A resolution commending the services rendered to the City of Roanoke by the

A proclamation declaring Sunday, October 8, 2023 as the 40th Anniversary of
CROP Hunger Walk Day.
Vice-Mayor Cobb read and presented the proclamation to Janet Chisom,
representative, CROP Hunger Walk Day.
3. HEARING OF CITIZENS UPON PUBLIC MATTERS:
City Council sets this time as a priority for citizens to be heard. All matters will be
referred to the City Manager for response, recommendation or report to Council, as he
may deem appropriate.
1. Freeda Cathcart, 2516 Sweetbrier Avenue, S. W., appeared before the
Council and spoke with regard to the Blue Ridge Soil and Water
Conservation Board's annual report and informed the Council about flood
preparedness grant funding.
Brian McConnell, 32 Elm Avenue, S. W., #302, appeared before the Council
and spoke with regard to "Anathema" and Mental Health Crisis.
4. CONSENT AGENDA: APPROVED (6-0)
All matters listed under the Consent Agenda are considered to be routine by the
Members of City Council and will be enacted by one motion. There will be no separate
discussion of the items. If discussion is desired, the item will be removed from the
Consent Agenda and considered separately.
C-1. Request to advertise a public hearing on Monday, October 16, 2023, at 7:00
p.m., to consider the leasing of approximately 5,709 square feet of space, on
the first floor of the Church Avenue Parking Garage located at 101 Church
Avenue, S. W., to the United States Postal Service.
RECOMMENDED ACTION: Concurred in the request.
C-2. Request to advertise a public hearing on Monday, October 16, 2023, at 7:00
p.m., to consider the conveyance of Official Tax Map No. 1420326, which is the
City's remaining interest in the Belt Line, to Roanoke Southern, LLC.
RECOMMENDED ACTION: Concurred in the request.
C-3. A communication from the City Clerk advising of the resignation of Amanda
McGee as a member of the Board of.Zoning Appeals, effective November 9,
2023.

COMMENTS OF THE CITY MANAGER.
The City Manager provided a brief overview of the Strategic Plan,
highlighting the ARPA funded projects and the recent tour of the project
facilities. He advised that the strategic priorities and City Council Code of
Conduct would be presented in January 2024, and the next City Council
retreat would be held on November 3 for budget planning.

1. Inquiries and/or comments by the Mayor and Members of City Council.
Council Member Priddy announced that GO FEST would be October 13 -15
at River's Edge and the event was major economic driver for the region.
He added that he would to improve upon bike lanes in the City.
Council Member Sanchez-Jones asked for an update on kayaking in parks.
Council Member Moon Reynolds announced that Roanoke Redevelopment
and Housing Authority was recognized by the Campaign for Grade-Level
Reading and inducted into the 2023 Public Housing Communities Honor
Roll. She stated that the recognition is an acknowledgment of its
significant contributions to supporting children who live in public housing
through the Book Rich Environments program; and RRHA will be formally
honored at the National Association of Housing Redevelopment Officials,
Annual Awards Merit Reception, Thursday, October 5, in New Orleans,
Louisiana.
2. Vacancies on certain authorities, boards, commissions and committees
appointed by Council.
Appointed Brenda Allen to fill the unexpired term of office of Lori Baker-
Lloyd as a member (Citizen-at-Large/Interest or Knowledge in Historic

Reappointed Daniel Karnes as a City representative of the Blue Ridge
Behavioral Healthcare, Board of Directors for a three-year term of office

Reappointed Andrew Raduly and Meg Dorsey as members of the Board of
Zoning Appeals for three-year terms of office, each, ending December 31,
2026; and appointed Sue Ellen Agresta to fill the unexpired term of office

tangible personal property tax returns for motor vehicles, including trailers, not used or employed
in a trade or business; establishing an effective date; and dispensing with the second reading of
this ordinance by title.
BE IT ORDAINED by the Council of the City of Roanoke as follows:
1. Subsection (e) of Section 32-108, Taxpayer's return—Generally, Article III, Tax on
Tangible Personal Property Generally, Chapter 32, Taxation, Code of the City of Roanoke (1979)
is amended and reordained to read and provide as follows:
Sec. 32-108. Taxpayer's return—Generally.
(e) Any person who fails to file his tangible personal property tax return on or
before the deadline or on or before the extended deadline for the filing of
such return as established by the commissioner pursuant to paragraph(d)of
this section shall pay a penalty of ten (10) percent of the tax assessable on
such return. Provided, no penalty shall be assessed for failure to file a
tangible personal property return for a motor vehicle,including a trailer,not
used or employed in a trade or business.
2. The ordinance shall be effective on January 1, 2024.
3. Pursuant to Section 12 of the Charter of the City, the second reading of this
ordinance by title is hereby dispensed with.

