Council meetings are offered with closed captioning for the deaf or hard of hearing. 1. CALL TO ORDER - ROLL CALL. Council Members Priddy and Sanchez-Jones were absent. The Invocation was delivered by Major Christina Trayntham, Salvation Army. The Pledge of Allegiance to the Flag of the United States of America was led by Mayor Sherman P. Lea, Sr. Welcome. ANNOUNCEMENTS: 2. PRESENTATIONS AND ACKNOWLEDGEMENTS: A proclamation declaring the week of June 23 - 29, 2024, as Employee Safety Week. Mayor Lea read and presented the proclamation to Nichole Gibson, Manager, Risk Management. Ms. Gibson introduced the Department staff in attendance. Recognition of the All-America City Delegation Team and Award. Carol Cobin, Communications and Community Engagement Specialist; Katie Hedrick, Assistant to the City Manager, and the Delegation Team introduced themselves and recanted their experience at the All-America City Delegation presentation. 3. HEARING OF CITIZENS UPON PUBLIC MATTERS: City Council sets this time as a priority for citizens to be heard. All matters will be referred to the City Manager for response, recommendation or report to Council, as he may deem appropriate. Alicia Grubb, 1412 Campbell Avenue, S. W., appeared before the Council and spoke with regard to the process of selecting an Interim City Council Member, noting that she hoped the Council chose someone who worked hard and lives in Roanoke. Brian McConnell, 32 Elm Avenue, S. W., Apt. 302, appeared before the Council and spoke with regard to government transition. Chloe Johnson, 2730 Massachusetts Avenue, N. W., appeared before the Council and spoke with regard to shade canopies in City parks to gain greater use of the parks and suggested the formation of a committee to look into the matter. Owen McGuire - 2514 Brambleton Avenue, S. W., appeared before the Council and spoke with regard to the Fishburn Park cottage and expressed concern with what was happening on the property. 4. CONSENT AGENDA: APPROVED, AS AMENDED. (5-0) All matters listed under the Consent Agenda are considered to be routine by the Members of City Council and will be enacted by one motion. There will be no separate discussion of the items. If discussion is desired, the item will be removed from the Consent Agenda and considered separately. C-1. A communication from Mayor Sherman P. Lea, Sr., requesting that Council convene in a Closed Meeting to discuss the selection of a candidate for the Interim City Council Member position, pursuant to Section 2.2-3711 (A)(1), Code of Virginia (1950), as amended. RECOMMENDED ACTION: Concurred in the request. C-2. A communication from the City Clerk advising of the resignation of Karl Willers as a member of the Roanoke Arts Commission, effective immediately. RECOMMENDED ACTION: Accepted the resignation and received and filed the communication. C-3. Report of qualifications of Dr. Lydia Pettis Patton as Interim City Manager for the City of Roanoke, Virginia; and Ilsa Saavedra-Rogan as a member of the Equity and Empowerment Advisory Board to fill the unexpired term of office of Auraliz Quintana ending December 31, 2026. RECOMMENDED ACTION: Received and filed. C-4. A communication from the City Attorney requesting that Council convene in a Closed Meeting to consult with legal counsel regarding a certain legal matter requiring the provision of legal advice by the City Attorney, pursuant to Section 2.2-3711 (A)(7), Code of Virginia (1950), as amended. RECOMMENDED ACTION: Concurred in the request. REGULAR AGENDA: 5. PUBLIC HEARINGS: NONE. 6. PETITIONS AND COMMUNICATIONS: 1. A report of the Roanoke City School Board requesting appropriation of funds for various educational programs; and a report of the Interim City Manager recommending that Council concur in the request. Vice-Mayor Cobb announced that the summer library programming and the parks and recreation kids PLAY guide were excellent sources of summer activities for children. Mayor Lea announced the Horton Hoops Program in Horton Park has already begun, but will last through August and has been well attended. 2. E., appeared before the Council and spoke with regard to how gun violence has affected her family since 1981, and how she wants to be an effective change agent in the City of Roanoke. Brandy Campbell, 909 Piedmont Street, S. E., appeared before the Council and spoke with regard to Gun Violence Awareness Month, the untimely death of her brother by gunfire and the many resources Carilion has for grief care. Victor Banks, 2604 Springhill Drive, N. W., appeared before the Council and spoke with regard to the Melrose Athletic Club and Champs Gym who have produced many great boxers at the State and local levels. Alton Akin, 1607 Red Oak Lane, S. A RESOLUTION concurring with and approving the recommendations of the Roanoke Arts Commission's("Arts Commission")allocation of City funds to various nonprofit agencies for Fiscal Year 2024-2025. WHEREAS,the Fiscal Year 2024-2025 budget approved by City Council for the Roanoke Arts Commission provides for funding in the amount of$336,500; WHEREAS, in order for nonprofit agencies to obtain an allocation for such funds, it was necessary for such agencies to file applications