The Pledge of Allegiance to the Flag of the United States of America was led by Mayor Joseph L. Cobb. Welcome Certification of Closed Meeting. (6-0) ANNOUNCEMENTS: 2. PRESENTATIONS AND ACKNOWLEDGEMENTS: Mayor Cobb advised that, going forward, the 2:00 pm meeting would begin with the Council Members providing "shout-outs" or announcing community events recently attended. The Council Members made the following announcements: Council Member Hagen "shouted-out" the Roanoke Lebanese Festival held at St. Elias Maronite Catholic Church over the past weekend. Council Member Sanchez-Jones "shouted-out" the first responders that attended the tragic accident on Cove Road. Vice-Mayor McGuire thanked all teachers, administrators and parents in preparation for the last week of school and wished all students good luck. Council Member Nash made a plea to City residents to end drunk driving, noting that actions and decisions affect others' lives. Council Member Powers "shouted-out" the staff of the City Treasurer's Office and Commissioner of the Revenue's Office who, have been taking in and processing tax payments. She encouraged citizens to pay their taxes on time. Mayor Cobb recognized the 30th anniversary of the reopening of the Hotel Roanoke and Conference Center on Saturday evening, May 31, and extended gratitude to Brian Mann, Brian Wells, staff and partners of the hotel, who helped make the event successful; he also "shouted-out" TAP and all youth who created the No Cap Zone Teen Summit, which was held on Saturday, May 31; and acknowledged residents honored by the Roanoke Blacksburg Technology Council at the TechNite Awards where Marc Nelson, Director, Economic Development received the Ruby Award, Nancy Agee was inducted into the Hall of Fame, Aileen Helsel received the Regional Leadership Award and the Tiny Cargo Company received the Small Leading Tech Company Award. Proclamation declaring June 2025 as Pride Month. Vice-Mayor McGuire read and presented the proclamation to Marissa Yi, Vice-President, Roanoke Diversity Center, Board of Directors. 3. HEARING OF CITIZENS UPON PUBLIC MATTERS: The City Council sets this time as a priority for citizens to be heard. All matters will be referred to the City Manager for response, recommendation or report to the Council, as he may deem appropriate. Brian McConnell, appeared before the Council and spoke with regard to leading community health and well-being in a time of polycrisis. Betty Davis, appeared before the Council and spoke with regard to unfair property tax rates. 4. CONSENT AGENDA: APPROVED (6-0) All matters listed under the Consent Agenda are considered to be routine by Members of the City Council and will be enacted by one motion. There will be no separate discussion of the items. If discussion is desired, the item will be removed from the Consent Agenda and considered separately. C-1. The City Manager offered the following comments: I'd like to provide an update on our preparations for the upcoming pool season, including staffing efforts and the opening of our new facility. Staff have been working diligently to recruit and hire qualified lifeguards. Currently, we have nine lifeguard candidates in the hiring process, with six of them having officially accepted positions. Staff are continuing to collaborate closely with Human Resources to expedite the onboarding process, so these individuals can begin work as soon as possible. We're also pleased to report that most of our pool clerk positions—many of which are filled by teen apprentices—have been successfully staffed. However, despite these efforts, we are still experiencing staffing challenges. As a result, there is a significant possibility that the opening of Fallon Park Pool may be delayed. On a more positive note, we're excited to announce that the new Washington Park Pool is scheduled to open on Saturday, June 7, 2025. After extensive public input and thoughtful planning, this facility has been designed to meet a wide range of community needs. Features include a zero-entry area with splash features, a 14-foot water slide, three lap lanes, a lazy river, and more. We also invite you to join us for a ribbon-cutting ceremony on Friday, June 6, 2025, at 3:00 PM, just ahead of the pool's public opening. We appreciate your continued support as we prepare for a safe and successful summer season. Thank you. The Roanoke Police Department launched Operation Summer Shield, a strategic summer initiative focused on reducing violent crime through sustained and coordinated efforts. This initiative includes felony warrant apprehension, targeted traffic enforcement, and proactive criminal interdiction. The initial phase of the operation prioritizes the removal of violent offenders and repeat criminals prior to peak summer holiday activity. This will be carried out in partnership with the U.S. Marshals Service under Operation Summer Guardian, which targets the execution of violent felony and high-risk warrants, and in coordination with Probation and Parole for the pickup of absconders. To further deter criminal activity, high-visibility traffic enforcement will be implemented in collaboration with the Virginia State Police Motors. This joint effort will include saturation patrols in high-crime areas, DUI enforcement, occupant safety checks, and reckless driving suppression. In addition, downtown saturation patrols will take place on Friday and Saturday nights during peak bar hours to prevent fights, weapons violations, and disorderly conduct in the city's busiest nightlife area. Operation Summer Shield exemplifies the Roanoke Police Department's ongoing commitment to community safety and collaborative partnerships to ensure a safer summer for the Roanoke community. 