Re: Proposed City Code Amendment, Section 32-108(e), Taxpayer's return—Generally, Article
III, Tax on Tangible Personal Property Generally, Chapter 32, Taxation- Removal of Late

Filing Penalty.
Section 32-108 of the City Code requires that every person that owns a motor vehicle, including a trailer not
used or employed in a trade or business, file a personal property tax return with the Commissioner of
Revenue on or before February 15 of each year, provided no such prior return has been previously filed, and
after occurrence of any of the following events: (1) a change in the name or address of the person or persons
owning such motor vehicle taxable by the city; (2) a change in the situs of such motor vehicle; (3) any other
change affecting the assessment or levy of the personal property tax on such motor vehicle for which a tax
return was previously tiled; or (4) any change in which a person acquires one (1) or more such motor
vehicles and for which no personal property tax return has been filed. Section 32-108(e) of City Code
provides for a ten percent penalty of the amount of the tax to be assessed against any owner who fails to file
their tangible personal property tax return on or before the deadline.
At the request of the Commissioner of the Revenue, I recommend City Council consider amending Section
32-108(e), Taxpayer's return Generally, of the Code of the City of Roanoke to eliminate the late filing
penalty on tangible personal property tax returns for motor vehicles, including trailers, that are not used or
employed in a trade or business. It is the Commissioner of Revenue's opinion such penalty places a burden
on the taxpayers of the City and is unnecessary, as that office is routinely informed by the Virginia Division
of Motor Vehicles whenever motor vehicles changes ownership, enabling the Commissioner's Office to
update its records accordingly for assessment purposes. Moreover, the Commissioner advises that staff time
incurred in assessing such penalties could be better utilized elsewhere, considering that the revenue
collected from such penalties each year is minor. The late filing penalty would remain in place for personal
property used in a trade or business.
A copy of the proposed ordinance amending Section 32-108(e) of the City Code is attached to this memo. If
City Council has no concerns, this matter will be placed on City Council's October 16, 2023, agenda for
consideration.

Re: Section 2-306 Gun Violence Prevention Commission, Division 2, Permanent Committees,
Article XIV Authorities, Boards, Commissions and Committees Generally, Chapter 2,
Administration,Code of the City of Roanoke(1979)
At a joint meeting of City Council and the City's Gun Violence Prevention Commission, proposed changes
to the City Code were presented to City Council.
The proposed City Code amendments seek to establish a similar review process currently utilized by the
City's Art's Commission and Human Services Advisory Board for the issuance of grants. Under the Art's
Commission's process City Council reviews the annual funding prior to the annual funding being awarded.
Currently, when the Arts Commission and the Human Services Advisory Board receive grant funding
outside of their annual funding, the final awards of the grant funds are not presented to Council prior to
award. This code amendment to the Gun Violence Prevention Commission provides that any
recommendations of annual funding made by the Commission on behalf of the City will be presented to the
City Council prior to award.
The proposed amendments seek to clarify the City of Roanoke's gun violence funding support of prevention, ;.
intervention, and response efforts and to confirm that the Gun Violence Prevention Commission review
process is aligned with other existing City Advisory Boards and Commissions. At the same time, <w
amendments are requested for the Arts Commission and Human Services Advisory Board to clarify the
current and historical process.

City Council in accordance with City Code Section 2-281. Pursuant to section 2-282, the mayor
will serve as an ex officio non-voting member of the Gun Violence Prevention Commission.
Council may appoint any member of city council, excluding the mayor.
(b) Purpose, Responsibility
The purpose and responsibility of the Gun Violence Prevention Commission shall be as
follows;
(1) Gather, review and study the issue of gun violence within the community;
(2) Make recommendations to city council for potential actions that the city may take
to reduce the epidemic of gun violence within our community and to make recommendations for
enhancing existing resources and campaigns; and
(3) Aid the city in making and developing community partnerships to assist in the
reduction of gun violence.