with the Arts Commission Agency Funding Advisory Committee; WHEREAS, requests for City funding in the total amount of$570,247 were received by the Committee from 30 agencies; and WHEREAS, after studying each application and holding rating and allocation meetings, the Committee recommended and the Arts Commission approved allocation of funding in the amount of $336,500 to such agencies and the Arts Commission for Fiscal Year 2024-2025, subject to City Council approval. ROANOKE CITY COUNCIL AGENDA REPORT To: Honorable Mayor and Members of City Council Meeting: June 17, 2024 Subject: Recommendations of Roanoke Arts Commission for Funding of Qualified Agencies for Fiscal Year 2024-2025. Background: The Roanoke Arts Commission Agency Funding Advisory Committee budget, in the amount of $336,500, was established by City Council with the adoption of the General Fund budget for FY 2023-2024 on May 13, 2024. A pre-proposal meeting was held on December 1, 2023 to assist the agencies and organizations with the application process. Applications that included procedures and ratings criteria were made available to all former recipients and other interested organizations. Applications from thirty (30) agencies totaling $570,247 were received as indicated on Attachment A. These agencies each applied for funds to support specific exhibitions, performances or educational programs. Funding is available to fund approximately 60% of the requested amount. Committee members thoroughly studied each application, interviewed representatives of the applicant organizations, and individually scored applications prior to an allocation meeting held on April 9 and 11, 2024. Through the application, organizations are required to demonstrate how their proposal would support implementation of the City's Arts and Cultural Plan or City Plan 2040. Agencies were also rated on other indicators such as effective management, financial health, collaboration, equity efforts, and if the proposed program meets a need in the community. The committee also considered the reports from quarterly organizational updates on the past year's grants and monitoring visits by Douglas Jackson, Arts and Culture Coordinator, and committee members Helen Dean and William Penn. The committee presented the recommendations to the entire Roanoke Arts Commission and these recommendations were unanimously approved on April 16, 2024 to present to City Council as attached. Agencies were then notified of the Arts Commission recommendations and tentative funding allocations, subject to final approval by City Council. Organizations that were not awarded funds were determined ineligible through the application process. Where possible, the organizations are being supported through other resources such as participation in the Arts Connect Neighbors Program and the Arts and Culture Coordinator is providing support to increase chances for eligibility in the 2026 funding cycle. Considerations: The funding criteria by which applications are scored also reflect the major priority areas established by City Council and the community through the arts and culture and comprehensive planning processes. Recommended Action: Concur with and approve the Roanoke Arts Commission's allocation for funding various nonprofit agencies for fiscal year 2024-2025 as set forth in Attachment A to this report. Background: In FY24, the City advanced community goals through strategic arts-based investments including the "Arts Connect Neighbors" program. Funded through the City of Roanoke and the National Endowment for the Arts (NEA) the effort provides resources to local artists and arts organizations to structure arts-based services for neighborhoods. The 50 offerings are currently available to neighborhoods through an online and paper catalog that promotes the host of ways the arts can help connect us across our neighborhoods and foster stronger places. The program pays the artists and arts organizations to provide the services selected. Because payments will be made directly to the vendor, the resources can support and encourage activity in less formally organized neighborhoods. The effort is in partnership with Neighborhood Services and the Roanoke Cultural Endowment. A sample of services might include: • An interactive dance performance for a block party. • A poetry or photography workshop bringing neighbors together to study their place and create and share art about it. • A muralist who helps a neighborhood identify a wall and create a design to energize the street. Additional funds are available for neighborhood organizations or teams to undertake "next step" projects, building upon the introductory successes of their engagements. Midway through the first year of the program, a second NEA grant allows expansion of the program to additional civic partners, artists, and neighboring communities, while providing more resources to continue working in Roanoke neighborhoods. Considerations: The funding recommendation by staff for the project totals $100,000. The NEA grant will support the project in the amount of $50,000. The grant requires a one-to-one match and payments will be made on a reimbursable basis. Matching funds in