2. On July 1, 2025, the City's tax abatement program that allows partial tax exemptions for rehabilitation of residential,commercial,and industrial real property(the"Program")will expire. The Program has historically been adopted by City Council in five-year increments,and was last adopted by City Council pursuant to Ordinance No. 41750-061520. The amount of the exemption is an amount equal to the difference in the value of the qualifying structure immediately before substantial rehabilitation,and immediately after substantial rehabilitation. Our office has been working with the Department of Real Estate Valuation to update and continue the Program for another five-year term upon its expiration,subject to approval by City Council.The proposed updates and amendments to the Program may be summarized as follows: Division 5 1. Section 32-93,Generally;termination of exemption program a. Extends the Program from July 1,2025 through July 1,2030. b. Lowers the Program application fee from$175 to$125 for single-family dwellings as required by state code. 2. Section 32-95,Eligibility of single-family dwelling real property. a. Conditions the property to be rehabilitated on being constructed no less than 30 years prior to the date of the application for exemption instead of January 1, 1979. b. Removes the requirement that the property must be assessed in the amount of $250,000 or less to qualify for the exemption. 1 3. Section 32-96, Eligibility of multi family dwelling, commercial, or mired use real property. Conditions the property to be rehabilitated on being constructed no less than 30 years prior to the date of the application for exemption. 4. Section 32-98,Application. a. Gives the director of real estate valuation the authority to accept applications after rehabilitation work has commenced provided such work has not been substantially completed. b. Removes the limitation that property taxes on all property the applicant owns be current to only the taxes on the property that is the subject of the rehabilitation be current. 5. Section 32-98.1,Eligibility. a. Removes the requirement that the property owner have no building code violations or other violations of city code pertaining to property maintenance for the exemption to remain in effect,as well as the exemption being lost if real estate taxes are not paid by December 31 or June 30. b. Adds a provision that allows the exemption to continue if the property is damaged after rehabilitation is completed that reduces the assessed value of the property to an amount lower than the value pre-rehabilitation value,provided the owner restores the property to its post-rehabilitation value during the remaining unexpired period of the exemption. 6. Section 32-99,Land Book. Removes reference to commissioner of revenue as the land book is now with real estate valuation. Division 5A-Exemption of Certain Rehabilitated or Renovated Commercial or Industrial Real Property Located in Enterprise Zone Two. This division is being deleted in its entirety as there is no longer an Enterprise Zone Two. Division 5B,Exemption of Certain Rehabilitated or Renovated Commercial Mixed-Use Commercial With No More than 80%Residential or Industrial Real Property Located in Enterprise Zone One A. With the removal of former Division 5A,Division 5B is proposed to be re-lettered as Division 5A,and renumbered as Sections 32-101.1 through Sections 32-101.8.Additionally,the proposed amendments are as follows: 1. Section 32-101.2,Rules and regulations for administration for division Removes references to commissioner of revenue. 2. Section 32-101.3.,Eligibility of commercial,mixed-use commercial,or mixed use real property. Removes requirement that property be constructed prior to January 1, 1970 to qualify and replaces it with the requirement that the property be thirty years or older. Division SC,Partial Tax Exemption in Redevelopment and Conservation Areas and Rehabilitation Districts. This division is proposed to be re-lettered as Division 5B. The proposed amendments are as follows: 1. Section 32-101.24,Amount of exemption. Removes the requirement that the property to be rehabilitated must be assessed at $250,000 or less,and increases the assessment threshold for properties located in CN Commercial-Neighborhood zoned districts from being under$800,000 to$1,000,000. 2. Section 32-101.25,Application. Removes the requirement that real estate taxes be current on all property owned by the applicant to being current on only the property to be rehabilitated. 3. Section 32-101.26,Eligibility. a. Removes the requirement that the property owner have no building code violations,or other violations of city code pertaining to property maintenance,for the exemption to remain in effect as well as the requirement that the owner not be delinquent in any real estate taxes owed the City. b. Adds a provision that allows the exemption to continue if the property is damaged after rehabilitation is made that reduces the assessed value of the property to an amount lower than the value pre-rehabilitation value,provided the owner restores the property to its post-rehabilitation value. Lastly,the Director of Real Estate Valuation proposes to add new Division 5C,Hotel Real Estate Tax Abatement Program.Succinctly,the purpose of this new division is to offset the approximate 500 hotel rooms that were lost since 2020 due to the pandemic.The exemption will apply to the increase in value from the rehabilitation or construction of a qualifying structure for 3 a term ranging from 5-15 years depending on whether the property is located in an enterprise zone,conservation district,or rehabilitation district.For the exemption to apply,the assessed value of the structure must be at least 120%of the media assessed value of comparable hotel properties in its class as determined by the director of real estate valuation. Once a total of 500 hotel rooms have been approved for abatement,the exemption provided under this division will sunset. Enactment of this division is expected to encourage the development of hotels in the City of Roanoke and lead to increased revenue. (b) This division shall terminate and no new applications for exemption shall be accepted on and after July 1, 2025 2030 unless reenacted.This provision shall not affect applications filed before that date,or the continued eligibility for exemption of properties approved before that date. (c) As used in this Division,the following terms shall have the following meanings: (1) Application fee means: a. One hundred seventy twenty-five dollars ( 40 $125) for an application seeking an exemption for a single-family dwelling;or b. Two hundred fifty dollars ($250.00) for each principal structure located on a parcel for