The City Manager was directed to retain the services of a consultant, pursuant to the City's Procurement Code, to study the City's entire Carvin.q Cove Reservoir property and produce a comprehensive land use plan for such property with the objective of maximizing 6 recreational uses of the property while at the same time protecting the primary water supply for the citizens of Roanoke from any use that would adversely affect the quality or quantity of such water or the cost of producing potable drinking water, such study shall be funded by an appropriation from the Water Fund; and that the Members of Council be invited to provide input regarding the request for proposal File #405.468 7. MOTIONS AND MISCELLANEOUS BUSINESS: a. Inquiries and/or comments by the Mayor and Members of City Council. Council Member Trout inquired about the status of acquiring a new portable acoustical shell for the Auditorium at the Roanoke Civic Center; whereupon, the City Manager advised that the acoustical shell will be a priority in the next round of Capital Maintenance and Equipment Replacement Program funding, and, if approved by Council, the acoustical shell will be in place in time for the fall season of The Roanoke Symphony. File #192-261-270 Council Member Swain called attention to concerns expressed by certain residents of the City regarding the encroachment of infill housing in their neighborhood, which infill housing is not compatible with the overall character of the remainder of the neighborhood. He requested that the City Manager investigate this specific concern and, in addition, provide Council with a report on the seriousness of the issue, city-wide. Funding Analysis Roanoke County & Roanoke City In an effort to develop an equitable, sustainable funding source, the Roanoke Valley Convention and Visitors Bureau is proposing funding t~om the City and the County based on a four year average of lodging, meals and admission taxes. The funding level we are recommending is 8%. Funding at this level would provide a return of the "buying power" the Bureau has lost over the past four years with flat funding. It will solve the competitive funding issue for the Bureau in the short term - 1 to 2 years - but long term, increased funding will still need to be addressed. This will allow an extra year for phasing in the request, while still providing some additional buying power for Bureau programs. It should be noted that nearly 80% of any additional funding over current levels will go directly towards marketing. Cronin, Manager, Roanoke City Department of Personnel Management, presented a written report of the City Manager advising that the current one year dental insurance contract with Delta Dental Plan of Virginia will expire on December 31, 1997; the City of Roanoke has joined with other governmental entities in the Roanoke Valley to consider joint purchase of dental insurance; regional cooperation in the form of joint purchasing of dental insurance provides the City of Roanoke with an opportunity to improve the level of dental coverage for employees at a reasonable rats and receive a multi-year contract; and Slabaugh Morgan White ranked Delta Dental Plan of Virginia as the company most responsive to the request for proposals, and members representing each governmental entity concurred in the ranking. The City Manager recommended that Council authorize award of a contract for dental insurance to Delta Dental Plan of Virginia for a period of three years beginning January 1, 1998 and ending December 31, 2000, under the terms and conditions contained in the City's present contract with such firm, except as otherwise noted in the report, and that the City Manager be authorized to execute said contract in a form to approved by the City Attorney and with the understanding that Delta Dental Plan of Virginia will provide the City Manager with said contract for execution no later than December 15, 1997. Mr. Harris offered the following resolution: (#33636-102897) A RESOLUTION authorizing execution of a contract and related documents with Delta Dental Plan of Virginia to provide group dental insurance for employees of the city and members of their families. The Roanoke County Board of Supervisors adopted a motion to approve the proposed joint contract for dental insurance with Delta Dental Plan of Virginia. AIRPORT: Jacqueline L. Shuck, Executive Director, Roanoke Regional Airport, presented an update on air service for the Roanoke Valley. She advised that the Roanoke Regional Airport Commission commissioned a study to analyze the quality of air service development and to identify any air service opportunities that were missing. She stated that frequently, elected officials engage in discussions concerning the airport and air service; whereupon, she presented information which can be used to promote Roanoke's Airport. She advised that the Roanoke Valley has, in effect, a comprehensive, proactive, aggressive air service development program which involves extensive market research, various surveys including semi- annual passenger surveys, a ticket survey in which tickets are analyzed to determine which tickets are written for travel agencies, as well as airport destimations; and local evaluation of scheduling regarding the types of