(4) It may make recommendations to and assist city council and the city manager in
determining what funds should be provided in the city's budget for resources to assist in the
reduction of gun violence and for the work of the commission.
(5) It may advise city council and the city manager regarding the participation in or
sponsoring by the city of performances, programs or other endeavors to assist in the reduction of
gun violence.
(6) It may seek donations, offers of services, and grants to further its projects and
activities and those of the city.
(7) For annual funding under the general fund, it shall, subject to administrative
procedures promulgated by the city manager. review applications or requests for funding made to
the city by private nonprofit agencies; advise the council as to the merits of funding the programs
of such agencies; recommend an allocation of funding to such agencies; and monitor and evaluate
the programs of such agencies.
(c) Appointment and terms of members.
Members of the Gun Violence Prevention Commission shall be appointed by city council.
The appointed member of city council shall serve only during their respective term of office.With
the exception of their initial staggered term, all other members shall serve for terms of three (3)
years. Members of the Gun Violence Prevention Commission. Other than the member of city
council, all other members shall be subject to the limitation on terms set forth in section 2-281.1.
(d) Members not compensated.
The members of the Gun Violence Prevention Commission shall serve without
compensation for their service as such members.
(e) Organization, selection of officers, meetings.
(1) At its initial meeting, the members of the Gun Violence Prevention Commission
shall elect a chair, vice-chair, and secretary. The member elected as chair shall serve as the
presiding officer at all meetings of the Gun Violence Prevention Commission. In the absence of
the chair,the vice-chair shall preside at such meeting.The secretary shall prepare agendas for each
meeting, take minutes of each meeting, ensure that proper legal notice of all meetings is provided,
and file minutes with the city clerk.All officers shall serve for terms that end on March 31 of each
year. Members may be reelected to serve as an officer without limitation.
(2) Gun Violence Prevention Commission shall adopt bylaws with respect to the
operations of the Gun Violence Prevention Commission. Such by-laws shall not be inconsistent
with the provisions of section 2-306.
(3) The Gun Violence Prevention Commission shall develop a schedule for regular
meetings on a monthly basis for each calendar year. The schedule shall include the dates and times
of each regular meeting for the ensuing calendar year. At the initial meeting of the Gun Violence
Prevention Commission in 2021, the members shall set its schedule for the balance of 2021.

(4) The Gun Violence Prevention Commission shall make at least one (1) public
presentation to city council each calendar year.The purpose of this public presentation is to update
council and the public on the progress being achieved in preventing gun violence within the
community.
(5) Special meetings of the Gun Violence Prevention Commission may be called by
the chair or by two (2)members of the Gun Violence Prevention Commission with at least twelve
(12)hours prior notice to each member, delivered in hand or by electronic mail. The notice of the
special meeting shall set forth the purpose of the special meeting and the special meeting shall be
limited to that purpose.
(6) The city manager shall appoint staff to assist the Commission in the performance
of their duties. The city attorney shall provide legal advice and assistance to the Gun Violence
Prevention Commission.
(f) Reports to city council.
The Gun Violence Prevention Commission shall make such other recommendations to city
council as the Gun Violence Prevention Commission deems appropriate. All recommendations
shall be in writing and delivered to the city clerk for inclusion the city council agenda packages.
The chair or designee shall attend the city council session at which such recommendations are
considered by city council.
2. The ordinance shall be effective upon passage.
3. The second reading of this ordinance by title is hereby dispensed with.

