Lea, Sr. The Pledge of Allegiance to the Flag of the United States of America was led by Mayor Lea. Welcome. ANNOUNCEMENTS: 2. PRESENTATIONS AND ACKNOWLEDGEMENTS: A proclamation declaring the week of May 19 - 25, 2024 as National Public Works Week. Council Member White-Boyd read and presented the proclamation to Ross Campbell, Director, Public Works and staff in attendance. A proclamation declaring May 2024 as Amyotrophic Lateral Sclerosis (ALS) Awareness Month. Council Member Sanchez-Jones read and presented the proclamation to Mark Kary, ALS Survivor. 3. HEARING OF CITIZENS UPON PUBLIC MATTERS: City Council sets this time as a priority for citizens to be heard. All matters will be referred to the City Manager for response, recommendation or report to Council, as he may deem appropriate. Liza Bance, 405 Allison Avenue, S. W., Apt.9, appeared before the Council and spoke with regard to the law enforcement presence downtown and hoped to increase the number of police officers on active duty in the City and their salaries. Anthony Perterson, 2750 Florida Avenue, N. W., appeared before the Council and spoke with regard to the applicants to serve on the Roanoke City School Board and expressed concern about questioning the role of the candidates. 4. CONSENT AGENDA: APPROVED, AS AMENDED. (7-0) All matters listed under the Consent Agenda are considered to be routine by the Members of City Council and will be enacted by one motion. There will be no separate discussion of the items. If discussion is desired, the item will be removed from the Consent Agenda and considered separately. C-1. Minutes of the regular meetings of Council held on Monday, April 1, 2024; Monday, April 15, 2024; recessed until Thursday, April 25, 2024; Monday, May 6, 2024; recessed until Monday, May 13, 2024; and a special meeting of City Council held on Thursday, April 25, 2024. RECOMMENDED ACTION: Dispensed with the reading of the minutes and approved as recorded. C-2. A communication from Mayor Sherman P. Lea, Sr., requesting that Council convene in a Closed Meeting to discuss the appointment of three Trustees to serve on the Roanoke City School Board, for three-year terms, each, commencing July 1, 2024 and ending June 30, 2027, pursuant to Section 2.2- 3711 (A)(1), Code of Virginia (1950), as amended. RECOMMENDED ACTION: Concurred in the request. C-3. A communication from Council Member Luke W. Priddy tendering his resignation as a Member of Roanoke City Council, effective June 30, 2024. Item was removed and considered separately. (6-0, Council Member Priddy abstained from the vote.) RECOMMENDED ACTION: Accepted resignation with regret; and received and filed the communication. C-4. Reports of qualification of the following individuals: Allison Oakey as a member of the Visit Virginia's Blue Ridge, Board of Directors to replace Anita Price for a one-year term of office commencing July 1, 2024 and ending June 30, 2025; Jeffrey Powell as a member (Public/Private) of the Youth Services Citizen Board for a three-year term of office, commencing July 1, 2024 and June 30, 2027; Robert Fralin as a member of the Roanoke Regional Airport Commission for a four-year term of office, commencing March 10, 2024 and ending March 9, 2028; Kathy Cohen as a member of the Gun Violence Prevention Commission for a three-year term of office , commencing April 1, 2024 and ending March 31, 2027; Anita Price as a Citizen-at-Large member of the Youth Services Citizen Board for a three-year term of office, commencing July 1, 2024 and ending June 30, 2027; and Niki Voudren as a member of the Mill Mountain Advisory Board for a three-year term of office, commencing July 1, 2024 and June 30, 2027. A communication from Council Member Patricia White-Boyd, Chair, City Council Personnel Committee, requesting that Council convene in a Closed Meeting to discuss a personnel matter, pursuant to Section 2.2- 3711 (A)(1), Code of Virginia (1950), as amended. CITY MANAGER: BRIEFING: FY24 Budget- April Monthly Budget Report - 15 minutes ITEMS RECOMMENDED FOR ACTION: A. Approval of the 2024 Annual Plan Update to the 2020 - 2024 HUD Consolidated Plan. Adopted Resolution No. 42933-052024. (7-0) B. Adoption of a resolution for the City of Roanoke Main Street designation. Adopted Resolution No. 42934-052024. (7-0) C. Acquisition of Real Property Rights for Stormwater Drainage Improvement Project— 3600 Block Peakwood Drive. Adopted Ordinance No. 42935-052024. (7-0) D. Acceptance of FEMA Hazard Mitigation Grant funds for acquisition, demolition and site restoration of one floodprone structure and adjacent vacant lot. Adopted Resolution No. 42936-052024 and Budget Ordinance No. 42937-052024. (7-0) COMMENTS OF THE CITY MANAGER. NONE. 2. CITY ATTORNEY: NONE. 8. REPORTS OF COMMITTEES: 1. A report of the Roanoke City School Board requesting appropriation of funds for various educational programs; and a report of the City Manager recommending that Council concur in the request. Donna Caldwell, Director of Accounting, Spokesperson. Adopted Budget Ordinance No. 42938-052024. (6-0, Council Member Sanchez-Jones abstained from the vote due to a Conflict of Interest.) 