aircraft landing in Roanoke, available seats, and an ongoing evaluation of air fares. She called attention to an outreach program with the Economic Development departments of Roanoke City, Roanoke County and the New River Valley, along with the Roanoke Valley Convention & Visitors Bureau and hotels and motels which target cities with good air service and the kind of air fares that will lure conventions to the Roanoke Valley. She advised that airport officials enjoy a good relationship with travel agencies and encourage them to report any problems regarding air fares, and travel agencies are provided with useful statistical information. She stated that the Roanoke Valley has an extremely strong passenger base, which is predominantly business; and Roanoke's fares are high, but air fares are high throughout Virginia. (See Air Service Development Program Evaluation and Opportunities Assessment on file in the City Clerk's Office.) CONSULTANTS REPORTS-WATER RESOURCES-SEWERS AND STORM DRAINS: George W. Simpson, Assistant Director, Roanoke County Engineering and Inspections Department, presented an update on the Regional Storm Water Plan. He advised that the Plan, which is now completed, has been in progress since 1985, the Plan concentrates on 16 priority watersheds in the Roanoke Valley and covers approximately two-thirds of the entire valley, and the Plan goes a long way toward addressing flooding problems in the Roanoke Valley. He explained that the Roanoke County Board of Supervisors has been briefed on the plan, and a presentation will be made to Roanoke City Council on November 3, to Salem City Council on November 5, and to the Vinton Town Council on November 18. J. Greg Reed, Civil Engineer, Roanoke City Department of Engineering, advised that two regional detention basins are proposed in the regional study, and it was determined by the consultant that the detention basins are well located and will provide positive benefits. He explained that one detention basin will be located in the Montclair neighborhood and the other will be located in the North Lakes neighborhood, both in Roanoke County, which will provide benefits to those specific neighborhoods, as well as downstream in the City of Roanoke, thus creating regional benefits to both Roanoke County and Roanoke City. He advised that assuming all of the necessary permits can be obtained, it is proposed to move forward with construction of the detention basins in approximately early 1998, and total cost for implementation of the regional plan for identified projects is $61 million, plus any costs associated with floodproofing. PARKS AND RECREATION: Elmer C. Hodge, Roanoke County Administrator, advised that Roanoke County has been successful in operating a County Recreation Center on Brambleton Avenue, which is the combination of a teen center and a senior citizen center. He stated that at the last joint meeting, an inquiry was made if it would be feasible to operate a similar center in downtown Roanoke in the City Market area, and City Council and the Board of Supervisors requested that the two administrations review the matter. Mr. Hodge advised that approximately $15,000.00 was spent for equipment and minor renovations to the current teen center; current membership is approximately 300; in 1995-96, there were 5,069 attended events and in 1996-97, there were 4,311 attended events (does not include attendance at periodic special events and Battle of the Bands); the annual budget is $87,000.00 which covers a staff of four persons and minor expenses, and this cost is offset by annual membership dues of $12.00 and $4,000.00 received from special events, 50 per cent of gross revenues are derived from arcade games and 16 per cent from vending machine sales. Mr. Hodge explained that it is estimated if a teen center is located in the City Market area of downtown Roanoke, costs would be similar for renovations and other operating expenses; however, rent and utilities would be an additional factor to consider, as well as additional staff, depending upon the hours of operation. He explained that the Brambleton Teen Center caters primarily to middle school teens, while a teen center in downtown Roanoke might appeal to older teens. Mr. Hodge advised that if the Board of Supervisors and City Council are interested in a regional project of this nature which would be funded by both localities, itl~.~mltended that a needs assessment be conducted by the Roanoke City and R~COunty Parks and Recreation Departments to ascertain whether there is s~ntereet from young people in the Roanoke area to move forward and, if so, to detmmirm the best location for another teen center. It was the consensus of both governing bodies that a report will be submittmJ at the next joint meeting. WATER RESOURCES-SEWERS AND STORM DRAINS: Kit B. Kiser, Director, Roanoke City Utilities and Operations, advised that Roanoke City and Roanoke County have worked together for a number of years on water/sewer contractual matters; and Roanoke County has been responsible for a large amount of water line construction. He further advised that the City has continued its water plant expansion and water line extension projects, and the City of Roanoke, along with the City of Salem, Town of Vinton and Botetourt