any other application for an exemption. (2) Mixed use means a structure constructed and used as a structure for commercial and residential purposes. (3) Multi family dwelling means a residential dwelling constructed and used for more than one(1)residential unit,including two-family buildings and any other multi-family building. (4) Principal structure means any building or structure situated on a parcel that may be used for habitation by humans. (5) Single-family dwelling means a residential dwelling constructed and used entirely as a residence for the owner or tenant of the real property as a single-family residence. (6) Substantial rehabilitation means construction work performed on a structure proposed by the owner seeking an exemption under this division and shall include the substantial rehabilitation,renovation,or replacement of real property. (7) Value means the assessed value of the structure situated on the real property as determined by the director of real estate valuation for real estate taxation purposes. Sec.32-94.-Rules and regulations for administration of division. The director of real estate valuation,with the advice and comment of the city manager, shall adopt and promulgate such rules and regulations not inconsistent with the provisions of this division as are deemed necessary for the effective administration of this division. 2 Sec.32-95.-Eligibility of single-family dwelling real property. (a) In order to qualify for the exemption from real property taxation for real property substantially rehabilitated for single-family dwelling use,a structure shall meet all of the following criteria: (1) . The structure must have been constructed no less than thirty(30)years prior to the date of the application for exemption; (2) Be improved so as to increase the assessed value of the structure by no less than forty(40)percent;and (3) Be designed for and suitable solely for single-family dwelling use after completion of such improvement—and. (c) The exemption shall commence July 1 of the tax year following the date of completion as determined pursuant to section 32-98.1(b). Sec.32-96.-Eligibility of multi-family dwelling,commercial,or mixed use real property. (a) In order to qualify for the exemption from real property taxation for real property substantially rehabilitated for multi-family dwelling,commercial,or mixed use,a structure shall meet all of the following criteria: (1) Be constructed no less than thirty years prior to the date of the application for exemption ; (2) Be improved so as to increase the assessed value of the structure by no less than sixty(60)percent;and (3) Be improved without increasing the total square footage of such structure by more than one hundred(100)percent;and (4) Be designed for and suitable for multi-family dwelling, commercial, or mixed use after completion of such improvement. (b) If an exemption is granted for multi-family dwelling,commercial,or mixed use properties pursuant to this Division,no other exemption,including one pursuant to Division 5A and 5B,pertaining to enterprise zones,will be granted,even if the use of the property changes. 3 Sec.32-97.-Amount of exemption. The amount of the exemption from real property taxation provided for by this division shall be an amount equal to the difference in the value of the qualifying structure immediately before substantial rehabilitation and immediately after substantial rehabilitation. This amount only,on a fixed basis,shall constitute the exemption,notwithstanding subsequent assessment or reassessment. The exemption resulting from substantial rehabilitation of a qualifying structure shall commence on July 1st of the tax year following completion of the rehabilitation and shall run with the real estate for a period of five(5)years,and only one(1)exemption under this division may be applicable to any structure at any point in time. If the qualifying structure has been designated with either H-1,Historic District,or H-2,Neighborhood Preservation District,zoning overlay designations,or is located within an area designated as a conservation area or a rehabilitation district by the city,then the exemption shall run with real estate for a period of seven(7)years. Sec.32-98.-Application. (a) Application for exemption of substantially rehabilitated real property from taxation under this division shall be filed by the owner of such property with the director of real estate valuation prior to commencement of any rehabilitation work for which exemption is sought. Provided however, as long as the rehabilitation for such property has not been substantially completed,the director of real estate valuation may accept applications for exemption after such rehabilitation has commenced for reasonable cause as determined in their sole discretion.Each application for such exemption shall be accompanied by an application fee. If a property is being converted, and new and additional tax parcels will be created,an application fee shall be paid for each tax parcel.No property shall be eligible for such exemption unless all appropriate building permits have been acquired, the administrator of code enforcement has determined that the structure and the real property are in compliance with the state wide maintenance code as provided in section 7-5 of city code or will comply with all applicable provisions of the state wide maintenance code as provided in section 7-5 of city code upon completion of the rehabilitation indicated in the application,the director of real estate valuation has verified that the rehabilitation indicated on the application has been completed, and the administrator of code enforcement has determined that the structure and the real property are in compliance with the state wide maintenance code as provided in section 7-5 of city code. Furthermore, no property shall be eligible for such exemption if the director of real estate valuation or the administrator of code enforcement has been denied access to the entire premises either before or after the rehabilitation work for which exemption has been applied, for purposes of determining whether the required rehabilitation has been completed,determining the value of the structure before commencement of the