2. A report of certain Authorities, Boards, Committees and Commissions in which City Council serve as liaisons or appointees. Council Member Priddy commented that the General Assembly voted on their budget to be effective on July 1, 2024 and noted that it included an item for Roanoke from the Office of Safer Communities Program, which would bring $2.5 million in funds each year for two years to help the Police Department and school to address what is happening in the community holistically. Vice-Mayor Cobb commented that GRTC was continuing to make progress related to the finance audit corrective actions; Metroflex ridership was up 12 percent per month; and the pay scale is to be reviewed for more competitive salaries; and the stakeholders meeting would be held on June 17 at 1:30 p.m. in the City Council Chamber. 9. UNFINISHED BUSINESS: NONE. 10. INTRODUCTION AND CONSIDERATION OF ORDINANCES AND RESOLUTIONS: 1. Adoption of a resolution directing the City Attorney to petition the Circuit Court to issue an order confirming that the remaining members of City Council for the City of Roanoke are authorized to appoint a qualified voter from the City at large within 45 days of the office becoming vacant to fill the council seat vacated by Luke W. Priddy for the remaining portion of his unexpired term through December 31, 2024. Adopted Resolution No. 42939-052024. (7-0) 11. MOTIONS AND MISCELLANEOUS BUSINESS: 1. Inquiries and/or comments by the Mayor and Members of City Council. Council Member Sanchez-Jones announced May 19 - 25, 2024 as EMS Week and expressed appreciation to all Fire-EMS staff. Council Member White-Boyd reminded everyone about the PedalSafe ROA Ride of Silence event on May 21 at 6:30 p.m., to honor bike riders who have been killed or injured. Council Member Volosin announced that the Virginia Recreation and Park Society featured Roanoke's PLAY PRIDE Program on the cover of a recent issue of their magazine. Council Member Moon Reynolds advised of the recent deaths of Mrs. Altha Dowe, former school teacher and The Reverend Pusha, Pastor, Ebenezer Baptist Church. 2. W., appeared before the Council and spoke with regard to the opening of Four Truth's Recovery House in her neighborhood and expressed concerns about increased drug activity in the area. W., appeared before the Council and spoke with regard to community relations and protocol and expressed concern about the lack of notification of the opening of the Four Truth's Recovery House in the neighborhood. James McMahan, 1306 Patterson Avenue, S. W., appeared before the Council and spoke with regard to the positive effects of a recovery house in the community. Alton Akin, 1607 Red Oak Lane, S. W., appeared before the Council and expressed concern about the City's current leadership. Mary Frazier, 405 King George Avenue, S. Cobb, to execute any and all documents necessary to accept and finalize such resignation. (7-0) 2. Adopted Resolution No. 42944-052024 electing and appointing Mayor Sherman P. ROANOKE CITY COUNCIL AGENDA REPORT To: Honorable Mayor and Members of City Council Meeting: May 20, 2024 Subject: Approval of the 2024 Annual Plan Update to the 2020 - 2024 HUD Consolidated Plan. Background: The City of Roanoke receives approximately $2.5 million in funding each year from the US Department of Housing and Urban Development under the Community Development Block Grant (CDBG), HOME Investment Partnership (HOME) and Emergency Solutions Grant (ESG) programs. These funds support programs to provide affordable housing, public services, neighborhood revitalization, economic development, homelessness prevention, and services to low and moderate income people. The City's funds are often heavily leveraged with funding and in-kind support provided by the non-profit agencies that are contracted to provide those services. Each program provides for the City to recover a percentage of funding for administrative costs to manage the funds. Remaining unspent funds from the CARES Act will be completely expended under this plan. The plan includes HOME-ARP funding allocated under the American Rescue Plan Act in 2021 that are required for expenditure by 2030. The City is required to submit a five-year Consolidated Plan with a related Annual Plan to HUD for approval. The Consolidated Plan, adopted and approved in 2020, covers the years 2020- 2024 and describes the City and its overall priorities and objectives for the anticipated funds for the next five years. Each year, the City is required to develop an Annual Plan to describe the specific activities to be undertaken for the program year, which coincides with the City's fiscal year. In compliance with the City's Citizen Participation Plan and HUD requirements, a public meeting was held on November 29, 2023 to receive citizen input on development of the 2024 Annual Plan. A second required public hearing was conducted by City Council on April 25, 2024. A 30-day public comment period was properly publicly advertised in advance of the comment period from April 8, 2024 to May 9, 2024. A summary of all comments will be provided as part of the submission of the 2024 Annual plan. Considerations: The proposed HUD Annual Plan contains a budget of $4,948,890.The plan directs a majority of CDBG and HOME funds into the Belmont Fallon Target Area, supporting $1.1 million in projects and programs during the fourth full year of funding in this target area. The City of Roanoke has several vibrant neighborhood commercial centers serving surrounding residents and the city, including Grandin Village, Wasena, and Crystal Springs; 2. The council-adopted Emerging Neighborhood Centers Vision Report and Gainsboro Community Hub Concept Plan identify five potential neighborhood centers support that could anchor vibrant neighborhoods and accessible neighborhood services at Melrose Plaza, 11th Street Northwest, West