Agreement. Minimum limits of liability
for Employer's Liabilim, shall be S 100.000 bodily injury each occurrence, 5500.000 bodily injury
by disease(Policy limit): and 5100,000 bodily injury by disease(each employee). With respect to
the Workers' Compensation and Employer's Liability coverage. Roanoke Public Libraries'
insurance company shall waive rights of subrogation against the Licensor, its officers. agents.
employees and volunteers. `
(4) Automobile Liability. Roanoke Public Libraries shall maintain during the life of this agreement
Automobile Liability insurance. The minimum limit of liability for such insurance shall be
S 1.000,000 combined single limit applicable to owned or non-owned vehicles used in the
performance of any work under its Agreement.
(5) Umbrella Coverage. The insurance coverage and amounts set forth in this Section may be met by
an umbrella liability Policy following the form of the underlying primary coverage in a nunimum
amount of S 1.000.000. Should an umbrella liability insurance coverage Policy be used. such
coverage shall be accompanied by a certificate of endorsement stating that it applies to the specific
Policy numbers indicated for the insurance providing the coverage required by this agreement. and
it is furl a
her agreed that such statement shall be made a part of the`certificate of insurance furnished
by Roanoke Public Libraries to RCPS.
(6) Evidence of Insurance. All insurance shall meet the following requirements:
(a) Roanoke Public Libraries shall furnish the RCPS a certificate or certificates of insurance
showing the type. amount. effective dates and date of expiration of the policies. RCPS
shall be notified of any deductible greater than 10°0 of the policy limit and such deductible
shall be subject to approval of RCPS, which shall not be unreasonable withheld.
(b) The required certificate or certificates of insurance shall include substantially the following
statement: "The insurance covered by this certificate shall not be canceled or materially
altered. except after thirty(30) days written notice has been provided to RCPS."
(c) Except for Workers' Compensation coverage and Employer's Liability coverage, the
required certificate or certificates of insurance shall name RCPS as additional insured in
connection with this Agreement.
(d) Insurance coverage shall be in a form and with an insurance company approved by the
RCPS which approval shall not be unreasonably_ withheld. Any insurance company
providing coverage under this Agreement shall be authorized to do business in the
Commonwealth of Virginia.

ROANOKE CITY COUNCIL AGENDA REPORT

Subject: Acceptance of Virginia Department of Transportation (VDOT) MAP 21 RSTP
and SmartSCALE Funds, Authorization to Execute VDOT Documents, and
Appropriation of Funds for the Orange Avenue Improvements from King
Street to Blue Hills Drive.
Background:
In 2020, VDOT initiated a Strategically Targeted Affordable Roadway Solutions (STARS)
study to evaluate operational and safety conditions along Orange Avenue (Route 460) from
Williamson Road (Route 11) to Route 220 Alt (Cloverdale Road). Within the study area, Route
460 has 12 signalized intersections which contribute to rear end crashes due to congestion
and stop and go conditions throughout the corridor as well as 16 unsignalized intersections
and 7 unsignalized median crossovers which contribute to the number of angle crashes due to
the lack of access control.
The STARS improvements identified within the Orange Avenue corridor from King Street to
Blue Hills consist of turning lane extensions, traffic signal upgrades, drainage work,
intersection thru-cuts and median r-cuts, crosswalk improvements, and associated work.
Prior to the STARS study, the City had been awarded SMART SCALE FY21 grant to begin
improvements within the same corridor. This grant increases the scope of those improvements
and replaces the grant funds associated with that project.
Considerations:
VDOT has awarded the City a MAP21 RSTP grant of $1,227,000 and SmartSCALE grant of
$12,614,372. Total grant funds total $13,841,372 for the design, right of way acquisition, and
construction of the project. Local match is not required.
Recommended Action:
Accept the VDOT's $13,841,372 award of MAP21 RSTP and SmartSCALE funding.
Authorize the City Manager or his designee to execute the VDOT Standard Project
Administration Agreement for Federal-aid Projects, Appendix A document, and VDOT Locally
Administer Federal-Aid Agreement Appendix B — Special Funding Program Conditions and
Requirements similar to the ones attached to this report. Such documents shall be in a form
approved by the City Attorney.
Authorize the City Manager or his designee to take such further actions and execute such
further documents, approved as to form by the City Attorney, as may be necessary to obtain,
accept, implement, administer, and use such funds identified above.
Adopt the accompanying Budget Ordinance to establish revenue estimates for the funding
sources identified above and appropriate funding in the same amount to the new expenditure

