A RESOLUTION memorializing the late James O. Trout, councilman, civic leader, friend.
WHEREAS, the members of Council have learned with sorrow of the passing of James O.
Trout on April, 25, 2000;
WHEREAS, James Oma Trout was bom on April 6, 1930, in Salem to the late Mac and Mary
Louise Trout. He studied civil engineering at the University of Virginia and Virginia Tech. He worked
as an economic development specialist for the Norfolk Southern Corporation. But Jim Trout will be
remembered most for his long history of service to the citizens of the City of Roanoke.
WHEREAS, Mr. Trout was first elected to City Council in 1968, and was elected or re-
elected in 1972, 1982, 1986 and 1996. He holds the distinction of being the only member of Council
to date to have served the city in five separate decades.
WHEREAS, having been a Golden Gloves boxer, Mr. Trout brought to bear a fighting spirit
and a fierce determination in his role as public servant, never shying away firom any battle he felt
necessmT to benefit the forgotten, to better the lives of Roanoke's less fortunate.
WHEREAS, Mr. Trout strongly believed in the worth of economic development and played
an integral part in the development of many fl'uitful projects: the Virginia Museum of Transportation,
the Roanoke Regional Airport, the Roanoke Centre for Industry & Technology and the Second Street
Bridge, among others.
WHEREAS, Council recognizes with gratitude the establishment of the James O. Trout
Award, an honorarium through the Regional Partnership Foundation, Inc., that would recognize
elected officials or employees of government that have demonstrated exceptional leadership and
courage in promoting economic development throughout our region.
WHEREAS, Mr. Trout will fondly and appropriately be remembered by his final campaign
slogan, "Jim Trout, the one and only."
THEREFORE, BE IT RESOLVED by the Council of the City of Roanoke as follows:
1. City Council adopts this resolution as a means of recording its deepest regret and sorrow
at the passing of Mr. James Oma Trout, and extends to his wife, Betsy Atkinson Trout; his two
daughters, Cheryl Trout Thacker and Patricia Anne Trout; his stepdaughter, Ann Carper Charlton;
his three sons, James Oma Trout, Jr. (along with his wife, Kim), Mark Dillard Trout and John Patrick
Trout; and his many surviving family members, the deepest sympathy of this Council.
2. The City Clerk is directed to forward an attested copy of this resolution to Mr. Trout's
widow, Mrs. Betsy Atkinson Trout.

Dear Members of Council:
I wanted to share with you the enclosed information regarding the
TransDominion Express, which was funded with $9.3 million by the
recent session of the Virginia Assembly.
This sum represents about half of the estimated $20 million cost to
get the project underway which will bring passenger rail service
back to Roanoke. The TransDominion Express would run from Bristol
to Lynchburg, with stops in Abingdon, Pulaski, Radford,
Christiansburg, Roanoke and Bedford.
The initial funding will be used to improve rail tracks along the
route owned and operated by Norfolk Southern. The remaining $10
million would be used to purchase or lease modern, high-speed
inter-city trains. It is expected that the first decade of
passenger rail service in our part of Virginia will have to be
subsidized by the Commonwealth.
This "state service railroad" is similar to the Charlotte-Raleigh
operation in North Carolina. I am excited about the prospect of
Virginia extending passenger rail service to our area, although I
continue to work on the National Mayors' Advisory Council for
Amtrak seeking to extend the national passenger service through our
area, also.
Recently I visited with the Presidents of Radford University and
Virginia Tech, namely Dr. Covington and Dr. Steger, respectively,
and they have expressed strong support for the development of
passenger rail service which will provide another transportation
option for the thousands of college students in the New River
Valley, also.
This is all so very exciting, and I am glad that our hard work over
the last many years might now be developing into something.
My thanks to Members of Roanoke City Council and our administration
for their continued support of this initiative to bring passenger
rail service through Roanoke. Bear in mind, however, that with
Members, Roanoke City Council

this additional transportation alternative for our citizens, our
valley will need to get together for a regional station in order
that the citizens of all the jurisdictions of the valley will have
a convenient depot for passenger rail service.
I would respectfully request that this correspondence be placed on

be received and filed. ' '

I am writing this letter in support of a vital program for the City of Roanoke --
the Roanoke Regional Chamber of Commerce's Community Business Development
Initiative (CBDI). Although in its infancy, the program already is making a difference in
Roanoke's inner city by assisting individuals in starting new businesses, helping small
businesses create jobs, increasing the City's tax base, and providing technical assistance
to businesses and residents through free or low cost seminars, workshops, and events like
Urban Business Appreciation Day.
I know that CBDI's funding was cut by 70 percent during Roanoke City's CDBG
budget review process. This shiz2 in funding will negatively impact the progress this
program has made in its first full year. I'm sure you are aware that the revitalization of
Roanoke's core neighborhoods can not rely on housing alone. Only a multi-faceted
approach to revitalization will make this area a contributing part of the City's economy
through the jobs, income, and tax revenue that CBDI is helping to create.
Did you know that CBDI counseled or visited more than 350 businesses this year?
Its clients received $225,000 in business loans. CBDI's Urban Business Appreciation
Day attracted more than 1,300 people to the northwest business district. And more than
!20 business people have attended CBDI training programs.
I strongly recommend that the City of Roanoke reinstate adequate funding for
CBDI at a level of at least $125,000. This program was recommended in the OUTLOOK
plan for Downtown Roanoke and the Roanoke Renaissance report. The foundation for a
solid and productive program has just begun to be laid. There is much more for the City
of Roanoke to achieve through CBDI and continued funding will bring greater benefits in
the coming year.

Subject: Railside Linear Park - Conveyance of Property
Background:
Property located adjacent to the tracks of Norfolk Southern Railway Company
between Second Street and South Jefferson Street was acquired by the City from the
Norfolk Southern Railway Company for the development of the Railside Linear Park.
By Resolution No. 34741-040300, Council authorized the recordation of a plat
dedicating most of this area as public right-of-way; it also created residual parcels
behind each of the properties on Warehouse Row, shown as Lots 1^, lB, and 2 thru
7 on Attachments #1 and #2. These residual parcels are not needed by the City and
may be disposed of as surplus property.
City Policy requires surplus property to be advertised and sold to the highest bidder if
property can be used to construct a separate structure. However, if property is
unsuitable for construction of a separate structure, as is the case with these parcels,
it may be offered to an adjacent property owner. Conveyance of real property must
be approved by City Council, following a public hearing.
Considerations:
The property is not needed by the City and may be conveyed to the adjacent
landowner, at no cost to the landowner. These parcels are of no use to anyone
other than the adjacent landowner. The City would be relieved of the cost of
continued maintenance of the property.
Recommended Action(s):
Authorize the advertisement of a public hearing and, lacking any comments to the
contrary, grant the City Manager authority to convey these parcels by quitclaim deed
to the adjacent landowner, in a form acceptable to the City Attorney.