End, 9th Street Southeast, and Gainsboro; 3. The adopted report identifies paths to revitalizing these small commercial districts including participation in and learning from the Virginia Main Street Network; 4. Main Street is a national model created by the National Main Street Center(NMSC), a subsidiary of the National Trust for Historic Preservation, to bring jobs, dollars, and people to small towns and urban commercial districts; 5. As a Main Street America Coordinating Program, the Virginia Main Street(VMS) program, housed in the Virginia Department of Housing and Community Development (DHCD), nurtures successful local revitalization programs across the state; 6. Background: In 2021, the City applied for VDOT Local Revenue Sharing Funds for the 3600 Block Peakwood Drive Drainage Improvements Project. In September of 2023, Council authorized the appropriation of these funds. The stormwater improvement project is to reduce residential flooding along Peakwood Drive in the vicinity of 3673 Peakwood Drive. This project will upsize the existing stormwater infrastructure in this area and add pipes and inlets to reduce the amount of runoff that reaches this location. In order to construct, operate, and maintain the proposed improvements, the City will need to acquire real property rights from one or more property owners. Considerations: City Council action is necessary to authorize the acquisition of real property rights needed for the 3600 Block Peakwood Drive Drainage Improvements Project. The real property rights needed are outlined below, but are subject to minor variation of location and extent pending final engineering design details. ROANOKE CITY COUNCIL AGENDA REPORT To: Honorable Mayor and Members of City Council Meeting: May 20, 2024 Subject: Acceptance of FEMA Hazard Mitigation Grant funds for acquisition, demolition and site restoration of one floodprone structure and adjacent vacant lot. Background: As part of the City's continued effort to maintain a flood resilient community. the Stormwater Division identifies properties with high existing flood risk to safety, structures and personal assets and provides opportunities for voluntary buyouts to property owners. In support of these efforts, the City submitted a Hazard Mitigation Grant Program (HMGP) application on April 28, 2023 to the Virginia Department of Emergency Management (VDEM) and the Federal Emergency Management Agency (FEMA) for acquisition, demolition and site restoration of one floodprone property and adjacent vacant lot (with common ownership) along Garnand Branch in the City. The grant was awarded on May 3, 2024 for a total of$210,000 in project costs funded by FEMA in the amount of $160,000, VDEM in the amount of$40,000, and a local match of $10,000. The property owner was contacted prior to submittal of the grant, and the owner expressed an interest in the program by signing a voluntary participation waiver. It is anticipated that upon acceptance of the grant, execution of agreement and appropriation of funds, that property owners would be re-engaged for acquisition discussions with the approval of City Council. Upon successful acquisition of the property, all structures on the property would be demolished and the site cleaned, graded and restored with native grass and tree species appropriate to the surrounding area. The mitigation of flood risk and restoration of these sites as floodplain assets advances the City's commitment to a safe and healthy community, harmony with nature, and a livable built environment. Considerations: City Council action is necessary to authorize the acceptance and appropriation of funds. City Council action is necessary to authorize the appropriation of local match funds. It is intended that this district be applied primarily along heavily traveled arterial streets, with an emphasis on clustering such development at major intersections. While recognizing the motor vehicle traffic generated by the uses permitted in this district, it is the intent of the regulations of the district to encourage and recognize pedestrian access and public transit forms of transportation by locating parking to the side and rear of buildings and minimizing conflict through landscaping and signage standards. The uses permitted in this district generally require a high volume of traffic along the frontage of the establishment and include horizontally oriented buildings. Such permitted uses include general retail establishments, offices, service establishments, motor vehicle related sales and service, eating establishments, and entertainment uses. The CG District is also intended to accommodate travel-oriented uses such as hotels, motels, and gasoline stations. PROJECT NARRATIVE: The Oakey's Family has been a trusted name in the funeral home business for over 150 years. In 2009, Oakey's Pet Funeral Home and Crematory (Oakey's) was established on Airport Road to serve the Roanoke Valley and the larger surrounding community. Since its establishment over fifteen (15) years ago, their business has grown as pets have continued in popularity and their personal impacts in the lives of their owners. With this continued growth, there is also additional demand for Pet Funeral and Crematory services. Oakey's has outgrown their existing building capacity and is requesting to modify the existing proffered conditions for this property to allow a small building addition and reconfigured parking area to access the facility. Oakey's is excited to request