ANNOUNCEMENTS: 2. PRESENTATIONS AND ACKNOWLEDGEMENTS: Presentation by Council Member Sanchez-Jones on an official trip to Sister City, St. Lo. France, from May 31—June 7, 2024. Council Member Sanchez-Jones and several others highlighted information and presented paintings to the City from her recent trip to St. Lo, France. 3. HEARING OF CITIZENS UPON PUBLIC MATTERS: The City Council sets this time as a priority for citizens to be heard. All matters will be referred to the City Manager for response, recommendation or report to the Council, as he may deem appropriate. Brenda Allen, 12 Gilmer Avenue, N. E., appeared before the Council and expressed opposition with regard to the transferring of the deed for a parking lot to the Roanoke Higher Education Center for complimentary student parking spaces. Cathy Carter, appeared before the Council and spoke with regard to the Gainsboro community and asked for an update to the Gainsboro plan. Bailey Medeirs Helgeson, 313 Luck Avenue, S. W., appeared before the Council and expressed gratitude for the opioid abatement awareness partnership. Barbara Duerk, 2607 Rosalind Avenue, S. W., appeared before the Council and asked if the Council-Appointed boards and commissions could conduct meetings in the evenings for public convenience. Mar Strong, 1021 Brandon Avenue, S. W., appeared before the Council and spoke with regard to the opioid abatement funding. Tyler Breeding, 5132 Cantor Drive, S. W., appeared before the Council and spoke with regard to the need for bike lanes and protection for cyclists. 4. CONSENT AGENDA: APPROVED (6-0) All matters listed under the Consent Agenda are considered to be routine by Members of the City Council and will be enacted by one motion. There will be no separate discussion of the items. If discussion is desired, the item will be removed from the Consent Agenda and considered separately. C-1. Minutes of the regular meeting of City Council held on Monday, August 5, 2024. RECOMMENDED ACTION: Dispensed with the reading of the minutes and approved as recorded. C-2. A communication from Council Member Patricia White-Boyd, Chair, City Council Personnel Committee, requesting that the Council convene in a Closed Meeting to discuss a personnel matter, pursuant to Section 2.2-3711 (A)(1), Code of Virginia (1950), as amended. RECOMMENDED ACTION: Concurred in the request. C-3. A communication from the City Attorney requesting that the City Council convene in a closed meeting to consult with legal counsel regarding actual litigation, where such consultation or briefing in open meeting would adversely affect the negotiating or litigating posture of the public body, pursuant to Sec. 2.2-3711 (A)(7), Code of Virginia (1950), as amended. Dr. Patton shared the following comments: Welcoming Week will be held on September 17; a tour of the Municipal Building at 10:00 a.m. On Thursday, September 19, a job fair will be held at 10am at the Main Branch Library; and on Friday, September 20, a citizen celebration will be held at 10:00 a.m., in the Council Chamber. The Virginia Department of Transportation will hold a public hearing on the Orange Avenue Improvements on Thursday, August 22, 5:00 p.m. - 7:00 p.m., Bonsack Elementary School, 5437 Crumpacker Drive, Roanoke, Virginia 24019. The Envision Williamson Road Project is extending the current phase to ensure focus groups are held in the month of September. The Gainsboro Branch Library will host its Women's Equity Day on Monday, August 26, 11:00 a.m. — 1:00 p.m., in the Virginia Y. Lee Room. The Summer Point in time count has been finalized and presented to the Blue Ridge Interagency Council; 342 persons were indicated as homeless, a 15 percent decrease in individuals since the January point in time count. The Eureka Park Recreation Center groundbreaking will be held on Thursday, August 22, at 9:30 a.m., at Eureka Park. The Interim City Manager's and City Clerk's Offices are currently scheduling the Council members two by two tours of City departments. 2. CITY ATTORNEY: None. 8. REPORTS OF COMMITTEES: 1. Council Member Sanchez-Jones commented that in waiting for hurricane Debby to arrive, she visited the City's floodprone areas and acknowledged that City employees had already barricaded most locations and were prepared for the storm. Vice-Mayor Cobb thanked all City employees for their preparedness for storms and daily efforts in providing city services. 2. SEPTEMBER—2023 Adopted a resolution consenting to the separation of two revenue bond issues in the Valley to enable the sale of various assets of Richfield Living. Received a Grant Update presented by Ms. Erin Burcham, President of VERGE. Received a report from Curtis Thompson, representing Business Seed Capital, Inc, on the proposal by the City of Roanoke to establish an Affordable Housing Loan Fund, which is currently under review by the City Attorney OCTOBER—2023 Approved a Facade Grant in the amount of up to $25,000 for improvements to the Colony House Motel at 3560 Franklin Road, S.W. 2 Approved a proposal to participate for up to five (5) years, with Roanoke County and the City of Salem in a retail development study at a cost to the Authority of not-to-exceed $30,000 each year. Received a report from Chris Chittum, Assistant City Manager, on the City's proposal to create with TAP a low-interest loan fund to assist in the development of affordable workforce housing in the City. NOVEMBER—2023 The Authority at its November 15, 2023, meeting accepted the Brown Edwards FY 2023 Audit. Received a report from Lucas Thornton on the Campbell Court Project. FEBRUARY—2024 The Authority adopted its Resolution Authorizing Second Amendment to the Riverdale Performance Agreement. MARCH—2024 Amended the Authority's Policy on Remote Participation to expand the use of remote participation at Authority meetings. Approved a Facade Grant in the amount of $19,644.66 for Franco's Frackin' Freedom, LLC (Global Metal Finishing) for facade improvements at 3646 Aerial Drive, (TM # 5220505 (Ms. Franco having left the meeting and not participating in the discussion or the vote). Determined to move some of the Authority's fund investments on the staff recommendation based on direct experience and the recommendation of Evelyn W. Powers, Treasurer of the City of Roanoke, to the John Lewis Group at Rockefeller Capital Management. APRIL—2024 Heard in closed session a proposal to develop a commercial facility for a proposal concerning a prospective business or industry where no previous announcement had been made. MAY—2024 Approved a Facade Grant Report. Approved a Facade Grant in the amount of$25,000 for Kalyan Hospitality and Roanoke Star Hotel, LLC d/b/a Spark by Hilton for property located at 3695 Thirlane Road (TM # 6530102), pending admission into the Enterprise Zone,. 