County, are partners in a massive sewage treatment plant and sewer interceptor expansion program; and a contract has been awarded for work on the Tinker Creek Sewer Interceptor and for expansion of the Sewage Treatment Plant to increase treatment capacity from 42 to 62 million gallons per day. He noted that the Roanoke River Interceptor Sewer Project is under contract, and the City has until January 1998 to make a decision on whether to proceed with the other portion or to redesign the project. LOW BAND RADIO SYSTEM: Mr. Hodge advised that at the July 23 joint meeting, there was discussion regarding installation of a Iow band tourist radio system on the Blue Ridge Parkway. He explained that no Federal funding is available for installation of the system, however, the State will participate if the radio system is installed on Interstate 81; if the system is installed on the Blue Ridge Parkway, participating local governments will have to fund the entire cost; and the Virginia Department of Transportation has estimated costs of installation in the range of $50,000.00 and $90,000.00, with annual maintenance costs estimated to be approximately $10,000.00. He explained that Blue Ridge Parkway officials philosophically support installation of a Iow band radio system on the Blue Ridge Parkway; however, the National Park Service has regulations which limit the use of the system to public information and no commercial advertising. Chairman Johnson advised that the majority of the Roanoke County Board of Supervisors stands ready to proceed with the project on the Blue Ridge Parkway. Vice-Mayor Wyatt advised that the Mayor has expressed support of the project; however, she was unsure as to the position of the other members of City Council. INDUSTRIES-LEGISLATION-FIFTH PLANNING DISTRICT COMMISSION: Lee B. Eddy, Member, Roanoke County Board of Supervisors, advised that he represented Wayne G. Strickland, Executive Director, Fifth Planning District Commission, who couldnot attend the meeting. He presented copy of the Regional Industrial Facilities Ac__[t of 1997, which allows those localities in the Fiftl~ -Plante Fourth Planning District, plus the Counties of Bland, Wythe, and Franklin, to enter into agreements for revenue sharing based upon industrial parks without having to go to referendum. He explained that the Act allows any three or more localities in the region to form an Authority to develop and operate a regional industrial facility which could be occupied by manufacturing, warehouse distribution, office or other commercial enterprise. He further explained that the Authority would be composed of two members appointed by each of the participating governing bodies, the Authority would be a political subdivision of the Commonwealth of Virginia with full fiscal authority, including the authority to issue tax exempt bonds, and member localities would have to agree to a plan for sharing revenues without the need for a referendum. He inquired if there is sufficient interest to approach the Fifth Planning District Commission and the New River Planning District Commission to initiate special information sessions. Following a brief discussion, it was the consensus that Mr. Strickland should proceed with planning for special information sessions. HOUSING/AUTHORITY-TOTAL ACTION AGAINST POVERTY: Chairman Johnson advised that at its regular meeting on October 28, the Roanoke County Board of Supervisors will consider a request of Lowe's, Incorporated, to rezone property on Route 220 South; and if successful, the County of Roanoke will, on its own behalf, contribute $1 million to the Total Action Against Poverty Blue Ridge Independent Living Center to be used for affordable housing which, when fully leveraged, should create a pool of approximately $3 million. Vice-Mayor Wyatt commended Roanoke City and Roanoke County for conducting meetings because the spirit of cooperation that exists has benefited the citizens of both localities. GREENWAY SYSTEM: As Chair of the Roanoke Valley Commission, Mr. Eddy expressed appreciation to Roanoke City approving the 1-581 pedestrian and bikeway connection. A ~remendous amount of construction work is underway at the park. The completion of this construction will dramatically change the perception of the park to the citizens on the Roanoke Valley and the Blue Ridge Parkway traveler. Please mark your calendars for Wednesday, May 6t~ as the dedication date for the Roanoke River Parkway and thc Arthur Taubman Welcome Center. With the opening of the Welcome Center, Explore will move to a seven day a week schedule. I would like to show you a short presentation that illustrates progress that has been made at the park over the last year. I also would like to shar~ with you a copy of our legislative report given to all members of the Oeneral Assembly last week. This report details the pressing needs the park has for capital infi-as funding. Situated in western Virginia offthe Blue Ridge Parkway, Explore Park's 1,100 acres include a historic area covering three periods in western Virginia history and environmental areas featuring scenic trails along the Roanoke River gorge and a wide variety of natural flora and fauna. The Park site was selected because of its convenient location adjacent to