this amendment to expand their business within the City of Roanoke. JNO M. Oakey, Incorporated, is requesting to amend existing proffered condition #1. The amended condition relates to the updated development plan while maintaining the restrictions on uses and signage standards. The property will remain Commercial General (CG) as the base zoning district/classification. This request is similar to the approved zoning amendment from 2009, but with a current/modified proffer to reflect the proposed improvements. This request further redevelops existing commercial property which is a priority over rezoning new property into commercial. The parking areas are being reconfigured as shown on the development plan. The addition location is critical to match the existing operations of the facility including one larger internal space for processing/operations. This specific program of the building is all located on the Eastern side (New Addition Side) The expanded facility will contain an additional cremation unit and expanded cold-storage cooler to serve the increased demand of pet cremation services. City Plan 2040 Future Land Use map identifies this area as Commercial —Large Scale which supports the continued commercial development along with section of Airport Road and within this area. Although the project is not considered to be large scale, the commercial component and proposed expansion to an existing commercial building appropriate and supports the Land Use Guidelines for this area. The site is located within the neighborhood planning district of Airport which has a variety of uses within this planning area including commercial, high intensity industrial, office, recreational, and other existing uses. This project exemplifies many of the qualities and attributes expressed within the neighborhood plan for future projects. This project maximizes the existing commercial property in an appropriate location and provides an appropriate context and site design. The proposed use is existing and only expands the interior operations without significant exterior impacts. PROJECT NARRATIVE: Qattam Properties LLC is requesting to rezone 3906 Thirlane Road NW (Tax ID: 6520104) containing approximately 3.310 acres from RA — Residential Agricultural District to II — Industrial District with conditions for the construction of a warehouse facility for their existing business as a primary use with supporting professional office within the existing building. Qattam Properties, LLC is a wholesale distributor of products/supplies for the convenience store industry. Qattam is looking to make a significant investment in the City of Roanoke on property that they currently own but is underutilized. This request further develops industrial property in an appropriate location with the City of Roanoke. A proffered condition is included with the request that allows all Airport District Uses plus professional or general office use which are appropriate in this area, but restricts undesirable uses within the Industrial District as part of the request. Professional or General Office use which is anticipated within the existing building is excluded from the Airport District which is why the subject parcel is being rezoned to I1. The proposed warehouse building will be one-story with an approximate footprint of 28,800 sf. The improvements on-site will include new access points to Thirlane Road to support passenger car, box truck, and tractor trailer access. A small parking area will be provided for the site to serve both the warehouse building and existing building (office) for the business. The site will have typical industrial site improvements including water, sanitary sewer service, stormwater improvements, and include pedestrian improvements along Thirlane Road. City Plan 2040 Future Land Use map identifies this area as Industrial which supports the continued development along this section of Thirlane Road and within this area. The industrial improvements proposed are in keeping with the adjacent area and the priorities set forth by the Lane Use Guidelines for this area. The site is located within the neighborhood planning district of Airport which has a variety of uses within this planning area including commercial, high intensity industrial, office, recreational, and other existing uses. This project exemplifies many of the qualities and attributes expressed within the neighborhood plan for future projects. This project utilizes an existing office building while expanding on-site with proposed warehouse operations in an appropriate location and provides an appropriate context and site design. Alam and K. Kronau absent, the Architectural Review Board adopted the proposed amendments. Background: In Old Southwest, 22 buildings were razed in one year during the 1970s. A non-profit organization, the Old Southwest Neighborhood Alliance, formed that decade to protect the neighborhood. In 1985, the National Park Service listed the Southwest Historic District in the National Register of Historic Places and the Commonwealth of Virginia created a parallel listing in its Virginia Landmarks Register. The historic district is roughly bounded by Salem Avenue, Jefferson Street, the Roanoke River, and 20th Street. In 1987, in response to community interest in preserving the district's historic landscape and following a public process, City Council adopted the H-2 Overlay District. The overlay district originally included all of the Old Southwest, and portions of, the