required rehabilitation in the application and the value of the structure after completion of the required 4 rehabilitation,and determining compliance with the state wide maintenance code as provided in section 7-5 of city code. (b) The property owner shall submit an application for exemption under this division in the form created by the director of real estate valuation pursuant to section 32- 94 of city code. The application form shall include the acknowledgement and consent of the property owner that: (1) all real estate taxes owned by the property owner on the any real property for which the exemption is sought are fully paid and current; (2) the real property,including the structures,for which an exemption is sought is in compliance with all applicable ordinances,rules,and regulations of the city; (3) the director of real estate valuation shall have access to the real property and structures thereon for the purposes of determining the value of the structures prior to commencement of the required rehabilitation set forth in the application,the estimated value of the structures assuming completion of the required rehabilitation set forth in the application,compliance with the required rehabilitation as set forth in the application,and determination of the value of the structures after completion of the required rehabilitation; and (4) the administrator of code enforcement shall have access to the real property and the structures thereon to determine(i)compliance with all applicable ordinances,rules,and regulations of the city with respect maintenance and condition of the real property,including the structures;and(ii)compliance with all applicable ordinances,rules,and regulations of the city with respect to the maintenance and condition of the real property and the structures thereon after completion of the required rehabilitation. The application will also include the acknowledgement of the property owner that the property owner is responsible to satisfy the eligibility requirements set forth in section 32-98.1 after completion of the required rehabilitation. (c) The burden of proof shall be on the applicant to show that the property for which exemption has been filed complies with all the eligibility criteria established by this division. The director of real estate valuation may require documentary proof of eligibility, and, in such cases,documentation satisfactory to the director shall be presented. If a property which has qualified for exemption is damaged by fire or act of God or due to some other cause or condition such that the remaining value of the property is less than its original assessment before being rehabilitated,then the exemption shall cease.Provided however,if the condition that caused the value of the property to decrease is resolved such that the assessed value of the property returns to its original assessment after being rehabilitated, the exemption shall continue for the remaining unexpired period of the exemption. Sec.32-99.-Land book. Nothing in this division shall be construed as to permit the director of real estate valuation to list upon the land book any reduced value due to the exemption provided by this division. 6 Sec.32-100.-Demolition. Sec. 32 101.11. 32-101.3. - Eligibility of commercial, mixed-use commercial,or mixed use real property. (a) In order to qualify for the exemption from real property taxation for real property substantially rehabilitated or renovated for commercial,mixed-use commercial,or industrial use within Enterprise Zone One A, a structure shall meet all of the following criteria: (1) Be thirty(30)years or older and located within Enterprise Zone One A; (2) Be rehabilitated or renovated so as to increase the assessed value of the structure by at least fifty thousand dollars($50,000.00)or more; (3) Be designed for and suitable for commercial, mixed-use commercial, or industrial use after completion of such rehabilitation or renovation; (4) The structure has not received an exemption under Division 5,exemption of certain rehabilitated real property,or former Division 5A,exemption of certain rehabilitated or renovated commercial or industrial real property located in either Enterprise Zone One , of this chapter;and 10 (5) The rehabilitation or renovation must be completed by June 30 that first occurs two (2) years of the date of the filing of the application for exemption. (b) The types of substantial rehabilitation or renovation improvements that will be considered as increasing the assessed value are limited to those made to the actual qualifying structure only.Other improvements,fees,or costs will not be considered. (c) Any new additions to the qualifying structure or any additional square footage over the pre-rehabilitation or prerenovation square footage will not be considered as increasing the assessed value of the qualifying structure or eligible for or considered for the tax exemption since the purpose of this incentive is to encourage rehabilitation or renovation of existing structures. Sec.32 101.12.32-101.4.-Amount of exemption. The amount of exemption from real property taxation provided for by this division shall be an amount equal to the difference in the appraised value of the qualifying structure immediately before rehabilitation or renovation and immediately after rehabilitation or renovation as determined by the director of real estate valuation.This amount only,on a fixed basis, shall constitute the exemption, notwithstanding subsequent assessment or reassessment. The exemption resulting from substantial rehabilitation or renovation of a qualifying structure shall commence on July 1 of the tax year following completion of the rehabilitation or renovation within the period required by section 32-101.11(ax5) and approval of the application and shall run with the real estate for a period of seven(7)years from the date of the commencement of the exemption as set forth herein. Only one(1) exemption under this division may be applicable to any qualifying structure during the life of the qualifying structure. Furthermore, any qualifying structure which obtains an exemption under this division shall not be entitled to obtain an exemption under division 5, exemption of certain rehabilitated real property, of this chapter. The maximum total amount of tax abatement for any qualifying structure over the seven-year period shall not exceed a total of one hundred thousand dollars($100,000.00). Should the amount of tax abatement exceed the total of one hundred thousand dollars ($100,000.00) before the expiration of the seven-year period, the exemption shall end when the tax abatement reaches the one hundred thousand dollars($100,000.00)figure and real property taxes will be due on the increased assessed value previously exempted. Sec.32 101.13 32-101.5.