if they will be removed.
Council Member White suggested that the comments of Mr.
Jeffrey be referred to the City Manager, City Attorney and
Director of Finance.
A report recommending authorization to amend the 2000-01
Annual Consolidated Plan Annual Update and to execute a
2000-01 CDBG Subgrant Agreement with the Kuumba

Council Member Bestpitch commended Roanoke County for hosting
the first Roanoke Valley Social which was held on Saturday,
October 7, at Explore Park and asked that the City of Roanoke take
the initiative to reciprocate in the near future.

Council Member Wyatt commended officers of the Police Mounted
Patrol Unit who recently met with students from Westside
Elementary School. She advised that their participation speaks well
of the Police Department and its efforts to go above and beyond the
call of duty to be of assistance to Roanoke's citizens, regardless of
their age.

TIME FOR COUNCIL TO LISTEN. MATTERS REQUIRING

Mr. Martin Jeffrey, 517 Rutherford Avenue, N. W., advised that as a
taxpayer of Roanoke, he has decided to participate in his government
which says that it values citizen participation. He further advised that his
participation will be on behalf of those citizens who, for various reasons,
cannot attend afternoon Council sessions to raise legitimate questions that
deserve a response by Council. He expressed concern regarding the
limited amount of time allotted to citizens to make their
comments/presentations before Council.

HEARING OF CITIZENS UPON PUBLIC MATTERS:
Request to discuss community and Police Department issues. Mr.
Wayne Jones, 127 Patton Avenue, N. W.
Mr. Jones addressed the issue of alleged police misconduct and
encouraged an investigation by the Citizen Review Panel
regarding problems between the Police Department and the
community.
Mr. Martin Jeffrey, 517 Rutherford Avenue, N. W., spoke with
regard to the James Minor motorcycle accident. He advised that
there are other witnesses to the police chase who will testify that
they observed police cruisers following Mr. Minor on to the 1100
block of Hanover Avenue where he met his death, and there are
other inconsistencies that witnesses will divulge to the
appropriate body. He called attention to a recommendation by
the City Manager regarding the appointment of a Citizen Review
Panel and requested that the panel, which will consist of police
officers and citizens, be activated to review all information
regarding the Minor accident to insure that there has been an
objective review.
The remarks were referred to the City Manager.

regard to the investigation into the death of her nephew, James Minor. In
light of certain alleged discrepancies in the investigation, she requested
that the matter be referred to the Citizen Review Panel for investigation.
She further requested that the following information be provided to the
Minor family:
Copy of the investigative reports prepared by police officers,
An account of the accident and the chase,
The emergency call report and the autopsy report,
All photographs of the accident scene and all other photographs pertaining
to the case,
A report on the motorcycle which was involved in the accident,
Names of all police officers involved in the case,
Copy of the report by Donald L. Stokes, witness to the accident.

~Vlr. Carl Cooper, 2120 Carroll Avenue, N. W., commended the City on
approving the Capital Maintenance and Equipment Replacement Program
budget which included 24 video cameras to be installed in police vehicles.
He suggested that once the video cameras are turned on, they should
remain on throughout the police encounter.

.,/Ms. Wanda Butler, 613 Milton Street, N. W., referred to alleged police
misconduct when officers were called to her residence to investigate a
domestic dispute.

Mr. Bryon Casey, 3741 Signal Hill Avenue, N. W. requested copy of the
video tape of the James Minor motorcycle accident. He questioned the
statement of the Police Department that a full investigation was conducted
when the vehicle that was involved in the accident is located in the City of
Salem and the motorcycle is located in the City of Roanoke. He alleged

that the Police Department's witness did not have a valid driver's license
or automobile insurance coverage on his vehicle, however, the individual
was not charged by police officers for these violations.

WHEREAS, Kit B. Kiser received his Degree in Civil Engineering from Virginia
Polytechnic Institute and State University and earned graduate credits in Hydrology; and
he served with the United States Corps of Engineers from October 1965-1967; and
WHE~S, Mr. Kiser was employed by the Roanoke City Water Department as
Utilities Engineer on November 1, 1967; he was promoted to Water Department Manager
on December 16, 1970, to Director of Utilities and Operations on July 1, 1973, and to his
present position as Assistant City Manager for Operations on July 1, 2000; and
WHEREAS, Mr. Kiser is a licensed Professional Engineer; he holds a Class I
Waterworks Operator License and is a lifetime member of the ~4merican Water Works
~4ssociation; he has served on various boards and committees, including the Roanoke Valley
Regional Solid Waste Management Board, Roanoke Regional Airport Commission, Roanoke
Valley Resource Authority, Chairman of the Flood Plain Committee, and a long-term City .
staff member assigned to work with the Water Resources Committee; and
WHEREAS, Mr. Kiser served as overseer of construction of the original Wastewater
Treatment Plant, and, legend goes, that he was so pleased with the purity effluent from the
plant that he volunteered to drink a glass of the water at the grand opening; and
WHEREAS, Mr. Kiser has been known to tnmt (or at least look for his lost h. unting
dogs) all night and report to work refreshed the next morning; and
WItEREA~, Mr. Kiser will retire from service with the City of Roanoke on October 31,
2000, after a long and distinguished career spanning a period of thirty-three years.

SUBJECT: Williamson Road Service District
On April 17, 2000, Mr. John L. Huffman addressed City Council regarding
his desire to be removed from the Williamson Road Service District. He objected
to paying the extra 10 cents per 100 dollars on his real estate to support the
efforts of the Williamson Road Area Business Association (VVRABA).
William C. Hackworth, City Attorney, was asked to deliver an opinion on
whether the service district lines could be redrawn to remove Mr. Huffman's
property. Mr. Hackworth's opinion stated City Council could make a legislative
decision to realign the district if it concluded Mr. Huffman's property would not
benefit from the imposition of this special tax. The purpose of the tax, as stated
in Ordinance No. 31472, adopted on May 24, 1993, was to further "economic and
business development and promotional activities intended to foster business
retention, business recruitment and developer recruitment, planning for the
revitalization of the Williamson Road area," and the many other public purposes
set out in the State enabling legislation.
After reviewing the properties in the service district and the work plan of
WP, ABA, it is recommended that Council not redraw the service district
boundaries. The city will soon break ground on the first phase of the Williamson
Road revitalization plan, eventually resulting in an improved gateway and
enhanced appearance of the entire corridor. In addition, WP, ABA is setting up a
business development center, sponsoring a School's Out for Summer (SOS)
event at Breckinridge Middle School on June 17, 2000, conducting a survey on
business needs in the area, providing monthly luncheons on business topics,
promoting the area through its web page, beginning a long range planning
process to coincide with the city's comprehensive plan, and working with the
neighborhood organization, the Williamson Road Action Forum, to participate in a

neighborhood plan for the area. Each of these projects could benefit Mr.
Huffman's business.
It is also a concern that redrawing the boundaries to appease one property
owner could result in constant requests from other owners, not just in the
Williamson Road area, but in the downtown service district as well. Both
WP, ABA and Downtown Roanoke Inc. (DRI) benefit all businesses in their
respective districts. Reducing their available funds by eliminating properties in
their districts is not warranted at this time.

relocation of modular units, the replacement of maintenance vehicles,
asbestos abatement, roof replacement, handicap access, Magnet School
improvements, and elementary school improvements.

improvements to Fairview Elementary School. The funds will provide for
construction costs, architect and engineering fees, and a contingency
reserve.