Background:
In March 1995, City Council authorized a contract for part time physician services for
the City's Occupational Health Clinic. The services provided under the contract were
public safety physicals, fitness for duty evaluation, employee sick calls and treatment of
injuries.
The initial contract period is due to expire on June 30, 2000.
Consideration:
After due and proper advertisement, one (1) proposal was received for the required
services. That proposal was submitted by Dr. Darrell F. Powledge, MD, MPH. Dr.
Powledge currently is the service provider. Negotiations were conducted, and an
agreement was reached with Dr. Powledge to provide the required services for a cost of
$117.50 per hour. This is the current hourly rate for Dr. Powledge. Dr. Powledge
normally works six hours per week. Funds to provide for this service are included in the
FY '01 recommended budget for Occupational Health in account 001-002-1263-2107.
Recommended Action:
Authorize the City Manager to enter into a contract, in a form approved by the City
Attorney, for part time physician services with Dr. Darrell F. Powledge, MD, MPH for a
period of one (1) year with the option to renew for four (4) additional one (1) year
periods for a cost of $117.50 per hour.

Parking Rate Increase for City Owned or Controlled Parking
Facilities
Background:
The current parking rates for certain city owned or controlled downtown parking
facilities consisting of Century Station Parking Garage, Church Avenue Parking
Garage, Market Square Parking Garage, Tower Parking Garage, Williamson
Road Parking Garage, Williamson Road Parking Lot and Viaduct Parking Lot
were established by resolution number 33192-120296 adopted on December 2,
1996. The operating expenses for the facilities continues to rise each year (3.2%
in the current fiscal year), and because the garages and lots are currently near
capacity, there is little revenue increase anticipated due to the inability to
increase the number of parkers.
In addition, AIIright Roanoke Parking, Inc., the operator of the parking facilities for
the city, has proposed amending the current management and operation services
contract to include additional services requested by the city that will enhance
customer service and improve garage appearance to citizens who park in the
facilities.
Consideration:
Effective July 1, 2000, increase the short term and monthly parking rates at each
of the said facilities as set forth in Attachment A., provided, however, that such
increase will not apply to current parking agreements that provide for a specific

AN ORDINANCE authorizing an amendment to the contract for management and operation

parking facilities, dated July 28, 1997; authorizing a temporary agreement with Allright for the
management and operation of the Viaduct Parking Lot; and providing for an emergency.
WHEREAS, the City entered into a contract dated July 28, 1997, with Allright for
management and operation services at certain City owned or controlled downtown parking facilities;
and
WHEREAS, the City and Allright desire to amend the contract to allow for a reduction in fees
charged due to a reduction in spaces available at the Viaduct Parking Lot; and
WHEREAS, the City and Allright desire to amend the contract to allow for additional services
requested by the City, set forth in a proposal by Allright, and to increase Allright's fees for such
additional services; and
WHEREAS, the City and Allright desire to enter into a temporary month-to-month agreement
for Allright to manage and operate the temporarily available spaces at the Viaduct Parking Lot.
THEREFORE, BE IT ORDAINED by the Council of the City of Roanoke as follows:
1. City Council, in accordance with the report of the City Manager to this Council dated May
1, 2000, hereby approves the following amendments to the contract for management and operation
services between the City and Allright Roanoke Parking, Inc., dated July 28, 1997, involving certain
parking facilities:
A. A reduction in the Management Fee paid to Allright under the contract due to a
reduction in parking spaces available in the following amounts for the following time
periods:
i) July 1, 1998 - July 31, 2000 - $16,505.37
ii) August 1, 2000 - July 31,2001 - $8,295.12
iii) August 1,2001 - July 31,2001 - $8,544.00
B. Allright will provide the additional services outlined in its proposal dated March 30,
2000, which were requested by the City, effective July 1, 2000, and for such
increased services, Allright will receive an increase in the Management Fee paid to
Allright, for a total amended Managemem Fee to be paid to Allright as follows:
i) July 1, 2000 - July 31, 2000 - $25,283 for that month for a total of $25,283
ii) August 1, 2000 - July 31,2001 - $25,934 per month for a total of $311,208
for the year.
iii) August 1, 2001 - July 31, 2002 - $26,712 per momh for a total of $320,544
for the year.
2. City Council approves a temporary contract with Allright for the management and
operation of the approximately 94 temporarily available spaces at the Viaduct Parking Lot to include
the terms as more fully set forth in the City Manager's report to this Council dated May 1, 2000.
3. The City Manager and the City Clerk are hereby authorized on behalf of the City to
execute and attest, respectively, the requisite contract amendments and temporary contract with
Allright, said documents to be in such form as is approved by the City Attorney, and to take such
further action and to execute such other documents as may be necessary to implemem those
documents.
4. In order to' provide for the usual daily operation of the municipal government, an
emergency is deemed to exist, and this ordinance shall be in full force and effect upon its passage.

Amendment to Management and Operation Services Contract
Between The City of Roanoke and AIIright Roanoke Parking, Inc.
On July 28, 1997, the City of Roanoke entered into a 5-year contract for
management and operations services with AIIdght Roanoke Parking, Inc.
(AIIright) to operate the city's downtown parking facilities. The facilities consist of
Church Avenue Parking Garage, Market Square Parking Garage, Century
Station Parking Garage, Tower Parking Garage, Williamson Road Parking
Garage, Williamson Road Parking Lot and the Viaduct Parking Lot. The Contract
took effect August 1, 1997. The city is currently in the third year of the 5-year
contract.
There are two issues regarding the above referenced parking facilities, which will
require an amendment to the existing contract between the City and the operator,
AIIright Roanoke Parking, Inc. They are outlined below:
1. In connection with the removal of the Hunter Viaduct, there was a reduction in
parking spaces available on the parking lot underneath, known as the Viaduct
Parking Lot. Because of the reduction in available spaces, beginning in July of
1998, AIIright voluntarily agreed to reduce their management fee by $16,505.37
through July 31, 2000. It was anticipated that the lot would be back in full service
no later than that date.
In February of 2000, the lot became fully available again. However, it was at that
time anticipated that the lot would only be fully available until August of 2000,
when it again would have the number of available spaces reduced. Because the
lot is not anticipated to be permanently returned to full service, it would be
appropriate to remove that portion of the management fee covering the
unavailable spaces from the management and operation contract, and enter into
a temporary month to month management agreement with AIIright for the Viaduct
Parking Lot operation of the approximately 94 temporarily available spaces
ending approximately in August of 2000. The month to month agreement is
summarized below:

AIIright.
50% of gross revenues collected after AIIright's cost and
expenses of $6,000.00 for fencing and striping of the lot
have been recouped by AIIright from revenue generated by
the lot.
AIIright will provide liability insurance coverage.
AIIright will provide for all routine maintenance of the lot.
2. In an effort to improve the maintenance and cleanliness of the remaining
parking facilities, and raise the level of customer service received by citizens, as
requested by the City, AIIright has proposed hiring additional maintenance staff,
upgrading the uniforms worn by personnel to make them more identifiable, and
improve the wage structure of employees to stabilize the workforce, all as set
forth in AIIright's proposal dated March 30, 2000. These additional services will
require an increase in the fee currently charged by AIIright to the city for
management and operation services for those facilities remaining available.
These additional services would take effect on July 1, 2000. The additional cost
for the first year will be $42,995.16 with a 2.97% percent increase for the next
year.
Consideration:
Enter into an amendment to the management and operation services contract
with AIIright adjusting the fee to coincide with the number of available spaces,
allow the city to enter into a month to month agreement with AIIright for
temporary operation of the temporarily available spaces at the Viaduct Parking
Lot until on or about August 15, 2000, and adjust the annual fees to compensate
for the additional services requested by the city for the remaining facilities as
outlined below.

Background:
The Help Eliminate Auto Theft (H. E.A.T.) grant program of the Commonwealth of Virginia
Department of State Police provides funds for auto theft enforcement initiatives. Roanoke
has been awarded $2,899 in H.E.A.T. funds for the period of March 1, 2000 to February
28, 2001. There is no local match for these grant funds. H.E.A.T. funds will be used for
the purchase of one hundred (100) anti-auto theft devices to be distributed at no charge
to citizens at a minimum of four (4) public events and at a minimum of twenty-five (25)
Neighborhood Watch groups or Civic group meetings. Grant funds also provide for the
purchase of anti-auto theft publications to be disseminated at these same events and
meetings.

A RESOLUTION expressing support for the naming of a United States Navy vessel after the
City of Roanoke.
WHEREAS, at least 52 American ships, including four United States Navy vessels, have
carried the name "Roanoke;" and
WHEREAS, the USS Roanoke, a three-masted steam frigate, was produced in Norfolk,
Virginia, in 1854, and served as the flagship of the United States home squadron, and witnessed the
famous Civil War battle of the Monitor and the Merritnac; and
WHEREAS, this same vessel was converted in 1863 to the United States' only three-turret
monitor and served as a guard ship for harbor defense until 1883; and
WHEREAS, the USS Roanoke was constructed in 1901 in Newport News, Virginia, and
served as a mine'-layer and troop transport during World War I; and
WHEREAS, the USS Roanoke CL-145 was launched in 1947, at a ceremony overseen by
former Roanoke Mayor and City Manager W. P. Hunter, and, in his first official act of office,
Secretary of Defense and Roanoke native Louis A. Johnson, and received so many awards during its
service in the Mediterranean Sea and the Pacific Ocean that it was often called "the cleanest ship in
the Navy;" and
WHEREAS, the USS Roanoke AOR-7 was commissioned in 1976 as a supply ship in the
Pacific, served in the Persian Gulf Conflict, was the largest of all the ships named''Roanoke," and was
decommissioned in 1995; and
WHEREAS, the first two navy vessels named ''Roanoke" were named after the Roanoke
River, and the two most recent "Roanokes" were named for the City of Roanoke; and
WHEREAS, the Roanoke Valley of Virginia is home to hundreds of veterans of the United
States Navy and the other armed forces of the United States, who have served with honor in the
defense of our country and who, along with the above-described ships, have caused the name
"Roanoke" to be regarded with distinction in naval history; and
WHEREAS, despite being located 200 miles from any navigable river or ocean, Roanoke,
through the History Museum & Historical Society of Western Virginia, has developed an extensive
exhibit, called Ships andShiprnates of the Roanoke Valley, to foster and commemorate its ties to the
sea; and
WHEREAS, the citizens of Roanoke are proud of the heritage demonstrated by the ships
named "Roanoke" and are desirous of continuing that heritage;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Roanoke that the
Council and the citizens of the City of Roanoke request the support and assistance of Virginia's
United States Senator John W. Warner, Chairman of the Senate Armed Services Committee and
former Secretary of the Navy, in having a fifth United States Navy vessel named after the five-time
All-America City of Roanoke.

Subject: Naming of a Fifth United States Navy Ship after Roanoke
Background:
At least 52 American ships have carried the name "Roanoke," including four United States
Navy vessels between 1854 and 1995. The first two naval vessels were named after the
Roanoke River, and the two most recent "Roanokes" were named for the City of Roanoke.
Considerations:
The History Museum of Western Virginia is dedicating a new exhibit called Ships and
Shipmates of the Roanoke Valley, on May 12, 2000, with special guest United States
Senator John Warner. The Museum has requested that the City seek Sen. Warner's
assistance in the naming of a future ship after our city. Such a request, at this time, would
be an excellent opportunity to market a unique part of Roanoke's history in partnership
with the History Museum of Western Virginia. Roanoke is home to hundreds of Navy and
other veterans, and is close to the Salem Veterans Administration Medical Center.
Roanoke has always had a proud heritage of recognizing our military heroes and
promoting our great city around the world. Roanoke is a five-time Ali-America City and it is
appropriate that a fifth United States Navy vessel be named after Roanoke at this time.
Recommended Action(s):
Adopt the attached resolution requesting that United States Senator JOhn W. Warner
assiSt Roanoke in securing its name on a Navy ship.

BE IT ORDAINED by the Council of the City of Roanoke as follows:

§2-37. Office hours, work weeks and holiday-,
(f) Notwithstanding any provisions of this
section to the contrary, the city manager, the deputy city
manager, the assistant city managers, the city clerk, the
director of finance, the city attomey, the municipal auditor,
the director of real estate valuation end the city registrar
shall not accumulate any equivalent time off for hours
worked in addition to regular office hours; provided,
however, that any such offcer may be absent from his
office during regular office hours, without penalty, so long
as such absence does not interfere with the normal
operations of such office.
§2-45. Leave of absence for educational our=o-..~-,
(d) As many as two (2) employees of the city may
be granted or be on such educational leave at any one (1)
time. No employee shall be granted such leave unless, in
the opinion of the city manager, his duties and
responsibilities will be adequately performed and
assumed by other proper persons presently in the
employment of the city.
§2-54. Paid leave.
(g) Paid leave up to eighty (80) hours may be
advanced to an employee by the department manager,
with written concurrence of the appropriate assistant city
manager, council-appointed officer or elected officer.
Should an employee leave the service of the city prior to
accrual of paid leave hours sufficient to cover the
advance, the regular current rate of pay of the employee
will be deducted for each outstanding hour from the
employee's paycheck. Pay deduction for an employee
exempt from the Fair Labor Standards Act shall not have
hours advanced or repaid for less than a full workday.
§2-58. Definitions.
As used in this article, the following words and
terms shall have the meanings ascribed to them in this
section:

Department. The word "department" shall mean the
department of human resources.
Director. The word "director" shall mean the director of
the department of human resources.
§ 2-61.1.
City manager to promulgate grievance
;)rocedure.
(a) The city manager shall establish and
promulgate for employees of the city a grievance
procedure including the components and features set out
in §15.2-1507, Code of Virginia (1950), as amended, and
otherwise complying with such section. Each amendment
made to such grievance procedure by the city manager
shall comply with §15.2-1507. The department of human
resources shall provide employees with copies of the
applicable grievance procedure upon request.
(b) The grievance procedure promulgated
pursuant to this section, and each amendment thereto,
shall be certified in writing by the city manager and the
city attorney to be in compliance with §15.2-1507, and
such certification shall be filed with the clerk of the circuit
court for the city. A copy of the certification of such
grievance procedure and any amendment thereto, shall
thereafter be filed with the clerk of the circuit court.
§2-62. Establishment and composition of department of
human resources.
Pursuant to section 23 of the Charter, there is
hereby created a department of human resources which
shall consist of such divisions and personnel as may from
time to time be established by the city manager.
§2-63. Appointment and control of director of human
resources; director to serve free from restraint,
interference or coercion by other employees,
boards, etc.
A director of human resources shall be appointed
by the city manager and shall be subject to the control and
supervision of the city manager or the city manager's
designee. Once appointed, the director of human
resources shall perform the duties and responsibilities of
such position free from interference, restraint or coercion
by the council or any employee, board, committee or
commission of the city.
§2-64. General powers and duties of director of human
resources.
(a) . The director of human resources shall have
the immediate direction and control of the department,
subject to the specific directions relating to the director's
duties and responsibilities contained in this article and to
the general supervision of the city manager or the city
manager's designee.
(b) The director of human resources shall have
the following responsibilities and duties:
(2) To prepare a pay plan for each position in the
classified service of the city annually. Such plan shall be
prepared and submitted to the city manager on or before
January 15 each year, for consideration in the preparation
of the city manager's recommended annual budget for the
city council's consideration.
(7) To keep and maintain a current personnel file
on each employee of each department, board,
commission, office and agency of the city, excluding
employees of the school board, with each such
department, board, commission and agency to provide the
necessary current personnel information to the
department of human resources.
(15) To perform such other duties as may be
assigned by the city manager.
§2-67. Promotions in classified service.
Vacancies in higher positions in the classified
service shall be filled on the basis required to be
established pursuant to subsection (b)(10) of section 2-64
and shall be open to both members of the classified
service and applicants from the general labor market from
which the city draws its work force; provided, however,
with the written approval of the city manager a position in
the classified service may be restricted to applicants
already in classified service of the city. All standards
applicable to promotion shall be applied' by the director of
human resources in accordance with the rules
promulgated by the city manager, and at least the six (6)
best qualified candidates, if there be that many, shall be
certified to the appointing authority and all promotional
appointments shall be made from among the persons so
certified. A change from a position in any class to a
position in another class for which a higher maximum rate
of pay in prescribed shall be considered a promotion.
§2-68. Clas~.
The director of human resources shall, at least
biennially, review and prepare, after consultation with all
officials having the power of appointment, and submit to
the city manager a plan of classification and grading,
containing job descriptions for all positions in the

classified service according to similarity of authority,
duties and responsibilities. Within ninety (90) days after
the submission of the plan, the city manager shall rejector
approve the same, with or without modifications. Once
approved, the city manager shall cause the classification
plan to be published or otherwise distributed among the
employees of the city. Changes in the classification plan
may be recommended from time to time by any
appropriate city official and shall take effect after review
and recommendation by the director of human resources
and when approved by the city manager. The class fities
set forth in the most recently approved classification plan
shall be used to designate such positions in all official
records, documents, vouchers and communications, and
no person shall be appointed to or employed in s position
in the classified service under any class title which has
not been recommended by an appropriate city official and
established in the current classification plan.
§2-69. Pay plan.
(b) The director of human resources shall
prepare and recommend to the city manager, on or before
January 15th of each year, a pay plan for the city
manager's consideration in the preparation of his
recommended annual budget for the city council's
consideration. The council shall adopt the same by
ordinance, with or without modifications.
§2-87. Technical and clerical eeaistanc,,.
The director of human resources or the director's
duly designated agent shall serve as a liaison person to
the commission, providing such clerical and technical
assistance to the commission as it may from time to time
request.
§2-89. Kee oJ2 JDg~.fj:~.[~.
Th.e director of human resources ah.all be
responsible for the keeping of all records of meetings of
the commission and hearings of commission panels.
§14-t6. Placement for collection qenerally.
(d) Premium service. Any person who'is able to
carry garbage, refuse and trash to the locations described
in subsections (a} and (b} of this section, but wishes to
receive service from the street to a point of collection
approved by the city manager may apply for said service
with the division of solid waste management. The fee for
said application, as well as any monthly charges for such
service, shall be as set forth in the fee compendium as
approved and amended by the city council from time to
time.
(2} The premium service may be
discontinued by the person contracting for
such premium service only upon written
notice to the division of solid waste
management at least ten (10) calendar days
prior to discontinuance.
(e) Physical exemption service. Physical
exemption service shall consist of the city carrying all
garbage, refuse and trash generated by all persons
residing in a dwelling unit from a point of collection
approved by the city manager to the locations described
in subsections (a) and (b) in this section; Any person who
is physically unable to carry all garbage, refuse and trash
generated by all persons residing in a dwelling unit to the
locations described in subsections (a) and (b) of this
section may apply for physical exemption service.
(3) Any person receiving, physical
exemption service must notify the director of
the division of solid waste management
within thirty (30) days, if the person becomes
ineligible for physical exemption service at
the subject address due to improved health
of the person receiving physical exemption
service, relocation of the person receiving
personal exemption service, or any other
reason.