-Application. (a) Application for exemption of substantially rehabilitated or renovated real property from taxation under this division shall be filed by the owner of such property with the director of real estate valuation prior to commencement of any rehabilitation or renovation work for which exemption is sought. (a) The director of real estate valuation shall,upon application made and within the limits as hereinafter provided, order the partial exemption from real property tax of real property upon which new structures or other improvements have been constructed within a redevelopment or conservation area,or a rehabilitation district established in the city. (b) The terms"application fee,""single-family dwelling,"and"value"as used in this division shall have the same respective meaning as these terms are defined in division 5. (c) This division shall terminate and no new applications for exemption shall be accepted on and after July 1, 2025 2030,unless reenacted.This provision shall not affect applications filed before that date,or the continued eligibility for exemption of properties approved before that date. 13 Sec.32-101.21.-Rules and regulations for administration of division. The director of real estate valuation,with the advice and comment of the city manager, shall adopt and promulgate such rules and regulations not inconsistent with the provisions of this division as are deemed necessary for the effective administration of this division. Sec.32-101.22.-Eligibility of residential real property. In order to qualify for the exemption from real property taxation for real property constructed for residential use,the new structure or other improvements must be designed for and used as a principal single-family dwelling structure, and uses accessory thereto. The structure must have an assessed value of at least one hundred twenty(120)percent of the median value of other residential structures in the neighborhood,as determined by the director of real estate valuation. Sec.32-101.23.-Eligibility of commercial real property. Other than real property constructed for single-family dwelling use, the only property eligible for the exemption provided by this division shall be commercial property in districts zoned CN-Neighborhood Commercial-Neighborhood. In order for such property to qualify, the new structure or other improvements must be designed for and used for purposes permitted in a CN district. Sec.32-101.24.-Amount of exemption. The amount of the exemption from real property taxation provided for by this division shall be an amount equal to the increase in assessed value resulting from the construction of the new structure or other improvement to the real estate,as determined by the director of real estate valuation. This amount only, on a fixed basis, shall constitute the exemption, notwithstanding subsequent assessment or reassessment. The exemption shall commence on July 1 of the year following completion of the new construction or improvements in accordance with section 32-101.26(b)and shall run with the real estate for a period of(i) seven(7)years for single-family dwelling structures, .tie . ate : ally ed at t ,and(ii)seven(7)years for structures in CN Commercial-Neighborhood zoned districts initially assessed at under one million dollars (R,00,000.00 $1,000,000) and five(5)years for such structures initially assessed at over this amount and only one(1)exemption under this division may be applicable to any real estate at any point in time. Sec.32-101.25.-Application. (a) Application for exemption of real property from taxation under this division shall be filed by the owner of such property with the director of real estate valuation after all required building permits are obtained and prior to any work being started on the subject property.Each application for such exemption shall be accompanied by an application fee. No property shall be eligible for such exemption unless all 14 appropriate building permits have been acquired and the director of real estate valuation has verified that the new structure or other improvements indicated on the application has been completed and a certificate of occupancy has been issued. Furthermore,no property shall be eligible for such exemption if the commissioner, director of real estate valuation,or the administrator of code enforcement has been denied access to the entire premises either before or after the work for which exemption has been applied,for purposes of determining whether the new structure or other improvements have been completed, for appraising the property, and determining compliance with the state wide maintenance code as required by section 7-5 of city code with respect to the maintenance and condition of real property,including structures. (b) The property owner shall submit an application for exemption under this division in the form created by the director of real estate valuation pursuant to section 32- 94 of city code. The application form shall include the acknowledgement and consent of the property owner that: (1) all real estate taxes owned by the property owner on any-the real property for which exemption is sought within-the-city are fully paid and current; (2) the real property,including the structures,for which an exemption is sought is in compliance with all applicable ordinances,rules,and regulations of the city; (3) the director of real estate valuation shall have access to the real property and structures thereon for the purposes of determining the value of the structures prior to commencement of the required rehabilitation set forth in the application,the estimated value of the structures assuming