Without limiting the foregoing. this Project has been selected through the Smart Scale (HB2)
application and selection process and will remain in the Six-Year Improvement Plan(SYIP) as a
funding priority unless certain conditions set forth in the CTB's most current Police-for
Inrpleinewatioii of a Project Prioriti_ation Process arise. Pursuant to the CTB's Policy for
Inrplenientation of a Project Prioriti_ation Process, this Project will be re-scored and or the
funding decision re-evaluated if any of the following conditions apply: a change in the scope, an
estimate increase, or a reduction in the locallv'regionally leveraged funds. Applications may not
be submitted in a subsequent SMART SCALE prioritization cycle to account for a cost increase
on a previously selected Project.
This Project shall be initiated and at least a portion of tine Project's prograrmned funds expended
within one year of the budgeted year of allocation or funding may be subject to reprogranuning
to other projects selected through the prioritization process. In the event the Project is not
advanced to the next phase of construction when requested by the CTB, the LOCALITY or the
localities within the metropolitan planning organization may be required, pursuant to S 33.2-214
of tine Code of Virginia, to reimburse the DEPARTMENT for all state and federal fiinds
expended on the Project.
Transportation.4lternatives Program
This Project shall be administered in accordance with VDOT's most current Transportation
_41ternatives Program Guide.
Without Bruiting the foregoing. CTB policy for allocations from the Transportation Alternatives
Programs requires that the Project must be advertised or otherwise under construction within
four years of the initial Project allocation or otherwise be subject to deallocation, unless prior
Department approval has been provided.
The DEPARTMENT shall conduct all environmental studies necessary to complete an
environmental document in compliance with the National Environmental Policy Act. unless
otherwise agreed to in writing and attached to this Agreement. The LOCALITY is responsible

for implementing any environmental commitments resulting from the environnental studies. In
addition. the LOCALITY is responsible for obtaining any water quality permits and conducting
any required hazardous materials due diligence efforts. VDOT's estimated cost for the
environmental studies and submissions Nvill be provided to the LOCALITY and deducted from
the Project funds.
Regional Surface Transportation Program (RSTP)
Allocated Regional Surface Transportation Program funds must be obligated within 12 months
of allocation and expended within 36 months of the obligation.
Congestion 31itigation Air Quality (CJL4Q)
Allocated Congestion Mitigation and Air Quality Program fiinds must be obligated within 12
months of allocation and expended within 36 months of the obligation.
Revenue Sharing
This Project sliall be administered in accordance with VDOT's most current Rei,enue Sharing
Progrcnn Guidelines.
Without limiting the foregoing. the Project shall be initiated such that at least a portion of the
Revenue Sharing Funds are expended within one year of allocation. For any project that has not
been initiated within one year. the CTB has the discretion to defer consideration of future
allocations until the Project moves forward. Further. if the Project has not been initiated within
two fiscal years subsequent to the allocation of Revenue Sharing Funds. the Revenue Sharing
Funds for the Project play be subject to deallocation from the Project at the discretion of the
CTB.