3 Received a report regarding the City's and Business Seed Capital, Inc.'s agreement to make low interest loans available to developers willing to set aside affordable housing in ongoing projects. Received a report of a potential economic development grant to a bio-tech company as an incentive to locate a production facility in the City. JUNE—2024 The Authority adopted its Resolution to donate $225,000.00 to the Roanoke Workforce Housing Development Fund. The EDA looks forward to continuing its close partnership in economic development with the City of Roanoke and stands ready to work as a full economic development partner with other members of the City's team. Mr. Bryan Musselwhite completed his term and stepped down from the Board, and the vacancy was filled by Mr. Robert Logan in January 2024. One vacancy on the Board of Zoning Appeals remains. The University values the mission of the higher education center and supports their efforts to secure additional free student parking as the volume of students continues to grow. The successes of RHEC in meeting the growing educational and developmental needs of the citizens of Roanoke and the region have created a need for additional free parking for students. In 2023, Radford University expanded its lease agreement with RHEC to better meet the high demand for Registered Nurses in Roanoke and the region. Thus, making the University the largest lessee in the facility. This significant expansion will increase the number of students, this fall, to approximately 220 which will place a strain on available parking for students. RHEC provides students free parking access by the facility, in lots managed by RHEC. However, this parking is on a first- come-first- served basis and the number of spaces is limited. When the lots are full, students are forced to seek other parking alternatives which can be costly over time. We currently operate 11 of our Roanok-based education and workforce development programs out of the facility. We have applied for a federal grant to add an additional program to those offerings at the RHEC.The new program, if funded,will serve about 40 students per semester and may require additional parking. In addition to the new program,we hope to expand our on-location offerings by providing Project Discovery workshops (currently provided in local schools) at the RHEC to attract home schoolers who are requesting services; and our Girls United project that serves juvenile-justice referred girls (also provided currently in local schools) at the RHEC. We are projecting serving approximately 30 additional students through these two classes who may need parking. Finally, we are in negotiations with a local college to offer nurse aide training to their students on- site at the RHEC. Background: The Department of Criminal Justice Services of the Commonwealth of Virginia distributes funding directly to local law enforcement agencies through the Byrne Justice Assistance Grant Program. The Justice Assistance Grant Programs fund many types of initiatives and are intended to improve Police Officer safety. On June 28th, 2024, the Department of Criminal Justice Services awarded the City of Roanoke $55,630 in grant funding. The application for the grant specified that the Police Department would receive $55,360 to fund the procurement of equipment that will aid in the safety of officers by minimizing the potential for injury. The equipment includes a kinetic breaching tool, under the door camera, and a small throw robot. The grant funds will also allow for the procurement of eight additional Flock Cameras that will assist with surveillance in high crime areas and help in the capture of violent offenders. Background: Major opioid settlements have resulted in payments being made to the Commonwealth of Virginia and its localities. The Office of the Attorney General worked with local government attorneys and counsel to craft a Memorandum of Understanding (MOU) describing how to allocate opioid settlements. The agreement includes a formula for distributing the proceeds based on a measure of harm per capita to communities across Virginia. All 133 counties and cities in the Commonwealth signed this MOU and the City of Roanoke receives direct distributions of the opioid settlements based on this formula. The Virginia Opioid Abatement Authority (OAA) was established by the Virginia General Assembly in 2021 as an independent entity to abate and remediate the opioid epidemic in the Commonwealth and is financially supported by the Virginia Opioid Abatement Fund. The OAA distributes individual distributions directly to localities to fund OAA approved projects. If a locality agrees to follow the gold standard in the expenditure of all Opioid Settlement funds, the locality will become eligible for a 25% incentive in increased funding through the OAA. The OAA also offers funds for localities through competitive cooperative partnership grants. Considerations: Over the past several months, the City of Roanoke has received several direct distributions of opioid settlement payments. The settlement payments are often received in installments and each settlement has its own schedule. The City has recently received payments from Allergen, CVS, Distributors, Teva, Walgreens, and Walmart totaling $727,071.84. All funds will continue to be used in alignment with the Five-Year Plan for Opioid Settlement Funds as shared with Council in March 2024. The City has also applied for several projects and cooperative grants through the Virginia Opioid Abatement Authority (OAA) for the fiscal year 2025. The OAA awarded the City two cooperative grant awards, both of which were partnerships between the City and Roanoke County. The OAA supported the continual funding of the Collective Response and effectively allowed us to roll over our year one dollars into year