PRESENTATIONS AND ACKNOWLEDGEMENTS: A resolution recognizing and commending the dedicated service of Christopher Chittum as Director of Planning, Building, and Development for the City of Roanoke, upon his retirement. Adopted Resolution No. 43086-110424. (5-0) 3. HEARING OF CITIZENS UPON PUBLIC MATTERS: City Council sets this time as a priority for citizens to be heard. All matters will be referred to the City Manager for response, recommendation or report to Council, as he may deem appropriate. Barbara Reynolds, 431 Vermont Avenue, NW, appeared before the Council and expressed concern about City-owned trees behind her property and asked the City to remove the trees. Sylvia King, 3102 Willow Road, NW, appeared before the Council and complimented the City Council campaigns as dignified and suggested the Evans Spring Caretaker Cottage be wrapped in plastic. 4. CONSENT AGENDA: APPROVED (5-0) All matters listed under the Consent Agenda are considered to be routine by the Members of City Council and will be enacted by one motion. There will be no separate discussion of the items. If discussion is desired, the item will be removed from the Consent Agenda and considered separately. C-1. Minutes of the regular meeting of City Council held on Monday, October 21, 2024. RECOMMENDED ACTION: Dispensed with the reading of the minutes and approved as recorded. C-2. Request for a public hearing to be scheduled and advertised for consideration of a request for tax exemption for personal property from Wellness Wagon, a non-stock, non-profit organization. RECOMMENDED ACTION: Authorized and advertised a public hearing on the above-mentioned matter for City Council's regular meeting on Monday, November 18, 2024, at 7:00 pm, or as soon thereafter as the matter may be heard, or such later date and time as the Interim City Manager may determine. Request for a public hearing to be scheduled and advertised for consideration of a request for tax exemption for real property located at 4751 Cove Road, NW, from Good Samaritan Hospice, Inc., a non-stock, non-profit organization. (5-0) COMMENTS OF THE INTERIM CITY MANAGER The Interim City Manager offered the following comments: Roundtable Gathering "Challenges and Change" On October 29 — 30, 2024, city staff met with 40 business owners in the Downtown Business District to identify collective solutions to impact change and provide support for small businesses and the Downtown area. Business owners heard about current housing trends and the history of the lack of affordable housing. Further, they learned of the city's current intervention strategies such as public safety and resource assistance. Staff are pulling together ideas shared and developing several plans to address the opportunities that exist for the unhoused population. Business owners will engage with staff in the coming months for a follow-up session. EDA Equipment Incentives Grant I wanted to remind you of the Economic Development Authority (EDA) Equipment Incentive Grant Program. This grant program will assist city businesses with purchasing essential equipment. The EDA is expected to commit $300,000 over two years ($150,000 annually). This program will be essential to help small businesses meet their equipment needs. The grant period is now open. Bike Lane Safety Video The newest safety and educational video on Bike Safety is available. The video highlights the different types of bike lanes throughout Roanoke and shares essential safety tips for both cyclists and motorists. From traditional and buffered bike lanes to green lanes at intersections and mobility tracks, each bike lane type helps improve visibility and safety on our streets. This video also explains the presence of multi-use shoulders that are not designated bike lanes, but that cyclists can use when they are clear. Messaging throughout each lane type also includes information about where to place trash, brush, and bulk items, parking, and how motorists and cyclists can interact. There will be a follow-up video specific to Solid Waste Management. Wasena Bridge Update Archer Western (AW) has completed the concrete foundation for Pier 3, marking a significant milestone in the project's foundation framework. The use of a pump truck during these large concrete pours not only streamlines the placement process but also enhances precision, which is critical for structural integrity. Each pier foundation requires about 160 cubic yards of concrete—equating to approximately 630,000 pounds (more than half a million pounds)—demonstrating the substantial scale of the work involved. Additionally, AW has addressed damage from Hurricane Helene to their work bridge across the Roanoke River, ensuring the continuation of demolition operations for the former bridge. These efforts are pivotal in maintaining project timelines and ultimately contribute to the overall success and safety of the infrastructure being developed. 