"Anathema!" and Our "Mental Health Crisis"
Good afternoon, my name's Brian McConnell and I'm addressing you today as a
Roanoke citizen and mental health advocate who's recently published an article
(taking 16 minutes to read) on Medium.com entitled, "Anathema! Beyond
Redemption?" which--among other matters, 'probes the impact of evolutionary
mismatch'.
More immediately though, and as we charge headlong into 2024's upcoming
Presidential election just 13 months from now--three especially crucial issues
present themselves to me as being primary to informing our respective choices
relating to both governance and leadership, or . . . (you know) a lack thereof!
In touching on just a few of the article's central points to convey a sense of the
magnitude of the "Mental Health Crisis" to which I'm alluding...:
1. . . . I cite a recent New York Post article disclosing CDC findings indicating
our youth's declining psychological and emotional wellbeing as an "ever
expanding mental health crisis".
2. As further evidence of the magnitude of suffering in this same regard,
"suicide" is now "the second leading cause of death for US children, ages
10-14".
3. Along these same lines, the article similarly cites a February White House
report coinciding with President Biden's State of the Union address urging 'a
bipartisan effort on mental health'.
4. As recently as this last July however, Dr. Rahul Gupta, Director for the Office
of National Drug Control Policy referred to the "latest CDC report" showing
"predicted overdose deaths" for the "12-month period ending in February
2023" as totaling 109,940 individuals and nearly 14 non-fatal overdoses
presenting "to the emergency department".
In this same way too, "costs associated with the (overdose) epidemic may
be as high as $1.5 trillion for the year 2020.
5. Likewise, on August 10 of this year, "the Supreme Court granted a stay" in
its Harrington v. Purdue Pharma L.P. case in response to "an emergency
request by the Biden Administration to block" the Sackler family's opioid
settlement deal of $6 billion.

Subject: Request to advertise a public hearing on Monday, October 16, 2023, at 7:00
p.m., to consider the leasing of approximately 5,709 square feet of space,
on the first floor of the Church Avenue Parking Garage located at 101
Church Avenue, S. W., to the United States Postal Service.
Background:
The United States Postal Service (USPS) has leased approximately 5,709 square feet of
space, including the mezzanine area, from the City of Roanoke in the first floor of the Church
Avenue Parking Garage for the past 24 years. The current lease ends on July 31, 2024. The
USPS desires to continue to lease the space for the operation of the Downtown Post Office
Branch. A lease extension is required to be approved and executed by the City and USPS. A
public hearing is required regarding such lease of public property for this purpose.
Considerations:
The proposed lease extension is for a five year term beginning on August 01, 2024 and ending
on July 31, 2029. The lease rate is $12.43 per square foot for a total annual rent of
$71,000. The current annual rent is $11.45 per square foot or $65,368. As part of the
requirements of USPS, the City will be required to pay a broker fee in the amount of
$10,650.00. The City will be responsible for capital and routine maintenance of the leased
premises except that USPS shall continue to be responsible for maintenance of the elevator
and shall be responsible for any improvements USPS installs after the commencement date of
the lease. USPS is also responsible for the payment of janitorial services and utility
charges. Revenue from the lease will be assigned to the Parking Fund.

This Agreement. made as of the last date written below, is between CITY OF ROANOKE ("Lessor), and Jones Lana LaSalle
Americas, Inc. ("Broker") as co-broker to Jones Lang LaSalle Americas, Inc. ("Agreement"), and confirms the terms
under which Lessor will pay a real estate brokerage commission to Broker for the lease ("Lease") between Lessor and the
United States Postal Service("Tenant")of that certain real property described as:

1. Lessor will pay Broker, and Broker will accept as its full and only compensation for services rendered in connection with the