two. funding the Collective Response at $349,741 for the year. The OAA also supported the renovation of a house on Patterson Avenue by Restoration Housing so that the property can be used for residential treatment for pregnant and parenting women, modeled after the former Bethany Hall, serving up to 16 women and 16 infants. The OAA awarded $225,472 towards the project with the City and County contributing $27,500 each from direct distributions. In total. the project will receive $280.472 to help bridge the gap in the project's overall budget which is also supported by other grants and contributions. The OAA also approved the rollover of funding for all five projects developed last year. Project 1 carries over $97,000 in funding to support training and awareness for Adverse Childhood Experiences (ACEs) targeted towards staff members and families, facilitated by Family Service of Roanoke at the West End Center and the Boys and Girls Club. Project 2 continues $61,000 in funding for Blue Ridge Behavioral Healthcare to employ a Certified Peer Recovery Specialist to serve in the Roanoke City Adult Detention Center. Project 3 carries over $48,000 supporting Virginia Harm Reduction Coalition to purchase test strips and a mass spectrometer. Project 4 continues $25,000 in funding to support a marketing campaign for the Warm Line at Blue Ridge Behavioral Healthcare. Project 5 supports opioid-related EMS supplies and training with $21,867 from the OAA and $28,133 from the City's direct distributions for a total of $50,000. By signing the Statement of Grant Award/Acceptance, the recipient agrees to: • Use the grant funds to carry out the activities described in the grant application, as modified by the terms and conditions attached to this award or by subsequent amendments approved by the Opioid Abatement Authority (OAA); • Adhere to the approved budget contained in this award and amendments made to it in accord with these terms and conditions; and, • Comply with all terms, conditions and assurances either attached to this award or submitted with the grant application. 1. Definitions a. Definitions are contained in the OAA s Glossary of Terms available on the OAAwebsite. 2. Use of Funds a. Recipient understands and agrees that the funds disbursed under this award may only be used in compliance with Code of Virginia §2 2-2370, any OAA regulations, and guidance issued by the OAA regarding the foregoing. i. The recipient's primary mission. the primary mission of sub-recipients, and/or the primary mission of other agencies funding a portion of the proposed program will not conflict with the OAA's mission as it is defined in Code of Virginia §2 2-236(D. b. Recipient will determine prior to engaging in any project using this assistance that it has the institutional. managerial. and financial capability to ensure proper planning. management, and completion of such project. c. Direct Costs i. A direct cost is any cost that can be specifically identified with the proposed project that can be directly attributed to the project and/or the project's measurable activities. ii. Direct costs include but are not limited to salaries, travel. equipment. and supplies directly connected to the project. 1. An example of direct costs would be paying an employee to manage an Opioid Use Disorder Treatment Program. iii. In accordance with Code of Virginia §2 2-2370 cA) (4). recipient may NOT use funds provided under this award to cover indirect costs Virginia Opioid Abatement Authority 1 of 7 Grant Award Terms and Conditions for Cooperative Partnership of Cities and Counties 1. An example of indirect costs would be allocating a percentage of time of an existing (fully funded) procurement officer to issue a request for proposals (RFP) for this project. 2. Including costs for something that is funded and already exists is considered indirect costs and supplanting. both of which are not allowed. d. Administrative costs that are new to the recipient for the purposes of government oversight and management of an abatement program to include managing and monitoring of expenses, collecting data, and making reports are considered allowable direct costs. i. New costs are defined as hiring an employee or contractor or increasing the hours of an employee or contractor to meet the oversight and management needs. ii. Utilizing abatement funds for a current employee's costs is considered supplanting and not allowed per Code of Virginia §2 2-2370 e. Utilizing abatement funds for a current employee's costs is considered supplanting and not allowed per Code of Virginia §2 2-2370. 3. Period of Performance a. Awards for cooperative partnership projects will be on a fiscal year basis. b. Each award will be for one full fiscal year with the option for up to four one-year renewals. c. An application for renewal will be required from the participating partner cities and/or counties and submitted by the end of the application period of each year prior to the renewal. d. Reporting will be on a yearly basis. e. After a project has been renewed four times, the partnership will need to submit a new application. f. The initial cooperative partnership projects will be awarded for Fiscal Year 2024 g. Beginning in FY2025, the OAA will require the fiscal agent to repay any unencumbered balances to the OAA by September 1 of the following fiscal year, unless a carryover request is submitted meeting the following conditions: i. The carry-over was planned and submitted as part of the approved project budget, or ii. The partnership is making reasonable and measurable progress to implement its project(s) as described in the approved proposal; and 1. The "project timeline" workbook will be used to document reasonable and measurable progress. iii. The partnership and fiscal agent remain in compliance with the terms and conditions of the OAA. 4. Reporting The recipient agrees to comply with any reporting obligations established by the OAA for this award. By accepting the award. the recipient agrees to submit a yearly financial and performance report throughout the grant period, as well as final reports to close the grant. No current awards will be considered for renewal if the recipient is not in compliance with the OAA's requirements at the time of renewal. For good cause, submitted in writing by the recipient, OAA