THIS AGREEMENT.. is hereby made and effective the date of the last (latest) signature
set forth below, by and between the CITY OF ROAN-OKE, VIRGINIA, hereinafter referred to as
the LOCALITY and the Cornnionwealth of Virginia, Department of Transportation, hereinafter
referred to as the DEPARTMENT. The DEPARTMENT and the LOCALITY are collectively
referred to as the "Parties."
WHEREAS, the LOCALITY has expressed its desire to administer the work described in
Appendix A. and such work for each improvement shown in Appendix A is hereinafter referred
to as the `'Project;" and
WHEREAS, the hinds shown in Appendix A have been allocated to finance the Project:
and
WHEREAS, the LOCALITY is conuiritted to the development and delivery of the
Project in an expeditious manner: and
WHEREAS. the LOCALITY is responsible for administering the Project in accordance
with DEPARTMENT guidelines.. including the most current Locallh-.=ldinilti.s•tered Projects
,Manual(**LAP Manual—), and with the program specific requirements shown in Appendix B,
based on the nature of the allocated funding for the Project as shown in the Appendix A; and
WHEREAS. the Parties have concurred in the LOCALITY's administration of all phases
of work for the Project in accordance with applicable federal, state and local laws and regulations;
and
WHEREAS, the LOCALITY's governing body has by resolution. demonstrated the
LOCALITY'S commitment to provide local funding for the Project to the extent contemplated
by this Aareement and further, by resolution or othenvise, authorized its designee to execute this
Agreement, and said authorizations are attached hereto.
NOW THEREFORE, in consideration of the mutual premises contained herein. the
Parties hereto agree as follows:
1. The representations, covenants and recitations set forth in the foregoing recitals are
material to this Agreement and are hereby incorporated into and made a part of this
Agreement as though they were fiilly set forth in this Section 1.
2. The LOCALITY shall:

a. Be responsible for all activities necessary to complete the noted phase(s) of the Project
as shown in Appendix A, except for activities, decisions. and approvals which are the
responsibility of the DEPARTMENT, as expressly required by federal or state laws
and regulations, or as otherwise agreed to, in writing. between the Parties. Every phase
of the Project will be designed and constructed to meet or exceed current American
Association of State Highway and Transportation Officials standards when the
facilities are locally maintained and shall further comply with all supplementary
standards established by the DEPARTMENT when the facilities are maintained by the
DEPARTMENT.
b. Meet all funding obligation and expenditure timeline requirements in accordance with
all applicable iederZ and state laws and regulations. all applicable Commonwealth
Transportation Board and DEPARTMENT policies, and those additional requirements
as identified in Appendices A and B to this Agreement. Noncompliance with this
requirement may result in deallocation of the funding from the Project, rescission of
state funding match,. termination of this Agreement, or the DEPARTMENT's denial of
future requests to administer projects by the LOCALITY, all of which actions are at
the discretion of the DEPARTMENT or as can be taken pursuant to applicable laws.
regulations, or policies.
c. Receive prior written authorization from the DEPARTMENT to proceed with
preliminary engineering, right-of-way acquisition and utility relocation, advertisement
and award for the Project, as required in the most current LAP Manual and other
applicable DEPARTMENT guidelines.
d. Adnunister the Project in accordance with the DEPARTMENT's most current LAP
Manual and other guidelines applicable to Locally Administered Projects as published
by the DEPARTMENT.
e. Maintain accurate and complete records of the Project's development as required in the
LAP Manual and any supplemental guidance and directives of the DEPARTMENT and
retain documentation of all expenditures and make such information available for
inspection or auditing by the DEPARTMENT upon request. Records and
documentation for the Project shall be maintained for no less than three (3) years
following the DEPARTMENT'S acceptance of the final voucher on the Project.
f. At least quarterly, but no more frequently than monthly, submit invoices with
supporting documentation to the DEPARTMENT in the form prescribed by the
DEPARTMENT. The supporting documentation sliall include copies of vendor and
contractor invoices paid by the LOCALITY, an up-to-date Project sununary and
schedule, and a summary of all payment requests, payments and adjustments. A
request for reimbursement shall be made within 90 days after any eligible Project
expenses are incurred by the LOCALITY. Reimbursement for eligible expenditures
shall not exceed funds allocated each year for the Project by the Cornmontvealth
Transportation Board in the Six Year Improvement Program.