§17-1.
Local board of ~ocial services designated
The director of human services shall be, ex officio,
the local board of social services of the city.
§17-14. Definition.
As used in this article, the term "board" shall mean the advisory
board of human services created by this article.
§17-15. Created; composition.
There is hereby created the advisory board of
human services, consisting of nine (9) members, to advise
the director of human services.
§17-18.
Selection and term of chairman; designation
of secretary.
The board shall annually choose one of its members
to be chairman for a term of one year and until his
successor is chosen and qualifies. An employee of the city
shall be assigned by the city manager to act as secretary
of the board.
§17-20. Functions, I~owere and duties.
(a!. The board shall serve in an advisory capacity
to the d,rector of human services with respect to the
duties and functions imposed upon the director as the
local board of social services.
(3) To meet with the director of human services
at least four (4) times a year for the purpose of making
recommendations on policy matters concerning the
department of human services.
(4) To make an annual report to the city council,
concurrent with the budget presentation of the department
of human services, concerning the administration of the
public welfare program.
§20-12t. Removal of inoperative vehicles.
(a) An owner of any inoperative vehicle on any property
which is zoned or used for residential purposes, or any
property which is zoned for commercial or agricultural
purposes, or the owner of any such property upon which
such an inoperative vehicle is located, shall bring such
vehicle into compliance with the requirements of this
chapter within ten (t 0) calendar days of the date of notice
to the owner of such inoperative vehicle, and the owner of
the property upon which such inoperative vehicle is
located, that such vehicle is in violation of this article. The
notice shall !1) reasonably describe the subject
inoperative vehicle and reference this article; (2)state that
any owner of such inoperative vehicle or property on
which such inoperative vehicle is located may appeal the
city manager's decision that the vehicle is in violation of
this article by filing a notice of appeal with the city's
department of planning and code enforcement; (3) stats
that failure to comply with the requirements of this article
may result in the removal and disposal of the vehicle; and
(4) state that such removal and disposal may be at the
expense of the owner of such inoperative vehicle or the
owner of property upon which such vehicle is located.
§20-123. Appeals.
(a) Any person aggrieved by a decision of the city
manager in connection with the administration or
enforcement of this article may appeal such decision by
filing a written notice of appeal with the city's department
of planning and code enforcement within ten (10) calendar
days of such decision. Any such notice of appeal shall
state the following in writing:
(1) The .order, requirement, decision or
determination which is the subject of the
appeal;
(2) The data of the decision; and
(3) The reason(s) for the appeal.

(b) Upon receipt of an appeal by the city's department
of planning and code enforcement, the city manager shall
designate a person, or panel of persons consisting of an
odd number of persons, who did not participate in making
the determination under review to hear the appeal.
§24-24.
General responsibilities of director of civic
facilities.
Subject to the supervision and control of the city
manager, the director of civic facilities shall be
responsible for the operation and administration of all of
the functions of the civic center. The director shall be
responsible for the collection of all rents, fees, charges,
receipts, revenues and other funds accruing to the city
from the operation of the civic center, and for payment and
report thereof to the city treasurer and to the director of
finance as and in the manner provided in section 24-27.
§24-25. Fidelity bonds for certain personnel.
The director of civic facilities, the assistant director
of civic facilities, the box office manager and the head box
office cashier shall provide, and shall keep in effect at all
times in the office of the city clerk, fidelity bonds, written
by a surety company authorized to do business in the
state and approved as a surety by the director of finance,
payable to the city in penalties of not less than two
hundred fifty thousand dollars ($250,000.00) each,
conditioned upon faithful performance of their respective
duties under this article and faithful accounting for all
funds coming into their hands under this article, the form
of such bonds to be approved by the city attorney.
§24-26. Rates for use and terms,
(a) The Roanoke Civic Center Commission shall
establish from time to time a current schedule of fees,
rentals, rates, chargee, and terms to be required for use of
the civic center and, subject to such limits and guidelines
as the commission may impose, authorize the director of
civic facilities to vary the fees, rentals, rates, charges, and
terms in certain instances for events at the civic center,
including, without limitation, concerts, plays, sporting
events, circuses or ice shows.
(b) The director of civic facilities may negotiate
and execute contracts, licenses, or leases for the use of
the civic center for single or multiple date events, with the
approval of the city manager or his designee, that occur
during any period of time of lees than twelve (12) monthe.
Furthermore, the director of civic facilities may negotiate
and execute contracts, licenses, or leases for the use of
the civic center for multiple date events, with the
concurrence of the city manager or the city manager's
designee, that occur over a time period of twelve (12)
months or more, but less than sixty (60) months, with the
approval of the Roanoke Civic Center Commission.
(c) A cash deposit or certified check equal to
one-half of the rent shall be deposited with the city six (6)
months in advance of the event or with the return of the
contract, whichever is later. The balance of the rent shall
be paid upon completion of the event unless otherwise
agreed. In the case of a public ticket sale where monies
from ticket sales on deposit in the civic center box office
would equal or exceed the balance of the rent, this
requirement may be waived by the director of civic
facilities. In negotiating contracts for use of the civic
center, the director of civic facilities may, with the written
approval of the city manager and for good cause
appearing to the city manager, reduce, waive or enlarge
any of the requirements set forth in this subparagraph.
(d) Civic, religious and charitable organizations,
the incomes of which are exempt from taxation under Re
United States internal Revenue Code, may apply to the
director of civic facilities for a civic rate, as established by
the Roanoke Civic Center Commission, to conduct a
nonprofit activity at the civic center, where the proceeds
do not accrue to the benefit of an individual, business or
commercial entity. The director of civic facilities may
authorize the use of a civic rats, where such rats has been
established by the Roanoke Civic Center Commission.
§24-27. Special revolving bank checking account for
receipts.
(a) All cash, including all payments made by
check, received from the operation of the civic center,
except concession commission receipts, shall be caused
to be deposited by the director of civic facilities, intact, on
the banking day following the data of receipt, in a special
revolving bank checking account maintained in the name
of the City of Roanoke Civic Center in such bank in the city
as is designated in writing by the director of finance.
(b) Withdrawals from the bank checking account
provided for in this section shall be made by check signed
by any two (2) of the following: The director of civic
facilities, the assistant director of civic facilities, the box
office manager or the head box office cashier. Every
withdrawal from such account shall be supported by
written authorization from the director of civic facilities or
the assistant director of' civic facilities, on which
authorization is clearly stated tho purpose of the
withdrawal. No withdrawal shall be made from such
account for the payment of expenses for the direct
employment of personnel or employees. Withdrawal from
such account shall only be made for one (1) or more of the
following purposes:
§24-28
Refund of receipts from advance ticket sales.
(a) Notwithstanding any other, provision of this
article to the contrary, whenever it may appear, in the
judgment of the director of civic facilities or assistant
director of civic facilities, to be necessary and in the best
interests of the city, for the protection of public property
from probable imminent danger, immediate cash refunds,
from advance ticket sales receipts in the city's hands, may
be made to the holders of such tickets, upon certification
in writing of the facts making such immediate refund
necessary being made by the director of civic facilities or
assistant director of civic facilities to the city manager.
Such refunds shall be accomplished by withdrawal of
funds on hand or on deposit in the special account
provided for in section 24-27 by check signed by two (2) of
the following: The director of civic facilities, the assistant
director of civic facilities or the box office manager. Such
check shall be drawn payable to the order of the director
of civic facilities or the director's designated assistant,
both of whom shall be under bond, with corporate surety,
which bond, in all instances, must be equal to or in excess
of the face amount of any such check.
(b) In the event of any refund pursuant to this
section, the director of civic facilities shall make adequate
provision for the protection of cash funds from the time of
their withdrawal until their disbursement or return to the
special account provided for in section 24-27, and the
director shall make full and adequate report and
accounting of the use of such funds and of tickets
refunded upon such form of report as may be prescribed
by the director of finance.
§24-29.
Authority of director, assistant director and
box office manager to cash checks.
Notwithstanding any other provision of this Code to
the contrary, the director of civic facilities, assistant
director or box office manager shall be authorized to cash
checks on which the city is the payor and a person with
whom the city has a written agreement for the purpose of
presenting a show, play, concert, exhibition, performance,
sports event or other entertainment at the civic center is
the payee, when so requested by the payee during such
hours as the banks of the city are not open for the conduct
of business with the general public.
§24-30.
Record of and settlement of accounts for
rental events.
(a). A separate record for.each rental e.vent held
at the civ,c center shall be mainta,ned by the d~rector of
civic facilities, on which shall be shown each cash receipt,
each cash disbursement and the net balance attributable
to such event. The total of the net balances of all such
records shall, at all times, equal the cash in the bank
account referred to in section 24-27.
Sec. 24-3t. Citv-soonsored events.
(a) For the purpose of furthering the best
interssta of the public and to lead to greater use of the
civic center facilities, the director of civic facilities, with
the written approval of the city manager given in each
instance, is hereby authorized to arrange for or engage
shows, plays, exhibitions, performances and other
entertainments from which the city may derive income