A RESOLUTION authorizing the School Board for the City of Roanoke to expend funds for

WHEREAS, by Resolution No. 34807-051500 the School Board for the City of Roanoke was
authorized to expend funds out of the City's capital improvement fund of up to $2.0 million for the
cost of adding to and improving the present school building at Fairview Elementary School; and
WHEREAS, additional work will be required at Fairview Elementary School increasing the
needed amount to complete the project to $2.75 million.
BE IT RESOLVED by the Council of the City of Roanoke that:
1. The School Board of the City of Roanoke is authorized to expend out of the City's
capital improvement fund up to $2.75 million for the cost of adding to and improving the present
school building at Fairview Elementary School ("the Project").
2. In accordance with U. S. Treasury Regulations {}1.150-2, it is hereby declared that the
City reasonably expects to reimburse capital expenditures and bond issuance costs for the Project
with proceeds of an obligation or obligations to be incurred by the School Board and/or the City.
The maximum principal amount of debt expected to be issued for the Project is $2.75 million.
3. This is a declaration of official intent under Treasury Regulation § 1.150-2.

A RESOLUTION authorizing the School Board for the City of Roanoke to make application
for a loan from the State Literary Fund for modemizing Fairview Elementary School.
WHEREAS, the School Board for the City of Roanoke, on the 16th day of October, 2000,
presented to this Council an application addressed to the State Board of Education of Virginia for
the purpose of borrowing from the Literary Fund $2.75 million, for adding to and improving the
present school building at the Fairview Elementary School, to be paid in twenty (20) annual
installments, and the interest thereon at four percent (4%) paid annually.
BE IT RESOLVED that the application of the City School Board to the State Board of
Education of Virginia for a loan of $2.75 million from the Literary Fund is hereby APPROVED, and
authority is hereby granted the said City School Board to borrow the said amount for the purpose set
out in said application.
The Council of the City of Roanoke will each year during the life of this loan, at the time it
fixes the regular levies, fix a rate of levy for schools or make a cash appropriation sufficient for
appropriation expenses and to pay this loan in annual installments and the interest thereon, as
required by law regulating loans from the Literary Fund.

Dear Members of Council:
As the result of official School Board action at its meeting on October
10, 2000, the Board requests City Council to approve a revised Literary Fund
loan application in the amount of $2.75 million for the Fairview Elementary
School project.
The overall project cost for the Fairview and Fishburn Park Elementary
School projects is $4.6 million based on bids received last week. The total
project cost for both schools is $400,000 less than the $5.0 million estimate
for Literary Fund loans on the projects included in the School Board's May
2000 Capital Improvement Plan. The increase in the Literary Fund loan
amount will fund the cost of additional work required for the Fairview project.
City Council is being asked to appropriate only $2.35 million of the
$2.75 million Fairview Literary Fund loan request. The remaining $400,000
of the Literary Fund loan request will not be appropriated at this time. It only
will be requested for appropriation if unforeseen additional work is required
during project construction.
State Literary Fund loan regulations provide for the repayment of loans
based on the total amount appropriated and expended by the locality. The
amount of Literary Fund loans authorized but not expended for a project is
simply canceled by the State on final close-out of the project.

that may be applicable to any of such debt obligations) (such debt obligations, the "Bonds"); and
WHEREAS, the City intends to issue a portion of the Bonds to finance certain equipment
included in the Project as "qualified zone academy bonds" within the meaning of Section 1397E of
the Internal Revenue Code.

to request Roanoke City Council to issue General Obligation Qualified Zone Academy
Bonds (QZAB) in an aggregate principal amount not to exceed $1,291,618. The
funds will be used to reconstruct and equip the Roanoke Academy for Mathematics
and Science.
The QZAB initiative is a federal program that allows lending institutions and
schools to form a mutually beneficial partnership to support education. The program
offers bonds interest-free and allows a bank or other lending institution to purchase
the special no-interest bond on behalf of a school. Schools qualify based on their
percentage of free lunch students.

portion of the cost of the Project, (iii) requests that the City Council of
the City of Roanoke, Virginia, (the "City") authorize the City to issue its

Drive corridor. Alternative solutions included (1) two-way traffic with a cul-de-sac at
Franklin Road; (2) making the road one-way; (3) closing the read to automobiles; (4)
restoring two-way thru traffic with an off-read recreational trail; and (5) stopping through-
traffic by splitting the read into two culs-de-sac in Smith Park. Each of these alternatives
includes the off-read trail that is planned as part of the Roanoke River Flood Reduction
Project.
At the same time, the Roanoke River Sewer Interceptor Project was progressing to the
vicinity of Smith Park. Construction of the interceptor in Smith Park was never intended
to close Wiley Drive; in fact, the first leg of the Roanoke River Greenway Trail was built
through Smith Park largely to provide access to the park during this construction.
Unfortunately, engineering issues necessitated the temporary closing of Wiley Drive
between in January 1999. Originally, staff expected to reopen the road in just a few
months.
On June 22, 2000, the City hosted the third public workshop to present a
recommendation favoring the first alternative and seeking public comments. About fifty
citizens attended, and thirty left written comments. Most of the interaction was positive
and upbeat. Although no alternative could be called the consensus choice, two-way thru
traffic seemed to have the strongest apparent support of all.
As a result, staff recommended implementing this plan with two-way thru traffic and
traffic-calming measures as part of the current Capital Improvements Program project
for park improvements. A budget for the project was prepared by a subcommittee of the
Citizen Advisory Committee for the Comprehensive Parks & Recreation Master Plan,
and the CAC supported using these bond funds for this project. Council appropriated
funding for the implementation at the regular 2:00 p.m. meeting on August 21, 2000
(Ordinance # 35023-082100; Account #008-620-9741-9001).

During the October 2 City Council meeting, a number of citizens voiced both support
and opposition for re-opening Smith Park. In addition, numerous e-mails, voice mails
and letters have been received by the City Manager's office on this issue.
Considerations:
This project has generated concerns from a wide range of interest groups.
Commuters want to start using the roadway again.
Naturalists have expressed an appreciation for the vehicle-free setting.
The Civitan Club donated about $50,000 for the Unified Playground in Smith Park
in 1993. This playground was the City's first fully handicap-accessible
playground.
The physically challenged have expressed concern about losing the ability to see
the river in a park setting.
The Corps of Engineers has been planning a handicap-accessible fishing site
along the Roanoke River.
Seniors and families with small children want easy access to the facilities of
Smith Park.
Walkers, bicyclists and greenway advocates have expressed a hope that Smith
Park can be a vehicle-free node along the Roanoke River Greenway. Some have
also expressed misgivings about traffic calming.
Fishers want easy access to fishing sites in Smith Park; some of these fishers are
disabled or have disabled family members.
In summary, citizens have shown a great interest in protecting the park experience and
the beauty of the river corridor while providing access to the river and the recreational
features of Smith Park.
Staff has been moving to implement the two-way thru traffic, traffic-calming measures,
and the off-road trail. We are in contract negotiations with Hill Studio, PC, which was
involved in the workshop process, for the development of construction documents.

Recommended Action:
Staff should proceed with the recommendation to implement the plan involving two-way
thru traffic with traffic-calming measures and the off-road trail in order to permit all
citizens access to the park and this drive.

Background:
In May 2000, funding needs for environmental commitments related to the Consent
Agreements and clean-up at the Public Works Service Center (PWSC) were identified.
The City continues to work with the state Department of Environmental Quality and the
federal Environmental Protection Agency to bring this matter to a close.
Considerations:
$477,911 was included in General Fund Transfer to Capital Projects Fund account in the
adopted budget, and $60,000 was included in the Capital Maintenance and Equipment
Replacement Program (CMERP) for FY 2000-01 to help meet our legal commitments for
the current fiscal year. Council action is needed to appropriate these funds to the PWSC
project.
To cover legal commitments of the PWSC project in FY 1999-00, $296,182 was transferred
from the Roanoke River Flood Reduction Project and must be repaid. $97,911 of this is
being repaid via this report. The remaining $198,271 to be replenished to this account will
be provided from Transfer to Capital during FY 2001-02.

