3. HEARING OF CITIZENS UPON PUBLIC MATTERS:
City Council sets this time as a priority for citizens to be heard. All matters will be
referred to the City Manager for response, recommendation or report to Council, as he
may deem appropriate. Roni Sutton, 1225 Bobbett Gap Road, Montvale, Virginia,
appeared before the Council to address costs associated with the renovation of the
Fishburn Caretaker's Cottage. Freeda Cathcart, 2516 Sweetbrier Avenue, S. W.,
appeared before the Council with regard to the renovation of the Fishburn Caretaker's
Cottage. Victor Banks, 2604 Springhill Avenue, N. W., appeared before the Council to
address concerns of misinformation by the Department of Economic Development with
regard to the leasing of Firehouse No. 6. The matter was referred to the City Manager
for review , response and report back to the Council. Penny Warden, appeared before
the Council tell her story of homelessness and seek assistance from the City of
Roanoke. The matter was referred to the City Manager for review , response and report
back to the Council. Owen McGuire, 2514 Brambleton Avenue, S. W., appeared before
the Council with regard to Fishburn Park and advised that it should remain free space,
he was in opposition of the sale of the Caretaker's Cottage. Dotsy Clifton, appeared
before the Council to urge the Council to reconsider policy with regard to the Police
Department and expressed distrust of the Police Department and previous police
administration.
4. CONSENT AGENDA: APPROVED (6-0)
All matters listed under the Consent Agenda are considered to be routine by the
Members of City Council and will be enacted by one motion. There will be no separate
discussion of the items. If discussion is desired, the item will be removed from the
Consent Agenda and considered separately.
C-1. Request a Public Hearing to Consider Sale of Property located at 0 Portland
Avenue, N.W. and also known as Official Tax Map Number 6410118.
RECOMMENDED ACTION: Authorized the scheduling and advertising of the
proposed sale of the Property for a public hearing on December 19, 2022, at
7:00 p.m., or as soon thereafter as the matter may be heard, or at such later date
and time as the City Manager shall determine, in his discretion.

Timothy R. Spencer as the City Attorney and Troy A. Harmon as the Municipal
Auditor for the City of Roanoke, for terms of two-years, each, commencing
October 1 , 2022 and ending September 30, 2024;

Directors for a three-year term of office, commencing January 1 , 2023 and

1. Inquiries and/or comments by the Mayor and Members of City Council.
Council Member Cobb advised that on December 8, 6:00 p.m., at the Martin
Luther King Bridge, Bridging the Community Gap would host a night of
peace and joy through song; on December 10, 11:00 a.m. - 2:00 p.m.,
FEDUP will host its Christmas of Hope event.
Vice-Mayor White-Boyd advised that she would submit a proposal to
rename the Richard F. Poff building to the Rubin E. Lawson building.
Council Member Moon Reynolds announced a tree planting effort through
One Valley, Inc., along Loudon Avenue, N. W., between 5th and 9th Streets;
a community engagement meeting for Eureka Park Recreation Center on
December 6, 6:00 - 7:30 p.m., at the Melrose Library; and advised that
United Way has added three vibrant females to their staff, Kianna Price
Marshall as the Vice-President of Marketing and Communication, Alicia
Childress as Vice-President of Resource Development and Cheryl Mosley
as Vice-President of Community Impact.
2. Vacancies on certain authorities, boards, commissions and committees appointed
by Council.
Reappointed Jason Varney as a member of the Board of Zoning Appeals for
a three-year term of office commencing January 1, 2023 and ending