may waive this provision. For all reporting questions and to submit reports. email to info.fvvoaa us. a. Reporting will include financial expenditures as well as programmatic performance measures on a yearly basis. Reporting frequency may increase in future awards. Virginia Opioid Abatement Authority 2 of 7 Grant Award Terms and Conditions for Cooperative Partnership of Cities and Counties i. Financial reports are due by September 1st of each year for the preceding fiscal year. Reports are due even if no expenditures occurred during the year. If the due date falls on a weekend or non-business day, the report is due on the next business day. ii. Performance reports that include the performance measures agreed upon in the award are due by September 1st of each year for the preceding fiscal year. This report will also include a narrative of the progress the program has made during the period. b. Each year during the application period, the recipient will have the opportunity to amend the current fiscal year's funding and request the next fiscal year's funding. If a cooperative partnership needs to request an off-cycle amendment. those requests will be handled on a case-by-case basis. c. The recipient will also include reporting on expenditures and programmatic performance measures for spending related to the recipient's direct distribution of the settlement in accordance with Code of Virginia 2 2-2370 IA) (5) d. The recipient has up to 90 days from the end of the award period to liquidate any unpaid obligations and submit a final report. The end of the award period occurs when funding is no longer available or the partnership elects to sunset the project. The liquidation period allows projects time to receive final invoices and make final payments. No new obligations may be incurred during this period. e. The method for reporting may change during a grant cycle and include an online software platform. 5. Maintenance of and Access to Records; Audits a. The recipient hereby agrees to retain all books, records, and other documents relative to this award for five (5) years after final payment. or until final payment period is audited by the Commonwealth of Virginia, whichever is sooner. b. The recipient hereby agrees to also retain all books, records, and other documents relative to this award in accordance with the Virginia Public Records Act Code of Virginia §42.1-76 et seq. c. The OAA, its authorized agents. and/or State auditors shall have full access to and the right to examine any of said materials during said period. d. The recipient hereby agrees to comply with all reporting and auditing requirements related to these funds as set forth by the Auditor of Public Accounts. e. The recipient agrees to forward a copy to the OAP,of the recipient's audited financial statements for the fiscal year that covers the grant award period. 6. Cost Sharing Cost sharing or matching funds are not required to be provided by the recipient unless they are specified by the recipient as part of the application. 7. Conflicts of Interest Recipient understands and agrees it must maintain a conflict of interest policy consistent with Code of Virginia §22-3100 et seq. and that such conflict of interest policy is applicable to each activity funded under this award. Recipient and subrecipients must disclose in writing to the OAA. any potential conflict of interest affecting the awarded funds. 8. Compliance with Applicable Law and Regulations a. Anti-Discrimination Virginia Opioid Abatement Authority 3 of 7 Si. Grant Award Terms and Conditions for Cooperative Partnership of Cities and Counties By submitting their proposals. recipients certify to OAA that they will conform to the provisions of the Federal Civil Rights Act of 1964. as amended, as well as the Virginia Fair Employment Contracting Act of 1975, as amended, where applicable, the Virginians With Disabilities Act. the Americans with Disabilities Act and § 2.2-4311 of the Virginia Public Procurement Act. If the award is made to a faith- based organization, the organization shall not discriminate against any recipient of goods, services, or disbursements made pursuant to the contract on the basis of the recipient's religion, religious belief, refusal to participate in a religious practice. or on the basis of race, age, color, gender or national origin and shall be subject to the same rules as other organizations that contract with public bodies to account for the use of the funds provided; however, if the faith-based organization segregates public funds into separate accounts, only the accounts and programs funded with public funds shall be subject to audit by the public body. (Code of Virginia. §2.2-4343 F)). In every contract over $10,000 the provisions in i. and ii. below apply: i. During the performance of this award, the recipient agrees as follows: 1. If the recipient violates one of these provisions, the OAA may terminate the affected part of this award for breach, or at its option, the whole award. 5. In accordance with Executive Order 61 (2017), a prohibition on discrimination by the recipient, in its employment practices. subcontracting practices, and delivery of goods or services, on the basis of race, sex. color. national origin, religion, sexual orientation, gender identity, age, political affiliation. disability, or veteran status, is hereby incorporated in this award. 6. The recipient will include the provisions of i. above in every subcontract or purchase order over $10.000, so that the provisions will be binding upon each subcontractor or vendor. ii. Any such employer who fails to comply with the provisions of subsection B shall be debarred from contracting with any agency of the Commonwealth for a period up to one year. Such debarment shall cease upon the employer's registration and participation in the E-Verify program. c. Ethics in Public Contracting By submitting their proposals, recipients certify that their proposals are made without collusion or fraud and that they have not offered or received any kickbacks or inducements from any other recipient, supplier. manufacturer or subcontractor in connection with their proposal, and that they have not conferred on any public employee having official responsibility for this proposal any payment, loan, subscription, advance. deposit of money. services or anything of more than nominal value, present or promised. unless consideration of substantially equal or greater value was exchanged. d. Immigration Reform and Control Act of 1986 By submitting their proposals, recipients certify that they do not and will not during their performance of this award employ an unauthorized alien as defined in the Federal Immigration Reform and Control Act of 1986. e. Debarment Status By submitting their proposals. recipients certify that they will not contract with organizations currently debarred by the Commonwealth of Virginia from submitting proposals on contracts for the type of goods and/or services covered by this award, nor are they an agent of any person or entity that is currently so debarred. 