Agreement with the Kuumba Community Health and
Wellness Center (Kuumba)
Background:
Each year, the City submits a Consolidated Plan Annual Update (Annual Update) to the
U.S. Department of Housing and Urban Department (HUD) in order to receive
Community Development Block grant (CDBG) and HOME Investment Partnerships
(HOME) entitlements. The Annual Update describes the individual programs to be
conducted with the funds awarded to the City. Substantial amendments to the Annual
Update require a 30-day public comment period before the change can be
implemented. The public comment period began with a newspaper advertisement on
October 4, 2000 and ends November 2, 2000.
Considerations:
Kuumba has requested financial assistance for the development of its Community
Health and Wellness Center located at 3716 Melrose Avenue, NW. The Center will
provide primary family health care, health education, assistance in obtaining
medications, patient case management and preventive care counseling to residents in
this under served area. A subgrant agreement with Kuumba is necessary in order to
provide funding for Kuumba. Funding is available in Account No. 035-G01-0140-5189
in the amount of $55,000 to be transferred to an account to be established by the
Director of Finance.
Recommended Action:
Authorize the City Manager to amend the 2000-01 Annual Update to reflect the
inclusion of the Kuumba program, and to execute documents in connection with said
amendment, following the public review and comment period provided no compelling
adverse public comments are received, and authorize the City Manager to execute a
CDBG Subgrant Agreement with Kuumba, approved as to form by the City Attorney,
similar in content to Attachment 1.
Transfer $55,000 from 035-G01-0140-5189 to an account to be established by the
Director of Finance.

34880-061900 appropriated funds therefore; and
WHEREAS, the Grantee has been authorized by its City Council pursuant to Resolution
No. XXXXX-101600, adopted October 16, 2000, to provide Fifty-Five Thousand and
00/100 Dollars ($55,000) in Community Development Block Grant funds as part of its
Kuumba Community Center program.
NOW, THEREFORE, the parties hereto mutually agree as follows:
1. SCOPE OF SERVICES:
The Subgrantee shall develop a Community Health and Wellness Center located
at 3716 Melrose Avenue, in the Grantee's northwest quadrant. The Subgrantee
shall provide health and health-related services to this under served area. In
particular, the 24016 and 24017 zip code areas within the northwest quadrant will
be targeted, serving approximately 100 individuals. Service will include primary
family health care, health education, assistance in obtaining medications, patient
case management, healthy well-being and preventive care counseling. This
activity will benefit Iow- and moderate-income persons and meet a Broad
National Objective based on "nature and location".
2. TIME OF PERFORMANCE:
This agreement shall be for the period of July 1, 2000 through June 30, 2001.
3. BUDGET:
The total amount of CDBG funds used for this project shall not exceed $55,000.
Funds shall provide for the purchase of health and medical equipment.

All funding to be provided under this Agreement is contingent upon necessary
appropriations by Congress and from the U.S. Department of Housing and Urban
Development (HUD).
PROPOSED PAYMENTSCHEDULE AND PROCEDURES:
This is a cost reimbursement contract. Requests for payment will be submitted
to the Office of Grants Compliance, 541 Luck Avenue, S.W., Suite 221, Roanoke
Virginia, for initial review and approval for payment. Funds will be disbursed
monthly, as needed. Payment will be made to the Subgrantee within ten (10)
days from date of receipt, subject to the approval of the Grantee. Approval of
each reimbursement request will be subject to CDBG eligibility and timely receipt
of the monthly reports as detailed in Paragraph 10. The Grantee reserves the
right to refuse payment to the Subgrantee in the event that the Subgrantee
submits a reimbursement request sixty (60) calendar days from the contract
expiration date.
SECTION 504:
The Subgrantee agrees to comply with any federal regulation issued pursuant to
compliance with the Section 504 of the Rehabilitation Act of 1973, as amended
which prohibits discrimination against the disabled in any federal assisted
program.
INDEMNIFICATION:
Subgrantee agrees and binds itself and its successors and assigns to indemnify,
keep and hold the City and its officers, employees, agents, volunteers and
representatives free and harmless from any liability on account of any injury or
damage of any type to any person or property growing out of or directly or
indirectly resulting from any act or omission of Subgrantee including: (a)
Subgrantee use of the streets or sidewalks of the City or other public property;
(b) the performance under this Agreement; (c) the exercise of any right or
privilege granted by or under this Agreement; or (d) the failure, refusal or neglect
of Subgrantee to perform any duty imposed upon or assumed by Subgrantee by
or under this Agreement. In the event that any suit or proceeding shall be
brought against the City or any of its officers, employees, agents, volunteers or
representatives at law or in equity, either independently or jointly with Subgrantee
on account thereof, Subgrantee upon notice given to it by the City or any of its
officers, employees, agents, volunteers or representatives, will pay all costs of
defending the City or any of its officers, employees, agents, volunteers or
representatives in any such action or other proceeding. In the event of any
settlement or any final judgement being awarded against the City or any or its
officers, employees, agents, volunteers or representatives, either independently
or jointly with Subgrantee then Subgrantee will pay such settlement or judgement
in full or will comply with such decree, pay all costs and expenses of whatsoever
nature and hold the City or any of its officers, employees, agents, volunteers or
representatives harmless therefrom.

COMPLIANCE WITH FEDERAL REGULATIONS:
The Subgrantee agrees to abide by the HUD conditions for CDBG programs as
set forth in Attachment A and all other applicable federal regulations relating to
specific programs performed hereunder. Further, the Subgrantee agrees to
require compliance with applicable federal regulations of the contractor by
agreement.
UNIFORM ADMINISTRATIVE REQUIREMENTS:
The Subgrantee shall comply with the requirements and standards of OMB
Circular No. A-122, "Cost Principles for Non -Profit Organizations" and within the
following attachments to OMB Circular A-110.
PROGRAM INCOME:
"Program income" means gross income received by the Grantee or Subgrantee
directly generated from the use of CDBG funds. Program income from any and
all sources shall be submitted to the Grantee within five (5) days of its receipt by
the Subgrantee. No program income is expected.
RECORDS AND REPORTS:
The Subgrantee shall maintain full and accurate records with respect to all
matters covered under this Agreement. All records pertaining to this Agreement
and the services performed pursuant to it, shall be retained for a period of four
(4) years after the expiration date of this Agreement or its Amendments.
Appropriate City and/or HUD personnel shall have free access to those records
during the agreement duration and the following four-year time period.
CONFLICT OF INTEREST:
No employee, agent, consultant, officer or appointed official of the Subgrantee,
who is in a position to participate in a decision-making process or gain inside
information with regard to any CDBG activity, may obtain a personal or financial
interest in any contract, subcontract or agreement with respect thereto, or in the
proceeds thereunder, either for themselves, their family, or business associates,
during their tenure or for one (1) year thereafter.

with any term of this award, and the award may be terminated for convenience
by the Grantee or Subgrantee upon written notification to the awarding agency

REVERSION OF ASSETS:
Upon expiration of this Agreement, or amendments thereto, the Subgrantee shall
transfer to the Grantee any CDBG funds or program income on hand at the time
of expiration and any accounts receivable attributable to the use of CDBG funds.
THIRD-PARTY CONTRACTS:
The Grantee shall not be obligated or liable hereunder to any party other than the
Subgrantee.
ANTI-LOBBYING:
To the best of the Subgrantee's knowledge and belief, no federal appropriated
funds have been paid or will be paid, by or on behalf of it, to any persons for
influencing or attempting to influence an officer or employee of any agency, a
Member of Congress, an office or employee of Congress, or an employee of a
Member of congress in connections with the awarding of any Federal contract,
the making of any Federal grant, the making of any Federal loan, the entering
into of any cooperative agreement, and the extension, continuation, renewal,
amendment, or modification of any Federal contract, grant, loan, or cooperative
agreement. If any funds other than Federal funds have been paid or will be paid
to any person for influencing or attempting to influence an officer or employee of

employee of a Member of Congress in connection with this agreement, the
Subgrantee will complete and submit Standard Form-LLL, "Disclosure Form to

ENTIRE AGREEMENT:
This Agreement, including all of its Exhibits, represents the entire agreement
between the parties and this Agreement shall not be modified, amended, altered
or changed, except by written agreement executed by the parties.
GOVERNING LAW:
This Agreement shall be governed by laws of the Commonwealth of Virginia.