Dear Mr. Mayor,Ms. Vice Mayor and Members of Council:
I write to request that that the entirety of Legislative Priority A6 be stricken from the City of
Roanoke Legislative Program for 2023. My concerns are both procedural and substantive.
Although most of you know me, I will first introduce myself. I lived and practiced law in the City
of Roanoke for over 40 years. I retired June 30,2022,but continue to live in the City. I serve on the Trust
Subcommittee of the City's Equity and Empowerment Advisory Board and chair its Workgroup 1 which
has the responsibility of working with Roanoke Police Department to help it regain trust with the City's
Black and Brown citizens.
I am a U.S. Army veteran first serving overseas in the Military Police Corp and then as a Special
Agent in the Army's Criminal Investigation Division at Ft. Meade,Maryland. CID is the Army's
equivalent of the FBI.We had two FBI agents in our field office.I have also been active in working to
prevent gun violence later in my career.
I served four years on the American Bar Association Standing Committee on Gun Violence
including on its leadership team, rotating off the committee in September 2021. I have organized
continuing education programs about gun violence for ABA members and also a joint program with the
National District Attorneys Association about the gun diversion program in Minneapolis and Hennepin
County,Minnesota that is described in the attachment to this email. I was on a team that planned the
argument and edited the U.S. Supreme Court Amicus brief filed by the ABA in the Bruen case dealing
with New York's concealed carry law that was decided by the Court last term.
I know something about the issue of gun violence and strongly support evidence-based efforts to
curb it.
My procedural concerns about Legislative Priority A6 are that it directly implicates the
Interwoven Equity provisions in Roanoke's City Plan 2040 adopted by City Council, and yet it is
reported Council did not discuss how some of the matters included in Priority A6 might conflict with the
principles of equity expressed in the Plan. I suggest that if people with a broader viewpoint had been
brought into the discussion from the beginning it likely would not have been necessary for me to raise
these issues now.
My substantive concerns are that Priority A6 is sweeping in scope,but yet does not contain
evidence-based proposals directed at reducing the major probletri-gun crime m Roanoke.
The EEAB,the Trust Subcommittee, and the work group I chair have not discussed Legislative
Priority A6 and I am not writing on their behalf,but I will give a few examples of substantive concerns
that I personally have.
The proposals should be evidence based. It does not appear that they are. For example,I question
how-snaking jay walking a primary offense will reduce violent crime in the City.If there is data that

supports such an unlikely conclusion, I would have hoped Council would explore that nexus before
approving such a proposal. It does not appear that was done.
Making a broken tail light a primary offense only feeds into the widespread criticism of law
enforcement that it wants to make"driving while Black"an offense. Again,if having a broken tail light is
somehow an indicator of a violent criminal,I would have hoped Council would ask for data to support
such an unlikely conclusion.
Requesting the roll back of no-knock warrants that are"high risk" is problematic. It can directly
impact a lack of trust by all citizens in the police department,particularly when things go badly.A
suspect who is high risk is likely armed.Breaking into the home of a high risk suspect, often when dark,
is extremely dangerous and may lead to gunfire. Things can go wrong, and do. Louisville found that out
when Louisville police broke into the home of Breonna Taylor,killing her. That resulted in more than 100
days of protests on city streets, sustained negative comments about Louisville in the national media,and
a court settlement of$12 million plus court ordered reforms to Louisville police practices and procedures.
Was Roanoke City Council apprised of these risks before it approved such a provision?Was a
litigation risk assessment conducted before voting to include this provision?What is the police response
plan for long-term,massive protests in the streets of Roanoke?What would such protests do to
Roanoke's reputation as an"Ali American City"?It appears these and other questions were not explored
by Council before it approved such a provision. It was reported there was no discussion.
Was there any discussion about the reason City Council would want to remove the authority of
judges in sentencing?That would seem to be something worth talking about,yet it appears Council did
not do so. That's what was reported.
These and other significant issues bear directly upon the lack of trust by Black and Brown citizens
in the Roanoke Police Department and I submit conflict with Roanoke City Plan 2040 and the work of
the EEAB. It seems clear to me a great deal more thought needs to be put into these issues,and Council
needs to be more fully briefed,before including any provision of A6 in the City's legislative priorities.
If Council wishes to include evidence-based proposals to reduce gun violence in its legislative
package for next year, I can make recommendations. If Council wishes to learn more about the approach
that has reduced gun violence in Minneapolis and Hennepin County,Minnesota,I can likely arrange a
briefing.
As for now,I request that Council vote to strike the entirety of A6 from its 2023 Legislative
Priorities.
I request that this email be included in the record of the 9:00 a.m. December 5,2022 meeting of
Council.