fixed annual or other periodic bumps and/or fixed annual other periodic rent escalations occurring during the initial term of
the Lease. The Aggregate Lease Value will not include any rental abatement, operating expenses and/or real estate taxes,
any additional amounts paid by Tenant for services over and above those furnished by Lessor as part of the Lease, and
option periods and/or lease terms beyond the initial term of the Lease. In no event shall the foregoing preclude Broker from
receiving a commission for any extension, renewal, expansion or additional leasing in the event Tenant has engaged Broker
to represent it.
4. Lessor agrees that it will not modify or in any way reduce the amount of Broker's commission hereunder. If either party
institutes any action or proceeding against the other relating to the provisions of this Agreement, the unsuccessful party in
the action or proceeding will reimburse the prevailing party all reasonable expenses, attorneys' fees, and disbursements.
THE PARTIES HEREBY WAIVE TRIAL BY JURY.
5. This Agreement will continue to be in effect until the first anniversary of its full execution. If on the first
anniversary the Lessor and Tenant are still negotiating for the Lease of the subject property, to the extent not prohibited by
law,this Agreement will be automatically extended until such negotiations cease or a lease is fully executed.
6. This Agreement constitutes the entire agreement between Lessor and Broker and supersedes all prior discussions,
negotiations, and agreements, whether oral or written. No amendment, alteration, or withdrawal of this Agreement will be
valid or binding unless made in writing and signed by both Lessor and Broker. This Agreement will be binding upon the
successors and assignees of the parties.
7. Lessor and Broker each represents and warrants to the other that, in connection with Tenant's Lease of the subject
property, it has not employed or dealt with any broker, agent, or finder other than Broker. Lessor and Broker shall each
indemnify and hold the other harmless from and against any claims for brokerage fees or other commissions asserted by
any broker, agent or finder employed by Lessor or Broker, respectively, or with whom Lessor or Broker, respectively, has
dealt.
8. Lessor and Broker agree not to disclose confidential financial information on commission,or any other information having an
adverse effect on the agreement and will refrain from using the information for any other purpose than that for which it was
furnished. The parties agree that there may be a client fee share, if allowed by applicable law.
9. Each party shall be responsible to the other party only for the reasonably foreseeable direct damages caused by its breach
of this Agreement and in no event will either party be liable to the other for any loss of or damage to revenues, profits, or
goodwill or other special, incidental, indirect, or consequential damage of any kind resulting from its performance or failure to
perform pursuant to the terms of this Agreement. In no event shall Broker's liability for damages in connection with a claim
made hereunder, including any indemnification obligation arising hereunder, exceed the amount of any commission actually
received by Broker under this Agreement.
10. Each signatory to this Agreement represents and warrants that it has full authority to sign this Agreement on behalf of the
party for whom it signs and that this Agreement binds such party.

Subject: Request to advertise a public hearing on Monday, October 16, 2023, at 7:00
p.m., to consider the conveyance of Official Tax Map No. 1420326, which is
the City's remaining interest in the Belt Line, to Roanoke Southern, LLC.
Background:
City of Roanoke staff is engaged in discussions with Roanoke Southern, LLC ("Roanoke
Southern"), to acquire several permanent easements, including crossing and air rights
easements, needed by the City across Roanoke Southern's property bearing Roanoke Official
Tax Map No. 1272602X, located at 671 Brandon Avenue, and across portions of Roanoke
Southern's interest in the tract of land commonly known as the Belt Line. These easements
are needed by the City for several City projects which include the Main Street Bridge
Replacement Project and to provide access by the public across Roanoke Southern's property
interest for the public to access the Roanoke River Greenway.
Considerations:
As part of the City's consideration to be paid Roanoke Southern for acquisition of the
easements, the City has agreed to convey Roanoke Southern City-owned property bearing
Roanoke Official Tax Map No. 1420326 which is the City's remaining interest in the Belt Line.
Authorize the advertisement and the scheduling of a public hearing on October 16, 2023, at
7:00 p.m., authorizing the City Manager to enter into a purchase and sales agreement with
Roanoke Southern, LLC, that provides for the conveyance of Roanoke Official Tax Map No.
1420326 to Roanoke Southern, LLC in exchange for the easements and for other good and
valuable consideration.

Service Industry Parking Program "SIPP"
In order to achieve more equity in the City's parking system: Park Roanoke
proposes to offer a Service Provider Rate for service workers in the Downtown
Business District at the Elmwood Park, Gainsboro. Center in the Square, Market,
Campbell and Church Ave. Garages. A monthly rate will be established for those who
meet the criteria set forth in the program guidelines. attached as Exhibit A. This
program will be known as the "Service Industry Parking Program." There will be a
limit of six available spaces at the Center in the Square Garage and ten spaces at the
Market Garage to be allotted on a first come first serve basis via an online program
application. There will be no space limitations at the Elmwood Park. Gainsboro,
Campbell or Church Ave. garages.
Amend the parking rate to reflect a Service Provider Rate for unreserved monthly
parking at a 50% reduction of the current market rate for the following garages:
Elmwood Park, Gainsboro. Center in the Square. Market. Campbell and Church Ave.
Garages. for parkers who meet the following criteria: (a) currently work in the service
industry in the Downtown Business District: (b) new parker to the system: and (c) are
low to moderate income earners. Eligible parkers will need to verify eligibility at the
Park Roanoke offices twice a year. Documents to be provided shall be (a) letter from
the service industry business owner operating in the downtown business district.