the Blue Ridge Parkway and its close proximity to the heavily traveled I-81 corridor. Grisso, Director of Finance December Financial Report This financial report covers the first six months of the 1997-98 fiscal year. The following narrative discusses revenues and expenditures to date. General Fund revenues reflect an increase of 4.63% or $2,496,000 compared to FY97. Variances in specific categories of revenues are as follows: General Property Taxes increased 3.74% or $792,000. Real estate tax revenue rose 2.2% from FY97. Collections through December total $21,267,000 or 52.09% of the estimate for the year. Public services Corporation taxes also rose slightly. Other Local Taxes rose 3.40% or $547,000 resulting from increases in sales tax revenue and electric service utility taxes. E911 telephone surcharge revenue, cable television franchise taxes, and prepared food and beverage taxes also increased. BPOL taxes were down through December, however the majority of this revenue is received in the spring. Revenue from Use of Money and Property is up $173,000 or 36.73% due to growth in interest revenue resulting from higher average daily cash balances in the General Fund. Grants-in-Aid Commonwealth increased 6.09% or $763,000 due to a timing difference in the receipt of Jail Block Grant revenue and an increase in Virginia Juvenile Community Crime Control Act revenue. Revenue from shared expenses has grown due to increased reimbursements for the Sheriffs Department. These are partially offset by a decrease in Comprehensive Services Act revenues through December. Grants-in-Aid Federal Government decreased $9,000 or 35.29% due to a timing difference in the receipt of FEMA revenue. Charges for Services are up $86,000 or 5.03% due to increased billings for EMS services and weed cutting and demolitions. These increases are partially offset by a decline in bulk garbage collections. Miscellaneous Revenue has decreased $23,000 or 16.44% due to a decline in proceeds from the sale of surplus property. Internal Services rose $181,000 or 20.58% due to a billing of $134,000 by Occupational Health Services to the Risk Management Fund to help fund the operation of the employee health clinic. FY98 is the first year for such billings. Engineering billings also increased, while billings by Street Maintenance and Building Maintenance declined. Honorable Mayor and Members Roanoke City Council February 2, 1998 Page 2 EXPENDITURES AND ENCUMBRANCES Expenditures and encumbrances in the General Fund have increased 4.62% or $3,743,000 since FY97. Variances in individual expenditure categories are discussed as follows: Judicial Administration expenditures rose 13.34% or $257,000. Personal services costs in the Sheriff and Commonwealth Attorney's department increased. The Clerk of Circuit Court expenditures are up due to the purchase of various office equipment and increased binding expenses in FY98. Law library expenditures also increased slightly. Public Safety expenditures increased $1,059,000 or 5.83%. Personal service costs and fleet management charges in the Fire Department rose. Jail expenditures are up due to a rise in personal service costs and the purchase of vehicles and computer equipment. The increase in Jail expenditures is partially offset by an increase in reimbursements. Juvenile Detention Home expenditures rose due to the purchase of security equipment and a decrease in reimbursements received from other localities. Public Works expenditures are up $1,003,000 or 7.90% largely due to the purchase of approximately 36,000 automated refuse containers by the Solid Waste Management department. A slight decrease in bridge inspection expenditures within the Engineering Department is offset by an increase in Paving Program expenditures. Streets and Traffic and Snow Removal costs also decreased slightly. Community Development expenditures decreased $124,000 or 8.58% due to a timing difference. In November of FY97, the City made a contribution of $175,000 to the Hotel Roanoke Conference Center Commission, matching a contribution of the same by Virginia Tech. A matching contribution of $131,250 was paid in January of FY98 with another $43,750 to be paid later in the spring. The decrease caused by these timing differences is partially offset by an increase in Community Planning expenditures. Transfer to Debt Service decreased $750,000 or 11.07%. The Series A-7 Jail Facility Bonds and Series A-8 Public School Improvement Bonds matured in August 1996. Therefore, transfers to Debt Service were not required for these issues in the current year, causing the category to decline. For the year, transfers will total $9,510,800, an increase of $200,000 from FY97. Nondepartmental expenditures rose $1,589,000 or 41.37% due to increases in transfers to the Fleet Management, Capital Projects and Grant Funds which are partially offset by a decrease in transfers to the Nursing Home Fund. The increase in transfers to Fleet Management is due to the appropriation of $457,000 of CMERP for vehicular equipment. The increase in transfers to Capital Projects is the result of an appropriation of $1,272,000 for the regional radio project. In FY97, a transfer of $545,000 was made to the Nursing Home Fund. No transfer to this fund will be made in FY98. I would