Subject: Appropriation of Funds - Homeless Assistance Team
Background:
The Roanoke Valley Task Force on Homelessness appointed by the City Manager in 1987
established a vision to reduce the incidence and prevalence of homelessness in the
Roanoke Valley. Since that time, many programs have been developed to address the
issue of homelessness, including the establishment of the Homeless Assistance Team
(HAT).
In 1997, the City of Roanoke received grant funds from the U. S. Department of Housing
and Urban Development (HUD) to provide supportive services to the homeless. The
current grant, in the amount of $433,656, was renewed in February 2000, for an additional
three-year period. The grant funds provide for three full-time employees as follows:

The current grant provides only for medical and dental benefits for these full-time
employees. No additional HUD funding is available until the year 2003. The City is
requesting local funds to cover the costs of life insurance, disability insurance, retirement
and paid leave benefits as afforded other employees. The total cost to provide these
benefits for the remainder of the grant cycle is $33,779 (a calculation worksheet is
attached). Funding is available in State and Local Hospitalization, Account 001-630-5330-
2010.
Considerations:
The continuance of these positions is dependent upon grant fund renewal. Upon
completion of the three-year grant period, funds will be requested through HUD to continue
to provide funding for the HAT program, as well as funding to cover employee fringe
benefits.

Mr. John Baker, technical advisor at the HUD field office, has indicated that these benefits
can be provided to full-time HAT employees as a part of the City's local matching funds.
There are no amendments to the grant that must be filed in order to facilitate this action.
Recommended Action:
Appropriate funds in the amount of $33,779 from the State and Local Hospitalization
Program, Account No. 001-630-5330-2010, to grant fund revenue and expenditure
accounts as indicated on the attachment to provide funding for full benefits for the three
full-time employees.

School Representative for Roanoke Interagency Council
City Council adopted Resolution No. 31301-011193 to establish a Community
Policy and Management Team (CPMT) for Roanoke, pursuant to the
Comprehensive Services Act for At-Risk Youth and Families; appointing the
membership of such team; providing for the powers and duties of the team; and
designating legal counsel and a fiscal agent, effective January 1, 1993.
Section 2.1-751 of the Code of Virginia (1950), as amended, requires the CPMT
to appoint representatives of certain agencies, including the community services
board, juvenile court services unit, department of health, department of social
services, and the local school division. When City Council established the CPMT,
the representatives from the member agencies were named by position and not
by naming an individual.
According to the resolution of Council, the school representative to the CPMT is
the Director of Special Services. An administrative reorganization in the Roanoke
City Schools shifted CPMT responsibility to the Assistant Superintendent for
Instructional Services and Learning Organizations.
Considerations:
Council needs to amend the resolution creating the CPMT to accurately reflect the
change in the title of the school representative on the RIC.

Background:
The Fifth District Disability Services Board (DSB) is responsible to local governments and
serves as a critical resource for needs assessment, information sharing and service
opportunities for citizens with disabilities, their families and the community. The following
jurisdictions in the Fifth Planning District have enacted resolutions establishing their
participation in a regional effort and have appointed a local official to serve: the cities of
Roanoke, Salem, Covington, Clifton Forge; counties of Roanoke, Craig, Botetourt, and
Allegheny and the Town of Vinton. Other members of the DSB include representatives
from business and consumers.
City Council authorized the Director of Finance to serve as fiscal agent for the Fifth
Planning District Disabilities Services Board on September 25, 1995, Resolution No.
32675-092595.
Funds in the amount of $10,973 have been allocated to the Fifth District DSB by the State
Department of Rehabilitative Services to the Blue Ridge Independent Living Center. (See
Attachment "A"). The Blue Ridge Independent Living Center will provide a local cash
match of $1,219.
Funds will be to create a loan closet for use by people with physical and/or sensory
disabilities. The loan closet will provide individuals with physical and/or sensory disabilities
who reside throughout the Fifth Planning District an opportunity to utilize a variety of
assistive devices to determine whether the device meets their need before actual
purchase. Items will include side stepper cane/walker, electric wheelchair, transfer boards
and other equipment. These devices will be provided to individuals on an emergency or
temporary basis.

BE IT ORDAINED by the Council of the City of Roanoke as follows:
1. Section 32-282.2, Penalty for late remittance, of Article XIII, Special Tax on
Consumers of Local Telephone Service, of Chapter 32, Taxation, of the Code of the City of
Roanoke, (1979), as amended, is hereby amended and reordained to read and provide as follows:
Sec. 32-282.2 Penal _ty for late remittance
If any seller shall fail or refuse to remit to the treasurer the tax required to be
collected and paid under this article, within the time specified by section 32-277 and
in the amount specified in this article, or the report required to be submitted under
this article, there shall be added to such tax by the director of finance a penalty often
percent (10%) of the amount of the tax.
2. Section 32-180, Failure to remit, of Article VII.I, Tax on Purchase of Utili_ty
Services, of Chapter 32, Taxation, of the Code of the City of Roanoke (1979), as amended, is hereby
amended and reordained to read and provide as follows:

If any person shall fail or refuse to submit to the treasurer the tax required to
be collected and paid under this article, within the time and in the amount specified
in this article, or the report required to be submitted under this article, there shall be

4. The City Clerk is directed to send forthwith an attested copy of this ordinance, by
certified mail, to the registered agent of every utility corporation and telephone company affected
by this ordinance, in conformance with {} 58.1-3814. B., Code of Virginia.
5. In order to provide for the usual daily operation of the municipal government, an
emergency is deemed to exist, and this ordinance shall be in full force and effect upon its passage.

Subject: Amendment to Ordinance relating to Special Tax on Consumers of Local
Telephone Service and to the Tax on Purchase of Utility Services
Background:
In addition to the Special Tax on Consumers of Local Telephone Service ( the "E-911 Tax") and
the Tax on Purchase of Utility Services ("Utility Consumer Tax"), the Office of Billings and
Collections administers numerous other local taxes such as the Prepared Food and Beverage
Tax, Admissions Tax, and the Transient Occupancy Tax. With the exception of the E-911 Tax
and the Utility Consumer Tax, all of the these taxes provide that the legal entity which collects the
taxes must file both a report and remittance by the due date of the taxes to avoid a penalty. The
report filed along with the tax payment includes information such as account number, tax period,
and the basis on which the tax is calculated. It also includes other necessary information such
as any exemptions, gross receipts, number of telephone lines, etc.., which allows verification of
the calculated tax payments.
We have recently become aware that both the E-911 Tax and the Utility Consumer Tax
ordinances as written only impose a penalty when a payment is not made. This often causes
difficulty in processing payments without the required reporting form.
Considerations:
The Code of the City of Roanoke (the "City Code"), relative to the majority of the local taxes,
imposes a penalty when both a report and remittance are not made by the due date. For

consistency and operational efficiency, the City Code for the E-911 Tax and the Utility Consumer
Tax should be amended to reflect the same wording as similar City Code sections.
Delays may occur in posting payments to the appropriate accounts that do not have the
necessary information to verify proper posting and accounting of the payment.
Recommended Action:
City Council adopt the attached ordinances amending Article XIII Special Tax on Consumers of
Local Telephone Service, Section 32-282.2 and Article VII.1 Tax on the Purchase of Utility
Services, Section 32-180 to provide a penalty if both a report and remittance are not filed and
paid within the time specified by Section 32-277 and Section 32-171, respectively.