completion of the required rehabilitation set forth in the application,compliance with the required rehabilitation as set forth in the application,and determination of the value of the structures after completion of the required rehabilitation; and (4) the administrator of code enforcement shall have access to the real property and the structures thereon to determine(i)compliance with the state wide maintenance code as required by section 7-5 of city code with respect maintenance and condition of the real property,including the structures;and (ii)compliance with the state wide maintenance code as required by section 7-5 of city code with respect to the maintenance and condition of the real property and the structures thereon after completion of the required rehabilitation. (a) The purpose of this division is to restore Roanoke City's hotel room capacity by incentivizing new hotel development or other conversion of a commercial property that is not a hotel. The program is designed to offset the net loss of 500 hotel rooms since December 31, 2020 and support tourism, economic development, and revitalization efforts. (b) The program shall measure progress and eligibility based on the number of hotel rooms added or replaced since 2020,rather than the number of structures that are rehabilitated without adding to the number of hotel rooms lost since 2020. (c) This division shall apply only to projects that contribute verifiably to the replacement of hotel rooms lost since December 31, 2020, and the exemption provided herein shall only apply to new hotel rooms that are added as a result of new construction,or replacement of existing structures into hotel use. (d) This division shall terminate on the date that 500 hotel rooms have been approved under this program, or five 5 years have passed since the date of adoption of this ordinance, whichever date comes earliest. 17 Sec. 32-103.Definitions. As used in this Division: Hotel means a building or group of buildings offering lodging accommodations to the public for compensation, including extended stay hotels, motels, inns, and similar establishments. New hotel construction means a hotel developed from the ground up on previously vacant or redeveloped land. Program Administrators means the director of real estate valuation,and the city manager or their designee, which includes the director of economic development, who reports to and acts under the authority of the city manager. Substantial rehabilitation means the conversion of an existing structure that is not a hotel into a ftanctioning hotel. Sec. 32-104.Eligibility. (a) Substantial Rehabilitation: 1. The structure must be at least thirty(30)years old at the time of application. 2. The structure must be converted from a non-hotel structure use into a hotel. 3. Upon completion, the assessed value of the structure must be at least one hundred twenty(120)percent of the median assessed value of comparable hotel properties in its class as determined by the director of real estate valuation. 4. The development must increase the total number of rooms in the City of Roanoke lost since December 31, 2020. (b) New hotel eligibility: I. Upon completion, the assessed value of the new structure must be at least one hundred twenty (120) percent of the average assessed value of comparable hotels in its class. 2. The development must increase the total number of rooms in the City of Roanoke lost since December 31,2020 (c) General requirements: 1. All properties must comply with applicable zoning, building, and maintenance codes. 2. All real estate taxes trust be current on the proposed site or structure. 18 3. Any quaking parcel which obtains an exemption under this division 5C shall not be entitled to obtain an exemption under any other division of this chapter. Sec.32-105.Abatement terms. (a) The abatement shall apply only to the increase in assessed value of the improvement resulting from the qualifying construction or rehabilitation of a structure. (b) Duration: The exemption shall last: 1. Five(5)years citywide for all qual fi'ing properties. 2. An additional ten (10) years shall be granted for qualifying properties located within an Enterprise Zone,Conservation District,or Rehabilitation District. 3. No exemption provided under this division shall exceed fifteen(15)years. (c) The exemption shall begin July 1 following the completion of construction or rehabilitation as determined by the director of real estate valuation. (d) The tax abatement program shall remain in effect until a cumulative total of 500 hotel rooms has been approved for abatement,based on the number of rooms added or replaced through qualifying projects. Once the 500-room threshold is met, or July 1, 2030 arrives, whichever occurs earlier, the program shall be deemed concluded and this division shall terminate. Sec.32-106.Application procedures. (a) Application shall be made prior to commencement of construction or rehabilitation to the director of real estate valuation. (b) Each application shall include: 1. Proof of property ownership. 2. A detailed project plan,including cost,scope,and timeline. 3. Waiver policy—any of these components can be waived upon successful petitioning to the Program Administrators. (c) The application fee shall be S250.00 per commercial structure. (d) Construction must be completed within the following time period from the date of application: 1. Two(2)years for rehabilitation projects. 2. Three(3)years for new hotel construction. 19 (e) The director of real estate valuation and Program Administrators shall verify completion and eligibility. Sec. 32-107.Program administration and compliance. (a) The director of real estate valuation shall oversee assessments and valuations for qualii�ing projects. The Program Administrators shall ensure alignment with city economic goals. (b) Properties may be inspected at any stage to determine eligibility and compliance. (c) Property owners must submit income and expense reports to the director of real estate valuation. (d) An abatement may be revoked if.