Subject: Acceptance and appropriation of the State Historic Preservation Fund
(HPF) to Virginia Grant, to be used by the Department of Parks and
Recreation for the rehabilitation of the Historic Fishburn Mansion, known
as the Mountain View Recreation Center.
Background:
The City of Roanoke has been awarded a grant for the Mountain View Master Plan and
Schematic Design project. This grant funded project will provide pre-development planning
services and architectural plans to determine the best and highest use for this facility,
positioning the rehabilitation project to move forward with plans for construction. The Historic
Fishburn Mansion, known as Mountain View Recreation Center, is listed on the National
Register of Historic Places.
This is a federally funded grant through the U.S. Department of the Interior, National Park
Service passed through the State Historic Preservation Fund. The grant amount is $40,000
with a required local match of $75,000, for a total project cost of $115,000.
Considerations:
The Parks and Recreation Department would like to make the necessary renovations and
improvements to the Fishburn Mansion while maintaining the historical integrity of the building.
Recommended Action:
Accept the State Historic Preservation Fund Grant to Virginia for $40,000 for necessary pre-
development planning services for Fishburn Mansion. Adopt the accompanying budget
ordinance to establish a revenue estimate in the amount of $115,000, transfer local match
funding of $75,000 from the City Manager's Local Match Funding for Grants 35-300-9700-
5415, and appropriate $115,000 into expenditure accounts to be established in the Grant fund
by the Director of Finance.

Subject: Acceptance and appropriation of the FY2024 Department of Motor Vehicles
(DMV) Highway Safety Grant — City of Roanoke Youth Transportation
Safety Campaign.
Background:
The Virginia Department of Motor Vehicles (DMV) is the administering agency for pass-
through grant funds provided by the National Highway Traffic Safety Administration. The
Virginia DMV offers these grant funds to successful applicants for activities that improve
highway safety in Virginia. The City's Transportation Division staff has applied for this grant in
each of the past four years. Previously funded safety campaigns resulting from these annual
grant funds have been: "Every Corner is a Crosswalk"; "No Need to Speed — Together we can
make our streets a safer place"; "No Need to Speed — Keep Students Safe" and "Change
Lanes to Pass".
In 2023, Transportation Division staff submitted a fifth DMV Highway Safety Grant application
to fund an education and outreach campaign to increase the safety of Youth Active
Transportation and Recreation. The application was based largely upon recent research
results from Roanoke College professor. Liz Ackley, which found: "In 2021, Roanoke families
reported that the primary barriers to youth active commuting are safety concerns -
inappropriate neighborhood driving speeds and motorists not stopping for people crossing the
street." (Ackley, 2022) Ackley's further research findings include: "self-reported engagement
in physical activity among Roanoke city youth falls short of the recommended threshold
outlined by national guidelines and thus may be insufficient to produce important
developmental and health-related benefits" (Ackley, 2022). To begin addressing these
research findings, the Transportation Division's 2024 Roanoke Traffic Safety Campaign will
seek to improve the safety of Youth Active Transportation and Recreation by reducing barriers
to children engaging in physical activity. This campaign also has the potential to contribute to
long-term positive health and developmental outcomes.
Considerations:
The DMV approved the City's FY2024 application and awarded $200,000 in funding to
implement a citywide media and education campaign. This fifth-year safety campaign
continues the City's efforts to save lives by reducing vehicle speeds on local roads, in
residential areas, and around schools and parks, as well as by increasing driver compliance
behavior at pedestrian crosswalks. This FY2024 grant funding will allow Transportation
Division staff to hire a consultant to develop and implement the campaign plan and strategy
including material production and direct media buys. There is a required 25% match of
$50,000 associated with this $200,000 award, which will be satisfied through the DMV's Paid
Media one-to-one match requirement, where media outlets supply a comparable free spot in
exchange for every paid spot. Transportation Division staff time used to manage the safety
campaign will also count toward the grant match.
Recommended Action:
Accept the FY2024 DMV Highway Safety (Education: the City of Roanoke Youth
Transportation Safety Campaign) Grant described above and authorize the City Manager, or
his designee, to execute the grant agreement and any related documents; all such documents
shall be approved as to form by the City Attorney.
Adopt the accompanying budget ordinance to establish a revenue estimate for $200,000 in
grant revenue and appropriate funding in the same amount into accounts established by the
Director of Finance in the Grant Fund.