4 Remedies for Noncompliance, failure to comply with federal laws and regulations, or
the terms and conditions of federal awards. may result in the imposition of sanctions
including but not limited to possible denial or delay of payment of all or a part of the
costs associated with the activity or action not in compliance.
h. Reimburse the DEPARTMENT for all Project expenses incurred by the
DEPARTMENT if, due to action or inaction of the LOCALITY, federally-funded
Project expenditures incurred are not reimbursed by the Federal Highway
Administration(FH`'4'A), or reimbursements are required to be returned to the FHWA,
or in the event the reimbursement is required by the provisions of§ 33.2-214 or § 33.2-
331 of the Code of Virginia (1950), as amended, or other applicable provisions of
federal, state, or local law or regulations.
i. On projects that the LOCALITY is providing the required match to state or federal
fiends, pay the DEPARTMENT the LOCALITY's match for eligible Project expenses
incurred by the DEPARTMENT in the performance of activities set forth in paragraph
2.a.
j. Administer the Project in accordance with all applicable federal, state, and local laws
and regulations. Failure to fulfill legal obligations associated with the Project may
result in forfeiture of federal or state-aid reimbursements.
k. If legal services other than that provided by staff counsel are required in connection
with condemnation proceedings associated with the acquisition of Right-of-Way, the
LOCALITY will consult the DEPARTMENT to obtain an attorney from the list of
outside counsel approved by the Office of the Attorney General. Costs associated with
outside counsel services shall be reimbursable expenses of the Project.
1. Provide, or have others provide, maintenance of the Project upon completion, unless
otherwise agreed to by the DEPARTMENT. Where the Project results in physical
constriction, the LOCALITY will continue to operate and maintain the Project in
accordance with the final constructed design as approved by the DEPARTMENT. The
LOCALITY agrees that any modification of the approved design features, without the
approval of the DEPARTMENT. may. at the discretion of the DEPARTMENT, result
in restitution either physically or monetarily as determined by the DEPARTMENT.
3. The DEPARTMENT shall:
a. Perform any actions and provide any decisions and approvals,within a reasonable time..
which are the responsibility of the DEPARTMENT. required by federal and state laws
and regulations, or as otherwise agreed to. in writing. between the parties, and provide
necessary coordination with the FHWA as determined to be necessary by the
DEPARTMENT.

b. Upon receipt of the LOCALITY's invoices pursuant to paragraph 21, reimburse the
LOCALITY the cost of eligible Project expenses. as described in Appendix A. Such
reimbursements shall be payable by the DEPARTMENT within 30 days of an
acceptable submission by the LOCALITY.
c. Where applicable.. submit invoices to the LOCALITY for the LOC'ALITY's share of
eligible Project expenses incurred by the DEPARTMENT in the performance of
activities pursuant to paragraphs 2. a. and 3.a.
d. Audit the LOCALITY's Project records and documentation as may be required to
verify LOCALITY compliance with federal and state laws and regulations.
e. Upon LOCALITY'S request, make available to the LOCALITY guidelines to assist
the Parties in carrving out responsibilities under this Agreement.
4. If designated by the DEPARTMENT. the LOCALITY is authorized to act as the
DEPARTMENT's agent for the purpose of conducting su vey work pursuant to S 33.2-
1011 of the Code of Virginia (1950), as amended.
i. Nothing in this Agreement shall obligate the Parties hereto to expend or provide any funds
in excess of fiends agreed upon in this Agreement or as shall have been included in an
annual or other lawful appropriation. State and federal Project funding is limited to those
identified in the Appendix A of this Agreement and is allocable only upon LOCALITY's
compliance with all requirements of this Agreement. In the event the cost of all or part of
the Project is anticipated to exceed the allocation shown on Appendix A. the Parties agree
to cooperate in seeking additional funding for the Project or to terminate the Project before
Project costs exceed the allocated amount. Any requested increase in federal or state
funding is subject to DEPARTMENT policy and procedures applicable to the hording
source and is not guaranteed.
G. Nothing in this Agreement shall be construed as a waiver of the LOCALITY's or the
Conuuonwealth of Virginia's sovereign immunity.
7. The Parties inutually agree and acknowledge, in entering this Agreement, that the
individuals acting on behalf of the Parties are acting within the scope of their official
authority and capacity and the Parties agree that neither Party will bring a suit or assert a
claim against any official, officer. or employee of either Party, in their individual or
personal capacity for a breach or violation of the terms of this Agreement or to otherwise
enforce the terms and conditions of this Agreement. The foregoing notwithstanding,
nothing in this subparagraph shall prevent the enforcement of the terms and conditions of
this Agreement by or against either Party in a competent court of lay.
S. The Parties mutually agree that no provision of this Agreement shall create in the public.
or in any person or entity other than the Parties, rights as a third party beneficiary
hereunder. or authorize any person or entity. not a party hereto, to maintain any action for.
without limitation, personal injury, property damage. breach of contract, or return of
money, or property. deposit(s), cancellation or forfeiture of bonds, financial instruments.