2. CITY ATTORNEY: NONE 8. A resolution designating a Voting Delegate and Alternate Voting Delegate for the Annual Business Meeting of the National League of Cities City Summit. Adopted Resolution No. 43093-110424. (5-0) 11. Public Matters Follow-up: Katie Hedrick, Inclusive Services Manager, provided the following report on public matters. Downtown Safety Concerns Mr. Nathan Harper, a downtown business owner, shared concerns about his own safety and that of other downtown employees. He was very complimentary and supportive of the Downtown Ambassador program and asked that patrolling and safety initiatives increase. Report Back: In September of this year, Deputy Chief Puckett of the Police Department issued a memo titled, "Downtown Safety and Visibility Enhancement Plan." The plan approves overtime payment for patrols of the downtown business district, additional patrols during peak night hours, dedicated officers during daylight hours, and increased visibility of officers and police vehicles. This plan was shared with Mr. Harper. Data Dashboards The Department of Technology is currently working with existing platforms to build a more comprehensive data dashboard that will be visible to Council members and staff as well as the public. Ms. Vanessa Bohr, Chief Information Officer, and Mr. Jared Anthony, IT Manager, shared more information about the process and showed examples of similar projects in Arlington, Texas; Tempe, Arizona; and Glendale, Arizona. Report Back: Council Member Moon Reynolds asked about other cities in Virginia that are utilizing similar systems. The best current examples are in Alexandria, Fairfax County, and Norfolk. The cities of Williamsburg, Chesterfield, and Arlington have data dashboards, but they are organized and utilized differently than Roanoke will use them. Reappointed Michael Waldvogel as a member of the Blue Ridge Behavioral Healthcare Board of Directors for a three-year term of office, commencing January 1, 2025, and ending December 31, 2027. Appointed Edward Garner as a member of the Board of Zoning Appeals to fill the unexpired term of Sue Ellen Agresta ending December 31, 2024; and for an additional three-year term of office commencing January 1, 2025, and ending December 31, 2027. Reappointed Scott Terry-Cabbler as a member of the City Planning Commission for a four-year term of office, commencing January 1, 2025, and ending December 31, 2028. Appointed Betty Jean Wolfe as a member of the City Planning Commission to replace Sarah Glenn for a four-year term of office, commencing January 1, 2025, and ending December 31, 2028. Appointed Adetoye Oshoniyi as a member of the City Planning Commission to replace James Smith for a four-year term of office, commencing January 1, 2025, and ending December 31, 2028. Reappointed Jonathan Lloyd as a member of the Equity and Empowerment Advisory Board for a three-year term of office, commencing January 1, 2025, and ending December 31, 2027. Reappointed Bethany Lackey and Cedric Wilson as members of the Human Services Advisory Board for four-year terms of office, each, commencing December 1, 2024, and ending November 30, 2028. WHEREAS, Mr. Chittum will resign from his position with the City as Director of Planning, Building, and Development effective December 1, 2024, after serving in this position for the past eight years; WHEREAS, prior to his service as Director of Planning, Building, and Development,Mr. Chittum served in various management positions in Planning, Building, and Development, since 1993; WHEREAS, Mr. Chittum completed a City Manager Apprenticeship and served as Assistant City Manager in 2024; WHEREAS,Mr. Chittum earned his undergraduate and graduate degrees from Virginia Tech; WHEREAS, before coming to the City, Mr. Chittum spent four years as Town Planner and County Planner in Vinton and Franklin County; WHEREAS, Mr. Chittum has been affiliated with esteemed professional organizations such as the American Planning Association, the American Institute of Certified Planners, the Congress of New Urbanism, and the International City/County Management Association; WHEREAS,Mr. Chittum has dedicated 31 total years of service to the City of Roanoke,significantly shaping the community's development and future; WHEREAS, during his long and distinguished career with the City of Roanoke, Mr. Chittum worked with the community to create dozens of plans including the development of the previous comprehensive plan, Vision 2020, the current comprehensive plan, City Plan 2040, and twenty-seven current neighborhood and area plans that help shape the urban design and land use of the City; WHEREAS, Mr. Chittum was instrumental in modernizing the City of Roanoke's Zoning Code and developed affordable housing strategies in support of promoting equity, community health, and complete neighborhoods; WHEREAS, during the COVID-19 pandemic, Mr. Chittum led the improvement of customer service within the Planning, Building, and Development Department by transitioning to the Trackit system, ensuring efficient service delivery and maintaining operations even amid unprecedented challenges;and WHEREAS, during his time as Assistant City Manager, Mr. Chittum revamped the Capital Improvement Plan and created a toolkit for succession planning in the City. THEREFORE, BE IT RESOLVED by the Council of the City of Roanoke as follows: 1. Background: Wellness Wagon, a non-stock, non-profit 501(c)(3) organization has applied for tax exemption of personal property it owns located in the City of Roanoke, at 708 5th Street, SW on the basis of benevolent and charitable use. The personal property for which exemption is requested is a 2006 Freightliner School Bus. Wellness Wagon uses this property to provide free and reduced price acupuncture to the community. Pursuant to the requirements of Section 58.1-3651, Virginia Code, if the City Council wishes to consider the application of Wellness Wagon for this property to be tax exempt. Council must first conduct a public hearing. Considerations: Wellness Wagon is a 36-foot mobile clinic that provides various acupuncture services in multiple ways. It organizes multiple community services into Wellness Rodeos so that it can provide these services together. At these events, services are provided free of charge. There are some stops where charges are based on a sliding scale per treatment. Companies also hire them to treat employees for $200 an hour. Recommended Action: Authorize and advertise a public hearing on the above-mentioned matter for City Council's regular meeting on Monday. Background: The Virginia Department of Transportation (VDOT) has awarded Revenue Sharing funds to partially support two drainage projects to be constructed by the Stormwater Utility. These projects, identified in the City's Capital Improvement Program, are as follows, along with their corresponding VDOT Universal Project Codes (UPCs): 1. Downtown — Rorer Ave Drainage Improvements (VDOT UPC 118181): This project aims to address the surface runoff flowing down Rorer Ave SW towards the intersection with 5th Street SW by adding stormwater inlets to capture additional runoff. 