ROANOKE, Va. (September 23, 2022) — ROA's "Rehabilitate Airfield Signage and
Lighting" project was recently selected as the 2022 Airports Council International
— North America (ACI-NA) Environmental Achievement Award winner for the
Environmental Improvement with Limited Resources Category.
In February 2022,ROA completed a multi-year endeavor to replace its entire airfield electrical system with new and more sustainable infrastructure.This included
replacing more than 900 fixtures,200,000 feet of airfield electric cable,and 14 Constant Current Regulators with an LED-based system to improve the Airport's
operational efficiency and reduce its overall energy consumption.
The LED system at ROA was projected to save around$7,500 per year in utility costs at then current electric rates.The reduced maintenance and bulb
replacements should save around$22,000 in materials and another$15,000 in labor annually.In addition to operational savings,ROA also realized savings by
opting to do the entire system replacement as one project,reducing costs associated with multiple design and construction initiatives.
Since the new system became operational,ROA has seen a 40%reduction in the amount of electricity used by the airfield lighting system as well as a 70%
reduction in labor hours associated with maintenance.Material waste associated with fixture repair and bulb replacement has all but vanished,eliminating landfill
waste from an annual average of 1,000 burned-out bulbs,including packaging and shipping material.
The Award was presented on Monday,September 19th at the ACI-NA Annual conference in Minneapolis, MN."Our panel of judges was particularly impressed with
the scope of this project,and the commitment to sustainability shown by replacing the entire quartz-halogen electrical system in a single project,"said Kevin
Burke,CEO and President of ACI-NA.
"This project was an innovative step toward boosting sustainability.Many airports only replace portions of the system at a time to reduce cost and operational
impact,changing fixtures but leaving existing regulators and cabling in place for instance.ROA took forward-thinking action by making an upfront investment in its
future and that of its community,"said Mike Stewart,Executive Director of the Roanoke Regional Airport Commission.
"The Airport's decision supports the City of Roanoke's Clean and Green sustainability initiatives and aligns with the Virginia Airports Sustainability Management
Plan.These changes will also create a more meaningful and immediate reduction in the Airport's energy consumption and waste generation.

Subject: State Criminal Alien Assistance Program (SCAAP) FY21 Grant.
Background:
SCAAP is administered by the Bureau of Justice Assistance Office of Justice Programs in
conjunction with the U.S. Department of Homeland Security. SCAAP provides federal
payments to states and localities that incurred correctional officer salary costs for incarcerating
undocumented criminal aliens who have at least one felony or two misdemeanor convictions
for violations of state or local law. These guidelines apply to those individuals who were
incarcerated for at least four consecutive days during the reporting period.
Considerations:
On November 3, 2022, the Sheriff's Office was awarded $15,620 in grant funding. There is no
required match for this program. In order to comply with grant requirements, all awarded
funding will be used to install a wheelchair lift in one of the transportation vehicles. This will
allow for compliance with ADA and accreditation programs.
Recommended Action:
Accept the SCAAP Reimbursement Grant described above and authorize the City Manager or
his designee to execute the grant agreement and any related documents; such documents to
be approved as to form by the City Attorney.
Adopt the accompanying budget ordinance to establish a revenue estimate in the amount of
$15,620 and to appropriate the same in an account to be established in the Grant Fund by the
Director of Finance.