WHEREAS, the City seeks to procure services for purchasing cards for small purchases and
travel expenses;
WHEREAS, City Council finds the purchasing cards to be a benefit to the City to facilitate
purchasing for small transactions and to create processing efficiency through payment of one bill to
one vendor, replacing numerous payments to many vendors while being managed closely by the
Departments of Finance and Purchasing;
WHEREAS, this Council also finds that use of the procurement method of competitive
negotiation for the needed purchasing card service will allow it to more fully consider factors of
experience and references relating to the offers and will also allow consideration of significant factors
other than just the price of the services to be provided; and
WHEREAS, City Council is of the opinion that such services should be procured by
competitive negotiation for other than professional services, rather than competitive sealed bidding;
THEREFORE, BE IT RESOLVED by the Council of the City of Roanoke as follows:
1. Pursuant to section 23.1-4(e), Code of the City of Roanoke, (1979), as amended, this
Council finds that the procurement method known as competitive sealed bidding is not practicable
and is not fiscally advantageous for the procurement of purchasing cards for small purchases and
travel expenses.
2. City Council directs that the procurement method known as competitive negotiation
for other than professional services shall be used for the procurement of purchasing cards for small
purchases and travel expenses.
3. This Resolution shall document the basis for City Council's determination.

Subject: Purchasing Cards for Small Purchases and Travel Expenses
Background:
It would benefit the City of Roanoke to enter into a contractual arrangement with a
credit card service provider for the use of purchasing cards. Purchasing cards would be
used for small dollar purchases of goods or services or for approved employee travel.
The use of such cards would facilitate purchasing for small transactions and create
processing efficiency through payment of one bill to one vendor, replacing numerous
payments to many vendors. Purchasing cards are a "best practice" as identified by the
Government Finance Officers Association. The Commonwealth of Virginia and
numerous Virginia localities use such cards.
The City administration plans to allow card purchases only where transactions do not
exceed $1,000. We have found that about 90% of our volume of transactions, but only
about 12% of the value of transactions, is represented by this level.
An administrative procedure would be written to govern the use of cards, and all
persons issued cards would be required to sign a cardholder agreement concerning
their responsibilities of card use. Appropriate management approval would be required
to authorize card issuance. The Departments of Finance and Purchasing would
manage the card program. A pilot program is planned, whereby card use could be
tested with limited users before the program is employed City-wide.
In order to have this program, an organization qualified to provide credit card service,
training and customer support, and the necessary controls and restrictions required by
the City must be engaged. Although the sealed bid method of procurement would
normally be used, it is not practicable or advantageous to use the sealed bid process in
this case. The experience and qualifications of a firm that can provide these services is
of equal, if not greater, importance than the cost. Issues of rebate percentages, card
flexibility, bill inquiry response time, billing procedures, dispute process time frame,
quality and availability of management reports, and electronic media capabilities are of
vast importance. Therefore, the process of competitive negotiation using a request for
proposal will be the best method of procurement for these services.

Consideration:
The code of the City of Roanoke provides as an alternate method of procurement to
using the bid process, a process identified as "competitive negotiation for other than
professional services." Prior approval by Council is necessary before this alternate
method may be used. See City Code section 23.1-4(e).
This method will allow for negotiations with two or more vendors to determine the best
qualified at the most competitive price.
Recommended Action:
City Council authorize the use of competitive negotiation as the method to secure a
vendor to provide appropriate services for the purchasing card program.

In response to several phone calls from Council members regarding the Planning
Commission's October 16th recommendations to you for the Citizens Advisory Committee,
I asked my staff to provide me with the following: (1) further clarification of the statistics
referenced by the Commission, and (2) detailed information on the process used by the
Commission in recommending citizens for the Advisory Committee.
With respect to the statistics, here are the clarifications:
There was a typographical error on the previous correspondence in the percentage
of the City population that is male. Forty-six percent of the City's population is
male, not fifty-six percent. Fifty-four percent of the City's population is female.
Residents of the region were previously included in the quadrant percentages.
Residents of downtown are included in the Southwest quadrant. The revised
numbers and percentages are as follows:

With respect to the process used by the Planning Commission, I have been advised of the
following:
The Long-range Planning Committee of the Planning Commission reviewed the
initial applications (approximately 130 at that time) with the assistance of the
planning consultant and Planning Commission staff. A draft list of 27 names was
developed with special emphasis on persons who would be representative of
various interests, cultures, gender, ages, and areas of the City and the Region.
That group agreed that the Advisory Committee should be limited to no more than
thirty persons.
The Long-range Planning Committee discussed the draft list of persons with the
full Planning Commission on August 28, 2000. Commission members provided
additional direction and recommended other citizen names for consideration. The
matter was referred back to the Committee for their final recommendation to City
Council. Applications from several citizens were solicited for participation to
achieve greater diversity and expertise. Citizens approached included: Charles
Price, Jonathan Wolfe, Sushella Shende, Carolyn Coles, Tom Pettigrew, Steven
Lemon, and Walter Rugaber.
As recommended, the proposed Chair and Vice Chair of the Advisory Committee
were contacted by a member of the Planning Commission to ensure their
commitment and willingness to serve in the leadership capacity. (I, personally, met
with Mr. Walter Rugaber, at the request of Mr. Manetta, to discuss his participation
in the project.) Task Team chairs also were contacted because of their technical
and leadership roles. All contacted persons were advised that their appointment
was at the discretion of City Council.
On September 18, 2000, a list of 30 citizen names was submitted to City Council for
consideration. Council advised that the recommendations were deficient with
respect to representation from citizens of Northeast and Southeast. Council also
expressed other concerns regarding diversity.
On September 21, 2000, Planning Commission members discussed Council's
comments at their regularly scheduled meeting and it was requested that the Long-
range Planning Committee review the applications to add persons in an effort to
address Council's concern. After discussing the matter with all Planning
Commission members by phone, five additional names were submitted to City
Council for their consideration.
On October 2, 2000, a revised list of 35 names was submitted to City Council for
consideration.
I hope that this information is.helpful to you:in understanding the process used by
the Planning Commission and in clarifying the composition of the recommended Advisory
Committee. Please let me know if you have any additional questions or concerns.

Vision 2001 Comprehensive Plan
The City Planning Commission met on Wednesday, October 11, 2000, to discuss City
Council's request to reconsider names for the Citizens Advisory Committee for Vision 2001, the
Comprehensive Plan. Six members of the Commission were present; Gilbert Butler was unable to
attend. Atier an extended discussion of the matter, the Commission unanimously voted to refer the
previously recommended 35 citizens to City Council (see attached) with the option of having Council
name seven additional citizens, at their discretion. As you can see from the following table, our
recommendations reasonably reflect the diversity of the city's population.