9. Remedial Actions In the event of recipient's noncompliance with these terms and conditions. other applicable laws, regulations, and/or settlements. OAA may impose additional conditions on the receipt of a subsequent tranche of future award funds, if any, or take other available remedies. 10. False Statements Recipient understands that making false statements or claims in connection with this award is a violation of Code of Virginia §18 2-498 4 and may result in criminal, civil, or administrative sanctions, including fines, imprisonment, civil damages and penalties, debarment from participating in state awards or contracts. and/ or any other remedy available by law. 11. Debts Owed the Opioid Abatement Fund a. Any funds paid to recipient (1) in excess of the amount to which recipient is finally determined to be authorized to retain under the terms of this award: or (2)that are determined by the OAA to have been misused: and have not been repaid by recipient shall constitute a debt to the Opioid Abatement Fund. b. Any debts determined to be owed the Opioid Abatement Fund must be paid promptly by the recipient. Travel Policy Recipients may follow their own established travel rates if they have an established travel policy. The OAA reserves the right to determine the reasonableness of an organization's travel policy. If the recipient does not have an established policy, then they must adhere to state travel policy. Award Amendments Once a proposal has been approved by the OAA, amendments will be handled as follows: a. At all times regardless of any amendment the cooperative partnership and fiscal agent must remain in compliance with the OAA's terms and conditions. b. A cooperative partnership may appropriate additional revenue that it receives for any approved project. In this event the OAA shall be notified of the change using forms approved by the OAA. c. A cooperative partnership may initiate line-item budget transfers within a project without approval from the OAA. 18. Delegation of Responsibility Any delegation of responsibility for carrying out grant-funded activities to any entity must be pursuant to a written memorandum of understanding or contract by which the implementing organization agrees to comply with all applicable grant terms. conditions, and assurances. Any such delegation notwithstanding, the applicant acknowledges by its acceptance of the award its ultimate responsibility for compliance with all terms, conditions, and assurances of the grant award. 19. Performance and Obligation Periods OAA awards to cities and counties shall have a performance period of two years (the current and following fiscal years). Recipients must submit yearly requests that amend the current year (if necessary) and apply for the next fiscal year's funding. Carryover of funds from FY2023 to FY2024 and FY2024 to FY2025 will be automatic. In subsequent years. carryover requests will need approval from the OAA or remaining balances will be repaid to the OAA. Reporting will be on a yearly basis for this first award cycle, due September 1. 2023, on forms prescribed by the OAA. Grant funds, including matching funds. may be expended and/or obligated during the grant award period of performance. Recipients may only charge to the award allowable costs incurred during this grant award period. 20. Limitation on the Use of Funds to Approved Activities The recipient agrees that grant funds will be used only for the purposes described in the recipient's application, unless OAA determines that any of these activities are out of scope or unallowable. Recipient will determine prior to engaging in any project using this assistance that it has the institutional. managerial, and financial capability to ensure proper planning. management. and completion of such project. c. Direct Costs i. A direct cost is any cost that can be specifically identified with the proposed project that can be directly attributed to the project and/or the project's measurable activities. ii. Direct costs include but are not limited to salaries, travel. equipment. and supplies directly connected to the project. 1. An example of direct costs would be paying an employee to manage an Opioid Use Disorder Treatment Program. iii. Administrative costs that are new to the recipient for the purposes of government oversight and management of an abatement program to include managing and monitoring of expenses, collecting data, and making reports are considered allowable direct costs. i. New costs are defined as hiring an employee or contractor or increasing the hours of an employee or contractor to meet the oversight and management needs. ii. Utilizing abatement funds for a current employee's costs is considered supplanting and not allowed per Code of Virginia §2.2-2370 e. Awards for cooperative partnership projects will be on a fiscal year basis. b. Each award will be for one full fiscal year with the option for up to four one-year renewals. c. An application for renewal will be required from the participating partner cities and/or counties and submitted by the end of the application period of each year prior to the renewal. d. Reporting will be on a yearly basis. e. After a project has been renewed four times, the partnership will need to submit a new application. f. The initial cooperative partnership projects will be awarded for Fiscal Year 2024 g. Beginning in FY2025, the OAA will require the fiscal agent to repay any unencumbered balances to the OAA by September 1 of the following fiscal year, unless a carryover request is submitted meeting the