Gun Violence Update November 1, 2022—November 30, 2022
Firearms
• Thirty-three (33) firearms seized in November, 349 firearms have been
seized in 2022 YTD.
Warrants Served:
• 580 total warrants served
• 155 felony warrants served
Incidents Involving Gunfire:
• On November 5th, officers responded to the 100 Block of Campbell Ave SE after hearing
a single gunshot fired. At their arrival, officers found an adult male victim with what
appeared to be a critical gunshot wound.The victim was transported to the hospital and
survived. The offender had already fled the scene, and investigation into this incident
remains ongoing.
• On November 6th, officers responded to the 700 Block of 29th St NW in referenced to a
reported gunshot wound. Upon arrival, they located an adult male victim with multiple
gunshot wounds.The victim was transported to the hospital, where he died of his
injuries. Detectives continue to work this case as it remains an active investigation.
• On November 9th, officers responded to the 1100 Block of Pilot St NW in reference to an
individual being shot. Upon arrival, officers located an adult male suffering from a non-
life-threatening gunshot wound.The victim was transported to the hospital, and denied
knowing the identity of the offender, who had already fled the scene by the time police
arrived. Investigation into this incident remains ongoing.
• On November 17th, officers responded to the 1100 Block of Forest Park Blvd NW in
reference to a reported gunshot wound.The victim was an adult male and had left the
scene in a personal vehicle to seek medical treatment before police arrived. Law
enforcement officers reported to the hospital to meet with the victim, who had non-life-
threatening gunshot wounds and was uncooperative with the investigation.
Investigation of this incident remains ongoing.
• November 18th, officers responded to Carilion Roanoke Memorial Hospital, where an
adult male suffering from a gunshot wound had arrived via personal vehicle seeking
care.The victim reported that he had been shot while walking in the 4800 Block of
Valley View Blvd NW. The victim denied seeing who shot him and was unsure of
important factors or circumstances of the incident. Investigation into this incident
remains ongoing.
• On November 201h, officers responded to Carilion Roanoke Memorial Hospital, where an
adult male suffering from a gunshot wound arrived seeking care. It was determined the
incident originally occurred near the intersection of 8th St SE and Church Ave SE. Despite
lack of victim cooperation, this investigation is on-going.
Firearm Related Suicide
• On November 7th, officers responded to an address in the 1600 Block of 8th St SE in
reference to a wanted subject. As the officers arrived the wanted subject retreated into
a lower area of the residence basement. When officers entered the
residence/basement,they found the wanted subject (an adult male) deceased from a
self-inflicted gunshot wound.
Prosecution / Court Proceedings:
• Our federal Task Force Officers, working with our Federal Law Enforcement partners,
were able to make several key charges this month, to include:
o Corey Lee Muse, who was indicted federally on charges of two counts of
Possession of a Firearm by a Convicted Felon, Possession with Intent to
Distribute Narcotics in excess of 500 grams, Possession of a Firearm by a Felon in
Furtherance of Drug Trafficking. Six firearms and $238,000 were seized from his
possession.
o Donovan Allen Carico, who was federally indicted with one count of Hobbs Act
Robbery, Brandishing of a Firearm in Commission of a Violent Crime, Possession
with Intent to Distribute Narcotics, Possession of a Firearm in Furtherance of
Drug Trafficking, Possession of a Firearm by a Prohibited Person. Eight firearms
and more than $40,000 were seized from his possession.
• Kai Lansana was indicted for the July 2019 murder of 24-year-old Salonya Evans.
Throughout the course of the investigation, Kai Lansana, 32 of Alexandria, VA, was
identified as a suspect in the homicide that occurred on Morehead Avenue SE. Lansana
was indicted in early November for charges of First Degree Murder, Use of a Firearm in
Commission of a Felony, and Statutory Burglary regarding this investigation. Lansana
was taken into custody in Frankfort, KY on November 9th by the U.S. Marshals Service
and held in the Frankfort County Regional Jail. He was extradited back to Roanoke,
served the aforementioned indictments and is currently in a secure facility awaiting trial.
We commend the dedication of the investigators assigned to this investigation—their
long hours, hard work, and commitment to solving this homicide brought this man to
justice. We hope this arrest brings some comfort to Salonya's family and community,
who continue to mourn her loss.
RESET Deployments for the month of November 2022:
For the month of November 2022, RESET deployed three (3) times.Those deployments
included two (2) homicides and a shots-fired incident.
We averaged four (4) volunteers and spoke to an average of thirteen (13) residents and folks
we came in contact with while in the area.