2. Campbell Avenue 2 Drainage Improvements (VDOT UPC 118162): The existing stormwater inlets along Campbell Ave SW between 4th Street SW and 3rd Street SW are inadequate for capturing stormwater runoff. This project will introduce additional stormwater inlets along Campbell Ave SW and limited up-sizing existing stormwater pipes. Considerations: In September 2019, the City applied for VDOT Local Revenue Sharing Funds for these projects, which include a local match requirement totaling $478,486: • Rorer Ave Drainage Improvements: $63,081 • Campbell Avenue 2 Drainage Improvements: $415.405 The local matches will be funded through the appropriate year Stormwater Utility bond funding. VIRGINIA. hereinafter referred to as the LOCALITY and the Commonwealth of Virginia. Department of Transportation. hereinafter referred to as the DEPARTMENT. The DEPARTMENT and the LOCALITY are collectively referred to as the "Parties." The representations. covenants and recitations set forth in the foregoing recitals are material to this Agreement and are hereby incorporated into and made a part of this Agreement as though they were fully set forth in this Section 1. 2. Meet all funding obligation and expenditure timeline requirements in accordance with all applicable federal and state laws and regulations, all applicable Commonwealth Transportation Board and DEPARTMENT policies. and those additional requirements as identified in Appendices A and B to this Agreement. Noncompliance with this requirement may result in deallocation of the funding from the Project. rescission of state funding match. termination of this Agreement. or the DEPARTMENT denial of future requests to administer projects by the LOCALITY, all of which actions are at the discretion of the DEPARTMENT or as can be taken pursuant to applicable laws. regulations or policies. c. Administer the Project in accordance with the DEPARTMENT's most current LAP Manual and other guidelines applicable to Locally Administered Projects as published by the DEPARTMENT. d. Provide timely certification by a LOCALITY official of the LOCALITY'S compliance with applicable laws and regulations on the State Certification Form for State Funded Projects or in another manner as prescribed by the DEPARTMENT. e. Maintain accurate and complete records of the Project's development as required in the LAP Manual and any supplemental guidance and directives of the DEPARTMENT and retain documentation of all expenditures and make such information available for inspection or auditing by the DEPARTMENT upon request. Records and documentation for the Project shall be maintained for no less than three (3) years following the DEPARTMENT'S acceptance of the final voucher on the Project. f. At least quarterly. but no more frequently than monthly. submit invoices with supporting documentation to the DEPARTMENT in the form prescribed by the DEPARTMENT. The supporting documentation shall include copies of vendor and contractor invoices paid by the LOCALITY. an up-to-date Project summary and schedule. and a summary of all payment requests. payments and adjustments. A request for reimbursement ent shall be made within 90 days after any eligible project expenses are incurred by the LOCALITY. Reimbursement for eligible expenditures shall not exceed funds allocated each year for the Project by the Commonwealth Transportation Board in the Six Year Improvement Program. Costs associated with outside counsel services shall be reimbursable expenses of the Project. k. Provide, or have others provide. maintenance of the Project upon completion, unless otherwise agreed to by the DEPARTMENT. Where the Project results in physical construction. the LOCALITY will continue to operate and maintain the Project in accordance with the final constructed design as approved by the DEPARTMENT. The LOCALITY agrees that any modification of the approved design features. without the approval of the DEPARTMENT. may. at the discretion of the DEPARTMENT. result in restitution either physically or monetarily as determined by the DEPARTMENT. 3. The DEPARTMENT shall: a. Perform ally actions and provide any decisions and approvals,within a reasonable time. which are the responsibility of the DEPARTMENT. as required by federal and state laws and regulations or as otherwise agreed to. in writing, between the parties. b. Upon receipt of the LOCALITY's invoices pursuant to paragraph 2.f. reimburse the LOCALITY the cost of eligible Project expenses, as described in Appendix A. Such reimbursements shall be payable by the DEPARTMENT within 30 days of an acceptable submission by the LOCALITY. c. Where applicable. submit invoices to the LOCALITY for the LOCALITY's share of eligible Project expenses incurred by the DEPARTMENT in the performance of activities pursuant to paragraph 2.a. and 3.a. d. Nothing in this Agreement shall obligate the Parties hereto to expend or provide any funds in excess of funds agreed upon in this Agreement or as shall have been included in an annual or other lawful appropriation. State and federal Project funding is limited to those identified in the Appendix A of this Agreement and is allocable only upon LOCALITY'S compliance with all requirements of this Agreement. In the event the cost of all or part of the Project is anticipated to exceed the allocation shown on Appendix A. the Parties agree to cooperate in seeking additional funding for the Project or to terminate the Project before Project costs exceed the allocated amount. Any requested increase in federal or state funding is subject to DEPARTMENT policy and procedures applicable to the funding source and is not guaranteed. 