Mountain View and Hurt Park neighborhoods. A portion of the Gainsboro neighborhood was later added to the overlay district. In 1979, City Council established the Architectural Review Board (hereafter ARB) with the stated purpose of protecting designated historic properties against destruction or encroachment of architecturally incompatible buildings and structures within the H-1 District. In 1987, City Council expanded the board's responsibility to include the new H-2 Historic Preservation District. The goals of design review by the ARB are: 1 • to ensure that work on historic buildings preserves architectural features and historic character, • to ensure that new construction is compatible with existing nearby and adjacent buildings, and ■ to pursue all alternatives to demolition of important buildings. Every year, the ARB reviews many applications in administering the historic district regulations adopted by City Council, as they pertain to the city's H-1 and H-2 Historic Districts. In 2023, the ARB reviewed 52 applications: 41 were approved and Certificates of Appropriateness issued, six were denied, and five were withdrawn. In addition, the ARB Agent reviewed and approved 119 Certificates of Appropriateness. The existing H-2 Architectural Design Guidelines (hereafter Guidelines) were adopted September 13, 2007 and most recently updated in 2011 . City Plan 2040 calls for the review and revision of the Guidelines to improve clarity and respond to new technologies and materials. Planning staff and the ARB developed the proposed amendments in multiple work sessions in recent months after review of the Secretary of the Interior Standards for Rehabilitation, multiple design guidelines from other municipalities in the Commonwealth of Virginia, and past ARB case history. The ARB briefed City Council at its March 4 joint meeting and both bodies indicated support for continuing the process. The ARB initiated consideration of the proposed amendments to the Guidelines by motion at its regular meeting on March 14, 2024. Considerations: In 2020, City Council, after a multiple year public process, adopted City Plan 2040 as the City's comprehensive plan. Preserving culturally, historically, and architecturally significant buildings and sites remains a key element in how to grow our community through preservation and context sensitive design. The plan also recommends review and revision of the Architectural Design Guidelines to improve clarity and respond to new technologies and materials. The proposed amendments make changes to four sections of the Guidelines: 1 . Working with the ARB: Aligns the Guidelines with the current timing and process. 2 2. Windows and Doors: Removes the requirement that windows be missing or beyond repair for replacement and allows replacement based on deterioration, clarifies the documentation required in a replacement request, and clarifies character defining windows should be retained. 3. Roofs: Removes the requirement that the roof be beyond repair, clarifies the documentation required in a replacement request, clarifies hidden gutters should be maintained, recommends the use of half-round and ogee gutters with round downspouts, adds additional replacement materials for pressed-metal shingle roofs, clarifies the recommended type of asphalt shingles, and clarifies roofing details to remain. 4. Alternative Energy: Clarifies solar panels are allowed on all structures as specified in the Guidelines. Public Outreach and Comment: The proposed changes were posted on the City's ARB page and sent out via Civic Send on February 25`h. Staff held one open house meeting at the Fishburn Mansion on March 6`h and presented the same information at four neighborhood meetings in March to communicate the proposed changes to the Guidelines. A summary of the comments received is attached. Following the open house and presentations at neighborhood meetings, planning staff and the ARB reviewed the public input and determined that the amendments to the Guidelines as proposed are the best next step as they allow an easier process for work on windows, doors, and roofs and allow additional materials and placement of materials in appropriate locations. Additional items of concern are best addressed outside of the Guidelines through additional outreach, education events, and allowing staff approval for additional items. Public Hearing: Public comment was received in favor and opposition of the proposed amendments to the Guidelines. The comments in favor noted that these changes are positive and allow property owners to make changes more easily to their property. The comments opposed requested allowing solar on all south facing facades, additional time to include more citizen comments, and the desire for additional allowances for sides and rears of buildings, and consideration of historic value of particular properties on Patterson Avenue in the review process. 3 The ARB discussed the comments, stating that the Board reviewed all of the citizen comments and think the amendments as proposed are appropriate as they streamline the process, address concerns regularly seen, and already allow solar installations to be considered on the south-facing facades. Conclusion: The ARB approved the proposed amendments to the Guidelines to improve clarity, respond to new technologies and materials, and allow an easier process to work on particular building elements, while ensuring that such work preserves architectural features and historic character.
