The January 6, 2025, 2:00 pm, Roanoke City Council Meeting was declared in
recess until Tuesday, January 7, 2025, at 2:00 pm, due to lack of a quorum.
CALL TO ORDER - ROLL CALL.All Present.
1. Statement of Purpose - Mayor Joseph L. Cobb
Mayor Cobb advised that the purpose of the meeting was for the newly elected
Council Members to take their seats.
2. Report from the City Clerk advising of the qualification of the Honorable Joseph L.
Cobb, as Mayor, and the Honorable S. Terry McGuire, Phazhon Nash and Nicolas
Hagen as Members of the Roanoke City Council for terms of four years, each,
commencing January 1, 2025, and ending December 31, 2028.

RECOMMENDED ACTION: Concurred in the request.
C-3. A communication from Mayor Joseph L. Cobb requesting that Council convene
in a Closed Meeting to discuss the process for selection of a:candidate for the
interim City Council Member position, pursuant to Section 2.2-3711(A)(1), Code
of Virginia (1950), as amended.
RECOMMENDED ACTION: Concurred in the request.
C-4. A communication from Mayor Joseph L. Cobb tendering his resignation as a
Member of Roanoke City Council, effective December 31, 2024.
RECOMMENDED ACTION: Accepted resignation with regret; and received
and filed the communication.
C-5. Reports of qualification of the following individuals:
Carla Terry as a member of the Personnel and Employment Practices
Commission to fill the unexpired term of office of Milton Hardy,_Sr., ending June
30, 2025;
Vickie Meeks Miller as a member of the Human Services Advisory Board to fill
the unexpired term of office of Sharon Toliver-Hardy ending November 30,
2026;
Byron Hamlar as a member of the Board of Zoning Appeals to replace Betty
Jean Wolfe for a three-year term of office commencing January 1, 2025, and
ending December 31, 2027;
John Black as a member of the Roanoke Arts Commission to fill the unexpired
term of office of James Davis ending June 30, 2026; and
.Joshua Johnson as a member of the Gun Violence Prevention Commission to
fill the unexpired term of office of Dr. Eric Anderson ending March 31, 2025.

received the largest number of votes for Members of City Council.
Oaths of Office were administered on Monday, December 30, 2024, by the Honorable
Judges of the Twenty-Third Judicial Circuit, as follows:

Council and Vice-Mayor of the City of Roanoke.
WHEREAS, the Honorable S. Terry McGuire received the largest number of votes of any
candidate running for City Council in the regular Councilmanic election held on the first
Tuesday in November 2024, and was, therefore, elected Vice-Mayor of the City for a two-year
term, which will commence January 1, 2025, as provided by §4 of the Charter of the City of
Roanoke.
THEREFORE, BE IT RESOLVED by the Council of the City of Roanoke that the
Honorable S. Terry McGuire be, and he is, hereby recognized to be a duly elected member of the
Council of said City for a term commencing on the Pt day of January 2025, and continuing for a
period of four years, and until his successor has been elected and qualified, and to be the duly
elected Vice-Mayor of the City for a term commencing January 1, 2025, and continuing for a

A RESOLUTION establishing a meeting schedule for City Council commencing January 1,
2025, and terminating December 31, 2025.
BE IT RESOLVED by the Council of the City of Roanoke as follows:
1. This resolution establishes a schedule of regular meetings for City Council
commencing January 1, 2025, and terminating December 31, 2025.
2. City Council shall hold regular meetings on the first and third Mondays of each
month, at the following times of commencement:
(a) . Unless otherwise provided by resolution-of Council, each regular
meeting on the first Monday in each month shall commence at 9:00 a.m. for the
conduct of informal meetings, work sessions, or closed meetings. Thereafter,
Council shall take up the regular agenda at 2:00 p.m. Council may recess between
the 9:00 a.m. session and the 2:00 p.m. session. The organizational meeting of City
Council on the first meeting in January 2025, shall commence at 2:00 p.m. and
immediately following, Council shall take up the regular agenda.
(b) Unless otherwise provided by resolution of Council, each regular
meeting on the third Monday in each month shall commence at 2:00 p.m. for the
conduct of regular business. The second meeting of each month shall be recessed
upon the completion of all business except the conduct of public hearings, and such
meeting shall be reconvened at 7:00 p.m. on the same day for the conduct of public
hearings.
3. When any regularly scheduled Monday meeting shall fall on a holiday of the City,
such meeting shall be held on Tuesday next following.
4. All regular meetings of City Council shall be held in the Council Chamber, Room
450,of the Noel C.Taylor Municipal Building,unless otherwise provided by resolution of Council,
with the exception of the 9:00 a.m. session of the regular meeting on September 2, 2025, which
location has yet to be determined by the School Board, however, the meeting will begin at 9:00
a.m., and after recess, reconvene at Council Chamber.
5. City Council may prescribe a day or time other than that established by this resolution
or a meeting place other than that established by this resolution by adoption of a resolution
establishing a new meeting day,place or time. City Council shall cause a copy of such resolution to
be posted adjacent to the door of the Council Chamber and inserted in a newspaper having general
circulation in the City at least seven days prior to the date of the meeting at such amended day,time
or place.
6. This Resolution shall have no application to special meetings of City Council called
pursuant to Section 10 of the City Charter.