be pleased to answer any questions which City Council may have regarding the monthly financial statements. The provision of a humidification system will preserve the library's collection of books and other documents, and also improve the level of comfort for staff and patrons. Office of City Engineer retained consulting engineer, Lawrence Perry & Associates, Inc. (LPA), 30 West Church Avenue, Roanoke, Virginia 24011, in May 1993 to provide design, bid assistance and construction administration services to analyze and make recommendations to upgrade existing HVAC system. Funding for HVAC/humidification project was set aside under a prior year Capital Maintenance and Equipment Replacement Program (CMERP). (A total of $127,300.00 was allocated for this project.) II. Current Situation: A. Invitation to bid for "HVAC -- Upgrade" proiect was advertised in Roanoke Times on November 23, 1997 and in Roanoke Tribune on November 26, 1997. The scope of work for the proiect consists of the installation of electric humidifiers that will produce steam for humidification, and hot-water duct coils (reheat) to handle dehumidification. Pneumatic-type humidistats will be provided in various locations throughout the building to actually control the humidification levels. Coils and pans of existing air-handling units will be cleaned along with the ceiling diffusers. Lastly, a general air-balancing of HVAC systems will be performed to bring air flow in all areas/spaces back to the levels originally designed and specified for the systems. Now there appears to be questions about the use of Carvins Cove, and we are of the opinion that although there is a great need to maintain the Cove in its natural state and to protect our very precious water source for the city, there is an increasing interest for public use as well. In order that the city might explore the best watershed land use plan and complementary public use, resulting in careful protection of this valuable natural resource, we would like to propose that City Council appoint a seven member advisory panel of city citizens. In the spirit of participatory democracy, as envisioned in our vision statement, the citizen committee would study the appropriate and careful protection of the Carvins Cove watershed. In conjunction with this, we would respectfully also ask that the City Manager be directed to assist the committee with internal or external studies, and provide the committee with needed access to information regarding watershed protection and recreation opportunities. The administration should work hand in hand with this citizens committee to provide our citizens with all the information necessary to reach an agreement on a satisfactory future master watershed use plan. BE IT ORDAINED by the Council of the City of Roanoke that: 1. The Code of the City of Roanoke (1979), as amended, is hereby amended and reordained by amending the following section: §20-89. Penalties for unlawful parking. Co) PKFINES Every person receiving written notice from a police officer that he has violated any of the sections of the preceding two (2) divisions of this chapter may waive his right to appear and be formally tried for the violation set forth in the notice upon the voluntary payment, as penalty and in full satisfaction of such violation, of the penalty set forth below. Such penalty shall be paid to the city treasurer during the regular working hours of his office or through any other method established by city council for the routine payment of such penalties. For purposes of this subsection, penalties shall be deemed to have been "paid" when full payment therefor has been received by the city treasurer, regardless of whether such penalty is paid in person or is mailed. The city treasurer shall not be authorized to accept partial payment of penalties due. Penalties for parking violations shall be as follows: (1) A penalty often dollars ($10.00) may be paid for a violation of sections 20-65 (except subsections (4) and (15) thereof), 20-66, 20-67, 20-68, 20-69, 20-70, 20- 71, 20-72, 20-73, 20-75, 20-79, 20-80, or 20-81, if paid within ten (10) days of the issuance by an officer (2) (3) (4) of a notice of a violation thereof, if paid thereafter, the penalty shall be twenty dollars ($20.00). If not paid within ten (10) days, a notice pursuant to section 46.2- 941, Code of Virginia, shall be sent by the city's office of billings and collections to the violator. Any violator to whom such notice is sent may pay such penalty of twenty dollars ($20.00) within five (5) days of receipt of such notice. A penalty of twenty dollars ($20.00) may be paid for a violation of section 20-65(4), and a penalty of fifty dollars ($50.00) may be paid for a violation of section 20-74, if paid within ten (10) days of the issuance by an officer of a notice of a violation thereof; if paid thereafter, the penalty for a violation of section 20- 65(4) shall be thirty dollars ($30.00), and the penalty for a violation of section 20-74 shall be sixty dollars ($60.00). If not paid within ten (10) days, a notice pursuant to section.46.2-941, Code of Virginia, shall be sent by the city's office of billings and collections to the violator. Any violator to whom such notice is sent may pay such penalty of thirty dollars ($30.00) for the violation of section 20-65(4) or the penalty of sixty dollars ($60.00) for violation of section 20-74, as the case may be, within five (5) days of receipt of such notice. A penalty of one hundred dollars ($100.00) may be paid for a violation of section 20-69(m), if paid within ten (10) days of the issue by an officer ora notice ora violation thereof, if paid thereafter, the penalty shall be one hundred ten dollars ($110.00). If not paid within ten (10) days, a notice pursuant to section 46.2-941, Code of Virginia, shall be sent by the city's office of billings and collections to the violator. BACKGROUND Ao Do E° Fo Cit~ Council reviewed and revised parking ticket fines in 1981. Citizens' perception is that there is no free parking downtown. Total on-street parking spaces in downtown Roanoke is 1,187 (see Attachment 1 and 1 a.) Four Hundred Twenty-two (422) of these spaces are restricted use or in no parking zones. Available on-street parking spaces in downtown Roanoke during normal business hours is 765.. Turnover of these spaces is limited due to the low parking ticket fine, contributing to fewer customers and lower sales for downtown businesses. Parking tickets were issued for 34,454 infractions of parking regulations during calendar year 1996 in the downtown area. Fifty-nine percent (59%) of these tickets were for overtime parking and meter violations. Ci_ty of Roanoke and Downtown Roanoke, Inc.'s interest in parking control is to ensure: Adequate road space for the safe and expeditious movement of vehicular traffic; and Fair and equitable rotation of on-street parking spaces. CURRENT SITUATION mo The cun'ent fine of $5.00 for overtime parking and meter violations is the lowest among certain Virginia localities surveyed (see Attachment 2). It does not deter parking violations because an occasional ticket may be more cost effective than monthly parking rates. Virginia Code 46.2-1242 requires a minimum $100.00 fine for handicapped violation. The city's current fine for handicapped violation is $50.00. Co Seven Hundred (700) monthly parking spaces are now available in downtown, consisting of 600 in parking structures and 100 on surface lots. Economic value of each parking space for downtown Roanoke businesses, per Downtown Roanoke, Inc., is estimated to be $200.00 per day, per space (see Attachment 3). Eo Downtown Roanoke, Inc. supports a fine increase for reasons of deterrence and space rotation (see Attachment 4). Virginia Western Community College supports a fine increase. Current fines do not deter repeat violators (see Attachment 5 and 5a). Roanoke City Fire Department supports a fine increase for fire hydrant parking violations for reasons of safety and to ensure that hydrants are accessible. ISSUES A. Deterrence to violators B. ALTERNATIVES Increase certain parking ticket fines as set forth in Section 20-89, City Code, (Attachment 6 shows the proposed increases of these fines on current city parking ticket.) Increased fines will be a deterrent to repeat violators and address the problematic issues raised by Downtown Roanoke, Inc. and Virginia Western Community College. Movement and safe _ty will be enhanced by the deterrent effect of larger fines. o An increase will bring Roanoke City's parking fine structure in line with Virginia jurisdictions. 4. The economic value to downtown Roanoke businesses will be enhanced. o Legal concerns would require an amendment to Section 20-89, City Code, as to fine structure. Raising the handicapped violation fine would Comply with the Virginia Code requirement. 6. Budgetary_ impact If the increase in fines acts as a deterrent as anticipated, an increase in revenue would be marginal. Do not increase parking fines. 1. Repeat violators will not be deterred. 2. Equitable and efficient use of on-street spaces will not be enhanced. 3. Roanoke Ci_ty will continue with the lowest fine structure in the area. 4. The economic value of spaces downtown will not be enhanced. Compliance with State would need to be addressed (re: Disabled Parking) in some other fashion. 6. There will be no impact on revenue. Dear Chip: Thank you for your recent inquiry regarding DRI's position on the proposal by the City of Roanoke to increase parking fines as a deterrent to the habitual abuse of on-street parking resources by certain downtown employees. Our organization realizes that turnover of on-street parking is essential for the survival of many downtown businesses and that there is a large surplus of off -street parking available to meet the needs of downtown employees. Based on these factors, the DRI Executive Committee resolved at their. April meeting to support the proposal to increase parking fines to $10.00 from the current $5.00 in order to discourage abuse of on-street parking and to encourage downtown employees to use the many long term parking facilities that are available in downtown Roanoke. We feel that the current $5.00 fine is at most an inconvenience since it parallels the daily rates charged in downtown parking lots and garages. We appreciate thc fact that the City of Roanoke is holding rates constant in its off-street parking facilities and ask that the City review the possibility of decreasing such long-term parking rates as an incentive to encourage