• 1. The property is not maintained in accordance with applicable building or maintenance codes; 2. The property is found to be non-compliant with the requirements of this division;or 3. The structure ceases to be used as a hotel. Sec.32-108.Special provisions—Room Replacement Focus. (a) Room-based replacement requirement. In cases where an existing hotel or motel is demolished,replaced, or undergoes expansion eligibility for tax abatement shall be based on room equivalency and the replacing hotel meeting the required 120% value threshold for similar hotel properties as determined by the director of real estate valuation. To qualify: 1. The demolished structure must have operated as a hotel or lodging facility since July 1,2020, and be 30 years or older. 2. The new construction must add hotel rooms beyond the number lost. Projects that do not increase the net room count will not be eligible. 3. The abatement shall only apply to the number of rooms exceeding the original room count. 4. The room count trust be supported by building plans and will be used to track the City's progress toward the 500-room program goal. (b) Historic properties. The law specifically addresses public contracts for information technology (IT) goods and services. The key provision is as follows: "No term or provision in any public contract for the acquisition of information technology goods or services shall be valid or enforceable to the extent that it is in conflict with Virginia law." This requirement ensures that all IT contracts entered into by public bodies, including local governments, are consistent with state law. The legislation was enacted to prevent the inclusion of contractual provisions that could undermine statutory protections, state policy, or public interests. The new code section provides that its requirements will only apply to a public body if its governing body has formally adopted these provisions as part of its procurement policies and procedures. The law becomes effective July 1, 2025. I recommend City Council consider amending Section 23.2-3, Procurement Authority, of the Code of the City of Roanoke to add language mirroring the state law's requirement that no IT contract may include terms inconsistent with Virginia law. Background: In 2019, the City applied for$133,500 in Stormwater Local Assistance Funds (SLAF) from the Virginia Department of Environmental Quality (DEQ)for the West Fork Carvins Stream Restoration Project. Initially proposed as a partnership with the Roanoke Regional Airport Commission (RRAC), the City continued the project independently after RRAC withdrew. The City completed a reduced-scope version of the project in spring 2024 using internal crews and existing matching funds from the Stormwater enterprise fund. DEQ has confirmed the project remains eligible for 50% reimbursement and has forwarded a grant agreement for execution. Considerations: City Council approval is required to accept the SLAF funds and to authorize execution of the grant agreement. Acceptance will enable the City to recover up to $133,500 in project costs. Recommended Action: 1. Background: In 2021, Parks and Recreation staff finalized an Amendment to the Mill Mountain Trails.Plan first adopted in 2006. The update sought to address progress on plan implementation; build on regional changes in outdoor recreation use and demand; identify opportunities for additions to the trail network; and to continue management guidelines that protect the natural resources of Mill Mountain Park. Staff formed a task force with volunteers and other stakeholder representatives to assess trail conditions and develop consensus around potential new trail projects. Progress on hand-building these new trails has proceeded since then at a steady pace with the continued cooperation of these dedicated staff and volunteers. The Roanoke Parks Foundation was established in 2022 as a non-profit to support the City of Roanoke's Parks and Recreation Department; its main focus is to improve quality of life for the City's residents and visitors alike by supporting the Department in realizing the goals of its 2019 Master Plan. In summer of 2023, the Foundation began planning for their first major capital project fundraising campaign, defining a scope to implement a significant number of the remaining unbuilt trails on Mill Mountain in an expedited timeline by hiring a specialty contractor. In early 2024, working with staff and an outside consultant, the Foundation developed proposed alignments to execute Corridors 5, 7, and 8 identified in the Mill Mountain Trails Plan Amendment. Corridor 5: This trail is a.connector from the alley off Ivy St roughly paralleling Riverland Road SE, intersecting with Wood Thrush just above the Riverland Road Trailhead lot. Corridor 5 was a second-tier priority in the Mill Mountain Trails Plan 2021 Amendment and provides an important multi-use off-road connection to access the east side of the trail system. Corridor 7A-D: Corridor 7 is planned to be a hub and spoke style layout, with trail connections from a central hub on the eastern side of the mountain radiating out to Wood Thrush Trail, Riverland Road Trailhead and Garden City neighborhood. The corridor is most feasible for machine-built, dedicated downhill mountain bike trails, and the Plan's Task Force recommended they be built as such. Corridor 7's hub and spoke style design was a top tier priority for construction—and the last remaining unbuilt trail at that priority level—in the Mill Mountain Trails Plan 2021 Amendment. This project will construct the climbing trail line to access the hub, as well as three 'spokes'—providing an easy, moderate, and challenging downhill line option. • Corridor 8: John Peake Pass This trail branches off of Sidewinder, connecting with Wood Thrush further north than Sidewinder and creating more loop options for trail users. Corridors 8 was a second-tier priority in the Mill Mountain Trails Plan 2021 Amendment and is multi-directional and multi- use. After a year of fundraising that far exceeded the group's original goal of$250,000, enabling the additional downhill lines to be incorporated into the scope, Black Diamond Designs was hired to construct the project in late 2024. Work began in March 2025, and the trails are expected to be completed in July 2025. Considerations: The names proposed by the Parks Foundation for the new Mill Mountain