following conditions: i. The carry-over was planned and submitted as part of the approved project budget. or ii. The partnership is making reasonable and measurable progress to implement its project(s) as described in the approved proposal; and 1. The "project timeline" workbook will be used to document reasonable and measurable progress. iii. The partnership and fiscal agent remain in compliance with the terms and conditions of the OAA. 4. Reporting The recipient agrees to comply with any reporting obligations established by the OAA for this award. By accepting the award. the recipient agrees to submit a yearly financial and performance report throughout the grant period, as well as final reports to close the grant. No current awards will be considered for renewal if the recipient is not in compliance with the OAA's requirements at the time of renewal. For good cause, submitted in writing by the recipient. Reporting will include financial expenditures as well as programmatic performance measures on a yearly basis. Reporting frequency may increase in future awards. Financial reports are due by September 1st of each year for the preceding fiscal year. Reports are due even if no expenditures occurred during the year. If the due date falls on a weekend or non-business day, the report is due on the next business day. ii. Performance reports that include the performance measures agreed upon in the award are due by September 1st of each year for the preceding fiscal year. This report will also include a narrative of the progress the program has made during the period. b. Each year during the application period. the recipient will have the opportunity to amend the current fiscal year's funding and request the next fiscal year's funding. If a cooperative partnership needs to request an off-cycle amendment, those requests will be handled on a case-by-case basis. c. The recipient will also include reporting on expenditures and programmatic performance measures for spending related to the recipient's direct distribution of the settlement in accordance with Code of Virginia 2.2-2370 (A) r;5? d. The recipient has up to 90 days from the end of the award period to liquidate any unpaid obligations and submit a final report. The end of the award period occurs when funding is no longer available or the partnership elects to sunset the project. The liquidation period allows projects time to receive final invoices and make final payments. No new obligations may be incurred during this period. e. The method for reporting may change during a grant cycle and include an online software platform. 5. Maintenance of and Access to Records; Audits a. The recipient hereby agrees to retain all books, records, and other documents relative to this award for five (5)years after final payment. or until final payment period is audited by the Commonwealth of Virginia. whichever is sooner. b. The recipient hereby agrees to also retain all books, records, and other documents relative to this award in accordance with the Virginia Public Records Act Code of Virginia §42 1-76 et seq. c. The OAA, its authorized agents, and/or State auditors shall have full access to and the right to examine any of said materials during said period. d. The recipient hereby agrees to comply with all reporting and auditing requirements related to these funds as set forth by the Auditor of Public Accounts. e. The recipient agrees to forward a copy to the OAA of the recipient's audited financial statements for the fiscal year that covers the grant award period. 6. Cost Sharing Cost sharing or matching funds are not required to be provided by the recipient unless they are specified by the recipient as part of the application. 7. Conflicts of Interest Recipient understands and agrees it must maintain a conflict of interest policy consistent with Code of Virginia §22-3100 et seq. and that such conflict of interest policy is applicable to each activity funded under this award. Recipient and subrecipients must disclose in writing to the OAA, any potential conflict of interest affecting the awarded funds. 8. Compliance with Applicable Law and Regulations a. Anti-Discrimination Virginia Opioid Abatement Authority 3 of 7 Grant Award Terms and Conditions for Cooperative Partnership of Cities and Counties By submitting their proposals. recipients certify to OAA that they will conform to the provisions of the Federal Civil Rights Act of 1964. as amended, as well as the Virginia Fair Employment Contracting Act of 1975, as amended, where applicable, the Virginians With Disabilities Act, the Americans with Disabilities Act and § 2.2-4311 of the Virginia Public Procurement Act. If the award is made to a faith- based organization, the organization shall not discriminate against any recipient of goods, services, or disbursements made pursuant to the contract on the basis of the recipient's religion. religious belief, refusal to participate in a religious practice. or on the basis of race, age, color, gender or national origin and shall be subject to the same rules as other organizations that contract with public bodies to account for the use of the funds provided; however, if the faith-based organization segregates public funds into separate accounts, only the accounts and programs funded with public funds shall be subject to audit by the public body. Any such employer who fails to comply with the provisions of subsection B shall be debarred from contracting with any agency of the Commonwealth for a period up to one year. Such debarment shall cease upon the employer's registration and participation in the E-Verify program. c. Ethics in Public Contracting By submitting their proposals, recipients certify that their proposals are made without collusion or fraud and that they have not offered or received any kickbacks or inducements from any other recipient. supplier, manufacturer or subcontractor in connection with their proposal, and that they have not conferred on any public employee having official responsibility for this proposal any payment, loan, subscription, advance, deposit of money. services or anything of more than nominal value, present or promised, unless consideration of substantially equal or greater value was exchanged. d. Immigration Reform and Control Act of 1986 By submitting their proposals. recipients certify that they do not and will not during their performance of this award employ an unauthorized alien as defined in the Federal Immigration Reform and Control Act of 1986. e. Debarment Status By submitting their proposals, recipients certify that they will not contract with organizations currently debarred by the Commonwealth of Virginia from submitting proposals on contracts for the type of goods and/or services covered by this award, nor are they an agent of any person or entity that is currently so debarred. 