For your general information, it is important that Council understand several key premises
upon which the Planning Commission made their recommendations:
The Citizens Advisory_ Committee is intended to provide guidance to the Planning
Commission on development of the plan and to coordinate the work of the seven Task
Teams. It is not a decision-making body. Public policy recommendations will be made by
the Planning Commission and adopted by City Council. The development of goals and
strategies will be by the Task Teams, which will be open to all citizens. The role of the
Committee is to ensure that the seven elements of Vision 2001 are integrated into a single,
coherent plan.
Initially, it was recommended that the size of the Advisow Committee be no more than thirty
persons in order to provide maximum meeting efficiency and coordination. Those persons
were to represent a broad cross section of interests and be balanced in race, gender, ethnic
background, and geographic population.
Roanoke City Planning Commission Architectural Review Board Board of Zoning Appeals
The Advisory_ Committee includes a Chair, a Vice-Chair, and Chairpersons from each of the
seven Task Teams. These chairs were recommended because of their expertise, interest, and
management abilities. Because of their personal time commitment and leadership role, these
persons have been personally contacted by Planning Commissioners to ensure that they are
willing to serve in that capacity, however, they are aware that their appointment is at the
discretion of City Council. No other persons recommended for the Advisory Committee
have been personally contacted.
We have received applications from all persons recommended for appointment. Please note
that not all of the approximately 165 persons sending in applications desired to serve on the
Advisory Committee; some wished only to serve on Task Teams. Over 1,000 applications
for the Advisory Committee and Task Teams were mailed or distributed to citizens.
Applications were distributed through various civic groups, including the Chamber of
Commerce, the Roanoke Valley Economic Development Partnership, neighborhood
organizations, Roanoke Jaycees, and Roanoke Regional Homebuilders Association, among
others. In addition, applications were mailed directly to citizens from lists provided by
various City departments, the Roanoke Neighborhood Partnership, Downtown Roanoke,
Inc., and others.
The Planning Commission is appreciative of City Council's support and participation in the
development of this very important project that will guide our future. Please let me know if you

At a regular meeting of the Council of the City of Roanoke which was held on Monday,
October 16, 2000, Mr. Wayne Jones, 127 Patton Avenue, N. W., addressed the issue of
alleged police misconduct and encouraged an investigation by the Citizen Review Panel
regarding problems between the Police Department and the community.
Also, Mr. Martin Jeffrey, 517 Rutherford Avenue, N. W., spoke with regard to the James
Minor motorcycle accident. He advised that there are other witnesses to the police chase
who will testify that they observed police cruisers following Mr. Minor on to the 1100 block
of Hanover Avenue, N. W., where he met his death, and there are other inconsistencies
that witnesses will divulge to the appropriate body. He called attention to your
recommendation regarding the appointment of a Citizen Review Panel and requested that
the panel, which will consist of police officers and citizens, be activated to review all
information regarding the Minor accident to insure that there has been an objective review.

Proposed amendments to Section 36.1-25, Definitions, of Article II,
Construction of language and definitions, and Section 36.1-445,
Additional Sign Regulations, of Article IV, Supplementary
Regulations, of the Code of the City of Roanoke (1979) as
amended.
Background:
The City receives numerous complaints from neighborhood leaders and citizens in
general, concerning outdoor advertising signs (billboards) along, and adjacent to, major
streets and gateway entrances into the City.
Section 36.1-445 of the Code of the City of Roanoke (1979), as amended, currently
provides that outdoor advertising cannot be located within 250 feet of a residential
district or within 250 feet from another such sign on the same side of the street.
Section 36.1-414 further provides for how distances between uses are to be
determined.
On April 13, 2000, the Circuit Court for the City of Roanoke reversed a May 4, 1999,
ruling of the Roanoke City Board of Zoning Appeals, in which the Board of Zoning
Appeals upheld the Zoning Administrator's decision that the spatial requirements for
outdoor advertising signs shall be measured from the property lines of the lots on which
the billboards are to be erected. The circuit court, basing its opinion on the language of
Section 36.1-445 (a) (3) of the City Code, held that the distance between billboards
must be measured between the billboards themselves and not the property lines of the
lots on which they are erected.
Consequently, amendments to Section 36.1-25, Definitions, of Article II, Construction of
language and definitions, and Section 36.1-445, Additional Sign Regulations are
needed. The proposed amendments are set forth in Attachment 1.
Roanoke City Planning Commission Architectural Review Board Board of Zoning Appeals
These amendments were discussed with the Ordinance and Names Committee of the
Planning Commission in July, 2000, and subsequently, were scheduled for public
hearing by the Commission.
The Planning Commission public hearing was held on September 21,2000. Mr. Ted
Tucker, City Planner, and Ms. Evelyn Dorsey, Zoning Administrator, presented the
planning staff report. It was noted that the proposed amendments were needed to
provide clarification to the existing ordinance to address recent court decisions and
eliminate ambiguous language. Also, it was noted that a more comprehensive revision
of the sign ordinance was currently under consideration, and that approximately thirty
ordinances from other localities in the state had been researched including Virginia
Beach, Loudon County, Chesterfield County, Fairfax, Richmond, Roanoke County,
Salem, Lynchburg, Danville, Arlington, and Charlottesville. Mr. Tucker and Ms. Dorsey
explained how the proposed amendments would affect the placement of billboards on
corridors adjacent to municipal boundaries and how the distances between them would
be measured. Mr. Keith Austin, 1545 Patrick Road, addressed the Commission on
behalf of Lamar Advertising advising that billboards were not increasing in number,
rather they were decreasing and that civic organizations were requesting their use for
public service advertising. He indicated that people did not hate billboards, they wanted
them regulated. While he recognized the need for clarification of the existing
ordinance, he felt that the existing ordinance was already restrictive as it applied to the
location of billboards adjacent to residential districts, and objected to the proposed
provision that would increase the distance from a residential district or municipal
boundary from 250 to 500 feet. He also questioned the amendment provision that
measured the distance between billboards, advising that other area localities measured
radially from the structure. He provided the Commission with an example of how the
proposed measurement from property line (in lieu of the structure) could affect the
placement of a billboard, noting that it was too restrictive. He asked the Commission to
let him and other representatives work further with staff to help resolve their concerns.
Mr. Randall Hodges, 1601 Seibel Drive, representing Hodges Sign Company,
addressed the Commission and advised that the existing code adequately addressed
billboards and opposed the proposed amendments. In response to the measurement
concern, Ms. Dorsey further explained that linear measurement from property line to
property line (rather than radial) was needed for effective administrative and
enforcement purposes and also, was necessary because of the zoning and
development patterns in Roanoke City which resulted in more street frontage along the
City's major corridors. Mrs. Evelyn Lander, Agent to the Commission, advised that
staff was not seeking amendments to the entire sign ordinance, they were proposing
only minor changes to those provisions which needed to be clarified because of recent
legal decisions. She advised that she understood that staff had been working with sign
representatives in the past regarding issues relative to the proposed revisions of the
entire sign ordinance, which was currently being drafted. She agreed to continue to
work further with sign business representatives and other citizens on this future major
ordinance revision once it was in an agreed upon form for comment.
Considerations:
The attached amendments are proposed for the purpose of providing additional
clarification on the method and manner in which the spatial requirements for outdoor
advertising signs will be measured and regulated by the City in the future.
The amendments will provide for a reasonable increase in the distances required
between outdoor advertising signs and the zoning boundaries of the City's residential
districts from 250 feet to 500 feet. Note, however, that existing billboards are grand-
fathered and can continue to be 250 feet from a residential district.
Finally, as a means of protecting and maintaining the existing aesthetic and scenic
values along major streets, thoroughfares and gateways into the City, the amendments
will prohibit the installation of any outdoor advertising sign, within a distance of 500 feet
of any location where a municipal corporation boundary is intersected by an arterial or
collector street.
Recommendation:
The Planning Commission, by a vote of 4-2 (Mr. Butler and Mrs. Duerk voting in
opposition to the motion) recommended that City Council approve the proposed
amendments to Section 36.1-25, Definitions, of Article II, Construction of language and
definitions, and subsections (a) (1) and (a) (3), of Section 36.1-445, Additional Sign
Regulations, in Article IV, Supplemental Regulations, of the City Code (1979) as
amended.
It should be noted that a motion to table the matter to allow further discussion with sign
representatives failed on a 3-3 vote (Mr. Manetta, Rife, and Chrisman in opposition).