pursuant to the terms of this Agreement or otherwise. Notwithstanding any other provision
of this Agreement to the contrary. unless otherwise provided, the Parties agree that the
LOCALITY or the DEPARTMENT shall not be bound by any agreements between either
party and other persons or entities concerning any matter which is the subject of this
Agreement. unless and until the LOCALITY or the DEPARTMENT has, in writing.
received a true copy of such agreement(s) and has affirmatively agreed, in writing. to be
bound by such Agreement.
9. This Agreement may be terminated by either Party upon 30 days advance written notice to
the other Party. Eligible Project expenses incurred through the date of termination shall be
reimbursed in accordance with paragraphs 2.f. 2.h.. and 3.b, subject to the limitations
established in this Agreement and Appendix A. Upon termination and unless otherwise
agreed to, the DEPARTMENT shall retain ownership of plans, specifications, and right of
way.unless all state and federal fiends provided for the Project have been reimbursed to the
DEPARTMENT by the LOCALITY, in which case the LOCALITY will have ownership
of the plans, specifications. and right of way.
10. Prior to any action pursuant to paragraphs 2.b, 2.g. or 2.h.of this Agreement, the
DEPARTMENT shall provide notice to the LOCALITY with a specific description of the
LOCALITY's breach of this Agreement. Upon receipt of a notice of breach, the
LOCALITY will be provided the opportunity to cure such breach or to provide a plan to
cure to the satisfaction to the DEPARTMENT. If.. within sixty (60) days after receipt of
the written notice of breach, the LOCALITY has neither cured the breach,nor is diligently
pursuing a cure of the breach to the satisfaction of the DEPARTMENT, then upon receipt
by the LOCALITY of a written notice from the DEPARTMENT stating that the breach has
neither been cured, nor is the LOCALITY diligently pursuing a cure, the DEPARTMENT
may exercise any remedies it may have under this Agreement or at law or in equity.
11. THE LOCALITY and DEPARTMENT acknowledge and agree that this Agreement has
been prepared jointly by the Parties and shall be construed simply and in accordance with
its fair meaning and not strictly for or against any Party.
12. THIS AGREEMENT. when properly executed. shall be binding upon both Parties. their
successors, and assigns.
13. THIS AGREEMENT may be modified only in writing by mutual agreement of the Parties.