and, in so doing, expend such city funds as ars
appropriated for the purpose of promotihg such activities
and bringing notice to the public of such activities; and
the director may, with the written approval of the city
manager, enter into written agrsemente on behalf of the
city engaging persons or firms to bring entertainment to
such facilities, and may cause to be paid to such persons,
in advance or out of proceeds to be derived from such
engagement, public funds expressly appropriated for that
purpose; and the director may, with the city manager's
written approval, guarantee to such persons minimum
sums to be payable by the city to such persons for future
performances; provided, however, that at no time shall the
aggregate amount of all such outstanding guarantees,
advance payments and other monetary obligations be
more than such sum as has been fixed by the council.
§24-90. Charges for private use of recreation
buildin.s or facilities.
(c) With the advice and prior written approval of
the city manager, the director of civic facilities, or the
director's designee, may negotiate and execute contracts
and amendments thereto, for the use of Victory Stadium,
so long as the fees for an event equal or exceed the city's
projected dirsct costs for the event.
§26-66. Penalty for violations.
(b) Alternatively or in addition to proceeding
under authority of subsection (a) of this section, the city
may provide that administrative civil fines be assessed
against any person who violates the provisions of this
article or any orders, rules, regulations, or permits issued
hereunder or pursuant to the city's enforcement response
plan. Such administrative civil fines may be in an amount
up to two thousand five hundred dollars ($2,500.00) per
violation per day, the amount to be set by the city
manager. Each day on which a violation occurs or
continues shall be deemed a separate and distinct
violation. The enforcement of such administrative civil
fines may be had through the courts ofthe Commonwealth
of Virginia in addition to any other legal means available
to the city. In addition to the administrative civil fines
provided for herein, the city may also recover reasonable
attorney's fees, court costa, court reporter's fees, expert
witness fees and other expenses of litigation by an
appropriate suit at law against any such person found to
have violated the provisions of this article or any orders,
rules, regulations, or permita issued hereunder or
pursuant to the city's enforcement response plan.
2. Section §17-2, Rules and re~lulations for operation of city home,
is hereby repealed.
3. In order to provide for the usual daily operation of the municipal
government, an emergency is deemed to exist, and this ordinance shall be in full
force and effect upon its passage.

Re: Appropriation of Roanoke Valley Detention Commission Operating Budgets
Dear Mayor Bowers and Members of Council:
The Roanoke Valley Detention Commission (the Commission) was established by the Cities of
Roanoke and Salem, and the Counties of Botetourt, Franklin and Roanoke. The Commission was
created to renovate and construct an addition to the existing City Detention Center to increase the
rated capacity to an eighty-one bed facility and to equip, maintain and operate the Center. City
Council appointed Glenn Radcliffe, Director of Human Development, and Jesse Hall, Deputy Director
of Finance as the City's representatives on the Commission.
The Commission agreed to purchase the Detention Center real property and equipment but to allow
the City of Roanoke to continue to administer and operate the facility until phase I, or 58 beds, of the
renovation is completed. The Director of Finance was appointed by City Council to serve as the
temporary fiscal agent for the Commission. Phase I of the facility is scheduled to open mid to late
May, 2000. The City will continue to be the fiscal agent and provide accounting, payroll, retirement,
and certain purchasing and personnel services for the Commission for an annual fee of $45,000. The
Commission is responsible for establishing a daily per diem rate for services provided to fund
operating expenses.
The Commission adopted an operating budget for the remainder of fiscal year 2000 and an operating
budget for fiscal year 2001, both of which are attached. These budgets and the per diem rate for
services provided are for City Council's information per the service agreement. Additionally, these
budgets need to be appropriated within the City's accounting system in order for the City to properly
administer accounting services.

March Financial Report
This financial report covers the first nine months of the 1999-00 fiscal year. The following narrative
discusses revenues and expenditures to date.
REVENUE
General Fund revenues reflect an increase of 6.76% or $7,157,000 compared to FY99. Variances in
specific categories of revenues are as follows:
General Property Taxes are up 5.69% or $2,122,000. Real estate taxes have increased $1,590,000 or
4.44%, reflecting the approximate rate of real estate assessment growth. Personal property taxes have
increased $409,000. The majority of personal property tax revenue is not received until the fourth
quarter of the fiscal year, however revenue received through the first nine months has risen due to
improved collections, aided by the increased portion funded by the Commonwealth. Penalties and
interest on delinquent taxes have increased 17.79% or $90,000, also reflecting the results of improved
collections during the current fiscal year.
Other Local Taxes increased 3.85% or $1,456,000. Prepared food and beverage tax revenue increased
$314,000 or 7.82% due, in part, to the addition of new restaurants in the Valley View area.
Telecommunications act right of way use fee, which became effective July 1, 1999, has produced
approximately $200,000 in additional revenue. Transient room tax revenue has increased $156,000
or 14.88% as a result of the 1% increase in the tax rate. Business, professional and occupational license
revenue is up 3.76% or $365,000.
Permits, Fees and Licenses are up 14.49% or $78,000. Building, electrical and heating inspection fees
continue to reflect increases resulting from commercial development and construction in FY00.
Revenue from Use of Money and Property is up 26.25% or $162,000. In July of FY00, the State was
billed for the amount that actual expenditures exceeded projected operating and maintenance costs for
the Commonwealth Building for FY99. This resulted in a significant increase in rental income.
Reimbursement received for the rental of the Municipal North Building by Social Services rose due to
an increase in the monthly rental fee.
Grants-in-Aid Commonwealth increased $3,355,000 or 13.62%. Law enforcement funding through
House Bill 599 increased $1,694,000. As part of the 1999 General Assembly, the Commonwealth
agreed to adjust funding to reflect the original provision of the bill, resulting in a significant increase
in funding expected in FY00. Rental car tax has increased 75.67% or $352,000 resulting from a timing
difference in the receipt of revenue. The addition of rental companies that include heavy truck rentals,
previously unavailable within the City, has also produced an increase in this revenue source. Revenue
received from the Commonwealth for the operation of the Sheriff's Department and the Jail has
increased by $220,000 or 5.74%, primarily to cover the increased personal service costs associated with