regulations, of Article IV, Supplementary_ Regulations, to clarify and provide appropriate

I am writin8 because I have learned that City Council is considering changing laws that
govern billboards located within the City's borders. As I understand the situation, you
are considering greatly tightening the restrictions that 8ova"n billboards and I want to
urge you to move cautiously in your deliberations.
Please don't misunderstand--it's not that I don't think that we need regulations. I do.
Rather, I am concerned that the new restrictions you are considering are so severe that
they might harm the Museum's ability to advertise its exhibits and programs through
billboards, and therefore we could suffer a loss in attendance and attendance-based
revellues.
The Museum depends on many forms ofdon,ued advertising to mm'ket itself We are
fortunate that many local media sources regularly donate thei~ ad space m airtime to us,
including television, radio, newspaper and billboard companies. Of'these, by Far, the
most consistent and generous in-kind donations come From Lamar edvenisin8, and I am
concerned that it'you substantially reduce the inventory that Lamar has to work with, the
f'n~n will no longer be able to nudce such in-kind donations to the Museum.
Also, on occasion, the Museum does purchase advertising, but with a limited budget. By
experience we have learned that the best advertisinl~ investment for us, in terms of
increased traffic derived From that advenisin8, is billboards. Simply put, because ot'the
pricing s~ructure for billboards, we can afford to purchase enough space to break through
thc "noise" and be effective in gcneratin~ new business. Ir'the cos~ ofbiUboards were to
increase substantially (dug to economic laws ot'supply and demand applied to a
decreased amount ofbiliboard space) we could no longer afford to purchase them. This
problem would be compounded by the fact that there is no other ~tom ot'media that we
ca~ afford, and the Museum's markctin8 efforts would therefore be s~iously weakened.

Background:
Property is located at the corner of Bullitt Avenue and Sixth Street, S.E., and was ac-
quired by the City in 1965. It is in a residential area (RM-2) and contains approximately
11,000 s.f. The lot has been assessed by the Office of Real Estate Valuation for
$10,000. City policy requires surplus property to be advertised and sold to the highest
bidder if property can be used to construct a separate structure.
Considerations:
The property is no longer needed by the City. The City would be relieved of the cost of
continued maintenance of the property. Sale of the property will produce income for the
City and will return the property to the tax base.
Recommended Action(s):
Authorize the advertisement of the City-owned parcel identified by Tax No 4013701 for
sale at a minimum price of $10,000 and authorize a public hearing on the sale of sur-
plus property. Lacking any comments to the contrary, approve the conveyance of the

Historic Belmont Preservation Association. We are a group of tax paying
citizens that are home owners and residents. We are alarmed by the .present
declining state of our Historic Belmont.
The k'ision Statement of The Historic Belmont Preservation Association,
envisions a vibrant, viable community that celebrates its heritage as one of
Roanoke's oldest neighborhoods. We plan to be as asset to the City of
Roanoke as one of the closest residential areas to Downtown.
Our Goals are:
To minimize the impact of non compatible land uses in the Belmont
neighborhood.
To take an active role in enforcement of existing codes that preserve quality
of life.
To encourage compatible infill housing development.
To involve residents, businesses and civic organizations in achieving our
goals.
The vision statement of the Historic Belmont Preservation Association is to
strive to maintain and preserve the historic housing stock in our '
neighborhood. We aim to provide a safe, clean environment for our families
and future generations. .~
Our beloved Belmont is full of historic character. Despite the fact that we are
not eligible for the National Historical Registry,< according to the
neighborhood parmership,>we feel our neighborhood is historical. The
reason we are not eligible is due to the loss of historic homes. This '.
neighborhoockhas suffered fi:om neglect for years. It is time for the residents
to take back their neighborhood.
Look at the progress made by the residents of Historic Gainsboro, it is a
prime example of residents working within the community and the city for ~'
the' preservation of the individual characteristics of that neighborhood. Given
the same opportunity Historic Belmont would also be an asset to the city. '-
Neighborhoods and residential associations have the same goals as the .city to
make our city grow and prosper and to attract new residents and businesses, '
and to feel pride with in our selves, our homes as well as our city.
Historic Gainsboro3 is ~ a strong community. They are a Historic district.
What is the major difference between Belmont and Historic Gainsboro?
Historic Gainsboro has Hotel Roanoke, Belmont has hotel Rescue Mission.
Which by the way, even the chairman of the rescue mission board said, he
would not raise his family or live next door to the mission. Darlene Burcha/n
and David Diez were both present at that meeting. Atler this admission He
got upset and left the meeting. A typical example of the routine at the
meetings that we have had the opportunity to be involved in.
The community meetings with the city & the mission were sterred by mike
brennon, from a consulting company. This was paid for by the mission. ~We
feel we were being asked leading questions. When the 3 concept plans wer~
announced, not one of the residentS ideas were represented. I feel tike the
mission has been told by someone at the city that this is a done deal.

Mayor, City Council thank you for allowing me the opportunity to address council.
There are issues concerning the proposed Rescue Mission expansion Wh{cfi r nded ts bring to
your attention. My neighbors and I have been working with the system for at least 3 years.
We've met with the city planning department and the Rescue Mission to discuss .our concerns.
We have tried to let the system work, but when other people are playing outside the system, that's
not fair.
There are things going on that don't make the city look good. It appears that some people fi.om
the city administration or council have given the Mission the impression that they will receive the
zoning changes they need. They have invested a lot of money and are raising a lot of money for
this expansion. They have distributing their Master's Plan for the last 4 years as if it was a done
deal. This idea that the Mission will get the rezoning they need has been given before the
community, which opposes the rezoning and the expansion, has been able to give their opinions in
the public hearings which are required by law.
Just on Fourth Street, those houses would cost about $15,000 a piece to be torn down. And the
houses themselves had value. The combined assessed value of the three houses that have already
been tom down is $92,000. In addition to the cost of demolition, someone has invested a lot of
money for some vacant land that is currently zoned residential. They believe that they are going
to be able to develop something big there.
Before the Rescue Mission can develop these properties they have to first have the area rezoned,
which requires public hearings, and then they need a special permit to have a group home. In
order to have another group home they have to be located t~. fi.om an existing facility. The
reason we have these rules is because having all these social service agencies so close together is
not good for the neighborhood. But, somehow the Rescue Mission has been given the impression
that they will get what they want.
I have heard some people say that members of the Mission Board are politically powerful. I have
been told that members of city council and the administration have personal relationships with
members of the Mission's Board and its Director. Many people are saying that this is a done deal
even though the community opposes it.
I am concerned that if the Mission gets their rezoning in spite of public opinion that its true that
the city is given the Mission the impression that this is a done deal.
I am even more concerned that the city let the houses get torn down so that the area was no
longer residential. I am afraid that this is just a way to get around the zoning heating process.
We just started the neighborhood planning process. The zoning in the neighborhood is going to
be redone. Was this just a way for the city to say that the area is no longer residential?
The fact that the city appears to be supporting what the Mission is doing has seriously broken
down the trust the community has with the city.
Speaking of trust, the city claims that they tried to do a community process. The city assigned a
new person on the planning staffwho knew nothing about history of the our neighborhood or
about Roanoke to facilitate the meeting. The Planning Department gave me only four days to
pass out flyers for the meeting. And then, the city had the Mission conduct the meeting with their
own architects and planners. The process was not honest. The Mission's planner.s kept saying
things that weren't true, like the houses were in bad shape and they weren't part of the
neighborhood. They were trying to sell the Mission's plans. This was not a legitimate effort to
bring the neighbors in to talk.
Then the city planner said he would meet with the neighborhood to hear our concerns without the
Rescue Mission being present. At the last minute, the city invited the Mission. The neighbors
have still not been able to meet with the city.