Middle School) to construct, install improve, operate, inspect, use, maintain, repair or replace
a water line or lines, water vault, valves, meter and other similar appurtenances together with
related improvements including slope(s) across the property to provide water service to the
property. The location of this easement is more particularly described on the attachment to this
report. Because the purpose of this easement is to benefit City-owned property, a public
hearing is not required pursuant to Section 15.2-1800 (B) Code of Virginia.
Recommended Action:

Sec. 2-306 Gun Violence Prevention Commission
(a) Established; composition.There is hereby established the Gun Violence Prevention
Commission as a permanent council-appointed board. The Gun Violence Prevention Commission
shall consist of nine (9) members, one (1) member shall be a member of city council and the
remaining eight (8) shall be residents of the city, unless such residency requirement is waived by
City Council in accordance with City Code Section 2-281. Pursuant to section 2-282, the mayor
will serve as an ex officio non-voting member of the Gun Violence Prevention Commission.
Council may appoint any member of city council, excluding the mayor.
(b) Purpose, Responsibility
The purpose and responsibility of the Gun Violence Prevention Commission shall be as
follows:
(1) Gather, review and study the issue of gun violence within the community;
(2) Make recommendations to city council for potential actions that the city may take
to reduce the epidemic of gun violence within our community and to make recommendations for
enhancing existing resources and campaigns; and

(3) Aid the city in making and developing community partnerships to assist in the
reduction of gun violence.
(4) It may make recommendations to and assist city council and the city manager in
determining what funds should be provided in the city's budget for resources to assist in the
reduction of gun violence and for the work of the commission.
(5) It may advise city council and the city manager regarding the participation in or
sponsoring by the city of performances, programs or other endeavors to assist in the reduction of
gun violence.
(6) It may seek donations, offers of services, and grants to further its projects and
activities and those of the city.
(7) For annual funding under the general fund, it shall, subject to administrative
procedures promulgated by the city manager, review applications or requests for funding made to
the city by private nonprofit agencies; advise the council as to the merits of funding the programs
of such agencies; recommend an allocation of funding to such agencies; and monitor and evaluate
the programs of such agencies.
(c) Appointment and terms of members.
Members of the Gun Violence Prevention Commission shall be appointed by city council.
The appointed member of city council shall serve only during their respective term of office. With
the exception of their initial staggered term, all other members shall serve for terms of three (3)
years. Members of the Gun Violence Prevention Commission. Other than the member of city
council, all other members shall be subject to the limitation on terms set forth in section 2-281.1.
(d) Members not compensated.
The members of the Gun Violence Prevention Commission shall serve without
compensation for their service as such members.
(e) Organization, selection of officers, meetings.
(1) At its initial meeting, the members of the Gun Violence Prevention Commission
shall elect a chair, vice-chair, and secretary. The member elected as chair shall serve as the
presiding officer at all meetings of the Gun Violence Prevention Commission. In the absence of
the chair,the vice-chair shall preside at such meeting. The secretary shall prepare agendas for each
meeting,take minutes of each meeting, ensure that proper legal notice of all meetings is provided,
and file minutes with the city clerk. All officers shall serve for terms that end on March 31 of each
year. Members may be reelected to serve as an officer without limitation.
(2) Gun Violence Prevention Commission shall adopt bylaws with respect to the
operations of the Gun Violence Prevention Commission. Such by-laws shall not be inconsistent
with the provisions of section 2-306.