the amount of$50,000 will come from the city's matching fund. The funds for this project will be used to hire artists and arts organizations to engage with City staff, neighborhood stakeholders, property owners and residents in developing early stage art- based projects, events, actions, artwork, and conversations that help capture and communicate the potential of neighborhood participation and action. Background: The Hidden Histories committee, a group of volunteers under the fiscal agency of the Harrison Museum of African American Culture and the leadership of Council member Trish White-Boyd, raised funds to commission a sculpture of Henrietta Lacks, which is now sited in Lacks Plaza at 410 3rd Street, SW. More than 270 individuals, families, businesses, and institutions contributed to the effort. Henrietta Lacks was born Loretta Pleasant in Roanoke, Virginia, on August 1, 1920. Mrs. Lacks was the source of the HeLa cell line that has been critical to countless advances in medicine, saving and extending the lives of people around the world. Henrietta Lacks passed away on October 4, 1951, and today her cells continue their monumental contribution. In Virginia, October 4 is now recognized as Henrietta Lacks Day. On October 4, 2023, hundreds of people attended the unveiling of the sculpture by local and regional artists Bryce Cobbs and Larry Bechtel. Considerations: Any gift of art to the City must be considered for addition to the City's Public Art Collection. The collection is managed by the office of Arts and Culture under the leadership of the Roanoke Arts Commission and the Department of Planning, Building, and Development. Maintenance requirements, longevity, and suitability are considered. Works are added to the public art collection through the acceptance by vote of the Roanoke Arts Commission for works valued under $5,000, or by vote of City Council for works above $5,000. The Henrietta Lacks sculpture is valued at the commission price: $107,000. This limitation had the effect of excluding other types of housing and limiting housing options; WHEREAS,localities across the United States have been working to amend zoning district regulations that limit uses to single-family residential uses. These localities have concluded that single-family residential districts constrict the supply of housing by excluding other types of housing, contributing to a shortage of housing. In addition, these localities have considered that zoning districts limited to single-family residential uses are a persisting legacy of racial and economic segregation; WHEREAS, the City Plan 2040, adopted by the City Council in 2020, called for new policies that would allow a range of housing options in all residential zoning districts; WHEREAS, on March 18, 2024, and following a public hearing, the City Council adopted zoning amendments to improve the availability of housing and housing alternatives, and to address 1 concerns related to the effects of district regulations that allow only single-family residential uses, as set forth in Ordinance No. 42902-031824 (the"March 18 Ordinance"); WHEREAS, the March 18 Ordinance amended the text of the City Zoning Ordinance, including the text of the district regulations for residential districts. The March 18 Ordinance did not amend the Official Zoning Map, nor did the March 18 Ordinance change any district boundaries; WHEREAS, a primary effect of the March 18 Ordinance was to allow for residential uses in residential districts,by right, in addition to single-family uses; WHEREAS,the City Council's adoption of the March 18 Ordinance followed the Planning Commission's March 11, 2024 public hearing; WHEREAS, following the March 11, 2024 public hearing, on that same day the Planning Commission deliberated and recommended adoption of the March 18 Ordinance; WHEREAS, the City Council's adoption of the March 18 Ordinance was also preceded by years of study and review by the Planning Staff; WHEREAS, the Planning Staff had briefed the Planning Commission on its progress regarding the March 18 Ordinance amendments in two Planning Commission work sessions; WHEREAS, in addition to the March 11, 2024 and March 18, 2024 public hearings referenced above, there was extensive community engagement and opportunities for public participation related to the March 18 Ordinance, including: a dozen open house sessions held at City libraries; a virtual meeting; and an online survey. Background: City Council adopted amendments to the zoning code on March 18, 2024, to improve and enhance equity and housing. The March 2024 zoning amendments required extensive study and review by City Council, the Planning Commission, and staff. The review process included opportunities for public comment and input. The 2040 City Plan, adopted in 2022, addressed the need for zoning revisions. After City Council adopted the 2024 zoning amendments, a lawsuit was filed in Roanoke City Circuit Court challenging certain procedures taken during the adoption process. Although the City believes that the proper procedures and process were applied, it is more efficient to repeal and then readopt the proposed text amendments than to litigate this matter in the courts.