public safety employees in the Sheriffand Jail departments. The increased portion of personal property
tax revenue funded by the Commonwealth of Virginia has produced approximately $102,000 in
additional revenue in this category. CSA and VJCCCA revenues have increased by $288,000 and
$276,000, respectively, due to timing differences in the receipt of funding from the Commonwealth.
Miscellaneous Revenue decreased 29.59% or $54,000 as a result of a timing difference in the receipt
of Payments in lieu of taxes from the Roanoke Redevelopment and Housing Authority. Payment in
Lieu of Taxes was received from the Redevelopment and Housing Authority in February of FY99, but
has not yet been received in FY00.
EXPENDITURES AND ENCUMBRANCES
General fund expenditures and encumbrances have increased .31% or $421,000 since FY99. Variances
in individual expenditure categories generally increased less than 2.5% when compared to prior year
to date expenditures and encumbrances. Larger variances are discussed as follows:
Community Development expenditures increased 25.57% or $496,000. Economic Development
expenditures increased due to additional costs incurred for an 1-73 economic impact study. Savings in
personal service costs from vacant positions have been offset by increased temporary service and office
relocation costs. Memberships and Affiliations expenditures also rose as a result of the increased
contributions paid to Roanoke Valley Convention and Visitors Bureau and Roanoke Economic
Development Partnership, as well as the additions of contributions to Virginia Amateur Sports, Center
in the Square and New River Valley Commerce Park in the current fiscal year.
Transfer to Debt Service Fund decreased 7.16% or $743,000. Declining principal and interest
payments for the 1994 and 1997 bonds were required in the current fiscal year.
Transfer to School Fund increased 3.46% or $1,086,000, as a result of the combined effect of the
2.66% increase in budgeted transfer and the appropriation of $252,000 of the $1,015,000 in CMERP
funds allocated to the Schools.
Nondepartmental expenditures decreased $929,000, or 11.95%. Transfers to Capital Projects Fund
has decreased $959,000 or 25.61%. Funding for certain projects has been reallocated from Capital
Projects to Debt Service for the repayment of debt to be made later in the fiscal year. Increased revenue
from the Federal government to the Greater Roanoke Transit Company has resulted in the reduction of
the local subsidy provided by the City, and thus a decrease in the Transfer to Transportation Fund.

Backg rou nd:
Significant drainage problems have existed for many years along Murdock Creek, which is
located in the Greater Deyerle Neighborhood. This project will replace the undersized street
culverts on Clara Avenue and Knollwood Road and construct a storm drain system along
Deyerle Road near Valentine Avenue. This project also represents the downstream
improvements which will allow the future improvements on Chesterton Street where several
houses are routinely flooded.
The project was properly advertised and bids were read aloud by D. Darwin Roupe, Manager,
Office of Supply Management, on March 23, 2000, at 2:00 p.m. Four (4) bids were received
with Aaron J. Conner, General Contractor, Inc., 221 Kessler Mill Road, Salem, Virginia 24153,
submitting the lowest base bid in the amount of $609,301.90, with one hundred fifty (150)
consecutive calendar days for project completion. With the acceptance of Bid Alternate No.
2, for a $36,000.00 deduction, the base bid was reduced to $573,301.90 and is below the
design-to-budget allowance of $588,000.00.
Due to a revision to the original scope of work for additional drainage improvements on Clara
Avenue, approximately $29,000.00 for this additional work is included in the contract price of
$573,301.90.
The cost of this construction project will be $573,301.90 with a 10% contingency of
$57,000.00, for a total appropriation of $630,301.90. Funding is available in the following
accounts:

Background:
Amendment to Firefighter Memorial Contract
The City of Roanoke entered into contract on September 10, 1999, with a local artist,
Betty M. Branch, to create a significant work of art from bronze as a Firefighter
Memorial. The work is a one and one-quarter (1-1/4) life size sculpture to be delivered
to the Virginia Museum of Transportation. Under the contract, Article 5 (c) of the
contract limits production of the sculpture to one original statue.
Mrs. Branch has requested, with the employee Firefighter Memorial Committee's
approval, to expand this original language to permit a limited production of four (4)
statues. Expanding production on this basis will only enhance the value of the original
casting.
Considerations:
Change the current language in Article 5(c) of the contract to read: "The artist shall
ensure that the odginal sculpture mold will be utilized to cast no more than four (4)
statues. The odginal to be delivered to the City of Roanoke. Up to three additional
castings may be made by the Artist with agreement between the Artist and the City of
Roanoke's liaison."
Recommended Action:
Authorize the City Manager to execute the amendment of the existing contract, in
substantially the form set forth in the original document and as approved by the City
Attorney, with Betty M. Branch, to allow for three additional castings.

Background:
Proposed tract for rezoning to LM, Light Manufacturing District, comprises an area 10 acres,
more or less, in the Hollins Road neighborhood. First Amended Petition to Rezone was filed on
January 20, 2000, and contains the following proffer "The petitioner hereby proffers that the
Property will not be used for the following Permitted Uses: (a) outdoor advertising, (b) tow truck

Planning Commission public heating was held on Wednesday, March 15, 2000. There was no
one present who spoke in support of or in opposition to the requested rezoning.
Considerations:
Current zoning of the subject area is HM, Heavy Manufacturing District. Surrounding zoning is
a mixture of heavy manufacturing, light manufacturing and residential.
Land uses surrounding the subject area are mostly industrial buildings with some residential
uses.
The neighborhood organization in the area is the Hollins Road Civic League, which has been
notified of this rezoning request. No comments have been received.