For decades, the City of Roanoke has promoted
Neighborhood Centers as important nodes in
DOWNTOWN their network of economic activity.
For the purposes of this study, four areas were
chosen from dozens of potential centers to serve
Neighborhood as test beds for revitalization. Selection was
based on a high potential for success,

considering activity drivers like traffic, residential
density, and amenities like parks. The existing
fabric of buildings and infrastructure were also
important factors.
Strategy Using the successful elements identified in the
three mature neighborhoods assessed, we
reviewed the four neighborhood centers and
outlined the most successful interventions that
can be replicated as strategies for revitalization in
other centers in the-future.

Located off Orange Avenue and nestled in the
housing areas of Harrison and Gilmer, this 3-

positioned for mixed use development already
having both commercial and residential

Background:
George Mason University has been awarded $1,483,000 through the 2022 Bureau of Justice
Assistance (BJA) Byrne Discretionary Community Project Funding/Byrne Discretionary Grants
Program. George Mason University has awarded the Roanoke Police Department a
subaward in the amount of $19,400.
The subaward will be used to conduct officer wellness checks for staff of the Roanoke Police
Department. The Roanoke Police Department will provide officers with a mandatory, mental
health check-in with a certified mental health practitioner. The subaward is for a two year time
period, with $9,700 available for each year.
Recommended Action:
Accept the George Mason University subaward described above and authorize the City
Manager or his designee to execute the grant agreement and any related documents; all such
documents to be approved as to form by the City Attorney.
Adopt the accompanying budget ordinance to establish a revenue estimate in the amount of
$19,400 and appropriate funding of the same amount into an account to be established by the
Director of Finance in the Grant Fund.

Subject: Amendment No. 3 to Contract with Freedom First Enterprises to provide all
equipment, materials, goods, labor and services necessary for providing
one-on-one financial counseling services.
Background:
The City entered into a Contract with Freedom First Enterprises on January 15, 2020, to
provide all equipment, materials, goods, labor and services necessary for providing one-on-
one financial counseling services for the Roanoke Financial Empowerment Center (FEC). The
initial term of the Contract was for one year with one additional one year renewal period, and
the Contract budget was a not to exceed amount of$227,500 for the first operating year of the
Contract.
There have been two Contract amendments to the initial Contract. For the Contract year
ending February 14, 2022, Amendment No. 1 to the Contract was granted to change the
second term expiration date from February 14, 2022, to June 22, 2022, due to the program
start not occurring until June 22, 2020, later than originally anticipated. For the Contract year
ending June 22, 2022, Amendment No. 2 to the Contract was granted on June 22, 2022, to
change the second term expiration date from June 22, 2022 to March 15, 2023, to align with
dates set forth in the "Third Amendment to Agreement Between The Cities for Financial
Empowerment Fund (the "CFE Fund") and the City of Roanoke" to implement an "Eviction
Prevention Boost Pilot Grant," and for a net amount of$56,875, increasing the Contract's
second term not to exceed amount to $284,375. The increased cost was due to the extension
of the second term of the contract.
Amendment No. 3 is now needed to increase the total amount of the second term not to
exceed amount by $93,611 for a total second term not to exceed amount of$377,986. This
amendment will allow for Freedom First Enterprises to continue to provide one-on-one
financial counseling services through March 15, 2023, and to continue to meet any additional
requirements set forth in the "Scope of Work" (Exhibit P) attached to the "Third Amendment to
Agreement Between The Cities for Financial Empowerment Fund (the "CFE Fund") and the
City of Roanoke" to implement an "Eviction Prevention Boost Pilot Grant."
Considerations:
Council approval is required for the amendment to the Contract. Funding for the Contract
amendment is available in accounts 35-C22-2603 (FEC-Eviction Prevention Boost) and 35-
310-8329 (FEC-Eviction Prevention Boost).
Recommended Action:
Authorize the City Manager or his designee to execute Amendment No. 3, approved as to
form by the City Attorney, to amend the City contract with Freedom First Enterprises for one-
on-one financial counseling services in accordance with the terms set forth in Amendment No.
3.
Authorize the City Manager or his deignee to take such actions and execute such documents,
approved as to form by the City Attorney, as may be necessary to provide for the
implementation, administration and enforcement of Amendment No. 3 to the above mentioned
Contract.