TAX RELIEF PROGRAMS
The City of Roanoke offers several tax relief programs to assist eligible residents:
1. Elderly Tax Freeze
Purpose: Stabilizes property taxes for elderly homeowners by freezing the assessed
value.
Eligibility:
• Age: 65+years.
• Residency: Principal residence.
• Income: Combined gross income< $51,200 (excludes $4,000 from other
residents and $7,500 of disability income).
• Net Worth: Combined net worth<$160,000 (excluding the home's value).
Application Period: April 1 —May 31.
2. Disability Tax Relief Program
Purpose: Provides property tax relief for homeowners with permanent disabilities by
freezing the assessed value.
Eligibility:
• Disability Status: Must certify total,permanent disability(under 65 years old).
• Residency: Principal residence.
• Income: Combined gross income<$51,200 (same exclusions as Elderly Tax
Freeze).
• Net Worth: Combined net worth<$160,000 (excluding the home's value).
Application Period: April 1 —May 31.
3.Veterans Tax Relief Program
Purpose: Exempts property taxes for qualified disabled veterans and their surviving
spouses.
Eligibility:
• Veteran Status: 100% service-connected,permanent, and total disability
(certified by VA).
• Residency: Principal residence.
• Surviving Spouse: Eligible if unmarried and residing in the home.
Application: Apply anytime during the year.

A RESOLUTION directing the City Attorney to petition the Circuit Court to issue an order
confirming that the remaining members of City Council for the City of Roanoke are authorized to appoint a
qualified voter from the City at large within 45 days of the office becoming vacant to fill the council seat

WHEREAS, Joseph L. Cobb was elected as Mayor of the City of Roanoke;
WHEREAS,Joseph L. Cobb still had two years remaining on his term as a council member for the
City of Roanoke:
WHEREAS,Joseph L. Cobb had to resign his seat on council to accept the position of Mayor for the
City of Roanoke;
WHEREAS,Joseph L. Cobb resigned as a council member for the City of Roanoke effective 11:59
pm on December 31, 2024 ("Date of Resignation");
WHEREAS,Mr. Cobb's term of office as a council member is set to expire on December 31,2026;
WHEREAS,Virginia Code §24.2-228 states that when a vacancy occurs in a local governing body
"the remaining members of the body or board,respectively,within 45 days of the office becoming vacant,
may appoint a qualified voter of the election district in which the vacancy occurred to fill the vacancy": and
WHEREAS, the remaining members of Council are desirous of filling the council seat vacated by
Joseph L. Cobb for the remainder of his unexpired term, through December 31, 2026.
THEREFORE, BE IT RESOLVED by the Council of the City of Roanoke that Council hereby
directs the City Attorney to Petition the Circuit Court asking that the Court issue an order confirming that
the remaining members of City Council for the City of Roanoke are authorized to appoint a qualified voter

ORDER
This cause is before the Court upon a petition filed by the City of Roanoke ("the City"), by
counsel,pursuant to the provisions of Virginia Code §§24.2-226 and 24.2-228.
Upon consideration of the petition,of any exhibits presented,and of the information furnished by
counsel for the City,the Court makes the following findings:
1. That having been elected as Mayor of the City of Roanoke, Joseph L. Cobb resigned his
seat as-a member of City Council of the City of Roanoke ("City of Roanoke") on December 30, 2024,
effective on December 31, 2024 at 11:59 pm.
2. The council seat vacated by Joseph L. Cobb had a term from January 1,2023 through
December 31,2026.
3. The next following regular councilmanic election for the council seat vacated by Joseph
L. Cobb is set for November 3, 2026.
4. Since the term of the Council seat vacated by Joseph L.Cobb is set to expire on December

5. Pursuant to Virginia Code§24.2-228, when a vacancy occurs in a local governing body
"the remaining members of the body or board,respectively,within 45 days of the office becoming vacant,

6. Section 4 of the City of Roanoke Charter,states that vacancies in the council shall be filled
for the remaining portion of the unexpired term within 30 days by a majority vote of the remaining
members of council.
7. Virginia Code§24.2-226C specifically provides:
Notwithstanding any provision of law or charter to the contrary, when an
interim appointment to a vacancy in any governing body or elected school
board has been made by the remaining members thereof,no election to fill
the vacancy shall be ordered or held if the general election at which it is to
be called is scheduled in the year in which the term expires.
8. City Council adopted Resolution No. 43120-010625, on January 7, 2025, directing the.
City Attorney to petition this Court to issue an order confirming that the remaining members of City
Council for the City of Roanoke are authorized to appoint a qualified voter from the City at large within
45 days of the office becoming vacant to fill the remaining portion of the unexpired term the council seat
vacated by Joseph L. Cobb; as provided in §4,Charter of the City of Roanoke,and Virginia Code§24.2-
226. .
9. City Council desires to appoint a qualified voter from the City at large within 45 days of
the office becoming vacant to fill the remaining portion of the unexpired term the council seat vacated
by Joseph L. Cobb for the remainder of his unexpired term through December 31,2026.
Upon consideration whereof, and in accordance with Virginia-Code §§24.2-226 and 24.2-228,
and §4 of the Charter for the City of Roanoke, the Court ADJUDGES, ORDERS and DECREES as
follows:
1. That the remaining members of City Council for the City of Roanoke are hereby
authorized to appoint a qualified voter from the City at large within 45 days of the office becoming vacant