The Comprehensive Plan recommends that:
Valuable industrial land should be conserved and used for industrial purposes.
New industrial development should be encouraged on appropriate sites.

be carefully planned and designed to promote quality development and good land
use.
Recommended Action:
By a vote of 7-0, the Planning Commission recommends that City Council approve the rezoning
request. Current zoning would change to LM, Light Manufacturing. Land use of the rezoned
property can be light industrial uses as provided for in the LM district. At present, the current
zoning is restricted to heavy industrial uses, which may be more objectionable to surrounding
uses. Neighborhood is separated from the subject properties by other properties zoned for
manufacturing use. The comprehensive plan would be followed.

(2) Pursuant to Section 36.1-690, Code of the City of Roanoke (1979), as amended,
Petitioner requests that the Property be rezoned from HM, Heavy Manufacturing District, to LM,
Light Manufacturing District, so that Petitioner may create and develop on the tract an industrial
park of light manufacturing uses.
(3) The Petitioner hereby proffers that the Property will not be used for the follo~g~x

parcel owned by RIA II, LLC and the official tax number of the parcel owned by Hollins Road
Warehousing, LLC (Exhibit "B").
WHEREFORE, Petitioner requests that the Property be rezoned from HM to LM in
accordance with the provisions of the Zoning Ordinance of the City of Roanoke.

AN ORDINANCE to amend §36.1-3, Code of the City of Roanoke (1979), as
amended, and Sheet No. 111, Sectional 1976 Zone Map, City of Roanoke, to rezone certain
property within the City, subject to certain conditions proffered by the applicant.
WHEREAS, James J. Walker, has made application to the Council of the City of
Roanoke to have the hereinafter described property rezoned from LM, Light Manufacturing
District, to C-2, General Commercial District, subject to certain conditions proffered by the
applicant; and
WHEREAS, the City Planning Commission, which after giving proper notice to all
concerned as required by §36.1-693, Code of the City of Roanoke (1979), as amended, and
after conducting a public hearing on the matter, has made its recommendation to Council;
and
WHEREAS, a public hearing was held by City Council on said application at its
meeting on April 17, 2000, after due and timely notice thereof as required by §36.1-693,
Code of the City of Roanoke (1979), as amended, at which hearing all parties in interest and
citizens were given an opportunity to be heard, both for and against the proposed rezoning;
and
WHEREAS, this Council, after considering the aforesaid application, the
recommendation made to the Council by the Planning Commission, the City's
Comprehensive Plan, and the matters presented at the public hearing, is of the opinion that
the hereinafter described property should be rezoned as herein provided.
THEREFORE, BE IT ORDAINED by the Council of the City of Roanoke that {}36.1-
3, Code of the City of Roanoke (1979), as amended, and Sheet No. 111 of the Sectional 1976
Zone Map, City of Roanoke, be amended in the following particular and no other:
Two adjoining tracts of land located at 1031 Patterson Avenue, S.W., and designated
on Sheet No. 111 of the Sectional 1976 Zone Map, City of Roanoke, as Official Tax Nos.
1112009 and 1112010, be, and are hereby rezoned from LM, Light Manufacturing District,
to C-2, General Commercial District, subject to the proffers contained in the First Amended

Dear Mayor and Members of Council:
Subject:
Request from James J. Walker, represented by Sam Garrison, attorney,
that properties located at 1031 Patterson Avenue, S.W., being Official Tax
Nos. 1112009 and 1112010, be rezoned from LM, Light Manufacturing
District, to C-2, General Commercial District, such rezoning to be subject
to certain conditions proffered by the petitioner.
Background:
The properties requested for rezoning are located on the northeast comer of the intersection of
Patterson Avenue S.W., and 11th Street S.W. A building formerly used for the sale of antique
furniture is located on tax parcel number 1112009 (see attached Map A).
The subject properties are located within a LM, Light Manufacturing District. Zoning of the
adjacent properties are: to the west, C-2, General Commercial District; to the north and south,
RM-2, Residential Multi-Family District; and to the east, LM, Light Manufacturing District. The
previous use of this property for retail sales, was a non-conforming use.
The applicant is requesting that the subject properties be rezoned from LM to C-2 in order to
allow for the future use of the property as a church or place of worship.
Planning Commission public hearing was held on Wednesday, March 15, 2000. Upon questions
by the Commission relative to potential use of the property for outdoor advertising purposes, Mr.
Garrison verbally agreed to submit an amended petition proffering that no outdoor advertising
would be allowed on the subject properties. Mr. Garrison subsequently filed an First Amended
Petition to rezone on March 16, 2000.
Considerations:
Comprehensive plan recommends that the City protect and retain industrially-zoned properties in
cases where such properties have a reasonable or significant potential for future industrial
development. In consideration of the mixed use character of the area surrounding the above-
described properties, however, the Department of Economic Development and Grants, does not

however, the Department of Economic Development and Grants, does not consider this property
to have a reasonable or significant potential for future industrial development.
Use of the property for the establishment of a church, will hopefully, improve the aesthetic
appearance of the property, and could possibly provide some additional stability in this mixed
use area.
If the properties are rezoned as requested, the applicant will automatically be required to obtain a
certificate of occupancy for a change of use on the property. In order to obtain this certificate of
occupancy the applicant will have to provide for any and all additional needs that may be
required for the new use, including off-street parking requirements.
Recommended Action:
By a vote of 7-0, the Planning Commission recommends that City Council approve the
applicant's request to rezone the described property from LM, Light Manufacturing District, to
C-2, General Commercial District, subject to certain conditions proffered by the petitioner.

plan is attached as Exhibit 1. A map of the area in which

Pursuant to § 36.1-690, Code of the City of Roanoke
(1979), as amended, the Petitioner requests that the said
property be rezoned from LM, Light Manufacturing, to C-2,
General Commercial District, for the purpose of a church with
adjoining parking.
The Petitioner believes the rezoning of the said
tracts of land will further the intent and purposes of the
City's Zoning Ordinance and its comprehensive plan, in that
the use of the property for church and parking purposes will
serve the overall needs of a mixed commercial/residential
neighborhood, there being other churches within a few blocks
nearby, and will increase the value of these tracts and of
adjacent land.
The Petitioner hereby proffers and agrees that, if
the aforesaid tracts are rezoned as requested, the rezoning
will be subject to, and the Petitioner will abide by, the
following condition:
That there be no outdoor advertising, as defined by
Roanoke City Code § 36.1-25, allowed on the premises.
Attached as Exhibit 2 are the names, addresses, and
tax numbers of the owner or owners of all lots or property
immediately adjacent to, or immediately across a street or
road from, the property to be rezoned.
WHEREFORE, the Petitioner requests that the above-