Meeting: November 7, 2022
Subject: Acceptance and Appropriation of Community-Based Gun Violence
Intervention Program — Gun Violence Emergency Relocation Project from
the Commonwealth of Virginia, Department of Criminal Justice Services.
Background:
The Virginia Department of Criminal Justice Services has awarded the City of Roanoke state
funding from the Community-Based Gun Violence Intervention Program. This funding will
expand the work of the Roanoke Gun Violence Prevention Commission by providing
necessary funds to relocate high-risk individuals and families from areas at high risk of further
gun violence. The amount of the grant is $200,000 to be used over two years, at $100,000
each year. The term runs from July, 1, 2022 and will end June 30, 2024.
Two partner agencies will perform the work of the contract as subgrantees: Total Action for
Progress (TAP) and Family Service of Roanoke Valley. Both agencies will work collaboratively
with other city departments, community groups and agencies in the intervention of gun
violence, and will coordinate closely with the Gun Violence Prevention Commission to ensure
the intervention is targeted, effective, and timely.
Considerations:
The project partners and Gun Violence Prevention Commission will work collaboratively with
the Roanoke City Police Department, Roanoke City Public Schools, the Office of the City
Manager, and community partners and agencies to complement the intervention efforts
currently underway by the Gun Violence Prevention Commission and the Roanoke Police
Department.
Recommended Action:
Adopt a resolution accepting the Gun Violence Intervention Program Grant from the Virginia
Department of Criminal Justice Services Grant # 495979 to support the existing work of the

BE IT ORDAINED by the Council of the City of Roanoke as follows:
1. Chapter 1,General Provisions, Section 1-14,Working of prisoner-Generally,Code
of the City of Roanoke(1979)as amended,are hereby amended and reordained to read and provide
as follows:
See. 1-14. -Working of prisoners—Generally.
(a) A prisoners work force is hereby established in the city as authorized in_section 64 of the
Charter, which force shall be under the direction and control of the city manager. The
work force shall consist of such prisoners in the "Adult Detention Center as are
designated by the sheriff. The city manager shall direct such work force at such time and
places as he may designate or as necessity may require. Prisoners may be assigned to
work in the j-a4Adult Detention Center or on any city property, but no prisoner shall be
ordered or permitted to work on other than city property nor shall any prisoner be used
for the personal gain or convenience of any public official or employee or of any private
individual.
(b) Any person, male or female, eighteen (18) years of age and over confined in the-jai1-the
Adult Detention Center convicted of a misdemeanor or any offense, and sentenced to
confinement in jailthe Adult Detention Center as a punishment, or part punishment, may
be required to work on the prisoners work force, unless excused for cause by the sheriff.
Any prisoner who is eligible to work on the prisoners work force and who refuses work
assignments because of claimed physical inability to work shall be examined by the
ja4Adult Detention Center's physician or by any other licensed physician so as to
determine the physical ability of such prisoner to work, and the sheriff may require a
physical examination by the}ailAdult Detention Center's -physician or other licensed
physician of any prisoner being considered for work on the prisoners work force when
necessary to resolve doubt as to physical fitness.
2. Pursuant to Section 12 of the Roanoke City Charter, the second reading by title
of this ordinance is hereby dispensed with.

A RESOLUTION naming the City-owned plaza located at 26 Salem Avenue SE (Official
Tax Map No. 4010118), the John Nolen Plaza.
WHEREAS, John Nolen is considered a noted founder of the urban planning profession
in the United States;
WHEREAS, in 1907, the Women's Civic Betterment Club of Roanoke raised funds to
hire John Nolen to develop a comprehensive plan for the City, focusing on its public health and
sanitation problems. It was his first-ever city plan, catalyzing his career and legacy as a city
planner. While male city leaders responded with apathy, the women found ways to accomplish
improvements in the public schools, sanitation, and the overall cleanliness of the City;
WHEREAS, by 1928, the male city government and business leaders had realized the
benefits of public improvements, and they hired John Nolen to develop a more comprehensive
professional development plan to make Roanoke a more livable and reputable city;
WHEREAS, despite a time when localities regularly adopted discriminatory policies that
enforced segregation, John Nolen created progressive development plans that strongly
recommended that the City treat all neighborhoods equally, regardless of racial makeup, by
requiring that all neighborhoods have the same basic infrastructure, such as paved roads and
sidewalks;
WHEREAS, the City of Roanoke received a National Historic Landmark Planning