downtown employees to park off-street and to assist with our efforts to recruit new businesses to the area. We also appreciate the efforts by the City to help us develop a parking incentive program to help foster increased residential development in the downtown area. The $5.00 fine has proven an insufficient deterrent for overtime parking. Students often park in 30 minute visitor spaces, risking the fine for sake of convenience. Efforts to correct such violations through stricter enforcement have proven unsuccessful. This has been a particular problem in the visitors parking lot serving admissions and related functions at Fishburn Hall. Overtime violations have hampered the intended purpose of visitors parking, to provide short term parking for visitors to obtain information about the college, get directions, etc.. Such violations are counter-productive to the operations of the college since they make it more difficult for potential students to make inquires or enroll. We respectfully request that you petition City Council on our behalf to raise the current fine for overtime parking at our college from $5.00 to $10.00. This would entail adding another fine category, with fines for the handicapped and "other" categories remaining at current levels. If approved by Council, we understand that implementation could not occur until after new tickets, reflecting the change, are printed in the fall. Do Petition to amend 1995 proffered conditions was filed on 11/6/97. Purpose of the request is to permit the property owner to develop the Peters Creek Road frontage for a mobile home sales lot, as an interim use. (This use is interpreted by the Zoning Administrator to be automobile related because of the trailer assembly and therefore, not permitted according to the conditions which prohibit the sale of automobiles, trucks, and construction equipment.) In addition, the petitioner desires to remove previously proffered conditions that no longer apply to the property. First Planning Commission public hearing was held on 12/3/97. There was no one present in opposition to the request. An Amended Petition to Rezone was filed on 12/2/97 prior to the meeting. Planning staff advised that keeping the condition for the frontage road remained an issue and that additional legal language questions needed to be resolved for some of the other proffered conditions. The matter was deferred for action until the Commission's January meeting. Mrs. Duerk requested that staff determine whether a deceleration lane was needed for Peters Creek Road. Go Second Planning Commission public hearing was held on 1/7/98. First Revised Petition was filed on 12/23/97 to address outstanding issues. It was noted that no deceleration lane would be required for Peters Creek Road for the proposed use of the property. Discussion at the Commission meeting included a concern for the storage of mobile homes or vehicles for sale within the front landscaped setback area. Mr. Helscher verbally proffered that he would honor the 25-foot setback shown on the concept plan. There was no one in opposition to the request. Planning Commission voted 4-1 to recommend approval of the rezoning request (Messrs. Chrisman, Rife Manetta and Butler voting for the request and Mrs. Duerk voting in opposition). II. Current Situation: Second Revised Petition to Rezone was filed on January 13, 1998. In order to deal with the increased traffic which will be generated by the retail and commercial use of the property, Petitioner agrees to reserve a thirty-foot wide area across the front of the property, parallel to Peters Creek Road, for a frontage access road which may be dedicated in the future in the event the City and/or VDOT elects to go forward with construction. Issues: Petitioner shall erect no structure above ground within the twenty-five (25) foot front yard setback along Peters Creek Road shown on the attached site plan (Exhibit B) dated December 19, 1997, from T. P. Parker and Son for Southern Showcase Homes, and shall not use this area for display, parking or storage of mobile homes or other goods or merchandise for sale. Bo Co Do Eo Fo Zoning is currently conditional C-2 and C-1. The frontage along Peters Creek Road is zoned C-2 for an approximate depth of 250 feet. The remaining approximately 750 feet depth is zoned C-1. Land use of the property is currently vacant. Surrounding land uses include a mixture of commercial development and vacant land. Access to the subject property is proposed from Peters Creek Road. Based upon the proposed traffic expected for the development, no changes in the deceleration lane for Peters Creek Road are expected at this time. The development is ultimately to be coordinated with the Brammer Village Complex which has access to a median cut. A 30-foot strip of land is reserved for a future frontage road that could extend across the frontage of several commercial properties along Peters Creek Road in order to tie into the traffic signal at North Lakes Drive. Storm water management in the Peters Creek watershed is an issue. The Roanoke Valley Regional Storm Water Management Plan completed in October, 1997, recognized flood events ranging in occurrence intervals from 2-year to 100 year frequencies. Most of the Peters Creek flooding problems