On February 18, 2020, Council passed Resolution No. 41668-021820 which authorized the
City Manager to enter into a Memorandum of Understanding ("MOU") with the United Way of
Roanoke Valley ("UWRV") for program management and funding of the Bank On Roanoke
Valley ("BORV") program.
Pursuant to the above listed Resolution and MOU, funding in the amount of $47,500 from the
UWRV is being given to the City to pay for funding of BORV for 2022-2023. In FY2022-2023,
UWRV will assess a 10 percent administrative fee ($3,000) from a $30,000 Wells Fargo grant
award that UWRV raised for BORV.
Considerations:
City Council action is needed to accept funding in the amount of$47,500 from UWRV. This
funding will fund BORV activities.
Recommended Action:
Accept the UWRV funding described above, authorizing the City Manager or his designee to
execute any documents necessary to receive such funding and to take such further actions
and execute such other documents as may be necessary to obtain, accept, implement,
administer, and use such funds. Adopt the accompanying budget ordinance to establish a

Subject: Approval of Title VI Coordinator Designation.
Background:
The Virginia Department of Transportation (VDOT) — Civil Rights Division oversees Title VI
Program Requirements. VDOT is required to conduct Title VI reviews of Local Public Agencies
(LPAs) receiving federal-aid thru VDOT in order to monitor and ensure Title VI compliance.
City of Roanoke in partnership with VDOT's Civil Rights Division is developing a Title VI
Implementation Plan.
Title VI prohibits discrimination on the basis of race, color, or national origin in programs and
activities receiving Federal financial assistance. Specifically, Title VI provides that:
"No person in the United States shall, on the ground of race, color, or national origin, be
excluded from participation in, be denied the benefits, or be subjected to discrimination under
any program activity receiving Federal financial assistance." 42 U.S.C. §2000(d).
Title VI was included in the Civil Rights Act of 1964 to establish a national policy of
nondiscrimination. LPA's are required to identify a position and designate the position as a
Title VI Coordinator. Title VI coordinators are responsible for implementing the LPA's Title VI
plans and strategies. There is a close working relationship between the City Engineer,
Transportation Manager, Director of Public Works, Purchasing Manager, Deputy Director of
Finance, Human Resources and City Administration.
Considerations:
City Council action is needed to approve the designation of the Director of Human Resources'
position to serve as the LPA's Title VI Coordinator. The Title VI Coordinator is responsible for
ensuring that all matters relating to nondiscrimination are administered effectively. The
Director of Human Resources would perform the duties of the Title VI Coordinator and ensure
implementation of the Agency's Title VI Federally Funded Transportation Program. Although
the Director of Human Resources reports to Deputy City Manager (direct supervisor), this
position shall have an indirect reporting relationship and access to the Agency
Administrator/City Manager.

As authorized by the City of Roanoke, Virginia Agency Administrator, the Title VI Coordinator
is responsible for initiating, monitoring, and ensuring LPA compliance with Title VI