Trails funded by the group are as follows: Corridor 5: Turnpike Corridor 7A (climbing trail): 611 Corridor 7B (easy downhill mountain biking): Happy Camper Corridor 7C (moderate downhill mountain biking): Stoke City Corridor 7D (challenging downhill mountain biking): Bloodroot Corridor 8: John Peake Pass, named in memory of local cyclist John Peake and in recognition of his family's generous support of this project This review is just for consideration and approval of the trail names. NOW, THEREFORE,in consideration of the mutual benefits to be derived from this Agreement, the parties covenant and agree as follows: Section 1: Definitions 1.1. Automatic aid is hereby defined as the provision of emergency response and/or incident mitigation assistance from one jurisdiction to another jurisdiction by agreement.Automatic aid is provided on a regular, formalized basis when specific units from one jurisdiction are dispatched automatically to specific areas of another jurisdiction because of proximity. 1.2. Mutual aid is hereby defined as the provision of emergency response and/or incident mitigation assistance from one jurisdiction to another jurisdiction when the requesting jurisdiction has exceeded their emergency response capabilities. Mutual aid is provided on a case-by-case basis. 1.3. Technical adjustments are hereby defined as minor adjustments to the automatic aid provisions in this Agreement for the purpose of facilitating operational or procedural improvements that do not increase the overall scope or amount of automatic aid provided or received by the Agencies. Section 2: General Provisions 2.1. This Agreement shall supersede and replace all prior agreements between the City and County regarding mutual aid and the joint provision of fire and emergency medical responses. 2.2. All fire and emergency medical services and rescue personnel,agents and other employees of the parties to this Agreement who are providing fire and emergency services outside their jurisdiction pursuant to this Agreement, shall have the same powers,rights,privileges and immunities as provided by law in their home jurisdiction. 2.3 The services performed and expenditures made under this Agreement shall be deemed to be for public and governmental purposes and all immunities from liability enjoyed by the Page 2 of 8 City of Roanoke,Virginia/County of Roanoke,Virginia Fire and EMS Mutual Aid Agreement—2025 County and the City and their fire and emergency medical services and rescue personnel within their boundaries shall extend to their participation in this Agreement outside of their home jurisdiction. 2.4. All pension, disability, Workers' Compensation, life and health insurance and other benefits to which fire and emergency medical services and rescue personnel are entitled shall be extended to the services performed by such personnel under this Agreement. Each party agrees that provisions of these benefits shall remain the responsibility of the respective employer of the individuals assigned to provide the services. 2.5. Each party agrees that, in all activities undertaken pursuant to this Agreement, each party hereby waives any and all claims against the other party which may arise out of their activities outside their respective jurisdiction under this agreement. The parties shall not be liable to each other for reimbursement for injuries to or death of personnel or damage to equipment incurred when providing services pursuant to this Agreement, including when going to or returning from another jurisdiction.Neither party shall be liable to the other for any other costs associated with or arising from the provision of services or the rendering of assistance under this Agreement, except as specifically provided under this Agreement. 2.6. Each party shall indemnify and save harmless the other party from all claims by third parties for personal injury and death or property damage which may arise from activities under this Agreement outside their respective jurisdictions, to the extent permitted by law, as provided in §27-2, Code of Virginia, as amended. 2.7. The parties agree to develop and adopt operational, communication, dispatch, safety and medical protocols that meet professional standards. All operational protocols are to be mutually agreed upon in writing by the Fire Chiefs of the City and County. 2.8. The parties agree that the County will bill and retain the assets for ambulance transport services when they respond into the City. The parties agree that each jurisdiction will provide appropriate information such as Commonwealth of Virginia standardized Geographic Information System(GIS)maps that will be used in the dispatching of fire and emergency apparatus. Each Agency delegates authority to request mutual aid under this Agreement to their respective Emergency Communications or E-911 Center based on dispatch protocols approved by the Agency Chief in accordance with this Agreement. 2.12. The provision of mutual aid assistance shall not be mandatory under this Agreement; however, the requesting Agency shall be immediately notified if assistance is unavailable. Section 3: Automatic Aid Responses 3.1. The City will provide 24-hour/7 days a week 3rd due engine and 3rd due ambulance coverage from City Station 13 to the County in the North Lakes and Montclair areas designated as Individual Reporting Area(IRA) 502& 503 of the County. 3.2. If there has been no technical adjustments agreed to by both Agency Chiefs, or if there has been one or more technical adjustments and one or both parties to this agreement affirmatively determine not to incorporate those agreements into an amended agreement, then upon expiration of the Initial Term, this Agreement shall automatically renew for successive one (1)year periods (each, a "Renewal Term"),unless either party provides written notice of non-renewal to the other party at least ninety (90) days prior to the expiration of the then-current term. 6.4 Renewal Terms. Each Automatic Renewal Term shall be subject to the same terms and conditions set forth in this Agreement,unless otherwise agreed to in writing by both parties. 6.5. This agreement may be terminated by ninety (90) day written notice of termination to the other party.