occur generally downstream of Cove Road and two regional storm water detention basins are recommended to reduce the frequency of flooding. One of those detention basins is recommended across Peters Creek Road between Cove Road and the North Lakes subdivision. A comprehensive on site, storm water management plan for the Brammer Village Complex has been approved by the City which includes an underground detention chamber adjacent to Peters Creek Road. In order to deal with the increased traffic which will be generated by the retail and commercial use of the property, Petitioner agrees to reserve a thirty-foot wide area across the front of the property, parallel to Peters Creek Road, for a frontage access road which may be dedicated in the future in the event the City and/or VDOT elects to go forward with construction. Current situation is as follows: Purpose ofrezoning request is to place the residence and lot, comprising 0.13 acres more or less, into a zoning classification that is consistent with its original, intended use. To date, there have been several contracts but no sale has been completed because lending institutions will not finance the property since it is not properly zoned. The house is part of an existing residential neighborhood; it also is situated at the comer of a sizable tract of undeveloped land which is zoned LM. B. Mr. Charles Boone appeared before the commission and stated that the reason his client was requesting the rezoning from LM to RM-1 was so that a potential buyer of the home would be able to obtain financing from a lending institutions. Ms. Tam Roop, City Planner, presented the staff report. She said the property is part of an existing residential neighborhood. She said she had learned earlier in the week that there is a purchaser for the home at 2143 Byrd Avenue and that the purchaser's loan has been approved, contingent upon approval of this rezoning. Ms. Roop said that she had viewed subject property with the city's Economic Development Administrator and he had said that he could not object to the rezoning, given that the industrially zoned tract was not and would not be for sale in the foreseeable future. Ms. Roop said she had heard from two adjoining property owners who were seeking information and questioning the impact the rezoning might have on them. One property owner had no objection. The other owner was referred to staff in another city department for additional information. She said both she and other staffer had tried numerous time without success to reach this owner by phone prior to the Planning Commission's meeting. There were no questions from or discussion by the Planning Commission and no one from the audience appeared before the commission to speak on behalf of or in opposition to the rezoning request. II. Issues are as follows: mo Zoning of the subject property is LM, Light Manufacturing District. The surrounding zoning pattern in the area is as follows: to the north and west is RM-1, Residential Multifamily, Low-Density District; to the south and east is LM, Light Manufacturing District. Bo Land uses surrounding the subject property are as follows: to the north and west are residential uses, predominantly single-family homes; to the east are light manufacturing uses along and adjacent to Plantation Road; and to the west is undeveloped property. C° Industrial land in the city has been identified as a valuable economic asset which should be protected. Although part of an existing residential neighborhood, subject property stands at the edge of an undeveloped tract which could be appropriately developed for LM use. However, at this time, that tract is not for Members of Council Page 3 sale and there is no indication that development of it for light industrial purposes will occur in the foreseeable future. The city's Economic Development Administrator viewed subject property and concluded that, ideally, an incoming company or the city should purchase subject property in order to preserve the entire block for LM uses. Failing that, however, he said he could not object to the property being rezoned so that the owner can benefit from its sale. Neighborhood organization for this area is the Williamson Road Action Forum which was notified of the petition to rezone by letter, mailed November 21, 1997. No comments were received. Adjoining property owners were notified of the rezoning request in letters mailed November 24, 1997. Two property owners called staff as noted earlier in this report. E. Comprehensive Plan recommends that: 1. Neighborhood character be protected and preserved; 2. The high quality of strong and stable neighborhoods be maintained; and 3. New industrial development be encouraged on appropriate sites. III. Alternatives are as follows: A. City Council approve the rezoning request. Zoning would become RM-1, Residential Multifamily, Low Density District, and the continued use of the site as a residence would be ensured by putting subject property into conformity with the zoning district, thus enabling financing to be obtained by prospective buyer(s). 2. Land use would continue as a residence. 3. Industrially zoned land could be developed. 4. Neighborhood would remain unchanged. 5. Comprehensive plan issues, as set forth, would be followed. B.