I can not imagine how the city council or administration can possibly think that the expansion of
the Rescue Mission is in anyway good for neighborhoods and the economic development of the
city.
The Historic Belmont Preservation Association sees our neighborhood as a vibrant, viable
community. Fourth Street and Dale Avenue have been, and will continue to be, viable residential
areas. I envision this neighborhood to be a safe, historical, whole community. I can see
downtown fi:om my neighborhood. We can hear music fi:om Elmwood Park. We can be a strong
part of Roanoke's future. I am asking City Council to not support the Rescue Mission's
expansion -- to let the legal process we have work!

hoods in which they are located and to establish standards to
encourage an adequate' quality-of service to the users of such
facilities.

(a) For those group care facilities permitted by special excep-
tion in an RS-l, RS-2, RS-3 or RM-1 district, the following
standards shall apply:
(1) The maximum number of occupants shall be eight (8)
including supervisory personnel and family members liv-
lng on the premises;
(2) No group care facility shall be located closer than one
thousand five hundred (1,500) feet to another group care
facility;
(3) Recreational space shall be available on the lot;
(4) No signage, other than that normally permitted in a
residential district, shall be permitted;
(5) No changes shall be made to the exterior of a building that
would detract from its appearance as a family dwelling;
and
(6) Parking shall be adequate to accommodate the needs of the
staff and residents.
(b) For those group care facilities permitted in an RM-2, RM-3,
RM-4, C-l, C-2, or C-3 district, the following standards shall
apply:
(1) The number of occupants, including supervisory personnel
and family members living on the premises, shall be based
on the following schedule:
(i) In an RM-2 district: Three (3) occupants for every two
thousand five hundred (2,500) square feet of lot area;
(ii) In an RM-3 district: Three (3) occupants for every one
thousand eight hundred (1,800) square feet of lot area;
(iii) In an RM-4 district: Three (3) occupants for every one
thousand (1,000) square feet of lot area; and

compliance with the general purpose of this chapter and the

and integrity of neighborhoods and commercial areas by promot-
ing excellence of development, preventing traffic hazards or
congestion, preventing undue land or site hazards, and encour-
aging the most appropriate development and use of land in
harmony with the neighborhood.

Sec. 36.1-571. Application.
(a) All applications for a zoning permit require pursuant to
section 36.1-671 shall be accompanied by either a basic or
comprehensive development plan.
(b) A basic or comprehensive development plan is intended to
represent graphically all components of a proposed development
required for review pursuant to this division. Development plans
may include, where necessary, written data or computations and
additional plans or drawings necessary to explain clearly the
proposed development.

(a) A comprehensive development plan shall be submitted with
all zoning permit applications except in the following cases:

(2) Construction, reconstruction, moving or addition to a du-
plex and including associated grading and clearing, when
development is not in conjunction with the construction,'
reconstruction, moving or addition to other duplexes on the
same lot or on an adjacent lot under the same ownership;
(3) Additions to buildings or uses which do not result in an
increase of greater than ten (10) percent of the floor area of
a building and where the number of required parking
spaces is increased no more than three (3) spaces; and
(b) In those cases where a comprehensive development plan is
not required, a basic development plan shall be submitted.

At a regular meeting of the Council of the City of Roanoke which was held on Monday,
October 16, 2000, Ms. Margaret Patterson, 414 4th Street, S. W., addressed Council with
regard to the investigation into the death of her nephew, James Minor. In light of certain
alleged discrepancies in the investigation, she requested that the matter be referred to the
Citizen Review Panel for investigation, and that the following information be provided to
the Minor family:
Copy of the investigative reports prepared by police officers,
An account of the accident and the chase,
The emergency call report and the autopsy report,
All photographs of the accident scene and all other photographs pertaining to the case,
A report on the motorcycle which was involved in the accident,
Names of all police officers involved in the case, and
Copy of the report by Donald L. Stokes, witness to the accident.
The remarks were referred to the City Manager for appropriate response.

Good evening MR Mayor, and members of the city council. My name is

Historic Belmont Preservation Association. We are a group of tax paying
citizens that are home owners and residents. We are alarmed by the .present
declining state of our Historic Belmont.
The Vision Statement of The Historic Belmont Preservation Association,
envisions a vibrant, viable community that celebrates its heritage as one of
Roanoke's oldest neighborhoods. We plan to be as asset to the City of
Roanoke as one of the closest residential areas to Downtown.
Our Goals are:
To minimize the impact of non compatible land uses in the Belmont
neighborhood.
To take an active role in enforcement of existing codes that preserve quality
of life.
To encourage compatible infill housing development.
To involve residents, businesses and civic organizations in achieving our
goals.
The vision statement of the Historic Belmont Preservation Association is to
strive to maintain and preserve the historic housing stock in our '
neighborhood. We aim to provide a safe, clean environment for our families
and future generations. ~
Our beloved Belmont is full of historic character. Despite the fact that we are
not eligible for the National Historical Registry,< according to the '
neighborhood parmership,>we feel our neighborhood is historical. The
reason we are not eligible is due to the loss of historic homes. This .
neighborhooc[has suffered from neglect for years. It is-time for the residents
to take back their neighborhood.
Look at the progress made by the residents of Historic Gainsboro, it isa
prime example of residents working within the community and the city for"
the' preservation of the individual characteristics of that neighborhood. Given
the same opportunity Historic Belmont would also be an asset to the city. '-
Neighborhoods and residential associations have the same goals as the city to
make our city grow and prosper and to attract new residents and businesses,"
and to feel pride with in our selves, our homes as well as our city.
Historic Gainsboro; is ~ a strong cormnunity. They are a Historic district.
What is the major difference between Belmont and Historic Gainsboro?
Historic Gainsboro has Hotel Roanoke, Belmont has hotel Rescue Mission.
Which by the way, even the chairman of the rescue mission board said, he
would not raise his family or live next door to the mission. Darlene Burcha/h
and David Diez were both present at that meeting. After this admission He
got upset and left the meeting. A typical example of the routine at the
meetings that we have had the opportunity to be involved in.
The community meetings with the city & the mission were sterred by mike
brennon, from a consulting company. This was paid for by the mission. -We
feel we were being asked leading questions. When the 3 concept plans werb
announced, not one of the residentS ideas were represented. I feel tike the
mission has been told by someone at the city that this is a done deal.

RESIDENTS.
Residents will be at evey zoning meeting .... if force .... tt is time for members
of council to lision to the voters and taxpayers ..... instead of there personal'
frien4s.

NEIGHBORHOOD FOR A LOT LONGER THAN ANY OF THE ·

approving the Capital Maintenance and Equipment Replacement Program budget which
included 24 video cameras to be installed in police vehicles. He suggested that once the
video cameras are turned on, they should remain on throughout the police encounter.

October 16, 2000, Mr. Bryon Casey, 3741 Signal Hill Avenue, N. W., requested copy of the
video tape of the James Minor motorcycle accident. He questioned the statement of the
Police Department that a full investigation was conducted when the vehicle that was
involved in the accident is located in the City of Salem and the motorcycle is located in the
City of Roanoke. He alleged that the Police Department's witness did not have a valid
driver's license or automobile insurance coverage on his vehicle, however, the individual
was not charged by police officers for these violations.
The matter was referred to the City Manager for appropriate response.