9. Remedial Actions In the event of recipient's noncompliance with these terms and conditions, other applicable laws, regulations, and/or settlements. OAA may impose additional conditions on the receipt of a subsequent tranche of future award funds, if any. or take other available remedies. 10. False Statements Recipient understands that making false statements or claims in connection with this award is a violation of Code of Virginia §18 2-498 4 and may result in criminal, civil, or administrative sanctions, including fines, imprisonment, civil damages and penalties. debarment from participating in state awards or contracts, and/ or any other remedy available by law. 11. Debts Owed the Opioid Abatement Fund a. Any funds paid to recipient (1) in excess of the amount to which recipient is finally determined to be authorized to retain under the terms of this award; or (2) that are determined by the OAA to have been misused; and have not been repaid by recipient shall constitute a debt to the Opioid Abatement Fund. b. Any debts determined to be owed the Opioid Abatement Fund must be paid promptly by the recipient. A debt is delinquent if it has not been paid by the date specified in OAA's initial written determination for payment, unless other satisfactory arrangements have been made. The OAA will take any actions available to it to collect such a debt. The Commonwealth of Virginia expressly disclaims any and all responsibility or liability to recipient or third persons for the actions of recipient or third persons resulting in death, bodily injury, property damages, or any other losses resulting in any way from the performance of this award or any other losses resulting in any way from the performance of this award or any contract, or subcontract under this award. b. The acceptance of this award by the recipient does not in any way establish an agency relationship between the Commonwealth and the recipient. 13. Protections for Whistleblowers a. Recipients shall comply with Chapter 30 1 The Fraud and Abuse Whistleblower Protection Act (Code of Virginia §2 2-3009 et seq.) b. No governmental agency may threaten or otherwise discriminate or retaliate against a citizen whistle blower because the whistle blower is requested or subpoenaed by an appropriate authority to participate in an investigation, hearing, or inquiry by an appropriate authority or in a court action c. No employer may discharge. threaten, or otherwise discriminate or retaliate against a whistle blower whether acting on his own or through a person acting on his behalf or under his direction. d. No employer may discharge. threaten, or otherwise discriminate or retaliate against a whistle blower, in whole or in part, because the whistle blower is requested or subpoenaed by an appropriate authority to participate in an investigation, hearing, or inquiry by an appropriate authority or in a court action e. An employer shall post notices and use other appropriate means to notify employees and keep them informed of the protection and obligations set forth in the provisions of Chapter 30.1. 14. Requirement to Report Potentially Duplicative Funding. If the recipient currently has other active awards. or if the recipient receives any other award of during the period of performance for this award, the recipient promptly must determine whether funds from any of those other awards have been. are being, or are to be used (in whole or in part) for one or more of the identical cost items for which funds are provided under this award. If so. the recipient must promptly notify OAA in writing of the potential duplication, and, if so requested by OAA. must seek a budget-modification or change-of-project-scope to eliminate any inappropriate duplication of funding. 15. Additional Monitoring Requirements The recipient understands that it may be subject to additional financial and programmatic on-site monitoring, which may be on short notice, and agrees that it will cooperate with any such monitoring in accordance with Code of Virginia §2.2-2370 i A) i 5). 16. Travel Policy Recipients may follow their own established travel rates if they have an established travel policy. The OAA reserves the right to determine the reasonableness of an organizations travel policy. If the recipient does not have an established policy, then they must adhere to state travel policy. Award Amendments Once a proposal has been approved by the OAA, amendments will be handled as follows: a. At all times regardless of any amendment the cooperative partnership and fiscal agent must remain in compliance with the OAA's terms and conditions. b. A cooperative partnership may appropriate additional revenue that it receives for any approved project. In this event the OAA shall be notified of the change using forms approved by the OAA. c. A cooperative partnership may initiate line-item budget transfers within a project without approval from the OAA. 18. Delegation of Responsibility Any delegation of responsibility for carrying out grant-funded activities to any entity must be pursuant to a written memorandum of understanding or contract by which the implementing organization agrees to comply with all applicable grant terms, conditions, and assurances. Any such delegation notwithstanding, the applicant acknowledges by its acceptance of the award its ultimate responsibility for compliance with all terms, conditions, and assurances of the grant award. 19. Performance and Obligation Periods OAA awards to cities and counties shall have a performance period of two years (the current and following fiscal years). Recipients must submit yearly requests that amend the current year (if necessary) and apply for the next fiscal year's funding. Carryover of funds from FY2023 to FY2024 and FY2024 to FY2025 will be automatic. In subsequent years. carryover requests will need approval from the OAA or remaining balances will be repaid to the OAA. Reporting will be on a yearly basis for this first award cycle, due September 1. 