(3) The Gun Violence Prevention Commission shall develop a schedule for regular
meetings on a monthly basis for each calendar year. The schedule shall include the dates and times
of each regular meeting for the ensuing calendar year. At the initial meeting of the Gun Violence
Prevention Commission in 2021, the members shall set its schedule for the balance of 2021.
(4) The Gun Violence Prevention Commission shall make at least one (1) public
presentation to city council each calendar year.The purpose of this public presentation is to update
council and thepublic o n the progress bei
ng achieved in preventinggun violence within the
p �'
community.
(5) Special meetings of the Gun Violence Prevention Commission may be called by
the chair or by two (2)members of the Gun Violence Prevention Commission with at least twelve
(12)hours prior notice to each member, delivered in hand or by electronic mail. The notice of the
special meeting shall set forth the purpose of the special meeting and the special meeting shall be
limited to that purpose.
(6) The city manager shall appoint staff to assist the Commission in the performance
of their duties. The city attorney shall provide legal advice and assistance to the Gun Violence
Prevention Commission.
(f) Reports to city council.
The Gun Violence Prevention Commission shall make such other recommendations to city
council as the Gun Violence Prevention Commission deems appropriate. All recommendations
shall be in writing and delivered to the city clerk for inclusion the city council agenda packages.
The chair or designee shall attend the city council session at which such recommendations are
considered by city council.
2. The ordinance shall be effective upon passage.
3. The second reading of this ordinance by title is hereby dispensed with.

At a joint meeting of City Council and the City's Gun Violence Prevention Commission, proposed changes
to the City Code were presented to City Council.
The proposed City Code amendments seek to establish a similar review process currently utilized by the
City's Art's Commission and Human Services Advisory Board for the issuance of grants. Under the Art's
Commission's process City Council reviews the annual funding prior to the annual funding being awarded.
Currently, when the Arts Commission and the Human Services Advisory Board receive grant funding
outside of their annual funding, the final awards of the grant funds are not presented to Council prior to
award. This code amendment to the Gun Violence Prevention Commission provides that any
recommendations of annual funding made by the Commission on behalf of the City will be presented to the
City Council prior to award.
The proposed amendments seek to clarify the City of Roanoke's gun violence funding support of prevention,
intervention, and response efforts and to confirm that the Gun Violence Prevention Commission review
process is aligned with other existing City Advisory Boards and Commissions. At the same time,
amendments are requested for the Arts Commission and Human Services Advisory Board to clarify the
current and historical process.

WHEREAS, City Council previously named a portion of the plaza between the Municipal
Building and the Commonwealth Building adjacent to 3rd Street S.W. as Henrietta Lacks Plaza;
WHEREAS, it has always been the intent of Council that a marker in honor of Henrietta
Lacks be placed in the plaza bearing her name; and
WHEREAS, a group of private individuals, lead by Council Member Trish White-Boyd,
working through the Harrison Museum of African-American Culture("Harrison Museum")worked
to raise funds to have an artist sculpt a statue of Henrietta Lacks to be donated to the City and placed
in Henrietta Lacks Plaza.
THEREFORE, BE IT RESOLVED by the Council of the City of Roanoke that it
acknowledges the following:
1. Council hereby accepts the donation of the statue of Henrietta Lacks from the
Harrison Museum.
2. Council approves the placement of the statue in Henrietta Lacks Plaza on a base
provided and installed by the City.

At a regular meeting of the Council of the City of Roanoke which was held on Thursday,
October 5, 2023, you were reappointed as a member of the Roanoke Valley Broadband Authority for
a four-year term of office, commencing January 1, 2024 and ending December 31, 2027.
Enclosed you will find a Certificate of your reappointment and two copies of an Oath or Affirmation of
Office form. Below are the next steps:
1. Please take both copies of the form to the Clerk of the Circuit Court of the City of Roanoke
to have the oath administered. It is located on the third floor of the Roanoke City Courts
Facility, 315 Church Avenue, S. W. The Clerk of the Circuit Court office will keep a copy on
file.
2. Please request from the Clerk of Circuit Court to send one copy of the Oath or Affirmation of
Office form to the City Clerk's Office.
The Oath or Affirmation of Office form must be completed prior to serving in the capacity to which
you were reappointed. The deadline to submit your oath is October 31, 2023.
Pursuant to Section 2.2-3702,Code of Virginia(1950),as amended, I am enclosing copy of the Virginia
Freedom of Information Act(transmitted via email). The Act requires that you be provided with a copy
within two weeks of your reappointment and each member is required "to read and become familiar
with provisions of the Act."