6. Nothing in this Agreement shall be construed as a waiver of the LOCALITY's or the Commonwealth of Virginia's sovereign inuilunity. 7. The Parties mutually agree and acknowledge, in entering this Agreement. that the individuals acting on behalf of the Parties are acting within the scope of their official authority and capacity and the Parties agree that neither Party will bring a suit or assert a claim against any official. officer, or employee of either Party. in their individual or personal capacity. for a breach or violation of the terms of this Agreement or to otherwise enforce the terms and conditions of this Agreement The foregoing notwithstanding. nothing in this subparagraph shall prevent the enforcement of the terms and conditions of this Agreement by or against either Party in a competent court of law. 8. The Parties mutually agree that no provision of this Agreement shall create in the public, or in any person or entity other than the Parties, rights as a third party beneficiary hereunder, or authorize any person or entity. not a party hereto, to maintain any action for. without limitation. personal injury. property damage. breach of contract. or return of money. or property. depositt s). cancellation or forfeiture of bonds. financial instruments. pursuant to the terms of this Agreement or otherwise. THE LOCALITY and DEPARTMENT acknowledge and agree that this Agreement has been prepared jointly by the Parties and shall be construed simply and in accordance with its fair meaning and not strictly for or against any Party. 12. Administer the Project in accordance with the DEPARTMENT's most current LAP Manual and other guidelines applicable to Locally Administered Projects as published by the DEPARTMENT. d. Provide timely certification by a LOCALITY official of the LOCALITY'S compliance with applicable laws and regulations on the State Certification Form for State Funded Projects or in another manner as prescribed by the DEPARTMENT. e. Maintain accurate and complete records of the Project's development as required in the LAP Manual and any supplemental guidance and directives of the DEPARTMENT and retain documentation of all expenditures and make such information available for inspection or auditing by the DEPARTMENT upon request. Records and documentation for the Project shall be maintained for no less than three (3) years following the DEPARTMENT'S acceptance of the final voucher on the Project. f. At least quarterly. but no more frequently than monthly. submit invoices with supporting documentation to the DEPARTMENT in the form prescribed by the DEPARTMENT. The supporting documentation shall include copies of vendor and contractor invoices paid by the LOCALITY. an up-to-date Project sununaiy and schedule. and a summary of all payment requests. payments and adjustments. A request for reimbursement shall be made within 90 days after any eligible project expenses are incurred by the LOCALITY. Reimbursement for eligible expenditures shall not exceed finds allocated each year for the Project by the Commonwealth Transportation Board in the Six Year Improvement Program. Provide, or have others provide, maintenance of the Project upon completion. unless otherwise agreed to by the DEPARTMENT. Where the Project results in physical constriction. the LOCALITY will continue to operate and maintain the Project in accordance with the final constructed design as approved by the DEPARTMENT. The LOCALITY agrees that any modification of the approved design features, without the approval of the DEPARTMENT. may. at the discretion of the DEPARTMENT. result in restitution either physically or monetarily as determined by the DEPARTMENT. 3. The DEPARTMENT shall: a. Perform any actions and provide any decisions and approvals,within a reasonable time. which are the responsibility of the DEPARTMENT. as required by federal and state laws and regulations or as otherwise agreed to. in writing. between the parties. b. Upon receipt of a notice of breach. the LOCALITY will be provided the opportunity to cure such breach or to provide a plan to cure to the satisfaction to the DEPARTMENT. If, within sixty (60) days after receipt of the written notice of breach. the LOCALITY has neither cured the breach.nor is diligently pursuing a cure of the breach to the satisfaction of the DEPARTMENT. then upon receipt by the LOCALITY of a written notice from the DEPARTMENT stating that the breach has neither been cured. nor is the LOCALITY diligently pursuing a cure. the DEPARTMENT may exercise any remedies it may have under this Agreement or at law or in equity. 11. THE LOCALITY and DEPARTMENT acknowledge and agree that this Agreement has been prepared jointly by the Parties and shall be construed simply and in accordance with its fair meaning and not strictly for or against any Party. 12. THE LOCALITY and the DEPARTMENT further agree that should Federal-aid Highway funds be added to the Project. this Agreement is no longer applicable.