2023, on forms prescribed by the OAA. Grant funds. including matching funds, may be expended and/or obligated during the grant award period of performance. Recipients may only charge to the award allowable costs incurred during this grant award period. 20. Limitation on the Use of Funds to Approved Activities The recipient agrees that grant funds will be used only for the purposes described in the recipient's application, unless OAA determines that any of these activities are out of scope or unallowable. The recipient must not undertake any work or activities that are not described in the recipient's application, award documents, or approved budget, and must not use staff, equipment, or other goods or services paid for with grant funds for such work or activities, without prior written approval, from OAA. 21. Procurement Recipients are responsible for ensuring that any procurement using OAA funds, or payments under procurement contracts using such funds are consistent with the procurement standards set forth in the Virginia Public Procurement Act Code of Virginia fi2 2- -300 et seq. as well as any procurement policies and procedures established by the applicant. Background: The Fire Programs Fund was established by the General Assembly during the mid- 1980s. Program funds are used to supplement the General Fund portion of the Fire-EMS Department. Program guidelines require that funds received are non-supplanting and may not be used to replace existing local funding. Roanoke Fire-EMS will receive FY25 funding in the amount of $512,549. such funds to be allocated as follows: Personal Protective Equipment $200,000 Vehicular Equipment $ 60,000 Professional Development $ 50,000 Small Tools and Equipment $ 75,000 Health and Safety Equipment $ 50,000 Community Risk Reduction $ 27,549 Regional Training Center $ 50,000 Considerations: Council action is required to accept, and appropriate, the $512.549 grant from the Virginia Department of Fire Programs. NOTICE OF PUBLIC HEARING COUNCIL OF THE CITY OF ROANOKE,VIRGINIA NOTICE IS HEREBY GIVEN that the Council of the City of Roanoke, pursuant to Section 15.2-202, Code of Virginia (1950), as amended, will hold a public hearing on Monday, August 19, 2024, at 7:00 p.m., or as soon thereafter as the matter may be heard, in the Council Chamber, 4th Floor, Room 450, Noel C. Taylor Municipal Building,215 Church Avenue, S.W.,Roanoke,Virginia,at which time citizens of the City of Roanoke shall have an opportunity to be heard to determine if such citizens desire Council to petition the General Assembly of Virginia to make certain amendments to the Roanoke Charter of 1952 by adding the Director of the City's Office of Real Estate Valuation as a council appointed officer, as described in the amendments set forth below. § 8. - Officers elective by council; rules; journal of council proceedings; quorum of council. The council shall elect a city manager, a city clerk, a municipal auditor, a director of real estate valuation, and a city attorney, none of whom need be a resident of the city at the time of their election but who shall take up residence within the city within three months of their election if not already a resident. Unless herein otherwise specifically provided, the council shall also appoint the members of such boards and commissions as are hereafter provided for. Pursuant to § 21 of this charter, the city manager shall appoint a director of finance. All elections by the council shall be viva voce and the vote recorded in the journal of the council. The council may determine its own rules of procedure; may punish its members for misconduct and may compel the attendance of members in such manner and under such penalties as may be prescribed by ordinance. It shall keep a journal or its proceedings. A majority of all of the members of the council shall constitute a quorum to do business, but a smaller number may adjourn from time to time. Upon a vacancy occurring in any such office the council shall elect a person to fill the unexpired portion of any term created by such vacancy; or, in the council's discretion, it may elect a person as an acting city manager, city clerk, municipal auditor, director of real estate valuation, or city attorney to hold such office for such lesser term and for such compensation as the council shall then determine; and any person so elected shall have, during the term for which he was elected, all of the authority and shall be charged with all of the duties and responsibilities of the office for which he was elected. § 9. - Elections by council, when held, terms, et cetera. * * * During the month of September 2016 and during the month of September of every second year thereafter, the council shall elect a city clerk, a municipal auditor, a director of real estate valuation, and a city attorney, each of whom shall serve a term of two years from the first day of October next following the date of their election and until their successor shall have been elected and qualified. § 23. Creation of departments and department heads; deputies and assistants. The council may by ordinance provide for administrative departments, and when such departments are created may define the functions, which such departments are to administer, may provide for the appointment of heads for such departments and define their duties and responsibilities. The council may by ordinance provide for the appointment of one or more assistants or deputies in the offices of the city attorney, the municipal auditor, the director of real estate valuation, and the city clerk and may define their duties and responsibilities. Such assistants or deputies, when acting in such official capacity, shall possess all of the power and authority and shall be subject to all of the duties and responsibilities given to or imposed upon their respective superiors under this charter. General powers. The director of real estate valuation shall be the administrative head of the office of real estate valuation, and shall be responsible to city council the director of finance for the effective administration of such office.
